On today's BradCast, Trump-induced chaos continues to worsen, from China to the U.S. Congress, and the fights over 2018 and 2019 elections continue in Georgia and North Carolina, while a court ruling in Florida will make things a bit easier for voters in 2020. [Audio link to show follows below.]

First up today, Donald Trump sends world markets --- including the Dow, which dropped more than 600 points on Monday --- plummeting, after China announces plans to respond to Trump's newest 25% tariff on $200 billion in Chinese goods on Friday. Today China announced they plan to institute retaliatory tariffs on some $60 billion in U.S. exports and may cut off sales from certain companies entirely. So, Americans are left paying exorbitant new import taxes (tariffs on Chinese goods imported to the U.S. are taxes paid by U.S. companies and consumers, they are NOT paid by China, as Trump keeps falsely asserting), and now financial markets are taking an additional hit. Experts worry the dispute could soon nudge the economy into recession if a trade deal is not brokered. Trump has since threatened to add new taxes on all goods made in China if they refuse to kowtow to his demands.

At the same time as Trump is playing out his ill-considered foreign trade war, he is also expanding his domestic war against Constitutionally-mandated oversight by the Legislative Branch. A weekend analysis by the Washington Post finds Trump and his allies are now blocking more than 20 separate Congressional investigations "into his actions as president, his personal finances and his administration's policies" in what experts --- and even former Republican Congress members and legal staffers --- cite as a deepening crisis of unprecedented proportions between the two co-equal branches.

From Florida, however, we have a bit of good news from a federal court, where a judge has ruled that the state must follow the Voting Rights Act by supplying election materials and assistance for Spanish-speaking voters in advance of the 2020 primaries. The ruling is key for the tens of thousands of new Spanish-speaking Florida voters who moved to the Sunshine State from Puerto Rico following the devastation of 2017's Hurricane Maria.

In North Carolina on Tuesday, Republicans voters in the state's 9th Congressional District will select their nominee to run against Democrat Dan McCready in a do-over general election scheduled for this fall, after the state refused to certify a winner from last November's contest following the revelation that the Republican candidate (and Baptist minister), Mark Harris, was found to have hired a GOP contractor who carried out a massive absentee ballot fraud scheme on his behalf. In February, after some remarkable testimony, the state scheduled a new election. Tuesday's GOP primary in NC promises to be a bit of a circus with 10 --- um, colorful --- Republicans running for the nod. If none of receive more than 30% of the vote, there will be a runoff in September, with the general election then pushed back to November. The U.S. House seat in NC-9 will remain vacant until then, as 2018's last undecided election is finally completed near the end of 2019.

In Georgia, meanwhile, results from a 2018 race are still being challenged in court, after more than 125,000 votes cast in last November's race for Lt. Governor appeared inexplicably "missing". The unusually large undervote rate in that contest does not appear in any others races, including statewide elections much farther down the ballot (eg. Sec. of State, Insurance Commissioner, etc.)

Moreover, the missing votes only appear to have occurred on ballots cast at the polling place, where voters are forcced to use GA's 100% unverifiable touchscreen voting systems. Hand-marked absentee paper ballots revealed no similar drop-off in voting rates for Lt. Governor and, according to our guest today, plaintiff MARILYN MARKS, Executive Director of the non-partisan Coalition for Good Governance, the unusually large residual vote rate was also inexplicably highest in predominately African-American precincts.

"It wasn't just our speculation that something went wrong with the machines," Marks tells me. "We had the premiere election statisticians in the United States look at this, and they basically said it would be a one-in-ten thousand chance that something wasn't happening in the machines that would have caused this kind of result."

Last January, as the Coalition sought a forensic analysis of the state's voting systems and other materials needed to carry out their lawsuit seeking to overturn the results of the Lt. Governor election, they were blocked by the state. Leading that fight was Republican Gov. Brian Kemp who is said to have narrowly defeated Democratic candidate Stacey Abrams last year on the same day, in a race where then-Sec. of State Kemp oversaw his own election and was found by several court challenges to have been suppressing the vote in predominately African-American areas. Last week, the Georgia Supreme Court heard the plaintiffs' appeal in the case, after a lower state court judge dismissed it --- without even allowing discovery --- earlier this year. Marks and the other plaintiffs seek to have the lower court's ruling by Senior Superior Court Judge Adele Grubbs reversed, so they may proceed with discovery, including forensic analysis by cybersecurity and voting systems experts, and a full trial.

"The dynamics of [the lower court] trial were extremely strange," she explains. "We told the Supreme Court several times that during the trial, when we were begging for discovery, begging for a jury trial, begging for a continuance because they had been blocking everything we were doing, the judge said, 'Look, I'm getting pressure to get this resolved. So, no --- you cannot have the documents, you can't have a continuance, and you can't have a jury trial.'

"Getting pressure"? From whom? "We don't know. She didn't disclose that," Marks says, "but that alone is reason to reverse her."

Marks joins us to detail how things went at the high court last week, and for an update on Kemp's new effort to move the voting systems in Georgia from its current 100% unverifiable Diebold touchscreen system, installed in 2002, to an all-new 100% unverifiable touchscreen system that prints equally unverifiable computer-marked paper ballot summary cards. On that front, Marks has been loudly opposing the move --- advocating instead ofr hand-marked paper ballots --- and offers some interesting news as well...

On today's BradCast: Some good reporting, some bad politics, and some accountability on the horizon. [Audio link to today's show follows below.]

Among the many stories worth your while covered on today's program...

  • Democratic House Speaker Nancy Pelosi seems to take impeachment "off the table", just as she did back in 2006 during the George W. Bush regime, asserting this time that, "Impeachment is so divisive to the country that unless there's something so compelling and overwhelming and bipartisan, I don't think we should go down that path, because it divides the country. And he's just not worth it." It was a mistake during the Bush era, and its a mistake now. Perhaps not a political one --- at least as she and many Democrats may see it --- but a mistake for the nation and its long term well-being. We discuss and explain why;
  • While he may (or may not) be safe from impeachment, Donald Trump's legal troubles are getting no better. New York state's recently elected Attorney General has now reportedly subpoenaed Duetsche Bank and other financial institutions related to a number of Trump projects where, according to recent testimony by his former personal lawyer Michael Cohen, Trump exaggerated his wealth on financial statements in order to fraudulently borrow money for real estate and other projects;
  • Speaking of subpoenas, federal investigators are now said to finally be investigating Republican election fraud in North Carolina, where a GOP absentee ballot fraud scheme resulted in the nullification of last November's U.S. House election --- and a new one now scheduled --- in the state's 9th Congressional District. The State Board of Elections had requested a federal probe following apparent GOP absentee fraud in the 2016 election, but Trump's U.S. Attorney in NC appears to have ignored the request, paving the way for the same fraud scheme to be repeated during 2018 cycle. McCrae Dowless, the contractor who carried out the fraud, as hired by GOP candidate Mark Harris, has already been indicted on state charges. But Harris, so far, has escaped accountability at both the state and federal levels. His campaign has now been subpoenaed by the feds. Stay tuned;
  • The Trump Administration evacuated the last of the remaining U.S. diplomats in Venezuela on Monday night, saying their presence in the country has become a "constraint" on U.S. policy there, whatever that may ominously mean. Top Trump officials have been threatening the administration of President Nicolas Maduro for several months since opposition leader Juan Guaido declared himself to be President of the nation in turmoil. Since late last week, power outages have crippled the country, with each side blaming the other and Maduro charging the U.S. has sabotaged the power grid with cyberattacks.

