County election boss claims there's no deadline for manual count of e-voting 'paper trails'
State SoS seems to disagree...
By Brad Friedman on 1/31/2009 2:26pm PT

We know what the excuse is in MN, but what's the excuse in Riverside County, CA?

Seems there is none, other than County Registrar Barbara Dunmore's hope to ensure the county remains one of the absolute worst places to cast a vote in the entire nation (and there's some stiff competition there!)

Though Dunmore certified the results of last November's election on Dec. 2 as "full, true and correct" --- 28 days after the election, as per state law --- it turns out she's still counting votes, months after the election. In secret...

The new Hillsborough Co Florida elections boss has saved the county $500,000 by going to Premier/Diebold and making them a deal they could not refuse. Of course with the problems the county had last Nov with uncounted ballots and memory card failures, Diebold should have returned all of the money the county has spent on their voting system and taken the machines back....

Wherein everybody flip-flops, Coleman makes a successful argument, but may have blown it with a 'phony' website crash and an horrendous argument for Internet voting...
By Brad Friedman on 1/30/2009 3:41pm PT

This afternoon, Day 5 of the U.S. Senate election contest between former Sen. Norm Coleman (R) and apparent winner of the '08 election Al Franken (D), Coleman offered another reason, just in case you needed one, to oppose his return to the Senate:

In a press conference outside the courtroom held just a short while ago, Norm Coleman announced that if he gets back into the Senate, he'll work on ways to make it easier for young people to vote online.

While we're in favor of "young people," and as many other legal voters who wish to vote, actually getting to cast their votes and have them accurately counted, if you like our currently unreliable electronic vote counting systems, which employ untested, unsecured, hackable garbage, then you'll love seeing that system opened up to the Internet!

All that said, however, where Coleman's case began on Monday as little more than a comedy of one error after another, as we explained in some detail earlier this week, over Days 4 (yesterday) and 5 (today), his legal team seems to have found a bit of footing, even if they've had to counter most of their own legal arguments that they'd made previously to keep ballots from being counted during the post-election hand-counting of ballots.

At the end of that process, Franken was found, by the state canvassing board, to have defeated Coleman by 225 votes, out of 2.9 million cast, even though Coleman was slightly ahead in the vote count during most of that time, and thus, argued adamantly against including as many previously rejected absentee ballots as he could.

But that was then, when he thought he was winning, and this is now, when he seems to be losing...

Senior Democratic House Judiciary member confident rule of law will be followed by Dept. of Justice under President Obama
NEWSWEEK: Before leaving office, Bush counsel ordered Rove, others, not to testify to Congress, arguing 'absolute immunity' from compelled testimony...
By Brad Friedman on 1/30/2009 12:33pm PT

A senior Democratic Congressman on the U.S. House Judiciary has said that either Karl Rove will testify before the committee, or he will go to jail. In the meantime, it has also now been learned, legal counsel for George W. Bush issued a letter just days before leaving the White House, claiming Rove, Bush, and other senior staffers have "absolute immunity" from testifying to Congress in the future.

Speaking on MSNBC, Judiciary member Rep. Jerrold Nadler (D-NY) said last night that if Rove fails to show, in answer to a subpoena issued earlier this week, he'll be cited for Contempt of Congress. Then, he said, "the grand jury indicts him, you arrest him for contempt, and you put him in jail until he is prepared to testify to obey the subpoena." (More details, as well as video of the Nadler interview, follow below.)

Most of the news is still coming out of Minnesota and the courts where Norm Coleman is trying to prove that he should still be the state’s senator. Most of the reports seem to point to unsuccessful arguments on the part of Coleman’s legal team. How much longer can this go on?...

Two Segments, Four Guests, All Republicans...
By Brad Jacobson on 1/29/2009 3:03pm PT

Guest blogged by Brad Jacobson of MediaBloodhound

If you're Chris Matthews and you're attempting to regain a reputation for being "fair and balanced" after famously exhibiting excitement about Barack Obama and his presidential campaign, what do you do? How about facilitating a discussion about Obama's proposed stimulus plan with two lawmakers from the same party, the Republican Party?

That's precisely what Matthews did during a segment on his January 27 edition of Hardball, inviting only Senator John Ensign (R-Nevada) and Representative Mike Pence, the House Republican Conference Chair, to discuss the plan.

Not enough?...

Rove on Conyers: 'He's Captain Ahab and I'm the whale'
O'Reilly: 'If you need a place to hide, we have it here at The Factor'
By Brad Friedman on 1/29/2009 2:23pm PT

Last night, on Bill "Paul Revere" O'Reilly's show on Fox "News," Karl Rove said he planned to refuse to testify before the U.S. House Judiciary Committee next Monday, as required by the new Congressional subpoena he was served on Monday.

Mr. "Revere" noted, at the end of the interview, that he offered Rove the opportunity to not discuss the issue on the program. "I told Mr. Rove, 'Look, if you don't want to talk about this tonight, you don't have to,'" the hard-nosed, fair and objective, no-spin "newsman" said.

