Yikes. On today's BradCast, Trump's fascistic lawlessness is really taking hold this week in several areas...with a lot of help from his fellow corrupt Republicans. A few GOPers, however, who serve as election officials in Colorado, aren't having it. And we are grateful to them. [Audio link to full show follows this summary.]

Lots of news today, and not much of it encouraging amid America's existential fight against Donald Trump's rising tyranny...

• Late last night, for the first time since 1999, in a simple majority vote that avoids the filibuster, Senate Republicans approved a Trump-requested package to rescind some $9 billion dollars in federal spending that had been previously approved through the bipartisan appropriations process. About $8 billion was to have been for foreign aid, and more than $1 billion was slashed from the Corporation of Public Broadcasting which helps fund NPR and PBS stations around the country. That is likely to kill a number of public radio and TV stations around the country entirely, particularly in rural areas which heavily rely on CPB support to continuing broadcasting over our public airwaves. After one more vote in the GOP House tonight or tomorrow, the bill heads to the President for his signature.

• Perhaps in hopes that it will somehow make up for Trump's refusal to release the "Epstein Files" (that he is almost certainly named in, many times), the Dept. of Justice in DC on Wednesday night ordered the firing of a top career federal prosecutor in the Southern District of New York (SDNY). The longtime, very well respected prosecutor is Maurene Comey, prosecutor of the late Jeffrey Epstein's case, as well as his accomplice Ghislaine Maxwell (who is currently serving 20 years for her part in Epstein's child sex trafficking scheme.) Comey --- whose "fear is the tool of the tyrant" statement to colleagues upon leaving is here --- also happens to be the daughter of Trump's imagined enemy, James Comey, the Republican FBI Director fired by Trump during his first term for his refusal to violate the law on Trump's behalf.

• In the Senate Judiciary Committee on Thursday, Democrats walked out after Republicans prematurely ended debate on the Appeals Court nomination of Emil Bove, one of Trump's criminal defense attorneys who is currently serving as a top DOJ official. Trump has nominated him for a lifetime appointment to the federal bench. Since being tapped for a top job at DOJ, Bove has played a key role in the Department's dismissal of corruption charges against NYC's mayor; headed up weaponized mass revenge firings at the Department; threatened officials who resisted Trump's agenda; and, according to a mountain of on-the-record evidence from a DoJ whistleblower, instructed prosecutors to defy court orders in immigration cases. His nomination is opposed by hundreds of bipartisan prosecutors and judges. So, naturally, Trump wants him to have a lifetime appointment as a federal appeals court judge and Republicans on the Judiciary Committee were happy to approve his nomination today in a 12 to 0 vote after Dems walked out in protest.

• With unpopular Republicans desperate to hold on to their very narrow majority rule in Congress, so they can continue to abuse it, some are now turning to voter suppression schemes in advance of next year's critical mid-term elections. In Wyoming, where it is already unlawful for non-citizens to vote, its MAGA Sec. of State Chuck Gray is implementing a new requirement for physical proof of citizenship for voting. Voting rights advocates --- some of whom are suing --- argue that the new law is certain to disenfranchise thousands of otherwise eligible voters (particularly women, whose married names may not be reflected on papers such as passports, REAL IDs, birth certifications) in a state which, with the recent help of the federal Immigration and Customs Enforcement (ICE) agency, has been able to uncover exactly ZERO cases of noncitizen voting in the state's most populous county.

• But the most alarming news this week regarding the Trump White House's assault on voting rights and voters and elections and democracy itself this week, comes out of Colorado. On Thursday the Washington Post reported on what appears to have been a --- so far --- failed scheme to breach sensitive voting systems in 10 counties across the state. The Denver Post subsequently confirmed and added to the report. The clumsy plot appears remarkably similar to the one that resulted in the unlawful copying and theft of proprietary statewide voting and tabulation software by Trump allies in Coffee County, Georgia in early 2021. (We covered that story closely, and helped break some of it, on this show.) In Colorado, however, where Republican County election Clerks say they were contacted last week by someone said to be working for the White House, seeking access to the voting systems by DHS, all of them say they rejected the attempt. No doubt, memories are fresh in the state of former Mesa County Clerk Tina Peters, who is currently serving 9 years in prison related to having breached her own County's voting system hardware and software following the 2020 election. We've got more Special Coverage on today's BradCast of the fourth --- and, theoretically, last, but who knows? --- criminal indictment of our disgraced former President for the Summer season. [Audio link to full show follows below this summary.]

On Monday's show this week, just hours in advance of the massive new criminal charges out of Georgia, we detailed the dangers to next year's elections of the illicit Coffee County, Georgia voting system software breach carried out by Trump supporters beginning on January 7, 2021 (and covered up in the many months that followed by Sec. of State Brad Raffensperger). The scheme --- which we helped break last year and have been covering ever since --- is now known to have been just one part of a multi-state conspiracy organized by Trump attorney Sidney Powell and hatched inside Trump's Oval Office in December of 2020. It remains a huge threat to the security of next year's Presidential elections across the entire state of Georgia and in more than a dozen states with jurisdictions using the same breached, proprietry hardware and software that was stolen from Coffee County.

On Tuesday's show, we detailed the sprawling 97-page RICO indictment [PDF] of Donald John Trump and 18 co-conspirators charged with 41 felony counts by a grand jury in Fulton County, Georgia late on Monday. The charges are related to Trump's alleged (and failed) criminal enterprise to steal the 2020 Presidential election in the Peach State (and elsewhere) and comes out of the two-year probe by Fulton County, D.A. Fani Willis. We broke down all of the charges, detailed those who were indicted, along with a focus on the specific charges brought against Powell and the three others facing several counts related specifically to conspiracies to commit Computer Theft, Computer Trespass, Computer Invasion of Privacy ("with the intention of examining personal voter data") and Conspiracy to Commit Election Fraud as part of the Coffee County scheme.

The new indictment brings the number of criminal felony charges that our disgraced former President is now personally facing in four different jurisdictions at both the state and federal level to a gob-smacking 91!

And then on today's program, our hot indictment summer continues, with both legal and political analysis of the new indictment with two old friends. Democratic voters, it seems, are an easily spooked bunch. A few bad polls and some seem ready to all but throw in the towel on the November midterms. But now is not the time for that sort of thinking. As discussed on today's BradCast, there is simply too much at stake this year --- Constitutional freedoms, democracy itself, survival on Planet Earth, just to name a few --- to get sidetracked by despair. To paraphrase Obama, don't boo-hoo! Vote! (And make sure everyone else you know does the same!) [Audio link to full show follows this summary.]

It was always gonna be an uphill fight this year. It still is. But it makes no sense to wallow. It does make sense to get to work. As President Biden correctly noted this afternoon, "Today we face an inflection point, one of those moments that only come around every several generations where there's so much change happening --- technologically, politically, and socially --- that the decisions we make now are going to determine the future of our nation and the future of your generation for the next 30 or more years."

With all of that in mind, these are among the stories covered on today's program...