    But some excellent reporting by the New York Times over the weekend reveals, yet again, that many of the claims against Maduro being made by Trump Administration and supportive Republicans in Congress like Sen. Marco Rubio, are based on completely false information. On Sunday, the Times published a video report revealing that claims by Trump officials from National Security Advisor John Bolton to Sec. of State Mike Pompeo to Vice President Mike Pence and, yes, Rubio, charging that Maduro's forces set fire to aid trucks coming from Colombia are inaccurate. In fact, as the Times' unearthed video reveals, it was protesters in support of Guaido on the Colombian side of the border who caused the fires. This is just one more reason to be skeptical about Trump's intentions in the troubled South American nation (and media reports of same) as his own political fortunes worsen at home.

    And, in case you don't find Rubio wrong enough in his false claims about the aid trucks, just wait until you hear what the dumb cluck charged over the weekend regarding an explosion at the 'German Dam' in Bolivar State!;

It's happening way too slowly. But, if you haven't noticed --- it's unclear whether Republicans have yet --- their "strategy" of simply ignoring and denying very real problems, from a wildly failed and corrupt Presidency to Earth's climate now on the brink of disaster, is no longer working. You can only ignore and deny and delay for so long before things just fall apart. It's a theme that comes up in a number of stories on today's BradCast. [Audio link to show posted below.]

Among the stories we cover today...

  • Fallout continues from Wednesday's bombshell Michael Cohen's testimony in the U.S. House Oversight Committee. According to conservative WaPo columnist Max Boot, evidence of at least five felony crimes by the President of the United States was offered under oath by Trump's former personal lawyer and fixer. Yet, Republicans don't seem to have a clue, according to Rightwing former NJ Governor Chris Christie, how to substantively respond. Describing it as a "fake hearing", as Trump did and hoping to tar Cohen as a "liar" only gets ya so far, particularly since Cohen already pleaded guilty to lying to Congress --- on behalf of Donald Trump! --- and is soon going to prison for it. His life would only gets worse if he lied to Congress again. So why would he? On the other hand, Trump has yet to face consequences for his unprecedented lies, cover-ups and felony crimes both before and after becoming President;
  • Speaking of Trump and lies, his second Summit with North Korean dictator Kim Jong Un in Hanoi, Vietnam abruptly collapsed on Thursday, ending early with no deal and no agreement signed as planned. Trump claims it was because the North insisted the U.S. lift all sanctions in exchange for the closure of its main nuclear site. The North claims Trump is lying. Who to believe? It should also be noted that Trump, the self-described great deal maker, continues to fail to make virtually any deals at all with anybody over the two years of his woeful if tumultuous Presidency.

    He also failed, once again, to condemn North Korea's brutal and atrocious human rights record, and even publicly sided with Kim over U.S. intelligence agencies (yet again), this time regarding the death of 22-year old American student Otto Warmbier after his imprisonment there. Trump said Kim told him he knew nothing about Warmbier's death and "take[s] him at his word" on that. But, as long as the unbalanced Trump still believes he's friends with Kim, we'll take that over the "fire and fury like the world has never seen" that 2017 Donald Trump had been promising when he threatened to wipe North Korea off the map;

  • Also today, in Israel, recommendations for felony indictments were announced by the Attorney General after a two year investigation of the dishonest, corrupt, Trump-supported, right-wing Prime Minister Benjamin Netanyahu, who is currently facing a tough upcoming election. Despite the corruption allegations, Netanyahu says he won't step down as PM amidst what he describes as an "unprecedented witch hunt" by "the left". (Sound familiar?);
  • Meanwhile, on Wednesday, while Cohen was testifying to Congress, McCrae Dowless and a number of his accomplices were arrested in North Carolina on charges related to absentee ballot election fraud on behalf of Republicans in the state. The long overdue accountability comes on the heels of last week's State Board of Elections hearing and unanimous vote for a new election in NC's 9th Congressional District. That, after Republican candidate and Baptist minister Mark Harris hired Dowless to run his absentee ballot campaign last year and lied about his knowledge of Dowless' tactics. The District Attorney who indicted Dowless and friends says more charges for "others", regarding the November 2018 general election, could be coming. Harris may want to do some heavy praying. The Board of Elections meets Monday to determine a date for the new election to fill the still-vacant U.S. House seat tainted by GOP fraud last year. Democrat Dan McCready says he plans to run again. The disgraced Harris says he won't;
  • And, more good news for voters on Wednesday, this time in Texas. A federal judge has ruled the state may not purge as many as 98,000 voters from the rolls after Secretary of State David Whitley and (criminally indicted) Attorney General Ken Paxton declared them to be non-citizens fraudulently registered to vote in the state. As became apparent just hours after Paxton announced Whitley's flawed list in a "VOTER FRAUD ALERT!", tens of thousands of those listed were revealed to have been citizens after all. That didn't prevent Trump from tweeting out the fake news as "just the tip of the iceberg", in order to falsely declare that "voter fraud is rampant". But it has now earned a reprimand from a federal court and will likely block Whitley's state Senate confirmation as SoS, if Democrats in the chamber keep their vow to block Governor Greg Abbott's former aide turned nominee. The federal judge found that just 80 of the 98,000 names were actually non-citizens;
  • Finally today, with the GOP's long-held Ignore and Deny strategy also falling apart on man-made climate change, Desi Doyen joins us for the latest Green News Report with news on that and much more, including some good news for solar power in Arizona for a pleasant change...

On today's BradCast: It looks like it'll be several more months before we actually have a member of Congress seated in the 2018 U.S. House race in North Carolina's 9th Congressional district. But, as of dramatic developments last night and again today, at least we now know that a new election is finally on the way. [Audio link to show is posted below.]

After a stunning past 24 hours, the NC State Board of Elections voted 5 to 0 on Thursday to hold a new election, following dramatic, surprise testimony on Wednesday at a public hearing over the disputed results of last year's NC-9 House election. Republican Mark Harris is said to have defeated Democrat Dan McCready by just 905 votes out of more than 275,000 cast, but evidence of absentee ballot fraud by a Contractor hired by Harris prevented the Board from certifying the results.

On Wednesday, John Harris, an assistant U.S. Attorney and son of the Republican candidate, took to the stand at this week's public hearings to turn against his father by detailing warnings he had given his dad about the Republican absentee ballot contractor, McCrae Dowless, whose record of defrauding elections was clear long before he was hired by Harris for his 2018 campaign.

