With Democrats still wetting themselves over last week's NYT/Siena polling showing Donald Trump beating President Biden a year from now in five of six swing-states, we finally carved out some time on today's BradCast to dig into the matter.

After a few news headlines, it's on to "that polling" that has freaked out so many regarding Biden's odds next year. It has spawned a thousand explanations. But mine, in short, is not unlike Margaret Sullivan's at The Guardian, where she argues that the bottom line is --- whether the polling is accurate or not --- the media are failing to accurately inform the American people. Not about the "horse race", but about Biden's accomplishments in office and the unprecedented dangers of Trump's vow to move the U.S. to become an authoritarian regime if he is allowed back in office.

President Obama's 2012 campaign manager Jim Messina argues today in Politico there is "no need to panic" over the polling numbers, based on his experience presiding over similarly grim numbers for the incumbent Prez back in 2011, when data guru Nate Silver suggested Obama was "toast" a year out from the election (which he ended up winning); New York Times Magazine gave him just a 17% chance of prevailing (apparently he beat those odds); polling by Politico showed Obama tied with Mitt Romney in 10 battleground states (Obama would go on to win 9 of them); and a December 2011 Gallup poll showed Obama losing to Romney across 12 battlegrounds states (he ended up winning 11 of them.)

In short, polling this far out doesn't mean much. But there are still plenty of reasons to be concerned. And plenty of reasons to spend time not on the horse race, but on the FACTS that Americans apparently aren't receiving from their mainstream media outlets. The FACTS of Joe Biden's extraordinary accomplishments in his first term, rivaling LBJ or FDR, and the chilling FACTS of what Donald Trump himself has vowed to do if he is re-elected, rivaling Hitler and Mussolini. (And, no, that is not hyperbole.)

As we discuss today, here is a new poll from Navigator Research revealing how wildly popular Biden's accomplishments are, whether the American people realize he has implemented them or not. And here is a list of 27 "insane things" Trump has promised, in his own words, to do if he wins a second term. And that list was created in September. He has doubled and tripled down on many of them since then.

After discussing much of the above, we open up our phone lines to listeners today, to get their explanations for all of this. Many of whom seem to get it, but a few, sadly, clearly do not. They are still buying the lies being spun by Trump, Republicans and Fox "News", because real news outlets are doing such a lousy job of telling the real story. The actual FACTS.

It's another crazy day in MAGA Land on today's BradCast, as Accountability Season gets a very good start even before the 2022's Election Season fully wraps up. [Audio link to full show is posted below this summary.]

Among our stories today from Accountability Season...

  • BREAKING at the top of today's program: Stewart Rhodes, founder of the far-right Oath Keepers clan (and former BradCast guest!) is found guilty of seditious conspiracy for his involvement in the January 6, 2021 insurrection at the U.S. Capitol. Fellow Oath Keeper Kelly Meggs was found guilty as well. Both now face as much as 20 years in prison on the sedition charges alone. They, and others, were also charged with Obstruction of an Official Proceeding and more. Perhaps our former President who inspired them should begin to be concerned.
  • Speaking of the former guy... Earlier this month, Kremlin-linked Russian businessman Yevgeny Prigozhin, known as "Putin's Chef", boasted on social media that "we have interfered, are interfering and will interfere" with U.S. elections. "Carefully, precisely, surgically and in our own way, as we know how to do." A week or two later, longtime GOP operative Jesse Benton --- who worked for Ron Paul, Rand Paul, Mitch McConnell and Donald Trump, among others --- was found guilty on six counts related to money laundering some $100,000 for another Russian businessman before the 2016 election. He was charged with helping to funnel money to both the Trump campaign and RNC that year. As it happens, both Benton and seditious conspirator Rhodes both got their start in politics working as aides for Rep. Ron Paul. Benton is now married to Paul's granddaughter. He was charged last year (along with yet another BradCast guest --- who died shortly after being charged) just months after Trump had pardoned Benton for separate charges against him regarding campaign finance violations and bribery during the 2012 election. We 'splain the full sordid story and Russian collusion along with wistful memories of Tibetan monks and nuns and Al Gore from back in the day when Republicans used to pretend to care about unlawful campaign donations from foreign sources.

And from Election Season...

  • Welp, the days are getting crazier and crazier in Arizona. On Monday, the deadline for counties there to certify election results before the state certifies all results next Monday, the Board of Supervisors in Cochise County voted against doing so. They claim they will reconsider the matter on Friday. That, despite any evidence of fraud or voting system failure in the Republican-leaning county. Katie Hobbs, the state's Democratic Sec. of State and apparent Governor-elect, quickly went to court yesterday in an attempt to force Cochise to certify their result as, she argues, they are required by law. If they don't, all of the county's voters may be disenfranchised and the results of at least one U.S. House race would flip from Republican to Democratic, along with the statewide contest for Superintendent of Public Instruction. Moreover, any remaining chance for Abe Hamadeh, the GOP candidate running for Attorney General, to overcome his current 510-vote deficit against Democrat Kris Mayes, would almost certainly be gone. As the Arizona Republic's EJ Montini snarks today, if Hobbs was gaming the system to somehow help state Dems this year, as MAGA Republicans baselessly claim, "she really, really stinks at cheating"!
  • Meanwhile, Georgia voters are proving to be really, really good at early voting. They shattered all-time records for doing so on Sunday and again on Monday of this week, outpacing both Presidential and other general elections alike in the state's current runoff election between Sen. Raphael Warnock (D) and Herschel Walker (R) for \ U.S. Senate. The big turnout could be a good sign for Democrats, though that's not certain. The long wait times it is causing for many voters around the Peach State, however, is a certain disgrace. (More on all of that, I hope, on tomorrow's show.)

