Today on The BradCast: Escaping MAGA and whether real accountability for the former President's many crimes and civil verdicts might finally begin to bend the curve against him from within his own party and from his own supporters. [Audio link to full show follows this summary.]

On Friday, a nine-member federal jury in New York ordered Donald Trump to pay an additional $83.3 million to writer E. Jean Carroll, who an earlier 9-member jury determined last year that he had sexually assaulted and repeatedly defamed. The original verdict cost him $5 million, but wasn't enough to stop the repeated defamation of Carroll.

All of this comes on the cusp of a completely separate verdict in a state case in NY where the judge has already determined Trump committed massive fraud by falsely inflating his assets to receive more favorable rates on bank loans, insurance and taxes. The State A.G. has asked that the judge now find Trump and his companies and his top executives (including his two eldest sons) liable for at least $370 million. That ruling is likely to come any day now.

A hundred million here, a hundred million there, and, before ya know it, you're talking about real money. Even for a "billionaire" like Trump. But will any of it make a difference to Trump's most ardent supporters? How about the few Republicans left who are neither Never Trumpers nor hardcore MAGA? Will they finally take notice? Might these rulings begin to make a difference in GOP primary polling, as the disgraced former President continues to be the party's front-running nominee for the 2024 Presidential election?

For thoughts on all of that and much more, we're delighted to be joined again today by RICH LOGIS, a former hardcore MAGA member himself who voted for Trump in both 2016 and 2020, before eventually coming to terms with the fact that he had become captive to what is a far-right political cult. (Our first conversation with him, with more details on that, was in October last year.)

Logis now runs PerfectOurUnion.us, devoted to "healing political trauma" and "building diverse, pro-democracy alliances". Today, he offers his insight, as a reformed MAGA member and former Republican pundit, on whether any of the recent verdicts against Trump --- and/or those that are still to come in the four separate criminal felony cases he is facing this year --- might finally begin to turn the tide away from the GOP's cult leader.

We also discuss Logis' thoughts published recently at Salon, on why the MAGA crowd is so gullible to mythologization and race-baiting, and how even Nikki Haley is now tapping into the same bloodstream to capitalize on a party that has long been captured (well before Trump) by racist polarization and "White fright".

Logis is now creating a new organization specifically devoted to "Leaving MAGA" and we begin the important discussion of how to help those captured by MAGA find their way out, and what friends and family members may be able to do to begin helping their loved ones find their way home.

"As someone who was in MAGA for seven years," he tells me, "Most MAGA voters are good people, deep down. But, unfortunately, the relationship between most MAGA Americans and Donald Trump is a very toxic one. While I don't defend ignorance, MAGA Americans have been traumatized by Trump and the rightwing and the Republican Party. They just have a skill set at keeping MAGA Americans desperate and panicked."

But, he insists optimistically, "if someone got into MAGA, they can get out of it." His own catalyst came after coming to terms with the fact that his own Governor, Ron DeSantis, who he had previously supported, was willing to let people die by lying to them about COVID vaccines in 2021.

"If someone who is very pro-MAGA speaks to someone who is very anti-MAGA, I guarantee, if they speak long enough, they're going to find some issues that they have some common ground and agreement on." He cautions, however, that vilification doesn't work. If it did, "everybody would have left at this point."

"It's going to take time," Logis insists. But he believes "there are more out there who are in the nascent stages of remorse. Because ultimately the strength of the numbers in Leaving MAGA will be in how many we can encourage and empower to leave and tell their stories publicly."

No matter what happens in this year's election, the year will be like none other in the U.S. Are the mainstream media --- which arguably helped lead us to our current mess at the edge of a potential collapse of American democracy --- able to meet the challenge? To serve a nation that badly news an unapologetic press able to call out the corrupted without "both sidesing" every issue? That's where we begin on today's BradCast, before covering a whole bunch of accountability for rightwingers and rightwing organizations in recent days and weeks. It seems impossible to believe that the U.S. mainstream media will be able to meet this moment. And yet, there are signs, suggests our guest today, longtime journalist and media critic DAN FROOMKIN of Press Watch, formerly of Washington Post, Huff Post, The Intercept and Harvard's journalism watchdog, the Neiman Foundation.

In a column late last year, Froomkin detailed the "intense internal pressure to defend democracy" that newsrooms will be facing in 2024. The greatest pressure, he reports, is likely to come not from outside those newsrooms, but from inside, where "traditional bosses are still in control," holding fast to "both sides" journalism, but where they are finally being challenged by what he describes as a "silent journalistic majority", an often younger and/or more diverse group of reporters "whose sense of self is defined by more than just not taking sides. It’s defined by informing the public of the truth."

With the stakes now higher than ever, he observes, there are signs, at least, that some in the traditional, unhelpful mainstream are begin to change in order to meet the moment. It's a tall order --- especially after so many decades of failure --- but there are some positive signs that even the traditionalists are beginning to understand the threat posed to American democracy itself by a Republican party which has now all but fallen to the fascistic, autocratic demands of its cult leader.

"The good news --- and it is unusual for me to focus on the good news in the media --- is that I think we're seeing two steps forward, one step back, in that I do see some braver, more honest, more upfront journalism happening on occasion at the major institutions," Froomkin tells me, before adding, "And then every so often, they'll backslide terribly."

He argues that many are "getting really impatient with this 'both-side'-ism, this 'a pox on both your houses' stuff."

"If you talk to any journalist who is not personally invested in the old way of doing things, you'll find that they actually agree with this critique. It is not a radical critique anymore. It is very much a 'How do we do journalism in this day and age?' question. And I think the answer is increasingly becoming that we need to call it out the way we see it. And that we need to stand up for democracy and for a free press, and for core journalistic values. It doesn't mean telling people to go vote Democratic, it doesn't mean being easy on the Democrats. But it does mean pointing out what this danger is right now."

"If Trump takes power, he's going to go after the media. And he will criminalize journalism in a lot of ways, and the free press will be under a lot of pressure. I don't think any journalist can sit there and say, 'I'll be fine if Trump wins.' They should all be terrified," Froomkin asserts, adding: "An increasing number are. You're seeing some of that, for instance, in this story on political violence. That was one of the big issues swept under the rug until recently."

As Froomkin explains, the jury is very much still out. But what he once saw as a "generational project" now needs to happen much quicker. "The stakes feel so high right at this moment --- for obvious reasons --- that I think there’s pretty good chance of change before November," he wrote last month. We'll see if he's right about that.

In the meantime, there has been some encouraging news elsewhere, at least from the court system in recent weeks, resulting in a rush of long-overdue accountability for people and organizations of the corrupted right.

  • Last week, New York Attorney General Tish James' office filed motions seeking $370 million from Donald Trump, his company, and its top executives for years of massive bank, tax and insurance fraud. She is also seeking a lifetime ban from the NY real estate market for Trump, and a five-year ban for his eldest sons. The whole crew has already been found liable by the state judge overseeing the case. The only question now is what the penalties will ultimately be. Closing arguments are this week and Trump will not be allowed to make part of them himself, after failing to agree he would do so without attacking prosecutors, the judge or his staff, or turn the remarks into a political statement.
  • Also last week, Wayne LaPierre, the wildly corrupt 30-year leader of the terrorist-supporting National Rifle Association, finally resigned on the eve of his corruption trial --- also thanks to Tish James in New York --- which began this week. LaPierre and other top NRA officials allegedly bilked millions of dollars from the non-profit organization to fund their own lavish lifestyles. James hopes to force LaPierre and the others to pay it all back and permanently bar them from serving on the board of any NY charity. Thoughts and prayers.
  • Longtime Republican grifter James O'Keefe's sleazy, fake "journalism" organization called Project Veritas, finally seems to be all but permanently dead. That, after O'Keefe was found to have overseen years of "financial malfeasance" according to its Board and newly seated CEO, Hannah Giles, who resigned last month citing "an unsalvageable mess" at the organization, "one wrought with strong evidence of past illegality and past financial improprieties." Giles originally played the "prostitute" in heavily edited videos published years ago by Andrew Breitbart targeting the community organizing and voter registration group ACORN. O'Keefe --- as we spent quite a bit of time some years ago detailing to mainstream media outlets who had also fallen for the hoax --- pretended to have dressed up as a "pimp" in those fraudulent videos. Though scams, they still resulted in rightwing millionaire, billionaire and just plain old dupes donating tens of millions of dollars to O'Keefe's organization over the years in support of their phony, frequently unlawful, partisan schemes targeting groups and individuals on the left. The organization and O'Keefe himself are reportedly under criminal and/or civil investigation for a number of those schemes.
  • Remember Kim Davis? The sleazy, far-right Kentucky county clerk who, in 2015, refused to issue marriage licenses to same sex couples after the U.S. Supreme Court's Obergefell ruling? Last week, a federal judge found her liable for $260,000 in legal fees and expenses incurred by one of the couples who she unlawfully refused to license. In 2022, a federal jury said she had to pay the couple $100,000 in damages. The rightwing legal organization representing Davis for free, Liberty Counsel, says they will appeal the original verdict, the order for attorneys fees, and Obergefell itself at the U.S. Supreme Court.