Today, we break down both the backstory from 2016 through the 2018 contest, as well as the astonishing key events from the past 24 hours in which John's testimony brought his father to tears in the hearing room [see photo above], and also stunned the McCready campaign which similarly not known in advance of John Harris' plan to take the stand to testify against his father's claims of innocence. "I thought what he was doing was illegal, and I was right," said John, discussing Dowless' record. In his own teary closing statements, he testified: "I love my dad, I love my mom, O.K.? I certainly have no vendetta against them, no family scores to settle, O.K.? I think they made mistakes in this process and they certainly did things differently than I would have done."

And with that, and a few other comments about the need to "transcend our partisan politics, and the exploitation of processes like this for political gain," we're happy to offer John Harris our coveted if more-rarely-than-ever-bestowed BRAD BLOG Intellectually Honest Conservative Award. We haven't given one of those out in years!

Moreover, just minutes before the testimony, emails and texts between father and son were released, detailing the warnings John had given his father Mark (a Baptist minister!) about Dowless, which undercut the Republican candidate's long-repeated, if never-believable public insistence that he'd known nothing about Dowless' penchant for forging absentee ballots.

In 2016, Harris lost the Republican primary by a very slim margin after losing an impossible number of absentee votes in Bladen County to the another candidate who had hired Dowless. In 2017 the state Board of Elections referred the election fraud case to the U.S. Attorney at Trump's Dept. of Justice. But the DoJ took no action, despite the mountain of election fraud evidence uncovered by state investigators from the 2016 GOP election fraud scheme. All before Harris hired him for his 2018 campaign and what state officials described earlier this week as a "coordinated, unlawful, substantially resourced absentee ballot scheme".

The 5 to 0 vote of three Democrats and two Republicans on the Board to hold a new election followed Mark Harris' own testimony in which he tried to distance himself from his son's damning testimony and attempted to defend his months of demands he be seated, before finally declaring today: "It's become clear to me that the public's confidence in the 9th District seat general election has been undermined to an extent that a new election is warranted."

Buckle up for the entire sordid and remarkable tale as it unfolded today and the many subsequent unanswered questions raised by this entire shameful mess.

Then, how hand-marked paper ballots were instrumental to uncovering the NC fraud scheme, how the recent report that Trump's DHS has moved resources from election oversight to immigration/border matters in advance of the 2020 race, and the disturbing story of the long-time Coast Guard official who, according to federal prosecutors on Wednesday, was a White Supremacist domestic terrorist plotting to murder "leftist" Democratic members of Congress (many of whom have been singled out by Donald Trump), along with MSNBC and CNN media figures "on a scale rarely seen in this country." That, on the very same day that Donald Trump tweeted, yet again, in all caps, that journalists are the "ENEMY OF THE PEOPLE!"

Finally, Desi Doyen brings us the latest Green News Report on the Trump Administration punting on action to prevent incredibly toxic chemicals in our drinking water, another global heat record last month, and even a bit of good news out of Australia for a change....

On today's BradCast: The crowded Democratic 2020 field gets crowded-er; The GOP's years of phony concerns about "voter fraud" are revealed as even phonier; And our own Green News Report meets another remarkable milestone. [Audio link to show is posted below.]

First up today, 2016 Democratic primary election second-place finisher Bernie Sanders announces he's running in 2020 and immediately raises a "yooge" amount of money in just hours. But the progressive independent Senator from Vermont faces a new set of challenges in his bid to win the nomination this year among a very crowded and already-quite-progressive field of candidates.

Then, the North Carolina State Board of Elections finally began their public inquiry into the Republican absentee ballot fraud scheme that apparently resulted in the 905-vote "victory" for Republican Mark Harris [pictured above at today's evidentiary hearing] in the state's 9th Congressional District race over Democrat Dan McCready last November. Neither candidate has yet been certified by the state Board as its investigation has been ongoing for months and as NC's Elections Director Kim Strach charged this week that GOP operative McCrae Dowless, a contractor hired by Harris and Bladen County Sheriff Jim McVicker, ran a "coordinated, unlawful and substantially resourced absentee ballot scheme" in two counties, with enough questionable ballots to have called the Harris/McCready 905-vote margin (out of some 275,000 votes cast) into doubt.

Dowless' scheme, according to public testimony at the hearing this week by Lisa Britt, one of his team of workers, included illegally collecting and modifying absentee ballots; paying workers to harvest those ballots; changing votes with attempts to match the ink used on each voters ballot; falsifying witness signatures and more.

While the state GOP is still backing Harris, national Republicans have remained mum about the coordinated election fraud conspiracy --- despite years of false claims about Democratic voter fraud. It's still unknown whether the 3-2 Democratic-majority State Board of Elections will ultimately certify Harris, call for a new election, or end in deadlock, since 4 votes are needed for either action. If deadlocked (or even if Harris is certified), the issue will be investigated and decided by the Democratic-majority U.S. House of Representatives. Shamefully, after state investigators found that Dowless ran a similar absentee ballot fraud scheme in 2016 and sought prosecution from the Dept. of Justice at the time, Trump's U.S. Attorney in the state ignored the matter, choosing instead to prosecute a handful of alleged non-citizen voters instead of the blatant fraud conspiracy that appeared, once again in 2018, to have stolen an entire election (or more.)

Donald Trump was busy 'making American great again' today by extending the longest federal government shutdown in the nation's history, intimidating and threatening federal criminal witnesses and their families, lying about Democrats and calling the U.S. House Speaker silly names. And --- oh, yeah --- continuing to do nothing about a very clear case of election-flipping fraud.

By and large, the only good news we could find for today's BradCast comes from the states. But we'll take what we can get. Among the stories covered on today's program:

  • Los Angeles teachers returned to work after a six day strike was settled with a new contract that increases pay and decreases class size, among other things;
  • In D.C., in the meantime, the government shutdown continued as new polling from AP-NORC finds Trump's approval numbers plummeting over the last month in the bargain;
  • After the President insisted on Wednesday that he was coming to Congress next week to deliver his State of the Union address amid the shutdown, Speaker Pelosi called his bluff and announced she was officially postponing it until after the government was reopened;
  • Also cancelled for now, the public testimony of Trump's former lawyer Michael Cohen before the U.S. House Oversight Committee that had been scheduled for the first week in February. The cancellation, according to Cohen's attorney, comes after the President's attempts to intimidate the federal witness by calling for his family to be investigated. Intimidating or threatening Congressional witnesses is a federal crime, not unlike the felony Cohen says Trump "directed" regarding hush-money payoffs before the 2016 election to women with whom Trump had allegedly had sexual affairs. Cohen could still be subpoenaed to testify before he begins a three year sentence in March;
  • The U.S. House seat from North Carolina's 9th Congressional District remains vacant today, after a state judge on Tuesday declined to order the certification of Republican Mark Harris amid the ongoing investigation into absentee ballot fraud by a GOP contractor hired by Harris. The apparent fraud by the contractor, McCrae Dowless [pictured above with Harris], appears to have flipped the race in Harris' favor by 905 votes. The State Board of Elections investigating the matter was dissolved earlier this month by a court, in an unrelated case which found that Republican state lawmakers had unconstitutionally changed the make up of the Board to disadvantage the Democratic Governor elected in 2016. That was the same year that Dowless was reported to have committed absentee ballot fraud on behalf of a number of other Republicans.

