Plenty --- far too much --- to get angry about on today's BradCast. Though we do find a bit of light among the darkness to help kick things off. [Audio link to full show follows this summary.]

FIRST UP... The good news: a federal judge in Indiana has blocked, for now, a law adopted by state Republicans that would have prevented Student IDs from being used as identification for voting purposes. The case to determine the Constitutionality of Indiana's SB10 will continue. But for now, for this year's critical midterm elections, some 40,000 Hoosier students will be able to vote with their IDs, just as they have, without incident, for the past 20 years.

Moreover, what happens in IN regarding Photo ID restrictions on voting doesn't stay in IN. It was a 2008 case out of Marion County, IN which originally opened the door nationally to the use of stricter and stricter, purposely disenfranchising, polling place voter ID laws. Liberal U.S. Supreme Court Justice John Paul Stevens, who wrote the controlling decision, later came to admit that the Court got it wrong. So did the lower District Court Judge who penned the original ruling. So, we'll keep our eyes on this matter. But it is good news for democracy fans for the moment, barring any new surprises from higher courts this year.

In less good news today, Republicans in the U.S. Senate have, for the fourth time, blocked a Democratic resolution to assert Congress's Constitutional power to declare (or prevent) war as Donald Trump's unimaginably ill-considered war in Iran continues. Worse: WaPo reports today that thousands of more ground troops are on now on their way to the region at Trump's command.

THEN... We get to today's really enervating news, though we get there in a way that just might energize you to do something about it!

No matter how the Trump Administration and his U.S. Department of Agriculture Secretary Brooke Rollins are trying to gaslight the public about it, they are, in fact, dismantling the beloved U.S. Forest Service. The plan, officially announced last month, will benefit no one but those who wish to plunder the 193 million acres of our public lands overseen, maintained and protected by the agency for more than 120 years. Despite her rhetoric and lies, Rollins is not clear-cutting the U.S. Forest Service for the good of the American people. The effort is for commercial purposes. To rob Americans of our sacred public lands to the benefit of the extraction industry, from miners to drillers to loggers. And, because it's the Trump Administration naturally, they are doing so unlawfully, the way they do pretty much everything.

We're joined today for a deep dive on all of this by award-winning filmmaker and conservationist JIM PATTIZ of MoreThanJustParks.com. He helped touch off a proverbial five-alarm fire about all of this with his blazing-hot, razor-sharp descriptive demolition of what the Administration is actually hiding under their March 31 announcement that the USDA is moving the Forest Service Headquarters from D.C. to Salt Lake City, Utah, while shuttering dozens of critical research centers around the country in the bargain.

Don't be fooled, Pattiz explains. This is not meant as "a sweeping restructuring of the agency to move leadership closer to the forests and communities it serves," as the USDA claimed in its press release. It is not "a structural reset and a common-sense approach to improve mission delivery." It is, as Pattiz detailed at Hatch Magazine last week, a scheme to relocate the beloved agency to a state which is currently suing the federal government to take over some 18.5 million acres of public lands, "that wants to own them, stripped of its science, stripped of its regional expertise, stripped of its institutional independence, and reorganized into a structure purpose-built for political compliance."

"This is a coordinated demolition of federal land stewardship in America," he warns. "The Forest Service was the last major federal land agency that still had the institutional muscle to resist. It had the scientists. It had the regional foresters. It had the culture, imperfect as it was, that still believed forests belonged to the public. After today, that agency no longer exists."

The USDA and White House itself have come out with both barrels against Pattiz and his fellow public lands supporters, particularly after he demonstrated this week in his newsletter how relocating the Forest Service headquarters from D.C. is in strict violation of federal laws adopted by both parties in Congress regarding fiscal year 2026!

"The White House called it 'lies from these losers," Pattiz tells me. But it is anything but. Pattiz has the receipts. In fact, he also has the goods regarding how it was Trump officials themselves who lied about their intentions to do exactly what they are now doing during their confirmation hearings in the Senate.

"This will affect somewhere in the neighborhood of 5,000 employees," says Pattiz, "of a work force that's already lost a fourth of the Forest Service workforce since Trump started his second term --- a critical agency that does most of the wildland firefighting in the United States --- a fourth of that agency gone. And now you're talking about an additional potentially 5,000 employees."

It's hardly just fire fighters. Scientists will be lost as well, along with decades of institutional knowledge with the move to Utah and the shuddering of regional research offices around the country, to be consolidated into one office in Colorado. Knowledge, research and decades-old, ongoing experiments will be lost that can't necessarily simply be restarted the next time a Democrat returns to power. "When you shutter 57 research stations, that is absolutely a 'kill shot' to our research program, which is the envy of the world," says Pattiz. "It's a kill shot."

And it's all being spearheaded by longtime enemies of public lands, such as Utah's Republican Sen. Mike Lee and a new Forest Service Director who was previously a logging executive --- the first time in the agency's 122-year history that its Director was not selected from among those already serving within it. In response to the new chief, Tom Schultz, citing Teddy Roosevelt, renowned defender of public lands, and Gifford Pinchot, who created what would become the Service, in the USDA's announcement about the move to Utah and the gutting of the Service, Pattiz was incensed.

"It makes my blood boil," he tells me today. "It is the antithesis of what the Forest Service is all about. Theodore Roosevelt made a career out of opposing people like Tom Schultz. It's just absurd to hear this logging executive who has inexplicably been installed as the Forest Service chief using the names of Gifford Pinchot and Theodore Roosevelt, because what they are doing is the anathema of Roosevelt and his legacy."

But it's not over yet. Lawsuits, Pattiz says, are soon to be filed. In the meantime, "the biggest thing people can do is write and call your representatives and senators, and tell them to stick up for the laws that they wrote." The very laws that were adopted on a bipartisan basis, signed by this President, requiring approval from Congress before a massive restructuring (and destruction) of this sort can begin at all. "Contact your representatives. Tell them to hold this Dept. of Agriculture accountable."

