It's NICOLE SANDLER, back again to guest host today's BradCast.

With everything around us consumed with coronavirus, I thought we could use a short break from it. So, after an update on the latest from the Covid-19 front, we'll completely change the subject to speak with MSNBC's LAWRENCE O'DONNELL.

A couple of weeks ago, as I was increasingly frustrated with MSNBC's adversarial attitude toward Bernie Sanders' campaign, I remembered that Lawrence O'Donnell had proclaimed himself a socialist and commented about it on Twitter. He engaged with me. After a while I invited him to continue the discussion on the air, and he accepted.

I'm happy to be able to share it with you. I came away with a slightly better understanding of how things work over there and a much greater appreciation for Mr. O'Donnell. And it's nice to focus on something other than a killer pandemic for a few minutes....

On today's BradCast: A look at what happened over the weekend in Nevada, and a look ahead at wait awaits in South Carolina on Saturday, Super Tuesday three days later, and yes, even beyond. [Audio link to show is posted below.]

So, the Caucuses in Nevada over the weekend went only slightly better when it came to reporting results than the Iowa Caucuses two weeks ago. But, because Bernie Sanders appears to have won in a rout there, the corporate media declared as much and didn't seem to be bothered, or even much notice, that it took another three days before all results were actually in. (Proving once again that corporate media is interested in headlines, not about making sure that voters see their votes counted accurately.)

We cover the reported results out of NV today, beginning with Sanders' landslide victory there, and the fight for runners-up, with Joe Biden coming in second over Pete Buttigieg, followed by Elizabeth Warren in fourth place. She was followed in turn by Tom Steyer and then Amy Klobuchar.

But the night belonged to Bernie. He received well over twice the number of votes than his nearest competitor (Biden) in NV. Buttigieg challenged the reported results from the Saturday caucuses and attacked Sanders during his post-caucus remarks to supporters in a way that Republicans should be very happy about (and in a way that Sanders would have been justifiably excoriated for, had he done anything similar in either 2016 or in this year's cycle.) We explain all of that on today's show.

We also look forward to this Saturday's important Primary in South Carolina and to Super Tuesday in 14 states just three days later on March 3rd. In SC, Biden's once seemingly-insurmountable lead in pre-election polling appears to be slipping, even as he retains a small edge over Sanders there, according to NBC/Marist, as of today.

At the same time, the national polls are seeing some movement as well, with Warren surging into second place behind Sanders and ahead of Biden in a new CBS/YouGov poll out today, reflecting what many regard as her strong debate performance last Wednesday. Their performance, however, was not reflected in the NV Caucuses given, that most caucus-goers had already voted before the debate in Early Voting (which was used for the first time there this year.)

So, with Sanders the front-runner at the moment, having won the popular vote in each of the first three primary/caucus states, members of the "Democratic Establishment" and their media supporters appear to be, well, freaking out a little bit. We play some of that freak out and discuss.

For the moment, however, all eyes are now on South Carolina, where voters across the entire state will be forced to vote on brand-new, 100% unverifiable touchscreen Ballot Marking Devices (BMDs). The new systems, made by Election Systems and Software, Inc., replace the state's old 100% unverifiable touchscreen Direct Recording Electronic (DRE) systems, also made by ES&S. Their systems have failed in election after election over the past decade in the Palmetto State and elsewhere. But, of course, even if they work as designed this Saturday in the SC Primary, it will still be 100% impossible to know after polls close if any ballot cast on the expensive devices actually reflect the intent of any voter.

That's just one of the problems --- though, one of the biggest --- with BMD voting systems. In Los Angeles County --- which has more registered voters in it than the entire state of South Carolina has people --- the Early Voting period for the March 3rd Super Tuesday primary (which will be held in 14 states) began on Saturday. We've been covering L.A. County's brand-new, $300,000,000 touchscreen BMD voting system for some time (about a decade in fact), warning about many of its failures and potential failures.