    Despite the State Election Board's referral for prosecution to Trump's U.S. Attorney in the state in 2017, action was never taken by federal prosecutors in response to the mountain of evidence of actual election fraud discovered by the Board. That, as Trump falsely claimed that same year that massive "voter fraud" was the reason for his 3 million vote loss to Hillary Clinton in the popular vote. While Trump was lying about massive voter fraud, his U.S. Attorney in North Carolina was prosecuting a handful of cases of unlawful votes allegedly cast by some non-citizens, while ignoring the election-flipping GOP absentee ballot fraud scam and allowing it to be repeated in the 2018 contest;
  • One of Trump's longtime partners in false claims of non-citizen "voter fraud" was then-Kansas Sec. of State --- and top GOP "voter fraud" fraudster --- Kris Kobach, who lost his race for Governor last year to Democrat Laura Kelly. Now, KS state lawmakers have introduced measures to revoke the prosecutorial powers they had granted to Kobach, at his years-long insistence. (He was the only Sec. of State in the nation to enjoy such powers.) The new GOP Sec. of State in Kansas wants to return the office to its original purpose of administering elections, after years of claims by Kobach that "illegal aliens" were stealing Kansas elections by unlawfully voting. The disgraced former Sec. of State failed to prosecute any such cases. But he did nab less than a dozen voters, mostly for casting ballots in two different states while owning property in each;
  • Finally today, some Dems floated the idea of giving Trump some of the billions he's demanding for a border wall, but only for other forms of border security. At the same time, Republicans supporting the President's demands have never once demanded to known how that spending would be paid for, despite repeatedly telling Americans we simply can't afford money for healthcare or education or infrastructure or the environment or verifiable election systems unless we cut spending elsewhere. With that in mind, we close with a noteworthy observation by HBO's Bill Maher last weekend on what Americans should really be learning from the longest federal government shutdown in U.S. history...

Every great Reality TV show needs a dramatic and gripping season finale. So too, apparently, does does every horrible Reality TV Presidency! [Audio link is posted below]

Today is our last new BradCast before Christmas (Angie Coiro will be filling in for us, along with a few "evergreens" over the next week or two), but, as has become clear today, Trump! The Presidency! has certainly delivered in the shocking and suspenseful season finale department! Including...

TWISTS AND TURNS! Acting AG Matthew Whitaker did not, as misreported earlier today, get approval from a DoJ ethics review to oversee Special Counsel Robert Mueller's probe. In fact, the ethics review determined he should recuse himself. But, apparently, he plans to ignore that finding;

SURPRISES! Trump defies his military advisers, not to mention stuns and infuriates members of Congress on both sides of the aisle along with experts in the region, by declaring "victory" on Twitter over ISIS and that he plans to now pull U.S. troops out of Syria! But when? Nobody seems to know. Is Afghanistan next? (Apparently so!);

MAIN CHARACTERS 'KILLED OFF'! Defense Secretary Gen. James Mattis, the last of Trump's "My Generals", and none too happy about the Syria decision, submits his surprise resignation, charging the President is anything but "clear-eyed" about the need for U.S. alliances and the threats faced from its adversaries;

SUSPENSE! Will Trump shut down the federal government over Christmas? Last week he said he would. Earlier this week he indicated he wouldn't. But, today, it looks like he will! And all over $5 billion in funding for a southern border wall (now "steel slats") he promised that Mexico, not tax-payers, would be paying for;

CHRISTMAS VILLAINY! Trump's USDA, in defiance of Congress's newly passed farm bill, announces they will now make it more difficult for the poor to receive food stamps. That'll show 'em!;

NUCLEAR CLIFF-HANGER! North Korea bluntly declares that "denuclearization of the Korean peninsula" actually means what it sounds like, and what those of us in the reality-based world (as opposed to the Reality TV world) already knew. They will not denuclearize unless the U.S. removes its own troops and nuclear weapons at the same time. Will Trump return to his threats for "fire and fury like the world has never seen"?! Stay tuned for the thrilling 2019 season!

Also today: The DNC announces its planned schedule for a dozen 2020 Presidential primary debates beginning in 2019, even though we're not yet even done with the 2018 election around here yet!

As we await the scheduled January 11th evidentiary hearing over the GOP's 2018 Absentee Ballot Election Fraud Scandal that has prevented Republican Mark Harris' 905-vote U.S. House "victory" over Democrat Dan McCready from being certified in North Carolina's 9th Congressional District, the state Board of Election's stunning 279-page 2016 investigative report [PDF] on apparent absentee ballot fraud by McCrae Dowless, the same GOP contractor hired in 2018 by Harris, is released. And it includes some jaw-dropping evidence begging the question: How can it be that Dowless not already prosecuted after 2016, but allowed instead to carry out the same unlawful election fraud scams in 2018?!

On today's BradCast: Trump appears now to be in very big trouble. So do Republicans in North Carolina's 9th Congressional District. But President Obama's Affordable Care Act soldiers on, even as signups are down as the open enrollment period for 2019 on the federal HealthCare.gov exchange quietly nears its close on Saturday, December 15th.

On Wednesday, Donald Trump's former personal lawyer and 'fixer' Michael Cohen was sentenced to three years in prison and some $2 million in fines after cooperating with federal prosecutors following guilty pleas to several felonies in August. Special Counsel Robert Mueller's team noted that Cohen has been helpful in their probe of Trump's still-unexplained relationship with Russia, but it was the charges brought by federal prosecutors against Cohen in New York's Southern District related to hush-money payoffs to women with whom Trump was said to have had sexual affairs that most immediately appears to cook Trump's goose.

Both Cohen and the federal government now allege that Trump, in the waning days of the 2016 campaign, "directed" a conspiracy to pay off the women in order to buy their silence in an illicit scheme to "influence the election". Those payoffs of $130,000 to porn actress Stormy Daniels and $150,000 to Playboy model Karen McDougal (via National Enquirer publisher AMI) are considered illegal campaign contributions.

Also on Wednesday, prosecutors announced a non-prosecution agreement with AMI, run by longtime Trump pal David Pecker, in exchange for their cooperation in the case. As discussed on today's show, Trump now appears to be in very VERY big trouble, at this point. If the man who helped make the payoffs at Trump's "direction" --- who had also cooperated with investigators --- received three years in prison for his crimes, imagine what may happen to the man who actually directed the conspiracy.