My ears are still ringing after the President of the United States spent about 20 minutes barking at me last night. But the show --- in this case, the final BradCast of 2025 --- must go on. [Audio link to full show follows this summary.]

VERY QUICKLY... Some final election results for the year, as a Democratic union leader and U.S. Army veteran won a special election on Tuesday for a state Senate seat in Kentucky in a more than 47-point landslide over his Republican opponent! Gary Clemons won almost 73% of the vote, according to today's unofficial results. Granted, it was in a Democratic leaning area of Louisville, but one where Kamala Harris won by just 6 points last year. So, it amounted to an approximately 42-point shift in favor of Team Blue. In Kentucky. That should help propel the Resistance into the critical mid-term election year of 2026.

THEN... Two of our favorite guests are here today for an end-of-year roundtable, of sorts, as we wrap up a...well...tumultuous year, to put it far too nicely, as we try to make sense of whatever happened last night during Donald Trump's weird, lie-filled, prime-time tirade and a whole bunch of other stuff at year's end.

We're joined once again today by fellow old-school bloggers HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo, and 'DRIFTGLASS' of the Professional Left Podcast.

AP noted last night that Trump has frequently said he believes more Americans would back him if they simply heard him describe his track record. Well, I think everybody heard him last night. Even if they had their TVs off, since the guy was shouting so loud. What he was shouting, however, was mostly a string of ridiculous claims and a whole bunch of numbers, many of which were made up out of whole cloth.

In his mercifully brief, but endlessly angry remarks, he said "at levels never seen before" or "at record levels" at least 7 times; referred to at least 11 different "records" that he claims to have broken over the past year; cited "history" --- as in, "never before in American history" --- at least 12 times; and blamed Joe Biden for most of his own failures at least 7 times.

Whether anybody is more inclined to back him after hearing that "record" --- (new polling out yesterday from PBS/NPR/Marist found his overall support at just 38%, AP/NORC clocked him in at just 36% approval) --- than they were before last night remains to be seen.

"I couldn't guess about his supporters, because I've lost all sense of anything making sense amongst the American electorate," quips an enjoyably cynical Digby today. "These people are crazy. And so is he. I am just looking at this and thought what kind of person watched that gibbering clown last night and thought, 'Wow, that is a great president'?"

"It is clear that Donald Trump has made a career out of lying to people. Now he's just a living sales pitch. But you can't out-shout kitchen table math," argues Driftglass in regard to last night's speech, before somewhat countering himself. "On the other hand, if you've ever read 1984, it's just a matter of telling the rubes what you want them to think. They are so sunk-cost bought-in to Donald Trump, they know if they don't believe it, the whole thing crashes down."

"There's a thing in aeronautics called the Jesus Nut," he continues. "It's this bolt-nut combination that holds the entire helicopter assembly together. Without it, you'd better pray to Jesus because you're going down. Donald Trump is that to them. He is the thing holding it all together. So whatever crazy crap he says, they have to believe it, they have to go along with it, because the alternative is the abyss."

When we move to the topic of whether Republicans are going to accept the Democrats latest attempt to help save them from themselves by extending the Affordable Care Act subsidies that Trump and the GOP cut --- with monthly premiums now set to skyrocket for tens of millions of Americans in the new year --- Digby believes that "Republicans are not coming to their senses."

"I think that the vast majority of the Republican caucus, in both the House and Senate, are happy to let the subsidies expire because they know they are going to lose next fall. They see the writing on the wall. And they figure, 'The one thing we did was we destroyed Obamacare.' That's been on their agenda from the very beginning. If they get nothing else out of this whole mess, they get that. They destroyed Obamacare. They don't care about how many people suffer, because this is their Great White Whale. Or Great Black Whale, I guess, in the case of Obamacare."

Driftglass, who explains that his ACA monthly premiums are set to quadruple next year for him and his wife thanks to the GOP's cuts (from about $700/month this year to more than $2500/month next year!), believes that Trump's own supporters "are going to take a huge hit, but they are going to go look for scapegoats, not solutions. And that is tragic. And it's dangerous."

He is also wistful about what has happened over the past year. "This country is now a different country than it was in 2024," he observes. "We have become a different place. We've lost our innocence. This happened after the Viet Nam War, the Civil Rights Movement. Fundamentally, this country has changed in ways we do not understand yet. And whatever happens after Trump, it is going to be a different place than you and I grew up in. And part of that is that there is now a solid block of 36% of the American public who are just insane."

We have much more insanity to try and make sense of on today's program. From the house of cards that Speaker Mike Johnson is barely hanging on to; to the release of the Epstein Files that, by law, is supposed to happen tomorrow (both Digby and Drifty are dubious, to say the least); to why it is that Indiana Republicans actually stood up to Trump's threats and refused to gerrymander their U.S. House map; to what could possibly reverse Trump's seemingly quickly sinking fortunes (and health) next year.

FINALLY... Desi Doyen helps us close out the show with our final 'Green News Report' for 2025, at the end of a program that hopefully gives you lots to chew on, worry about, think about, plan for, fight for or laugh about until we return in 2026...

It's difficult to fathom. But, we've got hard evidence on today's BradCast that Congress was actually in session today. Both chambers! Doing oversight. Holding votes and stuff! And, when it comes to the Republicans who control those chambers, natch, voting against the best interests of their own constituents. All of that, as Trump continued to lose one battle after another today --- in the courts and even in the state Senate of a very Republican state. [Audio link to full show follows this summary.]

There was also quite a bit of breaking news both right before and during today's hour. Among the stuff we covered...