And in other matters...

  • A bipartisan "Respect for Marriage" bill has been passed by the lame duck U.S. Senate to protect same-sex marriages following corrupt U.S. Supreme Court Justice Clarence Thomas' recent opinion with the overturning of Roe v. Wade arguing that marriage equality should be one of the next rights stolen by the Court from the American people.

Biden ends Russian imports, destroys Fox/GOP/Big Oil lies; Jan 6. insurrectionist 'guilty' on all counts; 'Proud Boy' indicted for U.S. Capitol conspiracy; Pardoned GOPer indicted for funneling Russian money to Trump 2016; Another former 'BradCast' guest indicted...

As the horrors of war continue in Ukraine today, we focus on the latest efforts to counter it by ending --- or trying to --- Russian oil and gas imports to the EU and US, and as we enjoy more accountability for GOP election fraudsters and insurrectionists, including one who funneled Russian money to Donald Trump's 2016 campaign and another who used to appear on The BradCast from time to time. [Audio link to full show is posted below this summary.]

Among the many stories covered on today's program...

  • Fossil fuel profiteer Shell Oil apologizes after getting caught secretly buying cheap Russian oil, even after pretending last week that it was ending its business with the country after their invasion of Ukraine. Does it smell "like Ukrainian blood?," Ukraine's Foreign Minister wonders.
  • On Tuesday, after nearly two hellish weeks of unspeakable humanitarian suffering in Ukraine and pressure from the public to do the right thing, several more major American companies --- McDonald's, Starbucks, Coke and Pepsi --- finally decided to "pause" doing business in Russia.
  • The European Union, which has made the mistake of becoming reliant on Russia for about 45% of its gas imports, announced plans to try and wean themselves off two-thirds of it by year's end. Hopefully this will help hasten their move to clean, renewable energy.
  • President Biden announced today that the U.S. will halt all imports of Russian oil and gas. Hopefully this will help hasten our move to clean, renewable energy.
  • Also, both White House Press Secretary Jen Psaki and President Biden pushed back hard against the obnoxiously phony claims by Republicans, Fox "News" and the oil industry that opening up more public land to oil and drilling leases and permits would lower surging U.S. gas prices. As both Psaki and Biden point out, Big Oil is already sitting on some 9,000 currently unused permits on millions of acres of land, as is. The GOP/Fox "News"/Big Oil axis of evil is really hoping that Americans don't know that, so they can blame Biden for the surge in global oil and gas prices...even as new polling finds American majorities are willing to pay more at the pump to help Ukraine and they want to expand renewable energy development, not fossil fuels.
  • The International Energy Agency (IAE) has a list of 10 things the EU can do to decrease gas use by at least 10% before year's end. Many of those things the U.S. can do as well. One thing many of us could and should do to lower the cost of gas in a big way during Russia's war on Ukraine --- since many of us already did it for much of the past two and a half years anyway, cleaning the skies and drastically lowering gas prices in the bargain --- WORK AT HOME AGAIN if possible!
  • The first January 6th insurrectionist to stand trial before a jury, was found guilty on all five felony counts today. (He's a helluva guy, apparently. Threatened to kill his own teenage children if they told on him. Ya know, as "patriots" do.) The DoJ hopes the result may lead other Trump insurrectionists to plead guilty. We hope it leads the DoJ to keep working their way up to the top of the insurrectionist cabal.
  • The leader of the violent rightwing street gang calling itself Proud Boys, Enrique Tarrio --- who wasn't even at the U.S. Capitol on January 6th, 2021 (because he was in police custody on a separate crime) --- was indicted, with several others in his gang of white hoodlums, on conspiracy charges related to their violent, coordinated attack on the Capitol. Tarrio had reportedly met with Oath Keepers leader Stewart Rhodes in a parking garage in the hours before the Republican assault on American democracy. Rhodes and several other Oath Keepers were also recently indicted on seditious conspiracy charges. And Rhodes, like another rightwing hoodlum facing new felony indictments in a separate matter (discussed below), had been a guest on The BradCast several years ago.
  • This story is amazing. Jesse Benton, a longtime Republican operative and former campaign manager for Senators Rand Paul (in 2010) and Mitch McConnell (in 2014), has already been pardoned for felony election fraud once, by Donald Trump in the closing days of his Administration. Now Benton has been indicted again, for more election fraud, and along with another former guest on The BradCast! Tune in for the full story, but Benton was originally charged and convicted some years ago for buying away an endorsement for about $75,000 from a Michele Bachmann supporter during the GOP Iowa Caucus in the 2012 Presidential campaign. At the time, he worked for Rand's father Ron Paul's Presidential campaign. Benton was sentenced to two years probation and a $10,000 fine just days before the scheme he has now been indicted for which includes receiving $100,000 from an unnamed Russian national, keeping $75,000 for himself, and giving $25,000 of it to the campaign of "Political Candidate 1" in his own name, an unlawful straw donation to avoid laws barring foreign money in American elections. Benton promised a meeting with "Political Candidate 1" in Philadelphia on September 22, 2016, the day that Donald Trump happened to be holding a fundraiser there. They all took pictures together, according to the September indictment unsealed on Monday, along with Doug Wead, a GOP Presidential historian and, in recent years, far-right operative who appeared a number of times on this program some years ago. Wead, a Senior Advisor to Ron Paul's 2012 campaign was indicted as a co-conspirator with Benton. They both face the potential of a lot of time in prison. Each of the six counts charged against both of them carries sentencing of 5 to 20 years. But, yup, more Russian money in Donald Trump's 2016 election. Who could have guessed it?
  • Finally, Desi Doyen joins us for our latest Green News Report, in which we can barely keep up with Russia/Ukraine related events in the energy industry (including nuclear) and as the U.N. offers some good news for a change, in this case regarding global plastic pollution.

