The SOTU begins shortly (we'll be covering tomorrow with Digby and Driftglass) so please forgive if my summary of today's BradCast is a bit shorter than usual. (Or, you're welcome!) [Audio link to full show follows this summary.]

FIRST UP... We've been spending much of the last week or so (see here and here) reporting on documents found missing from those released by the Dept. of Justice under the Epstein Files Transparency Act. Specifically, we've focused on a series of documents detailing allegations by a woman who says that she was raped, physically assaulted and threatened by Donald Trump at Jeffrey Epstein's home in New York City when she was just 13-years old.

Independent investigative journalist Robert Sollenberger was the first to report on the missing documents regarding the disturbing and salacious charges, and that other documents that were included in the DOJ's latest tranche revealed that the woman's allegations were credible enough that she was interviewed by the FBI four different times in 2019.

Today, NPR confirms and furthers Sollenberger's reporting to detail that at least 53 pages of those interviews and FBI notes created along with them, are indeed missing from the DOJ's Epstein Files database online.

In turn, Democrats on the House Oversight Committee issued a statement on the missing documents on Tuesday, noting that they have been "investigating the FBI’s handling of allegations from 2019 of sexual assault on a minor made against President Donald Trump by a survivor."

Ranking Committee Member Rep. Robert Garcia (D-CA) notes in the statement that, after having "reviewed unredacted evidence logs" at DOJ, he is able to "confirm that the DOJ appears to have illegally withheld FBI interviews with this survivor who accused President Trump of heinous crimes."

The Congressman vows that "Oversight Democrats will open a parallel investigation" into what he went on to describe during a presser on Tuesday as "the single largest cover-up in modern American history."

THEN... As we noted briefly on yesterday's program, late last week, Trump's FCC Chair Brendan Carr issued what some are describing as a new veiled threat to the nation's broadcasters. In a statement published on Friday, citing Trump's year-long plans to celebrate America's 250th birthday in July, Carr announced the FCC's "Pledge America Campaign," instructing broadcasters to air patriotic, pro-America programming, and suggesting that they "voluntarily choose to indicate their commitment to the Pledge America Campaign."

Some longtime media and communications experts have expressed concern about the announcement. One of them is HAROLD FELD, attorney and Senior Vice President at Public Knowledge, a non-profit good government group. He joins us on today's show to share concerns on not only that, but a number of Carr's other recent threats, including those that resulted in CBS attorneys instructing Stephen Colbert not to air a Late Show interview with Texas Democratic Senate candidate James Talarico. Colbert subsequently posted it only online instead.

"If somebody says, 'Nice business ya got here, be a shame if anything happens to it,' that lands differently if it's an insurance broker or a mobster," Feld tells me today, describing his reaction to Carr's "Pledge America Campaign" announcement. "Unfortunately, what we've been seeing is that this Administration falls into the mobster category, not the insurance broker category."

He suggests that Carr's request for "voluntary" pledges from broadcasters is "a potential trap". "If you don't sign, then it's 'Why do you hate America?' If you do sign [but] don't show the kind of 'celebration' that they are talking about, then it's going to be, 'Look at these guys, they said they were going to celebrate America but they hate America because they didn't show the right things, the things we want to see.'"

All of that comes, as Feld sees it, as a "real 'pay to play'" atmosphere from Trump's FCC, where they dangle approval or rejection of mergers and other things sought by broadcasters as bait or threats from what was statutorily designed decades ago to be an independent executive agency, separate from the White House itself and Presidential influence.

"Between these threats on the one hand, and these promises and gifts on the other hand to suspend federal law, to ignore anti-trust rules, this is a critically dangerous moment for our mass media and our First Amendment freedoms," Felt warns.

• After a week of climate change-fueled downpours in Southern California, it looks like it's the East Coast's turn, as a record climate-fueled blizzard all but shuts down the Northeast with as much as three feet of snow in some places. All of that, just over a week after Donald Trump gutted some 20 years of EPA rules meant to slow or mitigate our worsening climate crisis by regulating the release of man-made greenhouse gases that are heating the planet. But Trump says, "don't worry about it!", the public will now have more money to spend on health care in the bargain!

• Trump's FCC Chair Brendan Carr offers some tips on how broadcasters may avoid scrutiny by issuing a "pledge" to support this Administration's celebration of the 250th Anniversary of the Declaration of Independence this Summer. We take his suggestion to play more Schoolhouse Rock! In today's case, the classic 1973 episode about the nation's founding, called "No More Kings!"