FINALLY, as today's show ended, it looks like former New Jersey Gov. Chris Christie has decided to suspend his 2024 GOP Presidential campaign (much as we called for him to do --- if he was truly serious about keeping Trump out of the White House --- on yesterday's program.) The announcement comes just hours before a debate tonight between Nikki Haley and Ron DeSantis in advance of Monday's Iowa Caucuses. Presumptive frontrunner Donald Trump won't be at this debate either, but we will have Special Coverage, nonetheless, for some reason, on tomorrow's BradCast...

On today's BradCast: A couple of follow-ups and a deep dive into what almost certainly lies ahead beginning this weekend, including who is likely to be blamed for it, who may or may not still have a job when all is said and done, and what the cost is likely to be to the American people. [Audio link to full show follows below this summary.]

FIRST UP: The news broke just before airtime on yesterday's program, but I've now had time to read Tuesday's full, breathtaking court ruling [PDF] which seemed impossible to believe as it broke yesterday. But, yes, Judge Arthur Engoron's summary judgement ruling in New York state's $250 million fraud case against Donald Trump and his company and his two eldest sons is as brutal, if not more so, than we initially reported it yesterday.

In addition to utterly obliterating the case presented by defendants --- as "pure sophistry", "not relevant", "patently false", "fatally flawed", "simply untrue", "completely irrelevant," and "frivolous", among other things, some of which we share today --- Engoron details several of the eye-popping fraudulent lies told in years of Statements of Financial Condition (SFCs) signed off on by Trump in applications for bank loans. Breathtakingly inflated overvaluations of his key properties, including by 2,300% at Mar-a-Lago alone, where Palm Beach County assessed the property to be valued anywhere from $18 to 27.6 million in the years from 2011 to 2021. During those same years, Trump's SFCs said the property was worth from $426 to $612 million!

In total, the fraudulent overvaluations documented by the suit, just in the years in question, total anywhere from $812 million to $2.2 billion. "Even in the world of high finance," writes the Judge in response to defendants attempts to marginalize the false statements, "this Court cannot endorse a proposition that finds a misstatement of at least $812 million dollars to be 'immaterial'."

Each of the Trump properties seem to be "owned" by Limited Liability Corporations (LLCs) created by the Trump Organization to manage each of them. And, yes, the result of yesterday's ruling --- which we couldn't believe as it was breaking, but have now been able to confirm in the actual court order --- is that the Judge has ordered NY business certificates "controlled or beneficially owned by Donald J. Trump, Donald Trump, Jr., Eric Trump, Allen Weisselberg, and Jeffrey McConney" to be "canceled". He has also ordered "independent receivers to manage the dissolution of the cancelled LLCs."

All of that on summary judgement before the non-jury trial, to be decided by the very same judge, begins on Monday. Youch. There is, of course, the possibility for appeals and such. But it is kinda remarkable how Tuesday's ruling has sort of been downplayed by many of the corporate media outlets. Perhaps they can't believe it either.

Before we get to our guest today on a completely different topic, more good news as the Writers Guild of America approved their new contract with major corporate producers on Tuesday after a nearly 150-day strike. That now clears the way for a bunch of late-night shows to finally return to the air beginning this weekend and by Monday. Some shows and most films will still be largely paused as the actors union remains on strike against the studios.

NEXT UP: A federal government shutdown is now all but certain to begin as of Saturday, thanks to far-right Republicans in the House who are unable to strike a deal amongst themselves for a short-term Continuing Resolution, much less a full budget package for the new fiscal year. Nonetheless, a new poll out this morning suggests that while 1 in 3 Americans blame Republicans, 2 out of 3 are blaming either Democrats or President Biden for the shutdown?!? Seriously?!? How can that be?!?

To help make some sense out of all of this and what is about to happen and what its historical antecedents may be, we're joined today for a great conversation by author, columnist, political scientist, and longtime Congressional historian NORM ORNSTEIN of the American Enterprise Institute. He blames the corporate media's terrible "both sides", "access journalism" coverage for the mistargeting of blame by Americans for a shutdown by Republicans.

"It's entirely on House Republicans, egged on by Donald Trump," he explains. "These people want a shutdown. Because this is not an ideology. It is a theology. The theology is that government is evil, government is bad, lose government, we get freedom, without regard to the realities in the real world and on the ground. They are very happy to have chaos out there."

Ornstein also charges that the GOP, claiming to seek government spending cuts, are "hypocrites" because shutdowns end up costing the government money while hurting actual Americans. "This is not a harm-free zone we're entering into," he warns. "Not only does it not save the government money. In some instances, because functions will be postponed, maintenance will not be done, ultimately it will cost more. They're hypocrites, at minimum. They're not really talking about savings for the government. They're talking about bringing the whole mechanism down because they hate government."

While Republican House Speaker Kevin McCarthy is unable to wrangle his own caucus to even adopt a short term spending package to keep the government open as talks continue, he is also threatened with removal from his post as Speaker by the farthest right elements in the House. Ornstein offers some historical comparisons to this extraordinary moment, and argues that McCarthy "is in deep trouble."

"This movement towards using the threat of chaos, of shutdown, of default, as hostages" by Republicans in recent years, has "resulted in absolutely nothing happening. No concessions. Just the disruption." In recent years, he says, "we have been on a trajectory that is leading us further and further away from adults --- at least those that understand that no one is going to gain politically from a shutdown --- to a position now where we are basically being driven by the lunatic fringe."

He has, as ever, much more to help clarify on all of this today. All of it, as usual, well worth tuning in for...

Some breaking news just before airtime helped, once again, threw off our best laid plans for today's BradCast. But, given this particularly huge breaking news, we're just fine with that. [Audio link to full show follows below this summary.]

The New York Judge in state Attorney General Letitia James' $250 million civil fraud lawsuit against Donald Trump, the Trump Organization, his eldest sons, Don Jr. and Eric, and two top company executives, ruled [PDF] that they all committed years of "persistent and repeated fraud" to the tune of billions of dollars by inflating the value of company assets when applying for bank loans. They also decreased the value of the same properties to receive favorable terms on both insurance and taxes, according to the ruling.

Judge Arthur Engoron found in favor of the state's key contention during the summary judgment phase of the landmark case on Tuesday, before the non-jury trial is slated to begin next Monday. Trump's attorneys had also sought summary judgement, hoping to see the case thrown out entirely. Instead, the key issue has already been decided against them and Engoron, in a brutal ruling, has stripped the former President, his company, his sons and execs, of control over several of his main New York properties. The Trump Organization and its various LLCs were placed into receivership to be controlled by court-appointed officers!

In the massive fraud suit, James seeks to permanently revoke the Trump family's license to do business at all in New York state. The trial, set to begin next week, will now determine the other issues at stake and the full breadth of penalties. Of course, Trump will appeal everything. But, make no mistake, this is a huge verdict against the failed former President and current 2024 GOP frontrunner who, as validated by Judge Engoron today, has built his business empire on decades of fraud and lies.

Among the many other important stories also covered on today's program...

