Some good news, some bad news, and the most difficult news of all for talk radio: nuanced news on today's BradCast. [Audio link to full show is posted below this summary.]

Among the many stories covered on today's program...

  • Texas has finally figured out that home solar panels and battery storage can help save the state's brittle, failing electric grid this winter. That's good news for Texas, Tesla and homeowners who can make money selling excess energy back to the grid.
  • There is actually quite a bit of good news for renewable energy according to a new report this week from the International Renewable Energy Agency, as per the New York Times' Ivan Penn today. Top line: As solar and wind production are now cheaper sources for electricity than fossil fuels, renewables now dominate all new electric energy capacity (81% last year) and, if the current trajectory continues, are likely to very soon generate more electricity globally than fossil fuels.
  • Even the Brothers of Italy --- the actually fascist right-wing party which recently won a Parliamentary majority in Italy --- and its far-right leader Giorgia Meloni (soon to become Prime Minister) appear to be more progressive on climate change concerns than the Republican Party in the U.S. It's kind of remarkable really and, yes, a bit nuanced.
  • Speaking of fascists, with early voting now under way in many states for the critical 2022 midterms, so is the voter intimidation and suppression by disinformed rightwingers. MAGA Republicans in Arizona appear to be taking the early lead nationwide when it comes to reported intimidation, as armed and masked vigilantes in tactical gear are now camping out in parking lots near absentee ballot drop boxes because they've been duped into believing they are used for massive voter fraud. While some of the few remaining GOP officials in the state who haven't become brain poisoned are trying to lower the temperature, others, including MAGA Republican Gubernatorial nominee Kari Lake and MAGA State Sen. Kelly Townsend continue to fan the flames with lies about the 2020 election.
  • Meanwhile, however, in defending against Donald Trump's lies about election and voter fraud, Democrats may have backed themselves into a corner when it comes to their own ability to challenge election results themselves. In their ill-considered efforts to force Republicans into answering gotcha questions about whether or not they will accept election results for elections that haven't even happened yet --- which could include outcome determinative problems like voter suppression or problems with voting and tabulation computers --- Dems may have short-circuited their own ability to challenge results that legitimately need challenging. We discuss.
  • At the same time, MAGA rightwingers in several rural (heavily GOP-leaning) Nevada counties are certain that Dominion Voting Systems done them wrong in 2020. So now they're demanding hand-counted paper ballots. While hand-counting is, in fact, the only way to know for certain if computers actually tallied ballots as per voter intent, the NV GOPers who bought into Trump's evidence-free fraud conspiracies are doing it all wrong. One county has even been given permission by the state Supreme Court to begin hand-counting early ballots beginning this week. That is a recipe for all sorts of disaster, including unlawful leaks about early results.

    And here comes more nuance: While we have spent nearly two decades decrying computer-tabulated ballots, we have called not for hand-counting, but for hand-count pilot projects to determine its feasibility in each jurisdiction and to develop simple, efficient and publicly-overseeable protocols to do it safely and transparently at the precinct on Election Night, in front of everyone, before ballots are moved anywhere. (Similar to how it has been successfully been done for many years now by about 40% of the towns in New Hampshire.)

    Ad hoc hand-counting (for example, like the kind that took NV's Esmerelda County more than seven hours to tally 317 ballots after their June primary!) is a disaster in the making and one that is likely to end up discrediting real hand-counting for years to come. I hope I'm wrong.

    In the meantime, there are critical contests in the state this year, including a very tight race between incumbent Democratic U.S. Senator Catherine Cortez Masto and Republican Adam Laxalt. If she is reported to have lost and there are any questions about the results, good luck to the Dems after shortsightedly decrying any and all concerns about elections when they may need to challenge an election themselves.

OH AG looks $5.5B federal gift-horse in mouth; AZ GOP sanctioned for 'groundless' lawsuit after well-run 2020 election; Repub attacks on democracy seek to send voters to 'Back of the Line'...

It's a bit of a grab bag on today's BradCast, but one that will hopefully keep you well prepared for your next conversation with any of your still brain-poisoned wingnut friends, family and coworkers.[Audio link to full show is posted below summary.]

Included in our grab bag of coverage today...

