It's been a rough 24 hours or so. But we are among the lucky ones, as detailed at the top of today's BradCast. [Audio link to full show follows this summary.]

The photo of a massive fire nearby first came in via cell phone from a neighbor before we had even been able to publish yesterday's show to the blog. The show was, of course, about the ongoing wind and firestorms here in Los Angeles., including an interview with a longtime colleague whose house burned down on Tuesday night in Pacific Palisades.

Now it seemed to be happening to us. The City began sending alerts to all of our phones, telling us to get ready for an evacuation. From my back patio, I could see the huge flames and orange plumes rising out of Runyon Canyon, a park just a few blocks from where we live. It would come to be known as the "Sunset Fire" for some reason, as reported by the national media. Which meant that most of you probably learned more about the fire and what was going on than we did being in the middle of it.

The photo used above for our graphic today was taken by another neighbor at the end of our block about 30 minutes before the "GET OUT NOW!" order came from the City. As you can tell, it was unsettling to say the least.

Long story short (we share the longer version on today's show, with a bunch of interesting Lessons Learned along the way), after the mandatory evacuation order came, we, and a whole bunch of others folks in the area, grabbed up whatever belongings we felt we needed and high-tailed it out of here. Or, at least tried to. The narrow streets here in the lower Hollywood Hills were packed, in what national media correctly described as a sudden, chaotic evacuation.

Anyway, with the winds having died down from hurricane force levels 24 hours earlier, firefighters were able to get airborne again and knock down "our" particular raging inferno in fairly short order. "Only" 60 acres said to have burned. The mandatory evacuation order was lifted by morning and all was well upon our return. Safe and sound. But, as noted, tune in for more of the harrowing details.

It was inconvenient, and not a lot of fun. But we were among the lucky ones. More than 2,000 10,000(!) structures have now reportedly been destroyed or damaged in at least 4 different raging fires around Los Angeles, in what is being described as the most costly fire disaster in U.S. history, if not the most deadly. Six people are now reported killed, though authorities say that number is expected to climb when, and if, they are finally able to get the largest fires under control. Winds are predicted to pick up again tonight and through next week, though not as high as they had been over the past 48 hours or so. Stay safe out there. But do tune in for a few tips we learned over the past 24 hours about sudden, unexpected evacuations.

Also today, President Jimmy Carter --- who, speaking of harrowing experiences, was once lowered into a melted down nuclear reactor core! --- was finally laid to rest today. We share details and a few audio excerpts from today's memorial service at the National Cathedral in D.C.

Finally, Desi Doyen has our latest Green News Report, with more details on the L.A. fires and their connection to climate change, as we miraculously were able to produce both that and a 'BradCast' today...which I didn't see as remotely possible at about 7 or 8pm last night. But we made it. We are among the lucky ones...

From the heart of climate-changed wind and inferno country, apparently, it's today's special edition of The BradCast. [Audio link to full show follows this summary.]

As you might suspect, as we broadcast most days from Hollywood, pretty much in the center of Los Angeles, the bulk of today's show is dedicated to fire coverage. Yesterday we reported on the high winds, gusting at times to hurricane levels, nearly 100mph, and the National Weather Service Red Flag warnings of potentially out of control fires they were likely to bring. They did. The blaze in Pacific Palisades, on the coast, actually sparked up just as we began yesterday's program and had grown to about 300 acres by the time we signed off.

This morning, as we awoke to eerily blackened skies, which eventually gave way to a sickly orange pall by late afternoon, that fire had grown to several thousand acres. By showtime, once the winds had died down a bit and firefighters were actually able to take to the air to battle the blaze, it had grown to more than 24 square miles. More than 1,000 structures have now reportedly burned, and tens of thousands are under evacuation orders in that fire and three other major ones that have broken out across L.A. County --- near Pasadena to the east of us and Sylmar to the North --- in the bargain. The fire in Palisades, is now, officially, the most destructive fire in L.A. history.

We do our best to cover the latest on all of that today, as fire fighters are said to be overwhelmed and resources, such as water to battle the out-of-control infernos, has been in short supply, particularly while airborne units had been grounded.

One of those who lost their home last night in Palisades, tragically, was our friend JOHN AMATO, the longtime blogger and creator of the notorious Crooks and Liars blog. [See his last photos from his house here.] He is kind enough to join us on the show today from Santa Monica to detail his harrowing evacuation last night, along with details of all that he has lost today.

"It's just total destruction," says Amato. And though he hasn't yet been able to get back to his community, a neighbor who was among the last to leave told him that "everything is just melted to the ground."

"We've never seen the speed of this fire. It just spread so fast," he tells me. "The devastation is just incredible. The wind was blowing these flaming embers everywhere. It's like a tidal wave of fire."

Also today, the latest on Donald Trump's pathetic attempt at SCOTUS to avoid even a shred of accountability for his 34 felony fraud convictions in New York, and, by way of stark contrast, a reminder of a few more of the extraordinary accomplishments of President Jimmy Carter before he is finally laid to rest on Thursday. (Did you know that, in addition to creating the Dept. of Energy, he also created the Education Dept., which Trump vows to shut down, and FEMA, which is very very important out here in Los Angeles today, including to our guest who just lost his home?)

I suspect it's gonna get much uglier before it's all said and done. And we're here for it! A "MAGA Civil War"? Count us in on The BradCast! [Audio link to full show follows below this summary.]

But, first up, some other news today...

