Welp, Election 2022 continues into its second week of counting on today's BradCast. But it's our first chance to open up the phones to listeners after last week's historic midterm face-plant by Republicans and its associated very very good news for Democrats and American democracy itself. [Audio link to full show follows this summary.]

Before we go to the phones today, a bit of a monster "rant" on the accomplishments of Joe Biden and the Democrats after two years in office; a few updates on races called since we signed off last Friday; what they all mean; and some of the races still being tallied (which will also determine, among other things, which party controls the House of Representatives next year.)

The big races called since our final show last week include the U.S. Senate contests in Arizona and Nevada, both of which went to the incumbent Democrats in each state (Sen. Mark Kelly in AZ and Sen. Catherine Cortez Masto in NV). Those victories ensure majority control for Democrats in the upper chamber of Congress once again in January. Dems will have at least a 50/50 majority with Vice President Kamala Harris as the tie vote, even before the December 6 Senate runoff in Georgia between incumbent Sen. Raphael Warnock (D) and Herschel Walker (R).

But there are a ton of reasons for Democrats in GA to not let down their guard. Dante Atkins, over the weekend, detailed just some of the reasons why a 51-49 Senate is much better for Dems (and democracy) than a 50-50 Senate.

While Dems were celebrating retaining their Senate majority over the weekend, we were celebrating the fact that the last of the 2020 Election liars running for Secretary of State in battleground states were declared to have lost. In AZ, Democrat Adrian Fontes will become the new Sec. of State after defeating Trump-endorsed insurrection enthusiast and voting opponent Mark Finchem. And in NV, Democrat Cisco Aguilar was declared the winner over Trump-backed election liar Jim Marchant, founder of the "America First Secretaries of State coalition," featuring all of those Republican SoS candidates who, thankfully, were rejected by voters in last week's elections across the country in every single swing-state in which they ran. That alone will make the 2024 Presidential election indescribably safer.

Throughout the program, we also take care to call out a few of the folks from the Republican Party, the corporate media, and the even some on the lazy, knee-jerk far-left who ignored the available data and facts in order to misinform American voters that the GOP see a red wave, or even red tsunami, in last week's midterms. They didn't. They lost a seat in the Senate; will be lucky to win the narrowest of majorities in the House; lost Governorships in Maryland and Massachusetts (and, perhaps, Arizona, which is still close); took full control of both the Michigan and Minnesota state governments and may do the same in New Hampshire and Pennsylvania, just to detail a few of the GOP's remarkable failures in a year that Conventional Wisdom suggests they should have owned the night.

Also, mid-hour today, we get an update in the tallies of the very right Los Angeles Mayoral race where progressive Rep. Karen Bass just got a big boost from the latest numbers in her contest against "former" Republican billionaire real estate developer Rick Caruso.

Then, we turn to the phones for the first time since last week's midterms to get some thoughts from listeners on what the lack of "red wave" means for both Democrats and Republicans and whether any of it will help break the GOP's Trump Fever that is destroying both them and our democracy along with it (though not this week, at least!)...

On today's BradCast: It's no surprise that Fox 'News' deluded itself for months and even years about a "red wave" or "tsunami" coming for the 2022 midterm elections. It shouldn't be a surprise that the theoretically legitimate media got it wrong as well, given that they seem to make the same errors election after election. And yet, it's both surprising and disappointing, given that the data to counter their erroneous narrative was right there in front of their face the whole time...if they simply bothered to, or had the courage to, listen to it. [Audio link to full show follows this summary.]

"There was nothing magical about what I did," our guest today, TOM BONIER of the Democratic data research firm, TargetSmart, explains. "It was, as you say, seeing the numbers and reporting the numbers and, in the end, trying to stay away from predictions or projections, but to say, 'Look, this is what we're seeing'."

Bonier's well-documented Twitter threads on the data over the past many months spelled out what shouldn't have been a surprise to anyone. In the face of extremism from the right and, in particular, the Supreme Court, there was a backlash against Republicans which served to boost Democrats across the board.

Prior to today, Bonier joined us twice in recent months to discuss his analysis of data and what he was seeing and tweeting about to anyone who might have wanted to listen. In late August, after voters in deep red Kansas decisively rejected a ballot initiative that would have rewritten the state constitution to allow abortion to be banned, he joined us to explain what he saw as a "jaw-dropping" spike in new voter registrations for young, Democratic women following the Supreme Court's Dobbs decision in late June, overturning Roe v. Wade. Bonier saw similar spikes in new registrations all over the map, in "red" and "blue" states alike, but particularly where reproductive rights were most threatened.

