Yikes. Busy day on The BradCast. Including some remarkable breaking news, both good and bad, throughout the hour. [Audio link to full show follows below this summary.]

Among the many stories, breaking and otherwise, on today's program...

  • When the show began, the monster Hurricane Helene, barrelling toward a direct landfall near Tallahassee and the Big Bend region of Florida's panhandle, was already a dangerous Category 3. By show's end, it had become a terrifying Cat 4. As disturbingly, the storm began the day as a Cat 1! Thanks to record warm Gulf waters caused by man-made global warming, we have yet another case of deadly, rapid intensification for this storm. Experts also warn of an "unsurvivable" 20-foot storm surge on the Gulf Coast. The dangers beyond Florida, in already soaked southeastern states, are also quite serious and severe in the days ahead.
  • After what Trump Republicans describe as Joe Biden's supposedly "weaponized" Department of Justice indicted and/or convicted Democratic U.S. Senator Bob Menendez (NJ), Democratic Rep. Henry Cuellar (TX), and the President's own son Hunter Biden (twice) over the past year, federal prosecutors unsealed an indictment on Thursday against NYC's Democratic Mayor Eric Adams. The Mayor, who says he will not resign, was charged on five counts related to corruption on behalf of Turkey. If the Biden's federal government has been "weaponized" against Republicans, they sure have poor aim!
  • But, you know who was actually very good at weaponizing the federal government against his political enemies? Yup, Donald Trump, as a deep dive from the NYTimes' Michael Schmidt (free link) detailed over the past weekend. Time and again, during his years in office, then President Trump demanded --- and often got --- criminal and civil investigations by DoJ and highly unusual and invasive audits by the IRS against his perceived political enemies, many of whom, if they worked in the government, were also improperly fired. Schmidt also summarizes (free link) how Trump unleashed his government against such perceived enemies as F.B.I Director James Comey and other senior FBI officials; Hilary Clinton and her 2016 campaign; Obama's Sec. of State John Kerry; his own attorney Michael Cohen; News organizations and reporters at CNN, WaPo and NYT; his own National Security Adviser John Bolton; and many others. And, as Schmidt reminds us, Trump has already stated this month that he plans to do it again if elected to another term.
  • Looks like its a big day for corrupt NYC Mayors! Today the D.C. Court of Appeals permanently disbarred former Trump attorney Rudy Giuliani, after New York state also permanently revoked his license to practice law earlier this Summer. The disbarments are related to the disgraced former Mayor and federal proseuctor's false legal filings claiming election fraud, without actual evidence, following the 2020 election on behalf of the loser Donald Trump.
  • In related news, even as jury selection was underway in a major defamation trial in Delaware pitting voting machine vendor Smartmatic against the rightwing propaganda outlet known as Newsmax, a last minute, still-confidential settlement was struck between the parties. As CNN reports today, "The settlement is the latest in a string of 2020 election defamation cases to reach an out-of-court agreement before trial. Fox News famously settled with Dominion Voting Systems last year for a record $787 million, and the far-right channel One America News settled with Smartmatic earlier this year." They also note that "Newsmax still faces a separate defamation lawsuit over similar claims that was filed by Dominion." As referenced during the show, here is one of BRAD BLOG's exclusive investigative reports from 2010 that disgraced former Trump attorney Sidney Powell cited (and bastardized) as part of her defamatory allegations against both Smartmatic and Dominion, as subsequently echoed by all the rightwing fake news outlets and discredited and now disbarred yutzes like Giuliani.

On today's BradCast: It was a mixed bag for democracy overseas this weekend, where (as here in the U.S.) a democratic election does not necessarily guarantee the winner will be a small "d" democrat. Meanwhile, the version of democracy we have here at home ain't necessarily doing much better. Arguably worse, in fact. [Audio link to full show is posted at the end of this summary.]

Among the stories covered on today's program...

  • A 49-year old man has been arrested after attacking two staffers of Virginia's Democratic Rep. Gerry Connolly with a metal baseball bat on Monday at his district office in Fairfax. The motive for the attack was unknown as of airtime, but the incident is yet another in a sharp rise of threats and attacks against lawmakers and their families since Donald Trump's January 6, 2021 sore-loser insurrection at the U.S. Capitol.
  • For the first time in his 20 years as Turkey's leader, President Recep Tayyip Erdogan will now face a runoff election to retain power in two weeks. Over the weekend, the increasingly authoritarian Erdogan was able to notch just 49.5% of the large turnout vote, falling just short of the 50% needed to win outright against opposition leader Kemal Kilicdaroglu, who received just shy of 45%. The next two weeks will see a fight for the remaining 5.7% of the vote won in the first round on Sunday by a third party candidate. Erdogan is believed likely to pull off another victory on May 28 --- despite startling inflation and his handling of an earthquake that resulted in more than 50,000 deaths --- after failing to win outright for the first time in his political career. Kilicdaroglu, however, vows he will win control of the key NATO ally, which has drifted toward the conservative right and Russia in recent years.
  • The news was slightly brighter in Thailand over the weekend, where two different opposition parties to the ruling military junta easily bested the competition. It was a "stunning" victory for the liberal Move Forward party who, with the help of young, first-time voters, easily defeated the populist, billionaire-controlled Pheu Thai party that had been favored to win going in to the weekend. Move Forward's agenda includes rolling back the military's political role and reforming laws that stifle dissent. The question now, however, is whether either Move Forward or Pheu Thai will be able to build a governing coalition in parliament and win the coveted Prime Minister's position. All parties, however, including those backed by the military, seemed to recognize the voice of the weekend's democratic vote. For now.
  • Back here in the U.S., the controversy over last week's appalling, 70-minute Donald Trump town hall, gifted to him by CNN, continues. In the second half of today's program we open the phones to listeners on whether CNN should have held the forum at all --- allowing the disgraced, twice-impeached, criminally indicted, sexual abuser former President of the United States to offer lie after lie after lie before a live audience of cheering supporters --- and, if not, how should the frontrunner for the 2024 GOP Presidential nomination be covered? Also, while the performance was clearly a gift to Trump in his run for the GOP nod, will it actually help him in the long-run to win a general election next year? I am not so sure. In fact, I don't think it will help him at all and is as likely to hurt him in a number of ways. We take a lot of thoughts from a lot of callers on those points, several of whom disagree with my own take on the matter, though in several different and interesting ways...