  • Repeated "wildfire weather" warnings from the National Weather Service for Los Angeles, predicting "a life-threatening, destructive windstorm," with wind gusts as high as 100mph(!) from Tuesday afternoon through Wednesday morning, after months of dry weather appear to have been prescient. The day started here with a neighbors huge tree limb blowing over to crush our backyard canopy amid the gusty winds. By shows end today, tens of thousands being evacuated from a quickly growing wildfire in Pacifica Palisades, on the coast. It has gotten much worse since we got off air today, with hundreds reportedly abandoning their cars on the Pacific Coast highway to flee encroaching flames.
  • In what counts for Trump criminal accountability court news these days, his favorite federal Judge/tool, Aileen Cannon in Florida, who was seated at the very end of his first term after he lost the 2020 election, , is working hard for her promotion to SCOTUS. On Tuesday, she exercised dubious authority to block the release, at least for now, of Special Counsel Jack Smith's report on Donald Trump's two different, now-abandoned federal felony indictments for stealing thousands of pages of highly classified national security documents upon leaving office, and for his failed attempts to steal the 2020 election. We'll see how long her ruling stands.
  • Meanwhile, in New York, an appeals court on Tuesday rejected Donald Trump's attempt to stay his criminal sentencing, still scheduled for Friday, in the case in which he was found guilty of 34 felony fraud counts related to his hush money payments to a porn star to help him cheat to win the 2016 election. Barring any surprises, the sentencing is still on for this week, though the judge in the case has indicated he is unlikely to issue any jail time, given Trump's re-election. But, even with an "unconditional discharge", he will still become the nation's first convicted felon to be sworn in as President.
  • On Monday in New York, in federal court, former NYC Mayor turned disgraced Trump lawyer Rudy Giuliani was found in contempt of court for failing to lawfully respond to the $148 million defamation judgement against him won by Georgia election workers Ruby Freeman and Shaye Moss, who Rudy and Trump both falsely claimed had committed fraud during the 2020 election. If only Rudy could have figured out how to become President and make all of his crimes go away like Donny did.
  • Then, we're joined by RYAN COOPER, Managing Editor of The American Prospect, on the emerging (and hilarious) dust-up between the broligarchs who control Trump, like richest-man-in-the-world Elon Musk (and his sidekick Vivek Ramaswamy), and his hardcore MAGA cultists like Laura Loomer and Steve Bannon. Cooper's article on the matter is headlined "President Musk Declares War on American Workers".

    Just before the turn of the new year, sparks started flying when the duped MAGA cultists learned that Trump was going to continue the H-1B visa program that allows skilled tech workers to come to the U.S. and take less money to work longer hours than American citizens. After facing criticism for the Silicon Valley billionaires' favorite work visa scheme (the South African-born Musk came here himself on an H-1B), Musk took to the social media site he purchased and declared war on Loomer and any other MAGAs who dared oppose him, declaring: "The reason I'm in America along with so many critical people who built SpaceX, Tesla and hundreds of other companies that made America strong is because of H1B," before he added, "Take a big step back and FUCK YOURSELF in the face. I will go to war on this issue the likes of which you cannot possibly comprehend."

    The self-proclaimed "free-speech absolutist" then proceeded to downgrade and demonetize Loomer's account on Twitter/X, along with dozens of other MAGAs who dared call out Musk and the H-1B program.

    Today, Cooper explains tells me why the Silicon Valley broligarchs are so fond of the H-1B program, which, he says, they wield as a "weapon of class warfare" that "provides a pool of exploitable labor" that must do as you say or get sent back to their country. We also discuss Musk and the Right's actual position on "free speech" ("Tthey get to say whatever they want, and you get to shut up."); who appears to really be calling the shots now in Trumpland (Hint: its the guy who controls the "still depressingly influential social media platform that all the Republicans are on"); and how this nascent war between the two major factions of Trump's MAGA cult/coalition is likely to shake out in the days ahead.

    "We are in the realm of syphilitic emperor history books," Cooper tells me. "You've got Trump, who is 78 and clearly has lost MANY steps from when he was a young man. But Elon Musk is also incredibly erratic and impulsive. With these two megalomaniac narcissists with giant fevered egos, typically you'd see a massive falling out over something." And yet, so far, Trump is standing with the richest man on Earth and pretending he even knows what the H-1B program is. Meanwhile, says Cooper, about "Trump and his toadies, the minute they become inconvenient for him, he just throws them over the side. Which, for some reason, doesn't seem to affect the supply of people lining up to get thrown over the side the next day."

We're back on today's BradCast after our holiday break! And just in time for today's completely peaceful January 6th certification of the 2024 Electoral College results during a joint session of Congress. It sure is fun how peaceful things are when Republicans aren't pretending the election was stolen from them, eh? [Audio link to full show follows below this summary.]

But that doesn't mean 2025 hasn't started off with a bang, unfortunately, as discussed along with a whole bunch of stuff today as we begin to get caught up on some news we missed over our break and the news that continues to break now that we're back.

Before opening up the phones to listeners in the second half of today's show, here are links to just some of the stories cited in our coverage today...

  • Blogger and activist Jeff Tiedrich offers perhaps the best ever journalistic description of the "cognitively-impaired rage-baby" who, over the weekend, "melt[ed] down into saddest sad ever" over flags to be flown at half-staff in memory of President Jimmy Carter during the rage-baby's second inauguration two weeks from today.
  • Our factoids of the day on Jimmy Carter's environmental legacy, as the long goodbye to the 37th President of the United States continues before he is finally laid to rest in Plains, Georgia later this week at age 100.
  • In her capacity as President of the U.S. Senate, Vice President Kamala Harris, who lost the 2024 Presidential election to Donald Trump, oversaw the certification of the Electoral College results today during a peaceful joint session of Congress. It was carried out without challenge, incident, death, insurrection or terror attack on the U.S. Capitol, as previously incited by the former President (now official President-elect) four years ago today.
  • Criminal felon and rage-baby Donald Trump continues to rage this week following the ruling [PDF] last Friday by the judge in his New York hush money trial, where he was found guilty of 34 counts of felony fraud related to paying off a porn star to help him cheat to win the 2016 election. Justice Juan Merchan ordered that Trump would be sentenced this coming Friday, ten days before his second inauguration. But the judge also signaled Trump was unlikely to face any jail time and will instead receive an unusual, "unconditional discharge" for his many crimes. Nonetheless, Trump continues to rage and appeal and, so far, lose all of those appeals. Despite that likely lack of any actual punishment at all, the news now means Trump will almost certainly be sworn in to office as the first convicted felon to enjoy that great honor.
  • Also today, a few words about the terror attacks by two U.S. citizens last week on New Year's Day, one in New Orleans on Bourbon Street, one in Las Vegas outside of a Trump hotel in a Tesla Cybertruck, The latter was carried out by a hardcore Donald Trump (and Elon Musk and Bobby Kennedy Jr.) supporter, even though that aspect of the attack has been virtually ignored by the corporate media.