• Breaking just before airtime: Special Counsel John Durham --- tapped by Donald Trump and Bill Barr to investigate the investigators who investigated Russia's interference in the 2016 election --- is now 0 for 2 in Court. Igor Danchenko, said to have been a primary source for the so-called "Steel dossier", was charged in Durham's probe with five counts of lying to the FBI. He was acquitted today by a jury on all charges. He was the second to be indicted by Durham and then fully exonerated at trial. Even more humiliating for Durham: he personally handled most of the argument and questioning in court and reportedly ended up being rebuffed by his own witnesses who provided support for the defense. Worse, Danchenko, a Russian citizen living in the U.S., was reportedly "a treasured FBI informant" whose indictment "hurt U.S. national security."

• Last week we detailed the five U.S. Senate seats that could plausibly be flipped this year from Republican to Democratic (in PA, OH, WI, NC and FL) and the two Democratic seats that could plausibly be won by Republicans (in NV and GA). At the end of yesterday's show, however, we added another to the Plausible Red to Blue list when the "gold standard" Des Moines Register poll over the weekend found Iowa's 89-year old, 7-term Republican Senator Chuck Grassley to be just three points ahead of his Democratic challenger Mike Franken. Today, there's yet another Republican Senate seat said to be in jeopardy --- in deep red Utah of all places! According to two different polls, independent candidate Evan McMullin is said to be in a dead heat with GOP Senator Presidential election theft enthusiast and not Trump "bootlicker" Mike Lee. On Monday, the two sparred in their only debate. It didn't go all that well for Lee.

• On Monday, the Biden Administration opened its student loan forgiveness program at StudentAid.gov. The process has reportedly already served some 12 million applicants who may be forgiven for as much as $20,000 in debt. The process to apply reportedly takes no more than five minutes. All that is needed is a name, birthdate and social security number. The government will supposedly take care of the rest. At the same time, Republicans are suing to block Biden's program, created via Executive Order. But if they believe it's truly illegal, as Slate's Mark Joseph Stern observes today, they should introduce a bill to force those who received debt forgiveness to pay the money back. Do you think Republicans will do so?

• On Tuesday, President Biden spoke at a DNC event and vowed to codify the Constitutional rights and freedoms previously guaranteed by Roe v. Wade into federal law as his first order of business in January, after our corrupt, stolen and packed Republican Supreme Court majority took privacy rights and reproductive freedoms away from Americans last June. We share Biden's remarks today. But, in order to enact those protections, as he points out, Dems will need to hold their House majority and pick up at least two more Democratic Senators willing to reform the undemocratic Senate filibuster rule in November. If that happens, not only can abortion and privacy rights be protected by federal law, but voting rights can be expanded and protected, and the corrupt Supreme Court itself can be expanded and un-corrupted. But, again, if that's what you'd like to see, you better to get to work between now and November 8!

We are finally beginning to see the start of some real accountability for so many of the countless rightwing hoaxsters, fraudsters and scam artists who enjoyed their hey days during the Trump Era. Specifically on today's BradCast, we're beginning to see accountability for rightwing hoaxsters Steve Bannon, Alex Jones and the fraudsters calling themselves True the Vote. WE KICK THINGS OFF today with Donald Trump's former aide Steve Bannon, a guy willing to allegedly hoax millions of Trump's own supporters to raise money to build a border wall, while secretly keeping millions for himself and his fellow hoaxsters. He will face trial for those charges in New York. But this week he's facing sentencing after being found guilty on two counts of contempt of Congress for failing to respond to subpoenas for documents and testimony from the bipartisan House Select Committee investigating the January 6 insurrection and Trump's failed attempts to steal the 2020 Presidential election. The DoJ is recommending 6 months of prison time and a $200,000 fine. The sentencing hearing will be before a Trump-appointed federal judge this Friday.

NEXT UP, we're joined by award-winning broadcast journalist turned media activist SUE WILSON of Media Action Center to discuss the dangerous lies of rightwing hoaxster Alex Jones. Last week in Connecticut, Jones was ordered to pay $965 million in damages to parents of children killed in 2012's Sandy Hook Elementary School massacre. Jones was previously held liable in Texas in a separate defamation suit by other parents who also lost children in the mass shooting that resulted in the murders of 20 first graders and 6 adults.

Jones, as Wilson reported at The BRAD BLOG last week, denied that anyone was ever killed at Sandy Hook, claiming the parents of the children were "crisis actors" and that it was all a hoax by those who support gun safety measures. After years of using our public airwaves to repeat those false claims, many of the parents in question were traumatized, confronted by Jones' supporters and were forced to move, thanks to continuous harassment from some of Jones' deranged fans.

But the critical point Wilson asked in her piece was why it is that Jones is still broadcasting over our public airwaves at all? She notes today that some activists have complained to radio stations to successfully have his show removed from the air. But, she says he still remains on about 25 stations which are licensed to broadcast in exchange for "serving in the public interest". As Wilson details on today's show, there are still FCC regulations on the books barring the use of our public airwaves to promote hoaxes that involve crimes such as murder. Nevertheless, no action has been taken by the federal government against Jones or the stations who air him. We discuss why that may be, how listeners can take action to change that and the First Amendment issues surrounding the matter.

THEN, we've spent too much time on past shows already detailing how the GOP "voter fraud" fraudster group calling itself True the Vote (TTV) attempted to hoax the nation by creating a fake documentary with fellow hoaxster (and convicted election fraudster) Dinesh D'Souza called 2000 Mules.

The premise of the film is that TTV claims to have purchased third-party cellphone geolocation data that supposedly reveals thousands of phone users repeatedly visiting absentee ballot drop-boxes in multiple battleground states in 2020 to cast hundreds of thousands of fraudulent votes. Moreover, the group claims they have thousands of hours of surveillance camera video footage revealing the same "mules" visiting these drop-boxes over and over to cast the phony ballots.

The film was thoroughly debunked as nonsense almost immediately upon its release earlier this year. In fact, it includes no actual footage of anybody casting fraudulent votes. But certain rightwing dupes, including the former President, falsely insist that it does. Just last week, for example, in response to the House J6 Committee voting to subpoena Trump, he responded with an absurd 14-page reply [PDF] citing dozens of (long-ago debunked) instances of fraud in the 2020 election. He cited TTV's 2000 Mules film, claiming the group "collected over 4 million minutes of ballot drop box video, showing ballot stuffing at a level not seen before." The result, he falsely asserted, proved that "millions of ballots were stuffed...an Election-changing number many times over."

All of it, of course, is nonsense. And, as it turns out, even the office of Arizona's far-right, voter-suppression friendly Attorney General Mark Brnovich has now noticed. On Friday, the Criminal Division in his office referred TTV to the FBI and IRS for investigation. The AZ A.G. explains in their two-page referral letter [PDF] that, despite multiple meetings with the group's founder Catherine Engelbrecht and researcher Greg Phillips, who both claimed to have video evidence of fraud they promised to turn over, they never actually did. Furthermore, as the letter explains, the pair also met with FBI officials in Phoenix and claimed to have turned over the data to Brnovich's office. They later met again with Brnovich's office and claimed they gave the data to the FBI!

"Given TTV's status as a nonprofit organization," the Chief Special Agent in Brnovich's criminal division office wrote to the FBI and IRS on Friday, "it would appear that further review of its financials may be warranted."