  • Ohio's Republican Attorney General Dave Yost is suing the Biden Administration because the $350 billion that the Democratic COVID relief bill (the American Rescue Plan) allocates to help all 50 states overcome a revenue cash crunch includes a provision that prevents states from using that free federal money to finance state tax cuts.
  • Of course, Ohio could also just refuse to take the $5.5 billion earmarked for them in the federal legislation, which not a single Republican voted for in the U.S. House or Senate, often describing it as a "blue state bailout". But, because we believe in facts around here...As detailed in a new report this week from the financial website WalletHub, Ohio's Republican-majority state government ranks 16th among those most dependent on the federal Government. In fact, the site's latest annual analysis finds that 11 of the top 12 states most dependent on D.C. are all controlled by Republicans, while 12 of the 14 least dependent are run by Democrats. In other words, "blue" state taxpayer dollars continue to be a perpetual "red" state bailout.
  • With the election of Joe Biden and two Democratic U.S. Senators in Arizona (the 7th most dependent on federal dollars), the state is finally trending "blue", even as Republicans still hold control of the state legislature and governor's mansion. But turning "purple" is only leading the state Republican Party to lurch farther and farther to the right under the embarrassing --- and now costly --- leadership of AZ GOP Chair Kelli Ward. This week, a state judge ordered the Party to pay $18,000 in costs and attorneys fees to the state's Democratic Secretary of State after a frivolous lawsuit sought to force another post-2020 election audit in Maricopa County (Phoenix). The "bad faith" and "groundless" GOP suit, as the judge noticed in his sanctions order describing the effort as "gaslighting," failed to recognize that the County had already run a post-election hand-counted ballot audit, finding no fraud or inaccuracies in its Dominion Voting System tabulators.
  • For good measure, in late January, the Maricopa County Board of Supervisors commissioned another audit, this one examining voting system equipment and source code, searching for malicious software or hardware on the systems used in November, checking for evidence of inappropriate network or Internet connectivity issues and rechecking the accuracy of the tabulation system itself against millions of actual votes cast last year. In all cases, according to the two separate, independent, federally accredited voting system test labs commissioned to carry out the audit, "No Issues" were discovered across the board.
  • Despite the clean bill of health from those post-election audits and the failed, evidence-free lawsuits to try and overturn Biden's win in the Grand Canyon State, Republican lawmakers in the state legislature continue to move dozens of voter suppression bills forward in hopes of, at the very least, undercutting the state's very popular mail voting system, as used by 80 percent of voters (Republican and Democratic alike) even before the COVID pandemic. One such measure would both add onerous ID requirements to mail-in ballots and require that absentee ballots be postmarked by the Thursday before Election Day!
  • The efforts in Arizona are, of course, being echoed by Republicans in statehouses all across the country of late, with more than 250 voter suppression bills introduced in more than 40 states so far this year. All of which share the hope of making it harder for (certain) voters to cast ballots at all. The GOP has been hard at work at this sort of suppression for some time, though they are doubling and tripling down since the 2020 contest. All of which has echoes for folk singer/song writer MATT SIRCELY, whose new Back of the Line tune harkens back to the voting lines in Ohio in 2004, the lines of protesters marching across the Edmund Pettus Bridge on Bloody Sunday in Selma, Alabama in 1965, and the bread lines of the Great Depression. If Matt thought that thanking me for inspiration on this song would lead us to play it on the show...he is correct!
  • Finally, we close with Desi Doyen and our latest Green News Report, as extreme weather slams the North, South and West; as corporate media coverage of climate change fell over a cliff with the COVID pandemic last year; and as a top Texas utility regulator gets fired after being caught on tape helping to rig the system for corporate investors over Lone Star State rate-payers...

Guest: NatSec, cybersecurity and voting system journalist Kim Zetter; AND BREAKING: MUELLER GIVES REPORT TO ATTORNEY GENERAL...

Today's BradCast kicks of with the breaking news of the announcement, just minutes before air, that Special Counsel Robert Mueller has finally wrapped up his two year investigation into alleged Russian interference in the 2016 Presidential election, cooperation in the effort by Team Trump and any obstruction of that probe by the President of the United States. Though that may be the least troubling news on today's show. [Audio link to complete shows is posted below article.]

Mueller's confidential report has now been delivered to Attorney General William Barr, as per statute, and Trump's new AG promptly notified Congress [PDF] to say he plans to release a summary of the report as soon as possible, potentially as early as this weekend. We share what we know (and don't) from that freshly breaking news at the top of today's program. Then it's back to, at least some of, our previously scheduled program...

On the day that Jimmy Carter officially becomes the longest living President in U.S. history, we're reminded of a warning he issued while serving as co-Chair, with Bush Family consigliere James Baker, of the so-called "Commission on National Election Reform" formed by a group of Republican operatives after the highly disputed 2004 Presidential election in Ohio. The Blue Ribbon panel was, ostensibly, formed to make recommendations on how to improve elections after the second disastrous Presidential election in a row, following the 2000 debacle in Florida. But while the Republicans who created the private commission had hoped for a recommendation for photo ID voting restrictions at the polling place, the one we've cited most often over the years is the Commission's unambiguous finding that the greatest threat posed to elections comes from insiders, such as election officials and private voting system vendors. "There is no reason to trust insiders in the election industry any more than in other industries," the Carter/Baker panel warned in their final report.

That warning is particularly trenchant today, with, as we recently reported, the Democratic National Committee now calling for some form of remote or online voting during their 2020 Presidential nominating caucuses next year and what has just happened with the online voting system that Switzerland has used for some time in parts of the country.

The Swiss had planned to roll out their system nationally this year, but as longtime cybersecurity and voting system journalist KIM ZETTER of MotherBoard and the New York Times reports, things did not go as well as planned.

Zetter joins us to discuss the alarming story of what happened when Switzerland, last month, opened up a month-long public hack challenge for the system which, they previously boasted, had easily passed many regular internal security checks and even several they had contracted from KPMG, an international auditing giant.

But, as Zetter recently detailed at MotherBoard, the Swiss system, designed by Barcelona-based Scytl --- "a leader in developing various internet and other voting solutions for national or regional elections in 42 countries, including at least 1,400 counties in the US" --- was almost immediately found by independent researchers to feature "a critical flaw in the code that would allow someone to alter votes without detection ... in a part of the system that is supposed to verify that all of the ballots and votes counted in an election are the same ones that voters cast." That flaw, Zetter details, "could allow someone to swap out all of the legitimate ballots and replace them with fraudulent ones, all without detection."