Then we open the phones to listeners for the first time in the new year, To discuss the news of the day along with hopes and fears for what lies ahead this year. In addition to one of our favorite Trump trolls, we also hear from a caller who says that he went to school with Elon Musk in South Africa. What he tells us happened at that school, if true, may explain a whole lot about Elon Musk...

From darkness to light on today's BradCast. [Audio link to full show follows this summary.]

FIRST UP... As an increasingly panicked Team Trump continues to find new depths in which to sink and new, more dangerous lows to drill down into --- Elon Musk, one of the richest men in the world turned virulent Trump supporter, has gamed his increasingly rightwing social media site (which we still call Twitter) to force his obnoxious, dangerous, wildly false political commentary even beyond the nearly 200 million followers he has. All while turning off the very limited, crowdsourced fact-check system, for himself, even as it is supposed to apply to everyone else on the increasingly trash-filled site.

Among the results, a tweet of his this week that suggested someone should try and assassinated Joe Biden and Kamala Harris. It became a rare incident where even he decided he had gone too far and deleted the tweet after tens, if not hundreds of millions, had already seen it. (And, upon deleting it, going to on to blame everyone else for not appreciating his brilliant sense of humor).

That came after dozens and dozens of tweets this year, which have reached billions of people, falsely claiming that Democrats are bringing non-citizens into the country to vote in this year's election. The Washington Post, last week, did a deep dive into how Musk's false tweets have translated into very specific threats against elections officials around the country. "He's by no means unique," Maricopa County, Arizona's Republican Election Recorder told WaPo. "He just happens to have a very, very large microphone."

He's not the only one.

Donald Trump and J.D. Vance have spent the last week endangering the residents of Springfield, Ohio by spreading false claims about legal Haitian immigrants there (who they falsely describe as "illegal") destroying the town and eating the pets of other residents. The results of those lies: dozens of bomb threats that shutdown City Hall, schools, hospitals and has turned the Republican-run city into somewhat of a police state, as OH's Republican Governor was forced to deploy state law enforcement officials to protect town residents.

Kamala Harris, who doesn't utter falsehoods that threaten the lives of Americans, was asked about all of this madness during an forum with the National Association of Black Journalists this week. We thought her answer to that question was worth sharing in full today. It ends with this assertion: "This is exhausting and it's harmful. And it's hateful. And grounded in some age old stuff that we should not have the tolerance for. So, let's turn the page and chart a new way forward and say 'You can't have that microphone again.'"

THEN... Despite all of the above, there remains a huge number of Americans who regard themselves as very religious and yet appear dead set on voting again for the most un-religious person who has ever run for the White House.

Recent polling, however, shows that at least some of Trump's support from the religious community may be falling, even as other polling makes clear that the thrice-married, philandering and felonious former President still dominates the white Christian evangelical vote. At least the male voters who describe themselves as such.

But, according to our guest today, a white evangelical pastor himself, it doesn't have to be that way. And he is devoted to changing it. We're joined today by DOUG PAGITT, Executive Director and co-founder of Vote Common Good, a non-profit focused on "energizing and mobilizing people of faith to make the common good their voting criteria."

In a recent opinion piece for MSNBC, Pagitt detailed how his group's bus tour through battleground states this year is helping Christians to understand they don't have to vote Republican, while helping to teach Democratic candidates how to reach those voters, particularly in swing-states and counties.

So how did we get to such a place in this country, where a guy like Trump --- who has never been seen attending a regular religious service, either before, during, or after his Presidency --- would be the preferred candidate for a huge part of the religious community? Pagitt has a bunch of thoughts on all of this today.

"What's really going on is that the Democratic Party has had a pattern and reputation for not wanting religious voters," he tells me. "Kamala Harris is changing that. Joe Biden was changing that. Barack Obama worked to change that. But what Donald Trump exploited was this idea --- you hear him say, 'Democrats hate you religious people' --- somehow making out evangelicals to be both the rightful heirs of this nation as Christian Nationalists, but then also the persecuted minority. And somehow they get to hold both of these views."

Pagitt asserts that many Christians have, just by dint of birth, become Republican voters over the years. Because, as he says, "We don't know how to talk about faith in politics in the United States. We've been struggling with it since the founding of the country. We've never been good at it."

"But it doesn't have to be that way," he says. "Forty-four years ago, Jimmy Carter was an evangelical pastor from Georgia. He got 60% of the evangelical vote. In a lot of ways, the Democratic structure said to Republicans, 'You can have the religious white voters, we'll take the other voters.' That would be fine with me if we didn't keep electing someone like Donald Trump."

"The only reason we are out here, trying to get faith voters to consider voting for a Democrat for the first time in their life, is because this country cannot stand having Donald Trump have the power of the Presidency in his hand ever again."

Pagitt and his group have arguably made inroads. They are able to show deeply religious communities where they spent time in 2020 that swung radically in favor of Democrats after voting for Trump in 2016. He tells me that he believes their work can be critical in helping to do that again elsewhere, including in some of the most religious communities, where winning over a small subset of the electorate may be key to winning in marginal races for Congress and even the Presidency.

"There's an awful lot of people who have been told their whole life that Democrats are the enemy, and they're realizing they're not. But behavioral change is extremely slow," he explains today. "We know that three things always have to be in place when someone makes a behavioral change, whether that's doing a new diet or changing your voting habits."

"You have to take in some kind of new information that makes you think, 'Maybe I should do something different.' You need someone to invite you to actually behave differently based on that information. And then you need a community to participate in where people like you do that new thing. So many of these people, they don't have that. So we try to create that for them and let them know it's okay. It seems so rudimentary, but I've watched people with tears in their eyes when we say to them, 'If you choose to vote for a Democrat, first of all, it doesn't make you one. But even if it did, you're going to be okay. Your faith is still going to be alive.'"

We had a lot to talk about with Pagitt on today's show around all of this that I suspect you'll find enlightening. I know I did!...

Most of us, including President Joe Biden, who called upon Americans to "reject" political violence, may have been too quick to assume that the attempted assassination of Donald Trump on July 13 was politically motivated.