Offering further to further aide and abet Rove in dodging the rule of law and a Congressional subpoena, the courageous O'Reilly told Rove, "If you need a place to hide out, we have it here at the Factor." Impressive stuff. Video via RAW STORY...

UPDATE 1/30/09: House Judiciary's Rep. Jerrold Nadler (D-NY) says Rove will either testify or go to jail. (Also, hearing date postponed to Feb. 23rd) Video, details...

Any of you America-hating lying liars in the Republican Party ready to apologize?
(Didn't think so.)
By Brad Friedman on 1/29/2009 12:40pm PT

After all the stuff, nonsense, bullshit, lies, hoaxes, WSJ "editorials", Fox "News" Alerts, Presidential candidate lies, phony "conspiracy" claims, and-wall-to-wall cable and radio garbage that we had to endlessly suffer through, for months on end, leading up to last year's election, about supposed, massive "voter fraud" being committed --- by Democrats, naturally --- it turns out that in one of OH's largest counties, an exhaustive investigation by a Republican Special Prosecutor, appointed by his former GOP prosecutor partner (the Hamilton County Prosecutor who was also a state co-chair for the McCain/Palin campaign), looked into hundreds of "serious" allegations of such "fraud" and found exactly one such case.

One case.

No, it wasn't Ann Coulter. She commits her voter fraud in FL and in CT instead. But it was someone who had already turned himself in. His vote was never counted.

That's it. One case. Out of nearly half a million votes cast in Hamilton County, just one fraudulent vote was found. The Special Prosecutor's report is here [PDF].

After an entire season, using facts and reality-based information to fend off the insidious, America-hating forces of the evil Republican War on Democracy and their attempts to undermine the very core, the very heartbeat of our democracy, of our nation, for little more than attempted, pathetic --- and ultimately futile --- political gain, is anybody gonna apologize here? Anybody?

Rush? Sean? O'Reilly? John Fund? John McCain? John Danforth? Karl Rove? Tom Feeney? "Thor" Hearne? Todd Rokita? Jackasess at Powerline? Jackasses at Redstate? The entirety of the shameful, unpatriotic Fox "News" Channel? Anybody? Any of you liars and cowards and thieves and democracy-hating, facist-loving, Stalinesque, Saddamites have the guts, the courage, the sense of decency --- the love for your country --- to stand up and say you were wrong? That you are sorry?

Anyone? Anywhere?

Of course not. Especially not in Minnesota where not only have they found no such "voter fraud" epidemic --- as committed by Democrats or ACORN or anybody else --- but the Republicans are now trying to include actual fraudulent ballots in the results of the U.S. Senate race. Now that they need them in hopes of "winning".

No apologies, of course, because they'll all be back in two years and the same horseshit will be flowing loud and clear, once again from their democracy-hating souls, out to millions of Americans who are ready to believe --- listening over the corporately-run, though publicly-owned airwaves --- all over again and again and again. And again.

Not that they'll wait that long. Measures claimed to supposedly prevent (non-existent) "voter fraud" --- little more than measures meant to rob minorities, the elderly, students, and anyone else who tends to not vote Republican, of their Constitutional rights --- are moving forward, as John Gideon noted last night, and even as we speak, in TX, in UT, in MS and wherever else you can find depraved, soulless, Republican cretins who despise America, its history, and all that it pretends, and tries desperately, to stand for.

I am ashamed to call you people my fellow citizens.

As we promised, The BRAD BLOG covered your electoral system 2008, tirelessly, fiercely and independently, like no other media outlet in the nation, facing down the liars and cowards and democracy-haters of any and all parties. Please support our work, which only you help to fund, with a donation to help us continue the work so few are willing to do. If you like, we'll send you some great, award-winning election integrity documentary films in return! Details on that right here...

The trial against the use of unverifiable voting machines in New Jersey is continuing. Computer scientist Andrew Appel was before the judge tearing apart a Sequoia Advantage DRE voting machine to show how easy it would be to get into the machine and replace memory without anyone ever knowing about it. The trial is expected to take a couple weeks.

Mississippi and Utah have joined Texas in their misguided attempts to push through voter ID laws to combat non-existent voter fraud. In the meantime, one Ohio county has reported that after investigating claims of wide-spread voter fraud in Nov. a special prosecutor has found only one case and in that one the man involved told on himself....

Wherein 'voter fraud' no longer matters to Republicans...
By Brad Friedman on 1/28/2009 4:07pm PT

While former radio talk show host and author Al Franken is consistently described in corporate media reports as "comedian Al Franken," it seems it's the legal team of former Senator Norm Coleman who are providing the laughs in the first days of the U.S. Senate election contest up in Minnesota.

When even the unapologetic, rightwing, "Franken is stealing the election!" nutcases and conspiracy theorists at Powerline describe Coleman's legal case as being of "Three Stooges quality," you know these guys must really be falling apart.

Such seems the case again on yesterday's Day 2 of the trial, following the disastrous Day 1 when the 3-judge panel tossed out doctored evidence, as submitted by Coleman's team. Today's Day 3 doesn't seem to be going much better for them, either.

