On today's BradCast we head back to Georgia --- yes, again! --- for yet more new evidence highlighting the state as offering arguably the worst --- and most racist --- voting system in the nation. But we begin with breaking news today. Too much of it. [Audio link to full show is posted at bottom of summary.]

First up, Hurricane Laura is now a monster storm, currently a Category 4, and headed for landfall near the Texas/Louisiana border. The National Hurricane Center warns it will be "unsurvivable" and could submerge entire towns near the coast, with a storm surge as high as 20 feet and a menace to cities as far as 200 miles inland. A massive evacuation is now under way in both states, though avoiding the COVID pandemic in evacuation shelters may be very tricky, even as some areas in the storm's target zone have recently seen high positive test rates.

In Kenosha, Wisconsin, where protests continued for a third straight night following the outrageous police shooting, caught on tape, of African-American father Jacob Blake, two protesters were killed by a gunman on Tuesday. The alleged shooter, according to police, is a white 17-year old police fan boy from across the border in Illinois. Tuesday's shootings were also caught by cell phone video, not long after the suspected gunman was seen on video with a group of armed vigilantes being thanked by local police for their presence. After he had shot at least three protesters and was identified to police by others, the cops reportedly allowed him to walk right past them, assault rifle in hand, as they focused on the victims instead. The man was arrested today in Illinois.

Then --- after still more breaking news that the NBA's Milwaukee Bucks were boycotting their playoff game today to protest the shooting of Blake, leading the NBA to cancel all of tonight's playoff games --- we get to what necessarily became our truncated coverage of Day 2 of the Republican National Convention.

It was a stunning evening, in which one law after another was proudly broken or flaunted as the White House, U.S. Marines, the Acting Sec. of Homeland Security, a tax-payer funded trip by the Sec. of State to Israel, and the Presidential Seal were all used for political purposes, during the convention itself, so that Donald Trump could ironically be declared "the Law and Order President" by one hypocritical speaker after another.

Among the speakers were Trump's daughter Tiffany, his wife Melania and his son Eric who followed former Florida Attorney General Pam Bondi making the case --- with a straight face --- that Joe Biden's family members were involved in some sort of criminal nepotism. Trump's son Eric, who serves as Executive Vice President for his father's company, was sued this week by the New York State Attorney General for failing to respond with documents and testimony to a lawful subpoena amid an investigation into bank and tax fraud by his father and the Trump Organization where Eric works. All of that as Trump's senior economic adviser Larry Kudlow pretended that the COVID pandemic --- which has so far killed at least 178,000 Americans, including more than 1,100 on Tuesday alone --- was over, thanks to Donald Trump's quick response.

As usual, all of these nightmares underscore the need to prevent Trump from winning a second term. But it won't be easy, as we learn again today with yet another story of targeted voter suppression out of Georgia. We have spent a disproportionate amount of time in recent years on this program reporting on the disastrous state of voting in Georgia. It is thought possible that the battleground state could finally flip to "blue" for this year's Presidential election and its TWO U.S. Senate races, but it continues to feature arguably offer the worst voting system in the nation.

By way of very quick summary of just a few data points to back up that allegation:

  • In 2016, after a huge purge of voters from the roles, we would learn after the Presidential election that Georgia's then Republican Sec. of State, now Governor, Brian Kemp, left the entire voter database and passwords to its voting systems unprotected online for download by anyone. When caught, he lied about it and wiped the entire server despite an ongoing lawsuit.
  • In 2018, a federal judge found the state's nearly 20-year old, unverifiable, easily-hacked touchscreen voting systems, mandated for use at the polling place in every county, to be outdated, insecure and unverifiable.
  • In that year's election, overseen by Kemp himself, he was narrowly found (by those same failed systems) to have "won" the Governor's race in a contest that his Democratic opponent, Stacey Abrams, regards as illegitimate due to, among other things, the purges and disproportionate rejection of absentee ballots cast by African-Americans.
  • Also in 2018, some 250,000 votes in the Lt. Governor's race inexplicably disappeared in black precincts.
  • In 2019, the federal judge ruled the state's voting system so insecure and unverifiable that they were, in fact, unconstitutional. She banned them from further use and ordered the system to be replaced by a new one.
  • In 2019, the new Republican Sec. of State Brad Raffensperger ordered new, similarly unverifiable, easily-hacked touchscreen voting systems to replace the old systems found to be unconstitutional, rather than move to a cheaper, VERIFIABLE, hand-marked paper ballot system recommended by voting and computer experts. The new $130 million systems failed in their first outing late last year and again during primaries this year, leading to hours-long voting lines in the Peach State, once again, largely in minority areas.
  • And we would also later learn that the new digital optical-scan computers used to tally hand-marked absentee ballots in the Peach State had skipped counting unknown thousands of votes during the June primaries, due to a software setting that allows election officials or the private voting system vendor or even hackers to dial up or down the sensitivity setting to determine which votes are counted or not.