The FBI, by contrast, concedes that it hasn't identified a motive. That inability continued after an FBI search of the shooter's two cellphones failed to find "any indication of a motive, ideology or political views", CBS reported on July 17.

History reveals that not all high-level assassination attempts are politically motivated...

Accountability still matters. Even for apparent Presidential misdeeds from more than 40 years ago, as discussed on today's BradCast. [Audio link to full show follows this summary.]

Last week, New York Times' Peter Baker had quite a scoop. Ben Barnes, an 85-year old, longtime Democratic operative from Texas, detailed his claim that he and former Democratic Texas Governor turned Republican Presidential candidate John Connally took a trip through Middle Eastern capitals in the summer of 1980 to help convince Iran to not release the 52 Americans being held hostage until after that year's election.

His claim was that Connally, eyeing a cabinet role in the Reagan Administration, was hoping to send the message to Iran that they would get a better deal with Reagan than with Carter. Barnes said the pair were debriefed upon returning stateside by Reagan campaign manager and, later, CIA Director, William Casey. The campaign was reportedly terrified that Carter would win the release of the hostages that year in what would become known as the "October Surprise".

Instead, the hostages were ultimately released within an hour after Reagan being sworn in in January of 1981.

Our guest today, RUSS BAKER, (no relation to the Times' Peter Baker), is a longtime investigative journalist, author and now Editor-in-Chief of WhoWhatWhy.org. He has personally known Barnes for years and tells us that he isn't buying his story in the Times, said to have been revealed now by Barnes because the 98-year old Carter, who recently began hospice care, deserves to know the truth about what really happened.

Baker has been investigating the claim for decades that Casey himself engineered the "traitorous" deal on behalf of the Reagan camp and finds that explanation far more plausible than the Barnes/Connally scheme. Baker wrote his own response to Peter Baker's exclusive in a detailed newsletter article over the weekend headlined "The Iran Hostages, Carter, Reagan, and Bush: What the NY Times ‘Scoop’ Missed."

But whether it happened as Barnes claims or in some other way, Russ Baker, author of the 2009 best seller, FAMILY OF SECRETS: The Bush Dynasty, America’s Invisible Government, and the Hidden History of the Last Fifty Years explains why all of this still matters 43 years later; how the corporate media has largely ignored what would have been an extraordinary scandal by the Reagan campaign, George Bush Sr.'s role in all of this, and how different the world would likely be today if not for Reagan's defeat --- by hook or by crook --- of Carter.

"If Reagan had not been elected, I think it's safe to say that George HW Bush would not have been elected President himself," Baker tells me. "Then we wouldn't have had the Gulf War. His son wouldn't have become President and we wouldn't have had the Iraq War. You might not even have had 9/11, frankly, because a lot of the anger that generated these activities that led to 9/11 [which] had to do with policies that were carried out by these presidencies. Maybe even more importantly, there are huge differences between Democratic and Republican Administrations around climate change. Think of what would have happened if Al Gore had been President. You can be pretty sure we would have had a very different policy years ago about climate change. So our very ability to continue to live on Earth may have been affected by all of these things."

"I don't think they would have changed the media ownership laws. I think there would have been a lot more regulation. I don't think you would have even had a Rupert Murdoch and a Fox News. I don't think you would have had the current composition of the Supreme Court and all of their rulings for business and the wealthy. I think campaign contributions would have been restricted, and that would have changed Congress itself," He continues. "So whatever you want to pick, I think it basically was a coup, by making sure Carter didn't get re-elected. And all of these regimes since then were extensions of that coup government. With some partial breaks, I would say --- people like Clinton and Obama, very very limited in their ability to do much. I think their hands were largely tied. So a very profound change to everything as a result of this October Surprise situation."

As to the corporate media's failure in all of this, it's not that they won't hold Presidents and candidates accountable, says Baker, as he lists a bunch of Democratic candidates and Presidents whose "scandals" have been covered in great detail by the media, "but they seem to go hard only on certain people, and not always for the right reasons."

There is much more to tune in for in today's conversation that it'd be impossible to summarize here.

Finally, we close with some news of the day, including the huge, deadly tornado that ravaged parts of rural Mississippi over the weekend, and the connection to climate change, as Desi Doyen joins to explain.

Also, we have the latest on today's mass shooting at a private Christian elementary school in Nashville, Tennessee, where three 9-year old and three adults were murdered by an assault weapon-wielding 28-year old woman. It was the 129th mass shooting of the year in the U.S., according to CNN and the Gun Violence Archive.

As the breaking news of the shooting was being broadcast live today on Fox "News", a woman whose family was victim to another recent school shooting in a different state happened to be visiting Nashville. She briefly took over the cameras to explain how tired she was of all of this. Fox, after breaking away and then returning to the woman several times, finally cut her off, with anchor John Roberts concurring that he and his colleagues are, in fact, also becoming tired of the carnage. But are they really? You certainly wouldn't know it from all the activism that Fox "News" does in favor of elected officials who continue to block any and all rational gun safety legislation.

We have a few words for Roberts and Fox in response at the end of today's program...

Also: Computer tabulators declared losing candidates to be winners in at least two states in the November, 2022 mid-terms...

Yes, it's possible that two seemingly conflicting things can be true at once. On today's BradCast we report on two different cases where that is true, regarding Russia's war on Ukraine and Dominion Voting Systems' defamation case against Fox "News". [Audio link to full show is posted below this summary.]

First up today, on Presidents' Day, Joe Biden made a surprise visit to Ukraine to meet with its President Volodymyr Zelenskyy just days before the first anniversary of Russia's horrific invasion of its sovereign neighbor. It was also just days after Vice President Kamala Harris declared at the Munich Security Conference over the weekend that the U.S. believes Russia has committed "crimes against humanity" in their unlawful invasion.

In his remarks, President Biden described "a brutal and unjust war," as air raid sirens were heard during his visit to the Ukrainian capital. "One year later, Kyiv stands," said Biden after meeting with Zelenskyy at Mariinsky Palace. "And Ukraine stands. Democracy stands. The Americans stand with you, and the world stands with you." As we discuss, yes, it's possible to understand various diplomatic missteps taken by the U.S. and NATO in Eastern Europe following the fall of the Soviet Union, while still being able to hold the correct party accountable --- in this case, Russia --- for unjustifiable and continuing atrocities.