In late September he joined us again after analyzing specific voter data from that failed Kansas referendum. Hard evidence of an incredible spike in women voters that, he told us at the time, "just doesn't happen in elections." He posited that any suggestion that Democrats would be swamped in November, as the so-called Conventional Wisdom offered by pundits would have it, was simply ignoring the available data. He argued the election would be very close and almost certainly not a "wave" for the GOP.

He was right. Even though, over the past month in the run-up to Election Day, the corporate media were, largely in lock step, warning that Dems were done for, soon to be swamped by a red wave or even tsunami! How much of that erroneous punditry "blunted" the final results, Bonier laments, citing races like Mandela Barnes' in Wisconsin, where the Democratic candidate for U.S. Senate fell just shy of unseating incumbent Republican Ron Johnson by a single point.

"I like to think of myself as an optimist, but it was difficult over the last few weeks and months," he tells me. "In reality, what we do at TargetSmart is we listen to the data. That's all we were doing. Along the way I was looking at the voter registration data, looking at the early vote data, looking at it in the context of the polls and trying to draw some conclusions. But mostly providing context and questioning the hard-set assumptions that were really leading everyone."

We discuss, among other things, the "flood of Republican polling" in the last few weeks of the campaign and how it warped forecasts from poll aggregation sites like FiveThirtyEight, and how his fellow traveler, Simon Rosenberg, who also had it right, was "mocked" when he highlighted how forecasts were being swamped by those bad GOP polls.

By itself, the media failure "doesn't happen. It took some level of complicit behavior from those who should be guards against it," Bonier insists. "People are mocking Fox News at this point. We know it is a very biased Republican media platform. But the bottom line is most of cable and these other outlets had a level of certainty about this outcome in a very similar way. I have to say, as I spoke with reporters in the closing weeks, I would be telling them 'Look, this is going to be a close election. I don't see a Republican wave. I don't see that in the numbers.' And I was just short of mocked by reporters."

But, why? Is it a lack of courage to stray from the pack journalism and group think? Or, as media critic Dan Froomkin argued today, a symptom of systemic "rot" in the political media? Bonier offers his frank thoughts on that and much more as we dig deep in today's discussion. I strongly urge you to tune in for it in full.

And, we've also got the latest reported results out of still uncalled critical races for U.S. Senate, Governor, Sec. of State and Attorney General in Arizona and Nevada...

On today's BradCast: It has been nearly two weeks since Hurricane Ian slammed the great state of Florida, leaving behind a swath of destruction across much of the state. Midterm elections, meanwhile, are now just 4 weeks away, but FL's chief elections official --- its Governor, Ron DeSantis --- has yet to approve a plan for how to carry them out amid the rubble. [Audio file to full program follows this summary.]

Last week, Tommy Doyle, Supervisor of Elections in Lee County, home to Fort Myers, the hardest hit part of the state, released a proposal to extend early voting at 12 sites, turning them into Voting Centers where anyone in the County can vote from October 24 through Election Day on November 8. That, in place of the County's normal 97 community precincts, many of which were blown entirely away by Hurricane Ian.

But, according to our guest today, DeSantis has yet to respond to Doyle's proposal, despite the fact that much of the country is already voting in the critical midterms, while many Florida residents do not even have a mailbox left to send vote-by-mail ballots to. Furthermore, as our guest today --- a legendary former Election Supervisor in FL's Leon County (which includes the state capital of Tallahassee) --- notes, allowing the expansion of early voting and use of Voting Centers is now illegal in the state, despite a similar plan to hold elections carried out just after Hurricane Michael in 2018.

The great ION SANCHO, who retired in 2016 after nearly 30 years as Leon County's elections chief, joins us today to detail the very serious --- I would say, critical --- mess the state is currently in when it comes to carrying out the upcoming midterms. DeSantis, a Republican, happens to be running for re-election this year against the Democratic nominee, former Governor Charlie Crist. There is also a very tight race between incumbent GOP Senator Marco Rubio and his Democratic challenger Rep. Val Demings.

