Tick-tock. Time is running out for all of the Trump scams, as detailed on today's BradCast. Unless, of course, he wins on November 5th --- or has more success stealing the Presidential election this year than he did in 2020. [Audio link to full show follows this summary.]

Among the Trump scams, rackets and accountability for having fallen for them on today's program...

• Melania Trump, according to her new book, is virulently in favor of abortion rights. According to her publisher, she also wanted $250,000 to be interviewed by CNN.

• You know about many of Donald Trump's legendarily failed rackets from the old days: Trump University, Trump Steaks, Trump Water, Trump Vodka, Trump Casinos, just to name a few. More recently, during the time he's been running for President again, there's been Trump Sneakers, Trump Bibles, Trump Digital Trading Cards, Trump Coins, Trump Cryptocurrency and, introduced just last Friday, "Swiss-made" Trump Watches. He's selling them for $100,000 a pop! Even though, according to experts, they appear to be Chinese-made crap, if they even exist, and appear just as likely to be an open invitation to foreign influence peddling and money laundering. We explain.

• All of the above enumerated rackets, by the way, are private rackets. Any profits from them do not go to his Presidential Campaign, but straight into Donald Trump's pocket. And so --- according to the new 165-page filing [PDF] by Special Counsel Jack Smith, unsealed by U.S. District Court Judge Tanya Chutkan on Wednesday afternoon --- was Trump's attempt to steal the 2020 election. New evidence in the filing from prosecutors in his 4-count federal indictment in D.C., further details how the disgraced former President and convicted felon was fully aware that he'd lost the election in 2020, but didn't care. He was going to fight to steal it anyway. He also knew he had put Vice President Mike Pence's life in grave danger on January 6th, 2021. His response: "So, what?" And all of that, as prosecutors argue in their brief, was done in Trump's capacity as a private candidate for office. It was not done as part of his official duties as President. Smith's motion is meant to make that case in hopes of preventing the corrupted U.S. Supreme Court from dismissing the case on the basis of their absurd, anti-American, anti-Constitutional, made-up-from-whole-cloth ruling in Trump v. U.S. declaring criminal immunity to sitting Presidents for crimes committed as part of their "official" duties.

• In Colorado today, a state judge unleashed a brutal, if accurate, take-down of disgraced former Mesa County Clerk, Tina Peters during her sentencing hearing. Once a MAGA superstar, she is now a convicted felon on charges related to a criminal scheme to breach voting system software in her own County, based on false claims that fraud software was implanted in them to flip votes from Trump to Biden in 2020. The judge told Peters today: "I am convinced you would do it all over again if you could. You’re as defiant as any defendant this court has ever seen. You are no hero. You abused your position and you’re a charlatan." He called out her continuing claims of evidence-free fraud as "just more lies. No objective person believes them. No, at the end of the day, you cared about the jets, the podcasts and people fawning over you." He then sentenced her to nine years in prison before she was ">handcuffed and hauled out of the courtroom to immediately begin serving her time. See ya, Tina! May she be the first of many.

It's become very clear of late, as discussed on today's BradCast, that, whether the corporate media or rightwingers like to admit it or not, it is now progressive political policies that are popular among Americans. [Audio link to full show follows this summary.]

With progressive policies in place from the Biden-Harris Administration, for example, the U.S. economy continues to be the envy of the industrialized world. New, falling unemployment numbers and growing retail sales announced on Thursday, combined with recent data finding the annualized inflation rate has now fallen below 3%, sent the stock market soaring again on Thursday. Well, except for Donald Trump's failing media company (DJT), which fell to its lowest price since going public in January. Since then, the loser stock has shed more than 50% of its market value and a full two-thirds since its high-water mark in March. (We tried to warn MAGA investors. Oh, well.)

Just one of the progressive economic policies of this Administration is the landmark Inflation Reduction Act, signed by President Biden in 2022 after being adopted by Democrats in Congress without a single Republican vote. Among many other things, the IRA allows Medicare, for the first time in history, to negotiate drug prices with pharmaceutical companies. On Thursday, the Biden-Administration announced they have completed their first round of price negotiations on ten popular drugs which will save tax payers at least $6 billion a year and $1.5 billion in out-of-pocket costs to beneficiaries.