As yet another war in defense of democracy rages in Europe against a tyrannical autocracy, a decades-long champion of democracy in the U.S. and across the world is now in his final hours. On Saturday, the Carter Center in Atlanta announced that "After a series of short hospital stays," 98-year old former President Jimmy Carter has "decided to spend his remaining time at home with his family and receive hospice care instead of additional medical intervention."

We share some thoughts today on the legacy of our 39th President, including some of his comments last year on the first anniversary of the Donald Trump-incited Republican attempt to overthrow the U.S. Government on January 6, 2021. "One year on, promoters of the lie that the election was stolen have taken over one political party and stoked distrust in our electoral systems," Carter wrote at New York Times. "These forces exert power and influence through relentless disinformation, which continues to turn Americans against Americans."

The "relentless disinformation" of Fox "News" has been on full display for the past several days, following last week's redacted unsealing of Dominion Voting Systems' 192-page motion [PDF] seeking summary judgment in its $1.6 billion defamation suit against the right-wing fake news outlet. As the striking filing reveals in detail, Fox hosts and executives alike knew they were broadcasting fake, evidence-free claims of election fraud by Trump and his supporters following the 2020 election. They didn't much care. Instead, they feared losing viewers and chose to put company profits above both truth and the health of American democracy.

Dominion may prevail in this case. We hope they do. Even as we have been no friend to the company or any of the other oft-failed, private computer voting and tabulation firms over the past 20 years. In fact, some of the news misreported by Fox and Trump's supporters like Sidney Powell and Rudy Giuliani was taken directly from some of our accurate, exclusive reporting from years ago. But, again, two seemingly conflicting things can be true at once. Fox lied about election fraud and should be held accountable for that, and Dominion and other voting system vendors have repeatedly failed in American elections.

By way of fresh evidence to support that charge, we close with details on voting system failures in both New Jersey and California in November of 2022. In both cases, the systems ended up naming candidates who actually lost to be the winners and vice versa. In Monmouth County, NJ, the ES&S voting tabulators allowed duplicate votes to be uploaded to it twice. It wasn't discovered until last month. In Alameda County, CA, the tabulators were programmed incorrectly to do the impossible math of Ranked Choice Voting (RCV) elections in the Bay area. It was discovered in late December last year by a pro-RCV organization who happened to run the math on their own computers and discovered the error.

In both cases, the errors were discovered after losing candidates were certified as winners. How many places did that happen but wasn't ever discovered, because human beings rarely bother to count ballots to make sure the computers did so accurately. This is what comes of outsourcing public elections to private companies and running elections on computer systems that are virtually impossible to oversee by the American public.

On today's BradCast: The story of why Americans are still paying the health care price (in both blood and treasure) in 2022 for "free market champion" Ronald Reagan's 1987 Executive Order that gave away the tax-payer store to Big Pharma. Plus, a bunch of other somewhat happier stories. [Audio link to full story is posted below this summary.]

First up today, an update in the still-broadening criminal conspiracy probe by Fulton County District Attorney Fani Willis into Donald Trump's many faceted and failed efforts to steal the 2020 Presidential election in Georgia. With 17 known "targets" in the probe so far, including Rudy Giuliani and 16 fake Trump electors, the prosecutor tells Washington Post in an exclusive interview that there will be more "targets" announced soon and that she believes some are likely "facing prison sentences." She has yet to decide if the former President will be among them, though, with dozens of witnesses who have already been subpoenaed and testified to her Special Grand Jury in Atlanta, Willis says the Grand Jury should wrap up by year's end. A decision whether to call Trump in to testify --- or declare him a target --- is likely "to be made late this fall," she says.

Next, now that far-right retired Brigadier General and dyed-in-the-wool conspiracy theorist Don Bolduc won the GOP nomination in New Hampshire this week to challenge incumbent Democratic U.S. Senator Maggie Hassan this November, he's...um...re-evaluating some of his previous positions. During a primary debate with fellow GOP candidates before the primary, he proudly denied Joe Biden's victory in the 2020 election. "I signed a letter with 120 other Generals and Admirals saying that Trump won the election and, dammit, I stand by my words!," Bolduc bravely declared to cheers from Party faithful. When asked about his position this week on Fox "News," however, after winning the GOP nomination, Bolduc hemmed and hawed his newly discovered belief after "a lot of research on this", finding the 2020 "election was not stolen" and that "President Biden is the legitimate President of this country." Granite Staters will undoubtedly fall for his pretend new "moderate" line, right?

Then, newly reformulated COVID vaccine booster shots from both Pfizer and Moderna, designed to combat both the classic coronavirus and several newer Omicron variants, are now available to the general public in the U.S. The White House and CDC are recommending Americans get the new shot by Halloween to lessen the chance of infection --- or killing your grandmother --- over Thanksgiving and Christmas holidays when a new surge is expected. (They also recommend getting a flu shot at the same time.)

But why are new COVID vaccines even necessary more than two years into the pandemic? One reason is thanks to the fact that, despite tens of billions of tax-payer dollars given by the federal government to private companies for the development of the life-saving vaccines, the private pharmaceutical giants who make them refuse to give up their patent and intellectual property rights to make the vaccines available to the world. That means new variants continue to emerge, leading to more infections and the need for updated vaccines and, yes, more profit for Big Pharma. It's a pretty nice deal...for them.

So, how did we get here? We're joined today by ERNEST A. CANNING, longtime legal analyst at The BRAD BLOG, who recently took a deep dive into a 1987 Executive Order by Ronald Reagan that gifted patents and profits that go with them to huge, for-profit pharmaceutical companies that used tax-payer dollars to develop their inventions. That, from the Republican idol who, ironically, once declared: "We who live in free market societies believe that growth, prosperity and ultimately human fulfillment, are created from the bottom up, not the government down."