So, how do you think the first day of Early Voting went in L.A.? According to this report, and some of our own reporting as well, it did not go well, with officials unable to start up the new e-voting systems at all for several hours in a number of locations, some locations where the equipment didn't even arrive in time for Saturday's Early Voting, and an absense of the paper write-in ballots that were supposed to be available at every polling site as the first "condition" in the CA Sec. of State's recent "conditional certification" [PDF] of L.A.'s new "Voting Solutions for All People" (VSAP) touchscreen system.

County, to get a real, hand-marked paper ballot instead, by visiting LAVote.net to request a Vote-by-Mail ballot for the March 3rd election before Tuesday night, February 25th at midnight! (And please do the same if you live in ANY jurisdiction in the country where you will be forced to vote on a touchscreen voting systems at the polls!)

In the midst of all this, the Toddler in Chief still had the bandwidth to snark Greta Thunberg upside the head, and to sic the EPA on California again. On that latter point – my guest today is DR. JUSTIN FRANK. He’s the psychoanalyst behind the books Bush on the Couch, Obama on the Couch, and now Trump on the Couch. His insights into the man to whom no laws apply are intriguing.

I've got to get on air for today's BradCast shortly, where I'll discuss this in a bit more detail, so please excuse this terse post. But I'd like to get this information out there, in case anyone has additional details or observations to add.

No, I have no yet been able to check with the North Carolina State Board of Elections (SBE) or MSNBC to get their response, since I'm just getting the details myself from a tipster and racing to get on air.

I will also add the caveat that there are sometimes perfectly reasonable explanations for something like this, such as a typo or a bad transcription, or a non-nefarious bad data transfer anywhere along the path from the voting booth, to the county headquarters to the state Board of Elections to the media which report vote counts as they come rolling in.

So, with those caveats out of the way, this is from the Special Election for the U.S. House held on Tuesday night in North Carolina's 9th Congressional District. The election was a do-over after the SBE refused to certify the results of last November's election due to a massive Republican Absentee Ballot Election Fraud scheme that was uncovered, and has led to criminal indictments of seven folks who worked with a GOP contractor hired by Republican candidate Mark Harris last year.

On Tuesday, the Democratic candidate Dan McCready, who ran last November in the never-certified contest in which he was said to have lost by 905 votes, thanks to the absentee ballot fraud scam by the GOP contractor, ran this time against hard-right and very Trumpy Republican State Senator Dan Bishop.

The district has been held by Republicans since the 1960s, but polls showed the do-over race, like the one last November, to be very tight. So much so that both President Trump and Vice-President Pence were in the district for rallies for Bishop on Monday night before the election.

As of today, the State Board of Elections website shows Bishop (R) defeating McCready (D) by almost 4,000 votes or just over 2%.

Which makes this apparent anomaly from during last night's vote counting (most ballots were tallied by computer op-scan systems in the district, though Mecklenberg County's votes --- the county with the largest single share of the votes in the district --- were cast on 100% unverifiable touchscreen voting systems) all the more worrisome...

In this screenshot during Rachel Maddow's MSNBC coverage of the race last night, (the full video of the flip is also posted below) please note that, with 52% of the vote reportedly in, according to the chyron at the bottom of the screen, McCready led Bishop, 69,280 to 67,295...

But, just seconds later, when 55% of the vote was reportedly in, after leading most of the night, McCready's numbers actually appear to have rolled BACKWARD by 3,181 votes for some reason...

After publishing a post about Lawrence O'Donnell's MSNBC report on Donald Trump and Deutsche Bank, Tom received a letter from Donald Trump's attorney demanding a retraction and an apology. He explains what happened.

Then we turn our attention across the pond to the UK, where the new Prime Minister Boris Johnson appears to have engineered a coup of sorts. The Queen approved his plan to suspend Parliament for five weeks to allow him time to push through a "no deal" Brexit. People have taken to the streets in protest. I'll speak with American ex-patriot DENIS CAMPBELL, an author, journalist and broadcaster, who does his best to explain what's happening over there.