"Under the law I signed," Biden explained today in Maryland at a rally with Vice President Kamala Harris, "Medicare can negotiate lower prices for another 15 drugs next year, 15 the following, and 20 after that until every drug is covered. That's the law. Now!" As the non-partisan Congressional Budget Office determined before passage of the bill in 2022, the measure will save the federal government nearly $100 billion over a decade --- something that Republicans used to pretend to care about, at least until every single one of them voted against it.

That's just one example of popular progressive policies at work, of course. Harris' running-mate, Gov. Tim Walz, has signed a boatload of them into law in Minnesota, including the protecting abortion rights; legalizing recreational marijuana; implementing popular gun safety reforms; providing legal refuge for trans youths; enacting laws that expand paid family and medical leave; banning noncompete agreements; providing universal public school meals; free public college education for households with income less than $80,000/year; and capping the price of insulin in Minnesota (years before Biden was able to do so nationally.)

That alone is a virtual laundry list of both top progressive aims and popular policies that could be implemented at a national level. So, will a Harris-Walz administration be able to move such policies forward if elected in November? And what else do progressive activists hope to see from a new, Democratic administration?

We're joined today by ALAN MINSKY, Executive Director at Progressive Democrats of America, in advance of the group's 20th Anniversary Progressive Central gathering in Chicago this week ahead of the Democratic National Convention. Sen. Bernie Sanders will be keynoting the two-day gathering, co-hosted by a number of other progressive organizations and publications, with a speakers list featuring a huge list of progressive members of Congress, activists, and journalists.

So, how do progressives feel heading into next week's DNC after nearly four years of the most progressive Presidential administration in decades; an historic, month-long political whirlwind; and a brutal year of protests against Israel's horrific response in Gaza to last year's attack in Israel by Hamas? Minsky and I discuss the "turbulence" and "high stakes" of the moment, and the revelation, for much of the nation, that progressive policies are the popular ones.

"Progressive policies directly address the interests of the average household," Minksy explains, citing "four massive ticket items that just block people from achieving the American dream" so they "don't have to work three jobs to make ends meet."

Those four blocks, he explains, start with childcare. "It's almost prohibitively expensive to have a child in this society". And then the cost of higher education. "You get out with a degree, and you face housing costs, either rents or mortgages, both prohibitive for building anything like the kind of financial security that you want to have. And then, finally, of course, healthcare costs overwhelmingly shredding the finances of people and families late in life."

"Again, only progressives on all four fronts have clear policy solutions to each of those prohibitive costs that American families meet," he tells me, adding, "And these are practiced around the world in other countries, available for us to pursue. They're not radical ideas. They're commonsense ideas."

"The other thing progressive are willing to address that the other groups are not, because they just accept that it's there, part of the wallpaper of American society, and that's the clear spaces in our society where there is deep, endemic poverty. The urban core, small town and rural America, deep poverty in indigenous communities, and still in the Southeast --- the former Confederate states --- most of that region is still tremendously poor. Only progressives address this."

There is more, much more to chew on in our conversation, including the way disparate elements of the left can come together to achieve solutions to these issues, and how to "persuade a Harris-Walz Administration and their economic advisors that the way forward is to go further on those four big ticket items."

"Only the United States has a latent group of about 100 million people who can be lifted up, by very well understood mechanisms, into the middle class," observes Minsky. "When that happens, that is an economic boom."

As to the vibes on the ground in Chicago, where some progressive organizations are planning to protest the Biden-Harris position on Israel? "Free speech society, open society, that's where I want to live," says Minksy, before adding, in reference to the violence at protests at the DNC in the Windy City almost 60 years ago: "Chicago doesn't feel like it's 1968. It just doesn't. There will be notable actions. But, as much passion as there is out there, I don't think it's quite broadly at the level of what was going on in the country during the Vietnam War in 1968." We'll see if he turns out to be right about that.

Even Joe Biden is now making jokes about the plummeting value of the former President's latest scam, his attempt to turn his failing social media site into a Wall Street meme stock. As discussed on today's BradCast, it ain't working. At least for now. [Audio link to full show follows this summary.]