The pharmaceutical industry may disagree, even if they won't say so out-loud. "No matter how big a company and how much money was poured in by federal government for research and development, the patent would belong to the giant company," Canning explains. "We've been paying, just in general research, about $28 billion in pharmaceutical R&D every year." Given the "value of those patents," he notes, "we're talking trillions of dollars in a gift, not just tens of billions."

He also explains how all of this came about (beginning with Jimmy Carter) and why its now so difficult for Joe Biden to merely repeal Reagan's Executive Order in regard to the COVID vaccines.

But Canning also offers some brighter news related to patent abuse by Big Pharma, which he also recently wrote about at The BRAD BLOG. In a landmark initiative, the state of California is now fighting back. Democratic Governor Gavin Newsom recently announced the state will begin manufacturing insulin and will make the hundred-year old drug available for just slightly more than it costs to produce. Canning explains why that has become necessary as Big Pharma takes advantage of loopholes in Intellectual Property laws to bilk diabetics with outrageous prices for the inexpensive, life-saving medicine.

Finally, a private company that is --- shockingly enough --- apparently doing the right thing for the country and the world. (What?!) The family that owns outdoor gear brand Patagonia, headed up by its 83-year old founder, announced this week that they will be "making Earth our only shareholder". While the company will remain a for-profit entity, currently valued at around $3 billion, it will now begin giving away all profits --- about $100 million a year --- to two newly created entities, a trust and a non-profit, both devoted to combating our climate crisis.

(Any chance we can coax Patagonia into the pharmaceutical business while we're at it?!)

Dismantling pharmaceutical monopolies begins with repealing his 1987 Executive Order giveaway...

We should be both relieved and outraged!

Relieved that, earlier this month, the Center for Disease Control (CDC) and Food & Drug Administration (FDA) approved a new round of booster shots specifically re-designed to address new variants of the deadly COVID virus.

Outraged because, despite the expenditure of tens of billions of U.S. taxpayer dollars on research and development (R&D), the pharmaceutical industry's refusal to waive its "gifted" patent rights prevented a global rollout of the COVID vaccines. In turn, that refusal resulted in the need for the new booster shots.

Outraged because the industry's refusal to waive their patent rights has produced "excess mortality" with COVID that, as of the beginning of this month, has killed at least 6.5 million people worldwide, with no end in sight.

Outraged because this will, in all likelihood, not be the last newly reconstituted booster shot needed. It is the considered opinion of two thirds of the world's epidemiologists that the failure to provide global vaccinations will give rise to mutations that "could render current COVID vaccines ineffective."

And, yes, the patent rights were, indeed, a gift --- from the United States to the Pharmaceutical Industry...

In Georgia, the three white men who were caught on video tape murdering 25-year old black jogger Ahmaud Arbery in 2020 after hunting him down in their pick-up trucks, were each sentenced today to life in prison. Two of them, father and son, got life without the possibility of parole. The third, their neighbor, could be paroled after serving 30 years. But he's already 52, so...

In Arizona, or Florida, or wherever "they" preside, the buffoonish, rightwing conspiracy theorists, con-men and theoretical cybersecurity experts calling themselves Cyber Ninjas, declared they exist no more. That, just one day after an AZ state judge said they are to be fined $50,000 for each day that they continued to refuse to hand over public documents regarding the pretend "forensic audit" of Maricopa County (Phoenix), AZ's 2020 Presidential election they were hired by the GOP state Senate to carry out. More on that matter, hopefully, on a not-too-distant BradCast.

Next, as our week commemorating the grim, one-year anniversary of Donald Trump's attempt to steal the 2020 election by hurling thousands of supporters at the U.S. Capitol last year on January 6th, in hopes of halting the certification of the Electoral College vote with a deadly insurrection, comes to a close, a bit of mopping up and looking ahead to ways to prevent a more successful election coup from happening in the near future.

First, some reflections today from our 39th President, the 97-year old democracy champion Jimmy Carter. He wrote this week in the New York Times that he now "fears" for our democracy, citing last year's insurrection and the politicians in his home state of Georgia and elsewhere, such as Texas and Florida, who have "leveraged the distrust they have created to enact laws that empower partisan legislatures to intervene in election processes." Carter sees Americans "being persuaded to think and act likewise, threatening to collapse the foundations of our security and democracy with breathtaking speed." He says the he now fears that what he, his Carter Center and America itself "have fought so hard to achieve globally — the right to free, fair elections, unhindered by strongman politicians who seek nothing more than to grow their own power — has become dangerously fragile at home."

Carter is hardly the only one with a long and broad perspective on history who has become unnerved by what we are now seeing in America. Ronald Reagan's U.S. Solicitor General, Charles Fried, interviewed last month by CNN's Christiane Amanpour, noted his birth in Prague in 1935, when "Czechoslovakia was a real democracy" before "the demons of hell came out and spoiled that for 50 years." The 86-year old longtime Republican and Harvard Law professor now says he sees "those people re-emerging" and he "hears the same tune and it scares me."

So, for those of us paying attention, what can be done? We talk about exactly that today with our guest, DR. NILS GILMAN of the Berggruen Institute, following on his recent L.A. Times op-ed discussing similar nightmares as those cited by Carter and Fried which have continue to emerge throughout 2021 and what we can ALL now do to try and counter them.

Gilman was also the co-founder the Transition Integrity Project (TIP), a bipartisan group of security, military, political and media experts who met during the summer of 2020 to game out what might happen [PDF] in various worst-case scenarios if Trump decided to declare the election results invalid and/or refused to leave office that fall. We begin today with how his TIP group viewed the January 6 Electoral College certification event in advance, which he says they saw as a "moment of Constitutional stress that bad actors could potentially exploit," warning at the time that "there needed to be preparations on the part of law enforcement to be ready for that possibility." Perhaps we'll pay more attention to his group's warnings the next time, if they decide they need to reconvene before 2024 election.

He is now warning, in his piece at L.A. Times, that "the runaway train of illiberalism continues to bear down on American democracy, and the need to act could not be more urgent." Gilman explains today what he means by the term "illiberal democracy," a phrase he cites as being coined by Hungarian strongman President Viktor Orban, who was recently endorsed by Donald Trump. Under Orban, Hungary, in recent years, has seen its media essentially taken over by his rightwing government.