Yesterday, two of the six voter/witnesses called by Coleman, to testify how they were disenfranchised when their absentee ballots were rejected, actually admitted that their ballots were properly tossed because they were, in some way, incorrectly --- or even fraudulently --- cast...

Endowment would save struggling papers from need to meet profit goals, while promoting journalistic independence, argue financial analyst authors...
By Brad Friedman on 1/28/2009 1:09pm PT

In light of mainstream newspapers beginning to collapse around the country --- yes, the rise of the Internet is a substantial reason for the troubles they face, but their own failures, for so many long years, to meet their Constitutionally protected role as Fourth Estate watchdogs for the American people is also key to their downfall --- we're faced with a dilemma.

While they are, in many ways, responsible for their own potential/pending demise --- evidence for that critique littered throughout thousands of our very own pages here --- we also recognize the critical importance of a robust, well-funded, mainstream free press.

So what to do? In an op-ed in today's New York Times, David Swensen and Michael Schmidt (both financial analysts) suggest the nation's mainstream newspapers should go non-profit and be turned into endowed institutions "like colleges and universities" to "enhance newspapers’ autonomy while shielding them from the economic forces that are now tearing them down."

We don't yet have an opinion on this new idea, so we share it here in hopes of your thoughts on it. One point, however, in Swensen and Schimdt's argument is particularly tantalizing: the "journalistic independence" they contend we might see in such an overhaul of our nation's old media...

Darn those Bush-hating liberals at that Bush-hating liberal New York Times, as John Byrne explains at RAW STORY...

Karl Rove has been subpoenaed for a second time --- the first sign that Democrats under President Barack Obama's tenure will boldly go after Bush Administration officials in scandals that outlast his presidency.

You probably wouldn't have known it, though, had you read Tuesday's New York Times. The Times ran the story with a four sentence Associated Press brief on page 19 of the national edition and page 23 in New York City.
...
The Times' four sentence brief ran after the stories in the National Briefing, "California: Union Local Seeks a Vote," "California: Second Set of Octuplets Born," "Tennessee: Plea Deal in Nuclear Case" and "Guilty Plea in Iran Exporting Case."

Today the New Jersey voting machine trial started. The trial will decide whether the state’s DRE voting machines can continue to be used or whether they are error-prone and too easily hacked. Today Princeton University computer scientist Andrew Appel demonstrated how the Sequoia Advantage v 9 DRE works. The trial may last as long as four weeks....

By Brad Friedman on 1/27/2009 1:50pm PT

And speaking of Rightwing rubes and hacks enjoying big salaries from seemingly-respectable mainstream corporate media outlets, Bernie Goldberg has released his silly new book, A Slobbering Love Affair: The True (And Pathetic) Story of the Torrid Romance Between Barack Obama and the Mainstream Media, but the well-documented coverage of the book's arguments, so far, suggests it's a lollapalooza of inaccuracy, fudged facts, and mangled and out-and-out doctored "evidence". Color us stunned.

Media Matters has begun to fact-check the book, and has, for example, meticulously examined what Goldberg describes as "snippets" from an interview with NBC's Tom Brokaw, conducted by PBS' Charlie Rose, that purportedly reveals how Brokaw, and his Obama-loving big media brethren were in the tank for Obama from the git.

The only trouble? Goldberg has out-and-out doctored the transcript of the actual interview to make his case by completely re-arranging comments (often putting them entirely out of order), changing actual words to give them entirely different meanings than obviously intended when viewing the actual transcript, and leaving out huge chunks of the discussion which completely counter the argument being made by Goldberg --- who laughably considers himself both a journalist and a media crictic --- to try to sandbag the targets of his hit piece.

For example, at the end of one of the books many snarky grafs in which Goldberg argues that Brokaw waited until "just before Election Day to decide that he had no idea who Obama was," Goldberg sniffs "Ain't journalism wonderful?"

He then offers some of the "snippets" from that interview to help make his case, like this one:

ROSE: What do we know about the heroes of Barack Obama?

BROKAW: There's a lot about him we don't know.

Brokaw's busted, right?! Not so fast. Because now it gets high-larious. Or, at least it would be high-larious, were it not for the seemingly endless wingnut welfare available to the rube Goldberg and his ilk, from multi-million dollar propaganda houses like the rightwing whacko Regnery Publishing, who describe themselves, accidentally(?) ironically, as "a hit machine".

So, here's how MM dissects what was actually said, as documented by the actual, unedited transcript of the Brokaw/Rose interview, as compared to Goldberg's wholly mangled, out-of-context, out-of-order, "quoted" snippet above...

As our “Featured” article reports California Secretary of State Debra Bowen has sent a letter to new EAC Chair Gineen Beach. The letter has three proposals that Secretary Bowen is convinced will improve the integrity of voting systems used in the country. As stated in the article we at VotersUnite have also worked on this issue. The three proposals are that vendors should be required to disclose vulnerabilities, flaws, problems, etc. Also, the EAC should create a uniform incident reporting program. And finally, the “Election Day Survey” the states are asked to complete should include data from election officials about how their voting systems performed during a general election. We applaud Secretary Bowen for taking a stand on this issue....