  • Cassidy Hutchinson, star witness at last year's House January 6 Committee hearings and the former top aide to Trump's final Chief of Staff, Mark Meadows, warns that Trump "almost destroyed democracy in one day and he wants to run for President do it again."
  • This week's second GOP Presidential Primary debate, at the Reagan Library here in Southern California, will feature the same candidates as last month's debate in Milwaukee, other than former Arkansas Gov. Asa Hutchinson, who apparently did not meet the RNC's criteria. Trump was also not invited for refusing to sign the party's loyalty pledge, but he had already announced he wouldn't participate in any of their debates.
  • Labor economist Kathryn Anne Edwards offered a must-listen response to Louisiana's loopy U.S. Senator John Kennedy during a Senate subcommittee hearing last week on post-pandemic child care concerns. While Kennedy suggested he really really wanted to help, he had no idea where, oh, where the federal government could possibly find the money to do so. Edwards' straightforward, well-supported answer: Raise taxes on the wealthy that you've been lowering for the past two decades if you really care about children in need.
  • In a related matter on Tuesday, Joe Biden became the first sitting U.S. President, incredibly enough, to join a picket line with striking workers. In this case, he called on striking United Auto Workers members in Detroit to "stick with it," as he rallied workers with UAW President Shawn Fain. On Wednesday, the former President is set to speak at a non-union facility in a "red" county outside of Detroit.
  • California Governor Gavin Newsom signed a bill into law today that doubles the tax on sales of guns and ammunition in the state to help pay for increased school safety measures. While the federal government already charges a 10% tax on guns and ammo, California doubled it with one of their own, becoming the first in the nation to do so.
  • Bona fide good news today from our corrupted, packed and stolen U.S. Supreme Court. They rejected Alabama's attempt --- once again --- to violate the Voting Rights Act with a racially gerrymandered U.S. House map. Last June, in a surprising 5 to 4 ruling, with Chief Justice John Roberts and Justice Brett Kavanaugh joining the Court's three liberals, SCOTUS ordered the state to create a second majority black U.S. House District. Just 1 of 7 districts is currently a majority minority district despite African Americans comprising more than a quarter of the state's population. But Alabama Republicans, blatantly defying the U.S. Supreme Court, redrew their districts without including a second black majority district as mandated. A federal court panel then ordered a Special Master to draw up a new map instead. Alabama tried to stay that decision at SCOTUS, which unanimously rejected the state today in a one sentence ruling. That is good news for voters and bad news for several other GOP-controlled states trying the same gambit to cheat their way to a Republican majority in the House again next year.
  • Speaking of the Republicans' narrow majority in the U.S. House, it appears next to impossible at this hour to believe they will be able to agree amongst themselves on a spending bill to keep the federal government open as of Saturday. At least not without either Democrats saving them and/or House Speaker Kevin McCarthy losing his job as Speaker.
  • New Jersey's Democratic Sen. Bob Menendez, federally indicted for a second time late last week on charges of bribery and corruption, maintains his innocence. But the flood of fellow Democratic U.S. Senators calling for his resignation seems all but unstoppable now, with at least six of them --- including fellow NJ Senator Corey Booker --- calling for Menendez to step down. The charges, by the way, would seem to dramatically undercut Trump/GOP claims that the DoJ has been "weaponized" by Democrats against them.
  • Finally, Desi Doyen joins us for our latest Green News Report, as New Orleans declares a drinking water emergency; Fracking is "devouring American's groundwater" amid persistent drought in a number of states; and FEMA girds to suspend critical recovery operations in several states if Republicans shut down the federal government as of this Saturday...

It's still kind of hilarious that the Republican Speaker of the House this week, in announcing an impeachment inquiry of Joe Biden for...(fill in actual crime here when available)...described the Democratic President as "the picture of a culture of corruption". It's particularly amusing given the bulk of today's news on The BradCast. [Audio link to full show follow below this summary.]

Among our stories today...

  • The unspeakable death toll from flooding in Libya is now expected to be in the tens of thousands as bodies line the streets in the eastern coastal town of Derna, where 16 inches of rain fell in one day over the weekend resulting in the collapse of two dams. Given some of the horrifying new numbers from Berkeley Earth this week, however, suggesting that the planet has a good chance of exceeding the 1.5 degree Celsius increase of warming since pre-industrial times which the Paris Climate Agreement seeks to avoid, we could be in for many more such horrific disasters in the years ahead.
  • Following a nearly 5-year probe by a Trump appointed U.S. Attorney and a recently failed plea agreement, Hunter Biden was charged today with 3 felony counts related to using illegal narcotics while buying a gun. These are crimes which almost nobody is ever charged with, especially when they have never fired or even loaded the gun, which Hunter reportedly had for only 11 days. But that must be a part of the "special preferential treatment" the President's son has received, if you hear Republicans tell it. Try not to laugh.
  • The state judge overseeing the sprawling, 41-count racketeering conspiracy indictment [PDF] against the former President of the United States, Donald Trump and his 18 co-conspirators for their attempts to steal the 2020 election in Georgia, has determined that all 19 defendants will not be tried in a single group beginning in October, as Fulton County D.A. Fani Willis had sought. So far, former Trump attorneys Ken Chesebro and Sidney Powell will stand trial next month, but a trial date for all of the others will be set later, likely for some time next year --- if a slot when Trump isn't standing trial on felony charges in three other jurisdictions can be found.
  • The civil trial Trump faces --- along with his two eldest sons, his company and two top executives --- via New York state Attorney General Letitia James, for falsely and unlawfully inflating his company's net worth by billions of dollars in order to fraudulently receive bank loans and other benefits, begins on October 2. Just mentioning that since it seems few others are doing so these days for some reason.
  • The Fox Corporation was sued yet again this week, related to the knowing lies Fox "News" told about the 2020 election being "rigged". The latest suit comes courtesy of New York City's huge pension funds. They charge neglect of corporate duty to protect shareholders by opening themselves up to defamation suits like the one from Dominion Voting Systems. That one cost the pretend news outlet $787.5 million to settle earlier this year. The state of Oregon, on behalf of their public employee retirement fund, has joined the suit. All of which begs the question as to why anybody's money is actually invested in a company known, for years. to be as corrupt as Fox. I might suggest that those whose retirement funds are being handled by NYC and Oregon (and elsewhere) demand the funds pull their money from similarly irresponsible and corrupt corporations --- such as the major fossil fuel companies --- before they too face the huge financial liabilities that await them.
  • Are Wisconsin state Assembly Speaker Robin Vos and his fellow corrupt Republicans in the state's obscenely gerrymandered Legislature blinking in their recent threats to impeach newly-seated state Supreme Court Justice Janet Protasiewicz before she has even heard a case? The High Court's new liberal majority will soon be hearing two citizen petitions challenging the GOP's corrupt state district maps, which have ensured Republican majorities in both the Assembly and Senate for most of the past decade. But this week, just after state Dems announced a $4 million ad buy to let voters in the Badger State known what Republicans are up to in advance of 2024, Vos floated a new legislative "deal" to create new maps. Democratic Gov. Tony Evers immediately rejected the proposal as "bogus". We explain.
  • Remember that Kentucky County Clerk who refused to grant marriage licenses to same-sex couples back in 2015? Kim Davis will now have to pay one of those couples $100,000 for having refused to do so, according to a decision this week by a federal jury.
  • Ken Paxton, the unspeakably corrupt Texas state Attorney General and close Trump ally who is facing trial in the Republican-dominated state Senate on 20 articles of impeachment brought by the state's Republican-dominated House this week, may have dodged at least one bullet. A last-minute deal was struck between the opposing attorneys to skip testimony from Paxton's mistress on Wednesday. She's the one who was given a job by a Paxton donor to make it easier for them to continue their secret affair. The impeachment trial of the state's top law enforcement officer continues in the Senate, which will soon decide if the Republican should be removed from office based on charges of bribery, unfitness for office and abuse of power. Paxton's wife is a state Senator and has been present all week at the trial. She will, however, be barred from voting on his fate.
  • Washington Post reports today that Florida's corrupt Republican Governor Ron DeSantis enjoyed a whole bunch of unreported and undisclosed private plane flights, luxury resort accommodations and meals with wealthy donors after being first elected in 2018. With his Presidential aspirations now failing, he must be angling for a Supreme Court nomination.
  • Finally, Desi Doyen joins us for our latest 'Green News Report' with more on the horrific news out of Libya; the record costs of U.S. weather-related disasters so far this year; more bad news for Texas water drinkers; and a bit of encouraging news courtesy of Biden and the Democrats' Inflation Reduction Act. Oh, we're also still keeping an eye on the powerful, slow-moving Hurricane Lee, a monster storm in the Atlantic which is currently brushing by Bermuda and threatening New England, Canada and Newfoundland over the next several days...