While there are still a number of potential escape hatches such as the Presidential pardon power for Trump, his associates, his family members and his businesses, a new interview with incoming New York state Attorney General-elect Letitia James suggests she has that base covered as well. James says she intends to "use every area of the law to investigate President Trump and his business transactions and that of his family as well" at the state level, including "anyone" in his circle who may have violated state law. Trump's businesses and campaign are based in New York. James tells NBC she intends to bring state charges in an attempt to ensure Trump, his associates, his family and his various organizations are unable to evade accountability with Presidential pardons at the federal level.

In North Carolina, meanwhile, fresh revelations continue to emerge regarding the 9th Congressional District election which is at the center of an ongoing GOP absentee ballot election fraud scandal. New details in that matter today include the state Republican Party's admission that a new election will most likely be needed, following news this week that Early Voting results in Bladen County were reportedly leaked, illegally, in advance of the November 6th election.

Moreover, a new affidavit from a Republican now charges that McCrae Dowless, the GOP contractor hired by Republican Mark Harris to run his absentee ballot campaign in Bladen, where the fraud scheme appears centered, told him that he (unlawfully) had as many as 800 absentee ballots in his possession prior to the election. What came of those ballots we don't yet know, but Harris is said to have defeated Democrat Dan McCready by just 905 votes in the 9th District last month. At this point, I see no way that a new election in the district can be avoided, other than simply naming McCready the winner.

Also today, we're joined by ALICE OLLSTEIN, formerly of Talking Points Memo, now a congressional reporter at Politico, to discuss the nearly 10 percent drop off in signups this year for the Affordable Care Act (ObamaCare), as the federal open enrollment period comes to a close this weekend. "It's not high prices that are deterring people," Ollstein argues, citing a key piece of data to back that up, before explaining the several different reasons why signups are down this year so far, and how that may affect the future stability of the federal exchanges.

With Democrats set to take the majority in the U.S. House in January, Ollstein also details their dilemma in how to best defend against a federal lawsuit brought by several Republican-controlled states (and now supported by the Trump Administration) hoping to kill the landmark ACA and its vital protections for those with preexisting conditions...

On today's BradCast: The boondoggles continue --- from the Pentagon to the U.S. House and American elections --- as we can't look ahead to the new year without the continuing unresolved muck from this year. [Audio link to full show is posted below.]

When Democrats take the majority in the new Congress after the first of the year, one of their first orders of business will be determining who actually is allowed to be seated following the November 2018 midterm elections. There could be as many as three (and possibly more) seats challenged in the 116th Congress, thanks to the burgeoning GOP absentee ballot election fraud scandal in North Carolina, an admission by a newly-elected Florida Republican that he "may have" violated federal campaign finance laws, and a lengthy hand-count process in Maine's first-ever Ranked Choice Voting election for a U.S. House seat.

In NC's 9th Congressional District, Mark Harris --- the GOP candidate whose uncertified 905-vote "victory" is now being probed by state and federal officials after the emergence of evidence of absentee ballot fraud by a GOP contractor Harris hired in both the primary and general elections --- has said he'd agree to a new election, but only if evidence surfaces that the fraud in question would have changed the final results. That's a much higher bar than called for by state law, which allows the State Board of Election to take any necessary actions to "assure that an election is determined without taint of fraud or corruption."

In FL, Ross Spano, the Republican who is said to have won the race in the state's 15th Congressional District, now admits he received nearly $200,000 in personal loans for his campaign from two friends, in violation of the $2,700 per person federal contribution limit. One of those friends, despite having no official government role, is today reported to be helping to select Spano's Congressional hires. In both the NC and FL cases, it's not just Democrats crying foul. Tthe Republicans who were defeated in the primaries by Harris and Spano are also joining the public outcries.

In ME, a "recount" request by ousted Republican Rep. Bruce Poliquin in the 2nd Congressional District could result in a vacant seat for a while, as a hand-count of the complicated RCV counting process --- initially carried out after the election by a computer algorithm --- is a lengthy and onerous one that could stretch beyond January 3, when the new Congress is sworn in.

In non-election related news today, Donald Trump will reportedly call for an unprecedented $750 billion budget next year for the Pentagon after his previous increases to military spending. That, despite his description of Defense Department spending last week as "crazy" and previous vows to cut DoD's budget by 5 percent. The Administration's proposal for $750 billion is reported to be a "negotiating tactic" to ensure the $733 billion requested by the Pentagon, which is a far cry from the $700 billion Trump had called for previously and a substantial bump from the "crazy" $716 billion allocated for the current fiscal year.

We're joined today by investigative journalist DAVE LINDORFF to discuss the decades-long "accounting fraud" being carried out by the Pentagon, as detailed in his new exclusive exposé for The Nation. Citing whistleblowers, Inspector General's reports and a recent admission by the private accounting firm Ernst & Young that the Pentagon's books were so poorly documented that they simply cannot be audited, Lindorff explains how the DoD continues to seek --- and receive --- more tax-payer dollars year-after-year, even without needing or spending all they received in previous years. Rather than returning unpsent funds to the federal Treasury, DoD accounting gimmicks ("nippering" and "plugs") ensure endlessly increasing budgets and payments to Defense Contractors. The unchecked spending --- which amounts to trillions of dollars --- also helps to ensures that services Americans may actually need and want --- like healthcare, education and maintenance for infrastructure --- continue to be on the chopping block every fiscal year, even as Defense spending now accounts for 54 cents out of every federal tax-payer dollar collected.

"What the Pentagon does is they ask for more money than they need. They don't spend it all, and then they tuck away what isn't spent in ways that it won't be found --- violating the Constitution, by the way --- then that unspent money becomes a slush fund that's available to use however they want," Lindorff tells me.

"They've known about this stonewalling by the Pentagon for 26 years, which includes a lot of Democratic Congresses. Nobody has ever called them to the carpet on this," he charges. Despite Inspector General reports detailing the gimmicks and unaccounted for budget holes, "Nobody has been prosecuted for this. Nobody has been fired for this....If it's signed off on by the proper authority in the chain of command then it's 'supported' whether or not there's evidentiary material to back it."

Lindorff also argues that, with one recent exception, Democrats --- including progressives from Bernie Sanders to Beto O'Rourke --- have been largely silent on what he describes as a massive account fraud.

Finally today, Rep. Adam Schiff (D-CA), who will chair the U.S. House Intelligence Committee after Dems take over Congress next year, argued over the weekend that new filings from federal prosecutors on Friday suggest "There’s a very real prospect that on the day Donald Trump leaves office, the Justice Department may indict him" and "that he may be the first President in quite some time to face the real prospect of jail time." Schiff was referencing, among other things, details from a sentencing memo filed by federal prosecutors in New York on Friday charging that Trump "directed" a criminal conspiracy with his former attorney Michael Cohen to pay hush money to two women with whom Trump had affairs, in order to effect election results in violation of federal campaign finance laws...

GOP knew about fraud, ignored it; Also: GOP fraud in NY; 82 Walker noms approved in WI lame duck; Lame duck 'GOP smash and grab' in MI...

