On today's BradCast: What you need to know about the stolen national security documents retrieved by the FBI at Mar-a-Lago and the trouble Trump is in. And, about the known results of the strange-world-we-now-live-in primaries and special elections yesterday. [Audio link to full show is posted below this summary.]

First up, those elections, as based on incomplete and/or unverified results in both states.

The biggest story of last night, of course, was conservative Republican Rep. Liz Cheney's loss to a Trump-backed GOP primary challenger in Wyoming for the state's single, at-large House seat. As expected, Cheney lost bigly to former Never Trumper turned MAGA 2020 election denier Harriet Hageman. What does it all mean going forward for Republicans who wrongly hate Cheney and Democrats who wrongly love her and for the Republican Party itself? Cheney offered some hints, as we discuss, in her graceful concession speech on Tuesday night, promising once again that she "will do whatever it takes to ensure that Donald Trump is never again anywhere near the Oval Office."

Then, incomplete results from Alaska, where it has always taken a long time to tally them and will take even longer following election reform adopted by state voters in 2020. They now have an open primary system, where the top four vote-getters go on to general elections which become Ranked Choice Voting (RCV) contests among those candidates.

Like Wyoming, Alaska has just one at-large U.S. House district. But there were two elections for it on Tuesday following the death, earlier this year, of Republican Rep. Don Young. He held the seat for 49 years. One was a Special Election to fill the remainder of Young's term through the end of the year, the other was an open primary for a full term beginning in January.

On the Special, Democratic candidate Mary Peltola currently leads Republicans Sarah Palin (yes, that Sarah Palin) and Nick Begich with about 70% of votes tallied as of airtime. However, because it's an RCV election --- in which none of the candidates received more than 50% of first choice votes --- once the first round of counting is complete, the candidate in last place will be removed and their voters' second place choices will be redistributed to the other two candidates. The entire race is then tallied again. We are unlikely to know the final winner until the end of August, but if Peltola wins, she'd be the first Alaskan native to be elected to Congress.

In the open primary for the full House term beginning next year --- featuring nearly 30 candidates --- it appears that all three of the candidates in the Special will also advance to November's general election. The fourth candidate in that contest has yet to be determined as counting continues. In the state's U.S. Senate race, Republican Lisa Murkowski --- who, like Liz Cheney, voted against Trump in his second impeachment --- will advance to the November general, where she will face Trump-backed Kelly Tshibaka and two other candidates still to be determined, with just over 70% tallied.

Then, longtime, really smart, independent national security journalist MARCY WHEELER of Emptywheel returns to the show for the first time since the FBI's seizure of highly sensitive and classified national security documents at Mar-a-Lago last week, as stolen from the White House by Donald Trump upon leaving office last year.

As usual, we have a lot to cover with Wheeler, who was busy explaining on Twitter last week before anyone else that we know of --- before the unsealing of the FBI's search warrant detailing "probable cause" of three federal statutes violated by Trump --- that the Dept. of Justice was almost certainly investigating the former President for violations of the Espionage Act. As usual, after the warrant was unsealed, she was proven correct.

Also as usual when Marcy's on, you'll need to tune in for the full story. There is simply no way I can detail all of the critical insight and helpful information she has to offer here. But, among the points she helps clarify and explain along with key context from her years of covering similar cases dealing with the Espionage Act, obstruction of justice and the theft of government documents...

  • What each of the three U.S. Criminal Code statutes cited in the warrant means, and the evidence that Trump appears to have blatantly violated each of them.
  • Were there, or were there not, documents including nuclear records found and/or sought in the search, as reported by Washington Post before the warrant and inventory list of retrieved items was unsealed.
  • Are documents sought by the National Archives and DoJ still missing after the search? And/or have they been mutilated or destroyed in violation of federal statutes?
  • Despite a signed declaration by one of Trump's attorneys that all of the highly classified documents and other material stolen from the White House had been returned to the government as of June, in fact, that was proven untrue. Who is the insider that tipped off the DoJ?

Wheeler argues that Trump is likely far more concerned about obstruction charges than even violations of the Espionage Act. Why? "We know that some of the documents that were responsive to subpoenas regarded January 6," she tells me, before suggesting reason to believe that some of the documents Trump was trying to withhold might be related to other crimes of his from farther in the past, such as: obstruction of justice in the Robert Mueller/Russia investigation; his attempt to bribe the Ukrainian President ("We know that the White House counsel didn't provide Congress the fullest version of the 'Perfect Transcript' of the Trump call with Volodymyr Zelenskyy. So that's an example of concealing a document that should have been released."); or the transcript regarding the classified Israeli intelligence that Trump gave to the Russian ambassador during an Oval Office meeting ("the documents got altered and disappeared.")