All of the above is much funnier, outraging, and/or more enlightening when heard in full on today's surprisingly lively BradCast (given what we have to work with at times like these)...

On Monday night, the Democratic Iowa Caucuses melted down. Actually, they didn't melt down. They worked as well as expected. It was the reporting of the results from the caucuses that melted down, almost entirely due to a smartphone app that either didn't work as planned --- or because untrained precinct captains had trouble using it for its intended purpose: to send local, transparent, fully publicly overseen caucus site results to the the Iowa Democratic Party headquarters for release to the media. Of course, as we have warned for more than 15 years, it is always a terrible idea to use new, untested, secretly-developed, nontransparent, unnecessary computer technology for mission critical, cannot-fail elections.

On today's BradCast [Audio link posted below], we explain both the Iowa caucus process (which, itself, is actually among the most transparent --- if most complex --- of all the Presidential nominating contests); the known history of this app that failed so spectacularly after warnings by cybersecurity professionals (and by us on this program previously) against its use were ignored; how the app was supposed to work; and the problems from the 2016 caucuses (and even 2012 Republican Caucus in Iowa) that it was meant to solve.

(Relatedly, we also share a :30 second preview clip, featuring me, from CBS-2 Los Angeles, for an investigative report on Los Angeles County's new, untested, 100% unverifiable, $300,000,000 touchscreen voting systems that are being deployed for the March 3rd Super Tuesday primary election here for the first time in the nation's most populous county, despite warnings from cybersecurity and, yes, us. That story, and the warnings I offer in the preview --- and, hopefully, in the full story set to air on CBS-LA this evening --- have suddenly become even more wildly relevant over the past 12 hours or so than they were previously.)

If you take nothing else from all of this, please let it be that even if tech like this works perfectly (it never does), if the public cannot know that it did, confidence in democracy itself is deeply endangered. Though we've been issuing that warning for years, it is more true today than ever, especially after years of tossing additional computer "solutions" at our elections, no matter how dangerous it will be once again in 2020. As one longtime Election Integrity advocate emailed me today, somewhat sarcastically: "Who would have ever thought that using computers for election administration could cause problems? Aren't they supposed to make processes go more easily, more smoothly, faster, more accurate? What a stunner that everything descended into chaos when Iowa Democrats changed from their manual counting/reporting methods to move into the 21st century with computers!"

Before we get to our guest today then, with whom we also discuss all of this, perhaps I can summarize the lessons learned for the moment from Iowa as...A) the madness of using untested, secretly-developed, nontransparent new tech in mission critical elections; B) the importance of publicly overseen results tabulated by humans at the polling place (which Iowa has, despite the app meltdown, so the correct results will EVENTUALLY be known!) and; C) the absurdly complex procedures of the Iowa Caucus itself (on the Dem side --- the GOP side is far simpler) is a nice example of the complications and dangers in store for those who persist in calling for a Ranked Choice Voting (RCV) system. Given the complicated way the Iowa Democratic caucuses work (realignment of votes through several rounds of voting/counting after some candidates do not meet the viability threshold, etc.), it is very similar to RCV or Instant Runnoff Voting (IRV).

If you think the raw numbers, once they fully come out from Iowa, are impossible to understand and add up, just wait until RCV takes hold. As I almost always note on this topic: If you think we have enough trouble as is, transparently adding 1 + 1 + 1 in our elections in a way that can be publicly overseen and understood, just wait until we add the complicated, computer- and central-tabulation required algebra of Ranked Choice Voting to the matter!

Halfway through today's show, the Iowa Democratic Party finally released results from Monday night....well, just 62% of them, incredibly enough. They show Pete Buttigieg and Bernie Sanders in a virtual tie, followed by Elizabeth Warren and then Joe Biden, with Amy Klobuchar not too far behind. But, again, those are only partial numbers, so we don't need to spend too much time on them for now.

We're joined today by the great JOHN NICHOLS of The Nation, just back from Iowa, for an explanation --- and a rant or two --- about all of the above and whether Democratic supporters of several different candidates should be furious...or just breathe...as all of this is ultimately sorted out. There is a lot to discuss with John, who explains why he believes "caucuses suck" and the "scorching, huge damage" this all will have done to the Democratic Party and democracy itself. We agree on some points and disagree on others. But there is just far too much to detail here. So I suggest you just buckle up and tune in today!

Someone needs to let the President of the United States know that Memorial Day is, at least in theory, a somber remembrance for the nation's war dead. It might have been nice if that someone had done so before Trump showed up in Japan over the weekend --- for talks with that nation's Prime Minister --- and wished U.S. troops stationed with our ally and former WWII foe a "Happy Memorial Day!" It certainly wasn't a happy one around many parts of the U.S. for a number of reasons. But, once again, we try to find the bright spots where we can.

Among the swarm of stories covered on today's BradCast [Audio link posted below summary]...