Sancho notes that Hurricane Michael, which made landfall in a rural area of the state's panhandle, ended up decreasing turnout there by about 8% in 2018. But Ian hit one of the state's most densely populated areas. "It's a terrible situation," Sancho tells us, describing how "most of the precinct sites have been destroyed." Supervisor Doyle, he explains, has plans to run Voting Centers in Lee County "all the way through Election Day with expanded hours, which is illegal in Florida. You may not have early voting, for example, or a Vote Center open on Monday, or on Election Day."

Many of these problems come thanks to the state GOP's newly discovered hatred for absentee voting and other restrictions on voting passed after 2020 to make it more difficult to do so. Many of the suggestions for how to carry out the elections after Ian are the same as those carried out after an order signed by Gov. Rick Scott following Michael. But now, says Sancho, "we are all on pins and needles. Governor Scott issued his executive order giving the Supervisor of Elections expanded authority to deal with his voters eight days after the hurricane hit. We are now on Day 12 and Governor DeSantis has not told any Supervisor anything."

There are also political considerations likely in play for DeSantis. "He's in a pickle. He needs to provide expanded voting access, and that is made more critical by the fact that the areas that were hit were 2-to-1 Republican over Democrat," Sancho says. "The best that we can hope for is he gives the Supervisor of Elections the same kind of flexibility as Governor Scott gave the Supervisors in the Panhandle to deal with Michael. But [DeSantis] may be loathe to do that because it means he has to recant some of the things that he did this past legislative session."

It's not only Lee County where election plans have been rocked, Sancho explains. "I would count at least 9 counties. It caused a swath of destruction across the state. This is a huge number of voters." Nonetheless, early voting is supposedto begin in the Sunshine State in just two weeks. Whether that can happen remains anyone's guess at this hour. Suffice to say, my experience was, once again, very different from Desi's. But, if you haven't gotten a COVID shot lately, now is not a moment too soon to protect yourself and everyone else from the likely autumn/winter surge.
  • An explosion on the only bridge between Russian-annexed Crimea and the Russian mainland collapsed a portion of it over the weekend, and Russia's main military supply line to its war of aggression against sovereign Ukraine in the south along with it. In response today, Russia's Vladimir Putin doubled down on his many war crimes to date by launching another massive missile strike against nearly a dozen densely populated civilian areas, include Kyiv, Ukraine's capital.
  • Finally, from the war between autocracy and democracy oversees, to the same (if, so far, less bloody) conflict here at home. If they are Republican and on the 2022 ballot, chances are they are a denier of Joe Biden's 2020 Presidential election victory and/or will vote against certification of the next Presidential election if a Democrat is established once again to be the legitimate winner. Many GOP candidates across the country have been shifting their public positions on Trump's evidence-free claims of a stolen 2020 election following the primaries, in hopes of trying to fool more mainstream general election voters. But, don't be fooled. Some, like Mark Finchem, Arizona's GOP nominee for Secretary of State nominee, even claims to be an opponent now of vote-by-mail. ("I don't care for mail-in voting. That's why I go to the polls," he lied at a recent debate, before a public records search revealed last week that he has voted by mail in every election since 2004, and only voted in person this year for the first time since then.)

    A Washington Post analysis last week found "A majority of Republican nominees on the ballot this November for the House, Senate and key statewide offices" are, in fact, election deniers and "running in every region of the country and in nearly every state. Republican voters in three states nominated election deniers in all federal and statewide races The Post examined." That includes critical roles --- such as Governors and Secretaries of State --- responsible for certifying the 2024 Presidential election. We share some of the evidence of those lying, dishonest candidates and their deceptively shifting position presented a threat to American democracy, on today's program...

With the bipartisan January 6 Committee having postponed today's hearing, we take the opportunity on today's BradCast to spend some time rebutting the disgraced former President's supposed rebuttal to the two damning hearings held to date. But, of course, we've got much more as well, including election results from Tuesday and evidence of both voting system problems and bad faith elected MAGA officials already trying to disenfranchise 2022 voters. Among the stories covered on today's program...