Citing strongman leaders "all over the world, in Brazil, Turkey, the Philippines, Poland, "you're seeing the rise of this illiberal democracy, where you still have elections, but the electoral process is so corrupted that it basically ensures that you will get right or far-right victories under any and all circumstances." Sound familiar? That, as nations like Hungary are literally being hailed of late by folks on the American right like Tucker Carlson and Fox "News". "It's being celebrated in rightwing media as a model that America might want to follow," Gilman charges.

He goes on to detail, both in his op-ed and on today's program, what "ordinary citizens" who oppose such fascist takeovers of our democracy can and must do at the state and local level --- as we wait and hope for voting rights and election protection legislation at the federal level --- to otherwise counter such forces. Election officials are now facing threats from Trump's MAGA Mob across the country, even as his supporters are working to take over key election administration positions by both hook and crook.

"People can go out and become pollworkers," urges Gilman. "We have an under-supply. Run as a local election administrator. There are thousands of positions all over the country. Our election system is currently totally decentralized and local administrators have a lot of power, and we need people committed to the democratic process to be in those position, not people who are committed to partisan victory at any and all costs."

As he explains, "there are things that an ordinary citizen can do. But the truth is that the real problem is we need to have elites who are going to be committed to democratic practice. What we have in this country now --- and we're seeing this very much in the current Congress --- you see a split between some elites who are basically complicit with the crimes of the previous administration and then others who are complacent about the likelihood that this could come back. We need elites to take this problem more seriously and really take on the challenge of illiberalism and the anti-democratic tendencies that are becoming more and more legion in this country, particularly on the right."

We also discuss my personal concerns --- my personal nightmares --- about the ability of committed, bad faith Republicans at this point to game the Electoral College in 2024 in a way they were not prepared to do in 2020. If they do so --- at the state legislative and/or Congressional level --- I believe there is nothing currently in federal law or the U.S. Constitution to prevent such a bad-faith exercise from succeeding next time. On today's BradCast, a heads up for just one of the newest, horrible, deadly things the Trump Administration is hoping to pull off on behalf of toxic corporate polluters, even as we're all distracted by impeachment of the President. [Audio link to show is posted below.]

In addition to a top of show teaser for our 1000th Green News Report at the end of the show, we kick off with a quick news roundup. Among the stories covered...

  • 95-year old former President Jimmy Carter is said to be recuperating after surgery to drain pressure on his brain following a number of recent falls;
  • The Republicans' stolen U.S. Supreme Court, surprisingly, allowed a lawsuit to proceed against gun manufacturer Remington, as brought by families of victims killed with one of the company's AR-15-style weapons in 2012 at the Sandy Hook Elementary School in Newton, Connecticut. The case alleges Remington's marketing was unlawful under CT law, and the plaintiffs have successfully argued that a 2015 federal law which bans most lawsuits against gun makers should not apply in this instance. SCOTUS appears to have agreed. If the complaint is ultimately successful in finding Remington violated the law, it may open up new avenues for additional suits against gun manufacturers and dealers by victims of gun violence;
  • Less surprising news from the GOP's stolen SCOTUS today comes from those in attendance at the Court for oral argument on Tuesday in a case which could strike down President Obama's Deferred Action for Childhood Arrivals (DACA) program. Court watchers suggest that questions from five Justices auger that the Republican appointees are prepared to allow the Trump Administration to end the program meant to offer protection from deportation for more than 700,000 [PDF] children of immigrants (so-called "Dreamers") brought here by their parents at a very young age;
  • On the eve of public hearings for only the 4th Impeachment inquiry in U.S. history, Intelligence Committee chair Adam Schiff (D-CA) released details on procedures for the hearings beginning on Wednesday, while an 18-page Republican talking points memo, detailing how they plan to oppose charges against the President, was obtained and published by CNN.

But, while the nation's attention is understandably focused on impeachment, the Trump Administration is continuing its non-stop corruption of federal Government power in favor of corporate industry interests. A draft proposal for a new rule from the Environmental Protection Agency Administrator (and coal lobbyist) Andrew Wheeler, as obtained by the New York Times, reveals the EPA's latest attempt to undermine scientific research in favor of toxic industry pollution of air and water and more.

The new rule, if approved, picks up where one introduced by disgraced former EPA chief Scott Pruitt left off. The original iteration of the rule was met with a tidal wave of opposition in some 600,000 public comments, almost all opposing the scheme. Nonetheless, Wheeler not only ignored those comments, but has now broadened the new proposed rule so that it might actually be applied not only to new regulations from the EPA, but also to existing regulations as well.

In effect, as our guest today, DR. ANDREW ROSENBERG, Director of the Center for Science and Democracy at the Union of Concerned Scientists, warns, the new rule, if adopted, would "devastate public health and environmental protections".

The long sought-after rule would deny the use of scientific studies for the basis of EPA regulations, if the raw, underlying data of such studies are not fully released. That means, for example, that private medical information of those who participated in various health studies under confidentiality agreements would have to have their names and medical records exposed, or the studies cannot be used as a basis for federal rule-making. Industry groups, of course, favor the new rule, which they and Trump's EPA are selling as "scientific transparency". Scientists and health care providers, however, are strongly opposed, charging, as Rosenberg does, that the scheme will undermine public health protections and "would put the entire enterprise of developing science-based public health safeguards at risk."

The policy, he explains, upends decades of well-established scientific norms, as well as federal rule-making procedures, and is precisely what the chemical and fossil fuel industries, in particular, have been pushing for for years.

"This isn't about transparency. This is about restricting the ability of the government to do the job that we want them to do --- that is, to protect public health and safety," Rosenberg tells me. "There's absolutely no scientific basis for doing this. One of the ways that you can tell that --- it's not just my word for it --- they put no justification in the rule. They didn't even identify what problem they're trying to solve. There's no analysis of what the impacts of putting this rule in place would do. There's not even an analysis of how much it would cost the agency. But, more importantly, [there's] absolutely not a single word on how it would impact the agency's ability to put public health protections in place. So there is no merit to this proposal at all."