• In the federal courts, corrupt Trump-appointed U.S. District Judge Aileen Cannon ruled on Monday in Florida that the tax-payer funded report by Special Counsel Jack Smith --- detailing the tax-payer funded probe of Donald Trump's theft of thousands of national security documents upon leaving office after his first term, resulting in his federal criminal indictment on the matter --- is barred from ever being released to the public. Not even by future Administrations, if her absurd, ahistorical ruling were to be upheld. Smith himself remains barred from ever discussing it in the bargain. Stick a pin in all of that for a moment, because...

• Across the pond, just days after the arrest of the former Prince Andrew, related to revelations about his relationship with pedophile and Trump's longtime best friend Jeffrey Epstein, yet another high-ranking official was arrested on Monday. Former UK Ambassador to the U.S., Peter Mandelson is facing potential indictment on similar charges to the former Prince. All of it revealed by emails and other documents released by the U.S. Department of Justice under the mandates of the Epstein Files Transparency Act.

• Meanwhile, back here, as we discussed on last Thursday's BradCast in somewhat salacious detail, investigative journalist Roger Sollenberger has uncovered evidence revealing that the DOJ has unlawfully failed to release records regarding as many as four FBI interviews with a woman who alleges that she was raped, physically abused, and threatened by Donald Trump when she was just 13-years old. Sollenberger has also noticed some curious oddities regarding the timing of the discovery of certain Epstein-related documents by the DOJ and the return to Trump of the documents he stole at the end of his first term. (Yes, after Jack Smith was forced to drop his indictments against Trump when he was elected again, the DOJ returned those stolen documents to him shortly after he was sworn in a second time!)

  Is it possible that documents related to these allegations of Trump having raped and assaulted a minor were among those stolen by Trump? Might that explain why Trump was seemingly willing to face jail time to protect those documents, rather than simply return them to the Government after being politely asked repeatedly and warned many times of the consequences of not doing so? And if, in fact, he was hoarding some Epstein-related documents in his Mar-a-Lago mansion to keep them from seeing the light of day, is it possible that Jack Smith, after obtaining those documents via search warrant at Mar-a-Lago, knows all about it, but is now permanently barred by the Trump-appointed lackey Judge Cannon from ever talking about it? And is all of that revealed in the final report of his investigation that Cannon has absurdly blocked from ever being released to the public?

On today's BradCast: When fascism takes root, there's a whole lot more that comes with it. [Audio link to full show follows this summary.]

FIRST UP TODAY... Based on little more than a threat from Donald Trump's FCC Chair Brendan Carr to rewrite Equal Time rules for late-night talk show interviews on broadcast television, CBS, newly owned by Paramount/Skydance, is rolling over in advance. Stephen Colbert, whose top-rated Late Show with Stephen Colbert will be ending in May on the heels of the merger, says that CBS attorneys barred him from interviewing Texas' Democratic U.S. Senate candidate James Talarico on Monday, amid his primary election against Rep. Jasmine Crockett.

But all of that seems to have blown up in CBS' face, as nearly three-times the number of viewers, so far, have watched Colbert's streaming-only interview, posted to Youtube after network suits nixed the broadcast version, and some $2.5 million came rolling in for Talarico's campaign in the bargain.

Colbert himself told the story on Monday and then followed up on Tuesday. We share both segments today.

THEN... Trump and his party stormed to power in 2024 based in no small part on opportunistic, weaponized charges of antisemitism on the Left, amid campus protests against Israel's war on Gaza. After taking office again last year, that political campaign turned into a government extortion campaign against universities, colleges, law firms and other organizations who, the Trump Administration claimed, were exercising antisemitism.

But, when rightwing podcaster Ben Shapiro attempted to call out antisemites in the Republican Party and MAGA movement late last year, he was met with little more than a shrug by the 30,000 young Christian followers of the late Turning Point USA founder Charlie Kirk at the group's America Fest gathering in Phoenix. Shapiro was, among other things, calling out former Fox 'News' host turned podcaster Tucker Carlson for a softball interview with avowed neo-Nazi Nick Fuentes, and Shapiro's former employee, turned hugely popular podcaster, Candace Owens. She has, among other things in recent months, advanced a conspiracy theory that Israel was somehow behind last year's murder of Kirk.

It gets even more twisted, as new polling and focus groups find that young Republicans and evangelicals don't seem to have much of a problem with Hitler, and even long-established GOP institutions like the Heritage Foundation, have apparently decided to stand with Carlson and Nazis. Surprised? Don't be. They also got behind Trump even after he enjoyed a Thanksgiving week dinner with Kanye and Fuentes a few years earlier.

