Today's interview should be of great interest to all of the creators out there. Artists (both fine and musical), authors, and creators of goods that are sold to consumers all fight an uphill battle against a handful of giant corporations who call the shots, set the prices, and take advantage.

In their new book, Chokepoint Capitalism: How Big Tech and Big Content Captured Creative Labor Markets and How We'll Win Them Back, authors CORY DOCTOROW and REBECCA GIBLIN show how powerful corporations construct "anti-competitive flywheels" designed to lock in users and suppliers, make their markets hostile to new entrants, and then force workers and suppliers to accept unfairly low prices.

In the second half of the book, they explain how to navigate around the chokepoints, using tools ranging from transparency rights to collective action and ownership, radical interoperability, contract terminations, job guarantees, and minimum wages for creative work.

Focused on solutions, they're calling on workers from all sectors to unite to help smash these chokepoints and take back the power and profit that's being heisted away --- before it's too late.

There's also is a bit of news to report at the top of the show. The two big items both coming from President Joe Biden. On Thursday, he surprised everyone by announcing an Executive Action to pardon everyone convicted on federal simple marijuana possession charges, and called for the reclassification of marijuana as NOT a Schedule I narcotic. Pretty huge.

Then, at a fundraiser in NY on Thursday night, Biden, referencing Russia's assault on Ukraine, warned that "for the first time since the Cuban missile crisis, we have a direct threat of the use of a nuclear weapon if in fact things continue down the path they are going … we have not faced the prospect of Armageddon since Kennedy and the Cuban missile crisis …. I don't think there's any such thing as the ability to easily use a tactical nuclear weapon and not end up with Armageddon."

This has been an intense week, with two more hearings from the bipartisan U.S. House Select Committee investigating the January 6 attack on the Capitol and Donald Trump's attempt to steal the 2020 election. The tsunami of damning evidence and information has been somewhat overwhelming. I'm feeling more stressed out than I have in a while, and I realize it's because all of the memories of not only that day but, frankly, those four years when our entire world was derailed.

Without any medical training (so take it for what it's worth), I'm seeing signs of PTSD as the memories of those years come flooding back.

JOHN NICHOLS is National Correspondent for The Nation. You already knew who he is, as a fairly regular guest on The BradCast. So you may already know why I so enjoy speaking with him, especially at times like this. We started out talking about the J6 hearings, before seguing into a conversation about whether or not we can survive all of this and what it will take to get this country back on track to being a great nation.

So, we get deep and very aspirational. When you're dreaming, anything is possible. And when things are as dire as they are now, reaching for unicorns may be the least we should be doing...

On Tuesday, a jury in DC acquitted Michael Sussman, an attorney whose firm worked for Hillary Clinton during the 2016 election, of lying to the FBI. The failed prosecution comes three years after Donald Trump's Attorney General Bill Barr tapped U.S. Attorney John Durham to open a Special Counsel investigation into the origins of the FBI's probe into Russian interference in that election. Or, as the former guy demanded at the time: "They now go and take a look at the oranges of the investigation... the beginnings of the investigation, about the Mueller report."

The jury only deliberated for six hours before finding Sussman not guilty of lying to his FBI contact about working with the Clinton campaign when he tried to warn the federal agency about unexplained data transmissions between the Trump Organization and a Russian bank. Sad!

I'll admit that I have not followed this case or Durham's overall investigation very closely, despite many on the right desperately describing Durham's case against Sussman as a "BOMBSHELL!". But, that's probably because I don't watch Fox Not-News.

Investigative journalist MARCY WHEELER, on the other hand, has followed all of this very closely, takes her work very seriously and explains this insane prosecution and much more today. As she notes toward the end of the today's interview, "I've lived and breathed this stuff for 18 months now." She covers all of it in great detail at her somewhat eponymous website, Emptywheel.net.

So, Marcy is my guest whole hour. She's filled with details and stories, tells us all we need to know about this trial and Durham's overall (largely fruitless) investigation, which had no real predicate to begin with, other than Barr believing something didn't seem right about the original investigation into Russia's involvement in 2016.

Then we also look ahead to next week, as the U.S. House Select Committee's public hearings on the January 6, 2021 investigation begin next Thursday night...

One thing I think we can all agree on is that the last 2-3 years have been really rough. (OK, it's more like the last 5-6 years, but you get the gist of what I'm saying.) But it has prompted me on more than one occasion to long for some words of wisdom --- or biting philosophical commentary from the late great comedian, social satirist George Carlin.

Sadly, we lost him in 2008, but his work has lived on. Somehow, Carlin seemed to know what was ahead of us, and his bits regularly trend on Twitter even now as people re-discover his prescient comedy.