Breaking news today and a weekend full of otherwise dumb news resulted in a bit of a hodge-podge on today's BradCast. I hope you'll enjoy it anyway! [Audio link to full show follows below this summary.]

Among the many stories covered on today's program...

  • Rescue efforts continue in the aftermath of Sunday's horrific, pre-dawn, 7.8 magnitude earthquake --- and several huge aftershocks --- in Southern Turkey and Northern Syria. As we went to air, the death toll from both countries was more than 3,400. That tragic number is likely to continue to rise.
  • American Republicans are, no doubt, breathing easier today following the great Chinese Spy Balloon Crisis that gripped them with fear and threatened their very lives and those of their families for several days since last week. On Saturday, the U.S. military shot down the high altitude balloon off the coast of South Carolina and have been collecting its remnants for study. Thankfully, nobody was hurt throughout this days long national nightmare, and the Dept. of Defense suggests the U.S. gained more from the exercise, on balance, than China did. The DoD claims our borders were similarly breached by Chinese spy balloons three times during the Trump Administration. Despite fevered demands from some on the Right, neither President Biden nor Vice President Harris resigned in shame amid "the catastrophic Chinese Spy Balloon spectacle [that] clearly threatened American families" from coast to coast.
  • Great news for the wealthy! Thanks to campaign finance legislation adopted during the George W. Bush era in 2002, and huge inflation numbers in 2022, the amount of money that can now be donated to a single candidate for a single election has been increased from $2,900 to $3,300. The amount that can be given to national party committees, according to the Federal Elections Commission (FEC) has increased from $36,500 to $41,300 per year. And the amount allowed for payoffs to special national party committees, such as for national party conventions, has spiked from $109,500 to $123,900. Of course, those limits also apply to poor and working-class people instead. So, it's all totally fair and just some good ol' American "free speech" at work!
  • After declining to support Donald Trump's two Presidential runs in 2016 and 2020, the Koch Network is getting back in the game, vowing to oppose Trump this year by declaring their support for one non-Trump Republican by summer's end. We'll see if they have any better luck this year than their similar losing strategy back in 2016.
  • Despite conceding that Trump lost the 2020 election in Wisconsin, according to an audio recording obtained by AP, his campaign team in the Badger State vowed to help "fan the flame" of phony fraud as early as two days after Biden's win there.
  • Love him (or his policies) or hate him (or his policies), Joe Biden has accomplished more in the first two years of his Presidency than perhaps any other American President in history going back to at least FDR. Nonetheless, just one day before his second official State of the Union address on Tuesday, new polling out today from Washington Post and ABC News finds that 62% of Americans believe Biden has accomplished "not very much" or "little or nothing" in the first two years of his term. That may be an extraordinary failure by Democrats and the White House to get the word out about their own accomplishments. But the greatest indictment here should be for the corporate mainstream media whose only actual (Constitutionally-protected) job is to inform the public and educate the American electorate! Clearly, they have failed. Again. We discuss.
  • Finally, callers ring in today mostly on the topic of Biden's accomplishments or --- as several incorrectly see it --- lack thereof...

As it turns out, after so many years of warnings on The BradCast and at The BRAD BLOG, the local nightly news in Atlanta tonight sounds just like us, when it comes to concerns about the state's new touchscreen voting systems, and the same type of systems that are now used in at least 20% of the country. Of course, an urgent warning from one of the world's top experts, after examining GA's new electronic voting systems, finding they "suffer from specific, highly exploitable vulnerabilities that allow attackers to change votes" does get ones attention. [Audio link to full show is posted at the end of this summary.]