We're back for today's BradCast after some much-needed down time last week over the holiday when we tried to look the other way for a few minutes. We've got a lot of catching up to do.

Among the stories we try to catch up with today...

  • The independent Special Counsel appears to be wasting no time. Even on a holiday. Prosecutor Jack Smith, recently tapped by Attorney General Merrick Garland to oversee two Trump-related criminal probes by the Dept. of Justice --- on the January 6th insurrection and the classified documents stolen by the former President upon leaving office --- jumped into the documents case on Thanksgiving Day. While we were eating turkey, Smith was filing a one paragraph argument with the 11th Circuit Court of Appeals calling out Trump's attorneys for lying during a hearing earlier in the week. That hearing didn't go well for Team Trump, despite being heard by two Trump-appointed federal judges and one appointed by George W. Bush. Smith did not make things any better for them. We explain.
  • Two Trump-backed candidates in Alaska were each declared losers in the U.S. House [PDF] and U.S. Senate [PDF] races last week after weeks of counting in the state's Ranked Choice Voting midterm elections. Democrat Mary Peltola will fill the seat in the U.S. House previously held by the late Rep. Don Young, a Republican who occupied the state's only House seat for nearly 50 years. She defeated the failed former President's choice, the state's failed former Governor and Vice Presidential candidate Sarah Palin, as well as two other candidates. And, moderate Republican Sen. Lisa Murkowski, who voted to remove Trump from office during his second impeachment trial last year, was declared to have defeated Trump-endorsed GOP challenger Kelly Tshibaka. Dems will hold a narrow majority in the Senate next year no matter how the U.S. Senate runoff in Georgia between Sen. Raphael Warnock (D) and Trump-endorsed Herschel Walker (R) works out next Tuesday. But, if yet another candidate supported by the disgraced former President crashes and burns next week too, the extra seat in the upper chamber could make a huge difference for Democrats.
  • Meanwhile, in Arizona, former TV news anchor and Trumpette, Kari Lake, is still pretending that she must have won the Governor's election. All of the available evidence suggests Democratic Sec. of State Katie Hobbs was the winner, albeit by less than one percent. The narrow margin, however, is just a bit higher than the trigger for a statewide recount. So, Lake is now suing the Republicans who run Maricopa County (Phoenix), on the basis that the County's print-on-demand ballot system prevented voters from voting. It didn't. Though some GOP voters reportedly chose not to cast their ballots after being told the precinct-based scanners couldn't read the hand-marked paper ballots printed at a number of the County's voting centers. Those ballots were placed into a locked box and scanned back at County HQ. On Monday, the County certified their results, and the usual parade of deplorables issued threats to the officials for doing so. The state is scheduled to certify results next week, which will be followed by a recount in the incredibly tight Attorney General contest. It is currently led by Democratic candidate Kris Mayes over Trump-endorsed Abe Hamadeh who trails by just 510 votes out of more than 2.5 million cast in the state's November midterms.
  • Meanwhile, the world's largest volcano, Mauna Loa, is erupting again in Hawaii...for the first time in nearly 40 years.
  • Finally, we open the phone lines today for a bit of a "reverse BradCast," where callers ring in with stuff they want me and/or the world to know about. Among the topics raised by callers: Israel, Julian Assange, accountability for Don Jr. and Eric, democracy beyond elections, and more...

There are just too many crimes. Next time we'll need to plan a longer BradCast. [Audio link to full show follows this summary.]

We're not yet beyond the 2022 elections. Votes are still being tallied and races still being called. Only last night, media outlets finally were able to project the GOP would win back a majority in the U.S. House next year, if barely, and that progressive Rep. Karen Bass would be the winner of the Los Angeles Mayoral race over billion real estate developer Rick Caruso. Of course, the fallout from the election will continue for a while. Today, two-time Democratic House Speaker Nancy Pelosi --- love her or hate her, one of the most effective Speaker's in history --- announced that, while she plans to remain in Congress, she will not seek a leadership role next session. The first women to hold that job said during floor remarks today, that she is passing the torch to a new generation.

Most notably, however --- at least when it comes to accountability for the most corrupt man likely to ever hold public office in this nation, much less as President of the United States --- actual 2022 midterm voting continues as well, in the December 6th U.S. Senate runoff in Georgia.

That means the Dept. of Justice guidelines barring overt action in politically-related cases during the 60-day window prior to elections is likely still in effect. But even after the GA runoff on December 6th, as our friend Marcy Wheeler of Emptywheel recently explained, "Merrick Garland hasn't done the specific thing you want because DoJ has been busy doing things they have to do first." In other words, before federal indictments can be brought against Donald Trump, as many (yours truly included) are eager to see, there remains a lot of legal work that must be done in order to ensure that any such indictments result in actual convictions.

Our guest today is DR. ALLISON GILL of the notorious "Mueller, She Wrote" Twitter account and podcast, which tracks the many (seemingly endless) criminal and civil cases and investigations under way against the disgraced former President about as closely as anyone in the country. She agrees that patience remains a virtue in these cases. Depending on the case, as she explains today, we are looking at a matter of weeks to a matter of months before indictments can be brought against Trump. Though she does believe they are coming and that his announcement this week that he is running again in 2024 provides no protection against prosecution in any of these cases.

As we begin to move beyond the midterms, today seemed a good day to touch base with Gill to help us try and reset where things are regarding to the many ongoing criminal and civil probes, indictments and lawsuits still bearing down on Trump. To be honest, we've lost track of some of them in recent weeks as we'd moved largely full time to 2022 election coverage.

Those pending cases include (but are not limited to):

  • The New York state criminal tax fraud trial currently underway against the Trump Organization and its CFO Allen Weisselberg, as brought by Manhattan D.A. Alvin Bragg;
  • Bragg's New York state criminal investigation into bank, tax and insurance fraud by Trump himself, as seemingly abandoned earlier this year, but which could be revived following the trial against his company;
  • The $250 million New York state civil lawsuit for bank, tax and insurance fraud against Trump, his company, and his three oldest kids, Don Jr., Eric and Ivanka, filed by NY A.G. Letitia James, which Gill sees as extraordinarily damaging to Trump;
  • The Georgia Special Grand Jury probe, as brought by Fulton County D.A. Fani Willis, of the Trump-led criminal conspiracy to convince state officials to steal the 2020 Presidential election on his behalf;
  • The Dept. of Justice's federal probe of thousands of pages of classified documents stolen from the White House by Trump upon leaving office, in apparent violation of the Espionage Act, Presidential Records Act and obstruction of justice;
  • The DoJ's federal probe of the Trump-incited January 6, 2021 insurrection at the U.S. Capitol and his other many failed attempts to steal the 2020 Presidential election, including via a fake electors plot.

Add to those, Trump's failure to show up for his deposition this week in response to a lawful subpoena.from the the bipartisan U.S. House Select Committee investigating the January 6 insurrection. (Trump's former advisor Steve Bannon was recently sentenced to two months in prison for Contempt of Congress for failing to answer similar subpoenas from the Committee.)

"Don't forget," Gill adds today, "his Save America PAC is under federal criminal investigation. His Truth Social [companies] are under FINRA, FEC, and federal criminal investigation. He is facing a lot --- a lot --- of legal problems. We've got the E. Jean Carroll case, the Mary Trump case, the Hillary sanctions, the Michigan sanctions. He's in a lot of trouble from a lot of things. We're going to just have to see who drops the hammer first."