The value of Trump Media & Technology Group, trading under Donald Trump's initials as DJT, has lost about two-thirds of its value since it debuted as a publicly traded stock at the beginning of the month. If it "drops any lower," Biden quipped at a rally in Pennsylvania today, Donald Trump "might do better under my tax plan than his."

When it first went public, DJT quickly shot up to nearly $80 per share. It has been nose-diving by double-digit percentages pretty much every day since. The stock closed on Tuesday at less than $23 a share. On Monday night, the Washington Post's Drew Harwell posted a piece that is nearly equal parts hilarious, for those who enjoy the schadenfreude of Trump losing billions of theoretical dollars in just a few weeks time, and heart-breaking, for those who feel for the hundreds of thousands of Trump fans who have lost, in some cases, their "whole nest egg" because they were brain-poisoned enough to buy into Trump's latest fraudulent scheme.

Harwell's report of the reaction to the plummeting value of the stock by Trump supporters themselves on Truth Social, the money-losing venture that is currently DJT's only actual business, is harrowing and amazing. (But just more evidence of the "deep state", if you believe some of the denialists who are still buying more shares every day now!) But it serves as yet another reminder that, as sick as Trump is, it is our nation itself, and its people, whose illness we must eventually figure out how to attend to.

Anyway, tune in to today's show for many more thoughts on the above, and a whole bunch of other news of the day, including...

• Trump's recent Truth Social video rant on how Presidents simply can't do the job of Presidenting without absolute criminal immunity, the way the Founders wanted it. Then again, there is no evidence that the Founders wanting anything of the sort (quite the opposite, in fact); every President of the United States before (and since) Trump has been able to function just fine without it; and --- oh, yeah --- as Trump said in a separate rant just one day earlier, apparently "Crooked Joe Biden...can't put two-sentences together" but has been clever enough to mastermind all four of Trump's current criminal indictments in two different states and two separate federal jurisdictions, all without leaving a trace of evidence. "At what point are the actions of a sitting President...against his opponent for election interference considered illegal?," Trump asked. But, according to Trump just one day earlier, even if the President had anything to do with Trump's criminal indictments (he doesn't) it would still never be illegal!

• The disgraced former President's criminal trial in New York, on 34 federal counts related to hush-money payments to a porn star to help him win the 2016 election, seems to be moving faster than expected. On Tuesday, seven jurors were selected on the second day of the trial. Just five more jurors and six alternates are needed before opening statements can begin, perhaps as early as the beginning of next week.

• On Tuesday, House GOP lawmakers finally delivered their two articles of impeachment against Dept. of Homeland Security Secretary Alejandro Mayorkas to the U.S. Senate, where the high-crime-and misdemeanor-free charges are expected to die either very quickly or somewhat less quickly, in an impeachment trial that, according to the rules, must begin immediately and continue until complete. Good thing there is nothing else Congress needs to be doing right now.

• The far-right conspiracy outlet known as One American News (OAN) has reportedly struck a confidential settlement with voting system vendor Smartmatic, in the defamation lawsuit brought against the Trump-supporting TV channel for lies told about the company's voting systems following the 2020 election. Despite repeated false claims by OAN anchors and guests that Smartmatic software was used "in 30 states" to steal the election for Biden --- with zero evidence in support of those claims --- the company's voting systems are only used in one U.S. jurisdiction: here in Los Angeles County, where even brain-poisoned MAGA dupes aren't dumb enough to claim the election was stolen from Trump.

  For the role that we personally played in confusing Sidney Powell, Rudy Giuliani, and the OAN clowns regarding Smartmatic's role in U.S. elections, I can only say: "You're welcome!"

  The terms of the settlement are undisclosed, but it follows on last year's $787 million settlement between Fox "News" and Dominion Voting Systems over similarly false claims, as well as a settlement between OAN and a former Dominion executive. There are many other similar defamation suits still pending, however, by both Smartmatic and Dominion over lies told about them following 2020 by other well-known Trump conspiracists.

The death toll stood at 36 as we went to air on today's BradCast, with nearly 300 structures confirmed as destroyed. But officials have since bumped up the confirmed death toll to 53, with more than 1,000 homes and buildings destroyed in the town of Lahaina and surrounding areas on Hawaii's island of Maui. According to our guest today, who has been on the ground there since the blazes were first sparked on Tuesday, those numbers could still get far worse as he describes what has happened in his community as if "Hell opened its mouth."