But, first up, two Donald Trump attorneys in Colorado got sanctioned on Wednesday, bigly, for what the federal judge characterized in a brutal 68-page order, as a "frivolous", "not warranted", "bad faith" filing attempting to overturn the results of the 2020 election. It was summarily tossed last year. The judge called out the two lawyers, Gary D. Fielder and Ernest John Walker, for their complaint which, though it included many "sworn affidavits" claiming the election was rigged, actually included "no firsthand knowledge" of any fraud at all. The duo also made no effort to verify an included claim from Trump himself that Dominion Voting Systems had "deleted 2.7 million Trump votes." Describing their effort as "one enormous conspiracy theory," the judge charged the evidence-free allegations amounted to "the stuff of which violent insurrections are made." He ordered the Trump attorneys to pay the legal fees of all 18 entities named as defendants in their suit. More such serious sanctions are likely coming soon for other Trump attorneys as well, including well-known ones, in other states.

Down in Texas, meanwhile, Gov. Greg Abbott has called a second emergency special session of the state legislature to begin on Saturday, as the current one ends on Friday. The session is largely meant to force through a voter suppression bill that has now been blocked twice by state Democratic lawmakers who walked out to block a quorum that would allow passage of the measure in the GOP-controlled legislature. The state Democrats remain, for now, in D.C., where they are pleading with Congress to pass federal voting rights protections, as they remain out of reach of Texas state troopers who have been ordered by the Governor to arrest them and force them to attend what one lawmaker described as Abbot's "suppression session" in the Statehouse.

As a number of Democratic members of Congress call for their August recess to be cancelled, in order to allow passage of both Biden's landmark infrastructure passage and critical voting rights measures at the federal level, Georgia's Senator John Ossoff on Wednesday filed a federal Right to Vote Act. Currently, unbeknownst to many, there is no U.S. law or Constitutional mandate for such an affirmative right to vote for every eligible citizen. Add Ossoff's new measure (and matching legislation filed by Rep. Mondaire Jones in the House) to the list of measures that urgently need passage in advance of 2022 to counter GOP suppression efforts at the state level. Unfortunately, it's also another measure --- along with the For the People Act and John Lewis Voting Rights Advancement Act --- that will require reform of the filibuster first, since the Republican Party has now become little more than a Rightwing Authoritarian party that would never support an Right to Vote law in Congress.

Speaking of Georgia, there has been several remarkable developments over the past several days in the lawsuit by the Coalition for Good Governance seeking to bar the use of Dominion Voting Systems Ballot Marking Devices (BMDs) for all voters at the polling place. The Coalition's suit, which previously succeeded in winning a ruling in federal court that banned the state's 20-year old Diebold touchscreen systems, hopes to replace Secretary of State's 100% unverifiable new touchscreen systems, made by Dominion, with verified hand-marked paper ballots before elections in the state this Fall.

Last week, Atlanta Journal Constitution reporter Mark Neisse uncovered a secret study carried out by Raffensperger during the 2020 election finding that the vast majority of voters (81%) forced to use the touchscreen Ballot Marking Devices, didn't bother to review the computer-marked printouts before casting them for more than five seconds. A smaller majority (51%) either looked at their ballots for less than one second or not at all (20%) before casting their vote. In all, just 19% of voters, according to the Secretary's own taxpayer-funded study of more than 4,000 voters in 39 precincts last November, reviewed their computer-printed ballots to ensure accuracy for more than 5 seconds!

Remarkably, after AJC's Neisse obtained the study's results via GA's Open Records Act, Raffensperger, in a jaw-dropped Orwellian perversion of reality, claimed: "This research shows voters do indeed review their ballots for accuracy before casting them," before falsely asserting the study was "proof the votes that were counted were for the candidates the voters intended." Of course, if the results were so wonderful, it begs the questions as to why Raffensperger kept the study, and its results, a secret from the public.

Making matters even worse, one of the Coalition's own experts --- world-class voting system authority J. Alex Halderman, Director of the Center for Security and Society at the University of Michigan --- was granted access to the Dominion BMDs used in Georgia (as well as other jurisdictions, such as San Diego County, CA) to examine them for vulnerability to hacking and manipulation as part of the court case.

The results of his findings, the Coalition's Executive Director Marilyn Marks tells me, are so damning that the federal judge has refused to unseal them, even to the plaintiffs who hired Halderman! His report is currently sealed to all but the judge and the attorneys on both sides of the case. Neither the defendant, Raffensperger, or the vendor who manufactures and sells the systems, Dominion, according to Marks, have asked the judge to allow them to review the findings. They do not want to see them, for some reason. (Likely, because both would then be legally required to take action on the damning, 25,000-word report.)

For his part, while his specific findings are sealed right now by the court, Halderman has filed an urgent declaration [PDF] about the report, explaining that his findings must be "urgently" addressed by Raffensperger.

"My testing has shown that the BMDs used in Georgia suffer from specific, highly exploitable vulnerabilities that allow attackers to change votes despite the State's purported defenses," Halderman warns in the public declaration.

"Established practice in the security field would require State Defendants to promptly subject Georgia's voting system to rigorous testing in response to my report, to assess the extent and significance of each of the vulnerabilities I described, and to identify and promptly implement specific measures (where possible) to eliminate or mitigate each of those vulnerabilities." [Emphasis in original.]

The alarming declaration was enough, apparently, to spark the attention of local television media to finally cover the story that we've been warning about for more years than we can now count. We share 11-Alive (WXIA)'s very good coverage of this breaking and disturbing news from Wednesday night.

Among the stories covered on today's program...