• Just before airtime, news broke that yet another federal grand jury has, for a second time, rejected an attempt by the Trump Administration's corrupt Dept. of Justice to revenge indict New York Attorney General Letitia James. If you're keeping score at home, that's one indictment tossed out by a federal judge, followed by two attempted indictments rejected by two different grand juries, against the woman who successfully held Donald Trump to account actual fraud to the tune of hundreds of millions of dollars in both criminal and civil court last year.

• Also just before airtime, Republican lawmakers in the Indiana state Senate voted to reject a new U.S. House map that would have gerrymandered the Hoosier State's two remaining Democratic seats out of existence, defying Trump's orders, death threats from his supporters, threats to primary those Senators next year, and even his last minute message that he would cut off all federal funding to the state if they didn't obey! To their credit, the state Republicans did not!

• A federal judge on Thursday found that Kilmar Abrego Garcia was being held unlawfully held by ICE in immigration detention and ordered that he be freed immediately. Despite foot-stomping and promises by Trump's DoJ to appeal, Abrego Garcia was released before today's show ended. He is, of course, the Maryland resident, father and Salvadoran national who was wrongfully deported back to El Salvador earlier this year, before being ordered to be brought back to the U.S. by a federal judge. DoJ then indicted him on seemingly trumped-up charges, which he still faces, and ICE unlawfully tossed him into detention. Until today.

• Speaking of immigration, Dept. of Homeland Security chief Kristi Noem embarrassed herself and the Administration under questioning from Democrats in the U.S. House Homeland Security Committee on Thursday. We share some of the sharp questioning for DHS Barbie from Democratic Reps. Dan Goldman (NY) and Seth Magaziner (RI). Also testifying today was FBI Director of Operations Michael Glasheen who similarly embarrassed himself and the Administration when trying (and failing) to explain to the Committee's Democratic Ranking Member, Bennie Thompson (MS), why the non-existent "Antifa" organization is now absurdly regarded by the Bureau to be the nation's top domestic terror threat.

• Over in the U.S. Senate, Republicans blocked a Democratic bill to restore premium subsidies for more than 20 million Americans who receive access to health care via the Affordable Care Act (ACA, or Obamacare). Monthly premiums are now almost certain to skyrocket for millions at years end, leaving many Americans without health care at all. Four Republicans joined the Democrats' attempt to restore the massive GOP cuts, but it wasn't enough to overcome a Republican filibuster. For their part, a ridiculous Republican bill to give Americans about $1,000 per year in a so-called Health Savings Account to somehow cover health care needs, went down in flames. Several pending discharge petitions in the House may force votes next week on the matter in the lower GOP-controlled chamber.

• "Catastrophic" flooding is forcing evacuations for as many as 100,000 residents in the Pacific Northwest over the next several days, following as much as 18 inches of rain over the past 72 hours in some areas. The Skagit River in Washington, which reaches major flood stage at 32 feet, is now expected to crest at a record 47 feet! All consequences of the climate change disaster which most Republicans pretend is not happening, and pretend to not be caused by the man-made burning of fossil fuels.

• With increasingly dangerous floods, droughts, storms, fires, etc., it is disappointing to learn that Zillow, the nation's largest real estate listing site, is removing a feature, added just last year, that allowed home buyers to learn about a property's exposure to the climate crisis. Making climate risk data more difficult to find and use, does not make its reality disappear, however. "The risk doesn't go away," says Matthew Eby, founder of the non-profit financial climate risk modeling site, First Street, which supplied the scientific data previously used for the Zillow feature. "It just moves from a pre-purchase decision into a post-purchase liability." Good luck, home buyers!

It's no easy feat getting caught up on The BradCast after just one week off during the madness of the Trump Era. But, hey, nobody said fighting to save democracy amid an attempted authoritarian takeover by a crazy, brain-poisoned, power-mad, criminal cretin was going to be easy. With far more to cover than we had time to catch up with, we did our level best today and took a bunch of great callers to boot! But that requires focusing on the stuff that really matters and, well, putting off the rest for another day, if ever. And the stuff that really really counts right now, in my opinion, remains the fight for democracy and voting itself.

To that end --- and many others --- we covered quite a bit of ground in very short order today. Among the many stories we touched on before opening the phones to our first post-Thanksgiving callers...

• Today, a federal appeals court unanimously upheld a lower court ruling finding that Alina Habba, Donald Trump's personal criminal defense lawyer turned U.S. Attorney in New Jersey, was unlawfully appointed.

• That ruling follows on last week's court ruling that Lindsey Halligan, Trump's even more unqualified personal insurance lawyer turned U.S. Attorney in Virginia, was also illegally appointed. That ruling subsequently resulted in the dismissal of Halligan's absurdly corrupt criminal indictments against Trump's foes, former FBI Director James Comey and New York Attorney General Letitia James.

• Trump's belligerent, unqualified Defense Secretary and former weekend Fox "News" host, Pete Hegseth, may be in very big trouble for reportedly issuing unlawful orders to "kill everyone" in the Administration's first unlawful attack on supposed drug runners in boats in international waters off of Venezuela in the Caribbean. (More on that, I suspect, in the days ahead.)

• A quick catch-up on the various battles in the Gerrymandering Wars since we left --- in Texas, Indiana and North Carolina.

• Following the shock resignation of former(?) MAGA stalwart Marjorie Taylor Greene a week or so ago, Punchbowl News reported that a senior Congressional Republican is warning that the House GOP is "a tinder box." That "morale has never been lower" and that Republican House Speaker "Mike Johnson will be stripped of his gavel and they will lose the majority before this term is out." We'll see about that. But it's anything but inconceivable, at this point.

• Speaking of, in tomorrow's Special Election for the U.S. House in Tennessee's 7th Congressional District, progressive Democrat Aftyn Behn was said to be within two points of Republican Matt Van Epps, according to new polling last week, in a District won last year by Trump by a whopping 22 points! I wonder why morale is so low among Republicans in the House these days.