All of which brings us to this week, as the Georgia chapter of All Voting Is Local unveiled a new analysis of rejected vote-by-mail ballots from the June primary elections in the state. You'll be shocked to learn that in the three counties they examined, the mail-in ballots from black voters were rejected at disproportionately higher rates than others. For example, in the Atlanta suburb of Cobb County, Black voters submitted 24 percent of the absentee ballots requested but accounted for 38 percent of mail-in ballots rejected by the County.

We're joined today by AKLIMA KHONDOKER, former ACLU attorney, now Georgia State Director for All Voting is Local, to explain her group's analysis and why the rates of absentee ballot rejection are so high for black voters in Georgia and, to a lesser extent, Hispanic and Asian voters as well. Khondoker warns that while the group only looked at three counties in Georgia --- finding similarly alarming statistics in each --- the problem likely extends not only to the rest of the state, but likely to many others around the nation.

"I don't think this is unique to Georgia. This is likely something we would see nationwide," she argues, citing the "institutional and structural racism that has led to the wealth of problems that we see in our elections. There is no way to cleave the two. Because we have a clear system that has always worked for one and not the other." She goes on to explain how this new analysis is just one more data point underscoring evidence that institutional racism "undercuts everything in our election systems."

The Trump dumpster fire continues at the White House today, with CNN filing a lawsuit to restore White House press credentials for White House correspondent Jim Acosta, fresh rumors of top Administration officials about to be axed, and a "stunning" public call from the First Lady to fire National Security Advisor John Bolton's top deputy. But it's still the ongoing dumpster fires in Georgia and Florida that we focus in on once again on today's BradCast, as Democrats and voting rights advocates fight to ensure all legitimately cast ballots are tallied and the results are accurately recorded and reported. With the news out of Arizona late last night night that the U.S. Senate seat of retiring Republican Jeff Flake has most likely been won by Democrat Kyrsten Sinema over Republican Martha McSally, many have lauded the GOP Congresswoman's gracious concession video Monday night, even as Trump and the RNC were reportedly pressuring her to advance phony claims of fraud and miscounts in the race. To her credit, she did not take the bait. But that's likely only because she still hopes to be appointed by the Governor to the state's other U.S. Senate seat in the coming months.

Meanwhile, in Florida, an unprecedented three statewide "recounts" are now underway (as we discussed in detail on yesterday's BradCast), with Republicans holding diminishing leads in both the U.S. Senate and Governor's race. Those so-called "recounts" must be completed by Thursday November 15th. But, as our guest yesterday, Ion Sancho (who oversaw the state's 2000 Presidential "recount") explained, it will be physically impossible for paper ballot tabulation computers in Palm Beach County to finish the job before the state's absurdly short and largely arbitrary deadline this week.

Today, a state judge in Leon County, FL extended that deadline for Palm Beach --- one of the state's most populous and Democratic-leaning counties --- until November 20th. (Note: I incorrectly called it the most populous on today's show. I mispoke. It's the third most populous in the state.) Will similar court orders for other counties, such as Broward, be far behind? If not, the incomplete results tabulated by last Saturday, November 10th, just days after the Tuesday midterm elections, will be used in the final results, according to state law.