  • NY Attorney General Letitia James releases a report finding Gov. Andrew Cuomo sexually harassed as many as 11 staffers and retaliated against one of them, in violation of both federal and state law. The third-term Democratic Governor continues to deny the charges compiled over 5 months by the AG and refuses to step down. President Biden joins the chorus of calls for Cuomo's resignation. The NY State legislature announces they will soon conclude their impeachment inquiry.
  • New York City's outgoing Mayor, Bill de Blasio, announces that patrons of indoor leisure venues such as restaurants, gyms and shows will soon be required to show proof of vaccination. It's the first major U.S. city to require vaccination for use of businesses as the deadly and highly transmissible Delta variant of the coronavirus wreaks havoc, even in places like NYC where a higher-than-average percentage of the population has been smart enough to become vaccinated.
  • We continue to share heartbreaking stories of those who waited to too long --- for any number of usually terrible reasons --- to get vaccinated. Today's story features a husband and wife in Texas who didn't trust the vaccine, but now wish they had. They've both been "very, very, very, very sick" in the ICU and on ventilators for weeks. They are now begging relatives to make sure their four children get their shots, as it was too late for both parents to do so.
  • Florida is leading the nation of late in infections, hospitalizations and deaths, breaking their own pandemic records on the first two data points over the past several days. President Biden today noted that the states of FL and TX now account for one-third of all cases in the U.S. and called on their GOP Governors to stop making things worse by blocking local health mandates. But, Louisiana is also breaking its own pandemic hospitalization record, leading Gov. John Bel Edwards (D) to reinstate indoor masking mandates and Dr. Catherine O'Neal, Chief Medical Officer of the state's largest hospital, to issue a dire statement on Monday. She calls these the "darkest days" of the pandemic in her state, and is begging residents to mask up and get vaccinated. ERs in the state, she explains, are now unable to treat non-COVID patients, such as those having heart attacks or suffering from vehicle injuries.
  • Whether the CDC will say it out loud or not, Pulitzer Prize-winning science reporter Laurie Garrett argues that the "science says" a third mRNA shot is going to be needed for all Americans --- and that those over 60 should already be getting them.
  • And, yup, as TPM's Josh Marshall recently argued, citing the damage that mixed-messages from public health officials is causing, including to their own authority, while trying to coddle the voluntarily unvaccinated, "we need more blame": "We need to be placing the burdens on non-vaccination on the unvaccinated. And we need to be clear with the public that the problem is the non-vaccinated. They’re at fault. They’re to blame. And even more, the public influencers, celebrities and political actors who’ve driven resistance to vaccination are to blame."
  • In lighter news, the month-old pro-Trump "free speech" social media network (just the newest of many) called GETTR --- created by Trump spokesperson Jason Miller and funded by one of Steve Bannon's Chinese benefactors --- is reportedly being flooded with pro-ISIS propaganda, including "reams of jihadi-related material...graphic videos of beheadings, viral memes that promote violence against the West and even memes of a militant executing Trump in an orange jumpsuit similar to those used in Guantanamo Bay." MAGA!

On today's BradCast: We've got a lot of news to catch you up on from over the weekend --- and from today alone --- before we open the phones to listeners to ring in on Joe Biden's first 100 days in office. [Audio link to full show is posted below.]

First up, today's news...

  • Over the weekend, Biden officially declared the killing of 1.5 million Armenians by the Ottoman Empire beginning in 1916 to have been a "genocide". U.S. Presidents from both parties have declined to do so for decades, largely out of deference to Turkey, now a major NATO ally. Biden just went ahead and did it, after declaring his intention the day before to the Turkish President. Yes, it's a 100 year old story, in one respect, but not to the Armenian community which has sought such a declaration on the atrocity from a sitting U.S. President for years.
  • The U.S. Supreme Court announced on Monday that it would take up an NRA-backed case next term on the Constitutionality of the right to carry weapons outside of the home, a direct challenge to a century-old New York gun law. Similar statutes are on the books in a number of other states, including Maryland and Massachusetts. Given the news we discussed on last Friday's BradCast about the appalling 6 to 3 opinion issued by the GOP's stolen and packed SCOTUS last week --- and, in lieu of Democrats figuring out how to reform the Court to expand and unpack it --- today's news likely comes as a foreboding sign for gun safety advocates.
  • The U.S. Dept. of Justice on Monday announced a sweeping new "patterns and practice" probe of policing by the Louisville-Jefferson County Metro Government and Louisville Metro Police Department in Kentucky, following the middle-of-the-night 2020 police killing of 26-year old Breonna Taylor in her own home during a no-knock raid. The warrant was approved as part of a narcotics investigation which turned up no drugs and for which the City of Louisville has already agreed to a $12 million settlement after the police killing of the African-American emergency medical technician last year.
  • The Biden Administration is announcing the launch of an historic $12 billion summer food program to feed lunch to more than 30 million low-income children, as part of the recently passed $1.9 trillion American Rescue Plan. The USDA plan, according to experts who study childhood hunger, will go a long way towards feeding children who face food insecurity during summer months, when free school lunches are not available. The initiative comes on the heels of not only a hunger crisis amid the COVID pandemic, but after years of cutbacks to the Supplemental Nutrition Assistance Program (SNAP) and other programs to combat hunger by the Trump Administration. Another upside: Money spent on SNAP goes directly into local economies.
  • In news that broke just before airtime today, the U.S. Census Bureau released its first tranche of new numbers from the 2020 decennial survey revealing that Texas, Florida, North Carolina, Colorado, Montana and Oregon will each pick up Congressional seats in the once-a-decade redistricting process before the 2021 mid-term elections. New York, Ohio and, for the first time in its 170 years of statehood, California, would each lose a seat in the U.S. House. In fact, Texas is picking up two seats, while it, Florida and North Carolina have redistricting processes that are entirely controlled by Republicans, allowing them to gerrymander their states even further than they already are. Many of the Dem-controlled states picking up seats have processes in place that share power with Republicans for redistricting, or have a process controlled by independent commissions to determine new maps.
  • In some news that broke during today's show, California officials have announced that Republicans hoping to unseat the state's Democratic Governor Gavin Newsom in a recall election, have obtained the requisite number of verified signatures needed to hold the recall election for the first-term Governor this fall. More on that story, undoubtedly, in the days ahead.
  • And lastly, before we turn to callers ringing in on Biden's first 100 days, a word about the unusual, ongoing post-election hand-count in Maricopa County (Phoenix), Arizona, where the Republican-controlled state Senate is using tax-payer money to pay a private company named Cyber Ninjas, run by a Trump-supporting IT expert with no experience in elections, to recount the County's 2.1 million ballots from the 2020 election. The count is examining only the results of last year's Presidential race, reportedly won by Biden, and the U.S. Senate race, won by Democrat Mark Kelly. In both cases, it was the first time in decades for Democratic victories. While we are normally in favor of any and all attempts by citizens to oversee the results of their own elections, the Maricopa count is disturbing on several levels.