• Never mind polling. Let's look at some actual numbers following Democrats' rout of Republicans in the November off-year elections last month. A deep dive by Politico into 268 county, town and village executive seat races last month in New York --- including in deep red counties, towns and villages --- found that Dems out-performed 2017's "blue wave" election in the state, flipping, for example, more than 50 executive seats from "red" to "blue" last month. That, compared to the GOP flipping just one (1!) seat from "blue" to "red" on the same day.

• Another appeals court panel ruling while we were off --- this one from judges nominated by both George W. Bush and Donald Trump --- upheld a lower court ruling finding that a ridiculously frivolous lawsuit filed by Trump and Habba against Hillary Clinton and James Comey, claiming they tried to steal the 2016 election (or something), will, in fact, result in a one million dollar fine against the pair.

Things are not going well for the President of the United States. As revealed by the mostly breaking news stories covered on today's BradCast, today may be seen as one of the worst days he has ever had. Here's hoping for more such days. [Audio link to full show follows below this summary.]

• Tuesday began pleasantly enough, with Donald Trump offering Saudi Arabia's crown prince a royal welcome to the White House in advance of a black tie dinner, despite the fact that the CIA determined that Mohammed bin Salman likely personally approved the 2018 bone saw murder of Washington Post journalist and U.S. resident Jamal Khashoggi. After the regal parade of Saudi and U.S. flag-draped black horses and a rare flyover by six U.S. fighter jets to celebrate the arrival of the killer prince and major Trump Family business partner, Trump berated a reporter for daring to ask about the murder. He claimed, appallingly, that "a lot of people didn't like" Khashoggi anyway, that bin Salman "knew nothing about it", and, even if he did, hey, "things happen."

• Around the same time, on the other end of Pennsylvania Ave., victims of Trump's longtime best friend and convicted pedophile, the late Jeffrey Epstein, were rallying on the steps of the U.S. Capitol with the lead, bi-partisan co-sponsors of a bill mandating the Dept. of Justice release the "Epstein Files". One of the survivors, a Trump voter who was introduced to Epstein when she was just 14 years old, described the President as a "national embarrassment". The bill was finally to be voted on today, after months of attempted obstruction by both Trump and supposedly very Christian Republican Speaker of the House Mike Johnson. Today's vote happened only thanks to a Discharge Petition signed by a majority of House members (all Democrats, 4 Republicans) demanding it. Despite Trump's months of cover-up, blocking the DOJ from releasing the files that he could have ordered released in full at any time, the four sentence legislation was adopted nearly unanimously by the U.S. House in a 427 to 1 vote. Apparently, nobody other than Rep. Clay Higgins (R-LA) wanted to be regarded as having voted to protect pedophiles.

• Within hours, remarkably, the U.S. Senate, without debate, adopted the same bill by another veto-proof margin. The measure was passed by unanimous consent before heading to Donald Trump's desk for his signature. You think he'll hold one of his big signing ceremonies to do it?

• With all of that seemingly very good news, we echo the caveat I offered on yesterday's show. A provision in the legislation (the third of four sentences) allows the DOJ to "withhold certain information" including "materials that would jeopardize an active federal investigation." As luck would have it, just last week, months after Trump's DOJ declared there was nothing left to investigate in the Epstein matter, and days before Trump would pretend to flip-flop to favor the bill, he asked his corrupt Attorney General Pam Bondi to open an investigation into the involvement of his political foes with Epstein. She complied within hours, of course. On Sunday, Republican co-sponsor of the Discharge Petition in the House, Rep. Thomas Massie (R-LA), warned the new investigations might prevent the DOJ release of the files. Today, before the vote, at the presser on the steps of the U.S. Capitol, Rep. Marjorie Taylor Greene (R-GA) --- who deserves credit for taking on the President by keeping her name on the Petition --- warned same. That, after Trump's pretend change of heart on Sunday calling for the release of the files by instructing Republicans to vote for the bill so that lawmakers "can have whatever they are legally entitled to". The latter part of that phrase, observed David Kurtz today, is "doing a lot of work there."

• As rare as successful Discharge Petitions are in forcing votes on bills that the House Speaker refuses to bring to the floor, it happened yet again on Monday! A majority of House members, with the help of a few swing district Republicans signed on to force a vote --- within seven days, as required by House rules --- on a bill that would roll back Trump's Executive Orders earlier this year blocking collective bargaining rights for most federal workers.

• But things got even worse for Trump as today wore on. This time on the Gerrymandering Wars front. A three-judge federal appeals court panel in Texas blocked the new Trump-ordered gerrymander of the state's already gerrymandered U.S. House map, finding it to be an unlawful and unconstitutional racial gerrymander. Following a ten day hearing, the 2 to 1 ruling by the court panel, written by a Trump-appointed federal judge, blocked the new map from going into effect for the 2026 election --- at least for now. The new map was written by the GOP state Legislature to flip five, largely minority House seats from "blue" to "red" next year. It resulted in California voters recently adopting a new map, in an overwhelming statewide vote, to flip the same number of seats from "red" to "blue" in response. That map --- and perhaps a similar one now in the works by Democrats in Virginia --- will stay in place next year, unless otherwise blocked by a court for some reason. Texas' Republican Governor Greg Abbott vowed to appeal today's ruling to his friends on the corrupted U.S. Supreme Court.

• The ruling in the Lone Star State comes on the heels of the decision late last week by the Republican leaders of the Indiana state Legislature, to not redistrict the state's already very red U.S. House map in a Special Session this year, despite heavy pressure from Trump and Vice President J.D. Vance. The decision resulted in social media threats by Trump against both men, and a swatting attack against one of them. Despite that dangerous situation just hours after Trump's initial threat --- and his laughable opposition to political violence --- he issued another similar one against Republican lawmakers in the Hoosier State on Sunday.