As she tells me today, the failure is even more troubling than that, as it allows for a single insider to exploit a "back door in the cryptography scheme, that would allow someone to alter votes but make it look like the votes haven't been altered at all." In other words, "the system is supposed to have a check in it that's designed to ensure that the ballots that go into that encryption process and come out of that de-cryption process are the exact same ballots. But there's a flaw in that proof that verifies that those ballots are the same. Therefore, that would allow someone to swap out the votes and ballots while the proof still seemed to show that the ballots were the same."

Swiss Post, which runs the system, and Scytl who sells it, claim the exploit could "only" be carried out by an insider, so why worry?

So how are those plans coming for remote voting in the DNC's 2020 Presidential caucuses next year? And how can it be that we keep attempting these same unworkable electronic and online voting schemes from private vendors and election officials who swear by the "certified" security of their systems, only to find they are anything but secure once independent experts are allowed to test them in any way?

"We should have a voting system where we're not required to trust anyone --- we're not required to trust election officials, we're not required to trust the vendors, we're not required to trust the voting machine itself," Zetter, who has been covering electronic voting and tabulation systems on her national cybersecurity beat for more than a decade, tells me. "We should have a system that can be audited independently of all of those parties in order to verify the election results. That's really in the best interests of everyone." What such a system should be, of course, is another matter, which we also discuss, and even debate a bit, on today's important program...

Desi and I are ducking out for a short breather over the Independence Day holiday. But, before we go, I appeared recently on Free Forum, hosted by longtime broadcaster and great interviewer TERRENCE MCNALLY.

So, with McNally's kind permission on today's BradCast, we bring you that recent interview, originally recorded in studio on June 24, 2018 at KPFK, our flagship Pacifica Radio Network station in Los Angeles, in which the tables are turned a bit on me.

I respond to his questions about my background, the bizarre circumstances --- and, yes, election chicanery --- which helped lead me deep into the world of investigative blogging, broadcasting and muckraking some 15 years ago.

We also discuss detailed concerns about the reported (and still unverified) results of the earth-shaking 2016 Presidential election, how jurisdictions around the country are now moving to new computerized voting and tabulation systems in its wake (even as those systems, with computer-marked, barcoded ballots will only sever to make public oversight of results worse, not better) and what Americans can do right now to fight like hell to assure they are able to vote and have their votes counted as per intent in the crucial 2018 midterms.

On today's BradCast: Another reminder that the nation's elections officials remain woefully unprepared for and under-informed about threats to this year's crucial mid-term elections, and clear examples of where our governmental institutions currently work to combat blatant corruption by top officials (Missouri) and where they don't (D.C.).

First up, an election night cyberattack in Knox County, Tennessee's local primaries on Tuesday should have officials there (and elsewhere) far more concerned than they appear to be. We discuss why this latest attack echoes similar incidents we've seen previously (including at the end of election night during the 2004 Presidential election in Ohio), why such attacks are likely to become more frequent, and how election and cyber-security officials continue to woefully underestimate and misunderstand the very real dangers to our elections when they (falsely) tell the public, as they are doing in Knox County this week, that their computerized voting, registration and tabulation systems are "never connected to the Internet, so can't be hacked." They are wrong.

Next, Missouri's Republican governor Eric Greitens is now facing three different felony charges, two separate court trials, and the GOP-majority state legislature has now overwhelmingly decided to call a special session to consider impeachment. Greitens maintains his innocence in both a sexual blackmail scandal and campaign finance scandal. We explain why the extraordinary historical moment --- despite the Show-Me State's Governor refusal to resign, echoing Donald Trump in calling the well-documented evidence against him the result of a "witch hunt" by prosecutors (and his own party?) --- is actually, at least so far, an example of how the system is supposed to work.

Contrast that to the quickly devolving mess in D.C. today, where Republicans in the House and Senate who ought to be demanding accountability from a corrupt President, are looking the other way and/or undermining prosecutors, and where prosecutors seem to (falsely) suggest they cannot indict a sitting President, no matter the evidence of serious crimes. That, even as whatever credibility this Administration may have once had, has now disintegrated so much amidst Trump's latest flip-flops on a number of scandals, that even one top Fox "News" anchor unloaded on the President on Thursday, with an astonishing smack down of Trump lies, which ends: "I guess you’re too busy draining the swamp to ever stop and smell the stink you’re creating. That’s your stink. Mr. President, that’s your swamp." When you've lost Neil Cavuto...

Finally, Desi Doyen joins us with an update on the evacuations, earthquakes and new eruptions near Hawaii's Kilauea volcano and on the state's recent deluge (50 inches in 24 hours!) of global warming-related rain. As well as another explosion, massive fire and evacuations --- the third within the past month --- at a fossil fuel-related processing plant, this time in Louisiana...