FINALLY, on one of our programs last week, I broke down the five Republican U.S. Senate seats (in PA, OH, WI, NC and FL) that appear to have a plausible possibility of flipping to Democratic in November's critical midterm elections, and the two Democratic seats (in GA and NV) that could plausibly flip to Republican. But over the weekend, the Des Moines Register poll --- considered the Gold Standard for political polling in Iowa --- released an eyebrow raising survey finding that the state's 89-year old seven-term Republican Senator Chuck Grassley, now running for his eighth term, is only three points ahead of his Democratic challenger, retired U.S. Navy Admiral Mike Franken, among likely voters. The poll shows Grassley leads with 46% of the vote to Franken's 43%. Could that seat really be up for grabs in the Hawkeye State next month?!...

We've got yet another jam-packed BradCast for ya today, with results of note --- as we have them so far --- from the 7 states which held primaries on Tuesday. Then, we're joined by our guest with some helpful insight on what Democrats and progressives should learn from this year's elections to date and some of his critical concerns about the upcoming hearings by the bipartisan U.S. House Select Committee investigating January 6, 2021 insurrection. First, we fly through an extremely curated selection of results from several key races on Tuesday. Among them...

• IOWA: Retired Navy Admiral Mike Franken upset former U.S. Rep. Abby Finkenauer in the state's Democratic U.S. Senate primary. He will face off against 88-year old, six-term U.S. Senator Chuck Grassley. Also noteworthy in the Hawkeye State: progressive Democratic criminal justice reformer Kimberly Graham won the Democratic primary for prosecutor in Polk County (Des Moines), where she is likely to win this November.
• MISSISSIPPI: Two-term Republican Rep. Michael Guest was forced into a runoff by GOP voters as punishment for having voted in favor of a bipartisan, outside Commission to investigative the January 6th insurrection.
• MONTANA: Donald Trump's disgraced, scandal-plagued, forced-to-resign Interior Secretary Ryan Zinke is locked in a tight race to win his old job back as a U.S. Congressman. The final results of the close race with state Sen. Al Olszewski, which Zinke leads by about 1,000 votes as of airtime, will be held up by a day or two due to a ballot printing error that will require, under state law, that all ballots now be hand-counted.
• NEW JERSEY: While there may have been races of note there, we didn't have time for ANY of them today! Sorry about that, NJ! (I know. Always the bridesmaid...)
• NEW MEXICO: Seasoned TV weather guy Mark Ronchetti won the GOP primary for Governor after promising to increase the state's already record oil production, deriding new standards in state schools for increased instruction on race (in a state that is half Hispanic and has 23 federally recognized Native American tribes and nations), and by slamming his November opponent, Democratic Gov. Michelle Luhan Grisham, for closing in-person schooling during the worst pandemic in 100 years. Also: Progressive Democrat Gabriel Vasquez was victorious in the 2nd Congressional District race to take on GOP Rep. Yvette Herrell in what is seen by Dems as a possible House pickup this November.
• SOUTH DAKOTA: The state's only House Member, Republican Dusty Johnson, easily won his primary despite voting to certify the 2020 election results and in favor of the January 6 Commission. Shamefully, there is no Democrat running for the state's single At Large Congressional seat. Of greater note, a ballot proposition that would have raised the threshold for passage of certain future ballot propositions to 60% was soundly rejected by voters. That proposition was meant to make it harder to pass a ballot proposition this November that would expand Medicaid under ObamaCare to state residents. Similar expansions measures have been adopted by voter initiatives in about 7 other states. GOP lawmakers in SD must really hate their own constituents.
• CALIFORNIA: All statewide office holders are Dems, so there isn't much drama there. But two local contests have received quite a bit of national notice. The Los Angeles Mayoral race will go to a runoff, after Trumpy Republican real estate billionaire turned "Democrat" Rick Caruso failed to clear the 50% bar, despite dropping some $40 million of his own money into the race. He'll face progressive Rep. Karen Bass, previously seen as the favorite to win until Caruso and his money showed up, in the November runoff. But, interestingly, receiving as much or more notice from national corporate news outlets than almost any other race on Tuesday, voters recalled progressive criminal justice reformer, Chesa Boudin, after two and half years as San Francisco's District Attorney. Predictably, national media is (mis)reporting this as a story of "failed progressive policies" that resulted in rampant crime in the city, despite the fact that overall crime decreased during Boudin's tenure.

We're then joined by longtime progressive champion, journalist, and author JOHN NICHOLS of The Nation for analysis of Tuesday's contests --- and those from week's past --- along with his concerns and warnings about the upcoming January 6 hearings in the House.

As to the primaries so far this season, Nichols observes, among other things that while "Republican turnout is very spiked" and Dems "not so spiked", that is "not necessarily a complete disaster" for Democrats. He also notes that "progressives are winning a lot of Democratic primaries" and "in some unexpected and really interesting places".

"Despite what a lot of the pundits will tell you," he argues, means that "the grassroots Democratic voters seem to be sending a very clear signal that they want to go up against these Trump Republicans in this very tough year with clearly defined progressive candidates."

While he offers thoughts on the recall defeat of progressive District Attorney Boudin in San Francisco, Nichols also observes that criminal justice reformers are actually still winning elections in many other places around California and elsewhere. (See, for example, a progressive criminal justice reformer victories in neighboring counties to San Francisco and Kim Reynolds in Des Moines, IA, as mentioned above, as just two such examples.)

Then, it's on to the upcoming January 6 hearings, where Nichols has both advice and concerns, particularly about what the Committee will ultimately offer in their critical recommendations. His greatest concerns seem to center on what Democrats are willing to compromise on in order to find unanimity with the Committee's anti-Trump, but still hard-right Republican Vice Chair Liz Cheney.

Among Nichols' top hopes for the Committee: Recommendations that Congress adopt a resolution that bars insurrectionists like Donald Trump from office, as per Section 3 of the U.S. Constitution's 14th Amendment; and (in what will clearly be a much heavier lift for the Committee's Republicans like Cheney), a call to abolish the Electoral College.

But will the hearings ultimately make any difference to a divided nation, with so many already having hardened their positions on Trump and his attempt to steal the 2020 election? We've got a whole lot to discuss with Nichols today, so I hope you'll tune in!...

On today's BradCast: A day in which a cop was finally found guilty of the murder of a hand-cuffed black man is probably a good day to discuss an important idea for long-overdue police reforms that could help keep people alive and allow police to do more of what they should be doing and less of what they are not needed to do. [Audio link to full show is posted at end of summary.]

Just before airtime today, the verdict was announced in the trial of white, 45-year old former Minneapolis police officer Derek Chauvin, who was notoriously seen on video last year with his knee on the neck of George Floyd, a 46-year old handcuffed black man. After more than 9 minutes, Chauvin choked the life out of Floyd and was found guilty today on all three counts of 2nd and 3rd degree murder and 2nd degree manslaughter by a unanimous jury in Minneapolis. In a state already on edge from the killing of a 20-year old motorist by a 26-year veteran white cop just over a week ago in neighboring Brooklyn Center, MN, the state and the nation exhaled a collective sigh of relief as the judge announced the jury found Chauvin guilty on all counts before he was handcuffed and marched off to prison.