  • The record swarm of tornado swarms continued on Memorial Day, with some 53 twisters touching down in eight different states on the same day. A man in Ohio was killed when a car flew into his living room and at least 130 were reportedly injured in the Buckeye State, where power was knocked out to more than 5 million residents as of Tuesday morning. "Catastrophic" destruction was seen across many states after Monday marked a record-tying 11th straight day with at least eight tornadoes in the U.S. according to NOAA. Whether media outlets connected the virtually unprecedented storms (and month of flooding in the Midwest and Central U.S. that preceded it) to our worsening climate crisis is another matter entirely;
  • Speaking of Ohio, at least before the storms, a KKK rally on Saturday brought out 9 Klansmen and between 500 and 600 counter-protesters. At least the folks in Dayton got that one right, if not some of their responses to emergency interruptions during their favorite TV programs as tornadoes swept through the state on Monday;
  • And, speaking of getting it wrong, there is the far-right evangelist Franklin Graham, son of the late, respected minister Billy Graham. Franklin, a Trump supporter who has attacked Indiana Mayor and 2020 hopeful Pete Buttigieg for being both gay and a practicing Christian at the same time, used his tax-exempt religious pulpit to call for "Christian leaders" to declare a "day of prayer" next Sunday for Donald Trump, who, Franklin says, has been "attacked" by his "enemies" more than "any President in the history of this nation". President Abraham Lincoln dissents;
  • As the loony right rises, or tries to, we move out west to Fresno, California, which, as we reportedly exclusively back in 2013, single-handedly blocked an attempted statewide "recount" of Prop 37, a state ballot initiative that would have required the labeling of GMO foods. The wingnuttery in Fresno continued over the weekend, as its minor league baseball franchise, the Fresno Grizzlies, "celebrated" Memorial Day with a video tribute that featured a speech by Ronald Reagan and a montage of Americas "enemies" that included Kim Jong Un, Fidel Castro and....wait for it....New York's Democratic freshman Rep. Alexandria Ocasio-Cortez. The team eventually apologized to AOC --- hours after their initial apology for the video itself --- though they never bothered to mention that, among other "enemies" shown in the 3 and a half minute video played at the ballpark, anti-fascism and anti-KKK marchers were also singled out. 'Happy' Memorial Day!;
  • In voting news over the long weekend....the U.S. Supreme Court on Friday put on hold two different earlier rulings from lower federal appeals courts finding that Republicans in both Ohio and Michigan had unconstitutionally gerrymandered their Congressional maps for the past decade. The high court's action was issued without comment as we await their pending decisions on two similar cases the Justices heard earlier this year regarding unlawful partisan gerrymanders in North Carolina and Maryland. That may be a bad omen for those two cases. But, for now, the SCOTUS order blocks the lower court orders to draw new, fair Congressional maps for 2020 in Ohio by June 14 and in Michigan (where new state legislative districts were also ordered) by August 1;
  • There was better news, for a change, in the state of Texas of all places. The state's legislative session ended on Monday without confirmation of the nomination of Gov. Greg Abbott's Secretary of State David Whitley, thanks to all Senate Democrats refusing to support him. Whitley was forced to resign without the confirmation, which was withheld after the unqualified former travel aid to Abbott had falsely announced in January that 100,000 non-citizens were registered to vote in Texas, with 58,000 of them having illegally cast votes since 1996. As it turns out, most of those voters had become naturalized citizens over that period. But that didn't prevent Whitley from instructing the state's County Clerks to purge voters in 30 days unless they could prove their citizenship or from referring the case to the TX Attorney General who promptly ordered criminal investigations for his own part in the attempted purge. The state was sued by three different voting rights groups and a number of naturalized citizens. They were forced to settle by changing voter roll purge rules for the future and paying some $450,000 to plaintiffs for their legal costs and fees;
  • Finally today, with at least 24 candidates vying for the 2020 Democratic presidential nomination and debates set to begin next month, voters have been sizing up how the hopefuls might take on Donald Trump next year (presuming he's the GOP nominee) if they win the nod. Last week, during a Washington Post forum, South Bend, IN Mayor Buttigieg, who was deployed to Afghanistan in the Naval Reserves, cited Trump's draft dodging due to a claimed "disability" during the Vietnam War. When asked about his comments over the weekend on ABC's This Week, rather than backing off of them, Buttigieg doubled-down, revealing a) Trump was, indeed, a draft dodger who now pretends to revere the military, but who was willing to let someone else take his place in Vietnam and b) Mayor Pete is not afraid to stand up, at least rhetorically, to the bully who has become the President of the United States, even after some in the media attempted (as they do) to try and call him out for it...

Guest: Ernest A. Canning; Also: GOP 'Green Party' dirty tricks in MT's U.S. Senate race; And, the movement to repeal the 2nd Amendment...

On today's BradCast: GOP dirty tricks in Montana; why an alleged torturer should be imprisoned rather than promoted to CIA chief; and, abolishing the 2nd Amendment all together. [Audio link to show follows below.]

First up: Senate Majority Leader Mitch McConnell admitted this week that stealing a Republican majority on the U.S. Supreme Court was his crowning achievement after three decades in Congress. But he's not done packing the federal courts just yet for another generation, which underscores his urgency in trying to hang on to the GOP's thin majority in the U.S. Senate this November.

That may also help to explain the bizarre situation in Montana's U.S. Senate race, where the GOP appears to have ginned up a fake Green Party candidate who was previously on the state Republican Party's payroll, in hopes of siphoning votes away from Democratic Sen. Jon Tester in an otherwise very Trumpy state. (But did the Dems do something similar in supporting a Libertarian candidate for the U.S. Senate back in 2012, the last time Tester was on the ballot?)

Meanwhile, the Senate returns from their recess next week, and will soon begin confirmation hearings for a number of recent high-level Trump cabinet and executive agency nominees. Among them is Gina Haspel, the CIA's Deputy Director who has been tapped to take Mike Pompeo's spot as CIA chief (after Pompeo was nominated to become the new Sec. of State following Trump's firing of Rex Tillerson.)

Haspel, however, was the CIA's chief of a secret U.S. prison in Thailand following the 9/11 attacks, where a number of terror suspects were tortured in 2002, in violation of long-held international treaties, to which the U.S. has been a party, at least, since the days of Ronald Reagan. She also reportedly signed off on the destruction of the video-taped evidence that documented the horrific torture by the U.S. at that prison.