    For one, it is being paid for by tax-payer dollars, but run by a Trump supporter who, in addition to having no knowledge of elections or election technology, has a record of promoting demonstrably false claims about the election having been stolen by election system vendors, a number of communist counties, and allies of Joe Biden. The company heading up the count is also not using accepted hand-count practices established by the state. And they also refuses to disclose the amount or additional sources of dark money funding that it is receiving to carry out the hand tally. Moreover --- and most disturbing as of now --- is the fact that the tax-payer funded organizers are barring both media and the general public from overseeing the examination of the ballots from the 2020 election (which should, theoretically be protected and remain in state custody, under federal law, for 22 months.)

    I am in close touch with some of the folks who are working as observers on the count --- the ones with actual experience in post-election audits and recounts, unlike the Republicans in charge of this scheme --- and hope to have more information for you on this in the days ahead. There is no rush, apparently. At the rate of counting being carried out by the paid-for counters --- who not only counting, but examining ballots for signs of fraud --- it could take about 15 months to tally all of the ballots, according to one experienced election integrity advocate closing tracking the process.

  • Finally today, in advance of President Biden's first address to a joint a session of Congress on Wednesday night, his 99th day in office, media are rounding up their various assessments of the Administration's first 100 days and grading the President on his performance to date. It seems his bold actions have taken many in both the media and public --- who had previously regarded old Joe as an establishment, institutionalist centrist --- by surprise. We open up the phones to callers to do a bit of the same temperature taking today, to find surprisingly positive reviews for the new President from our usually somewhat cynical and progressive listener base here in Southern California (and, in Minneapolis, Chicago and elsewhere today.)

On today's BradCast, the gaslighting of the nation continues, from Flynn to Florida. [Audio link to show follows below.]

Two weeks ago, U.S. Attorney General Bill Barr's Dept. of Justice stunned the legal world by filing a motion to drop all charges against Lt. General Michael Flynn, Donald Trump's first National Security Advisor and one of his earliest supporters. Flynn had twice pleaded guilty before three different judges about lying to the FBI about his conversations with the Russian Ambassador before Trump's inauguration. His guilty plea also included the admission that he was a paid agent for the nation of Turkey, which he failed to disclose even as he received highly classified briefings after Trump's election before going on to serve as the nation's top national security official in the White House.

Flynn initially lied to FBI officials in January of 2017 and was recently set to receive his sentencing in federal court when his new Fox "News" lawyers convinced him to try and withdraw his guilty plea. Before U.S. District Court Judge Emmet Sullivan was able to decide on that matter, Barr, Trump's new fixer, jumped in to try to make the prosecution go away completely, claiming that the initial interview during which Flynn lied to federal officials about his conversation with Russian Ambassador Sergey Kislyak, should never have happened in the first place. Barr argues the counterintelligence probe being carried out by the FBI at the time, looking into Russia's alleged interference in the 2016 campaign and potential cooperation by the Trump Campaign, should also have never happened in the first place.

The problem is Barr's own DoJ --- just a few months ago, at the beginning of this year, in their sentencing recommendation memo [PDF] for Flynn --- argued the 2017 interview was "material to the FBI’s counterintelligence investigation to know the full extent of the defendant’s communications with the Russian Ambassador, and why he lied to the FBI about those communications." They called Flynn's false statements to the FBI "significant" and potential "evidence of links or coordination between the Trump Campaign and Russia."