Before speaking to our guest on a related note today...Republicans at the state level in Montana are the latest to pass new laws to restrict access to the voting booth (for certain voters) on the heels of Donald Trump's evidence-free claims that the 2020 election was stolen from him. Two new provisions were adopted in MT on Monday under the guise of preventing fraud, despite Republicans in the state being unable to cite any examples at all of voter fraud there in modern history. One bill would end same-day voter registration, which has been a problem-free success in the state since its broad bipartisan passage in 2005. The other measure enacts new Photo ID restrictions at the polling place by, among other things, disallowing student IDs as an acceptable form of ID for voting, despite 20 years of zero problems or fraud with such IDs. The bills were signed by the Governor yesterday, and the state was sued by Democrats in response today. Montana becomes the third state to adopt newly restrictive voting laws following the 2020 election, after Iowa and Georgia did so previously. All three are now be forced to defend their new suppression laws in court.

On the federal level, Democrats in the House have passed several laws which would counter many of the new restrictions being pushed forward by Republicans at the state level. But filibustering Republicans and the refusal by Democrats like West Virginia's Joe Manchin to reform or kill the undemocratic Senate rule are preventing passage of those landmark measures that would protect voters and elections nationally. Today, during a hearing in the Senate Judiciary Committee on "Jim Crow 2021: The Latest Assault on the Right to Vote," ranking Republican Sen. Chuck Grassley made clear how out to lunch he is and how disingenuous his party is in supporting these new restrictions on the franchise. Among Grassley's embarrassing comments at today's hearing: His contention that Major League Baseball pulling their All-Star game out of Atlanta is "likely to cost the city's economy 100 million jobs" (there are fewer than 11 million people in the entire state) and that corporations and voters exercising their free speech rights to decry vote suppression amounts to "economic terrorism".

Then, it's back to policing with our guest today, JORDAN BLAIR WOODS, criminology expert and Associate Professor of Law at University of Arkansas' School of Law. Amid outrage over a seemingly never ending series of incidents revealing cops assaulting and/or killing motorists --- usually black ones --- following otherwise routine traffic stops, the demands for policing reforms grow seemingly louder each day.

Woods has been writing at a number of law journals for several years now about one seemingly simple reform that could save lives and prevent so many traffic stops from turning deadly: replace traffic stops by armed police with unarmed traffic monitors. According to the Dept. of Justice [PDF], more Americans, 24 million, come into contact with police via traffic stops than by any other means each year. Routine stops for a missing tail light, an expired tag or even an air freshener hanging from a rear view mirror too often turns unnecessarily deadly. As Woods detailed in a 2019 Michigan Law Review article [PDF], this can be attributed to cops being trained to believe that every traffic stop could turn deadly in seconds (even though that is decidedly not the case.)

As he tells me today, "One of the key reasons why we see officers having so much authority to do what they're able to do during traffic stops really rests on this myth that traffic stops are especially dangerous settings for police officers.  But what we're seeing play out, and what empirical research has really documented, is that when we're thinking about who is harmed during traffic stops, it's those who are from communities of color that are disproportionately stopped, frisked, cited, arrested and ultimately subjected to force. And, unfortunately, too many times it results in their death during traffic stops."

Reporting on this same topic earlier this year at The Appeal, Meg O'Connor notes: "Black drivers are 20 percent more likely to be stopped than white drivers, and as much as twice as likely to be searched, according to a study of 100 million traffic stops conducted by the Stanford Open Policing Project. And 11 percent of all fatal shootings by police in 2015 occurred during traffic stops, according to a Washington Post database of police killings."

So, what if cops were taken out of that equation entirely? In his recent Stanford Law Review article, Woods offers a framework for doing just that. "The basic idea behind the framework," he explains, "is that we know that tens of millions of traffic stops occur every year. Many of these are for run-of-the-mill traffic violations. I argue in my framework that we don't really need police to be involved in this type of enforcement. So it creates new public agencies that are completely separate from the police, work independently from the police.  Their basic role is to enforce traffic and not to conduct criminal investigations, which is really where we see a lot of problems during traffic stops today come from."

He calls for traffic agencies to be created and manned by "unarmed traffic monitors to essentially do routine traffic enforcement. They wouldn't be armed, they wouldn't have the typical police powers to search or arrest. It really bring the traffic stop to being just about traffic."

"One of the advantages I see to having non-police agencies and non-police traffic monitors conducting these types of stops, is that we could really use discretion to only be enforcing traffic laws in situations where we think there's a notable safety threat, and eliminating these situations that we are seeing now over air fresheners. We know that these minor infractions are being used for pre-textual reasons by police to pull people over. We avoid that by at least moving to a regime where police are not handling this type of work," Woods argues.

But would such a system place unarmed traffic monitors in harms way during stops? Would it cut off a necessary crime fighting tool for police? Can much of this work simply be automated to remove many of the face-to-face confrontations in the first place? And, given that Wood's proposition seems like such a no-brainer reform, frankly, what legitimate objections might police or lawmakers have to such a new framework?

We discuss all of that and much more with Woods today, who also comments on similar reforms recently enacted in places like Berkley, California and elsewhere, as many cities and towns across the nation seek reforms to help stem the tide of our excruciating epidemic of unnecessarily violent and systemically racist policing.

Finally, we're joined by Desi Doyen with the latest Green News Report. As usual, she rings the alarm bell on new studies warning of our worsening climate emergency, even while sharing some exceptionally encouraging news today, including word that the nation's largest coal mining union now appears to be on board with Joe Biden's plan to find new work in renewable energy for those whose jobs in dying fossil fuel industries will necessarily be displaced in the critical effort to mitigate the most deadly effects of our ever-warming climate.

On today's BradCast, we open with the breaking news about the longest serving Senator in Congress. 87-year old Republican Sen. Chuck Grassley from Iowa has tested positive for the coronavirus. We wish him well, as the COVID crisis explodes across the nation because Grassley's party and President failed to even try to combat the deadly pandemic that has, so far, killed almost a quarter of a million Americans, and may kill as many more by the time Donald Trump mercifully leaves office in January. The rest of today's show is moderately less infuriating. [Audio link to show follows below.]

We start off today with good news/bad news stories regarding both the incoming President-elect and the definitely, whether he's man enough to say it out loud, soon-to-be-former outgoing President. Unfortunately with 64 more days until he's out, by law, the increasingly unstable Trump still has his finger on the nuclear button. The bad news is, as the New York Times reports, he is attempting to launch an attack on Iran his final days. The predicate is a recent report from the the International Atomic Energy Association (IAEA) finding that --- thanks to Trump reneging on the hard-fought, successful 6-party deal struck under President Obama that prevented Iran from being able to build a nuclear weapon --- the nation is once again rebuilding its nuclear stockpile. The good news is that there are apparently just enough not-insane top officials left in the White House and Pentagon that they were reportedly able to talk our deranged President out of sparking WWIII on his way out the door. For now.

The good news/bad news regarding President-elect Joe Biden is that, according to sources who spoke with NBC News, he is disinclined to seek accountability for the many crimes committed by Trump and his administration over the past four years. Yes, it's an echo of Obama's failed "look forward, not back" policy regarding George W. Bush Administration crimes after the Democrat took back the White House in 2008. As we've long argued, that lack of accountability paved the way for the rise of Donald Trump and other GOP miscreants. The good news (good-ish, anyway), is that Biden also says, according to advisers, that he hopes to restore the important separation between the White House and the Department of Justice upon taking office. That means that prosecutors will be free to follow the law and investigate and prosecute as they see fit. Much of this, therefore, rests upon whoever Biden names as Attorney General, though none of this will protect Trump from criminal accountability at the state level, especially in New York.