"If we just look at the Watergate timeline," she posits, regarding the sprawling January 6 investigation, "we won't see indictments until April 2023. And this is far more complex [than Watergate]. So it's going to be interesting to see how the timing plays out. Or whether maybe Garland says, 'Hey, Fani Willis, you take the fraudulent electors stuff, I'll take the documents stuff.'" That, she explains, would have the advantage of potentially convicting Trump under state law for which he can't be pardoned by a future President (or even by a Georgia Governor, since they are not granted state pardon power.)

Gill does believe --- in fact, she is "very, very certain" --- that Trump will be indicted in at least one of the federal cases we discuss today. Tune in to find out which one!

The first of many hammers to come on Donald Trump's years of lying, grifting and defrauding the American people and the world came down today in New York, as detailed on today's BradCast. [Audio link to full show follows below this summary.]

According to New York Attorney General Letitia James on Wednesday, the former President falsely inflated his net worth by billions of dollars over many years in wildly fraudulent financial statements that allowed him to unlawfully obtain bank loans as well as tax and insurance benefits he had not earned.

"Claiming you have money that you do not have does not amount to 'The Art of the Deal.' It's the art of the steal," alleged James near the end of her announcement this afternoon, detailing "astounding" financial falsehoods which Trump employed over decades. "There cannot be different rules for different people in this country or in this state, and former Presidents are no different. And so, today, we're making good on that promise, on our commitment, because no one --- no one --- is above the law," she said.

After a three-year probe, James filed a 222-page lawsuit [PDF] in New York state court against Trump and the Trump Organization, as well as his three oldest children, Eric, Don Jr. and Ivanka. The company's longtime Chief Financial Officer, Allen Weisselberg and its Controller Jeffrey McConney were also named as defendants.

The A.G. detailed dozens of flagrant incidents of "staggering" fraud in her civil suit. It seeks to "permanently bar Mr. Trump, Donald Trump, Jr., Ivanka Trump, and Eric Trump from serving as an officer or director in any New York corporation or similar business entity registered and/or licensed in New York state" and "bar Mr. Trump and the Trump Organization from entering into any New York real estate acquisitions for five years." The suit also seeks to disgorge some $250 million, the estimated "financial benefits obtained through the persistent fraudulent practices."

Moreover, James said that many of the violations of law detailed in her case are not only civil, but also criminal She has now referred those charges to both state and federal authorities at the Manhattan District Attorney's office, the IRS, and the U.S. Attorney's office in the Southern District of New York.

Among the many fraudulent practices employed by Trump to inflate his self-worth, as detailed by James at her presser today, was his claim that his 11,000 square foot penthouse apartment at Trump Tower was actually 30,000 square feet. By falsely more than tripling the size of the apartment, he was able to value it at $327 million, far more, according to James, than any apartment has ever sold for in New York City. It was an overstatement, as Weisselberg conceded during his deposition, of "give or take" $200 million.

As James' office noted in their announcement of the suit today, Trump also lied about dozens of other properties, including Mar-a-Lago, which he valued in financial statements "as high as $739 million" when, in fact it "should have been valued at closer to $75 million."

But there is more. Much. All of which allowed the disgraced former President and TV star to inflate his net worth by billions of dollars in recent decades. We share the bulk of James' statement on today's show, in case you missed it. It was, at times, breathtaking.

We're joined today by accountability and national security journalist MARCY WHEELER of Emptywheel to discuss Jame's long-awaited civil suit in the Empire State and several of the many other ongoing criminal investigations bearing down on Trump elsewhere.

"It's important for people to remember that with this [case in New York], as with all of Trump's legal exposure, this stuff takes time," Wheeler cautions, explaining that Trump is going to do everything possible to stall the A.G.'s lawsuit, as he does with everything else. "So, it's not like tomorrow he's going to be put in cuffs by the IRS. This is his empire, and he is going to fight for his empire, he's going to fight for his brand."

Until James announced her lawsuit today, we had originally planned to discuss, with Wheeler, the DoJ's case against Trump at Mar-a-Lago, as a federal judge appointed by Trump has been running absurd and corrupt interference for him following the FBI's search at his Florida club, finding that he stole more than a thousand pages of highly classified national security documents upon leaving office.

"He probably still has classified documents lying around his properties," Wheeler argues, charging "the thing about Trump is he's never going to stop cheating." At least until someone stops him.

Right now, in addition to James' civil action on Wednesday, there are at least three other major criminal probes that Trump is being forced to contend with. Today was likely only the first shoe to drop in that regard. Stay tuned...

"If you're innocent, why are you taking the Fifth Amendment?," Donald Trump used to repeatedly bellow at his campaign rallies. "It's disgraceful," he would tell his MAGA Mob over and over again in 2016. "Only the mob takes the Fifth!" All words that, we just have a feeling on today's BradCast, may soon come back to haunt the disgraced, twice-impeached former President. [Audio link to full show is posted at end of this summary.]

Trump, and his family, and his family business, are now just losing motion after motion, case after case in courts across the country. And the more the losers lose, the more they have to lose.

Among the stories covered on today's program...

  • The BRAD BLOG web server was offline for much of the past 24 hours. We explain what happened and why we're likely gonna need to some shows off in the days ahead in hopes of finally fixing it. (And, yes, we could really use your help!)
  • Of course, if we had an obscene $200 million contract from Spotify (not just $100 million as previously reported), it might be much easier to fix it. But nobody is worth $200 million just to talk on air or on a webstream, no matter how important what they may have to say. But that's especially true for folks like Joe Rogan, who just fills the time with words --- entertaining or otherwise --- that may also have the affect of killing people. Moral of the pathetic Spotify/Rogan story: the company doesn't pay its musical artists nearly enough and, if they have that much extra money lying around to blow on one guy to help spread deadly misinformation, they are also definitely not paying enough in taxes.
  • As to our loser former President and his loser family, Donald Trump and his daughter Ivanka and son Don Jr. lost bigly in New York court on Thursday, where a judge ordered them to answer questions under oath within the next 21 days from state Attorney General Letitia James. She is investigating the family and their business for very clear evidence of years of bank, tax and insurance fraud. Their gambit to sue to the AG to avoid sitting for a deposition has failed and each of them may well consider pleading the Fifth very soon. Ya know, like the mob does.
  • The news was no better for Trump in his hopes of avoiding accountability regarding the insurrection he incited last year on January 6th, in his last desperate bid to steal the 2020 election. On Wednesday, President Biden and the White House counsel rejected Trump's attempt to invoke Executive Privilege to block White House visitor logs from January 6th, 2021.
  • And, also in D.C. this week, the Attorney General there had another victory in court over the Mob Family Trump, when a federal judge allowed him to restore the Trump Organization back into his lawsuit regarding millions of dollars that Trump and his family and his Trump Organization appear to have unlawfully stolen from the non-profit Presidential Inauguration Committee back in 2017. In a stunning ruling by a different judge last year, the company had been released from the lawsuit. But D.C. Attorney General Karl Racine brought evidence to the Court revealing that the unspeakably cheap and greedy Trump Organization inappropriately billed the Committee for about $50,000 in Inaugural weekend hotel rooms that they never ended up using. We explain the sleazy backstory.
  • In somewhat similarly amusing news, out in Colorado, the very Trumpy disgraced and recently arrested Mesa County Clerk, Tina Peters has now declared her intention to run for Secretary of State! Her backstory of recent disgraces --- apparently helping to steal and distribute proprietary voting system software after sneaking into a secure warehouse and turning off security cameras in the middle of the night; being relieved of her duties and barred from overseeing her county's election by a state judge; being investigated for election-related crimes by local, state and federal prosecutors; and being hilariously arrested last week for refusing to turn over evidence that she violated a judge's order by video-taping a court proceeding (among other stuff) --- should make her a top-notch candidate to win the GOP primary for the state's top election official this year! That, even as state Republicans are pretending as if they'd really rather she didn't run at all.
  • Finally, Desi Doyen joins us for our 13th Anniversary Green News Report! Despite almost certainly being the nation's longest-running bi-weekly national broadcast devoted to coverage of our climate crisis, the news on that front continues get largely worse, not better, as revealed again in today's episode. Though, as usual, there is also a bit of very good news on that front to help the medicine go down a bit easier...