The notion that Evangelical Republicans claim to be supporters of Israel because they support the Jewish people has always been absurd to those of us paying actual attention for the past whole bunch of decades. The fact that the lie is only now beginning to come to the attention of some in the public and media is somewhat mind-blowing.

But the slow-motion implosion among MAGA Republicans is really something to watch, and far more widespread and insane than I can adequately detail here in a short summary post.

Longtime investigative journalist ART LEVINE, on the other hand, who joins us for a very lively conversation on today's program, has published an exhaustive expose on all of this at The Washington Spectator this month, headlined "Inside the MAGA Meltdown Over Antisemitism". The piece's similarly exhaustive (if very accurate) sub-hed: "A Parade of Charlie Kirk Wannabes, Nazi Sympathizers, End Times Prognosticators, Media Grifters and Nostalgic Evangelicals Scramble for Control of Their Imploding Coalition".

Levine tells me today that it is all "insanely hypocritical," arguing that "essentially, Donald Trump might be considered the Anti-Semite in Chief, because of his own overt symbolism. If you're inviting, over to your home, Kanye West, who recently had a 'Heil Hitler' video on Twitter, and Nick Fuentes, he is an open Holocaust denier, it's just nuts!"

"There's no more fig leaves," Levine charges, based on his months of painstakingly documented and linked research. "All of the standard distancing modes between Republicans and antisemitism has dropped away."

We pick up on today's BradCast with several new developments in stories we covered on yesterday's show plus much more, thanks to another insane day in Trump World. [Audio link to full show follows this summary.]

Among our coverage today...

• On yesterday's show, we spoke with former DOJ Public Corruption chief Randall Eliason about reporting over the weekend, confirmed by multiple outlets, that Donald Trump's so-called "Border Czar", Tom Homan, accepted $50,000 in cash inside of a takeout food bag last year in exchange for a promise to "facilitate" future contracts if Trump won the election. According to internal DOJ documents and multiple sources at each outlet, Homan was caught on tape receiving the money from undercover law enforcement agents posing as businessmen. But after Trump took office, the bribery probe into Homan was summarily dropped by Trump associates leading the FBI and DOJ, on the supposed basis that no crimes were committed by Homan in the payoffs during the investigation begun during the Biden Administration.

  But, by last night, White House Press Secretary Karoline Leavitt took the DOJ denials a step further, claiming that Homan "never took the $50,000." That denial was not made by the DOJ when the story was first reported over the weekend. And even Homan himself, when asked about all of this on Fox "News" last night, didn't make that claim. Here merely said "I did nothing criminal. I did nothing illegal." Tune in for the full update on that wild story, before it disappears into the Trump news cycle ether. (Though Congressional Dems, to their credit, are trying to prevent that from happening.)

• In another follow-up to another story we covered, if only briefly, yesterday... The news broke just before airtime that Disney/ABC announced Jimmy Kimmel's late night show would be returning to air on Tuesday, after it had been "indefinitely" sidelined last week following threats by Trump's sleazy FCC Chair Brendan Carr to rescind broadcast licenses from local affiliates who carried the show. The wildly inappropriate, unprecedented (and perhaps unlawful?) threats from Carr (and Trump) came after they decided they didn't like a fairly benign (and accurate) remark that Kimmel made on his show last week regarding the assassination of far-right Republican activist Charlie Kirk. The decision by Disney to bring Kimmel back was clearly based on massive public opprobrium, including massive cancellations of Disney's streaming services, etc.

  That good news, however, was tempered last night by an announcement from local station conglomerate Sinclair, declaring they would be pre-empting Kimmel's how with news programming. Broadcast behemoth Nexstar joined Sinclair on Tuesday, meaning that tens of millions of Americans in dozens of major markets will still be unable to watch Jimmy Kimmel Live! Both of those corporate conglomerates --- which own dozens of local stations all over the country (even if most Americans don't even realize it) have major mergers pending before Trump's corrupted FCC. So this very public fight, with serious First Amendment implications, will apparently continue. That, explains Josh Marshall today, is not necessarily a bad thing.

• Our twisted President rambled for nearly an hour today to the U.N. General Assembly in New York. It was as insane as you might have imagined, only more so. From lies about his domestic accomplishments during his second term, to lies about his having "ended seven wars", to threats to the world's nations regarding migration, energy and climate change, about which he took particularly hilarious zeal in lying about in virtually every aspect, describing it as a "con", a "scam" and a "hoax". Desi Doyen helps us debunk just some of the most obnoxious lies from Trump at the U.N. on Tuesday. And, as also discussed: Please wary of the claims reported late today that Trump has somehow flipped his position on Russia's war on Ukraine.