She has much more, including this fresh tidbit regarding obstruction: "There was a leak by one of the rightwing journalists [covering this story] that said, 'People close to Donald say he doesn't have to give [certain documents] over because the Archives will just give it to the January 6 Committee.' I'm like, 'That's a confession of obstruction! He just literally confessed to the elements of the offense for obstruction!' And honestly, Brad, this is something that virtually everyone is missing --- this is the one that Trump is terrified of."

There are many details we still don't not know and more disturbing revelations to come. As Wheeler notes several times, this all likely to get much much worse for Trump. But, she emphasizes, just based on what we already know it's already really really bad for him.

"Every half hour or so," she says, "this flash goes through my brain, and I go, 'Oh my God, Donnie has really, really screwed himself .' There are ways that I can imagine this snowballing that people aren't even grasping at this point. And that is all separate from the question of whether he's taken the nuclear codes and given it to [Saudi Crown Prince] Mohammed bin Salman. You don't really need to get ahead of the game here to figure out things are pretty bad."

Guest: George Beebe of the Quincy Inst. for Responsible Statecraft...

While voters were at the polls for primary elections in six states (Arizona, Kansas, Ohio, Michigan, Missouri and Washington) on Tuesday, we take the moment to turn to foreign affairs for a hot minute on today's BradCast.

Happily, few problems were reported for voters at the polls in those six states --- at least that we could find so far today --- beyond another predictable failure of electronic poll books, this time across Mohave County, AZ, for about six hours when polls opened. More issues may reveal themselves before tomorrow, or thereafter, of course. Meanwhile, there are a whole bunch of far-right, Trump-backed, 2020 election deniers on the ballot today, with several running for critical offices such as Governor, Sec. of State and the U.S. Senate. All of which, if those candidates win on Tuesday and again this November, could cause very serious problems for democracy itself in 2024. We'll pick all of that up on tomorrow's show, with whatever noteworthy reported results may be available by then.

But today, we had the opportunity circle back to Russia's ongoing war with it's sovereign neighbor Ukraine, now entering it's sixth horrific month following Russia's invasion on February 24. If you follow most Western media, Ukraine's military is making valiant if deadly headway in pushing back at over-extended and exhausted Russian troops in the South, while Russia presses its offensive in the East.

If you follow Kremlin-controlled media, this is a war special military operation that can never be won by Ukraine, and continues to threaten expansion into a global conflict, including the use of nuclear weapons, as Russia takes great pains to note --- on an alarmingly regular basis.

But, it's not only Russian-controlled media suggesting the war is ultimately unwinnable for Ukraine. A number of foreign policy-centered Western media outlets and think-tanks have long argued similarly in a push for peace talks and a ceasefire in the now war-torn nation of Ukraine.

There was some good news this week, in that an agreement brokered by Turkey and the U.N. between the two warring nations last month has resulted in ships carrying Ukrainian grain finally able to leave port to deliver food around the world. Russian ships will also be allowed to do so through safe corridors established amid mined waters in the Black Sea. If the agreement holds, millions of tons of grain and other agricultural products will finally be able to flow from "the breadbasket of Europe" to help ease rising global food prices and the threat of hunger and political instability in developing nations.

The first ship to leave port on Monday was "loaded with two commodities in short supply: corn and hope," as U.N. Secretary-General Antonio Guterres described it. Beyond that, there is not much to be hopeful about in the protracted conflict.

Writing at The National Interest over the weekend, veteran foreign policy experts and former U.S. National Security officials Steven Simon and Jonathon Stevenson made the case for diplomacy. They called on the U.S. to help encourage a negotiated settlement by making clear to Ukraine that "Neither side can fulfill its maximal war aims" and they must find opportunities for peace talks and, if possible, a cessation of hostilities, despite Vladimir Putin's apparent disinclination to negotiate.

"It is well and good for the United States and its NATO allies to keep arming Ukraine. But it is also time to encourage both sides to start exploring possibilities for a political solution before escalation puts diplomacy even farther from reach," the pair conclude. "And unless the United States and NATO condition military assistance on Ukraine’s constructive political engagement, they will lack the leverage to work effectively towards a stable objective."

But is such a demand appropriate or even possible under the current conditions in the war torn nation? Isn't it up to Ukraine --- which has lost so much in blood, treasure and sovereign territory --- not the U.S. or NATO, to decide when and if Ukraine is ready to negotiate an end to the war?