Then, it's back to Election 2020 Crazy Land, where...

• Trump must decide by Wednesday if he's gonna cough up $7.9 million dollars for an almost certainly futile "recount" in Wisconsin;

• Trump crony Sen. Lindsey Graham appears to have tried to convince Georgia's Republican Secretary of State to toss out lawfully cast ballots in the state, according to the woeful and embattled Sec. of State Brad Raffensperger. That could amount to any number of both state and federal crimes committed by the man who heads the Senate Judiciary Committee, as we explain;

• Amid Raffensperger's ongoing quasi-audit, quasi-recount, quasi-recanvass in Georgia --- an otherwise wholly-meaningless and extra-legal exercise invented by Raffensperger to try to kiss up to Trump and the other Republicans who are being mean to him because Trump lost Georgia --- nearly 2,600 untallied ballots were discovered in GOP-leaning Floyd County. With those ballots added to the current totals, Trump will pick up some 778 votes on his approximately 14,000 vote deficit against Biden in the Peach State;

• In Pennsylvania, the crazy is almost too much to keep up with today. On Sunday, Team Trump revised its baseless federal lawsuit by removing a demand to toss some 680,000 ballots. That leaves only a complaint regarding Democratic-leaning counties which lawfully allowed voters who cast mail-in ballots that were deficient in some way (missing a signature or the secrecy ballot) to come in and "cure" the deficiency before Election Day. Republican-leaning counties, for unknown reasons, didn't bother. Either way, there are reportedly nowhere near enough such ballots to overcome Trump's current deficit of more than 73,000 votes.

  But the amusing part is that almost the entire legal team representing the Trump Campaign in the Keystone State withdrew from the case entirely by Monday, leaving one poor GOP schmo with a rightwing radio show representing Trump as his attorney on the case. (Just days after Election Day, the same schmo also told his listeners on air that "no bombshells are about to drop that will derail a Biden presidency," that "litigation will not work" and "will not reverse this election.")

  After a federal judge denied the schmo an extension for Tuesday's emergency hearing, so he could bone up on the case, Trump sent Rudy Giuliani to rescue him, even though Rudy hasn't appeared as an attorney in a courtroom since 1992. We had no news from today's hearing by airtime, but we have since heard it did not go well.

  But just before airtime, we did get word out of the PA Supreme Court on a separate case, in which Team Trump lost yet again. This time, on their counter-factual claims that Republican observers were not allowed to properly oversee counting in Philadelphia. The state Justices found that they were allowed, as per state law, and that the claim was false. That brings Trump's losses to date in his election related challenges to something like 25 out of 26 cases nationally. But don't worry! He's totally gonna "win" this thing any day now!

• Finally, Desi Doyen joins us for our latest Green News Report as Hurricane Iota slams Nicaragua (the record-smashing 30th Atlantic storm of the season, and the most powerful to date in 2020); the Trump Administration rushes to sell off drilling rights in the previously-pristine Alaska National Wildlife Refuge; and President-elect Biden meets with business and labor leaders to begin moving forward again on both the economy and climate...

On today's BradCast: American democracy is far more broken than most of us realize. But we can't begin to repair it until we've corrected the GOP's stolen U.S. Supreme Court by expanding it and, as our guest today notes, "entrenching democracy". [Audio link to show follows below.]

But, before we get to that today, very quickly, we take note of the more than 200,000 Americans who have now been killed by COVID-19. As AP reports, that is the equivalent of a 9/11 disaster every single day for 67 days in a row. Or the entire city of Salt Lake City, UT or Huntsville, AL being wiped off the map. That horrific number likely under-counts the real total by tens of thousands and is expected to more than double to nearly 400,000 or more dead by the end of this year. The tragic landmark also comes the day after the President of the United States told his supporters at another shoulder-to-shoulder, largely-maskless campaign rally in Ohio on Monday night that the coronavirus "affects virtually nobody."

Meanwhile, Republicans in the Senate appear to have completed their hypocritical contortions of reality in order to declare they are now ready to vote to fill the U.S. Supreme Court seat vacated with the death of Justice Ruth Bader Ginsburg just four days ago. See? That was easy! Never mind all of those vows back in 2016 --- and even as recently as July of this year, in the cases of hypocritical Republican Senators Chuck Grassley and Joni Ernst of Iowa --- that they would never, ever support a new Justice being seated on the Supreme Court in the last year of a Presidential term! The "new rule", as Lindsey Graham dishonestly lied about it in 2016 (on video tape, asking for his words to be used against him if he ever acts otherwise), is now apparently the "old rule" and no longer operative. After his flip, Graham announced Monday night that whoever Trump's nominee is (to be revealed Saturday, before RBG is even buried), they "will be supported by every Republican in the Judiciary Committee and we have the votes to confirm the justice on the floor of the Senate before the election. And that's what's coming."

The news from Graham, who now chairs the Senate Judiciary Committee, comes as Colorado's Sen. Cory Gardner agreed to support Trump's nominee, after saying in February of 2016, when Scalia died, that "I think we're too close to the election. The President who is elected in November should be the one who makes this decision.". It also comes as Utah's Mitt Romney, who voted just months ago to remove Trump from office during his impeachment trial, declared that he believes it's in keeping with "historical precedent" and a matter of "immutable fairness" to consider, ASAP, a third lifetime appointment to the highest court in the land by the man who he didn't even think should hold the job of President just seven months ago. Things change quickly around here.

For the record, Ernst, Gardner and Graham are all facing very tough re-election challenges this year from Democratic Senate nominees Theresa Greenfield in Iowa, John Hickenlooper in Colorado, and Jaime Harrison in South Carolina, respectively.

None of these nightmares, however, could even be happening, were it not for our broken system of democracy. One which has allowed not only one stolen Supreme Court seat back in 2016, but which allows a President who lost the popular vote and a Republican caucus in the Senate which received fewer votes than the Democratic Senators (yet still retains its majority) to break their own invented "precedent" in order to steal yet another seat on the nation's highest Court.

As our guest today characterizes the stolen SCOTUS majority after the GOP's FIRST stolen seat in his upcoming Harvard Law Review article on "The Degradation of American Democracy --- and the Court": "McConnell's stratagem was unprecedented: the theft of a Supreme Court seat. Even though Democrats have now won the popular vote in six of the last seven presidential elections, a combination of the vicissitudes of the electoral-college system, the ability of most Justices to time their retirements, and McConnell's Machiavellian maneuver, has produced the most conservative Supreme Court since the 1930s. This is not how democracy is supposed to work."

But it's how it "works" now, apparently, even as that paragraph was penned before McConnell's latest "Machiavellian maneuver" upon the death of RBG. We're joined today by Harvard Law School legal historian, Prof. MICHAEL KLARMAN, to discuss our broken democracy and how to begin repairing it by expanding the size of the current Court to restore the liberal majority stolen from Democrats beginning in 2016. We last spoke with Klarman back in 2018, when he argued that if Democrats failed to do so when they next regained both the White House and the Senate majority, they would be committing "political suicide". Now, he argues, the case is even stronger and more urgent.