We're joined today by ERNEST A. CANNING, attorney and longtime BRAD BLOG legal analyst, for whom the matter of someone alleged to have overseen torture becoming the next CIA director is very personal.

Canning's father, as he detailed in a recent article, was imprisoned and waterboarded by the Japanese during WWII, before testifying against his torturers during the war crimes trials held by the Allies after the war. We discuss what happened to his father at the hands of the Japanese command of the notorious Bridge House prison, why the U.S. has long held torture to be a violation of international law, and how the Democrats' failure to demand accountability of Bush-era torturers has resulted in Haspel's nomination, rather than imprisonment.

He explains that while the Japanese general in charge of the notorious Shanghai prison "did not personally take part in my father's torture, he was sentenced to a life sentence under a principle called 'command responsibility'. He had command responsibility over the people who were carrying out torture in an agency that he was responsible for. And if you use that same principle of 'command responsibility', which remains viable under intentional law today, Gina Haspel should be in prison. She should not be coming before the Senate to be confirmed as the CIA's next director. And, I think it's a slap in the face of everybody who has ever undergone such horrific treatment that Donald Trump would nominate her."

(Also, just to lighten things up a bit, I also get Ernie's take on Trump's asinine and evidence-free reiteration in West Virginia on Thursday, that millions of fraudulent votes accounted for his 3 million vote loss to Hillary Clinton in the 2016 popular vote count.)

Finally, a federal judge in Massachusetts on Friday upheld the state's ban on military-style assault weapons. And we share some listener mail in response to retired U.S. Supreme Court Justice John Paul Stevens' op-ed last week, wherein he suggested that it's time to repeal the 2nd Amendment to the U.S. Constitution...

Before this disappears into the ether of the memory hole, since the the history books tend to be written by the "winners", here's what the actual, contemporaneous, independently verifiable evidence shows instead. These are not the "alternative facts", as Kellyanne Conway described what new Whitehouse Press Secretary Sean Spicer and his boss have been trying to sell, but what the demonstrable facts actually show.

The turnout for the Womens' March in D.C. alone on Saturday, dwarfed the attendance at Donald Trump's Inauguration the day before. The official estimate from the Washington Metropolitan Area Transit Authority finds Saturday was the second-busiest day ever for the D.C. Metro rail system, bested only by the first Inauguration of Barack Obama in 2009. Ridership for Trump's Inauguration was even lighter than the average workday in the nation's capital...

According to crowd scientists (yes, apparently there is such a thing), the Womens' March was about three times the size of Trump's Inauguration which was, in turn, also dwarfed by each of Obama's two Inaugurations, but particularly his first one. Based on analysis of photos and video taken at the National Mall and the surrounding areas, Marcel Altenburg and Keith Still, crowd scientists at Manchester Metropolitan University in Britain, "estimated that there were about 160,000 people in those areas in the hour leading up to Mr. Trump’s speech Friday. ... They estimated that at least 470,000 people were at the women’s march in Washington in the areas on and near the mall at about 2 p.m. Saturday."

That, in contradiction to the new Alt-Fact President, who insisted the crowd at his ceremony on Friday "looked like a million, a million and a half people," and that the area "all the way back to the Washington Monument was packed." Once again, actual evidence suggests that wasn't the case, by a long shot.

Here, for the record, is just some of the actual evidence --- high quality photos taken from the Washington Monument, at both Obama's 2009 Inauguration and Trump's 2017 ceremony, "captured 45 minutes before the respective oaths of office, show[ing] areas that were crowded with people at Mr. Obama’s inauguration that were clearly empty during Mr. Trump's"...

On today's BradCast, the last one before Election Day(!), we debunk a lot of nonsense --- and out-and-out lies from the Donald Trump Campaign, in several instances --- from over the weekend and in to today. [Audio link to show is posted below.]

Among the stories and avalanche of news covered on today's BradCast:

  • FBI Director James Comey confirms there is nothing in newly discovered emails (most of them duplicates they'd seen before) that would lead to an indictment of Hillary Clinton;
  • And, no, there is no "murdered FBI agent" involved, no matter what you saw on Facebook over the weekend;
  • There was also no "assassination attempt" on Trump in Reno, NV over the weekend by a Republican sign-holder despite his campaign suggesting otherwise;
  • There was, however, a Trump supporter with a gun intimidating voters outside a VA polling location;
  • There appears to be record early voting turnout in dozens of states, and notably in Hispanic areas, where Trump's campaign blatantly lied over the weekend about polls being kept open "illegally" after hours;
  • Nathan Sproul, a long-time GOP operative whose companies have a checkered past related to voter registration fraud in several states, was secretly hired by the RNC in 2012 and then fired once more fraud allegations became public. He's now been quietly hired again by the RNC and Trump camp in 2016;
  • Dems lose several 'voter intimidation' lawsuits against Trump (but may have actually won anyway);
  • There will be at least 868 fewer places to vote in 2016, thanks to SCOTUS gutting Voting Rights Act
  • Kansas Sec. of State Kris Kobach is ordered (yet again, and hopefully once and for all!) to allow all registered voters to vote in both state and federal elections;
  • North Carolina is ordered by a federal court to restore all unlawfully purged voters to the rolls before Election Day;

And, much more, as we head into Election Day together, near the end (hopefully?) one of the darkest and most insane cycles in U.S. history...

From Smartmatic to Diebold: Responding (yet again) to partisan worries of vote flips and voting machine ownership...