On today's BradCast, it's unclear if Donald Trump's hope for making America great again is to see foreign countries warn their citizenry against traveling here due to the risk of gun massacres and racist hate crimes, but that's now how "great" we are. [Audio link to show is posted below.]

Uruguay and Venezuela issued alerts to travelers following recent mass shooting in the U.S., and Mexico is considering legal action following the murder of seven of their citizens in the shooting at the El Paso Walmart on Saturday which took the lives of 22 in all.

At the same time, the U.S. cities which endured mass shootings by domestic terrorists over the weekend don't really wish to have a visit from the man who has inspired so much hatred and death. But the White House says that Trump will be going to El Paso and Dayton on Wednesday anyway. That, despite locally elected officials who wish he wouldn't, as they mourn their dead and protest the racist hate-mongering President who continues to sow the ground for even more rightwing violence. (And as El Paso waits for Trump's campaign to pay them the more than $400k for security that they are still owed following his last campaign rally there months ago.)

While the El Paso shooter is being investigated on Domestic Terrorism charges after echoing Trump's "Hispanic invasion" language prior to the massacre, the FBI announced on Tuesday that the mass shooting at the Gilroy, California, Garlic Festival just over a week ago is now also being probed as a Domestic Terror incident. So why is it so difficult to bring Domestic Terror charges against white male American citizens who committed these acts of terror and others like them? Federal statutes make prosecution of foreign terror charges easy, but domestic charges have a much higher bar and fewer options for law enforcement to choose from.

So, there are now calls to beef up federal Domestic Terrorism statutes, but do they stand any better chance of changing than the very-low-hanging-fruit gun safety laws that Ohio's GOP Gov. Mike DeWine is now calling for in the Buckeye State? (Laws that Dems have been calling for for years? And that even Donald Trump is now pretending to call for at the federal level?) Don't hold your breath. Fox News Presidential adviser Sean Hannity's breathtakingly stupid idea for protecting schools and malls from gun violence may have a better chance of actually become reality.

But at least one former GOP U.S. House Member, Rep. David Jolly, who quit the party last year over Trump, predicts his former Republican colleagues will not change any laws even after the recent string of gun massacres. He is now calling for every Republican in the U.S. House and Senate to be voted out of office next year. "Beat 'em. Beat every single one of them," he now says.

Notwithstanding Donald Trump's 4-Pinocchio claim that low-end wages are on the rise, there is an ample body of evidence that wealth inequality has reached levels not seen since the onset of the Great Depression. Those who study the issue often compare the financial holdings of the privileged few to those of the many.

A 2017 study, for example, revealed that just three individuals – Bill Gates, Warren Buffet and Jeff Bezos – had, at that point, held as much wealth as the bottom 50% of the American population --- some 160 million people. It's a wealth gap that continues to grow exponentially.

Amazon founder and Washington Post owner Jeff Bezos is the Ebenezer Scrooge-like poster child for obscene wealth disparity. Last year, Bezos agreed to pay Amazon employees $15 per hour wages, but only after sustained pressure from Senator Bernie Sanders (I-VT) and Rep. Ro Khanna (D-CA), who introduced the StopBezosAct.

At $15 per hour, a full time, 40 hour per week Amazon employee would earn $31,200 per year, before taxes. How generous! According to Business Insider, every 60 seconds, Bezos earns $149,353. That's more than four (4) full-time Amazon employees collectively earn in a year. Bezos' per minute earnings are $56,000 higher than the $93,170 in annual earnings an individual would have to make in order to be placed within the top 10%.

In the minds of most people, $215 million looks like an enormous sum of money, and it is. Business Insider reports that Bezos rakes in $215 million per day, every day, and more than $6.5 billion per year. Amazon, which reported $11.2 billion in earnings last year, did not pay one dime in federal taxes.

While these numbers are essential to understanding our gaping inequality problem, they really don't do much by way of exposing what life is like for those at the bottom end of the scale, to wit: the homeless, who, to many, are simply "invisible" .