• Finally, also not great news for Trump in today's Green News Report with Desi Doyen, as Trump's joke of a FEMA Director is pushed out after just six months; the U.N. climate summit under way in Brazil (which the U.S. sent no representatives to) declares it will finally be taking on climate disinformation by the fossil fuel industry and its supporters (like Trump); and that, speaking of, new documents reveal Exxon has been quietly funding climate denial and disinformation campaigns across Latin American for years...

As noted, it was a terrible, horrible, no good, very bad day for Donald Trump, which is generally a very good day for the rest of us, as described with much more context, detail, insight, color, sound and special effects on today's program. I hope you'll tune in...

It may not be the most pressing issue many are focusing on right now. But, as discussed on today's BradCast, the Administration's burgeoning attempts to officially whitewash American history is very much of a piece with all of the other authoritarian tactics and policies emanating from this White House. [Audio link to full show follows below this summary.]

Last week, a Florida insurance attorney turned White House Special Asst. to the President, Lindsey Halligan, penned a rather menacing and certainly unprecedented letter to the head of the Smithsonian Institution, the beloved, 179-year old historical organization established by Congress in 1846 (fifteen years prior to the Civil War), as an independent agency led by a Secretary and a bipartisan Board of Regents.

Halligan's letter, citing Donald Trump's March Executive Order titled "Restoring Truth and Sanity to American History", serves to notify the Smithsonian's Secretary that the White House intends to carry out a "comprehensive internal review of selected Smithsonian museums and exhibitions...to ensure alignment with the President's directive to celebrate American exceptionalism, remove divisive or partisan narratives, and restore confidence in our shared cultural institutions."

Two days later, the 118-year old Organization of American Historians (OHA) penned their own scathing response, calling out what they describe as an "unacceptable instance of ongoing executive overreach, striking at the independence of one of our nation's preeminent historical and cultural institutions." They characterize the White House's stated intentions as "the opposite of a fulsome presentation of the history of the United States" and "in service of authoritarian control over the national narrative, collective memory, and national collections."

Over the weekend, Willamette University historian, award-winning author SETH COTLAR, whose newsletter is called Rightlandia, drew attention in a Bluesky thread to a reference in Halligan's letter focused on what she describes as "Americanism --- the principles, and progress that define our nation".

But that phrase, "Americanism", as Cotlar, who joins us on today's program, explains, has its own troubling history.

"The beauty of it for those who are using it is that is so vague. How could an American be opposed to 'Americanism'?," he asks rhetorically. "What things that would be at the Smithsonian would be operating against 'Americanism'? It's a very undefined thing, which is typical of an authoritarian regime, where they get to decide what it is."

And that, of course, is only the beginning of Cotlar's concerns, given that the phrase "Americanism" has historically been "used by the far right in the U.S. in order to push illiberal, I would argue often fascistic, visions of the nation. Usually racist, often antisemitic."

"The term," Cotlar tells me, "has functioned very effectively as tool of radicalization" going back at least to WWI, throughout the national rise of the KKK in the 1920s, into the anti-Communist McCarthy era in the 50s and 60s, and beyond...right into Trump's White House.

It has "functioned very effectively as tool of radicalization. It would be a way to foster a sense of 'This is what it means to be an American'. It means to be white and Christian, and people who are not white and Christian are somehow not quite as truly American as anybody else."

The phrase "America First," which Trump has used throughout all of his Presidential campaigns, has a similarly troubling history that Trump may or may not know about himself. (He doesn't know much, after all, about history.) But "the people in Trump's movement who do know this history are very aware of what the term 'America First' means, and its genealogy," argues Cotlar.

He goes on to detail how the Administration's unprecedented attempt to push aside actual historians to take control of the Smithsonian is ultimately the "history piece" of Trump's broad and radical "nationalistic" agenda, meant to "restore some nostalgic vision of some idyllic past." He describes the effort as a "weirdly Stalinesque, Orwellian effort to just obliterate parts of the actual historical record."

The amount of news we need to catch up with today before getting to some callers at the back end of the show is ridiculous, even by BradCast standards! [Audio link to full show follows below this summary.]

Natural disasters, lots of court rulings and some important election news out of several states on today's program. Here are summaries and links to just some of those stories...

• More than 2,000 are dead in Myanmar following a 7.7 Magnitude earthquake over the weekend. The death toll is expected to rise sharply, thousands of building have reportedly collapsed, health officials are said to be "overwhelmed" and, though Trump vowed to send help, apparently U.S. aid workers are nowhere to be found as they have been in the past. Aid workers from China, Russia and India are on the scene, however. Also, victims received little help or critical information from Radio Free Asia either, in the wake of Trump having shut down the U.S. Agency for Global Media (USAGM), the parent agency for RFA, Voice of America and its international sister networks.

• But there was a lot of good news out of federal district courts since we last spoke, including for Voice of America and, presumably, Radio Free Asia. A judge issued a temporary restraining order to prevent Trump from violating federal law by shuttering the USAGM and the networks it oversees. The U.S. District Court judge ordered about 1,200 journalists, engineers and other staffers back to work, for now, after they were placed on leave or fired after Trump's seemingly unlawful order to shut it all down two weeks ago.

• More good news late last week from the U.S. District court for the Consumer Financial Protection Bureau (CFPB). A judge on Friday ordered that it too be reopened and its workers rehired, after Trump/Musk attempted to gut the only federal agency that fights for consumer rights against fraud and deceptive practices by big banks, insurance companies and sleazy payday lenders.

• Another U.S. District Court on Friday temporarily blocked the Trump Administration from deporting migrants to countries from which they did not originally come without allowing a court challenge first.

• Over the weekend, two different federal judges --- both appointed by Republican President George W. Bush --- blocked the key parts of Trump's outrageous Executive Orders unconstitutionally targeting two major law firms he doesn't like (because they represented former Republican FBI Director Robert Mueller, who was tapped to investigate interference by Russia in our 2016 election during Trump's first term.)

