Today's BradCast picks up, by and large, where yesterday's show warning, left off. [Audio link to full show follows this summary.]

Among the stories covered today...

  • First up, it looks like the U.S. House has passed a Continuing Resolution to temporarily fund the federal government through early next year in advance of this Friday's otherwise scheduled shutdown date. With the farthest right of the GOP House conference balking, of course, Democrats were once again needed to save the day to pass the measure, which now heads to the Senate for likely adoption. New Speaker Mike Johnson's move is the exact same thing that got then Speaker Kevin McCarthy tossed from his Speakership by the extremists in his own caucus. Johnson, however, is apparently being given a pass, for now.
  • Then, we return to my argument from yesterday regarding the failure by most of the corporate media to properly inform the electorate about the two currently most likely candidates to win next year's 2024 Presidential nominations. In the case of President Biden, media are failing to accurately and proportionately report on his remarkable successes. In Donald Trump's case, they are still not fully covering the very real threat his own promised policies for a second term present to the nation.

    But some are getting it, including former Republican Congressman turned morning show host Joe Scarborough and his guest yesterday, global politics Professor Brian Klass. After Scarborough cited Trump's recent Nazi-like rhetoric for what it is, Klass made clear, in no uncertain terms: "I study the breakdown of democracy, and I don't know how to say this more clearly: We are sleepwalking towards authoritarianism, and people are not waking up to this."

  • After receiving blow-back for Trump, at a Veterans Day rally over the weekend, describing his perceived domestic enemies as "vermin", just as Hitler and Mussolini did before him, Trump Campaign spokesman Steven Cheung attempted to reject the criticism from some corners over the remarks...by doubling down in a statement promising that Trump opponents' "entire existence will be crushed when President Trump returns to the White House.” --- Not really helping, Steve.
  • Moreover, after a number of chilling recent news reports cited Trump's own vows, along with his campaign's and affiliated outside rightwing groups to create extremist plans for a second term in office --- including promises to prosecute, jail and even execute opponents and to construct major "camps" to hold millions of immigrants and homeless Americans --- his Campaign's co-managers, Susie Wilies and Chris LaCivita, issued a statement hoping to downplay detailed policy plans issued by anyone but the campaign as "purely speculative" and "merely suggestions". Unfortunately, many of those plans have been discussed with media by former top White House officials and Trump loyalists like Stephen Miller at the suggestion of the Campaign itself. And, as the New York Times observes, "the most incendiary rhetoric and proposals have come from Mr. Trump’s own mouth."
  • A judge in Michigan, just before airtime today, rejected a challenge to Trump's candidacy under Section 3 of the 14th Amendment, which bars those from public office who, after taking an oath to defend the Constitution, “engaged in insurrection” against it. Despite the repeated historical use of the Amendment over the last 150 years or so since it's adoption, the judge claims that Congress must act before it can be used to block a Presidential candidate from the ballot. (After tonight's show, with more details now out, it is clear that --- as with last week's ruling by the Minnesota Supreme Court in a similar challenge --- the judge's ruling is only in response to Trump's placement on the primary ballot. Both courts have left open further challenges to Trump's viability in a general election. Also, as with last week's Minnesota decision, the petitioners have vowed to immediately appeal the decision to a higher court.)
  • Meanwhile, Trump's criminal defense team in the Georgia conspiracy case against him and 18 others for attempting to steal the 2020 election in the Peach State, appears to be the source of leaked videos of three former Trump attorneys (Ken Chesebro, Sidney Powell and Jenna Ellis) and Atlanta bail bondsman Scott Hall. Each have pleaded guilty in the case and have agreed to cooperate with prosecutors against the other defendants. The selective videos, leaked to both ABC News and Washington Post, are of the four defendants being interviewed by Fulton County prosecutors just before they copped their pleas. They reveal a number of new details in the case, but appear designed to undermine their witness testimony, send a threatening message to other potential cooperators and witnesses, and otherwise highlight Trump's expected defense in the case. Fulton County D.A. Fani Willis is now seeking an emergency order from the judge to prevent any further leaks of discovery evidence. The judges in Trump's other criminal cases would be wise to take notice of what he appears to be doing in Georgia.
  • The U.S. Government released a massive, 2,200-page report today, its Fifth National Climate Assessment, finding that climate warming in the U.S. is now outpacing the global average and warning that every part of the country is being adversely affected by worsening heat waves, drought, wildfires, heavy downpours, and more. Minority communities are being disproportionately harmed. The cost of climate crisis damage to Americans is now averaging more than $150 billion each year, with last year clocking in at $178 billion. Along with the release of today's report, President Biden announced $6 billion in new investments --- paid for by the Democrats' Inflation Reduction Act and the Bipartisan Infrastructure Act --- to "make communities across the country more resilient to climate changes...focused on key climate goals, including modernizing our aging electric grid to withstand extreme weather...Reducing flood risks to communities. Improving drought resilience. Support conservation for our national parks...And advancing environmental justice for disadvantaged communities, because they’re the ones always left behind."
  • Finally, Desi Doyen joins us for our latest Green News Report --- for which the new National Climate Assessment came in too late today --- to report on last week's GOP Presidential Primary debate in Miami(!) which failed to even mention climate change; Australia's new treaty with the nation of Tuvalu as it disappears for good beneath the rising seas; and much more...