Joe Biden is now one year in. Donald Trump is now one year out. Have the media figured out how to properly cover either or both of them? We discuss on today's BradCast. [Audio link to full show is posted below this summary.]

But first, Trump's troubles are getting worse by the day hour. It's been a bad 24 hours for the disgraced, twice-impeached, one-term former President. But that's usually good news for America!

As we literally begin today's program, news breaks that the U.S. Supreme Court is allowing the National Archive to turn over hundreds of pages of Trump White House documents to the bipartisan U.S. House Committee investigating the January 6, 2021 attack on the Capitol and Trump's attempt to steal the 2020 Presidential election.

That bad news for Trump (and good news for everyone else) follows last night's bad news for him (and good news for us) out of a New York state courtroom. NY Attorney General Letitia James has been investigating years of apparent bank, insurance and tax fraud by Trump, the Trump Organization, and Trump's children for years. She recently subpoenaed Trump and his kids Ivanka and Don Jr. to sit for depositions in her civil probe. (She is also working with the Manhattan D.A.'s long-running criminal probe into related matters.) Trump and the kids sued to quash the subpoena and, late on Tuesday night, James' office filed documents in response, detailing what she describes in the court papers as "significant additional evidence indicating that the Trump Organization used fraudulent or misleading asset valuations to obtain a host of economic benefits, including loans, insurance coverage, and tax deductions.”

We discuss some of that "significant additional evidence" today, along with the additional news that when Eric Trump, back in 2020, failed to quash his own subpoena, he subsequently "then invoked his Fifth Amendment right against self-incrimination in response to more than 500 questions over six hours.” That's his right, of course. But back in 2016, while running for President, Trump described pleading the Fifth as "disgraceful". "The mob takes the Fifth," he said at the time. "If you're innocent, why are you taking the Fifth Amendment?" We'll see if he, Ivanka and Don Jr., soon join his "disgraceful" son Eric in doing the same, along with the Trump Organization's "disgraceful" Chief Financial Officer Allen Weisselberg, who's already been criminally charged with fraud in Manhattan after also pleading the Fifth more than 500 times as well during his own deposition with James.

And then there's the new guy in the White House, who doesn't seem to be criminal or a liar or a fraudster at all. Today marked the end of Joe Biden's first year in office. It's been a rocky one at times, but also extraordinary successful on a number of legislative and economic issues.

We're joined today by ERIC BOEHLERT, longtime media analyst and publisher of the Press Run newsletter, to discuss media coverage of Biden at the one year mark, and how it compares to coverage of Trump's first --- and subsequent --- years in office.

While Biden's approval numbers have been flagging in recent months --- Gallup pegs his one year average at just under 49% --- they are still above Trump's during his entire Presidency. Nonetheless, we saw little from the media declaring Trump's Presidency was over or a failure at the end of his first year, by way of contrast with what we see from the media now, despite several remarkable successes for Biden over the last 365 days.

"It's very similar to Obama," Boehlert asserts. "If you go back and looked at his first year, first term, 'Oh his coalitions are falling apart!' Lots of doomsday coverage for Obama that turned out to be nonsense." He later adds, "Good luck going back and finding stories about whether the Trump Presidency was failed, 'How does he reset?,'" after his first year. "There was an acceptance that Trump was going to poll in the thirties, and the press just went on from there. In terms of how the coverage differs from Biden and Trump, I think that's the key one there."

Suffice to say, the difference in coverage of each President, as Boehlert details, is stark. And not in a good way. Among the other related issues discussed, above and beyond media coverage of the two Presidents: Has the media come to fully understand, much less appreciate, the unprecedented nature of this tenuous moment for American democracy itself?

"We have two sides," Boehlert explains. "A center-left Democrat doing his best, and we have a Republican Party that wants to destroy free and fair elections in America. So if you're the press, don't play that down the middle. Don't pretend those are similar choices."

"When Trump was inaugurated, the press didn't change how it covered Trump," he observes. "You would read the coverage and think Jeb Bush was President, you would think John McCain was President. You would think this is center-right, normal, traditional....not this madman narcissist. I think with the Biden era, they just want to play this game --- 'His polling is down! We've found some Democrats who are critical of him!' These aren't the times for the norm. The Trump years weren't the time for the norm. And we're not seeing drastic change." And that failure by our corporate media is not a good sign for the nation. Or the planet.

Finally today, it appears that Fox "News" is not satisfied by simply rewriting reality in the present. They are now attempting to rewrite history itself, it seems, as far as who actually killed Abraham Lincoln. Seriously. In the bargain, a Lincoln assassination expert's response to an invitation to appear on Fox Nation (the propaganda streaming service companion to the propaganda cable news channel) to discuss it, is one for the ages!...

On today's BradCast: We wouldn't blame you if you felt like averting your eyes from the desperate, usually-sad, often-hilarious, chaotic and so far failed attempts by the incompetent Team Trump to somehow try and steal the 2020 election any way they can. Yes, that's still going on. It's our job, however, to keep our eyes on it, and so we do again today, as things continue to fall apart in all new ways with each passing hour for Donald and what's left of his legal team. [Audio link to show follows summary below.]

Today, we cover the ongoing chaos the Trump Campaign is attempting to wreak in at least four different states. So far, only in Georgia has an election official who has buckled to pressure from Trump and fellow Republicans. Of course, he's a Republican himself and is doing a lousy job of it. But, in almost every case, the strategy --- such that there is one --- now seems to be to target the votes of African-Americans to be tossed out.

In Wisconsin today, the Trump Campaign plunked down $3 million to pay for a partial recount in the state. A full count would have cost the cash-strapped campaign $7.9 million. They have asked for counts only in heavily African-American Milwaukee County and Dane County, in a state where Joe Biden currently leads Trump by about 20,000 votes. In requesting the partial count they are doing what Republicans were outraged by in Florida in 2000 in the Bush v. Gore case, when Gore sought recounts only a few counties. The GOP, at the time, succeeded in forcing a statewide recount instead, which they were able to convince the U.S. Supreme court to block entirely. (Extra fun and irony today for those who noticed that Eric Trump complained in 2016 about the Presidential recount that year in the same state because the cost "Could Have Saved at Least 5,000 Children's Lives." He also falsely claimed that Hillary Clinton had anything to do with that recount. In fact, it was sought and paid for by the Green Party's Jill Stein for less money than the Trump Campaign sent to the Badger State today.)

In Pennsylvania, where Biden appears to have won by almost 82,000 votes, Rudy Giuliani made an absolutely hysterical jackass of himself during a federal court hearing on Tuesday. He hasn't argued a case in federal court for 30 years, and boy did it show! Just part of the fun included his opening argument in which he declared the case was about "widespread nationwide voter fraud!," before later admitting under questioning from the U.S. District Court Judge during the same hearing that "this is not a fraud case." That was hardly the only way in which he beclowned himself, especially as he focused on leveling baseless claims against the voting in heavily-minority Philadelphia. But it should also be noted that he declared his evidence-free case "a classic violation of equal protection....This is exactly Bush v. Gore!" That's fun, considering his campaign then violated a basic tenet of that 2000 case with their request for a cherry-picked partial recount in WI today.)

In Michigan on Tuesday night, the two Republicans on the Board of Canvassers in Wayne County refused to certify the November 3rd results due to claims of irregularities in the county's largest city, Detroit. (Seeing a pattern here yet?) The irregularities in question, apparently, regard small inconsistencies between the number of ballots cast and the number of voters signed into the pollbooks in a number of precincts in the county, in a state where Biden appears to have won by almost 160,000 votes. Despite a higher number of inconsistencies during primaries in the County earlier this year --- and a larger percentage of inconsistencies in majority white cities in the same County --- the Republicans on the Board certified the spring primaries without a problem. Their refusal to certify the general election deadlocked the Board at 2 to 2 and prevented certification for a few hours on Tuesday night. Brutal public comments at the Board's hearing and agreement to ask the Democratic Sec. of State for an audit of Wayne County's discrepancies, resulted in certification after all, by a unanimous 4 to 0 vote in a new vote by the Board held just three hours later.