On today's BradCast, we cover an enormous amount of news, breaking and otherwise, on both the Presidential "recount" story in three different states, as well as the fight against the Dakota Access Pipeline in North Dakota. And we speak to Green Party candidate Jill Stein's campaign manager, David Cobb, about the ongoing and "escalating" legal battles and fights for citizen oversight of election results in Wisconsin, Michigan and Pennsylvania. First today, the latest on the breaking news over the weekend in the story of the denial of a permit for the controversial pipeline in ND, where thousands of native Americans have been protesting for months against its construction near tribal lands. On Sunday, in a huge victory, the U.S. Army Corps of Engineers denied an easement to Dallas-based Energy Transfer Partners that would have allowed them to complete the pipeline by building on disputed land near and beneath Lake Oahe, the Standing Rock Sioux's source of drinking water. The victory, while monumental --- even as the protests and violent attempts by law enforcement to stop them have been almost entirely ignored by mainstream corporate media --- may be short-lived, depending on legal actions and decisions made by the next President. Desi Doyen joins us for the latest.

At the same time, over the weekend, the corporate media was busy misreporting and misleading the legal maneuvers of Green Party Presidential candidate Jill Stein, who has dropped just one of the statewide voter-initiated suits demanding a PA "recount", in favor of a federal filing [PDF] today, on Constitutional grounds, seeking federal intervention for a statewide count and forensic analysis of 100% unverifiable voting systems used there. Stein and her attorneys held a press conference and rally today outside of Trump Tower in Manhattan, to explain the efforts.

Also, a federal judge this morning ordered [PDF] the state of Michigan to being counting ballots today, after successful maneuvers by Team Trump delayed the start of that effort late last week and had hoped to further delay or deny citizen oversight of results entirely. MI's Attorney General (a Trump supporter) falsely argued in his filing and during an unusual emergency hearing in federal court on Sunday, that the count might endanger the state's Electoral College votes. U.S. District Judge Mark Goldsmith ordered the counting to begin at noon today, however, finding that any further delay "would likely violate [plaintiffs'] right to vote under the First and Fourteenth Amendments" and that "there is a credible threat to the voters' right to have a determination made that Michigan's vote for president was properly tabulated." The MI GOP has vowed to appeal both the federal and state cases against counting ballots.

My guest today, Stein's campaign manager David Cobb, the Party's 2004 Presidential nominee --- who, himself, called for the partial statewide count that happened after that year's Presidential contest in Ohio --- joins us to discuss the latest developments in the ongoing counts and court cases in all three states, and to explain why Stein and the Green Party "are demanding integrity in the election system."

In PA, he explains (as we long have as well), that "there is no way to properly verify the DRE --- direct recording electronic --- equipment, otherwise correctly known as 'black box voting'. It's terrible to begin with and they should never be used. ... The real gain here is forensic experts getting an opportunity to get their hands on these machines --- and that is exactly what we are seeking in all three states --- but, in Pennsylvania, in federal court specifically, because of the completely outrageous system of recount provisions in the state." (To get an idea how horrific they are, check out my interview with VotePA's Marybeth Kuznik from last week, or read today's filing [PDF] in federal court.)

"I really want to underscore," he tells me, "we are escalating the fight into federal court in Pennsylvania precisely because the Pennsylvania laws are so horrible."

"These black box voting machines are hackable," he continues. "If any nefarious individual can get their hands on them, there are ways to manipulate them. That's the reason it's so important to have these forensic studies done. So that we can literally verify the vote. What is Donald Trump afraid of?"

We also discuss the efforts of the Green Party going back to Cobb's own attempted "recount" in Ohio, when two top election officials in the state's largest county, Cuyahoga (Cleveland), were found guilty and sentenced to the maximum sentence in prison for having rigged the 2004 Presidential "recount".

"We are demanding that every vote counts, so count every vote! It's just that simple. At the end of the day, if we do not have confidence in the election system, we cannot have confidence in our government itself," he argues.

Finally, speaking of counting votes (or not), North Carolina's abhorrent Republican Gov. Pat McCory has announced he is giving up his own battle for a statewide recount (which we supported) and has conceded the race to the state's Democratic candidate Attorney General Roy Cooper, becoming the first Governor to lose a re-election bid in state history...

On today's BradCast: As we first broke last week, Green Party Presidential candidate Jill Stein has now filed for 'recounts' (attempts at first time hand-counts and forensic audits, in any event) in Wisconsin, Pennsylvania and soon in Michigan. Independent candidate Rocky De La Fuente has also filed in WI. [Audio link to show is at end of article.]

Today we catch up on all that the calls for "recounts" have led to over the weekend and since the holiday break last week, including: News on the more than $6M raised by Stein to pay for the counts so far (the number that both she and the attorneys seeking the counts had told me about last Monday before any of this had become public); the Clinton Team (somewhat) joining the effort; Donald Trump demeaning it as a "scam" and offering wildly false claims of "voter fraud"; Stein's emergency effort to draft needed voter volunteers for filings in PA; the legal question (and now lawsuit) over whether WI will "recount" paper ballots by hand or by the same computers that tallied them in the first place; whether there will be sufficient time for any kind of proper public counting before the federally mandated December 13 deadline; and whether there is anything to count in PA at all, where they still shamefully force voters to use 100 percent unverifiable touch-screens across most of the state.

We are joined by long-time election fraud investigator and author Richard Hayes Phillips, to discuss all of that and his detailed report about the unusually large apparent voter turnout numbers in many rural WI municipalities and the difficulty citizens have in verifying and overseeing those numbers. As Phillips explains, there are horrible public reporting requirements for both results and for same-day voter registration provisions in the state.