• In Election News, Republicans took a pounding over the weekend in Louisiana's Saturday elections. All four constitutional Amendments placed on the ballot by the state's Trump-lovin' GOP Governor, Jeff Landry, went down in flames. Each lost resoundingly, with nearly two-thirds of voters rejecting each ballot issue, as turnout nearly doubled what state election officials had been expecting. For some reason, voters --- even in Republican-leaning states --- seem to be very angry of late. At Republicans. Landry tried to blame a billionaire who had nothing to do with Saturday's referendum for his embarrassing shutout, while ignoring the Republican billionaires who fruitlessly dumped billions in support of Landry's four losing amendments.

• Speaking of...it's Election Day on Tuesday in Florida and Wisconsin (and a number of other states), with two vacant U.S. House seats up for grabs in traditionally very red districts in the Sunshine State and ideological control of the state Supreme Court on the line in the Badger State. Republicans seem very concerned about all of those contests, with the President's billionaire top-funder, Elon Musk, generously spreading his "free speech" around in the form of $100 checks to Wisconsinites who signed his petition against "activist judges" and two $1 million checks given away to two lucky voters/signers-of-his-petition who showed up to his rally in Green Bay on Sunday. The richest-man-in-the-world stumped for the very Trumpy Republican state Supreme Court candidate Brad Schimel, who is running against Judge Susan Crawford. She is supported by the state's Democrats. For reasons discussed on today's show, that election could hardly be more important --- to the nation, in fact. The House contests down in Florida, meanwhile, may also prove to be bellwethers for GOP electoral chances in upcoming off-year and mid-year elections under a very unpopular President.

It's our last BradCast before time off for travel over the holiday next week. Unlike years past, it looks like SCOTUS will be late in releasing all of their opinions for this term before its normal end this week, so we won't be here to comment immediately on some of the biggest decisions (or on tonight's Presidential Debate) until after our return. But we've got plenty to cover from the corrupted rightwing Court already this week, including with a guest today who suggests the analysis by many legal experts on yesterday's ruling striking down yet another part of federal public corruption law has been somewhat misleading. [Audio link to full show follows this summary.]

Among the big SCOTUS decisions still to come, is a case regarding the "Chevron Doctrine" which, for decades, has given legal deference to federal agency experts over judges or corporate challengers, when it comes to the interpretation of federal laws through rules and regulations promulgated by those federal agencies. That could all be about to change, with enormous consequences first for the EPA, but also across the entirety of the federal government --- or, the so-called "Administrative State" as rightwingers have taken to deriding it. We explain the doctrine and some remarkable ironies behind the Court's upcoming ruling, whatever it may be, today.

But the corrupted, stolen and packed rightwing Supreme Court did manage to issue several rulings today. Among them....

• The Court rejected a multi-billion dollar nationwide opioid settlement with OxyContin maker Purdue Pharma and its owners, the Sackler family.
• In a clear win for corporate interests, they gutted the SEC's ability to carry out in-house proceedings on civil fraud complaints, requiring federal jury trials instead in an opinion likely to have far-reaching effects on other regulatory agencies as well.
• SCOTUS also kicked a Presidential election year hot potato down the road for another day by allowing Idaho hospitals, for now, to perform emergency abortions under federal law, even though the procedure is barred under state law.
• And, as we also discuss with Desi, the High Court blocked, for now, to the EPA's "Good Neighbor" rule which limited air pollution from power plants and other facilities that pollute downwind states. While the regulation has already substantially lowered pollution --- and saved lives --- in the states where it is in place, the Court prevented the EPA from enforcing it until after lower court challenges by largely Republican-controlled states and several industries are completed.

NEXT... On yesterday's show we critically covered the Wednesday SCOTUS ruling in Snyder v. U.S. [PDF], an opinion which overturned the conviction and 21-month prison sentence of an Indiana Mayor who received a $13,000 check from a company just two weeks after his city had granted them a contract worth more than a million dollars. The Court's rightwingers determined that the federal statute in question only applies to out-and-out bribery cases, where a quid pro quo was agreed upon before a public action. After-the-fact "gratuities", the Court's six Republican-appointees ruled, are apparently just fine. Or, at least, not unlawful under their reading of the federal statute in question.

While many legal analysts and experts have derided the ruling since it was issued on Wednesday, our guest today, RANDALL D. ELIASON, former chief of the Fraud and Public Corruption Section at the U.S. Attorney's Office in D.C., now a white-collar criminal law professor at George Washington University Law School, had a different take that he posted to Twitter yesterday: "I have no problem with the Snyder decision, that 18 USC §666 covers only bribes and not gratuities. I think that makes sense."

Really? Why? Today Eliason joins us to explain why the law --- which, as Justice Ketanji Brown Jackson notes in her dissent with the Court's other liberals, "imposes federal criminal penalties on agents of those entities who 'corruptly' solicit, accept, or agree to accept payments 'intending to be influenced or rewarded'" --- can arguably be interpreted as applying onlyto before-the-fact bribes, as opposed to after-the-fact "gratuities", as they are described by the Court's majority.

"I'm not happy about the outcome," Eliason concedes today. "You're right that there's been a pattern of decisions over the last more than a decade narrowing public corruption laws, and I've been critical of a lot of them. And I've been on your program being critical of a number of them in the past."

"So I'm not happy about the outcome. But I don't think the majority is being unreasonable in this particular decision. Because what this decision is about is not whether the conduct of the Mayor is a good thing, or whether it should be prohibited. It's just about the language in this particular criminal statute that Congress drafted. And it's really a badly drafted statute. It's poorly written. It's confusing. And even though the lower court in this case had upheld his conviction, several other federal courts of appeals had said the same thing, that this law does not apply to gratuities, and agreed with Snyder."