Son of VA's GOP Guv-elect tried to vote illegally. Twice; 1/6 Comm. moving toward Trump; COVID lies widen death gap between 'red', 'blue' states...

We've got a lot of news to cover on today's BradCast, breaking and otherwise. Not all of it is terrible. So there's that! [Audio link to full show follows this summary.]

Among today's stories...

  • First up, a story that broke late last week which we need to note here for the record. The 17-year old son of Glenn Youngkin, Virginia's presumptive Governor-elect, tried to vote illegally last week. Twice. At a precinct where his family isn't even registered to vote --- even though he's too young to vote at all, but "insisted" on being allowed to do so. His father pretended to run on an "election integrity" platform during the primary, but his campaign is now criticizing the media for reporting on the story at all. Meanwhile, Virginia election officials suggest Youngkin's son broke no laws --- which seems impossible to fathom once you hear the details. Of course, it's made all the more maddening by knowing what generally happens to those who happen to be black or brown while unknowingly voting or registering unlawfully --- versus what happens to the white son of an incoming Republican Governor. Just ask Crystal Mason in Texas for one.
  • On Tuesday, a U.S. District Court judge overseeing Donald Trump's federal lawsuit attempting to prevent the National Archives from releasing January 6th-related records from his White House, denied his latest motion. The records were been subpoenaed by the U.S. House Select Committee investigating the Trump-incited attack on the U.S. Capitol and will be turned over to the Committee on Friday unless the judge, or a higher court, rules otherwise before then. We explain.
  • The same Committee, led by its Chair Rep. Bennie Thompson (D-MS) and Vice Chair Rep. Liz Cheney (R-WY), have been very busy so far this week. On Monday, they subpoenaed six top Trump Campaign officials, including disgraced former National Security Advisor Lt. Gen. Michael Flynn and far-right attorney John Eastman. And on Tuesday they issued 10 more subpoenas, this time to officials who worked for Trump or the Justice Department, including his senior adviser Stephen Miller and Press Secretary Kayleigh McEnany. While its unclear if the Committee will end up subpoenaing Trump himself, they have expressly not ruled it out and sure do seem to be working their way quickly up the food. Of course, until we learn if Attorney General Merrick Garland and the DoJ intend to bring criminal Contempt of Congress charges against Steve Bannon --- in response to the referral sent to them by the U.S. House --- for refusing to testify and turn over subpoenaed documents in the same investigation, none of these subpoenas will have much teeth. If Bannon is indicted, on the other hand, it will be game on for everyone. We continue to wait and watch...
  • In COVID news, a North Dakota lawmaker who organized a rally on Monday to oppose vaccine mandates wasn't able to make it. He has COVID. But he's also certain that Ivermectin, the horse deworming anti-parasitic he is taking, will cure him. Public health experts do not concur.
  • That NC lawmaker is hardly alone in falling for the vast, criminal, disinformation industry surrounding the coronavirus. A new study from the Kaiser Family Foundation finds nearly 80% of Americans either believe or are unsure whether to believe one or more complete falsehoods surround the pandemic, including evidence-free claims that the government is exaggerating the number of COVID deaths; that the government is hiding deaths caused by the vaccines; that the vaccines can give you COVID; that they contain microchips; or can change your DNA. The survey also found that those who trusted rightwing outlets like Fox "News", OAN and Newsmax were FAR more likely to be suckered by those lies.
  • All of which helps explain the news that the gap between COVID infections and deaths in "red" states versus "blue" states continues to widen with each passing month. Last month, 25 out of every 100,000 residents in heavy Trump counties died from COVID, versus just 7.8 residents in counties that voted heavily for Joe Biden. It was the fifth straight month that the gap in death rates between Trump and Biden counties has widened. That gap continues to grow this month as well, with new deaths now running 5.8 times higher per capita in the the heaviest "red" counties versus the heaviest "blue" counties.
  • We've reported many tragic stories over the past year about those who've refused, for various reasons, to get vaccinated, only to come to regret their choice after becoming hospitalized with a severe case of COVID. Many went on to die. Today, we have a variation on that story...with a sobering, but happier ending.
  • Finally, Desi Doyen joins us for another very busy Green News Report, following the passage last week of the $1.2 billion bipartisan infrastructure bill in Congress, including a number of key climate provisions, and as the critical U.N. climate summit known as COP 26 continues this week in Glasgow, Scotland...