Klarman also clerked for the Honorable Ruth Bader Ginsburg when she served as a judge on the U.S. Court of Appeals for the D.C. Circuit in the 1980s and shares some thoughts on both her passing and on his time working for the now-legendary late Justice at the top of our conversation.

"The argument for altering the size of the Court is very straightforward," Klarman goes on to explain. "The only argument against it is if Democrats do it, then Republicans will do it, and we'll be in a retaliatory cycle that will never end. But there are three different responses to that. One is the Republicans have already done it by shrinking the size of the court by one [for a year after Scalia died]. Second, the Republicans will do it, whether Democrats do it or not, the first time it appeals to Mitch McConnell to do it. Mitch McConnell has demonstrated in the last few days that he's just an utter and complete hypocrite. ... So if Republicans are going to pack the court anyhow, that's hardly an argument against Democrats doing it."

"The other argument is we need to break out of the situation we are in right now, which is a Republican Party and a President that are a threat to American democracy," Klarman warns, before going on to list the ways in which the GOP now "suppresses votes in a score of different ways at the local level --- with voter ID laws, with voter purges, shutting down mobile voting sites so college campuses can't encourage students to vote --- I mean, it's really quite extraordinary what the Republican Party is doing in order to steal elections."

Klarman tells me that any Democratic attempt to entrench democracy, should they win the White House and Senate, can be struck down by a Supreme Court that "will come up with some contrived Constitutional argument to strike it down."

"If you actually entrench democracy, and all Americans who wanted to vote could vote without obstacles, the Republicans Party understands they would never win another election until they start changing their policies so that they appeal to more Americans," he says.

Right now, Klarman argues, "The deck is stacked against Democrats. So Democrats get one chance to do this right [if they are able to win back the White House and Senate in November.] And if they don't do it, then you're going to have to give up on American democracy pretty soon, because this Republican Party supports an authoritarian President who doesn't believe in freedom of speech, freedom of the press, independent judges, who encourages violence, who pals around with autocrats around the world. The Republicans are fine with that. People don't seem to appreciate how alarming the situation is. We are on the cusp of losing our democracy. This is the most important election in American history, since the Civil War."

Hey! Remember Brett Kavanaugh? The Donald Trump SCOTUS appointee who demonstrably lied during his sworn U.S. Senate Confirmation hearings last year before Republicans voted to ram him through to a lifetime appointment on the highest court in the land, anyway? Yeah, we do too. Thankfully, so does our guest on today's BradCast who, as a member of Congress, can actually maybe --- just maybe --- do something to finally bring some accountability there. And, according to a letter signed by him and House Judiciary Committee Chair Rep. Jerry Nadler (D-NY) on Tuesday, there is now evidence that they intend to try and do just that! [Audio link to full show is posted below.]

But, first up today, NBC News nailed it in a headline we saw only after getting off air today: "Trump turns day of grieving for shooting victims into day of grievances". That about sums it up. On Monday, in a scripted teleprompter speech, the President responded to the two weekend gun massacres that took the lives of at least 31 in El Paso, Texas and Dayton, Ohio by asking Americans "to set destructive partisanship aside...and find the courage to answer hatred with unity, devotion and love". But, just over 24 hours later, he began to unleash various attacks on Democrats Beto O'Rourke, Ohio Sen. Sherrod Brown, Dayton Mayor Nan Whaley, former Vice President Joe Biden, and even managed to tie Senators Bernie Sanders and Elizabeth Warren somehow to the shooter in Dayton. All of that before, during and after what were supposed to be Presidential visits to the two recovering cities, intended to console them and help ease their pain after the twin tragedies.

On Tuesday night, Trump first broke his call for setting aside partisanship with a misfired Twitter snipe at El Paso native Beto O'Rourke's name, in which he told the former Texas Congressman to "be quiet!" after O'Rourke accurately tied the El Paso shooter's white supremacist diatribe to Trump's identical references to an "invasion" at our southern border. But on Wednesday morning, before leaving for his trips to the two grieving cities, he told reports at the White House that he felt his "rhetoric brings people together" and he "would like to stay out of the political fray." That vow didn't even last until he arrived in El Paso, with his new Twitter attacks emanating even while he was on Air Force One.

But in news today that is much less insane, we are joined by REP. HANK JOHNSON (D-GA), a member of the U.S. House Judiciary Committee and Chair of its Subcommittee on Courts, Intellectual Property and the Internet. That subcommittee oversees the federal court system, including the U.S. Supreme Court. On Tuesday, Johnson and Nadler sent a letter to the National Archives and Records Administration requesting records from Justice Kavanaugh's tenure in the White House during the George W. Bush Administration, when he first served in the White House Counsel's office from 2001 to 2003 and then as White House Staff Secretary from 2003 to 2006.

The request includes thousands of documents either never reviewed or never requested by then-U.S. Senate Judiciary Committee Chair Chuck Grassley (R-IA) during Kavanaugh's SCOTUS confirmation process last year. While Grassley requested no documents at all from Kavanaugh's tenure as Staff Secretary --- during which many decisions were discussed and made in the run-up to Iraq War and about the torture and detention of suspect terrorists and prisoners of war --- thousands of documents from Kavanaugh's time in the White House Counsel's office were withheld from the Senate Judiciary panel last year after they were privately reviewed by Kavanaugh's own personal attorney.

Johnson explains why Democrats are now seeking all of those records, what they hope to find, and what they may do with the information they unearth from them on the Committee which has jurisdiction to launch impeachment proceedings for all federal judges, including Supreme Court Justices.

Of course, it remains to be seen whether the Trump Administration will attempt to block the records request, which asserts the rights of the Committee to review the documents under the Presidential Records Act of 1975. If they are blocked, Johnson tells me, they are prepared to take additional measures to obtain the records. The Georgia Congressman also responds in detail to a number of my questions including whether he supports an expansion of the U.S. Supreme Court in order to unpack the Republican's currently stolen majority; why he is not currently among the majority of House Dems publicly calling to open an official Impeachment Inquiry in his Judiciary Committee; and what he thinks of his home state of Georgia's current plan to move from one 100% unverifiable touchscreen voting systems to an all new, if equally unverifiable touchscreen voting system --- rather than a cheaper, verifiable hand-marked paper ballot system --- before next year's crucial 2020 Presidential election in a state that many believe may finally be ready to flip "blue" after years of GOP dominance in the state.

On what he hopes to find in Kavanaugh's records from the George W. Bush years: "I hope to discover that Justice Kavanaugh has been completely forthright and honest with the U.S. Senate during his confirmation process. Moreover, I hope to find that the conduct of Justice Kavanaugh, during his time as Secretary with the Office of Counsel for the President, at all times conducted himself in a way that would be in keeping with that of someone who now serves on the U.S. Supreme court with a lifetime tenure. And, of course, that is only subject to the House's ability to impeach, should there be a need for it. The American people deserve to know who we have on the US Supreme Court, what his background is, and if he was honest with the Senate in his confirmation proceedings."

On expanding the stolen SCOTUS: "It's no question that the courts have been stacked with judges with a particular political bent...They are holding the future back, and it's hurting America. So we, as the legislative branch, with the power to expand the Supreme Court --- nothing in the Constitution says that it will be a Court of nine Justices --- so we have to look at whether or not its in the efficiency of our process that we need to expand the Court. We really don't need to politicize the courts. But unfortunately the courts have been politicized. So the question is, what do we do? And how will the Supreme Court react to the fact that the legislative branch is open to looking at alternatives to the current way that it does business?"