No, Iraq hasn't (yet) announced plans to invade North Carolina to help spread democracy. But, on today's BradCast, it's starting to look like it might not be a bad idea. [Audio link to show is posted below.]

Just before air today, Dan McCready, the Democratic candidate in NC's 9th Congressional District U.S. House race tainted by evidence of GOP absentee ballot election fraud, withdrew his concession offered last month. McCready charges that Republican Mark Harris "bankrolled criminal activity" in the district in the hiring of contractor McCrae Dowless who appears to have gamed absentee ballots in Bladen and perhaps Robeson Counties, resulting in the 905-vote margin by which Harris had previously been thought to have won.

At the same time, NC-9's incumbent Republican Rep. Robert Pittenger, who Harris reportedly defeated in the primary last May, tells Washington Post that his concerns about fraud during that race --- when he lost to Harris by just 828 votes (more than half of them absentee ballots from Bladen) --- were shared with both state and national GOP officials at the time. Nonetheless, despite years-long claims of concern about fraud leading to passage of often unconstitutional GOP laws that restrict the ability of many Democratic-leaning voters to cast ballots, Republicans took no action after the primary. In fact, similar concerns about absentee ballot fraud by the same contractor surfaced after the 2016 election in the state as well.

The Charlotte Observer has now called for the 2018 election in NC-9 to be started over, from scratch, beginning with the primary. "Evidence demands it," their editorial board opined this week. We've got a whole bunch of late-breaking news related to the burgeoning NC-9 election fraud scandal today (along with my completely irresponsible prediction about how this entire thing ends).

Also, in related news, a newly emerging election fraud scandal in New York, where Republican and Independence Party leaders have now been charged with forging signatures on nominating petitions in order to boost chances for GOP candidates. (If that sounds familiar, it's because Republicans, apparently --- including very high-profile ones --- do that quite a bit.)

Meanwhile, GOP lawmakers in Wisconsin and Michigan this week continued their efforts to undermine the will of the midterm voters in the wake of disastrous performances in the November elections. In Wisconsin, where the GOP-gerrymandered legislature on Wednesday adopted unprecedented measures during an extraordinary lame duck session to remove power from the Governor, the Attorney General and voters in advance of Democratic Governor-elect Tony Evers and AG-elect Josh Kaul taking office next month, state lawmakers also confirmed 82 appointees of outgoing Republican Governor Scott Walker to state positions in one single day. Several of the positions had reportedly been vacant for as long as a year, and more than 30 of the new appointees have had no public hearing whatsoever in the state Senate. That power grab is particularly hypocritical for Walker, who warned his Democratic predecessor in 2010 to avoid all new appointments in the final two months of his term.

In Michigan, GOP lawmakers have proven similarly disdainful of voters during the lame duck session. Earlier this year, they adopted two voter-initiated ballot measures concerning increases to the state's minimum wage and paid sick leave for workers in order to prevent the proposals from appearing on the November ballot. But, this week, during the lame duck period before Democrat Gretchen Whitmer can be sworn in, Republican lawmakers gutted the measures they had just adopted in September. They would not have been able to do that had they been voted on by voters. The controversial --- and perhaps unconstitutional --- effort was given the green light by outgoing Republican AG Bill Schuette, who lost his bid for Governor in November to Whitmer.

Finally today, Desi Doyen joins us for our latest Green News Report, with a bunch of very bad news on global carbon emissions and climate change, but a bit of encouraging news from several major companies in response to it...

Trump tariff idiocy; Runoff results and an election contest in GA; Good news in Little Rock, AR; More on NC-9's GOP election fraud scandal; WI Republicans muscle through their brazen power grab...

Given many of the stories covered on today's BradCast, it's beginning to feel more and more each day like the GOP is a party in its death throes. Of course, rumors of that death have been greatly exaggerated in the past. [Audio link to show follows below]

Among the many stories covered on today's program...

  • The stock market was closed today in observance of a national day of mourning declared for President George H.W. Bush, whose funeral ceremony was held on Wednesday at the National Cathedral in D.C. The market closures may prove to have been a good thing, given that the Dow plummeted some 800 points on Tuesday after it became clear that Donald Trump and his Administration had lied over the weekend regarding a deal with China to avoid more tariffs on Chinese imports. During a Twitter rant that helped send the markets plunging, Trump appeared to reveal once again that he has no idea what tariffs actually are. He seems to believe they involve foreign countries paying money to the U.S., rather than an actual tax on American consumers. Is it conceivable that he really does not understand this by now? Or is he just continuing to play his supporters for chumps? We discuss;
  • In Georgia's runoff election for Secretary of State on Tuesday, Republican Brad Raffensperger has declared himself the winner over Democrat John Barrow, in a race that will have serious repercussions for the 2020 Presidential election in the trending-"blue" southern state, where voter suppression and 100% unverifiable touchscreen voting systems created havoc in the 2018 Gubernatorial race said to have been won by GOP Sec. of State Brian Kemp. Raffensperger has called for new 100% touchscreen systems that create unverifiable computer-marked/barcoded ballot summary cards. Barrow, who is waiting for late absentee ballots to actually be tallied, has called for the only system of voting that is actually verifiable by the public after an election: hand-marked paper ballots.

    At the same time, the state's largest newspaper, the Atlanta Journal Constitution, has finally noticed the wildly anomalous undervote rate from the November 6th general election in the Lt. Governor's race, as only seen in the unverifiable touchscreen results, not on the vote-by-mail paper absentee ballots. Last week, we discussed these concerns with plaintiff Marilyn Marks of the non-partisan Coalition for Good Governance. Two weeks ago, Marks filed an election lawsuit contesting the results of the Lt. Governor's race. She and other plaintiffs are seeking a first-of-its-kind post-election forensic audit of the state's voting systems in light of the seemingly inexplicable undervote numbers;

  • But there was some good news from Tuesday's runoffs as well. In Little Rock, Arkansas, where, six decades after angry white mobs protested the integration of nine black students at the Little Rock Central High School in 1957, the town will now have its very first elected African-American mayor!;
  • In North Carolina, new details continue to emerge from the intensifying GOP absentee ballot election fraud scandal which has prevented the certification of Republican Mark Harris' purported 905-vote "win" over Democrat Dan McCready in the 9th District U.S. House race. A second woman has now come forward to allege that she was paid to unlawfully collect absentee ballots by McCrae Dowless, a former felon contracted by Harris in Bladen Country and, as discussed today, by the Bladen County Sheriff Jim McVicker. The GOP Sheriff has deleted his campaign webpage on Facebook and refuses to comment after he was found to have paid thousands of dollars to Dowless along with Harris.

    A top Democrat in the U.S. House has now suggested that "Republican operatives stole" the House seat and cites the silence from the Trump Administration about it. "LOCK THEM UP," quipped new House Democratic Caucus chair Hakeem Jeffries (D-NY) on Tuesday. Rep. Seth Moulton (D-MA) has now called for a new election and, on Wednesday, he was joined in that call by the editorial board of The Charlotte Observer, the state's largest newspaper.