But much of today's show is focused, however, on the absurd clown show that has been underway in Georgia for the past week, where the Republican Sec. of State, Brad Raffensperger, buckled to pressure last week from Trump and fellow Republicans who hold him responsible for the fact that Trump appears to have lost there by about 13,000 votes.

Last week, when Raffensperger announced an unprecedented statewide "audit, recount and a recanvass all at once," we explained on the program how that's not actually possible or even legal. This week, Raffensperger quietly admitted as much, sending out a letter to County Elections Officials [PDF] to notify them that "after evaluating the audit procedures...the original results...tabulated on and after election day, and certified by the county election superintendent, should be the results that your county certifies as the November 2, 2020 General Election Totals."

In short, the so-called "Risk-Limiting Audit" of 100% of the ballots cast in GA's Presidential race was not a "hand recount" as many media outlets have been misreporting it, but a largely meaningless exercise meant to try and appease our cry baby President, as my guest today, JEANNE DUFORT of the Coalition for Good Governance, describes it. Dufort has been on the ground in the state where she has also been a voter plaintiff in some of the Coalition's lawsuits. They are plaintiffs in a long-running federal case seeking to ban the state's use of new, unverifiable touchscreen voting systems made Dominion Voting Systems. (The same lawsuit succeeded in obtaining an order from the federal judge that banned the state's previous, 20-year old, unverifiable touchscreen systems made by Diebold. Despite recommendations from cybersecurity advocates and voting systems experts, Raffensperger chose to move to the new $100+ million touchscreens that are similarly unverifiable.)

Over the past 48 hours, two Republican-leaning counties discovered about 2,700 votes each that had gone either unscanned or unreported to the state previously. Those would have been discovered in the normal course of regular post-election canvassing, and netted about 1,000 votes for Trump overall. That will decrease Biden's final state certified margin from about 14,000 votes to about 13,000 votes. He will still be declared the official winner. After state certification on Friday, Team Trump will then have an opportunity to seek an official "recount" (as opposed to Raffensperger's pretend one) in which, by state law, the ballots will scanned again by the same computers that scanned them the first time. So that is also unlikely to change the final results.

Dufort explains today what she was able to observe over the past week during Raffensperger's "audit"/"recount"/"recanvass" which amounts to little more than Election Integrity Kabuki Theater. But, she tells us, there were still a few lessons to be learned from it all, as elections officials, poll workers and count observers who have been working for weeks amid a deadly pandemic, will now have to prepare very quickly for the two January 5 U.S. Senate runoffs in GA that will determine which party controls the Senate next year. Early voting begins on December 14th, not long after some municipal elections are also held in some counties on December 1st. All while carrying out another "recount" which Trump will almost certainly request after Friday's state certification. After all, there were a lot of --- you-know-whos --- that cast ballots against Trump in the city of Atlanta. That can't stand, right?

"The big thing is this is theater," says Dufort, speaking for herself, not the Coalition. "We've been calling for this [unverifiable Dominion Voting] equipment to be banned in the same way our lawsuit got the last Georgia system banned. So we are not fans of this equipment. But it's really ironic to see the same legislators who forced this $100 million purchase on the state to now be saying, 'Hey let's return it to the vendor! Let's get rid of it! It's a terrible system!', because they didn't get enough for their money. They didn't get a President for their money, and it's not clear they're going to get two Senators for their money. So it's kind of a funny time in Georgia."

Finally, we close with some listener mail that may hit the nail on the head: Trump isn't trying to getto 270 electoral votes. He's trying to take enough votes away from Biden so that he gets less than the required 270, so the election must be thrown to the House where the Constitution allows for minority (Republican) rule to win the day. With Rudy Giuliani now leading Team Trump's efforts, how could the plan fail?!

Pompeo undermines democracy; Trump/GOP's pathetic 'voter fraud' claims keep failing; GA Repubs turn on their own Sec. of State...

The unfortunately necessary debunkery of Donald Trump and his GOP's various embarrassingly desperate efforts to steal the election from Joe Biden continues on today's BradCast, even as the U.S. Secretary of State manages to shock with an extraordinarily offense comment and Republicans are now turning on their own in Georgia to appease the soon-to-be-former President. [Audio link to show is posted below this summary.]

Among the too-many stories covered on today's show...

  • Even Fox 'News' is beginning to refuse to air the White House's "voter fraud" BS. It's not the first time Fox has refused to play along with GOP "voter fraud" lies since Election Day;
  • Sec. of State Mike Pompeo makes a wildly unfunny, dangerous and un-American "joke" from the lectern at the Dept. of State about a "smooth transition to a second Trump Administration";
  • Corporate media continue to do a rather competent job of quickly debunking the endless and so-far evidence-free claims being made by duped Trump supporters and shameless Trump attorneys in court regarding "voter fraud". CNN's Donie O'Sullivan deserves special credit for one of his reports taking on Trump supporters directly at a "Stop the Steal" rally in Pennsylvania, with facts to debunk their false conspiracies regarding "Trump ballots being burned in bags" (they weren't), vote totals being inflated overnight for Joe Biden (they weren't), and much more;
  • Separately, CNN also debunks Trump's latest Twitter tantrums regarding his evidence-free claims of fraud in Pennsylvania (no, GOP observers were NOT prevented from watching the ballot count), Nevada (no, 3,000 voters did NOT vote unlawfully from other states), Georgia (no, Trump did not "win on Election Night") and Wisconsin (no, Trump's campaign is not "looking very good" in the state they appear to have lost by more than 20,000 votes);
  • Team Trump files yet another embarrassingly lame lawsuit in Arizona, falsely charging that 180 voters (out of 155,860) who cast Election Day ballots in Maricopa County (Phoenix) improperly had their ballots rejected as overvotes;
  • Short of an unlikely shocker in the still-uncalled Alaska U.S. Senate race, the last chance for Democrats to take back majority control of the U.S. Senate will now be in Georgia's two U.S. Senate runoff elections on January 5th. They will have to win both of them. And now, both of the state's Republican U.S. Senators, Kelly Loeffler (who is running against Rev. Raphael Warnock) and David Perdue (who is running against Jon Ossoff) are sucking up to their demented sore loser President by turning on GA's Republican Sec. of State Brad Raffensperger, hilariously "citing no evidence" in calling for his resignation.

    Longtime listeners of The BradCast will recognize Raffensperger as the corrupt dope who purchased the state's new, wildly-expensive, easily-manipulated, 100% unverifiable computer touchscreen Rube Goldberg voting systems made by Dominion Voting and forced on every county in the state for first time use this year. That, instead of a cheaper, verifiable, hand-marked paper ballot system urged by cybersecurity and voting systems experts alike.

    Republicans have been falsely accusing Dominion in recent days of being controlled by Democrats and responsible for "stealing" the election from Trump in Michigan and Georgia. While there is no evidence to support their claim, I have invited those Republicans worried about Dominion to join me in my call for getting the company out of Georgia's critical U.S. Senate runoffs altogether by turning to all hand-marked paper ballots to be publicly hand-counted in both races. The statewide election will feature just two races, with only two candidates in each, so hand-counting them on Election Night would be very simple and completely transparent.

    While my invitation to Republicans has become quite popular on Twitter, so far they have failed to join the effort to prevent the "Software from hell!" that folks like Eric Trump are pretending to be the cause for his father's humiliating re-election loss. Sad!

    While Raffensperger says he will not resign, a comment from former Republican Sec. of State turned illegitimate Governor Brian Kemp, along with an article from the far-right Federalist, suggests that state Republicans may try and move to ban mail-in voting altogether for the runoffs, despite the spiking deadly pandemic and the requisite reliance on unverifiable Dominion voting systems at the polling place, in hopes of returning to their years-long glory days of GOP voter suppression in the Peach State;

Debunking wingnut 'voter fraud' nonsense while welcoming them to the fight against private voting vendors and inviting them to join our call for hand-marked paper ballots in GA's upcoming U.S. Senate runoffs...

