Democracy is under attack again today. And not just in D.C. We're here to do our part in defending it wherever possible on today's BradCast. [Audio link to full show follows this summary.]

Among our many stories today...

  • The rightwing, inexperienced, recently elected but now very unpopular President of South Korea attempted a power grab today by declaring martial law and the shutdown of the National Assembly for largely trumped up reasons. (Pun intended.) It didn't work. His own political party joined the opposition Democratic Party majority in the nation's parliament for a swift, unanimous vote to shut down the attempted self-coup just hours after it began. The country's military wasn't much help to the President either. (Which may be just one reason Donald Trump has tapped loyalist stooge, accused rapist and years-long womanizing drunkard, Pete Hegseth of Fox "News", to be his own Sec. of Defense.) But there are a whole bunch of other lessons that we need to learn in THIS country from what happened today in South Korea which may be very helpful in the months and years ahead.
  • Meanwhile, power grabs by Republicans are underway at the state level in this country as well following the November 5th election. In the closely divided battleground state of North Carolina, where Donald Trump won at the Presidential level, Democrats were victorious up and down the ballot in a bunch of statewide offices including Governor, Lt. Governor, Attorney General, Sec. of State and Superintendent of Public Instruction. The GOP also lost its gerrymandered supermajority in the state House by one seat. So Republicans, in the weeks they have left with supermajorities in both chambers of the state legislature, are now attempting, under the guise of a "sham" Hurricane Helene disaster relief bill, to strip extraordinarily broad swaths of power from those offices and hand it to the GOP-controlled state legislature. Outgoing Democratic Governor Roy Cooper has already vetoed the bill, but Republicans in the Senate have voted to override it and protesters in the state are attempting to prevent House Republicans from doing the same. The measure, among other things, strips the incoming Democratic Governor's ability to appoint members of the State Board of Elections, to fill vacancies at both the state Appeals and Supreme Court levels with judges of his choosing, and, in a sop to the fossil fuel industry, prevents the state Attorney General from, as Cooper said in his veto, the "ability to advocate for lower electric bills for consumers." The 131-page bill, originally introduced in November and passed by both chambers within 24 hours, would also place new restrictions on elections in the state, which election officials charge would result in votes going uncounted.
  • If that North Carolina measure is adopted before the new state legislature is sworn in next month, it will almost certainly be challenged by Democrats at the state Supreme Court, where last month one of its two liberal Justices, Allison Riggs, very narrowly defeated her Republican challenger, Jefferson Griffin, by fewer than 1,000 votes out of more than 5.5 million cast. A machine recount confirmed the initially reported machine-tallied results. Now Griffin is seeking both a hand-count and the disqualification of more than 60,000 ballots.
  • There is somewhat brighter news this week in another battleground state, where a Wisconsin judge has finally struck down former far-right Republican Gov. Scott Walker's wildly controversial 2011 law that stripped the power of certain public unions to collectively bargain for wages and other benefits. The law, according to the judge, is unconstitutional since it takes those powers from "general" unions, such as the state teachers union, while allowing it for "public safety" officials, such as police and firefighters unions who were supporters of Walker's at the time. Back in 2011, you may recall the weeks-long fight over the measure, bringing hundreds of thousands of protesters to the state capital as Republicans in the legislature muscled the bill to passage. Of course, the judge's ruling will now be appealed up to the state Supreme Court which, as of last year, finally has a narrow, 4 to 3 liberal majority that will once again be tested during yet another WI Supreme Court election this April.
  • And, speaking of every vote mattering, a legal and political battle is underway right now in Minnesota over a state House race where Democratic Rep. Brad Tabke was declared the winner by just 14 votes over his Republican challenger Aaron Paul after a recount and official canvass. That said, an investigation by the local County Attorney found that 21 absentee ballots in the race may have been accidentally discarded prior to being tallied. Republicans have filed suit to declare the seat vacant and are seeking a special election. This one seat matters. As of now, with the Democratic Tabke as the winner, Democrats and Republicans will each hold 67 seats in the state House, where lawmakers are preparing a power sharing agreement. If the Republican Paul ultimately ends up winning the seat, the balance of power would be shifted with a two-vote, 68-66 GOP majority. Yup, every vote matters. Even the ones that were tossed due to "human error", according to the County Attorney.
  • Finally, Desi Doyen joins us for our latest Green News Report, our first since returning from the holiday. And she's got a lot to catch us up on, from the collapse of a U.N. plastics treaty summit in South Korea (prior to today's attempted coup!), to a lackluster (at best) agreement at the U.N.'s COP29 climate talks in Azerbaijan, to new worries about how extreme drought is set to exacerbate immigration issues at our southern border...