In a recently released report (see below) titled, "Paradise Lost", Eric Johnson of Seattle ABC News affiliate, KOMO, takes an in depth look at what wealth disparity has wrought for those at the very bottom --- the 59,000 homeless people in Los Angeles County. Not mentioned by Johnson is that 11% of those struggling to survive without a roof over their heads are U.S. military veterans. The numbers of individuals in L.A. who are slipping into the homeless abyss, according to Johnson, are increasing --- by 16% over the previous year.

Johnson focused on what he described as "the worst man-made disaster in the United States" --- "53 square blocks of suffering and mental illness and drugs on a level that is hard to fathom." For the homeless of L.A., conditions may be even worse than those experienced during the Great Depression. They face what Johnson described as "the long-ignored cousin of addiction and homelessness: disease."

"We have not seen conditions for humans like this since medieval times. Period. And that's a fact," Dr. Drew Pinsky told Johnson. He is, literally, correct...

Two federal courts uphold Legislative oversight of the Executive Branch...

The federal courts, so far anyway, are holding up well amidst the Constitutional Crisis foisted upon the nation with President Donald Trump's attempts to stymie all Congressional oversight of the Executive Branch and the potentially criminal record of its chief occupant. The Judicial Branch firewall, at least according to one renowned Constitutional law expert --- and at least on the matter of the Congressional subpoenas --- should hold up all the way to even the otherwise very divided U.S. Supreme Court.

On May 20, just seven days after hearing oral arguments, United States D.C. District Court Judge Amit P. Mehta issued an erudite 41-page decision [PDF] in which he ordered Donald Trump's accounting firm, Mazars USA, to comply with a subpoena issued by the House Oversight Committee. Both the subpoena and subsequent court order directs Mazars to provide financial records from Trump and several affiliated entities to the panel. Judge Mehta also denied Trump's request to stay the order pending appeal, reasoning that the President had failed to either cite "potentially persuasive authority" or "present serious legal questions" to overcome nearly 140 years of Supreme Court case law establishing the right of Congress to obtain the requested records as part of its broad investigative authority.

Judge Mehta's rationale was so compelling --- and the "legal" arguments advanced on behalf of the President so specious --- that, when Harvard Law Professor Laurence Tribe, a preeminent constitutional expert appeared on MSNBC's The Last Word with Lawrence O'Donnell following the ruling, he predicted the President's appeal would not only be swiftly denied by the United States D.C. Circuit Court of Appeal, but that the Supreme Court would either deny the President's request that it hear the case or swiftly affirm the District Court decision. Tribe described the law in this realm as a "slam dunk" and said he'd "expect all nine Justices...would follow the law."

It took only one day for Tribe's sentiment to be echoed elsewhere. Citing Mehta's decision, Judge Edgardo Ramos at the U.S. District Court in the Southern District of New York, issued a bench ruling immediately after oral arguments in a separate, if related case. Ramos directed Deutsche Bank and Capital One to comply with a Congressional subpoena to turn over the President's bank records. That subpoena, according to The New York Times, seeks "to elicit information on potential money laundering and bank fraud." Like Mehta, Judge Ramos refused to issue a stay pending appeal...

Calls for VA's Governor to step down may make political sense for Democrats, but is it wise and/or the right thing to do? Callers ring in...

On today's BradCast, should Virginia's Democratic Governor Ralph Northam resign after his 1984 medical school yearbook was revealed late last week to have featured a photo of a man in blackface standing next to a man in a KKK costume? Don't answer that too quickly. Or, at least listen to today's show first. [Audio link to show follows below.]

After apologizing on Friday night for the appearance of the photo --- calling it "clearly racist and offensive", but failing to specify which of the pictured two men he actually was --- the Governor said at a bizarre Saturday press conference that he was neither man and that he had never even seen the photograph before, since he hadn't purchased that year's yearbook. He says the photograph hit him "like a ton of bricks" on Friday night. However, he told the media that he did remember an instance around the same time when he darkened his face to dress up as Michael Jackson for a dance contest. He said he remembered the contest outfit very specifically, discussing it publicly for the first time on Saturday, while insisting that he never recalls dressing up in either minstrel show blackface or as a Klansman, as depicted in the mystery photograph.