It's that time of the election cycle again. Happens every four years. (Every two, actually.) On today's BradCast: That moment when partisans on the Right declare Democrats are stealing the election with voting machines owned by George Soros and Democrats worry that Republicans are doing the same via private companies actually owned by big GOP supporters. [Audio link posted below.]

Both sides see votes flipping on touch-screen systems to their opponents. Both sides declare it only happens to their chosen party. Both sides have reason to worry about private ownership of our electoral systems. Both sides tend to be very selective about their concerns. And both sides do nothing about it until it's time to start freaking out again just before the next election.

The old, previously debunked charge that the progressive billionaire Soros is somehow controlling voting machines across the U.S. re-appeared yet again in the Rightwingosphere over the weekend, only slightly modified from its 2012 version. This time it has resulted in a petition to WhiteHouse.gov --- so far, signed by more than 70,000 since it was posted late last week --- demanding "congress meet in emergency session about removing George Soros owned voting machines from 16 states."

But, of course, as we noted back in 2012, when Democrats were concerned about the actual ownership of voting machine company Hart Intercivic by associates of Mitt Romney, Soros does not own any companies with voting machines in the U.S. He doesn't own any companies with voting machines used elsewhere either, to my knowledge. But the original seed for the persistently false rumor seems to have been planted, in no small part, by The BRAD BLOG's exclusive coverage way back in 2008 of a Venezuelan voting machine company named Smartmatic --- once believed linked to Hugo Chavez --- and their secret ownership of the Intellectual Property (IP) used in voting machines made by Sequoia Voting Systems. Many of those machines are still used in about 15 states across the country.

Sequoia has since been purchased by a Canadian firm named Dominion Voting, which, like Sequoia before it, lied about Smartmatic's ownership of IP used in Sequoia's machines. But, as I explain on today's program, it could hardly be further removed from Soros who, as it turns out, has absolutely no stake in Smartmatic or any of the other vote counting companies deployed in the U.S..

But, like Democrats, Republicans have every right and reason to be concerned about the obscene private corporate ownership of our nation's public voting and tabulation machinery. (Please petition Whitehouse.gov about that!) As I noted to a reporter seeking comment about the concerns about Romney's ties to Hart Intercivic around this same exact time before the 2012 Presidential Election...

Once again, we're reminded of the dangers of the privatization of our once-public electoral system. The company's ties to Romney aren't the only disturbing ones we've seen with similar companies over the years. The fact is, that nobody other than the public should have any sort of control of our elections. The proprietary voting systems now in use in all 50 states, whether owned by Romney associates, a George W. Bush associate (as with Diebold in 2004) or even a company tied to Venezuela's Hugo Chavez (as with Sequoia Voting Systems which blatantly lied about that tie to public officials, and the Canadian firm Dominion which purchased Sequoia and also immediately lied about the fact that Intellectual Property of their voting systems used all across the U.S. is still owned by the Venezuelan firm), continue to be a grave threat to American democracy and confidence in U.S. Elections.

And, like similar clockwork, once again this year we are now hearing the shouts about touch-screen voting machines flipping Democratic to Republican and Republican to Democratic --- and the claims from partisans on both sides that "this only ever happens to Republicans/Democrats!" --- as early voting gets underway in a number of states. Is there legitimate reason to worry about such votes flipping? The answer is both yes and no, with reason for all of us to be ashamed, as I explain on the show today.

Guest: Palm Beach County, FL Election Supervisor Susan Bucher...

On today's BradCast, "this is not normal, this is not politics as usual", Michelle Obama declared. But, at least in Palm Beach County, FL, after last week's hurricane, the top election official says she's ready for whatever storm may be coming. [Audio to the complete show is linked below.]

I'm joined today by Susan Bucher, Palm Beach County, FL Supervisor of Elections, to discuss preparations for late voter registrations following Hurricane Matthew and what she suspects may be record turnout in Early and Election Day voting. She describes yesterday's court order to extend the registration period until October 18th as "a victory for all Floridians," and says that, despite the tight deadlines now before early voting begins on October 24th, her county is ready.

"We're a tough state, we're a tough county --- and we've been working overtime for a month to make sure we're ready for the big push. We opened our doors on the holiday on Monday. We were just slammed with lots of people all day. We opened early, we stayed late. All of our employees have been working overtime. We will get it done before early voting starts," she vows.

"Millennials now outnumber senior citizens and nearly half the voters under 30 are Latino or African-American," Bucher explains. "And, especially after the last debate, we saw a very large push of citizens out there. There are young people registering voters and bringing us stacks [of registrations] that are a foot deep. People are very anxious about this election. We have 880,000 voters and, let me tell you, I have never seen it so supercharged as I see it now. The last Presidential turnout was 70 percent. We're setting up for about 80-85 and maybe more."

Her county was, before she arrived eight years ago, made infamous for its Butterfly Ballot disaster during Florida's 2000 Presidential election debacle, one of the "original sins" leading us directly to the poisonous politics of the 2016 Presidential Election, as I detail once again on today's show. But Bucher says she ready, as we revisit more recent disasters in her county and state, such as Republican Governor Rick Scott's failed attempt to unlawfully purge thousands of legitimate voters from the rolls in 2012; the 6-hour long lines to vote that same year, after Scott cut the number of Early Voting days in half; and the paper ballot computer tabulators which incorrectly reported the results of three races in Palm Beach, declaring losing candidates to be "winners" back in 2010.

(Bucher tells me the software failures in those Sequoia tabulators have now been corrected in her county, but says she has many checks and balances in place, and is ready to go to court to get approval once again for hand-counting, if necessary, as she did in 2010 when she happened to notice the strange results. The state does not allow a hand-count of paper ballots without a court order. "It's unfortunate that it always takes court action with this Governor and this Secretary [of State] but if that's what works, then that's what we need to do," she tells me, going on to describe the recent conference call with the U.S. Dept. of Homeland Security regarding concerns of hacks to voting and registration systems in the Sunshine State and elsewhere around the country.)