Well, it took long enough --- much longer than media usually wait --- but by Saturday morning, they finally recognized the obvious by calling Pennsylvania, and thus the Presidential election, for Joe Biden. The Right --- from the religious wacko Right to the non-religious wacko Right --- are in the midst of some pretty serious denial about it all, as we share at the top of today's BradCast, along with a few quick headlines, some serious debunkery, an invitation to Republicans to join the election integrity movement, and a bunch of gleeful calls from listeners. [Audio link to show is posted below summary.]

Among the quick headlines today: yet another rally on Wall Street in the wake of Biden's election; good news about a possible COVID vaccine (which Trump had nothing to do with!); Trump fires his Defense Secretary; more top Trump Administration officials test positive for the virus; and Biden's reported plans to issue a quick series of Executive Orders after being sworn in on January 20th to reverse some of the most egregious offenses of the Trump Era.

Then, we pick up today, somewhat, where we left off last week, debunking a number of the many absurd, evidence-free allegations of "voter fraud" being propagated by the deniers and conspiracy theorists on the Right --- from "SharpieGate" to false claims of "dead people" voting in Michigan to false claims (debunked by Fox "News"!) that Republicans were prevented from watching ballot tabulation --- as well as a look at one of the few legitimate concerns that have come to light since last Tuesday's Election Night. Namely, a concern about misreported vote tallies in Antrim County, Michigan, a small, heavily GOP-leaning area in the northern part of the state. According to the Democratic Sec. of State, the problem was due to a failure by Republican county officials to install a late update to their Election Management System software which is used to upload county results to the state at the end of the night. The problem resulted in Joe Biden momentarily appearing to have defeated Donald Trump by a landslide in the County. The error was quickly discovered, corrected and the posted results were properly reversed to reflect Trump's victory there.

But the incident (as well as the apparent losses of both MI and Georgia for the Republicans) has helped fuel a push from the Right toward demonizing Canadian-based Dominion Voting System --- the private voting system vendor in Antrim and other MI counties. While the Trumpers are falsely attacking the company as a tool of Nancy Pelosi and Hillary Clinton (even though Republican lobbyists work for the firm which has donated to Republicans), we're happy to join the critique in as much as no private company should have so much control over what are supposed to be our public elections. A call for an independent investigation and a hand-count of the county's paper ballots would be perfectly appropriate there.

Dominion is also the company which runs Georgia's elections, with a new $100+ million contract to supply 100% unverifiable touchscreen voting systems for in-person voting at the polls across the entire state and scanners for the state's hand-marked paper absentee ballots --- scanners which were found to have skipped counting many votes during the state's June primary.

While Biden appears to have won the state of Georgia by some 12,000 votes as of airtime (and, in Michigan, by about 150,000 votes), I invited Republicans via Twitter over the weekend (in a short threat that has gone mildly viral) to get rid of Dominion's influence over elections all together by joining me in demanding hand-marked paper ballots, publicly hand-counted, for the state's critical upcoming U.S. Senate runoff elections. Those two runoff elections will determine which party controls the upper chamber of Congress for first two years of the Biden presidency.

If the GOPers --- including folks like Eric Trump --- are serious about their concerns that "software from hell!" as Eric called it, made by Dominion somehow stole the election for Biden, they will join those of us in the fight for real Election Integrity in that call. So far, they haven't. But we can still hope.

Finally today, we open the phones for listeners to ring in following this weekend's huge news --- to gloat, to express their joy, their concerns, and much more --- as we begin to see a glimmer of light at the end of our long, if still-ongoing, national nightmare...

Staring down --- and making sense of --- Trump's cowardly threats against a peaceful transition and to democracy itself; Also: Accountability coming soon for Trump Family in NY; And, yes, even TX is now in play...

On today's BradCast: He wants you to be frightened. He wants to terrorize you. Don't let him. Vote instead. [Audio link to today's show.]

The fact that time is running out for the Trump Crime Family and their decades of fraud in New York --- as Eric also clearly knows --- is probably not helping, but Donald Trump is getting desperate. Hence, his refusal to commit, when when asked about it during a press briefing Wednesday at the White House, to a peaceful transfer of power after this year's Presidential election.

His excuse? "The ballots are a disaster...Get rid of the ballots....The ballots are out of control." While many have been discussing the disturbing options that some Republican controlled states may consider using to override the ballots by having their legislature select Electors to the Electoral College this year in defiance of voters, that's probably not what Trump was talking about yesterday when pretending "the ballots are out of control!"

He has been complaining for months about states that are automatically sending absentee ballots to all active registered voters this year. He is pretending this is "out of control" and a "scam" by Democrats to somehow steal the election. In fact, as we break down on today's show, Trump's complaints are, themselves, a scam.

In short, 5 states (Oregon, Washington, Colorado, Utah and Hawaii) have long sent all voters absentee ballots, whether they request one or not. Of those, only Utah is a so-called "red" state, and none of them are seen as anywhere close to likely to flip their Presidential vote from the way they voted in 2016. So, Trump is almost certainly not complaining about those five states.

But this year, due to the COVID-19 pandemic that Trump failed so disastrously to control, 5 other states (California, Vermont, New Jersey, Montana and Nevada) will also be sending mail-in ballots to all voters. Of those, the first three are very reliably Democratic states in Presidential elections. Trump won Montana by some 20 points in 2016. So, of those five, only Nevada (whose Republican Secretary of State is in charge of the election) could be considered, in any sense, a swing-state --- though it hasn't elected a Republican nominee for President since 2004, and a new Fox "News" poll out this afternoon shows Trump trailing Joe Biden there by 11 points.

If somehow, magically --- due to some imagined massive Democratic fraud --- both Montana and Utah suddenly flipped to Biden this year, but Trump managed to hold all the same other states he won in 2016 (none of which have instituted universal Vote-by-Mail this year), Trump would still win the Electoral College.

So what is he pretending to be so bothered by? Actually, nothing. He is simply desperate to win and, as his chances of doing so are dwindling, he's desperately grasping to pretend there is a massive Democratic scheme to cheat him out of that win with universal Vote-by-Mail. There isn't.

But make no mistake, he will do nearly anything to come up with a way to get a "win" --- as long as it's other people who will risk their lives for it. That, of course, is also why he is hoping to further pack an already stolen, 5 to 3 rightwing U.S. Supreme Court, and why he is signaling that there may not be a peaceful transfer of power in the event that he loses.

Despite his threats, Trump is a coward. Bullies want you to be afraid of them, when, in fact, they are terrified of you. As well he now should be.

This nation is about to be tested in a way that we haven't seen since at least the Civil War. But, as we discuss today --- and in agreement with both Nancy Pelosi's and Bernie Sanders' responses today to Trump's Briefing Room thuggery --- the solution is the vote. An overwhelming landslide of a vote, which is now completely possible if we all step up and do our duty to save this democracy. To paraphrase Barack Obama: Yes, we can!...But will we?

We will find out over the next six weeks...and beyond. We offer both advice and encouragement to that end on today's show.

Also today, just a few more reasons for Trump's increasing panic, in addition to the New York State Attorney General and the Manhattan District Attorney both quickly closing in on Trump Organization crimes in two separate probes: A federal court this week tossed out the Trump/RNC lawsuit in Nevada seeking to block their Vote-by-Mail election, despite legislation adopted by the state legislature and signed by its Governor; And the news that even Texas could now be in play, with a record 1.6 million newly registered voters, Democrats spending millions on TV ads in a state long previously considered to be a Republican state, the Biden Campaign hiring on-the-ground staffers, and CBS' latest Battleground Tracker poll finding Trump leading Biden by just two points in a state that hasn't elected a Democratic nominee for President since 1976. Oh, and Republicans appear so frightened about what could happen if voters are allowed to cast their votes in Texas this year, that a bunch of them are suing their own Republican Governor to roll back his tepid expansion of Early Voting in response to the coronavirus.

Finally, Desi Doyen has quite a bit of "big" and, yes, very good news for us today (for a change) in our latest Green News Report...