One of the two African-Americans in the same medical school class that graduated with Northam told AP the explanation is plausible, as he didn't purchase the yearbook either and found the racist photo on Northam's page to be out of character. Despite Northam's record of working closely with the African-American community and still being a member of a predominately black church in the town where he grew up, top Democrats from Virginia to D.C. and beyond continued their loud calls on Sunday for him to step down and allow his Lt. Gov. Justin Fairfax --- an African-American Democrat --- to replace him.

But should he? And should he be shunned for something that may have never happened? Or, if it did, happened 35 years ago and appears completely inconsistent with his record since then? The answers to those questions are both "absolutely yes" and "no, not so fast", as we discuss with callers today, focusing on Northam's remarks at the strange, yet seemingly earnest Saturday presser in which he stated that acquiescing to calls to step down would allow him to "spare myself from the difficult path that lies ahead," adding: "I could avoid an honest conversation about harmful actions from my past. I cannot in good conscience choose the path that would be easier for me."

We endeavor to have a least part of that "honest conversation" with tons of callers on today's program, including some discussion about key civil rights figures (from Lincoln to Justice Hugo Black to LBJ) whose own histories of racism arguably allowed them to lead on a number of landmark civil rights issues from Emancipation to Brown v. Board of Education to the Civil Rights of 1964 and Voting Rights Act of 1965.

Also today: While I was happy to see MSNBC, on Friday night, highlight a Super Bowl ad buy in Georgia markets by former Democratic gubernatorial candidate Stacey Abrams' voting rights group Fair Fight, calling for "hand-counted paper ballots," the news outlet's Rachel Maddow Show maddeningly cut the :30 commercial off when reporting the story, just before the crucial line calling for "hand-marked paper ballots"! (Made, in the spot, by Republican Commissioner of Habersham County, GA Natalie Crawford, by the way.) Maddening. Especially since, unless the voters rise up to protect overseeable elections and stop them, the state of Georgia, along with counties in key states like Ohio, Pennsylvania, and Texas --- not to mention Los Angeles County and neighboring Ventura County! --- are all now planning moves to expensive, unauditable touchscreen Ballot Marking Devices (BMDs) before the 2020 Presidential election. Those systems print out computer-marked and barcoded paper ballots which are 100% unverifiable after an election has ended.

Add MSNBC's failure there to a list of disappointments over the weekend from the mess in Virginia to the loss of the L.A. Rams at the Super Bowl...

Legal scholars find DoJ opinion fails to consider Constitutional measure for Executive Branch continuity during a President's criminal trial...

So long as there is a prospect for the issuance of a pardon by a Vice President once he/she becomes President, or the expiration of the statute of limitations while a President remains in office, the indictment of a sitting President may be the "only" constitutional means for ensuring "Equal Justice Under Law".

That conclusion, of course, is at odds with the official U.S. Department of Justice (DoJ) position that a sitting President cannot be indicted until after he/she leaves office. The DoJ's position is based upon the December 10, 2000 Opinion issued by the DoJ's Office of Legal Counsel (OLC), citing an earlier OLC opinion that "the institution of criminal proceedings 'would interfere with the President's unique official duties, most of which cannot be performed by anyone else.'"

But that position is flawed and is being challenged by a number of legal scholars, including Harvard Law Professor Laurence Tribe, a preeminent constitutional expert, whose famous former students include Supreme Court Chief Justice John Roberts and President Barack Obama.

In a December 10 Boston Globe op-ed and during a subsequent appearance on MSNBC's Last Word with Lawrence O'Donnell (see video below), Tribe noted that the long-controversial OLC opinion lacks the force of a judicial precedent and is at odds with the legal accountability required of all federal officers, including the President...