On why Johnson is not currently among the majority of Dems in the House publicly calling for an official Impeachment Inquiry: He stands by his current position (despite my generous offer to allow him to make news by changing it on today's BradCast), while explaining, "We are proceeding in the nature of an impeachment inquiry at this time, and we're doing so without calling it an impeachment inquiry so as not to put the 31 red-to-blue winners in 2018, new Democrats, not to put them in jeopardy of not being able to come back and keep us in the majority in 2020. ... At some point we may accumulate the record that we can then pass the impeachment resolutions on and then proceed to the evidence --- not just the Mueller Report, but the evidence... take that over to the US Senate and have a trial. " After I press him a bit on his current position, he concedes: "I tell you what --- if you call me back in about two or three months, maybe I will have changed on impeachment."

And, finally, on Georgia's Republican Governor and Sec. of State defying cybersecurity experts to move from one unverifiable touchscreen voting system to another: "I think the way to go is to have hand-marked paper ballots that are then scanned into a counting machine and counted. And then you have the paper ballots that you can test the results of the tally machine against, and that way, you can have a verifiable vote. ... But we cannot do it on this new system that the Georgia legislature has authorized. I think it is a $125 or $150 million dollar expenditure that will be for a system that we can't even rely on. I think it's bad for the taxpayers, it's bad for the voters, it's bad for democracy, and it's a bad move for Georgia."

Jeff Flake will go down in history as a split-the-difference kinda guy. It was his "neither this nor that" stance at the end of today's hearing that might well spell the end for SCOTUS nominee Brett Kavanaugh. I refer in today's show to an image on the New York Times story - a screen capture of a video by Erin Schaff. A man with much on his mind.

Flake voted yes, but not until he threw a wrench in the works: he wants an FBI investigation over the next week. It was utterly unclear even to his colleagues whether that was a motion or not - I've got the audio in the show for you - but it started the dominoes falling. Lisa Murkowski joined him in his stance. Mark Judge, the sole alleged witness to the assault on Ford, agreed to cooperate with the FBI. Finally, Donald Trump followed suit.

So was Flake's conscience sparked by Ford's story, or the other allegations, or the protesters --- more sexual assault victims --- who followed him to an elevator and made him listen? Or did he reach sudden clarity on what this episode will look like to future generations, and decide he'd better straddle that line but quick?

It doesn't matter, ultimately. The dominoes are down.

Speaking of Rewire, this story posted there late today is deeply affecting. Watching Dr. Christine Blasey Ford’s life get shredded, five Congresswomen spoke up to publicly identify themselves as victims of sexual assault or domestic violence. Rep. Alma Adams of North Carolina said so very simply that this is "just part of her job representing her constituents."

This hour I present to you the contrasting statements of the accuser and the accused. A tentative but strong, conciliatory and polite woman (asked about taking a break, she replied "Does that work for you? I’m used to being collegial."), and an angry, bellowing, interruptive, hostile nominee for a lifetime position on the U.S. Supreme Court. As Brian Behar tweeted: "Can you imagine what the reaction would've been if Dr. Ford had behaved even half as hysterically as Brett Kavanaugh or Lindsey Graham?"

Speaking of Twitter: you’re welcome to view my analysis of Brett Kavanaugh’s tell-tale face. I tweeted that thread before he took his seat at the hearing; then, every time I glanced at his face, it only confirmed for me his wrath at having his power, privilege, and entitlement questioned in the slightest. I guarantee you: countless women have seen that face in the worst of all possible circumstances, and you never forget it.

On today's BradCast: It's National Voter Registration Day as the crucial midterm general elections on November 6th are now exactly 6 weeks away. Other than that, today's news may be somewhat less encouraging --- though we, and the world, manage to have a bit of a laugh at Donald Trump's expense, in the bargain. [Audio link to show follows below.]

First up: Happy National Voter Registration Day! Do you need to register to vote before November 6th? Have you checked your registration lately to make sure it's accurate? Today is a great day to do so!

Today is also a great day, apparently, for the world to laugh at the President of the United States, as they literally did at the United Nations General Assembly on Tuesday. Not with Donald Trump, but at him, during his address to the Assembly.

While there, during a joint media avail with the President of Colombia, Trump also took the time to attack the two named women who have accused his U.S. Supreme Court nominee, Brett Kavanaugh, of sexual assault during high school and his first year at Yale. Trump also dismissed the allegations as little more than "a con game being played by the Democrats." That, even as new information continues to buttress the allegations by the women and as the calls grow louder (even from Mormon women) for a full, legitimate investigation of their charges, which the White House and Republicans refuse to ask the FBI for (and which even potential Kavanaugh swing vote Lisa Murkowski (R-AK) now says she'd like to see.)

Meanwhile, Kavanaugh, a longtime GOP operative who claimed during his initial Senate confirmation hearings just weeks weeks ago that "the Supreme Court must never be viewed as a partisan institution", took to the right-wing Fox 'News' air waves on Monday night for a softball interview with his wife, in hopes of defending himself against the growing allegations. He and his first accuser, Dr. Christine Blasey Ford, are scheduled to give testimony before the U.S. Senate Judiciary Committee on Thursday. In advance, the all-white, all-male Republicans on the Committee have announced they are hiring a woman to ask questions of Ford on their behalf, though they won't identify her. They have also now scheduled a committee vote on Kavanaugh's nomination the very next day, on Friday.

At the same time on Thursday, Trump is scheduled to meet at the White House with Deputy Attorney General Rod Rosenstein, the Republican who oversees the Robert Mueller Special Counsel probe into the alleged conspiracy between Team Trump and Russia. The meeting, at which many expect Rosenstein will be fired, follows a misleading exclusive report published by the New York Times charging Rosenstein had suggested secretly taping Trump and recruiting White House staffers to invoke the 25th Amendment early last year. As subsequent reporting by other outlets reveals, however, Rosenstein was reportedly being sarcastic with his comments, according to people who were actually at the meeting in question. Nonetheless, we are still barreling toward a potential Constitutional Crisis as early as Thursday, thanks in no small part to the pretext for firing Rosenstein --- and perhaps Mueller, shortly thereafter --- äs provided by the Times' reporting.

We're joined today by former Media Matters media critic, author and political writer ERIC BOEHLERT of ShareBlue to discuss both of these stories and where they may be headed, as well as for some insight into what the hell is wrong with the New York Times.

On the Supreme Court, Boehlert says, among many things of note today: "With Merrick Garland, and with Kavanaugh, the Republican Party in 18 months is this close to demolishing the legitimacy of the United States Supreme Court. That has huge implications, not just for law and justice, but for an authoritarian like Trump. Because corrupting the high courts is always a goal of any authoritarian, just like de-legitimizing the free press."

As to his analysis of the "institutional problems" at the Times, you'll have to tune in for details, but he notes: "There does seem to be a pattern. When they get things wrong, they get things wrong in a way that helps Republicans."