Those are just some of the difficult and nuanced questions we discuss with our guest today, GEORGE BEEBE, Director of Grand Strategy (yes, I know, an ominous sounding title!) at the Quincy Institute for Responsible Statecraft, one of our go-to think-tanks for smart, no-nonsense foreign policy solutions.

Beebe's is the author of 2019's The Russia Trap: How Our Shadow War with Russia Could Spiral into Nuclear Catastrophe. He served over two decades in the U.S. government as an intelligence analyst, diplomat, and policy advisor, including as director of the CIA’s Russia analysis and as an advisor on Russia to Vice President Dick Cheney. (Yes, we discuss both of those ominous matters --- his work with the CIA and for Cheney --- as well!)

Among the questions and issues Beebe speaks to today: His concern that there is no real exit plan for our current strategy, not unlike the lack of a U.S. plan when we launched the Iraq War in 2003; Is it true that there is no way for Ukraine to "win" this war? That the only way is via diplomacy?; Should it be up to the U.S. and NATO, who are supplying much-needed armaments to help Ukraine defend itself, to decide when Ukraine should negotiate towards a settlement? Or should that remain Ukraine's sole decision?; Does Russia even have an interest in negotiations?; What should we learn from their repeated reminders that a continuation of the war could lead to a potentially nuclear expansion?; And, since it's actually a somewhat related matter, what does Beebe make of House Speaker Nancy Pelosi's controversial visit on Tuesday to Taiwan, and what effect is that likely to have on the Russia/Ukraine conflict?

"This is a very complex issue," Beebe tells me on the matter of the United States' own culpability in the matter. "Most foreign policy issues don't have single factor origins. They're usually the result of a confluence of different forces. What's happened in Russia's invasion of Ukraine is that it is the culmination of a series of developments, missteps on the part of a lot of different players over time, that all contributed to the situation that we're facing today."

"That doesn't excuse the Russians and it doesn't excuse Putin from making the choice to invade Ukraine. I think he is fully responsible for that choice, regardless of what preceded it. It didn't have to happen," he argues. But "Russia certainly has what I regard as understandable security concerns...That doesn't mean that the invasion was justified [or] that the manner in which this operation was carried out was at all justifiable."

"But I also would not say that Putin simply woke up in February and said, 'Hey, I would like to invade Ukraine.' There was a lot that went into shaping that decision, and I think a lot of blame on both the Russian and the Western sides."

As you can tell, there is much to discuss and try to make sense of with the Director of Grand Strategy at the Quincy Institute today. I hope you'll tune in for it!

Tonight, the bipartisan House Select Committee investigating Donald Trump's Jan. 6, 2021 insurrection at the U.S. Capitol and his many other attempts to steal the 2020 Presidential election, holds the last of their summer series of blockbuster public hearings, for now. We'll see if Fox "News" bothers to carry this one, since they didn't last time, choosing to run an ad-free episode of Tucker Carlson's show instead. God forbid their groomed viewers turn away during commercials for even a second and learn any actual news.

But, of course, Fox isn't the only rightwing TV channel lying to their viewers day in and out about these remarkable, historic hearings, the deadly events of January 6, and all of the other ways Trump tried undermine American democracy. A new report finds that Newsmax is duping their viewers even worse than Fox, if that's possible, broadcasting at least 40 false claims about the J6 attack since the Committee's hearings began last month. Among the station's lies peddled repeatedly to their easily-played viewers: There were only a few hundred rioters in the Capitol that day (DoJ pegs the number at around 2,000); They were "unarmed" (except for all of the guns, knives, pepper spray, spears, brass knuckles, baseball bats, etc.); and that Trump ordered the National Guard to the Capitol, but was blocked by Nancy Pelosi (the President, not the Speaker of the House, commands the National Guard.)

In any event, whether Fox or Newsmax carry tonight's hearings and/or lies about them, we'll tell you the truth about them on our own Special Coverage on tomorrow's BradCast.

Today, we discuss the need for the long-overdue expansion of the Supreme Court. New polling finds approval of the Court has plummeted over the past two years. According to Marquette University Law School's poll today, 66% of Americans approved of SCOTUS in September of 2020. That number is now at stunning 38%. Their survey follows Gallup's recent finding (before the overturning of Roe v. Wade) that confidence in the Court is at an all-time historic low since they began asking the question in the 1970s.