Meanwhile, in Georgia, as in Florida, voting rights groups filed suit to extend the voter registration deadline there as well, following mandatory evacuations over the final weekend of voter registration.

Also today, hear them roar: Sen. On today's BradCast, Al Gore returns to the scene of the 2000 crime in Florida, and so do we, as the fight to vote in the Sunshine State starts all over again. Because of course it does. [Audio link to show posted below.]

Hillary Clinton appears to have opened up a strong lead in national polls following the release of Donald Trump's 2005 'hot mic' tape lewdly boasting about sexually assaulting women. But the Presidential Debate on Sunday may have staunched some of the bleeding for now, as RNC Chair Reince Priebus announces they are standing by their man. Either way, if Trump is to win the White House, he must first take the state of Florida, where his ally, Republican Governor Rick Scott ordered the evacuation of millions last Thursday before Hurricane Matthew tore up the state's east coast.

In the bargain, voter registration drives were canceled on what had been set as the final weekend before the state's deadline to register. Scott --- with a very long and very unfriendly history towards voters --- refused to extend that deadline. Democrats sued [PDF], and a federal judge, who described the state's "irrational" reasons for not extending as "poppycock", has pushed today's deadline to Wednesday, pending a hearing scheduled for tomorrow when he may take further measures.

Election expert Dr. Daniel A. Smith, PhD, President and founder of ElectionSmith, Inc and University of Florida Research Foundation Professor of Political Science joins us to explain why extending the state's "arbitrary deadline" is so important, and to detail some of the empirical numbers and many concerns facing voters and would-be voters in the Sunshine State. For example, in 2012, as he notes, during roughly the same period in which this year's storm sent Floridians scrambling for safety, more than 116,000 new (and disproportionately Democratic-leaning) voters signed up to vote. That, even as many are just now returning home and dealing with flooding and other more pressing concerns in the aftermath of the Matthew.

"We looked at the last five or six days of voter registration prior to that cutoff [in 2012] and the numbers actually jumped out at me. On the last day of voter registration back in 2012 there were at least 64,000 people who registered to vote. On the last day!," he says. President Obama ending up winning Florida that year by just 73,000 votes.

And what of those who did manage to register and get their form into a mailbox mail before evacuating? "Who knows what happened to that mailbox?," Smith observes. Those forms "might not even be processed at all, because it's lost. We don't know. These individuals will have no recourse if they finally get back online and see that they're not registered, if that registration application doesn't get to the Supervisor's office."

We cover quite a bit in the conversation, including Gov. Scott's sorry history of taking extraordinary measures to make both voting and registration more difficult in Florida (remember those ridiculous 6-hour lines for Early Voting in 2012?), the fact that just 117 new voter registration forms have been turned in by the state GOP in the past month, as well as Smith's take on voter fraud and the likelihood of inappropriately purged voting rolls in Florida and other states around the nation. "When we talk about voter fraud in this country, it's really not at the retail level of individuals coming into the polls and falsifying their identity and voting twice or maybe three times. That rarely, if ever happens," he says. "Where we actually do have some concerns is that on the wholesale level, in which it's usually someone in a Supervisor's office, a clerk, or someone is --- it can be malicious, it can be just accidental - cleaning the records in a way that is not permissible under federal law . We certainly had that in 2012, when it was the directive of the [Florida] Sec. of State's office to the Supervisors of Elections. First, some 180,000 individuals who they suspected as being 'non-citizens', and then ultimately 2,625 individuals who they flagged as being potential non-citizens. Most of those were actually citizens."

On today's BradCast, Trump's "charitable" foundation gets shut down by law enforcement, two major (unusual) hurricanes threaten millions, and actual fact-checks from one side of this nightmarish election to the other. [Audio link posted below.]

Among the stories covered on today's program...

• "The Trump Foundation must immediately cease soliciting contributions or engaging in any other fundraising activities in New York," according to the letter from New York state Attorney General Eric Schneiderman's office, warning that the GOP nominee's charity "shall be deemed a continuing fraud upon the people of New York" unless it provides required paperwork regarding fundraising activities within the next 15 days.
• Two major hurricanes threatening island nations in both the Atlantic and Pacific.
• Much-needed fact-checking on the misreporting and purposeful mischaracterization of comments made at a February fundraiser by Hillary Clinton.
• More much-needed fact-checking on the misleading (and potentially illegal) comments made by Trump regarding long ago debunked 2012 "voter fraud" in Pennsylvania (which even Philadelphia Republicans are getting sick to death of) and details on why Trump is now being so careful about the words he is using to urge supporters to go to "certain areas" and "watch" the polls.
Updates on the state of Wisconsin's failure to follow federal court orders concerning their discriminatory Photo ID voting restrictions. (More on this in last Friday's show.)
More concerns about the possibility of hacked voting, voter registration and tabulation systems resulting in potential chaos this November 8th.

Today on The BradCast: Where the Presidential race stands as we head into the debates and how an ingenious GOP scheme in 2010 may have served to undermine (small-d) democracy in the U.S. for a decade or more. [Audio link posted below.]

As Hillary Clinton and Donald Trump prepare to face off in their first Presidential debate, national polls are now, largely --- and amazingly --- a dead heat, with Trump beginning to take the lead in several key states that would give him the Presidency.

Meanwhile, as Dems struggle to hold on to the White House and fight long and longer odds to regain control of the U.S. Senate, a majority in the U.S. House, once again, remains seemingly out of grasp entirely for Democrats despite their candidates and policies being far more popular amongst the national electorate.