Will Republicans file a federal challenge to today's state court order? GOPers have been repeating their Florida 2000 playbook which successfully robbed voters of a legitimate count (and, likely, Democrats of a Presidential victory) that year. Republican Gov. Rick Scott and Donald Trump have been offering up evidence-free charges of "fraud" in the vote count and ginning up protests outside tabulation centers. So, a similar federal legal challenge may not be far behind if the numbers keep narrowing against Republican Gov. Rick Scott in his Senate race against incumbent Democratic Sen. Bill Nelson, and against Republican Rep. Ron DeSantis in his gubernatorial contest against Democratic Mayor Andrew Gillum.

At the same time, in Georgia, the federal courts continue to find in favor of voting rights advocates. On Monday night, a federal judge ordered the state to hold off on certification of election results and to review the voter registrations of those forced to vote by provisional ballot. The judge in the case brought by Common Cause Georgia said the state must create a website or telephone hotline for provisional voters to learn whether their votes had been counted or rejected --- with detailed reasons for the rejection and an opportunity to cure whatever is said to be have been the cause of it --- before Friday.

In a separate case today, brought by the Coalition for Good Governance and the National Lawyer's Committee for Civil Rights, a different federal judge granted an emergency ruling to stop the unlawful rejection of Vote-by-Mail absentee ballots in Gwinnett County, GA based only on missing information such as a voters birth date. The judge found the state's process to be in violation of the federal Civil Rights Act.

We're joined today by Common Cause GA Executive Director SARA HENDERSON to try and make sense of the continuing dumpster fires in the state set ablaze by Republican vote suppressor Brian Kemp who resigned his position as Secretary of State last week after declaring victory in his race for Governor against Democrat Stacey Abrams --- even as the fight continues to tally thousands of uncounted or rejected absentee and provisional ballots. Kemp is reportedly leading the race with 50.24% of the vote, less than one-quarter of one percent above the 50% mark that would trigger a December runoff between him and Abrams.

Henderson explains that, thanks to the disastrous way Kemp has run the election, as well as how the state's electoral system has been allowed to whither over the past several decades, it's virtually impossible to know how many uncounted or incorrectly tabulated ballots remain across the state. "This whole circus that we're witnessing is just a product of years and years of defunding elections," she tells me.

Donald Trump is twiddling and fretty lest the US lose arms sales to Saudi Arabia, and what’s a missing journalist compared to that?

The ACLU is among those sounding the alarm about new regulations proposed for the National Park Service to inflict on White House protestors. It's ugly stuff; maybe the most blatant bit is shaving down to just five feet --- yes, FIVE FEET --- of White House sidewalk space allowed to protesters. That, and raising the cost of permits and fees. If you ain't got the coin, there goes your "free" speech. You can comment directly to the NPS, or via the page set up by the ACLU.

On today's BradCast: Trump gets even uglier as he's forced to back down on his lies about his immigration policies. A few election results out of D.C. and Arkansas. And some thoughts for progressive voters as we barrel towards this November's crucial midterms. [Audio link to show posted below.]

First up: A quick round-up of results and problem reports following primary elections on Tuesday in Washington D.C. (where voters adopted a $15 minimum wage measure for those in the service industry, despite a cynically and wildly misleading "Save Our Tips" campaign funded by the restaurant industry in opposition to Initiative 77) and in Arkansas (where runoffs were held following primaries and a computer tabulation "fiasco" late last month on 100% unverifiable touchscreen voting systems made by ES&S.)

Next: After repeatedly claiming he didn't have the legally authority to keep parents and children together after they were arrested crossing the border, Donald Trump buckled under growing political pressure and signed an executive order on Wednesday to allow parents and children to stay together after being arrested crossing the border.

Many questions (and legal challenges) lie ahead regarding the new policy and what will now happen to those 2,300 children ripped from their parents over the past month following the Administration's chaotic and ill-considered "zero tolerance" policy at the southern border.

We cover a number of related stories to all of that today, as well as some response to our coverage of the issue over the past week. That response includes a bit of a rant in return, regarding the necessity of voting for Democrats this November --- good ones or bad ones --- in service of putting some brakes on the disastrous cruelty and incompetence of Trump/GOP rule in D.C. (Or, for those who prefer the chaos and cruelty of the Trump Administration, and there are many who do, the option to vote for Republicans or stay home entirely in support of still more of it.)