Of course, this comes on the heels of Mitch McConnell nuking the Senate filibuster in order to pack the High Court with Donald Trump's three corrupt, extremist Republican nominees, including one of them (Amy Coney Barrett) just eight days before the 2020 election. That, after McConnell had changed the size of the Court for over a year while refusing to seat Barack Obama's nominee to the seat vacated by Justice Antonin Scalia in February of 2016, because, according to Mitch, the vacancy came just too close to a Presidential election, when the voice of the American people deserved to be heard first.

But now, with SCOTUS closing out its term with an unprecedented spate of radical rulings --- rolling back long-held Miranda rights; throwing out states Second Amendment rights to well-regulate the concealed carry of firearms; further eroding the long-standing Constitutional separation of church and state; blocking the Environmental Protection Agency from protecting the environment through the regulation of carbon pollution; and, of course, overturning the privacy rights and reproductive freedoms established 50 years ago by Roe v. Wade --- it sure seems like a re-balancing (and de-corrupting) is in order!

Given the striking down of privacy rights in Roe, Democrats in the House have been scrambling to codify reproductive freedom into federal law, along with bills that guarantee the right to both interracial and same-sex marriage, and even the right to use contraception. That, after the Court struck down the same privacy rights in 'Roe' that are the basis of those other Constitutional rights that Justice Clarence Thomas called for revisiting in his concurrence to the majority opinion overturning Roe.

But while codifying those rights into federal statute is critical (most House Republicans voted against all of them this week!), expanding the Court, to UNpack and UNsteal it, so that it represents the American people once again is even more critical.

On Monday, a group of Democratic lawmakers called for exactly that, touting their Judiciary Act of 2021 [PDF] which would expand the number of seats on the Court from 9 to 13. But that measure, so far, has not yet even received a Committee hearing, much less a vote on the Democratic-controlled House floor. What gives?

We're joined today by SARAH LIPTON-LUBET, Executive Director of the non-profit Take Back the Court organization, to discuss exactly that. Her group was formed in 2018 to warn of the danger then posed to democracy itself by the GOP's stolen Supreme Court, and to call for its expansion as the only strategy to re-balance SCOTUS after its 2016 theft. [We spoke with Aaron Belkin, the group's founder, back in 2020.)

"Republicans already changed the size of the Court for a year while they blockaded Merrick Garland's nomination. So a Republican power grab, that's just a part of reality. Given that, isn't a world where we fight for what's right better than a world where we surrender unilaterally?," Lipton-Lubet posits today, when I ask her about the fear expressed by some Democrats that Republicans will just take similar action the next time they are in control of both chambers of Congress and the White House. "To folks who are worried about what Republicans might do in the future, I have to say I'm really worried about what they've done already, and about what we need to do to fix the harm that they've caused in the here and now. They've stolen the Court. They've overturned Roe. They've undermined our democracy. And expanding the Court is our only shot at rebalancing the system and regaining those rights."

"This is only headed in one direction," she warns. "The ideologues on the Court are only going to get more radical. They're only going to get more unhinged. I think leaders can lead, or they try to play catch-up later after countless people have been irreparably harmed. And that's really the situation we're in."

"Living under the control of this Court --- it's not tenable. It's not sustainable. It's not going to stand," she argues. "Eventually we are going to get there." So, why are the bulk of elected Democrats, including the President, still pulling their punches and dragging their feet on this? We discuss that and much more with Lipton-Lubet today.

Before we get to a bunch of callers on today's BradCast, responding to the overturning of Roe v. Wade and Planned Parenthood v. Casey by our corrupt, extremist, activist, rightwing Republican Supreme Court majority, a few news items. [Audio link to full show follows this summary...]

  • Russia reportedly launched a missile strike on a crowded shopping mall in a central Ukrainian city with some 1,000 civilians reportedly inside. The number of dead and wounded are still unknown, but Ukrainian President Volodymyr Zelenskyy said at least "scores" are likely dead.
  • The bipartisan U.S. House Select Committee investigating the January 6 insurrection and Donald Trump's multiple attempts to steal the 2020 Presidential election announced a surprise last-minute hearing scheduled for tomorrow (Tuesday, 6/28). They did not announce a witness list, though some have speculated that documentarian Alex Holder, who was granted insider access to interviews with and footage of Trump, his kids, Vice President Mike Pence, and other insiders both before and after January 6, might be testifying. The Committee has said only that they are calling the hearing due to "recently obtained evidence." We'll have Special Coverage, as usual, on tomorrow's BradCast.
  • The radical rightwingers packed onto our Supreme Court are continuing to dismantle Constitutional rights and freedoms. On Monday they found in favor of a public high school football coach from Bremerton, Washington who was eventually fired after he refused to stop kneeling on the 50-yard line after games to hold prayers. White guy who takes a knee to pray on the public high school football field cannot be fired. Will be paid with your tax-payer dollars. Meanwhile, a black guy who takes a knee on the football field to protest racial injustice can absolutely be fired for it, apparently. That, as the U.S. Constitution's separation of church and state continues to be corruptly eroded by our radical, stolen and packed U.S. Supreme Court.
  • The extremist Court, according to Gallup polling last week, is now seeing it's all time lowest approval rating in the 50-years that Gallup has been polling on confidence among Americans in the High Court. Just 25% of Americans now have "a great deal" or "quite a lot" of confidence in the Court. That's 11 points down from one year ago and 5 points lower than the Court's all time low in the Gallup survey. And the kicker: that survey was taken prior to Friday's unprecedented ruling overturning the long-established Constitutional right to privacy and reproductive freedoms in Roe v. Wade.