David Daley, until recently the Editor in Chief at Salon, now a Fellow at the University of Georgia's Grady School of Journalism, joins me on today's BradCast to discuss his new book, Ratf**ked: The True Story Behind the Secret Plan to Steal America's Democracy. In it, Daley documents "Operation REDMAP", the insidious (and brilliant) Republican scheme carried out with a few million dollars and a handful of GOP operatives back in 2010 that succeeded in putting the U.S. House out of reach for Democrats for a decade --- while they were still celebrating their 2008 victory and barely paying attention to what Republicans were up to.

"It is nothing short of the most audacious political heist of our time," Daley tells me. "The Republican State Leadership Committee, they realize that 2008 might have been a wipe-out for the Republicans, but that did not matter if they could win in 2010. Because the census requires that you redraw every district line in every state legislature and in the Congress every ten years they came up with a brand new idea."

That successful idea in 2010 resulted in Democrats receiving 1.4 million more votes than Republicans for their U.S. House candidates in 2012, while still losing control of the chamber to Republicans by 33 seats. "The party completely fell asleep at the wheel," he says, allowing "an overwhelming avalanche of dark money and negative ads, into these small little towns" that would determine control of state legislatures, followed by an unprecedented computer-aided gerrymander of every GOP controlled state in the nation. That, in turn, led to the seemingly uncrackable Republican majority in the House that has served to bastardize so much of our national politics through today.

"The Democrats didn't have the imagination to come up with this idea," Daley argues. "It is entirely legal. However, it is also entirely and deeply undemocratic." The GOP came up with "a partisan hammer to take control and hold it," in what Daley describes as nothing short of a "political moneyball" plan that would "lock in partisan control of a chamber [of Congress] for a decade or more."

Guest: Campaign Legal Center's Brendan Fischer on smoking gun emails leaked from quashed state criminal probe of Wisconsin's Governor...

Today on The BradCast, startling revelations from the massive document dump of emails and other materials from the currently-quashed state criminal investigation into Wisconsin Gov. Scott Walker's 2012 recall election fundraising. [Audio link to show posted below.]

The Guardian's remarkable 1,300 page leak of documents from the so-called "John Doe investigation" of Walker's illegal collusion with "independent" third-party non-profit groups is, in many ways, jaw-dropping. As we discuss on today's show, in addition to that collusion, the leaked emails also reveal state GOP operatives preparing to declare massive Democratic voter fraud, without a shred of evidence in support, in order to try and win a very close 2011 election for state Supreme Court Justice David Prosser. The rightwing Justice would ultimately ensure a Walker-friendly majority on the court to support the Governor's controversial union-busting law.

"Do we need to start messaging 'widespread reports of election fraud' so we are positively set up for the recount regardless of the final number? I obviously think we should," writes one of the GOP operatives in one of the emails as results from the tight race came in. "Talk radio needs to scream the Dems are trying to steal the race...We need to declare victory first so it appears that the results are being overturned if they go the wrong way." Sound familiar?

[You can see what came of that recount, which we covered extensively back in 2011, including exclusives revealing, among other irregularities, ballot bags ripped and discovered "wide open" with mismatched or missing serial numbers as well as ballots found completely unsecured and other similar messes and mistallies across the state. My 2011 interview with Prosser's challenger, then Asst. Attorney General Joanne Kloppenburg, after she was ultimately forced to concede, thanks in no small part to the dishonest scheming applied by the operatives cited above, is right here.]

Attorney Brendan Fischer, Associate Counsel at the Campaign Legal Center in D.C., joins us to help unpack the breathtaking smoking guns revealed by these newly-disclosed documents, after the state's probe of Walker was shut down by the very same elected Justices on the state Supreme Court whose elections were funded by the exact same corporate millionaire and billionaire donors and illegal mechanisms revealed by the quashed documents. Yes, it makes my head spin too.

"These documents show the breadth of the coordination scheme that Walker was engaged in," Fischer tells me. "It shows that what the Republican and Democratic prosecutors in Wisconsin were looking into with this investigation was really significant. It was a broad scheme to evade the state's corporate contribution limits and disclosure requirements. And that was very explicit. The purpose of Walker coordinating was to evade disclosure laws, to allow corporations and controversial donors to support Walkers' re-election without any sort of public disclosure or public accountability. That was not a bug in this coordination scheme, that was the purpose from the beginning. And the emails show that very clearly."

You really need to listen to today's show to get the full picture of what happened, and how this scheme has served as a template for GOP elections all over the country now (including the very same donors behind Donald Trump's campaign and, indeed, as we learn, including Trump himself who gave money to the "independent" Wisconsin Club for Growth on the very same day he met with Walker in NYC.) Fischer also describes, for example, the lead paint manufacturer who secretly donated $750,000 to the tax-exempt, non-profit "social welfare" group before state Republicans slipped in a provision to a budget bill that granted immunity to his company in the face of lawsuits from hundreds of children poisoned by the paint. "The public was unable to connect the dots between the secret three-quarters of a million dollar contributions to Wisconsin Club for Growth and the later policy decisions that Walker took" on behalf of the donor, explains Fischer.

"Bigger picture, this is one of those rare snapshots into how 'dark money' works," he says. "When you look at these documents, the two [Walker and WCfG] are interchangeable. This was not an instance where Walker's campaign had a few conversations here and there with Wisconsin Club for Growth Officials...Wisconsin Club for Growth was an arm of the Walker campaign."

Fischer also goes on to explain what we might expect as the U.S. Supreme Court considers a motion that could re-open the state's criminal probe later this month. Even if I say so myself, it's a must-listen BradCast today...