George Carlin's American Dream, a new two-part documentary directed by Judd Apatow, debuted on HBO last week. Carlin's only child, KELLY CARLIN, joins me on the show today to talk about this very personal project and about her father, the voice of an era (actually, several), George Carlin.

Yesterday was Memorial Day. As much of our military seems to be entrenched in right-wing politics, I was pleased to learn about a veterans group called Common Defense because it's made up of progressive veterans! Republicans and conservatives do not have a monopoly over our military, so I was happy to speak with NAVEED SHAH, the group's political director, to learn a bit about the progressives who also serve our nation...

MARCY WHEELER is always one of my favorite guests. She's an independent journalist, writing at her own semi eponymous blog Emptywheel. She's always covered national security and intelligence issues, and she's really gone all in on covering everything surrounding the January 6 capitol insurrection.

Wheeler is living in Ireland these days, but she calls into the listen lines that have been set up for the Jan 6 hearings, and covers the hearings better than anyone else doing it.

Unfortunately, while the hearings are carried and available for all to listen in on using those phone lines, there is no similar platform from which to hear the jury trials. But she's managing somehow.

Marcy is also following the actions (and inaction) of the Dept. of Justice and other entities who have investigations into the former administration and its attempts to overturn a free and fair election.

I suggested she's got the makings of a great, quite comprehensive book. But she reminded me that if she were to write now, she'd be unable to cover the news as it was happening. So she'll stay on the beat for now…

Among them: Ukraine's sinking of the Moskva, Russia's flagship in its Black Sea war fleet; and new anti-abortion laws being quickly enacted by GOP states in anticipation of this summer's U.S. Supreme Court ruling that may well end or, at least, severely restrict 1973's landmark Roe v. Wade precedent and its right to privacy for women seeking reproductive care.

Next, my conversation this week with my friend TANYA in Ukraine. I met her six weeks ago as Putin's war began, when I cold called the Friends Forever Hostel in Kyiv. We've been communicating ever since via text message. And, this week, we connected for the first time via video with Zoom. I'll share some of that conversation on today's program.

Finally, my discussion with AMY GAJDA, former journalist turned Tulane University Professor of Law and an expert on privacy and the media. We discuss her new book Seek and Hide: The Tangled History of the Right to Privacy on what is clearly an important topic these days.

After recapping the celebration of Ketanji Brown Jackson's confirmation as the next Justice of the Supreme Court on the south lawn of the White House today and a look at the rest of the day's news, we jumped into the flood waters of our climate crisis.

EUGENE LINDEN is an award-winning journalist and author who deals with science, nature and the environment. His last book on climate change, Winds of Change, explored the connection between climate change and the rise and fall of civilizations.

His new book, released this week, is called Fire and Flood: A People's History of Climate Change, from 1979 to the Present. Along with the history of climate change, Linden points a big finger at the insurance industry for encouraging people to move to high risk areas.

He tells me there is a path back from the cliff, but we need to act now…

My guest today is ELIE MYSTAL, Justice Correspondent for The Nation, and author of the new book, Allow Me to Retort: A Black Guy's Guide to the Constitution.

Elie's point is quite logical. He says that Constitution was written by a bunch of white men for white men. He was not only not who they meant when they wrote 'All men are created equal' as that document specifies that men who had the same melanin in their skin as he has are considered to be 3/5 of a person. And women? Well, we didn't count at all apparently (and still don't, as it's 2022 and we still don't have an amendment proclaiming us equal!)

He says his goal was to "expose what the Constitution looks like from the vantage of a person it was designed to ignore," and that he does.

As for the idea that the Amendments fixed the problems in that flawed document, Elie points out that the Bill of Rights, the first 10 Amendments, were what the video gamer community would call a 'day one patch.' They were demanded in order to get the votes needed to pass. But they were written by the same white guys who wrote the original, who he says "didn't think they were actually necessary but did it to placate political interests."

As is always the case with Elie, it was a fascinating, energetic conversation.

In the last segment, I introduce you to Tanya. She and her husband own the Friends Forever Hostel in Kyiv, Ukraine. I met her on Feb 28, when I called in my quest to find a Ukrainian citizen to talk to who spoke decent English.

We've been 'talking' ever since over the Telegram app, and have become friends, thousands of miles and a world apart. I find it easier to wrap my head around worrying about a specific person than the 43 million+ population of Ukraine. I share her odyssey with you. And for one person, a happy 'intermission,' as this tragedy is far from over...

It's Nicole Sandler, back for another day guest hosting the BradCast. Friday was another brutal day of war perpetrated by Vladimir Putin on the people of Ukraine. It's unfathomable that this is happening. There's coverage of it everywhere, so I thought that today, we'd focus on the rest of the news.