Biden, Trump (mostly) sweep; Haley drops out; McConnell endorses; Protests haunt Dem victories in MN, CA; Few (though some noteworthy) Election Day voting system failures...

On today's BradCast: We distill a whole bunch of stuff --- results, problems, politics, concerns --- from Super Tuesday's primaries and caucuses in some 15 states and one U.S. territory. [Audio link to full show follows this summary.]

Included in our coverage today...

  • Donald Trump won most, if not all, of the GOP nominating contests on Tuesday by largely anywhere from 60% to 80% over Nikki Haley who defeated Trump in Vermont. Nonetheless, she subsequently announced on Wednesday that she is suspending her campaign, without (yet) endorsing Trump, saying he must now earn her support and those of her backers.
  • Republican Senate Minority Leader Mitch McConnell --- after pretending to be outraged by the deadly January 6, 2021 insurrection which he described Trump as "morally responsible" for --- endorsed him for President on Wednesday. I've got a word or two about that today.
  • Joe Biden won the Democratic contests in all of the states which voted on Super Tuesday, most by well over 80%. (He only received 70% and 73% respectively in Minnesota and Oklahoma. More on that below.) Nonetheless, if you were watching CNN last night, you'd have heard how Trump "DOMINATED!" his primaries, while Biden just did "very well" on the Democratic side.
  • After the U.S. Supreme Court, last year, required Alabama to finally add a second U.S. House District where Black voters might elect a candidate of their choosing --- in a state where 27% of the population is Black but only 1 of 7 U.S. House seats are even held by a Democrat --- more than 6,500 voters in that newly redrawn district were misinformed by County officials about which Congressional District they were supposed to vote in on Tuesday. The Chair of Montgomery County's Board of Registrars blamed a computer "software glitch" for what several candidates worried may have led to mass disenfranchisement.
  • Meanwhile, in Utah, where Republicans decided to run their own statewide Caucuses this year, an untold number of voters end up going home without voting when the Party's computer systems crashed or were otherwise unusable at many Caucus sites. The Salt Lake Tribune describes the "chaos" that ensued.
  • In North Carolina, GOP voters elected their Holocaust-denying Lt. Gov. Mark Robinson as their nominee for Governor this year. Democrats, who selected state A.G. Josh Stein for the job on Tuesday are likely delighted about that. Also in NC, preacher and former Rep. Mark Harris appears to be heading back to the U.S. House after his 2018 campaign for the state's 8th Congressional District resulted in a do-over election after Harris hired a known election thief who illegally collected ballots and filled them in for Harris. That election was tossed by the state Election Board and a chastened Harris chose not to run again. But now he's back! And on Tuesday, he apparently won enough votes to avoid a run-off. So, he appears headed back to D.C. next year thanks to further GOP gerrymandering of his NC district since he last tried to steal the election there.
  • In Texas, Democrats elected Rep. Colin Allred to take on Senator Ted Cruz this fall. Though state Republicans drew the line, apparently, at nominating a convicted January 6th insurrectionist for the U.S. House in the state's 19th Congressional District, sticking with the current Republican incumbent instead.
  • Jason Palmer defeated Joe Biden on Tuesday to win the Democratic Caucus in American Samoa! Who is Jason Palmer? We discuss, while noting that the victory came in a 51 to 40 vote (Not percentage points! That's the actual vote tally!) on the U.S. territorial island some 2,500 miles southwest of Hawaii. Apparently it pays to actually show up and campaign! Palmer was the only Democratic candidate who actually did so. Other than that, yeah, Biden actually "DOMINATED!" on the Dem side last night.
  • There was, however, a noteable vote for "Uncommitted" in Minnesota's Democratic Primary on Tuesday, with some 19% of voters casting a protest vote against the President, presumably as a statement in opposition to the Biden Administration policy regarding Israel's war in Gaza. The state has a sizeable Arab-American population. MN Democrats' bump for "Uncommitted" this year, as compared to the last time a Dem President ran for reelection in 2012, was substantial --- much more than a similar protest vote in Michigan last week --- even as all of the other states with similar "None of the Above" options on the ballot to date (Alabama, Massachusetts, North Carolina and Tennessee) all saw a decrease in such votes this year as compared to 2012.
  • Still, the protests from a small faction of the Left are unmistakable. Democrats dismiss those voters at their peril. Especially in critical battleground states like MI and MN. The protest was impossible to not notice at Rep. Adam Schiff's victory celebration last night in California. He will face Republican former MLB star Steve Garvey for the state's open U.S. Senate seat this November, after outpacing fellow progressive Congressmembers Katie Porter and Barbara Lee last night. But protesters chanted "Cease-fire Now!" and "Free Palestine!" throughout Schiff's entire victory speech on Tuesday, which the L.A.-based Dem handled gracefully. The Biden Administration does seem to be taking notice. Over the weekend, Vice President Kamala Harris gave remarks on Sunday calling for an "immediate cease-fire", "given the immense scale of suffering in Gaza."