Week's later, in the May 7 motion to dismiss the charges [PDF] against Flynn --- which all of the career prosecutors who worked on the case for years refused to sign --- Barr's DoJ claimed the exact opposite, that the January 2017 interview with Flynn was not "conducted with a legitimate investigative basis." Barr himself, during an interview with a former Fox "News" reporter explaining the unprecedented filing, argued that the FBI "did not have a legitimate basis for a counterintelligence investigation against Flynn."

But Barr's DoJ argued the opposite case only weeks earlier and offered few details in the new filing about why they are now, suddenly, changing their legal position. Judge Sullivan is none to happy about any of it and has retained a retired prosecutor/federal judge to argue against the new filing now that the DoJ has literally joined forces with the Flynn defense team they were previously prosecuting.

The argument, as national security journalist MARCY WHEELER of Empty Wheel recently reported, is now between the Barr DoJ's two different and conflicting positions on the matter and, she explains, should be covered as such by the corporate media seeking to "both sides" every issue.

Wheeler joins us today to explain the extraordinary, unprecedented mess, and how it is that Barr and his DoJ now find themselves, literally, on both sides of the issue, as the nation's top law enforcement official continues his partisan bidding for the President of the United States. "You can't, as the same party," says Wheeler, "stand before a court and say, 'I think 2 plus 2 is 4 and then the next day come in and say, 'I think 2 plus 2 is 17.' That's effectively what DoJ has done, given that Bill Barr's DoJ said in January this was material to a serious and legitimate investigation, and now he's saying this was not material because the investigation was not legitimate."

She also discusses whether the media are falling for Barr's bogus claims; whether Barr and the DoJ could, themselves, be sanctioned by Judge Sullivan; and whether Sullivan's new hire, Judge John Gleeson, may argue that Flynn, in this case, should be charged with contempt for his perjurious lies to the court.

Then, as Barr tries to gaslight the nation, the state of Florida, under the command of GOP Governor and Trump pal Ron DeSantis, is apparently trying to do the same amid the coronavirus pandemic. A new report from Florida Today finds that the state's lead Department of Health official who headed up the creation of Florida's highly lauded COVID-19 dashboard website, was recently removed from the job after refusing to censor key scientific data on coronavirus cases, spread and deaths in the Sunshine State while DeSantis is risking lives by "reopening" the economy there faster than health experts recommend.

The way in which Republicans are trying to deny, ignore and otherwise hide scientific data in favor of promoting the economy at all costs, as we discuss, is a perfect hyper-speed analog of how the same political party has attempted to deny, ignore and otherwise hide the science of climate change in favor of the economy, no matter the expense to the public and the death toll that folly similarly entails.

Finally, Desi Doyen joins for the latest Green News Report with more lessons we should learn from the COVID crisis about the climate crisis; news on the massive, climate change-fueled cyclone about to slam into one of the poorest regions on earth in the middle of the pandemic; and the Trump EPA's approval of rocket-fuel toxins in your drinking water...

It's been a long month here at the BradCast, but the end is near. Brad Friedman and Desi Doyen return to their rightful places here on Monday. I'm NICOLE SANDLER, holding down the fort for one final show until they return.

When Brad called to tell me that his father had suffered a stroke, and that he and Desi were heading out to Arizona to be with him, I told him I'd be here for whatever he needs. That's what friends do. And I consider Brad and Desi not only friends, but family. I'm glad I could help them out so they didn't have to worry about anything here, but be fully with his parents, taking care of what's really important in life. But I, like you, am looking forward to the return of the Brad Friedman-hosted 'BradCast' and Desi's much-missed Green News Report!

On this final show of the week, I spent the first two segments, once again, recapping the latest news. Harvey Friedman sure picked the craziest time in this generation to make his exit, as the already frenetic pace of breaking news accelerated exponentially in the past month.

Today was insane, with news on the Giuliani front (he's the subject of a criminal investigation now too, after his associates were arrested Wednesday attempting to flee the country!). The Pentagon is now telling Turkey to stop doing what Donald Trump gave them his blessing to do less than a week ago. And, oh, what he authorized was genocide of our only real allies in the region. But the dominoes are about ready to fall, as even his staunchest defenders in Congress - Lindsey Graham, we're looking at you - are appalled by his actions and are calling him out publicly about it. And a courageous former Ambassador to Ukraine defied the White House's warning that no one would be testifying or cooperating with the impeachment inquiry, showing up today and apparently blowing the roof off the sucker. At press time, we'd only gotten reports about her explosive opening statement. I'm guessing more details will emerge in the coming hours and days.

Our guest today is an old friend and Air America Radio colleague, JACK RICE. In addition to being a broadcaster and journalist, he's also a trial lawyer. And he was a CIA case officer under the Clinton and Bush 43 administrations. I call on Jack regularly for his expertise, which he kindly provided in reference to the plethora of news we're living through.

On today's BradCast: If you think the way the Republican Party has rigged and stolen the U.S. Supreme Court is appalling, just wait until you see what they're trying to do of late at a few of the state Supreme Courts! [Audio link to show is posted below.]