"At a minimum, the problem is a lack of transparency," Phillips tells me today. "We have no way of knowing how many registered voters there are [in WI]. If you don't know how many registered voters there are, you don't know if too many ballots were cast." His report finds that, based on the latest state-reported voter registration numbers, there were "193 towns with turnout of 90% or better, 25 towns with turnout of 95% or better, and 7 towns with turnout of 100% or better." Those exceedingly high turnout numbers are likely lower in reality, due to same-day registration in WI, but the lack of reporting requirements for those numbers is "unacceptable".

"This is the period of time during which we must analyze those numbers to decide whether or not to challenge the election, and we don't have reliable numbers to use!" Philips, who personally examined tens of thousands of ballots and poll books and much more in Ohio after the disputed 2004 election there, resulting in his book Witness to a Crime: A Citizens' Audit of an American Election, says WI's turnout numbers remind him of a number of counties where he found fraud in Ohio, where there was some 80% turnout reported.

He also warns --- as I have, very loudly, for many years --- that there are almost no ballots to actually count in PA. "The five biggest cities in Pennsylvania that have no paper record of anybody's vote, except for absentee ballots, which only amount to 1 or 2% of the ballots," he says. "My God, if Wisconsin and Michigan which are very close were to actually flip and fall to Hillary Clinton's column, we will face a constitutional crisis, because this whole election will come down to Pennsylvania and the vote cannot be verified. I want America to know this."

Also hearkening back to Ohio in 2004, Phillips notes that there are tens of thousands of ballots with no vote at all for President in MI --- even near Detroit --- according to the state's unverified optical-scan tabulators. It's impossible to know how people voted, unless paper ballots are actually counted by human beings, he confirms. "Who knows who these ballots are actually marked for?"

"I'm not a shill for Hillary Clinton. I didn't even vote for her. But I want everyone's vote to count," he argues. "I want the winner to win and the loser to lose." Crazy idea, I know. Please take some time to listen to today's program...

Guest: Election integrity expert and exit poll analyst Jonathon Simon
Also: Fake news from both fake AND real news outlets continues to undermine democracy...

What would Donald Trump do if the Exit Polls showed him winning key states before Election Results announced that he had actually lost them instead? It's an excellent question (that virtually answers itself), raised by my guest on today's BradCast. [Audio link to show is posted below.]

Yes, once again, according to several analyses, the disparities between Exit Polling and Election Results, as reported by unverified computer tabulators, suggest that one or the other of those two sets of data may be wrong. The first Exit Polls released by the media consortium on Election Night suggested that Hillary Clinton won in key battleground states, such as Wisconsin, Pennsylvania, Florida, Michigan and North Carolina, that she ended up reportedly losing.

Figuring out what did or didn't happen, of course, remains very important. Had just about 50,000 votes across the three states of WI, PA and MI alone been recorded for Hillary Clinton instead of Donald Trump, she would be the President-Elect today.

Dr. Jonathon Simon, author of CODE RED: Computerized Election Theft and The New American Century, and the man who originally documented almost identical disparities during the 2004 President Election, joins me to discuss his latest analysis of the still-continuing problem in 2016 and what needs to be done about it --- hopefully before the Electoral College meets to make it official by casting their votes next month.

"There are huge disparities, way outside the margin of error, pretty much all in the same direction and, yeah, outcome reversing," he tells me. "So the question becomes, what do you believe? I'd be the first to say we're not going to prove anything with exit polls. But what we really have is two sets of really lousy evidence. We have exit polls --- you could ask, 'Why would you believe them?' --- and you have the vote counts. And you could also ask, 'Why would you believe them?' They're concealed, they're computerized, they're outsourced, they're privatized --- whoever is programming them has the basic control over how those votes are counted or how fictitious it could be. They're also subject to outsider hacking, as well as insider rigging."

"Let me put it this way," Simon continues, "the question that I would want to put to anybody keeping score at home would be, 'What would Trump do?' If these same numbers came out, only they were reversed --- in a parallel universe, he won the popular vote, and Hillary Clinton won the Presidency and the electoral college, and there were all these states in which the exit polls favored Trump and somehow the vote counts favored Clinton --- you can bet your bottom dollar, based on what he said going into the election, based on the attitude he had about not conceding, about making sure if he felt there was any suspicion that he would challenge, that they would be challenging these results."

But what of the response from Edison Research, the sole provider of Exit Polling data for the national media, that the methodology used for Exit Polling in U.S. elections, unlike polls designed for use in other countries, should not be used as an indication that the reported vote counts are fraudulent or otherwise in error? And why do these apparent "red shifts" in vote counts, as Simon describes the difference in the two data sets, tend to happen mostly to Democratic candidates (or, in the case of the Democratic Primary, to the more progressive candidate, Bernie Sanders) rather than to Republicans?

Simon, a longtime election integrity advocate, and I discuss all of those questions and much more, including the real problem with this type of analysis between Exits and Results: the data that create both are still kept secret from public scrutiny, leaving everyone guessing --- and serving to further undermine U.S. democracy as a result.