Explaining the bumpy and uncertain legal path toward protecting --- or ending --- a critical reproductive freedom in all 50 states

The nationwide right to terminate a pregnancy with medication is now at stake in three pending federal lawsuits. One, in Texas, has been filed by abortion opponents. Another has been filed in West Virginia by a manufacturer of one of the drugs used to terminate a pregnancy, after state lawmakers have attempted to ban its use in the state. The third is a complaint from a physician in North Carolina where her ability to prescribe the drug may now be in peril.

The outcome of these three cases may ultimately succeed in protecting nationwide access to abortion rights even in states where Republican lawmakers have attempted to ban all such freedoms.

That said, while unlikely, it's also possible that one of these three cases could result in the elimination of the right to medical abortion in all 50 states...

But justice may soon be at hand due to a governmental realignment...

In his April 1963 Letter from a Birmingham Jail, Dr. Martin Luther King, Jr., lamented: "Justice too long delayed is justice denied". No case underscores the civil rights icon's assertion better than the years long fight by North Carolina Republicans to keep unlawfully gerrymandered state and Congressional district maps in place, long after they've been repeatedly found by courts to be in violation of the law and the Constitution.

The tortured history of Covington v. North Carolina --- a "successful" challenge to the illegal racial gerrymandering of 28 of North Carolina's state House and Senate Districts --- exposes the injustice occasioned by Republican tactical delays. It is a strategy that, thanks to those racial gerrymanders, permitted Tar Heel State Republicans to retain overwhelming majorities in the legislature following last November's General Election –- 34-16 in the state Senate and 74-45 in the House --- even though, in the very same statewide election Democrats Roy Cooper and Joshua Stein were respectively elected governor and attorney general.

But a recent ruling by the U.S. Supreme Court should finally result in new maps, and Special Elections under them, in the Tar Heel State, where the maps have been in place for elections since 2012. Recent legal precedent and a political realignment are on the side of those seeking to force the state to finally carry out those new elections in 2017, rather than waiting for the 2018 mid-terms...