And with that and a few other points of related note, we open the phones to listeners on what comes next, how the nation must respond, and which long-established Constitutional rights this illegitimate Court is likely to strike down next.

While callers may offer some other notes, I'm happy to offer the reminder that the solution still remains voting and organizing, along with the reminder that had Hillary Clinton received 2 votes that otherwise went to Donald Trump in 2016 in each precinct in Michigan, Wisconsin and Pennsylvania, we'd not be in the authoritarian mess we're facing now. Moreover, as political scientist Rachel Bitcofer observed following the Court's ruling on Friday, a Supreme Court with Clinton's nominees on board, rather than the three Trump nominees packed onto the Court by Republicans, likely means that gerrymandering would have been blocked by now, and Citizens United might have been overturned...just two name a couple things we missed out on because too many decided to stay home or vote for Trump in 2016. "We can't continue to hurt ourselves by not voting," she correctly concludes.

Packed Court of radical, activist GOP Justices invent imaginary 'historical' reasons to cancel reproductive freedoms, personal privacy rights, gun safety laws; Also: Many more well-established Constitutional rights now in peril; Biden, Pelosi respond; Voting remains the answer...

On a dark and historic day in America (and, apparently, on The BradCast), I offer a few thoughts on how unelected, radical, extremist, activists Justices (who are not "conservative" by any stretch of the imagination, please stop calling them that), who have been packed onto a stolen U.S. Supreme Court majority have only just begun the corrupt work for which their lifetime seats on the High Court were purchased. [Audio link to full show follows below this summary.]

On Thursday, the illegitimate Republican majority simply ignored the written text of the 2nd Amendment's mandate to "well regulate" the right to bear arms by cancelling [PDF] New York's century-old law limiting the concealed carrying of weapons in public, robbing elected state officials of their right to protect their citizenry from gun violence.

Then, on Friday, after declaring in their gun ruling that officials elected by the voters have no right to well regulate firearms, the same corrupt Justices cancelled [PDF] a half century of well-established Constitutional rights to personal privacy and reproductive freedom. The rightwing Court extremists declared that states and, indeed, the federal government, do have the right to force women to bear the child of their rapist --- even as the product of incest or sex trafficking.

In overturning 1973's Roe v. Wade (the landmark 7 to 2 majority opinion written by a non-corrupt Republican-appointed Justice), Sam Alito echoed Clarence Thomas' gun ruling one day earlier by pretending that any specific rights not in existence 233 years ago, when the Bill of Rights was written, lacks the "historical tradition" to be considered a Constitutionally-protected right. (Never mind that whole "well regulated" mandate of the 2nd Amendment which is, as it turns out, literally in the Bill of Rights.)

Neither Thomas' newly divined "historical tradition" requirement for Constitutional rights or Alito's "historical understanding of ordered liberty", are made up out of whole cloth. The concept appears nowhere in the Constitution, which actual, if uncorrupted, conservative legal experts know very well.

As horrible as all of this is, it will only get worse until the corrupt Court is unpacked and expanded to reflect the actual will of the American electorate. The Court's rulings on abortion and on gun safety are opposed by huge, bipartisan majorities.

In a separate opinion on Roe, Thomas --- arguably the Court's most corrupt Justice --- called for the Court to cancel other long-standing Constitutional rights established under the same 14th Amendment privacy rights which the Court has now dismantled in cancelling Roe. "We have a duty to 'correct the error'" by reversing the landmark opinions that established Constitutional rights to contraception, same-sex intimacy and marriage...though not inter-racial marriage for reasons that the inter-racially married Thomas failed to explain.