"The system is set up to be concealed, and the government and the media are working pretty hard to make sure it stays concealed," Simon explains. "And you've got a bunch of people with democracy in their hearts who are working just as hard, if not harder, to try to un-conceal it. It's an uphill battle, but that's what we're doing right now."

Also today, speaking of undermining U.S. democracy, more on the problem of fake news versus real news in a 'post-truth' world, and how fake, pro-Trump/anti-Clinton news stories received more exposure on social media in the run-up to the Presidential Election than news from actual news outlets did. But, as we also report, even the real, theoretically legitimate new sites continue to undermine democracy with fake news, even today...

From Smartmatic to Diebold: Responding (yet again) to partisan worries of vote flips and voting machine ownership...

It's that time of the election cycle again. Happens every four years. (Every two, actually.) On today's BradCast: That moment when partisans on the Right declare Democrats are stealing the election with voting machines owned by George Soros and Democrats worry that Republicans are doing the same via private companies actually owned by big GOP supporters. [Audio link posted below.]

Both sides see votes flipping on touch-screen systems to their opponents. Both sides declare it only happens to their chosen party. Both sides have reason to worry about private ownership of our electoral systems. Both sides tend to be very selective about their concerns. And both sides do nothing about it until it's time to start freaking out again just before the next election.

The old, previously debunked charge that the progressive billionaire Soros is somehow controlling voting machines across the U.S. re-appeared yet again in the Rightwingosphere over the weekend, only slightly modified from its 2012 version. This time it has resulted in a petition to WhiteHouse.gov --- so far, signed by more than 70,000 since it was posted late last week --- demanding "congress meet in emergency session about removing George Soros owned voting machines from 16 states."

But, of course, as we noted back in 2012, when Democrats were concerned about the actual ownership of voting machine company Hart Intercivic by associates of Mitt Romney, Soros does not own any companies with voting machines in the U.S. He doesn't own any companies with voting machines used elsewhere either, to my knowledge. But the original seed for the persistently false rumor seems to have been planted, in no small part, by The BRAD BLOG's exclusive coverage way back in 2008 of a Venezuelan voting machine company named Smartmatic --- once believed linked to Hugo Chavez --- and their secret ownership of the Intellectual Property (IP) used in voting machines made by Sequoia Voting Systems. Many of those machines are still used in about 15 states across the country.

Sequoia has since been purchased by a Canadian firm named Dominion Voting, which, like Sequoia before it, lied about Smartmatic's ownership of IP used in Sequoia's machines. But, as I explain on today's program, it could hardly be further removed from Soros who, as it turns out, has absolutely no stake in Smartmatic or any of the other vote counting companies deployed in the U.S..

But, like Democrats, Republicans have every right and reason to be concerned about the obscene private corporate ownership of our nation's public voting and tabulation machinery. (Please petition Whitehouse.gov about that!) As I noted to a reporter seeking comment about the concerns about Romney's ties to Hart Intercivic around this same exact time before the 2012 Presidential Election...

Once again, we're reminded of the dangers of the privatization of our once-public electoral system. The company's ties to Romney aren't the only disturbing ones we've seen with similar companies over the years. The fact is, that nobody other than the public should have any sort of control of our elections. The proprietary voting systems now in use in all 50 states, whether owned by Romney associates, a George W. Bush associate (as with Diebold in 2004) or even a company tied to Venezuela's Hugo Chavez (as with Sequoia Voting Systems which blatantly lied about that tie to public officials, and the Canadian firm Dominion which purchased Sequoia and also immediately lied about the fact that Intellectual Property of their voting systems used all across the U.S. is still owned by the Venezuelan firm), continue to be a grave threat to American democracy and confidence in U.S. Elections.

And, like similar clockwork, once again this year we are now hearing the shouts about touch-screen voting machines flipping Democratic to Republican and Republican to Democratic --- and the claims from partisans on both sides that "this only ever happens to Republicans/Democrats!" --- as early voting gets underway in a number of states. Is there legitimate reason to worry about such votes flipping? The answer is both yes and no, with reason for all of us to be ashamed, as I explain on the show today.

For our analysis of the final --- and, by our count, 25th! --- debate of the 2016 cycle, I'm joined once again by award-winning journalist Heather Digby Parton of Salon and the Hullabaloo blog, and by David Dayen, of Fiscal Times and author of Chain of Title: How Three Ordinary Americans Uncovered Wall Street's Great Foreclosure Fraud.

As you probably expect, we spend some time focusing on Trump's dishonest claims that the election is being "rigged" and his refusal to promise a peaceful transfer of power. But we also discuss the, at times, disingenuous outrage about it all from the media as well as both Republicans and Democrats, each of whom seem to have developed more than a bit of convenient amnesia about recent elections, about the mechanics of our electoral system, and even very recent assertions about all of the above.

Yes, election fraud and election integrity are topics about which we have some familiarity around here. And, while nuance and complexity and facts may not play well in the corporate media or among angry partisans near the end of an insane election cycle, no small amount of each are called for today. We do our best.

"Digby" and Dayen also bring insight on a number of the other surprisingly substantive issues raised at the debate (as well as important issues that, once again, were not), many of which have been largely overlooked in the wake of Trump's latest embarrassing tantrum(s)...

On today's BradCast, Trump's "charitable" foundation gets shut down by law enforcement, two major (unusual) hurricanes threaten millions, and actual fact-checks from one side of this nightmarish election to the other. [Audio link posted below.]