You have likely heard, by now, that devastating wildfires were whipped up this week in Hawaii, amid near hurricane force wind gusts from the northern edge of Hurricane Dora, passing about 500 miles to the south. The high winds made it impossible for firefighting helicopters to snuff out the blazes in their early hours on Tuesday. Those fires then grew out of control amid dry and windy conditions over the next two days.

Officials are still battling to contain the fires as search and rescue efforts are ramping up, even as they attempt to find shelter for displaced residents and tourists in the once tropical paradise.

We're joined today by radio veteran SHAGGY JENKINS from Maui, where he formerly served as the longtime Program Director at our affiliate station there, KAKU 88.5FM. Jenkins now serves as Operations Manager for a group of Hawaii stations and has been putting in a ton of overnight on-air hours along with his regularly scheduled morning show, to try and help keep the community informed over our public airwaves during the ongoing emergency.

In addition to the firestorms that seemingly sprang up from nowhere and have leveled much of the historic, 1700s-era town of Lahaina --- once the Hawaiian kingdom's capitol city --- on the western side of Maui, Jenkins explains that fires are also raging somewhat to the east and on the Big Island as well.

"Although Lahaina made a lot of national headlines, parts of the neighborhoods upcountry, far away from Lahaina, have also had devastation. We've had complete neighborhoods and subdivisions wiped out for local families," he tells me, describing scenes that look more like bombed out cities of post-WWII Europe or in Ukraine today. "It's on a scale that we've never seen. It's just exhausting to look at, because it's still happening. I don't know how to describe Lahaina other than it's like Hell opened its mouth."

"It's all gone," laments Jenkins, as he becomes swept up in emotion describing the fate of Lahaina, "one of the most historic cities in the entire state."

"It's kind of hard to put into scale how much history, and how much of our old families that were born here and raised for generations, have lost everything. Some of the places that have been devastated --- they're the postcard images that you send everybody when you come to a vacation here. And they're all gone."

"The families that lived in those areas ... they're gone ... I'm sorry ... It's hard," he tells me as he chokes up, "...because we on the island, we're very close, as far as the local population. We know everybody."

Jenkins details how environmental conditions have changed in recent years as our climate crisis has taken a toll in drying out the once idyllic tropical paradise, and as "Big Ag" sugar operations up and left behind unrestored swaths of land.

"It is appreciably different" in recent years, he explains. "Part of the reason for that, not too long ago, we shut down the sugar industry here. The center body of the island is mostly ag land. And when the sugar industry left, a lot of that land went barren waiting for different owners. As all of these changes have happened, it's dried out the island. For the past five years, we have seen more and more brown than we usually do. Those conditions --- those dry, big, open-area fields --- were some of the reasons that the fires here spread so much. And since the sugar industry ended, we have had a step up in our wildfires."

One of the biggest ways we can help, Jenkins says, is to not come to Maui right now. While the island thrives on the tourism industry, now is not the time, as empty hotel rooms are being used to help house those who have lost everything. "We do not have the water, we do not have the power, we do not have the space," he asserts, noting that he is not "anti-tourist", but "every single resort that we have that has an empty room, we are trying to put in a local displaced family."

"The way that you can help us, the best way, is to stay away, and let us have the time to find and bury our dead, to fix our broken infrastructure. And, sadly, to start the very dangerous and long, arduous process of rebuilding one of the most historic cities in the state."

• Reinsurance giant Swiss Re Group released a report asserting that severe thunderstorms during the first half of this year in the U.S. have resulted in unprecedented levels of damage, including some $34 billion in insured losses. That number accounted for 70% of the $50 billion in global catastrophic damage from similar storms over the same period.