We share both President Biden and House Speaker Pelosi's responses to today's historically corrupt ruling, as they vow that the fight for Constitutional freedoms is not over and call on Americans to make their voices heard in response this November.

"Today the Supreme Court of the United States expressly took away a Constitutional right from the American people that it had already recognized," the President said. "They didn't limit it, they simply took it away. That's never been done to a right so important to so many Americans. But they did it."

"This fall," he later emphasized, "Roe is on the ballot. Personal freedoms are on the ballot. The right to privacy, liberty, equality --- they're all on the ballot."

They are indeed.

It's NICOLE SANDLER back with you, guest hosting the BradCast once more this week. [Audio link to full show follows this summary.]

On Tuesday, a jury in DC acquitted Michael Sussman, an attorney whose firm worked for Hillary Clinton during the 2016 election, of lying to the FBI. The failed prosecution comes three years after Donald Trump's Attorney General Bill Barr tapped U.S. Attorney John Durham to open a Special Counsel investigation into the origins of the FBI's probe into Russian interference in that election. Or, as the former guy demanded at the time: "They now go and take a look at the oranges of the investigation... the beginnings of the investigation, about the Mueller report."

The jury only deliberated for six hours before finding Sussman not guilty of lying to his FBI contact about working with the Clinton campaign when he tried to warn the federal agency about unexplained data transmissions between the Trump Organization and a Russian bank. Sad!

I'll admit that I have not followed this case or Durham's overall investigation very closely, despite many on the right desperately describing Durham's case against Sussman as a "BOMBSHELL!". But, that's probably because I don't watch Fox Not-News.

Investigative journalist MARCY WHEELER, on the other hand, has followed all of this very closely, takes her work very seriously and explains this insane prosecution and much more today. As she notes toward the end of the today's interview, "I've lived and breathed this stuff for 18 months now." She covers all of it in great detail at her somewhat eponymous website, Emptywheel.net.

So, Marcy is my guest whole hour. She's filled with details and stories, tells us all we need to know about this trial and Durham's overall (largely fruitless) investigation, which had no real predicate to begin with, other than Barr believing something didn't seem right about the original investigation into Russia's involvement in 2016.

Then we also look ahead to next week, as the U.S. House Select Committee's public hearings on the January 6, 2021 investigation begin next Thursday night...

On today's BradCast: You'd think by now they'd certainly have learned that insecure, un-overseeable (and thus, unverifiable) voting systems are a terrible idea in the age of phony claims of "Fraud!" by the MAGA Mob. But, apparently, Dems --- at least a bunch of them in the California state legislature --- never seem to learn.

First up today, however, a quick review of everything, happening everywhere, all at once. And specifically some critical news today from overseas. On that overseas news...

  • Joe Biden declared today in Japan that, "yes", the U.S. would intervene "militarily" if China were to invade Taiwan. That, he said, was a commitment made "even stronger" following Russia's invasion of Ukraine. Other U.S. officials, however, say those comments do not reflect a change in U.S. policy. Okay...
  • In Ukraine, a 21-year old Russian soldier who says he was ordered several times by superiors to kill an unarmed civilian, before he finally did, was sentenced to life in prison on Monday. He admitted to the crime and apologized to the wife of the 62-year old man that he killed. In truth, he seems to be a young kid who had no idea he would end up in a hot war in Ukraine when he signed up for the military to help out his family. There are likely to be hundreds of more such trials in Ukraine given the number of documented war crimes we've seen over the past three months of this horrific war.
  • And, in what we hope is a blow to Russia's well-funded, worldwide propaganda regarding Ukraine, a veteran Russian diplomat at the U.N. office in Geneva, Boris Bondarev, resigned on Monday, declaring in a scathing letter to colleagues that "it is intolerable what my government is doing now." He describes how, over his 20-year diplomatic career for Russia, he has never been "so ashamed of my country", calling the invasion of Ukraine "not only a crime against the Ukrainian people, but also...against the people of Russia." He went on to deride "propaganda clichés in the spirit of Soviet newspapers of the 1930s" emanating from the Russian foreign ministry and charges that it is no longer "about diplomacy," but "all about warmongering, lies and hatred." This incredibly brave man concludes: "The Ministry has become my home and family. But I simply cannot any longer share in this bloody, witless and absolutely needless ignominy. Job offers are welcome..."

NEXT, in a whiplash inducing change of topic today, as primary season continues (with midterm elections on Tuesday in Alabama, Arkansas and Georgia --- and several important primary runoffs in Texas), we turn to the urgent matter of a new bill moving quickly through the California state legislature which would allow Internet Voting in the state --- or, as the bill deceptively describes it, "electronic Remote Accessible Vote by Mail" or "RAVBM".