But, first up today: Donald Trump says the Crown Prince of Saudi Arabia told him he had nothing to do with the disappearance --- and, likely, murder --- of Washington Post journalist, Saudi citizen and U.S. resident Jamal Khashoggi at the Saudi consulate in Turkey. The Prince's word appears to be good enough for Trump, who went on to compare the situation to the allegations of sexual assault against now-U.S. Supreme Court Justice Brett Kavanaugh

Meanwhile, the midterm elections are now exactly three weeks away and early voting got underway on Monday in Georgia where, you'll be shocked to learn, it didn't go well. After our previous coverage of ongoing racially disproportionate voter suppression schemes under the command of GA Sec. of State and Republican gubernatorial candidate Brian Kemp (who is in a tight election contest with Democrat Stacey Abrams), and after very serious and years-long concerns about their completely unsecure, wildly hackable, and 100% unverifiable touchscreen voting systems, it appears that the electronic pollbook systems failed across Fulton County (Atlanta) on the first day of early voting.

In not entirely unrelated news, the GOP appears to now be a wholly owned subsidiary of Las Vegas billionaire Sheldon Adelson.

Then, we move to some of the insanity of several attempted state Supreme Court coups this week with Slate's legal reporter MARK JOSEPH STERN. Stern joins us to detail both some good news from the Florida state Supreme Court, regarding that state's Supreme Court, and an apparent Constitutional Crisis in West Virginia after a decision by that state's Supreme Court, regarding their state Supreme Court. If it all sounds nuts, it's because it is.

First, in Florida, outgoing Republican Gov. Rick Scott had vowed to name three new Justices to the Court, even though the Democratic-appointed Justices he planned to replace will not be vacating their seats, because of term limits, until after Scott officially leaves office in January. Stern reports the largely good news --- with a caveat or two --- regarding the Sunshine State's Supreme Court's unambiguous ruling last week that will leave the job of appointing three new Justice to Scott's successor instead (who will be either Democratic gubernatorial candidate Andrew Gillum or Republican Ron DeSantis, depending on how things go on November 6th.)

Then, things get far crazier at the West Virginia state Supreme Court, where the Republican state legislature, along with Republican Gov. Jim Justice, have been attempting a coup by impeachment of all five Justices on the state's 3 to 2 Democratic-majority Court. This story has more jaw-dropping twists and turns in it than I can possibly describe here --- including five temporary replacement Justices determining that at least one of the impeachments was unconstitutional under state law and the GOP-majority state Senate which hopes to move forward with a trial anyway...if only they could only find a Justice willing to preside over it, as required by the state Constitution.

Just tune in for the insane details on how, as in Florida, West Virginia Republicans are doing anything and everything they can to blatantly steal a Democratic-majority high court.

And, as if that's not enough, Stern then reports on the wildly hypocritical decision by the U.S. Supreme Court last week that will leave a new voter suppression law --- enacted by North Dakota Republicans --- in place for the November midterms. The ruling effectively changes the state's election law at the last minute before this year's general election and is likely to disenfranchise thousands of Native American voters. The ruling threatens to undermine this year's re-election chances of Democratic Sen. Heidi Heitkamp, who won her previous election in 2012 by just 3,000 votes, and could assure Republicans hold their control of the U.S. Senate along with it.

Yes, elections and Supreme Courts --- be they at the federal or state level --- matter!

Finally, Desi Doyen joins us for the latest Green News Report, as the long road to recovery begins and the death toll increases after the catastrophic Hurricane Michael, and as a bought-and-sold Republican Party --- from Marco Rubio in Florida to Donald Trump in the White House --- continue to deny the deadly and costly impacts of climate change on behalf of their fossil-fueled corporate owners...

On today's BradCast, I'm your host as Brad and Desi make their way along the road. Some of you hear my show, In Deep with Angie Coiro, alongside the BradCast on the same stations and streams.

We're awash in immigration stories this week, none of them good. Between Donald Trump's ongoing snit that there's no border wall, and his dead-eyed sidekick Stephen Miller's pleasure that the first round of sobbing, damaged children was a such grand success, a new round of detentions and separations is in the works. While reports are that grabbing wailing children from their families and losing them in the system isn't the plan this time around, the proposed "binary choice" isn't a whole lot better. Captured families can sit together in detention while justice slowly creeps toward them, or - their wailing children will be grabbed from them. That sounds awfully familiar.

TINA VASQUEZ has an article published simultaneously on Rewire.News and the New York Review of Books. She talks with me about the organizations shooting for the moon, working to #Abolish Ice. In fact, some go further, with dreams of open borders and Jeff Sessions put out to pasture.

Then the latest on the disappearance and probable murder of Washington Post columnist Jamal Khashoggi. BILL BROWDER is the founder and CEO of Hermitage Capital Management. When his lawyer was tortured and killed by the Russians, Bill campaigned in the US for sanctions against Russia for the crime. The result is the 'Sergei Magnitsky Rule of Law Accountability Act' - the same act Congress cites in its requests to Trump to investigate Khashoggi's fate. Trump so far continues to twiddle his thumbs. Bill talks to me about what justice in this case looks like to him.

SARAH CRAFT brings us tidings of great joy. Yesterday the state of Washington's top court found the death penalty unconstitutional. Sarah - with Equal Justice USA - says it's a trend that seems to be growing.