  • An error caused by paper jams during ballot scanning on Election Day at the precincts on the state's computer tabulators in Iowa during their June 7 primaries has reportedly resulted in a whole bunch of recounts across the state. Cedar Rapid's KCRG cites an email from the Sec. of State's office which has lead to those recounts, in hopes of reconciling the number of ballots misreported by the scanners as cast with the number of voters who actually signed in to vote.
  • Noteworthy election results from four states which held primaries on Tuesday (Maine, Nevada, North Dakota and South Carolina) and one (Texas) which purposely held a low-turnout U.S. Special Election yesterday, instead of at the same time as their regular primaries in March or primary runoffs in May. While we cover a lot of Tuesday's races, and why they matter (or don't), the most disturbing one is likely the Secretary of State's race in Nevada, where a 2020 election denialist by the name of Jim Marchant has apparently won a 38% plurality to become the GOP's nominee to become the critical swing-state's chief election official in advance of the 2024 election.
  • The dangers of an election denier like Marchant, who served as one of the state GOP's fake electors in 2020, and who has said he wouldn't have certified Joe Biden's victory over Donald Trump that year had he been SoS at the time, is a stark warning of what lies ahead. But we're already seeing the dangers of brain-poisoned MAGA Mobsters in positions of elected authority. The three-person County Commission in a very right-leaning rural county in New Mexico, is refusing to certify results from their June 7 primary. Even though votes are cast on hand-marked paper ballots across the state, the County Commission unanimously voted against certification of primary results, citing distrust of the County's digital ballot scanners made by Dominion Voting. They have no evidence of fraud, which might otherwise allow a court to order the hand-count they are seeking. They just don't trust the results in the County where Trump won 62% of the vote in 2020. The Republican County Clerk is furious and the Democratic Sec. of State is now suing the County Commission ahead of this Friday's deadline for County certification. Expect much more of this in the months and years ahead. We've long warned about exactly this type of fallout from our irresponsible rush to the use secret vote casting and counting systems made by private vendors and the avenues it opens for opportunists to claim fraud without any evidence of same.
  • On Monday night, after the bipartisan U.S. House Select Committee investigating the January 6, 2021 attack on the Capitol and other efforts by Trump to steal the 2020 election, our corrupt former President issued a 12-page rebuttal [PDF] to the Committee's first two hearings. We rebut his dumb rebuttal today. It leans heavily on tired, long-ago debunked nonsense, such as his lead in some swing-states on Election Night "inexplicably" disappearing (after heavily-Republican polling place ballots were quickly tallied before the arduous task of opening and verifying and counting heavily-Democratic vote-by-mail ballots one-by-one) and how thousands attended his rallies, while Biden chose not to hold super-spreader events during the worst pandemic in 100 years. Much of Trump's (ghost-writer's) claims were already debunked during the Committee hearings to date, which he seems to presume that his supporters didn't watch or are too dumb to understand.

    Trump's ghost-writer spends most of the rebuttal ink citing what is laughably described as "indisputable proof" of "Ballot Trafficking" presented in the repeatedly debunked 2000 Mules movie. That's a pretend documentary film created by a long-discredited GOP "election integrity" group named True the Vote and a rightwing activist named Dinesh D'Souza who actually pleaded guilty himself to several federal election fraud crimes before he was later pardoned by Trump.

    As noted, the film has been repeatedly debunked, including by us, several times by now. Months before it was even released, the Georgia Bureau of Investigations (GBI) and FBI concluded the group's claims about cell phone data purporting to reveal evidence of "ballot harvesting" by "mules" of tens or hundreds of thousands of fraudulent ballots cast in drop-boxes, in fact, reveals no crimes at all. A GA state Board of Elections investigation after the movie's release found that supposed "ballot mules" in Atlanta, shown via security camera footage in the film, were just regular voters legally casting their own ballot and those of direct family members. None of the "mules" are ever seen in the film visiting a drop-box or multiple boxes more than once.

    But, perhaps the most stinging rebuttal came from Trump's own Attorney General, Bill Barr this week. During sworn testimony to the J6 Committee, shared by the panel on Monday, Barr laughed out loud at even the mention of the name of the film, before going on to explain how he found it to be "singularly unimpressive," "indefensible," and that it failed to "establish widespread illegal harvesting." That, of course, is a long way from the "indisputable proof" Trump's dumb rebuttal claimed it to be.

  • Finally, speaking of the House J6 Committee, Republican Vice Chair Liz Cheney released a video teaser on Tuesday for its next upcoming hearing scheduled for Thursday. This one will focus on the pressure Trump placed on Vice President Mike Pence to help him steal the 2020 election by tossing out valid Electoral College votes on January 6, 2021. Cheney's teaser video includes testimony from one of Trump's top White House attorneys who says he warned outside lawyer John Eastman, who developed the scheme for Pence to toss out the votes, to "get a great f'ing criminal defense lawyer," adding "you're gonna need it."