I've got a bit of a rant today (and so does Desi) on the incredibly lazy argument, still heard from some progressives --- even after all that we've seen in the Trump Era --- that "both sides are the same". We've got a few words for those who forward arguments which support that notion, which serves only to perpetuate the worst of the Trump/GOP's inhumane and horrifically destructive policies.

Finally: As a reminder what can happen in a mostly normal, progressive country, Canada, on Tuesday night, ended 90 years of failed prohibition policy, by approving the sale and use of recreational marijuana across the entire country...

We catch up with a lot of news today, at the end of another ridiculously busy week, on today's very busy BradCast! But, hey, we start with a laugh and end with a song. So, it can't be all that bad, right? [Audio link to show follows below.]

Among the many stories covered on today's program...

  • Donald Trump's horrendous idea for arming school teachers and workers appears to have come straight from Archie Bunker, and it won't work out well, especially for black teachers;
  • After the NRA's A+ rated, Florida Gov. Rick Scott joins the NRA's A+ rated Florida Sen. Marco Rubio in blowing away Second Amendment straw-man arguments, he proposes a package of tepid gun reforms for the state in the wake of the Parkland, FL massacre, including barring those under 21 from buying a semi-automatic rifle;
  • A handful of D.C. GOPers also consider raising the federal age for gun purchases (though don't hold your breath, the NRA is against it.);
  • The problem isn't 'Washington' or 'Congress', it's Republicans, and it's time to remove them from office at the federal, state and local level;
  • After new charges against him and former Trump campaign chair Paul Manafort were filed on Thursday, Manafort's partner and former Trump aide Rick Gates copped a guilty plea on Friday and agreed to cooperate with Robert Mueller's Special Counsel probe. Mueller filed even more new charges against Manafort on Friday;
  • Trump may be about to fire his second National Security Advisor, Gen. H.R. McMaster;
  • Did Melania Trump's parents receive permanent U.S. residency, and soon citizenship, thanks to the "chain migration" (family reunification) program that Donald Trump and the GOP are hoping to kill in exchange for protection of DACA kids?;
  • Fox "News" reports that Defense Sec. James Mattis has quietly decided to allow transgender troops to serve in the military, despite Trump's declaration last year that they would be barred from serving "in any capacity";
  • New effort launched by Democrats and gun reform advocates to register high school students to vote in advance of the 2018 mid-terms;

And, finally, some closing thoughts on the heroically shining students of Marjory Stoneman Douglas High School and their performance of the song they wrote just days after a former student, armed with a legally purchased semi-automatic weapon, killed 17 of their fellow students and teachers and wounded more than a dozen others...

On today's BradCast, we try to make sense (wish us luck!) of Donald Trump's first, anything-but-normal State of the Union Address on Tuesday night. [Audio link to show follows below.]

After some quick news headlines --- (on another top Trump official resigning in shame, another senior Republican Congressman announcing he won't run for reelection, a Democratic Senator avoiding a second corruption trial, and a literal GOP train-wreck) --- we dive into our special coverage of what used to be a solemn and largely serious U.S. tradition.

We're joined today for commentary, fact-checking and other post-SOTU analysis by DAVE JOHNSON, longtime blogger, creator of "Seeing the Forest", and former Senior Fellow at Campaign for America's Future, and TARA DEVLIN, comedian, creator of RDTDaily.com and host of the weekly, TaraBuster podcast.

Desi Doyen joins us as well, of course, to help break down and fact-check Trump's misleading claims and outright SOTU lies on the economy, tax cuts, healthcare, immigration, drug prices, dangerous "national security" plans, his deceptive infrastructure proposal, his racist dog-whistles and shameless attempts at fear-mongering the American people during Tuesday night's joint session of Congress.

We also review just some of the things that Trump didn't mention in his speech for some reason (America's deadly gun epidemic and climate change, among others), whether Democrats will be able to counter the coming tsunami of GOP propaganda in advance of the 2018 midterms, and how Rep. Joe Kennedy, III performed in his Democratic Response to Trump's address.