Finally, ELIZA GRISWOLD, poet and journalist. She spent three years with the Haney family, on the edge of Appalachia. Stacy Haney watched her son grow sicker and weaker, pets die, farm animals born deformed, and the family's drinking water turn black. She realized all that was connected to the fracking down the road. But in a town getting rich on fracking leases, she was ostracized in her fight against the company. Eliza's book is Amity and Prosperity: One Family and the Fracturing of America.

Among the headlines today:

The news about Jamal Khashoggi gets more and more grim. Turkey claims to have both audio and video evidence of the missing journalists murder --- although for reasons I detail in the show, Turkey is not an entirely reliable narrator here. US sources tell the Washington post this sounds to them like a failed rendition attempt. Donald Trump is twiddling and fretty lest the US lose arms sales to Saudi Arabia, and what’s a missing journalist compared to that?

The ACLU is among those sounding the alarm about new regulations proposed for the National Park Service to inflict on White House protestors. It's ugly stuff; maybe the most blatant bit is shaving down to just five feet --- yes, FIVE FEET --- of White House sidewalk space allowed to protesters. That, and raising the cost of permits and fees. If you ain't got the coin, there goes your "free" speech. You can comment directly to the NPS, or via the page set up by the ACLU.

Melania Trump is the most bullied person in the world. No, really.

The percentage of American kids without vaccinations has quadrupled since 2001, proving once again that idiocy is highly contagious.

And Joe Biden thinks Dems have a shot at taking both the House and the Senate in the midterm elections. From your lips etc., Joe!

After the headlines roundup: a conversation with NELINI STAMP, Organizing Director with the Working Families Party and a key organizer in the #BlackFridays movement. Last Friday was the kickoff for women – particularly women of color and non-binary women – to don black clothes and walk out of work at 3pm local time. Nelini reviews that impressive first week, and what the movement is about.

Then, SORAYA CHEMALY discusses her new, highly-researched book, Rage Becomes Her. It probes cultural messaging about anger – and the effects of that messaging – on every era of women’s lives, from the cradle onward. The footnotes section is both impressive and sad – impressive because it is so. Darn. Thorough. And sad because – as the author is a woman – research tells us she's viewed as inherently less credible, and she has to work that much harder showing her work.

The new Twin Peaks (which is excellent, by the way!) may be less surreal than the latest goings on inside our current White House. On today's BradCast, the latest news on the ever unfolding investigations into Team Trump and on his overseas trip (stories Trump already managed to conflate today), along with big election-related news from the U.S. Supreme Court and a quick preview of this week's upcoming U.S. House special election in the state of Montana. [Audio link to show is posted below.]

Today, before we get to the latest in the David Lynchian tales of President Trump, two new and important election-related rulings by the U.S. Supreme Court. One, being described by UC Irvine Election professor Rick Hasen as a very "big deal" and "a major victory for voting rights plaintiffs" deals with racial and partisan gerrymandering in North Carolina, with ramifications for a number of other similar Republican gerrymanders in several states. The other is a victory for campaign finance restrictions. Both cases feature surprising alliances between Republican and Democratic-appointed Justices following last month's confirmation of Neal Gorsich to fill the vacant seat stolen by Republicans after the death of Justice Anton Scalia.

And, speaking of elections, we also preview the U.S. House Special Election set to take place in Montana this Thursday, as populist first-time candidate and popular folk singer Rob Quist barnstormed the state over the weekend with Bernie Sanders. Republican establishment candidate Greg Gianforte is said to have a small lead in pre-election polls, despite being recently caught on tape supporting the GOP health care bill while seeking money from wealthy lobbyists, even while telling voters on the stump he hadn't made up his mind about it yet. In addition to providing a bellwether for the 2018 elections, it may also serve to shake up the current, very serious divide within the Democratic Party itself, depending on how the results shake out this week. That divide has been somewhat obscured by the madness of the Trump White House, but the bitter split between Bernie and Hillary partisans is still very much creating a rift among progressives and Democrats.

Then, we're joined by the great Heather Digby Parton of Salon.com and the Hullabaloo blog to try and make sense of ALL of the latest in the increasingly surreal Trump Administration investigations, and the ongoing troubles Trump ("the clear and present danger"), his former National Security Adviser Michael Flynn ("something wrong with him"), his Vice President Mike Pence ("Involved up to his eyeballs"), and many others. In addition to all of that and whether or not it may be heading towards impeachment, Parton also shares thoughts on Trump's overlooked recently reported threat to lock up journalists (reminding us that AG Jeff Sessions is "by far the most dangerous, malevolent person in the Administration") and offers insight on a number of late-breaking stories related to all of the above, including: Flynn, reportedly, now taking the 5th to avoid self-incrimination in response to Senate Intelligence Committee subpoenas; Trump digging himself deeper in Tel Aviv during his 9-day jaunt overseas; and now he may have even have lost a few of his own supporters following his speech on Islam in Riyadh, Saudi Arabia.

If you watched the new Twin Peaks over the weekend, as I did (the first two hours all year that I haven't thought about Trump, frankly!), what's going on in this Administration is even more difficult to make sense of right now, believe it or not. So, enjoy!...