The measure, Senate Bill 1480, sponsored by Bay Area Democratic state Senator Steve Glazer, is opposed by dozens of world class voting system and cybersecurity experts --- both groups and individuals --- and is supported only by a handful of groups, including Microsoft and a couple of disability rights organizations. Nonetheless, it passed out of California's Senate Appropriations Committee on Friday and will quickly receive a vote on the Senate floor as early as today, before moving to the state Assembly and on to the Governor for his signature, if it's adopted there.

Dangerous Internet Voting schemes have long been prohibited in California. But SB 1480 would remove that prohibition to allow it for use by "qualified disabled individuals" once the Secretary of State certifies an Internet Voting system. Until then, those individuals would be allowed to vote via fax, according to the measure. Opponents see the targeting of disabled voters as a first step toward broader implementation of Internet Voting schemes.

We're joined today to explain all of this by one of the nation's most prominent Internet Voting experts and opponents. DR. DAVID JEFFERSON is a veteran of Livermore National Lab, a former board member of VerifiedVoting.org, and a pioneer in research at the intersection of computing, the Internet, and elections for 20 years. He has also served as advisor to five successive Secretaries of State of California on technology-related issues, specifically on voting technology.

Jefferson explains today what a terrible idea SB 1480 is and why, detailing the many concerns about security of transmission over the Internet, lack of transparency, and how even fax transmissions now use the Internet to send and receive information which can be easily intercepted and changed during transit without either the voter or election officials having any idea that it happened.

The wording "electronic Remote Accessible Vote-by-Mail" in SB 1480 is, itself, "kind of a contradiction in terms," says Jefferson, "because you are no longer mailing a piece of paper back. After filling out the ballot on your computer screen or mobile device, you then click a button that says 'send back by fax' or some other electronic means. It inevitably travels over the Internet from the voter to the jurisdiction that is going to count it. So it's not a voter-verifiable ballot by the time it gets to the jurisdiction, and it's not meaningfully auditable because it's not voter-verified. It's subject to many, many cybersecurity hazards along the way."

"California has been a leader in not allowing any form of Internet voting. Some other states have copied that because they often look to California for leadership on technical issues," Jefferson observers, adding: "This would be, in my opinion, a giant step backwards."

"It's pretty clear to many of us that the long-term goal of some of the moneyed backers of bills like this --- and by the way, it's not just California, these bills pop up all over the country --- that their long-term goal is to open the door to Internet voting to all voters, if they can," he tells me. "They've tried before, and in some states they have succeeded, for some time, and it fortunately hasn't lasted. So yes, that's a realistic concern."

Bottom line, warns Jefferson: "If an election is attacked through the Internet, it's hard to even know that the attack has even occurred."

One would think CA Dems would know that by now, as they've tried over and over again (unsuccessfully, to date), to pass a measure that would lift the state's prohibition on using the Internet for voting or transmitting votes. SB 1480 is opposed by, among others, Brennan Center for Justice, California Voter Foundation, the Electronic Frontier Foundation, Verified Voting, Public Citizen and some of our personal favorites like the Coalition for Good Governance, Free Speech for People, and Scrutineers.org, not to mention about a dozen grassroots "Indivisible" organizations and the Progressive Democrats of America. But, apparently, that hasn't yet been enough to slow down what will absolutely be a nightmare for California voters and others across the country, if this terrible idea becomes law.

The longtime election integrity advocates at Scrutineers.org have created an action page on SB 1480 at Scrutineers.org/California, with details on the legislation and steps you can take right now to let the state Senate, Assembly and Sec. of State know that this is a horrible idea for California, the rest of the nation, and secure, overseeable, verifiable American democracy itself...

On today's BradCast: It's primary election day in five states, with voting system problems reported in at least three counties in one of them, as the President traveled to upstate New York to condemn white supremacist "terrorism" and grieve with the community following Saturday's racist massacre at a neighborhood grocery story in a predominately black area of Buffalo. [Audio link to full show is posted below this summary.]

FIRST UP, a bit of seemingly encouraging breaking news just before airtime today from the New York Times. They report that the Dept. of Justice "has asked the House committee investigating the Jan. 6 attack for transcripts of interviews it is conducting behind closed doors, including some with associates of former President Donald J. Trump." The paper describes the news as "further evidence of the wide-ranging nature of the department’s criminal inquiry into the events leading up to the assault on the Capitol and the role played by Mr. Trump and his allies as they sought to" steal the 2020 election.