• All of this, even as 2024 Republican (Vice-)Presidential hopeful and U.S. Senator Tim Scott of climate change-threatened South Carolina took to Fox "News" on Wednesday with faux outrage claiming that the idea that we are facing a "climate emergency is ridiculous"(!) Of far greater import, he asserted, is that "we have a border emergency that is an existential threat right now." Desi Doyen has a few choice words for the embarrassing Senator, who apparently hasn't noticed the actual existential threat of climate change, right now, which has, over the same 24-hour period during which Scott was blathering his dangerous, wingnut, fossil-fueled disinformation on Fox, taken the lives of at least 53 of Scott's fellow American citizens in Hawaii. That, just days after hundreds have died from prolonged extreme heat in places like Arizona.

For some reason, it seemed like a good moment on today's BradCast to bone up on exactly what "racketeering" or RICO charges are. I have a feeling it may come in handy in the days ahead. [Audio link to full show follows below this summary.]

But, FIRST UP, it's Election Day in Ohio. One single statewide ballot issue, in the middle of August. That's because Republican lawmakers were hoping to undermine a ballot measure set for this November which, if successful, will codify protection for reproductive freedoms into the state Constitution.

For more than 100 years in the Buckeye State, Constitutional Amendments were adopted via the ballot with a simple majority vote. Today's measure, Issue 1, would raise the requirement needed for passage to a 60% super-majority. Of course, the GOP's Issue 1 on the ballot today would require just 50% + 1 for passage.

As we've been reporting, despite the state Republicans' attempt to sneak their anti-democracy Amendment past voters (after, earlier this year, adopting legislation to ban August Special Elections), early voting has been huge. Today's Election Day turnout was reportedly higher than expected as well. Happily, there were, so far, only a few reported problems at the polls. We'll see if that changes and we'll have reported results on this critical measure tomorrow.

THEN, over the weekend, Donald Trump's top attorney on his new indictment by Special Counsel Jack Smith for his many failed attempts to steal the 2020 Presidential election, was all over the news shows offering absurd defenses for his client's crimes. John Laura told Meet the Press, for example, that "a technical violation of the Constitution" isn't actually unlawful.

Congressman Jamie Raskin (D-MD), who happens to be a Constitutional law professor (as well as both the Lead Manager for the U.S. House during Trump's second impeachment for insurrection and a member of the bipartisan House Select Committee investigating it) strongly begged to differ. Critically, he noted in his response to Lauro's remarks, there are people serving years in jail in this country for falsifying one single vote, whereas Trump "tried to steal the entire election."

Thank you, Congressman!

NEXT, we continue to await what is almost certainly going to be Trump's fourth criminal indictment in about as many months. This one will come any day now, likely this week or next, courtesy of Fulton County, Georgia District Attorney Fani Willis in relation to Team Trump's failed attempts to steal the Peach State's election in 2020 from Joe Biden and the state's voters.

Her case, for reasons explained on today's program, could be expansive, including many charges and many conspirators acting in concert with Trump. Exactly who will be charged and what they will be charged with remains unknown.

Among the many questions about Willis' case: Will she invoke the state's "Racketeer Influenced Corrupt Organizations" (or RICO) Act or just simple conspiracy charges? And, oh, by the way, what are the difference between the two, as RICO is best known for use against organized crime by the mafia, etc.?

Luckily, KEITH BARBER, former attorney, former Republican and current Daily Kos contributor on law and Constitutional matters, recently wrote about exactly that and joins us today for a helpful RICO primer and insights into Willis' likely imminent indictments.

Short version of the difference between "conspiracy" and "RICO", as Barber wrote last month: "Conspiracy requires an agreement between the co-conspirators to commit what are usually specific crimes. RICO does not require proving any such agreement. So long as the parties commit the required predicate offenses, as part of the same 'enterprise,' acting 'in furtherance of a common purpose,' RICO can be satisfied."

As Barber tells me today: "The mob boss doesn't necessarily plan anything with the guy who is running the protection racket He may not even know him. But they are both engaged in the same broad criminal enterprise. That's the distinction between RICO and conspiracy. You don't have to show the connections that are shown in the [Jack] Smith indictment of Trump between the co-conspirators. It's sufficient if they engage in a pattern of racketeering activity in furtherance of the same general objective."

If you'd like a more detailed explanation, tune in to today's show, when Barber also offers his thoughts on who is likely to be indicted. "All indications are, all the hints are, that it's going to be a whole lot of people, with a whole lot of charges. It's kind of mind-boggling how many people it could be."

