Repubs rollover for unqualified Trump pick to lead Pentagon, help suppress FBI report on serious allegations; Also: Latest on L.A. Fires...

Today on The BradCast: The first of what will likely be a series of contentious U.S. Senate advice and consent hearings for key cabinet nominees tapped for the second Trump Administration. Tomorrow seven such hearings are scheduled, most of them overlapping with each other, purposely making public oversight even more difficult. [Audio link to full show follows below this summary.]

Fox "News" weekend host, National Guardsman, accused sexual assaulter, womanizer and public drunkard Pete Hegseth faced a grilling from U.S. Senate Democrats on the Armed Services Committee on Tuesday, even as they were constrained by Republicans who agreed to just one single round of questioning, with just seven minutes for each member. They also refused to share an FBI background report on Hegseth with rank-and-file Committee members.

That, after Hegseth similarly refused to meet directly with any Democratic Senators on the panel in advance of today's hearing, which is usually the custom for such high-profile nominations. Moreover, late on Monday night, the New York Times reported that --- similar to the 2018 report compiled on sexual assault allegations against Justice Brett Kavanaugh during his Senate nomination hearings --- the FBI failed to conduct in-depth interviews with critical witnesses, such as Hegseth's second of three wives, who have made disturbing allegations against him.

The Times observes that Trump's transition team "commissioned the F.B.I. background check on Mr. Hegseth last month after initially floating the idea of hiring private contractors to look into the president-elect's cabinet picks. As the client, presidential transition teams are traditionally able to set the parameters for background checks into cabinet picks, and potentially dictate which witnesses are interviewed and what questions are asked."

Taken together --- as we do on today's show with extended excerpts from today's hearing --- the allegations against the wildly unqualified and ill-considered Hegseth are simply mind-blowing, particularly for such a key role as leader of the Pentagon's three million employees and oversight of its annual $850 billion budget. The Trump nominee has no experience at the Pentagon, much less leading an organization with more than 40 or so employees. And, he's faced allegations of financial mismanagement at both of the veterans non-profits he has overseen, along with a long list of other charges, including rape, that he defiantly (and inaccurately) described at today's hearing as coming from "anonymous sources."

Still, it became clear throughout the hearing that Hegseth would face no resistance whatsoever from any Republican on the panel, including military vet and sexual assault survivor Sen. Joni Ernst of Iowa. Shortly after the hearing, she declared her intention to vote to confirm the 44-year old Trump nominee who has repeatedly asserted that women have no place in military combat roles.

Finally, we've got late updates in the still-raging Los Angeles Fires out here, where officials gained a measure of additional containment of the two major blazes --- in Pacific Palisades near the coast and of the Eaton fire, inland in Altadena and Pasadena --- in recent days. However, the National Weather Service issued yet another "Particularly Dangerous Situation" warning overnight for parts of L.A. as strong Santa Ana winds are expected to kick up again tonight and throughout early Wednesday. As we saw last week, that could result in explosive new fires or the quick expansion of those that are now entering a second week of disaster, destruction and death.

Desi Doyen joins us or our latest Green News Report with additional concerns about the fallout from those toxic, climate change-fueled conflagrations, even as Donald Trump and Republicans spread massive disinformation about them and threaten to withhold federal disaster aid from California...

Guest: Former U.S. Army Captain Sue Fulton of Sparta...

On today's BradCast: With millions of Americans imperiled by a massive, potentially "catastrophic" hurricane tonight, the President of the United States took the moment to give the finger to the Pentagon by signing a ban on transgender service members in the military. [Audio link to show follows below.]

(Note: Giving the finger to the federal court system and the U.S. Constitution itself, with a pardon of the reviled Sheriff Joe Arpaio, didn't happen until the hurricane became a Category 4 and we were already off air today.)

First today, Hurricane Harvey is set to slam into the Texas Gulf coast as dire warnings are issued by the National Weather Service that some areas may be "uninhabitable for weeks or months" thereafter. The startling language in the forecasts echo that not heard since it was used by in the extraordinary NWS warning issued prior to Hurricane Katrina in 2005, 12 years ago this week (as we also covered on air at the time).

Our own Desi Doyen --- a native of south Texas herself --- explains the concerns of changing, global warming-fueled weather patterns that are leading forecasters to predict that Harvey may stall in place for days, dropping massive amounts of rainfall (as much as 40 inches in some places) over the next several days, before the storm could move back out to the Gulf only to return for a second landfall. Are state and federal officials --- with many key posts still unfilled by Trump --- fully prepared for what's to come?

Then, we're joined by SUE FULTON, former President of Sparta, an organization supporting lesbian, gay, bisexual and transgender members of the military and their families, to discuss Donald Trump's recent surprise Twitter-announcement that "The United States government will not accept or allow transgender individuals to serve in any capacity in the U.S. military."