Finally today, Desi Doyen joins us for our latest Green News Report, as the impacts of Hurricane Florence continue in the Carolinas two weeks after landfall, including new evacuations, more record flooding, the toxic release of coal ash into North Carolina waters, and the media failure to connect the climate change dots to all of it. She also offers a bit of good news for us today, for a change, out of Cleveland, OH! So there's that!...

On today's BradCast: While much of the media have turned away from the continuing --- and, in some cases, worsening --- disaster following Hurricane Florence in the Carolinas in order to focus on the fight over the U.S. Supreme Court (which we cover as well today), flood waters continue to rise, along with the storm's immediate death toll, and new toxic threats and emergencies continue to develop.

On the one-year anniversary of Hurricane Maria's deadly landfall in Puerto Rico --- where some 3,000 U.S. citizens died from the storm and its aftermath --- we're joined by author and disaster historian SCOTT KNOWLES of Drexel University and the Disaster Research Center at the University of Delaware. Knowles says "Trump is wrong," regarding his denial last week of the startling death toll from Maria. He explains the well-established methodology behind its determination, while noting the response "is deeply political. There are winners and losers in the count." Thus, he notes, a similar denial of years of death and disease for first responders after 9/11 and the PTSD suffered by veterans years after wars have ended. "I think we have to talk very clearly and very honestly about the impact of disasters not being confined just to the moment in which they occur."

He offers some of the political and civic history behind focusing on such natural disasters (as Trump and others do) as singular, limited events, not unlike the type of nuclear attack which the federal government set about preparing for in the 1950s and 60s. That work, as Knowles described in a recent New York Times op-ed, gave rise to the birth of social science disaster research. In the 1990s, he explains, that resulted in a "re-think" about what the Federal Emergency Disaster Agency (FEMA) could accomplish under President Bill Clinton, in order to focus on "long term thinking of preparation and community-based preparation" for major disasters, only to see the Agency revert back to its focus on emergency recovery following the 9/11 attacks. "September 11 turned the clock back to 1951," he argues.

As to lessons learned from more recent disasters, such as Hurricanes Harvey and Maria last year and Florence this year, Knowles cites the U.S. construction industry as one of the most politically powerful at the state and local level, helping to ensure that well-understood threats, like those linked to the impacts of global warming, too often take a back seat to commercial development. "The fact is that the most powerful lobby in any statehouse across the country is the construction industry. They call it the 'FIRE sector' --- finance, insurance, and real estate. I call it the 'finance-construction complex.' There are very, very strong, deep-pocketed interests in building, and that's across the country," he tells me. "Those rules are handled almost entirely at the state and local level. So federal policy can change, but it will still have a lot of trouble telling Georgia, the state of North Carolina, the state of South Carolina, what they can and can't allow along the coastline, or in California, what they can and can't allow along a wildfire corridor."

Knowles also sees "an emerging consensus in emergency management" that we are likely to soon see proposed changes to certain disaster warnings and metrics, such as the Saffir-Simpson scale that categorizes hurricanes from 1 to 5. He argues the scale "is now in the way of effective risk communication," as it has become increasing unhelpful and arguably counter-productive for the public in appreciating the real and immediate threats posed by storms in a climate changed world.

"We have to get very serious about the issue of environmental protection and not just acting like disasters are just aberrant things that are only going to happen once in awhile," says Knowles. "The coal ash and the animal waste in North Carolina --- that's a huge environmental nightmare, but you can find a nightmare like that waiting in all fifty states."

Next, an update and a few thoughts on the battle over U.S. Supreme Court nominee Brett Kavanaugh and whether Dr. Christine Blasey Ford, who has accused him of sexual assault in the 1980s, will testify before the U.S. Senate Judiciary Committee next week. Ford's attorney now says she is willing to do so --- though not by the Monday deadline arbitrarily set by Senate Republicans --- presuming "terms that are fair and which ensure her safety." For his part, Judge Kavanaugh has reportedly spent three days this week attending practice sessions at the White House for his response to the Committee. But, if he is completely innocent of the charges as he claims, why is so much practice actually necessary? We discuss.

Finally today, Desi Doyen joins us for the Green News Report with the latest on the growing toxic toll of Hurricane Florence, the long road of recovery that lies ahead, and this week's announcement by Trump's Interior Department of still more rollbacks to methane regulations, despite the impact of the greenhouse gas on climate change and the natural disasters like Florence that it helps to super charge...

On today's BradCast: Except for our Florence coverage, it's all about November 6th, including the GOP's rush to seat another alleged sexual predator on the U.S. Supreme Court. [Audio link to show follows below.]

First up today, a quick update on the still-ongoing disaster of Hurricane Florence, with the human death toll rising to 37 and the poultry and pork death tolls in the millions, after three feet of rain fell on parts of the Carolinas, thousands remain in shelters, and the environmental disasters --- including toxic human waste and animal waste now streaming into swelling rivers and floodwaters --- may just be beginning.

Next, the reason why Republicans are in such a panic to minimize the allegations of attempted rape by Brett Kavanaugh, their nominee to the U.S. Supreme Court, in any way they possibly can in advance of the quickly arriving November 6th midterm elections. That minimization includes avoiding both time and an FBI investigation at any cost. The White House could have already requested one, which Sen. Orrin Hatch (R-UT) insisted was "the very right thing to do" --- at least during Senate Judiciary Committee hearings on the 1991 sexual harassment allegations by Anita Hill against then-nominee, now-Supreme Court Justice Clarence Thomas.

Then, you may recall at the beginning of the year I reported on a strange conversation I had on Twitter with Alabama's Sec. of State John Merrill regarding the state's voting systems, resulting in Merrill blocking me on the social media site. It wasn't the first time Merrill had blocked election experts or journalists or his own constituents. But, even after a federal court later in the year found that Donald Trump was violating the First Amendment rights of his constituents by blocking them on Twitter, Merrill still refused to unblock anybody. A query to his office about that, just before the state's May primary elections, resulted in a bizarre and unhinged exchange via phone and email with the Secretary. Today, Merrill is being sued by the ACLU of Alabama for violating his constituents' First Amendment rights for blocking them and, of course, that means that AL taxpayers will likely be on the hook to pay for the so-called "conservative" Merrill's knowingly unconstitutional behavior.

Also, speaking of transparency and the rule of law, the U.S. Supreme Court, just weeks before the 2018 midterms, has allowed a lower court ruling on "dark money" to take immediate effect, meaning that some political non-profits will now have to disclose the names of wealthy donors who spend more than $200 per year in hopes of buying elections. The Koch-sponsored hit squads, including their ringers on the FEC, are none too happy it.

Finally, we've got some good news for voters in California, where the Governor has now signed a bill requiring election officials to notify voters when local officials believe signatures on Vote-by-Mail ballots don't match the one on their registration file. Such voters will now be notified at least eight days before any results are certified, so they have a chance to fix the problem, which could happen for many reasons, before the ballot is simply discarded (as tens of thousands have routinely been tossed in previous elections).

Also, good news for Democrats in Wisconsin, where the "gold standard" of Wisconsin polling outfits finds divisive, two-term Republican Gov. Scott Walker now trailing Democrat Tony Evers in this year's Gubernatorial race.

And, in Kansas, yet another top former Republican official has endorsed Laura Kelly, the Democratic candidate for Governor, in her race against controversial GOP nominee Sec. of State Kris Kobach...