• "The Trump Foundation must immediately cease soliciting contributions or engaging in any other fundraising activities in New York," according to the letter from New York state Attorney General Eric Schneiderman's office, warning that the GOP nominee's charity "shall be deemed a continuing fraud upon the people of New York" unless it provides required paperwork regarding fundraising activities within the next 15 days.
• Two major hurricanes threatening island nations in both the Atlantic and Pacific.
• Much-needed fact-checking on the misreporting and purposeful mischaracterization of comments made at a February fundraiser by Hillary Clinton.
• More much-needed fact-checking on the misleading (and potentially illegal) comments made by Trump regarding long ago debunked 2012 "voter fraud" in Pennsylvania (which even Philadelphia Republicans are getting sick to death of) and details on why Trump is now being so careful about the words he is using to urge supporters to go to "certain areas" and "watch" the polls.
Updates on the state of Wisconsin's failure to follow federal court orders concerning their discriminatory Photo ID voting restrictions. (More on this in last Friday's show.)
More concerns about the possibility of hacked voting, voter registration and tabulation systems resulting in potential chaos this November 8th.

On today's BradCast: As several polls tighten in advance of the Presidential election, the FBI issues a new warning to states about voting system intrusion and last minute battles continue in federal courts over voting rights access to the polls.

First up, a new report today from investigative journalist Michael Isikoff warns of recent intrusions, believe to be by foreign entities, into voter registration systems in both Illinois and Arizona. The report cites an "FBI Flash" warning [PDF] from its Cyber Division, recently issued to state election officials in hopes of warding off similar intrusions to electronic registration and voting systems in advance of the November election.

The latest news on the completely foreseeable vulnerabilities in our voting and registration systems underscores (yet again) what we've been warning about for so many years at both The BRAD BLOG and The BradCast. Unfortunately, as usual, reporting on this issue from mainstream corporate media comes too late to make much of a difference before the next election, after which the warnings are likely to be all but forgotten...until just before the next election.

Then, BradBlog.com's long-time legal analyst, attorney Ernest A. Canning joins us for an update on the roller coaster-like voting rights battles still waging in federal courts across the country, including the latest disturbing news on Photo ID voting restrictions in Wisconsin and why something known as "The Purcell Principle" will, once again, play a key role in all of those legal fights this year.

Canning, who also wrote about the just the latest example of GOP "voter fraud" hypocrisy over the weekend, summarizes the latest dispositions in a number of key court fights against racially discriminatory Photo ID voting restrictions in Wisconsin, Texas and North Carolina, and related legal battles over access to the polls in states such as Kansas, Arizona and the swing-state of Ohio. All of those cases are likely to have an impact on results up and down the ballot this year.

MSM, Repubs and Dems finally decide e-voting and tabulation a concern...

On today's BradCast, we examine charges made by Donald Trump of a rigged November election, the case made by Bernie Sanders supporters that Hillary Clinton may have won the primary due to election fraud, and the mainstream corporate media finally deciding that, yes, hacked voting and tabulation systems really are a threat to American elections. [Link to audio of today's program follows below.]

It's fun (not really) to see corporate media outlets --- once again on the eve a major election --- suddenly very worried about so much of what we have been reporting (see, literally, thousands of stories at The BRAD BLOG and on The BradCast) about the vulnerability of the U.S. electoral system. We've been warning of exactly that for more than a decade.

The recent concerns follow the hack of DNC emails, said by Dems to have been carried out by Russian intelligence agencies, months of charges of "election fraud!" from Sanders supporters, and now new charges from Trump and friends that the Presidential Election will be stolen by Dems this November by electronic voting machines or voter fraud (or whatever the hell he and his supporters are now sputtering.)

It might all have been more fun had all of the above noticed these concerns years ago, rather than right after what some believe is a stolen election and right before one that some believe could be stolen. Ya know, back when there would have been time to move to transparent voting and counting systems instead.

Nonetheless, with those real concerns --- from all sides --- of hacked, stolen, manipulated or just plain erroneously reported election results, I note that "concerns" are not proof of fraud. So, today, we examine the various arguments, including some detailed thoughts --- both critical and complimentary --- on a new 100-page draft report [PDF] by Election Justice USA, titled "Democracy Lost: A Report on the Fatally Flawed 2016 Democratic Primaries".

Their report (and others making similar charges in recent months) details what EJUSA believes to be proof and/or evidence of fraud that benefited Hillary Clinton during the primary. In stark summary (much more detail offered on today's show itself!), the group's evidence of voter registration fraud in some locations is disturbing, if not completely unlike what we've seen in previous elections. But, I am somewhat less moved by their evidence of electronic voting and tabulation manipulation, as based largely on analysis of disparities between Exit Polling and reported election results. I try and explain why I am not particularly persuaded by studies of Exit Polls in regard to U.S. elections, and why, frankly, my response to their report would be similar whether they found proof of fraud or proof of zero fraud in the election. In both cases I would say what I have been saying for years: We need publicly hand-counted, hand-marked, paper-ballots in this country in order to have real confidence in results. (That is what I've long described as Democracy's Gold Standard.)