He explains that there is "a real legal distinction between a bribery and a gratuity", and that other federal statutes prohibit them both. But in this case, §666 is less than perfectly clear. And, when there is a "tie" in legal interpretation, the tie is supposed to go to the defendant who, the Court noted, can still be held accountable for accepting a gratuity under state and local laws.

"You see a lot of headlines in the wake of this decision: 'Supreme Court says bribery is okay.' No, the whole point was it wasn't bribery. It was a gratuity, which is something far less serious. And the issue was does this particular statute cover this kind of gratuity? The answer is no. I think, based on the way that statute is written, it's a reasonable outcome."

While I'm not sure I fully agree --- and even he notes that Justice Jackson makes several good arguments in her dissent --- Eliason's expertise and insight into the laws in question shed welcome light on this otherwise seemingly corrupt ruling.

On a related note, we also discuss how all of this might apply to the arguable millions of dollars in "gratuities" that members of SCOTUS, like Clarence Thomas, have accepted over the years and whether that might play into the Court majority's opinion. And how Congress, had they not become completely dysfunctional in recent years, could easily clarify this issue through simple legislation.

On one other matter before we finish our conversation with Eliason today, he offers his thoughts on SCOTUS' upcoming Fischer decision regarding whether the statute used to charge hundreds of January 6 defendants --- including Donald Trump --- with "obstruction of an official proceeding" may be struck down by the Court. Eliason is "pessimistic" about what is likely to happen, though believes that even if the Court strikes it down for use against many of those charged for the J6 insurrection, that "there's a good chance that the charges against Trump would still survive."

Once again, on today's BradCast, we've got a mid-week "ketchup" for you, with everything you need to know about the disgraced former President's still-ongoing, first criminal trial. And it's been a very big week in that regard. [Audio link to full show follows this summary.]

But, first up today, interesting results out of Indiana on Tuesday, where the "zombie campaign" of Nikki Haley, who quit the race two months ago, still racked up nearly 22% of the vote in the Republican Presidential Primary against Donald Trump. (Joe Biden ran uncontested on the Democratic side.)

Next week's primaries will be in Nebraska, Maryland and West Virginia, where former coal baron and federally convicted criminal Don Blankenship --- a hard-right loon --- has decided to run in the Democratic primary to fill the U.S. Senate seat being vacated by rightwing Democrat Joe Manchin. Blankenship lost as the Republican nominee against Manchin in 2018. This year, as a "Democrat", he'll be running next week in WV against staunch pro-union candidate Glenn Elliot and Marine Corp vet and grassroots organizer Zach Shrewsbury. The winner will likely be taking on current Governor and coal baron billionaire Jim Justice who ran for Governor as a Democrat in 2016 before flipping to Republican in 2017 just after he was elected.

Then, it's on to today's coverage of the past week's criminal Trump Trial in New York, where the former (and future?) President faces 34 felony charges related to hush-money payments made to porn star Stormy Daniels to help him win the 2016 Presidential election. Daniels was called by the Prosecution for testimony on Tuesday and, as you likely know by now, it was a bit of a blockbuster.

Even Joe Biden is now making jokes about the plummeting value of the former President's latest scam, his attempt to turn his failing social media site into a Wall Street meme stock. As discussed on today's BradCast, it ain't working. At least for now. [Audio link to full show follows this summary.]

The value of Trump Media & Technology Group, trading under Donald Trump's initials as DJT, has lost about two-thirds of its value since it debuted as a publicly traded stock at the beginning of the month. If it "drops any lower," Biden quipped at a rally in Pennsylvania today, Donald Trump "might do better under my tax plan than his."

When it first went public, DJT quickly shot up to nearly $80 per share. It has been nose-diving by double-digit percentages pretty much every day since. The stock closed on Tuesday at less than $23 a share. On Monday night, the Washington Post's Drew Harwell posted a piece that is nearly equal parts hilarious, for those who enjoy the schadenfreude of Trump losing billions of theoretical dollars in just a few weeks time, and heart-breaking, for those who feel for the hundreds of thousands of Trump fans who have lost, in some cases, their "whole nest egg" because they were brain-poisoned enough to buy into Trump's latest fraudulent scheme.

Harwell's report of the reaction to the plummeting value of the stock by Trump supporters themselves on Truth Social, the money-losing venture that is currently DJT's only actual business, is harrowing and amazing. (But just more evidence of the "deep state", if you believe some of the denialists who are still buying more shares every day now!) But it serves as yet another reminder that, as sick as Trump is, it is our nation itself, and its people, whose illness we must eventually figure out how to attend to.

Then again, there is no evidence that the Founders wanting anything of the sort (quite the opposite, in fact); every President of the United States before (and since) Trump has been able to function just fine without it; and --- oh, yeah --- as Trump said in a separate rant just one day earlier, apparently "Crooked Joe Biden...can't put two-sentences together" but has been clever enough to mastermind all four of Trump's current criminal indictments in two different states and two separate federal jurisdictions, all without leaving a trace of evidence. "At what point are the actions of a sitting President...against his opponent for election interference considered illegal?," Trump asked. But, according to Trump just one day earlier, even if the President had anything to do with Trump's criminal indictments (he doesn't) it would still never be illegal!

• The disgraced former President's criminal trial in New York, on 34 federal counts related to hush-money payments to a porn star to help him win the 2016 election, seems to be moving faster than expected. On Tuesday, seven jurors were selected on the second day of the trial. Just five more jurors and six alternates are needed before opening statements can begin, perhaps as early as the beginning of next week.

• On Tuesday, House GOP lawmakers finally delivered their two articles of impeachment against Dept. of Homeland Security Secretary Alejandro Mayorkas to the U.S. Senate, where the high-crime-and misdemeanor-free charges are expected to die either very quickly or somewhat less quickly, in an impeachment trial that, according to the rules, must begin immediately and continue until complete. Good thing there is nothing else Congress needs to be doing right now.