The madness continues on today's BradCast. But, midway through the show, SCOTUS put the unanimous brakes on the MAGA Mob's latest greatest hope to overturn the 2020 election, while top Republicans increase their eliminationist rhetoric to foment violence and Trump prepares to hand out pardons like Christmas candy.

A new survey out this week from Gallup finds a huge drop in the self-identified mental health of Americans. Not surprising. Perhaps also not surprising is that, among demographic groups which saw double-digit drops from their previous self-ratings of "excellent" mental health, Republicans and independents were near the top, while Democrats were among those groups identified with the smallest change in their own mental health ratings from previous surveys.

Not sure what that may mean exactly, but somehow it seems relevant today as the Republican Party appears to be mentally crumbling before our eyes as it begins to sink in for them that they've been lied to about Trump having "won" the 2020 election. Or even that they would somehow be able to come up with evidence --- any evidence --- that proves in court that Joe Biden and the Democrats and dead Hugo Chavez somehow stole it from Trump.

Last week, Trump Campaign lawyer and former U.S. Attorney, Joe diGenova, called for a former top DHS official, Chris Krebs, to be "taken out at dawn and shot" because he dared believe the 2020 election was "the most secure in American history." DiGenova and the Trump Campaign and Newsmax TV, the wingnut outlet which aired the Team Trump call to execute a former government official, all now face a serious lawsuit from Krebs.

Over at the old school wingnut outlet, Fox "News", formerly sane business anchor turned racist wingnut drama queen Lou Dobbs broke into a frothy rage while interviewing top White House advisor Stephen Miller because Trump and his party, as Dobbs sees it, aren't fighting hard enough to overthrow the election while "the Republican Party...is watching its blood drain into the streets because they're gutless."

And out in Arizona, where the very Trumpy Republican Governor Doug Ducey has been forced to repel entreaties by the President of the United State to stage a coup and declare the loser President to be the "winner" of the state's electoral votes, the state GOP, chaired by a loon named Kelli Ward, is asking Twitter followers to give their lives (literally) for Donald Trump. The AZ GOP even went so far as to follow up that request with a second tweet that includes a clip of "Rambo" holding an arrow to someone's head, while uttering: "This is what we do, who we are. Live for nothing, or die for something." That, in a state where a gun massacre was carried out in 2011 at a Democratic event that killed six and almost fatally wounded then Rep. Gabby Giffords whose husband, Mark Kelly, just unseated the state's Republican U.S. Senator on November 3rd.

All of that madness came before the U.S. Supreme Court today unanimously rejected the only case to come before the Court to challenge the 2020 Presidential election results. (The Trump Campaign has promised to go to SCOTUS themselves, but hasn't.) The rejected case was filed by U.S. Rep. Mike Kelly (R-PA) and several Pennsylvania state lawmakers challenging the new absentee ballot law that they passed (and voted for) last year as a violation of the state Constitution. The Pennsylvania Supreme Court already strongly rejected the challenge, and this afternoon, mid-show, SCOTUS refused to hear the attempted federal appeal.