Also discussed: last night's court ruling in columnist E. Jean Carroll's rape and defamation case against Trump and his counter-suit for defamation against Carroll. Short version: Trump's suit was tossed as the judge confirmed that, yes, Trump was found by a jury to have been a rapist according to common vernacular, and Carroll's second civil trial against him (she already won $5 million from him during the last one, now she's suing for at least $10 million) is scheduled to begin early next year and could be a very very short trial given everything that was already established as a fact in the first trial.

Among the stories covered today making that point and related others...

• Donald Trump's "Indictment Week" in New York gets pushed back (at least) another week, though The Joker may or may not have something to say about it this weekend at the Manhattan Courthouse.

• Former news anchor, Trumpist election denier and GOP grifter Kari Lake in Arizona is still busy hoaxing what's left of her supporters into believing she won last year's Gubernatorial election against Democrat Katie Hobbs. (No, Hobbs is not a "twice-convicted racist", no matter how many times Lake repeats that sleazy, false claim.) On Wednesday, Lake saw her 2022 election fraud claims rejected [PDF] by yet another court. This time, it was Arizona's Supreme Court. While rejecting most of her claims yet again, they did kick one of her seven claims back to a lower court for re-examination. That claim has to do with the signature verification process for ballots cast during early voting. Both the lower trial court and Maricopa County Court of Appeals misinterpreted the claim, according to the Supremes. We explain the claim in question, why it needs to be reheard, and why it will almost certainly not result in the 2022 election results being overturned.

  None of that stopped Lake from misrepresenting yesterday's ruling at the high court to her supporters on social media, to whom she tweeted: "HUGE: AZ Supreme Court Rules in Favor of Kari Lake." She didn't bother to share a link to either a news story or the Court's actual order with that tweet.

  But that may be a step up from when she lost every single claim, for a second time, at the Appeals court in Maricopa last month and declared: "BREAKING: I told you we would take this case all the way to the Arizona Supreme Court...Buckle up, America!"

• Speaking of obnoxious Republican liars, Florida Governor Ron DeSantis who reportedly did win his election last year, was furious at critics of his "Don't Say Gay" law enacted earlier in the year. Opponents of the measure, such as legal journalist Mark Joseph Stern pointed out at the time that the language of the bill allowed for a ban on "Classroom instruction by school personnel or third parties on sexual orientation or gender identity" in all public school grades, not just kindergarten through third grade, as DeSantis falsely claimed at the time.

  When critics pointed out that DeSantis was wrong, he sanctimoniously charged they were being dishonest about what the bill actually said, claiming it only applied to grades K through 3. "It's why people don't trust people like you," he chastised journalists at the time, "because you peddle false narratives!"

  Well, funny thing about that. As AP reported Wednesday, the DeSantis Administration is now "moving to forbid classroom instruction on sexual orientation and gender identity in all grades." They hope to expand the ban to grades 4 to 12 based on the original legislation in the state where the Governor and GOP Presidential hopefully unironically claims "Freedom Lives Here". DeSantis appointees heading up the state Board of Education and state Education Department will be voting to make the change next month. No legislative changes will be needed to be made to the existing law. Imagine that.

• Coincidentally, the Republican state lawmaker who authored FL's "Don't Say Gay" law, pleaded guilty this week to numerous federal felonies, including wire fraud, money laundering and making false statements, after fraudulently obtaining more than $150,000 in federal COVID relief funding for two businesses of his that were defunct during the COVID pandemic. The (now former) lawmaker, Joseph Harding, now faces years in prison. He will be sentenced in July.

• The Sunshine State is hardly the only one where elected Republicans are punishing state residents with hateful and cruel legislation. Nebraska's state legislature advanced a bill today that would ban gender-affirming care for minors. The anti-LGBTQ measure has been strenuously opposed by progressive state Senators, including one, Senator Megan Hunt, who has a transgender teenage son. We share some of her remarks today. Opponents vow to filibuster every single other bill on the state Legislature's calendar, effectively shutting it down for the rest of the session, in order to block the bill. It must survive two more debates before passage and signature by Republican Gov. Jim Pillen who vowed to sign it if it reaches his desk.