"It's another flim-flam plan from the greatest con-man who ever lived," explains Devlin about at least one of the items mentioned above. "That's going to be one of those things that in a few months Trump is going to deny he said. It ain't gonna happen. The opposite is going to happen," says Johnson about another one of those items. Trump chickens out; WI and AL block elections; More embarrassment for KS; Help for sharks; And a perfect gift for the First Family...

After yet another exhausting and harrowing week in Donald Trump's America, as the Doomsday Clock inches closer to midnight, we try to lighten things up a bit, at least comparatively, on today's BradCast --- even if it's not always easy. [Audio link to show follows below.]

Among the many stories covered on today's program...

  • A few words about Donald Trump's reported attempt to fire Special Counsel Robert Mueller last June before chickening out, which the President describes today as "fake news";
  • Republicans are now, literally, trying to block democracy by preventing elections from happening at all. Gov. Scott Walker in Wisconsin and the GOP-controlled Alabama state legislature provide just the two latest examples;
  • Kansas' failed Governor Sam Brownback has, apparently, failed up, with an appointment by the Trump Administration, confirmed this past week by the U.S. Senate, after Vice President Mike Pence was brought in to break the tie vote in Brownback's favor;
  • Speaking of failures in the state of Kansas, their Secretary of State Kris Kobach, a long-time GOP "voter fraud" fraudster and now candidate for Governor, enjoys still more shame and ignominy this week, as it was discovered that he exposed private information, including the last four digits of social security numbers for thousands of state officials and employees --- including his own! --- on an unprotected Internet page;
  • The Guggenheim Museum declines to loan a valuable Vincent van Gogh painting to Donald and Melania Trump for use in their White House residence, but offers a solid gold alternative that seems perfect for the first family;
  • And, speaking of the first family, Trump's recently reported hatred of sharks --- revealed by adult film actress Stormy Daniels in the wake of revelations of her alleged affair with Donald Trump and $130,000 hush-money payoff just before the 2016 election --- has resulted in an outpouring of donations to shark charities across the nation and the world! See? Donald Trump can do some good in this world after all!

Beyond that, on today's program, we've got some encouraging news on voting rights in the state of Florida, believe it or not. A citizen initiative to allow former felons to vote has officially qualified for the state's November ballot, after an herculean effort to gather more than 800,000 qualified signatures by proponents who hope to help re-enfranchise some 1.7 million Floridians who have completed their sentences, many of them years ago.

While the grassroots effort has already been monumental --- as a segment from Sam Bee's Full Frontal highlighted last year --- the measure must still receive more than 60% approval from voters this November in order to amend the state's constitution. More former felons --- who are disproportionately African-American in FL --- are disqualified from voting in the Sunshine State than any other. Only they, Kentucky, Virginia and Iowa currently ban such citizens from voting for life. "Florida accounts for nearly 25 percent, or 1.6 million, of the people who have lost their right to vote" in the U.S., according to the ACLU. "As a result, one in ten Floridians are shut out of our democracy."

But, if it was up to the Trump Administration, there would be many more such felons in FL and everywhere else. We're joined today by criminal justice journalist JUSTIN GEORGE of The Marshall Project, to discuss his recent article looking at "Trump Justice, Year One: The Demolition Derby", in which he examines "nine ways Trump has transformed the landscape of criminal justice, just one tumultuous year into his presidency."

We discuss the many changes made by Trump's Department of Justice and Attorney General Jeff Sessions, as they attempt to "demolish" the legacy of the Obama Administration. From their rhetoric and tone on crime, the "drug war" and immigration, to policy changes on policing, sentencing, mass incarceration, the private prison industry, and in stacking the federal bench with rightwingers, Team Trump is hoping to unwind many of the criminal justice reforms successfully enacted by Obama and his DoJ, particularly in the later years of his Presidency.

But have Trump and Sessions' attempts to rollback Obama's criminal justice legacy, to date, been particularly effective? And, for that matter, why did Obama's efforts at reform come so late in his Presidency?

We cover a lot of ground in my conversation with George today, before somewhat departing from our usual beat to close with a bit of dirty laundry, sleaze, speculation and rumor mongering concerning Donald and Melania Trump --- though we've got a reasonable justification for doing so today...mostly...