Well, obviously not all of it... but there were three areas I wanted to talk with the always brilliant MARCY WHEELER about. Marcy is an independent journalist who focuses on matters of national security and civil liberties at her own Emptywheel blog.

I spoke with her on Monday, Presidents' Day, which was a few days before Putin invaded Ukraine. Nevertheless, her thoughts on what brought us to that point are interesting, as she weaves all the threads together...

The first of the three areas she enlightened on was filing by Bill Barr-appointed Special Counsel John Durham, which Fox not-News covered ad nauseum for days, criticizing the responsible media for not reporting on it...until Fox themselves suddenly stopped talking about it.

Second, the progress being made on the Jan 6 insurrectionists prosecutions and House Select Committee investigation.

And, of course, Russia/Ukraine.

I'm somewhat afraid to get my hopes up about the idea of Donald Trump and his accomplices being held accountable for their crimes, despite seeing the bipartisan House Select Committee investigating Jan. 6 doing their work. I can't wait to see their hearings.

But I also remember being confident when Robert Mueller was investigating, knowing a report was on the way. And we know how that went. Trump's minions were able to preempt the release of the report and put out a completely fabricated synopsis of its findings.

I remember Peter Strzok, the FBI counter-espionage agent who first opened an investigation into Russian tampering into the 2016 election. And then watched Trump bully and eviscerate him after private texts with a coworker surfaced, allowing the entire narrative to be hijacked. The Washington Post put together adevastating supercut of Strzok's testimony before Congress, if you need a refresher --- or, for some reason, want to get really angry.

So, I'll be cautiously optimistic that good will prevail, even if I wouldn't bet on it.

My guest today is PETER STRZOK, FBI veteran and New York Times bestselling author of COMPROMISED: Counterintelligence and the Threat of Donald J. Trump. His book has just been released in paperback and includes a new afterword with fresh reporting on the flood of Trump intelligence revelations that have come to light since it was first released.

I really enjoyed our conversation, and wish he were still on the job.

We started the show with a bit of the latest news. And I figured, after being so serious with Strzok, we could end on a lighter note. So, I shared a couple of songs that deal with the Spotify/Joe Rogan/Neil Young issue. First, a new little ditty from Steven Page, former lead singer of Barenaked Ladies called "Choose Young". And we finish up with Lauren Mayer (who publishes wonderfully funny and topical song parodies on YouTube) and her song called " They Fought Spotify".

I think one of the more important jobs of any President is choosing the people who'll make up the cabinet and perform other important functions in the government. It's hard to forget TFG (the former guy) bragging that he'd hire "Only the best people". Well, we know how that went. Did Joe Biden do better?

I’m joined today by JEFF HAUSER, director of The Revolving Door Project, who scrutinizes the executive branch appointments. We'll get his thoughts on Joe Biden's picks as his first year in office draws to a close next month.

As usual, we’ll start the show with the latest news, of which there was precious little this week. But, shortly before publishing today’s show, actual news did break! The jury is back in the Ghislaine Maxwell trial… She was accused of recruiting teenage girls to massage pedophile Jeffrey Epstein at his homes in Palm Beach, Florida, New York, New Mexico and elsewhere between 1994 and 2004.

Well, she was found guilty on five of six counts including conspiracy to commit sex trafficking and sex trafficking of an individual under 18. She was found not guilty of enticement of one individual under 17 with the intent to engage in illegal sexual activity.

So that happened…

And we’ll end the show with a warning to America about a big threat from down here in Floriduh…You can thank me after Election Day 2024, I hope...

I have a busy show for you today. But I start today's companion post with a bit of a retraction from the CDC which just arrived in my inbox. I honestly don’t know whether to laugh or cry, as it showed up just as I put the finishing touches on today's show.

Our first guest today is JOHN M BARRY, a professor at Tulane and author of a number of books. The one we're concerned with today is The Great Influenza: The Story of the Deadliest Pandemic in History. Barry literally wrote the book on the closest approximation of what we're living through right now. So I wanted to check in with him to ask how the 1918 Spanish Flu finally ended, and to ask if we might be on the same track with the arrival and potential predominance of the Omicron variant. And, frankly, it appeared that I may have hit on something.

At least until five minutes ago, when I received this alert. "CDC significantly cuts estimate of omicron's prevalence in US," reads the headline at The Hill. So I kept reading...

I guess that just means the situation is even more dire than we thought.

Also today, I reached back into late 2020 for our second interview, but there’s a method to my madness. In October of 2020, NY Times columnist NICHOLAS KRISTOF and his wife, Sheryl WuDunn, produced a film to go along with the book they released the previous year with the same title, Tightrope: Americans Reaching for Hope.

In it, Kristof takes a hard look into poverty in America, the wealthiest nation on the planet. He takes us back to his hometown of Yamhill, Oregon, where people are really struggling.