Short of that, with computerized voting and counting systems that are difficult, if not impossible for the public to oversee, confidence in U.S. elections will continue to erode whether fraud or error actually exists in the results or not. That, in and of itself, as I have shouted for years, continues to present a grave threat to America's system of representative democracy.

Plus: Ready for Warren?...

On today's BradCast, while the Democratic Party and the mainstream corporate media may have moved on --- and Elizabeth Warren may feel ready to be Commander-in-Chief if tapped as Vice President --- there are millions of still-untallied ballots in the state of California. Meanwhile, in the key Presidential swing-state of Ohio, Democrats are being disproportionately purged from the voting rolls by state Republicans in advance of the 2016 general election. Yes, democracy actually still matters, and that includes counting the ballots of all the legal voters who wish to vote, counting them accurately, and in a way that we can know they have been counted accurately. While we've been reporting this week, often exclusively, on the huge number of still untallied ballots --- both Provisional and Vote-by-Mail ballots --- here in Los Angeles County, ever since Tuesday's Presidential Primary, new data now reveals the totals are even higher than we've so far reported, both in L.A. and across the state. With some 3.5 million ballots now tallied in the Democratic Primary, and a 500,000 vote (appx. 13%) margin for Hillary Clinton over Bernie Sanders, there are still some 2.5 million ballots that have yet to be tallied at all. We discuss what that means and why it matters on today's program.

We also discuss the necessity of taking action on issues that effect elections before your candidate is announced as having lost one. While it's a message we've been shouting from the rooftops at BradBlog.com and on The BradCast for more years than we care to remember, perhaps Sanders supporters will now take note and action. And perhaps Clinton supporters will join them now, rather than waiting until the media declare President-elect Trump has sewn up the race. As one of the cell phone companies used to say: Can ya hear me now?

Speaking of taking action before it's too late, it appears that the state of Ohio is purging voters from the rolls at an alarming rate. Specifically, Democratic-leaning voters in urban areas won by Obama in 2008 and 2012 are being purged at a disproportionate rate to more Republican voters in suburban, whiter areas. To date, more Democratic-leaning voters have been removed in the state's three largest counties in OH than Obama's margin of victory in the state in 2012. Can ya hear me yet?

But, there is also some good news for voting rights and democracy advocates out of the Buckeye State on today's show, as a federal judge has found this week that a number of election reforms enacted by the Republican state legislature and signed by its Republican Gov. John Kasich in 2014 are unconstitutional. That good news, however, comes a bit too late for those voters who had their otherwise legitimate provisional ballots unconstitutionally rejected, thanks to those GOP provisions. Naturally, the state's Republican Sec. of State Jon Husted plans to appeal the federal court's ruling.

Guest: Washington Monthly's David Atkins | Plus: Sanders files for KY 'recanvass' and good news for OH voters!...

On today's BradCast, the Bernie Sanders campaign files for a 'recanvass' of Kentucky's exceedingly close May 17th Democratic Primary; Some very good news for voters out of a federal court in Ohio; And an explanation for why Democrats in California should be thanking the Vermont Senator for staying in the race through the Golden State's Presidential Primary on June 7th. First up, as Washington state Republicans hold their Primary today (with no surprises expected, even as we explain how one could occur), we report on the breaking news of Sanders' request for a "recanvass" in Kentucky, where Hillary Clinton reportedly defeated him by just 1,924 votes --- less than one-half of 1% out of nearly half a million votes cast --- last week, according to the computer-tallied results. We explain how a "recanvass" is decidedly different from a "recount", and how it remains the case that, thanks to the number of votes cast in the Bluegrass State on 100% unverifiable touch-screen voting systems, we can never actually know who the voters really preferred there. The "recanvass", scheduled for this Thursday, is unlikely to change that or the reported results, as it will largely be little more than a review of the already-existing electronic tally.

Then, a federal court in Ohio finds the shortening of the Early Voting period and "Golden Week" (a period of time when Buckeye State voters used to be able to both register to vote and cast a ballot on the same day) by state Republicans, is in violation of Section 2 of the Voting Rights Act as well as the 14th Amendment of the U.S. Constitution. The U.S. District Court has ordered those days to be restored for the General Election, even as this case and a number of others filed by Democrats and voting rights advocates around the country may be headed to the U.S. Supreme Court, where the vacancy that Republicans refuse to fill is likely to result in continuing chaos and confusion over U.S. voting rights.

Next, I'm joined by David Atkins of Washington Monthly, to discuss at least two reasons why, despite so much whining from Democratic Party establishment apparatchiks, it remains very important for Democrats, both in California and nationally, that Sanders remains in the Presidential race at least through the party's Primary on June 7. Atkins explains how the contest has helped lead to skyrocketing voter registrations for Democrats out here and, as importantly, how the state's "Top Two" primary system could results in disaster for a number of U.S. House races if Dem turnout is depressed. Sanders, Atkins argues, is doing the party a tremendous favor by staying in and continuing to fight the good fight.

He also goes on to ring in on the internecine battle between Sanders and Clinton supporters and on whether he believes the party will ever be able to survive its latest outbreak of (sometimes "messy") democracy.

Finally, Desi Doyen joins us for the latest Green News Report, which includes, among much more, evidence that, while Donald Trump claims to believe climate change is a "hoax", his very own companies believe otherwise...