    (For my part, I'm just happy that at least some in the media reporting on this have finally noticed they were previously misreporting on it as a "voter fraud", rather than election fraud, scandal, even though voters are accused of having done nothing wrong here. In fact, they are the ones who appear to have been defrauded in this matter by GOP insiders! Happily, the Washington Post removed three references to "voter fraud" in one of their stories after my complaints last week.)

    All of that, even as Republicans in the state's legislature continue to jam through a polling place Photo ID voting restriction during the lame duck period before they lose their supermajority in the upcoming new session, along with their ability to override a veto from the state's Democratic Governor. The Photo ID measure, which they've been trying to adopt for years, claiming it necessary to prevent "voter fraud", did not, until today, apply to absentee voting --- where actual fraud clearly exists;

  • Finally today, speaking of lame ducks, the GOP-gerrymandered and controlled state legislature in Wisconsin worked, literally, all night to jam through a bill aimed at stealing power from incoming Democratic Governor Tony Evers, incoming Democratic Attorney General Josh Kaul and from the state's voters who elected Democrats for every statewide office in November. Adopted by party line votes in both chambers as the sun rose today after another all-night session, Republicans hope GOP Gov. Scott Walker will sign the measure before leaving office after the first of the year. Walker, who was rejected by voters last month, has said he planned to do so.

    As we discussed on yesterday's program, the outrageous GOP power grab in WI mirrors a similar coup by the NC legislature in 2016 after a Democrat was elected as Governor in that state. Republican lawmakers in Michigan are also considering similarly desperate measures before Democrats take over as Governor and Sec. of State in that state next month. All in all, the desperate power grabs by GOPers around the country do not suggest a healthy party but, rather, one that may well be revealing its political death throes.

On today's BradCast: The GOP's utter contempt for democracy and voters is now on full display in several states where things did not go well for the party during the November midterms, and nowhere more so than Wisconsin. [Audio link to show follows below.]

In states where Democratic candidates did well in last month's midterms, leading to a loss of control by Republican lawmakers, there is now a desperate and brazen scramble in lame duck legislative sessions to pass laws in hopes of robbing power from incoming Democrats before they can be seated. In Michigan, for example, where Dems won statewide races for Governor and Secretary of State and voters overwhelmingly adopted ballot initiatives to expand voting rights, GOPers are jamming through last-minute legislation to prevent the Election Day registration that voters had adopted.

In North Carolina, the Republican-controlled state legislature is ramming through a Photo ID restriction law before they lose their Super-Majority to override Democratic Governor Roy Cooper's vetoes. That action is particularly hypocritical as the state is in the midst of a massive absentee ballot election fraud scandal, apparently perpetrated by a GOP contractor and former felon hired by Republican Mark Harris in his race against Democrat Dan McCready for the U.S. House seat in the state's 9th district. Republicans claim that Photo ID voting restrictions at the polling place are necessary to prevent fraud --- of which there is little or none by voters --- even while calling for Harris to be certified by the state despite clear evidence of serious absentee ballot fraud on behalf of the Republican candidate. We've got more new details on that ongoing probe today, which has prevented Harris' reported win --- by just 905 votes out of more than 280,000 tallied --- from being certified by the state Board of Elections.

But it is Wisconsin today where the GOP is attempting perhaps the most audacious power grab in the nation this year. As Republican Gov. Scott Walker was voted out in November in favor of Democrat Tony Evers, the GOP is attempting to usurp the powers of the incoming Governor, along with Democratic Attorney General-elect Josh Kaul, on a litany of issues before they can be sworn in. The new provisions, never mentioned by Republicans during the campaign, were introduced suddenly in a massive 144-page bill unveiled late last Friday night in a special legislative lame duck session called before Walker is finally out.

Despite Democrats having won every statewide contest on the ballot in Wisconsin's 2018 midterms, Republicans were able to retain control of the wildly gerrymandered State Assembly. They received just 45 percent of the vote overall, but will nonetheless control 63 of 99 seats in the Assembly. This week, they are using that ill-gotten legislative muscle to swipe the incoming Governor and AG's powers. They hope to block the Democrats' campaign promises to expand healthcare and ease suppressive voting restrictions (which arguably resulted in enough voter disenfranchisement to narrowly give the state to Donald Trump in 2016). Republicans are also attempting to restrict early voting in 2020 in hopes of avoiding losses similar to those suffered by GOPers in 2018. The unprecedented Republican power grab has led to protests at the state capital in Madison this week of the type not seen since shortly after Walker took power in 2011 and immediately worked with the Republican legislature to strip collective bargaining rights from public union members.

We're joined today by OneWisconsinNow's ANALIESE EICHER --- a plaintiff in the 2016 federal case which struck down the WI GOP's previous attempt to curtail early voting --- to detail the outrageous and unprecedented #WIGOPPowerGrab being strong-armed through the state legislature tonight.

"What we're seeing here is the obliteration of the separation of powers," Eicher tells me. "We know that when Republicans don't like the results, they seek to change the rules and to change how things operate. With Democrats sweeping six statewide elections here in Wisconsin, the only option for the Republicans to maintain what they thought was their really, really great unilateral control of the State of Wisconsin is to make changes."

"We're seeing everything from limiting local governments' abilities to do work on their roads, limiting their abilities to pay a prevailing wage, changing the makeup and composition of boards and commissions in Wisconsin, so that the legislature has equal or more power than the Governor in regards to appointments. We're seeing change's to people's abilities to get healthcare and receive benefits," she says.

"We're seeing changes to the Attorney General's office, as to whether the Attorney General can leave a lawsuit or join a lawsuit," she explains, referring to Kaul's vow to remove WI from the federal lawsuit by several GOP-controlled states challenging the Constitutionality of ObamaCare and its protections for people with pre-existing conditions. "This extraordinary session bill severely limits his ability to essentially do what he campaigned on, and what people voted for him to do."

As one Democrat noted during hearings today in Madison, the action being taken by the legislature "will invalidate the results of the will of the people and shows direct contempt for the voters". But, of course, that is the whole idea, since Republicans now clearly hate democracy. Eicher argues Republicans "want to stay in power, no matter what the cost" and suggests "voters are not responding well to what's happening in this extraordinary session." She believes they will pay a price for this in 2020.

On today's BradCast: The complicated death of a U.S. President during the Trump-era and fresh updates on several midterm election count controversies, fiascos and fraud investigations. [Audio link to show follows below.]

First up: George H.W. Bush, the 41st President of the United States died on Friday. Remarkably enough, there was a question as to whether Donald Trump, the 45th President of the United States would attend his memorial service, given his obnoxious attacks on the Bush family in recent years, as recently as this past summer. Reportedly, Trump will attend, even after making Bush Sr. the butt of campaign rally jokes just months ago. We review parts of Bush Sr.'s legacy today --- without either dancing on his grave or lionizing --- particularly on the environment, while leaving the more unsavory parts of that legacy to callers who ring in with their own thoughts on "41".