That sounds like encouraging news, even if the Times, for some absurd reason, describes the effort to steal the election as an attempt "to keep him in office after his defeat in the 2020 election." Normal humans would describe it simply as an attempt to steal an election. Our corporate media, and even most Democratic officials, for reasons I cannot explain, do not do so. In any event, sounds like good news no matter how stupidly the Times is reporting on it.

NEXT, it's midterm primary day in Kentucky, Oregon, Idaho, North Carolina (where insurrectionist Rep. Madison Cawthorn is running for his life) and Pennsylvania (where Dems see one of their best opportunities to flip a Republican-held U.S. Senate seat.) We'll have noteworthy results on tomorrow's program, but today we focus on three counties in PA, where voters were reporting problems simply trying to cast their vote.

In Berks county "widespread" problems were reported apparently with the County's new electronic pollbooks made by ES&S, just added to polling places countywide for the first time this year. Those new computers were added to the complicated mix of high-tech equipment already forced on voters in Berks, where residents are required to vote on 100% unverifiable touchscreen Ballot Marking Device computers at the precinct. It was a full two and a half hours after polls opened before officials finally deployed backup paper pollbooks(!)to all locations in the county, so voters could finally vote. It's unclear whether the systems simply didn't work, or election officials didn't make sure to properly train poll workers to use them. Either way, voters couldn't vote for hours and some were undoubtedly disenfranchised entirely because emergency paper ballots were not supplied either, according to one state Rep. who said he was held up for hours (though he appears to have misreported the problem as one with voting machines, as opposed to the e-pollbooks.)

In Alleghany County (home of Pittsburgh), some precincts reportedly opened hours late, due to a mix of problems, including lack of keys to get into precincts or a lack of Election Judges in some case, thanks to COVID. At least they respect their voters enough there to allow them to vote on simple, verifiable hand-marked paper ballots (with simple paper pollbooks) ... once the polls finally opened, in any event.

In Luzerne, a Republican-leaning county with a history of voting system issues, it was reportedly the touchscreen voting machines made by Dominion that held up voters, though the Chair of the County's Board of Elections seemed happy to throw poll workers under the bus for what she described as "human error". That, instead of taking blame for forcing those over-worked, under-paid workers to use overly complicated computer systems with a lack of training, in order to eventually (maybe) allow voters to cast unverifiable ballots on touchscreen voting systems after they manage to sign in with e-pollbook computers made by ES&S.

THEN, we head to Buffalo for President Biden's remarks to victims of Saturday's mass shooting by an 18-year old white supremacist who killed 10 and wounded 3 with a Bushmaster assault rifle in a matter of minutes in a predominately African-American neighborhood. The massacre came just three days after a Trump-appointed federal appeals court judge issued a ruling overturning California's law banning semiautomatic weapons purchases for those under the age of 21, finding the law to be an unconstitutional violation of the 2nd Amendment.

In his Wednesday ruling, Judge Ryan Nelson cited "the heroism of the young adults who fought and died in our revolutionary army" in "reaffirm[ing] that our Constitution still protects the right that enabled their sacrifice: the right of young adults to keep and bear arms.” Never mind that young adults during the Revolutionary War used rifles that fired one shot at a time after being laboriously loaded through their muzzle --- as opposed to the semi-automatic Bushmaster rifle used to shoot more than a dozen, including an armed guard, in mere seconds on Saturday in Buffalo.

Biden said today that the nation must "reject the lie" of "replacement theory" spread the far-right, Fox "News" and GOP elected officials, while describing America's diversity as its strength. He derided the "hateful minority" who spread the lie "for power, political gain and for profit" --- as Fox' Tucker Carlson has done hundreds of times on his primetime show and as GOP House Leadership's Rep. Elise Stefanik of upstate NY has recently done in her campaign ads.

"Evil will not win," the President vowed in moving and powerful remarks which we share at length. "Hate will not prevail, and white supremacy will not have the last word," Biden said, charging that "hate and fear have been given too much oxygen by those who pretend to love America."

FINALLY, Desi Doyen joins us for a few thoughts on all of the above, as well as our latest Green News Report. Among the matters she covers today: a new analysis finding wildfires are likely to double across the U.S. in the next several decades; while Russia has used energy as a weapon in its war on Ukraine, they are now threatening to cause a global food crisis as well; and while the state of California recently became powered by 100% renewable electricity for a short time, the state of Texas is, once again amid another heat wave, having trouble even keeping their lights on...