• The far-right conspiracy outlet known as One American News (OAN) has reportedly struck a confidential settlement with voting system vendor Smartmatic, in the defamation lawsuit brought against the Trump-supporting TV channel for lies told about the company's voting systems following the 2020 election. Despite repeated false claims by OAN anchors and guests that Smartmatic software was used "in 30 states" to steal the election for Biden --- with zero evidence in support of those claims --- the company's voting systems are only used in one U.S. jurisdiction: here in Los Angeles County, where even brain-poisoned MAGA dupes aren't dumb enough to claim the election was stolen from Trump.

  For the role that we personally played in confusing Sidney Powell, Rudy Giuliani, and the OAN clowns regarding Smartmatic's role in U.S. elections, I can only say: "You're welcome!"

  The terms of the settlement are undisclosed, but it follows on last year's $787 million settlement between Fox "News" and Dominion Voting Systems over similarly false claims, as well as a settlement between OAN and a former Dominion executive. There are many other similar defamation suits still pending, however, by both Smartmatic and Dominion over lies told about them following 2020 by other well-known Trump conspiracists.

We begin again on today's BradCast with the latest developments in what AP is now calling the latest Israel-Palestinian war, before catching up with a number of political and climate related issues here at home. [Audio link to full show follows below this summary.]

ISRAEL v. HAMAS:

• On Monday, the leaders of France, Germany, Italy, the U.K., and the U.S. issued an unusual joint statement condemning the "terrorist actions of Hamas" over the weekend, declaring "steadfast and united support to the State of Israel" and recognizing "the legitimate aspirations of the Palestinian people".

• Today, an at-times visibly angry President Biden expressed similar sentiments, decried the weekend's "atrocity on a appalling scale"; warned against adversaries both at home and abroad who might be tempted to take advantage of the situation for political violence; vowed to help secure the release of American hostages around the world; declared this "a moment for the United States to come together, to grieve with those who are mourning"; promised to uphold the "laws of war", and reiterated that the U.S. "stands with Israel" while condemning the "indiscriminate evil" of the weekend's attack. He also confirmed that 14 Americans are now confirmed to have been killed as a result of Saturday's surprise assault by Hamas.

• Beyond that, we cover the latest, including escalating death tolls, with at least 1,000 dead in Israel, and at least 800 dead in Gaza, as Israel continues its fourth day of pounding neighborhood after neighborhood in the Gaza Strip with air strikes. More than 200,000 Palestinians have reportedly fled their homes for U.N. shelters, as deliveries of food, fuel, water, electricity, medicine and other supplies to Gaza have been cut off by Israel, as hospitals are said to be running out of supplies, surgical equipment and antibiotics.

• Back home in Congress, the U.S. House remains crippled thanks to Republicans having removed their own House Speaker last week. Given our recent history and the current situation in the Middle East, that might not actually be a terrible thing.

2004 MISCELLANY:

• On Friday, the Wisconsin Supreme Court, after a 4 to 3 vote, scheduled a hearing next week on a voter petition to draw fair legislative maps for the state Senate and Assembly, for the first time in more than a decade. Justice Janet Protasiewicz, whose recent election gave liberals a majority on the High Court for the first time in 15 years, has decided to not recuse herself from the case, even as GOP Assembly Speaker Robin Vos' threat to impeach her if she did so has shown no sign of materializing yet.

• Out here in California, 74-year old former L.A. Dodgers All-Star Steve Garvey announced today that he will be running as a Republican next year to fill the seat held by Dianne Feinstein, who recently passed away. He will be vying for one of the two spots up for grabs in next year's March Primary, in hopes of going on to compete in the November general election. He will have to face off with at least three Democratic all-stars hoping to become the state's new Senator, including Congressmembers Barbara Lee, Katie Porter and Adam Schiff --- and potentially against Laphonza Butler should she decide to run, after having been tapped by Gov. Gavin Newsom to fill the rest of Feinstein's term.

• Robert F. Kennedy, Jr., with much support from Republicans, announced on Monday that he plans to drop out of his Democratic primary bid and run for President as an independent next year. In theory, he will join Cornel West who plans to do the same after leaving the Green Party, and a potential candidate put up for 2024 by the right-leaning "centrist" group calling itself No Labels.

LATE-BREAKING AND FINALLY:

• Republican Rep. George Santos (NY), already facing 13 federal campaign finance-related charges, now faces an additional 10 related to identify theft for stealing donor credit cards to make unauthorized charges.

• Hurricane Lidia spun up quickly before airtime to become a major Category 3 storm as it headed toward landfall on Mexico's Pacific coast near Puerto Vallarta. (Since we've gotten off air, Lidia has spun up even more, making landfall as a Cat 4 with 140 mph winds!) It is the second tropical storm to slam the Pacific coast in two days, following landfall by Max on Monday.

Last week, a U.S. District Court judge in the Southern District of Florida issued an important preliminary injunction [PDF] to a cruel state measure blocking medical treatment for transgender kids.

Relying upon medical science and a U.S. 8th Circuit Court of Appeal decision handed-down last year, Judge Robert Hinkle temporarily enjoined provisions of a Republican-engineered state statute and rules issued by state medical boards to enforce it, which make it a crime and grounds for terminating a license to practice medicine, for physicians who furnish minors (under 18) with gender-affirming care.

In his 44-page ruling, Judge Hinkle found that the plaintiffs (adolescent transgender children and their parents) were likely to succeed in their claims that the state's new restriction on gender-affirming care violates the Due Process and Equal Protection Clauses of the 14th Amendment to the U.S. Constitution. Allowing the law to take effect, he explained, was likely to cause "irreparable harm" to the child plaintiffs...