Also today, updates on several recent stories we've been closely following of late, including a state House District contest in Alaska that was tied after the initial tally and then "recounted" on Friday, with control of the entire state legislature hanging in the balance. The state's "recount" of hand-marked paper ballots was carried out by hand late last week, and also ended in a tie, until one previously untallied ballot was added after finding that it had been wrongly excluded from the count. That one vote was enough to hand the election to Republicans and, with it, the full reigns of state government to the GOP which now controls the state House, Senate and Governor's mansion. We explain.

In another follow-up from Friday's show, a lawsuit filed by the Democratic Party in Georgia was settled late last week to allow more time for absentee ballots to be received in Tuesday's crucial midterm runoff elections was resolved in favor of voters. With the state's next Secretary of State on the line in the runoff, scores of counties had waited until just one week before Election Day to mail out absentee ballots, requiring that they be returned by Election Day on December 4th. An agreement with the state now allows such ballots to be tallied, as Democrats had sought, so long as they are post-marked by Election Day and arrive up to three days afterward.

Finally today, still more new details on the growing GOP election fraud scandal in North Carolina, which has kept a reported 905-vote Republican U.S. House "win" from being certified by the State Board of Elections. New details have emerged on the rather stunning criminal record of GOP contractor McCrae Dowless [pictured above right], who was hired to run an absentee ballot campaign in NC's 9th Congressional District in Bladen County on behalf of GOP candidate Mark Harris. Analyses of absentee ballots both returned and, mysteriously, not returned, reveal inexplicable irregularities in both the 2018 GOP primary and the general election. In both cases there are now more and more indications of a massive absentee ballot fraud scheme that may have affected the final results.

The controversy and likely criminal investigations come after evidence from the 2016 election suggested Dowless ran a similar absentee scam in that election as well. Dowless, according to police records, spent time in jail from an outrageous life insurance fraud scheme in the 1990s. So, naturally, he was hired by the GOP to work on their elections in 2016 and 2018. We discuss some of those stunning new details in a state where Republicans, ironically enough, have been claiming for years that new restrictions are needed at the polling place in order to deter fraud by Democrats!...

One vote contest in KY; One 'mystery ballot' could determine control of AK House; New GA lawsuit before Tuesday's runoff; More on the GOP Election Fraud case in NC's 9th Cong. District; Also: Media Matters' Pam Vogel on Sinclair's latest offensive abuse of our public airwaves...

Every. Single. Vote. Matters. Or, at least it's supposed to. On today's BradCast we've got a bevy of stories, almost a month after the midterm elections, to prove it. Also, a rightwing broadcast media behemoth --- the nation's largest single owner of local television stations --- faces new blowback for offensive, anti-immigrant commentary they forced their local news outlets to carry. [Audio link to today's jam-packed show is posted below.]

First today, in Kentucky, where nearly half a dozen state House races were determined by half a dozen votes or less, a Republican incumbent has now filed a contest in House District 13 after reportedly losing to his Democratic challenger by just one single vote. No matter how that challenge ends, and it may take a while, Republicans will still hold super-majority control in the Bluegrass State.

But, in Alaska --- which, incidentally, was struck by a major earthquake today --- one single still-uncounted "mystery ballot" in one single state House race may determine control of the entire body for the next two years. We explain.

Meanwhile, in Georgia (the nation's apparent new headquarters for mass voter suppression) the midterms aren't over yet either, with two statewide runoffs set for Tuesday in the Secretary of State and Public Service Commissioners race. But, on Thursday, the state Democratic Party sued the state to allow absentee mail ballots postmarked by Election Day to be counted. Their complaint charges that many counties in the state failed to timely send out requested vote-by-mail ballots until just one week before next week's December 4th runoff. That, they say, will not allow enough time for many voters to receive their ballots and mail them back to the county by Election Day, when state law says they are due.

Dems note that overseas and military votes are tallied, as long as they are postmarked by Election Day and arrive no later than three days after the election. They want the same rules applied to all absentee by mail voters, thanks to the Secretary of State and Counties' delay in sending out tens of thousands of ballots. The GA Sec. of State's office, incredibly, blames the delays on Democrats for trying to ensure all votes were tallied from the November 6th general election! [Post-air update!: GA agrees to count ballots that arrive by December 7th, if post-marked by Election Day!]

In North Carolina, the U.S. House election mystery in the 9th Congressional District has now fairly clearly become a GOP election fraud case. We've got new details today, based on affidavits from voters in Bladen County who describe an unlawful scheme, apparently by a GOP contractor for the Republican candidate, to collect absentee ballots and either alter them before delivery to the County or not deliver them at all. This follows on the surprise State Board of Election decision on Tuesday to not certify the NC-9 race, as previously expected, between Republican Mark Harris and Democrat Dan McCready. Until the new revelations of apparent election fraud, Harris had reportedly won the race by just 905 votes out of more than 280,000 cast. However, as recent analyses have revealed, Harris apparently received a virtually impossible number of absentee by mail votes in Bladen County. On Friday, the NC State Board of Elections decided to delay action until after a a hearing to review evidence in the matter on 6 December 21. They have the authority to, among other things, order a completely new election in the Congressional District.

Finally today, in a widely-reported skirmish at the U.S. southern border with Mexico near San Diego last weekend, U.S. officials fired tear gas into Mexico, sending many women and children migrants from Central American running for the lives. 42 arrests were made by U.S. Customs and Border officials, but AP reports this week that none of the migrants detained will actually be charged with any crimes!

Nonetheless, in the wake of the U.S. use of tear gas on asylum seekers, former Trump staffer Boris Epshteyn, who is now Sinclair Broadcast Group's Chief Political Analyst, offered a commentary in response which local news outlets at hundreds of Sinclair-owned television stations around the country were told to run. Epshteyn's offensive "must-run" commentary charges that migrants were "attempting to storm" the U.S. border in an "attempted invasion of our country. Period." The commentary, as usual, echoed the politics and rhetoric of Epshteyn's far-right nationalist fear-mongering former boss who had sent thousands of U.S. military troops to the border in the days before the midterm elections to, purportedly, help propel the so-called "invasion" by men, women and children fleeing violence and poverty in Central America by foot.

We're joined today by PAM VOGEL of Media Matters who has been documenting Sinclair's abuse of our public airwaves at otherwise-trusted local media outlets, which are now required to carry Epshteyn's "must-run" commentaries as often as five times a week. While Sinclair initially distanced themselves from their own Chief Political Analyst in a "tepid response" after public outrage emerged following Epshteyn's offensive "invasion" commentary, the company has since come out in his support, turning their efforts to false attacks on Media Matters instead. Vogel details the shameful story and how Sinclair could --- and indeed may --- face license renewal problems from the FCC for their abuse of our public airwaves with biased, false and far-right propaganda on their nearly two-hundred television stations across the nation.