Fulton, a former U.S. Army Captain and a member of the first coed graduating class at West Point, had worked with the Obama Administration's Pentagon on the policy that had previously lifted the ban on openly transgender service members last year. She describes the detailed and meticulous process that had been carried out by the Department of Defense, with stakeholders from every branch, as well as outside organizations, and the military's own interest in carrying out the policy change that Trump is now reversing.

We discuss how Trump's own process to reverse the policy change appears to run precisely counter to the one carried out by Obama, as well as the wishes of military leaders and service members and the vast majority of Americans of all parties. We also discuss why Trump appears to be carrying this reversal out, despite both the success of lifting the ban to date and comparable changes to similar exclusionary policies that had previously barred both women and openly gay members.

Fulton has a lot to share and inform us about all of this. I strongly recommend tuning in for today's show in full.

For now, however, especially with all of the breaking news I'm still trying to follow tonight, I'll share just this one quote from Fulton for now: "[The Pentagon] did not make this decision to open transgender service willy-nilly --- they made it based on their judgment about military readiness. That's as it should be. I hear people telling me, 'This should be about military readiness', and the answer is: this is absolutely about readiness. This is about having the strongest, most effective military force that we can muster to protect and defend the interests of the United States. And, as part of that, the Pentagon has determined that allowing transgender people to serve --- to keeping that talent within the armed forces, and continuing to recruit talent from as broad a pool as possible --- is right, is the best thing to create this strongest possible force. And that decision was made carefully. Now that decision is being overthrown based on no evidence. In fact, based on saying that the evidence that the Pentagon itself uncovered and determined to be accurate should somehow be thrown out the window."

Then, as luck would have it, no sooner did I finish speaking with Fulton, then news broke late today that, in fact, Trump has made good on his threat and has officially signed new guidance, ordering the Pentagon to proceed with restoration of the ban on transgender service members.

That, just days after calling for "unity" in the country, and telling members of the military at Fort Myers: "Every person who puts on the uniform makes our nation proud. They all come from across our land. They represent every race, ethnicity, and creed. But they all pledge the same oath, fight for the same cause, and operate as one team --- with one shared sense of purpose."

What an extraordinary monster. And I'm being very polite here...

On today's BradCast: While the national media is obsessed with Trump, a record amount of dark money from undisclosed corporate sources is being spent on judicial elections at state Supreme Courts. Also: A whole lotta other breaking news today, from a new development in the Hillary Clinton email probe, to some white, armed hooligan wingnuts getting off the hook for an armed federal takeover, to one U.S. Senator likely killing his own re-election chances during a debate last night. On today's interview, Alicia Bannon, Senior Counsel at the Brennan Center's Democracy Program, joins us to explain the flood of outside spending from corporate, dark money sources now pouring in to state Supreme Court elections around the country, as detailed in her new analysis published this week. We also discuss the disturbingly increasing politicization of judicial elections and why it is that judges are selected by elections at all in some 38 states.

"Around the country, we've been seeing these elections become higher cost, more politicized, and attracting a lot of special interest attention," she tells me. And that's worrying, because, among other reasons, "a judge needs to be deciding cases based on their understanding of what the law requires and the facts that are in front of them, and not out of fears of what that's going to mean for fundraising in the next election cycle, or what's going to be the subject of their next attack ad."

While judicial elections "were actually a reform measure," when originally introduced in the 19th century because "there was a concern that those judges were too closely aligned with the political branches," Bannon explains, in the wake of Citizens United and other measures that have increased the flow of money into politics, judicial elections, "are putting even more pressure on judges because of the money involved and the conflicts of interest that get created."

We go on to discuss a number of such judicial conflicts of interests, from the remarkable case of the state Supreme Court in Wisconsin to the election that will determine the balance of the Supreme Court in North Carolina next week, to the judicial campaign being funded in no small part by fossil fuel interests in Louisiana, where the same corporate funders are facing legacy environmental cases to be decided by the very same court.

Bannon, who also clerked for Sondra Sotomayor when she was an appellate judge on the U.S. 2nd Circuit Court of Appeals, also shares a bit of personal insight on the U.S. Supreme Court Justice.

Also today: The FBI notifies the U.S. Senate that they have found some additional emails in a separate investigation that may relate to their probe of Hillary Clinton's email server and the cable "news" industry predictably freaks out; The Bundy Brothers are acquitted at trial, for some reason, after their six-week armed takeover of a federal wildlife facility in Oregon earlier this year; Donald Trump fails to put up the $100 million he had promised to his own campaign; and Illinois Sen. Mark Kirk (R) offers an outrageously obnoxious racial slur during a debate with his opponent, double-amputee Iraq War veteran Rep. Tammy Duckworth (D)...