But, if some 50 (and counting) failed, evidence-free court cases from Team Trump haven't yet done the trick, and they are unable to spark the violent new civil war they are clearly hoping for, Donald Trump is still busy preparing to give away pardons "like Christmas gifts" to his aides, friends, family and even himself while he still has the chance. As of today, such a pardon appears to have helped the admitted felon and former National Security Advisor Mike Flynn off the hook after he twice pleaded to lying to the FBI (while also admitting that he was an undeclared paid agent of Turkey.) So, in lieu of a violent upheaval --- or maybe along with it --- why not issue Presidential Pardons to all of your corrupt friends, family and business associates on the way out the door? Even before they've been charged with any crime? That appears to be coming very soon at this point.

To discuss the awesome, virtually unchallengeable Constitutional power of the Presidential Pardon, we are joined today again by former Asst. U.S. Attorney RANDALL D. ELIASON of George Washington University Law School. Several weeks ago, Eliason wrote an excellent primer on the scope and recent history (and abuse) of the Pardon power and the PardonPalooza that both he (and I) expect to see in the coming days.

Eliason challenges some of the common wisdom concerning Presidential Pardons (for example, whether it's true that someone who is pardoned loses their 5th Amendment right to refuse to testify about the criminal matter to Congress and law enforcement officials and whether or not a Pardon is actually an acknowledgement of "guilt"); whether Pardons may be legally challenged as corrupt or unlawfully self-dealing and, if so, how exactly; whether a President is Constitutionally allowed to pardon himself; and whether this one is likely to do so (answer in short: of course he is!)

As the news that U.S. Circuit Court Judge Emmet Sullivan dismissed the Michael Flynn case as "moot" just before airtime today, and the news that SCOTUS unanimously declined to take up the challenge to Pennsylvania's electors came during our discussion, we also get Eliason's reaction to both of those breaking matters.

As the GOP's stolen U.S. Supreme Court further undermined American democracy today...and as climate change-fueled extreme weather resulted in a tar sands oil train derailing and leaking hundreds of thousands of gallons of crude into the drinking water supply for Iowa (and perhaps even Nebraska)....and as the President of the United States lied about immigration facts again while calling for the violation of both U.S. and international law by ending all Constitutional Due Process rights for those seeking asylum in the U.S....many of the always-reliable hand-wringers in the corporate mainstream media and the same Rightwingers who went all the way to the U.S. Supreme Court to support a bigoted baker who refused to bake a cake for a gay couple, are just beside themselves that some Administration officials are facing public protests for their abhorrent complicity in undermining so much that the U.S. supposedly stands for.

We detail all of that on today's BradCast, and open up the phones to listeners on all of it, including calls on whether it's appropriate (and/or long overdue) to protest/shun public officials in their private lives (at restaurants, etc.); what really needs to be done regarding immigration (lots of fact-checking today to Trump's continuing lies about it), and whether, as student protester Mario Savio said, when kicking off the Free Speech Movement at Berkeley in 1964, this is a "a time when the operation of the machine becomes so odious, makes you so sick at heart, that you can't take part! You can't even passively take part! And you've got to put your bodies upon the gears and upon the wheels...upon the levers, upon all the apparatus, and you've got to make it stop! And you've got to indicate to the people who run it, to the people who own it, that unless you're free, the machine will be prevented from working at all!"...

False claims of 'terror' in Sweden and false 'voter fraud' in New Hampshire may be funny, but Trump's fake news is deadly serious...

On today's BradCast: 75 years ago this past weekend, FDR issued Executive Order 9066, sending 120,000 Japanese-Americans to concentration camps in one of the most shameful moments in American history. Today, we fight to keep history from repeating itself as Trump offers big lies about terrorism, voter fraud and the media, among other things --- for a reason. While Trump's Executive Order attempting to ban Muslims and refugees from seven different countries has been blocked by the federal courts, another one is promised to take its place soon. And in order to do so, the Administration continues to offer lies about terror attacks to justify its actions, this time with the President citing a non-existent terror incident in Sweden --- fake news that he heard about (and misreported) from Fox "News" the night before his campaign rally in Florida on Saturday.

That dangerous lie comes on the heels of a week of another big lie from Trump and his top advisers concerning false claims of "thousands" of cases of "voter fraud" in New Hampshire and elsewhere --- and as Trump declares the media to be "the enemy of the American People."

While the lies are now non-stop, ridiculous and, at times, hilarious, the insidious reason behind them is chilling, dangerous, shameful and about as un-American as possible. Why all of it matters, and more, on today's BradCast...