Nonetheless, Rosenberg cautions, even if the public makes noise about this, given Wheeler simply ignoring the response to the Pruitt version of the same rule, it will likely be implemented. But, he notes, it will almost certainly be challenged in court, at which time public comments against the new rule will become very important. As Desi Doyen notes at the end of today's interview, some 200,000 Americans die each year prematurely due to pollution which will only be made worse under this new rule.

Court blocks Trump 'national emergency'; Congress sues for Trump taxes; FL Repubs gut landmark voting reform; Carter says Trump 'illegitimate'; 2020 dirty tricks now underway; Dems talk climate at first debate...

It's been a rough week in the federal courts for Donald Trump. Even the Republicans' stolen U.S. Supreme Court failed to grant at least one victory to the Administration in its loss last week over the fight to add a question on citizenship to the 2020 U.S. Census. That loss, where Trump clearly expected a win from his cooked High Court, has resulted in the admission of another humiliating defeat for Republicans, but a huge victory for those of us who still support the idea of democracy...as fragile as it remains in the U.S. on the eve of our Independence Day holiday in 2019. There were other encouraging signs of hope from our courts this week as well, though there remains plenty to be concerned about as we head toward the crucial 2020 elections. [Audio link to show follows below.]

Among the stories covered, in addition to the breaking Census news, on today's BradCast...

  • Trump may be getting a few tanks for his corrupt 4th of July celebration at the Lincoln Memorial on Thursday, though they won't be rolling down Pennsylvania Avenue. Where they will be, according to some poor writing from CNN, is another matter. ("Trump later confirmed tanks would be present during remarks in the Oval Office.");
  • Heat records are shattering in the U.S. and around the world, resulting in mussels cooking in their own shells in normally cool Northern California and highways dangerously cracking and buckling in South Dakota. What happened in Mexico and Europe, however, we hold until today's Green News Report at the end of the program;
  • But, back to the courts, as the U.S. House Ways and Means Committee filed a federal lawsuit on Tuesday against the Administration for failing to turn over six years of Donald Trump's tax returns as required by federal law, in a case that Trump seems unlikely to win. A long legal fight, however, may help him to delay the inevitable, unless he is able to receive a helping hand to undermine the rule of law from his friends at the stolen and illegitimate SCOTUS;
  • But the lower courts, so far, have provided little help to Trump. Late last Friday, with surprisingly little notice, albeit in the middle of a ton of other news, a federal judge in California blocked Trump's phony "national emergency" declaration meant to steal billions of dollars from the military to build portions of his long-promised Southern border wall (which apparently Mexico is still not paying for.) The same judge in two different challenges to Trump's blatant attempted theft, ruled that Trump's use of military funds for this purpose was "unlawful" and in violation of Congress' Constitutionally-mandated control of federal purse-strings. The Administration, however, is expected to appeal both rulings;
  • Voters in Florida, in the meantime, will have to hope for good news from the courts in the days ahead after Republican Gov. Ron DeSantis --- who was reportedly elected by less than one half of one percent of the vote last November --- quietly signed a controversial new law late on a Friday, without ceremony, the day before his deadline to sign it, which guts the state's reform of a 150-year old racist voting restriction. Despite passage of state Constitutional Amendment 4 last November --- by an astonishing nearly 65% of the electorate --- the new bill was passed along partisan lines in the GOP legislature to restore a restriction on the right of many former felons to vote. The new law, which went into effect Monday in the Sunshine State, requires former felons to pay off all court fines and fees before being allowed to vote, in contravention of the statewide ballot initiative which took effect on January 1 with no such restrictions. DeSantis had specifically pushed the GOP-controlled legislature to pass the bill, which will block many of the 1.5 million former felons --- including 1 out of 5 voting age African-Americans in the state --- from seeing their lifetime ban on the right to vote lifted. Voting rights advocates accurately describe the measure as an unconstitutional "poll tax" and have already filed suit to block it. The "conservatives" in the state will now have to spend millions in order to defend their new, unpopular law;
  • That's just one of the measures the GOP is beginning to take in order to boost their odds in 2020, as former President Jimmy Carter noted late last week that he doesn't believe Donald Trump is a legitimate President. Speaking Friday at a human rights forum hosted by the Carter Center --- which has served as a monitor of elections in third-world countries for decades --- the former President charged: "There’s no doubt that the Russians did interfere in the elections and I think the interference, although not yet quantified, if fully investigated would show that Trump didn’t actually win the election in 2016. ... He lost the election and he was put into office because the Russians interfered on his behalf." He said "yes", when asked by the forum's moderator if he believe Trump was an "illegitimate" President. Carter may be right or wrong. Shamefully, nobody knows for certain, since the public was never allowed to examine the ballots or the voting and tabulation systems following the 2016 Presidential election. That lack of public oversight, as we have long argued, continues to erode confidence in the legitimacy of American democracy. New, 100% unverifiable voting systems being put in place in advance of the 2020 race, unfortunately, (in states like Georgia and cities like Philadelphia and counties like Los Angeles) are likely to make that problem even worse;
  • But, speaking of how bad the 2020 cycle could be, the Trump Campaign has already begun their dirty tricks, according to a report in the New York Times. One of its "rising star" digital content producers has created a phony Joe Biden campaign website, meant to look like Biden's official campaign site, in order to smear the former Vice President. Neither the Trump campaign nor its staffer, Patrick Mauldin, who admits to having created the site, is noted on the page as being behind it. The fake campaign site, according to the paper, has received more visits than Biden's official website, and Mauldin has also "anomalously" created pages meant to undermine other current 2020 Democratic front-runners such as Bernie Sanders, Elizabeth Warren and Kamala Harris. Do Dems have any plans on how to deal with this sort of thing in 2020? Right now, it appears that they do not. Unless Dems pull together somehow --- even across another rough and tumble nominating process --- a repeat of the 2016 disaster should not be a surprise to anyone;
  • Finally, speaking of 2020, Desi Doyen joins us for our Green News Report special coverage of last week's first Democratic Presidential Debate in Miami, where the planet's worsening climate crisis finally received at least a little bit of airtime from many of the Presidential hopefuls across the span of the much-watched two-night event...