Perhaps it was the journey of making the film and writing the book that convinced Kristof to make a major life change. This year, he quit the NY Times, moved back to Oregon and launched his campaign to run for Governor. It appears to me that he's doing it for all the correct reasons. Welcome to that weird week between Christmas and New Years during which not a lot of news is made, and we'd all rather be doing something else! Well, Brad Friedman and Desi Doyen are off doing something else, so you got me again, NICOLE SANDLER as your trusted guest host, filling in today on the The BradCast! After a perfunctory look at the lack of news happening today, we're joined by MARCY WHEELER, the independent investigative journalist based at emptywheel.net, who covers national security and civil liberties. For the past few months, she's been covering the pleas and proceedings around the January 6 attack on the U.S. Capitol.

Of the 700 plus who've been arrested so far for their participation in the riot and/or insurrection, Marcy tells us that around 100 have cut deals with the court, most of them on trespassing charges.

The best thing I heard from Marcy is that she believes justice is being served. And though the wheels of justice turn excruciatingly slowly, she thinks the criticisms being lobbed at Attorney General Merrick Garland are somewhat overblown and claims that DOJ is doing the necessary groundwork to fully prosecute those responsible.

I wanted to know if the groundwork will eventually lead to charges against the former president, and she referred me to a post she wrote back in August at emptywheel titled "How a Trump Prosecution for January 6 Would Work", in which she suggested it'll all come down to obstruction of justice...which is what the U.S. House Select Committee investigating the attack seems to probing regarding Trump et al right now...

Medicare Open Enrollment ended on Tuesday, but I learned that you can still make changes to your plan during a special period that runs from January to March. So, with that in mind, I'm sharing an interview I did on my show on Monday, the day before open enrollment ended.

But, first up today, some of today’s news headlines, including the Supreme Court's ruling on the Texas abortion ban case, S.B. 8; the threat posed to Ukraine by Russia; the UK court determining that Julian Assange may be extradited to the U.S. to stand trial; the successful vote to create a union shop at a Starbucks in Buffalo, New York and the decision by Kellogg's to replace striking workers at their Michigan factory with scabs (and an Internet scheme that has crashed that plan); how Big Pharma has raised prices far in excess of the current rate of inflation, and more.

Then...by now, you've probably been inundated with commercials about Medicare Advantage. Remember the old adage, if something seems too good to be true, it usually is? That applies to healthcare too. Not only is Medicare Advantage not what they present it to be, it is an instrument leading to the privatization of Medicare.

And from an article I read at Common Dreams last week, I learned that there's another Medicare privatization scheme that started under Trump and is still forging ahead during the Biden years, called Direct Contracting.

So today, I speak with DR. DIANE ARCHER of JustCareUSA.org, who truly explains all you need to know about traditional Medicare and gap insurance, Medicare Advantage, and the new Direct Contracting program. And as I mentioned during the interview, there's an explanation of what it takes to buy a Medicare gap policy after you've been in a Medicare Advantage program. Find that explainer here. But beware, it's not pretty!

For those of us still too young for Medicare, we're still in the open enrollment period for the ACA (or, Obamacare) through healthcare.gov or your state exchange. Biden's pandemic relief bill, the American Rescue Plan, that was passed soon after he tool office really brought down our costs. So if you go to the exchange, you can find good insurance at a very good price.

To be covered on Jan. 1, you must enroll by Dec. 15. Open enrollment runs through Jan. 15...

Before we get to today's guests, there was some big breaking news just as the show was going to air. Steve Bannon was finally indicted Friday on two counts of criminal Contempt of Congress after he defied a congressional subpoena from the House Select Committee investigating the January 6 insurrection at the Capitol.

That was followed by two other interesting news tidbits. Summer Zervos, the former Apprentice contestant who accused Donald Trump of sexual assault and subsequently sued him for defamation after he smeared her, abruptly dropped her case today, while still maintaining the allegations. There has to be more to that story!

And, the week officially ended with the news that Brittany Spears is finally free of the conservatorship that's controlled her life for the past 13 years.

Now for the rest of today's show...I'm based in South Florida, where we have one of the all-time worst Governors ever. Job One is voting Ron DeSantis out of office next November. On a previous BradCast episode, I shared my interviews with the first two Democrats to enter the race against him: Nikki Fried and Charlie Crist. Today, I bring you the third candidate to jump in, FL state senator ANNETTE TADDEO.

The second of today's double-header is a conversation with DAVE ZIRIN, sports editor atThe Nation and host of the Edge of Sports podcast. Today we didn't really talk sports, but Dave's new book, The Kaepernick Effect, which isn't even about Kaepernick himself but, as the title suggests, the effect his activism had on athletes from high school to college to the pros.