• Finally, Desi Doyen joins us for our latest Green News Report, with both good and bad news for the world's oceans; and a report on the disbanding of a climate change denier group recently convened by Trump's Dept. of Energy to help lie about climate science...

So much Team Trump criming, so little time to cover it all on today's BradCast. But we try. [Audio link to full show follows this summary.]

Over the weekend, MSNBC broke the news, followed by confirmation from New York Times, that Donald Trump's so-called 'Border Czar', Tom Homan, was caught on tape last September accepting $50,000 in cash --- in a takeout food bag --- from undercover law enforcement officials posing as businessmen. The sting came about after the target of a separate corruption probe tipped off officials that Homan was accepting bribes in exchange for lucrative border security contracts in a new Trump administration, presuming he won last year's election.

After Trump took office, he tapped Homan to oversee his mass deportation of migrants, a scheme that, they had promised, would focus on removing "the worst of the worst" criminals. Instead, the majority of deportees have no criminal record, but the guy running the program has apparently been caught on tape accepting a cash payoff before returning to office.

The investigation into Homan, which reportedly began in the summer of 2024 under the Biden Administration's DOJ, was summarily closed after Trump returned to power by Trump's former criminal defense attorney turned Deputy Attorney General, Todd Blanche, and his FBI Director, Kash Patel. One of Trump's other personal attorneys, Emil Bove, who served as a top DOJ official until recently being confirmed by Republicans in the U.S. Senate as a federal judge, also reportedly had a hand in shutting down the probe of Homan.

A DOJ spokesperson described the investigation as "blatantly political" and an effort to target "President Trump’s allies rather than investigate real criminals and the millions of illegal aliens who flooded our country," claiming the investigation "found no evidence of illegal activity."

Over the same weekend that story broke, Trump sent what appears to have been meant as a private message to his Attorney General Pam Bondi, effectively ordering her to bring criminal charges against three of his top political foes, New York Attorney General Letitia James, former FBI Director James Comey, and California U.S. Senator Adam Schiff. The message addressed to "Pam", seemingly meant to be private, was instead posted publicly by Trump on his own failing social media website.

We're joined today for insight on all of this by RANDALL D. ELIASON, former chief of the DOJ's Fraud and Public Corruption Section at the U.S. Attorney Office in the District of Columbia. He now teaches white collar crime at George Washington University Law School and pens the Sidebars Blog newsletter.

Is there any reason to believe the DOJ and FBI were right to drop the bribery probe against Homan, in which it seems he was caught dead to rights taking a cash bribe according to multiple reports?

"It's really impossible to know without knowing exactly what's on the tape. It would all come down to what he said and what he agreed to do in exchange for the cash," Eliason tells me today. "But I will say that accepting $50,000 in cash in a fast-food bag is kind of an indication of corrupt intent, that the recipient knows something shady is going on. So you've got to say at a bare minimum, there's a substantial basis to conduct additional investigation." Reportedly, that's exactly what DOJ was doing until Team Trump shut it all down.

"This line coming out from the White House and the DOJ that there was no evidence of any criminal wrongdoing, that doesn't hold water," he argues. "There's clearly something fishy going on here when you're taking fifty grand in cash in a Cava food bag. So there's certainly some smoke there." But, he further explains, "the Supreme Court has made the federal bribery statute so narrow" there are a number of ways Homan could get off the hook. Of course, the fastest way is to have friends at the DOJ willing to corruptly dismiss the entire matter.

We discuss that in detail, along with what Eliason describes as an extraordinary break from decades of norms and tradition with Trump's "private" message to his A.G. regarding bringing charges against his perceived political foes.

"Trump sees the Justice Department as a tool that he can use to punish his enemies and reward his friends," charges Eliason. "And this historical, very important norm that politics is kept separated, that the Justice Department is kept independent from the White House because we don't want politics to influence criminal investigations and criminal prosecutions, has just been flipped completely on its head and thrown out the window. It doesn't exist anymore under this administration."

"He is trying to use the Justice Department to go after his political opponents. And he also uses it to reward his friends. Whether it's Homan, or [Mayor] Eric Adams in New York City, or all the January 6 rioters, pardoning all of them. It's one of the most discouraging things that is happening in this administration --- the complete gutting of the law."

"This is really scary stuff," adds Eliason. "This idea that the President can order a prosecutor to bring criminal charges, and if he doesn't, he'll fire you and put someone in place who will. It's unthinkable to anyone who has worked as a federal prosecutor. It's directly contradictory to the mission and ethical obligations of a federal prosecutor. It would have been completely unheard of before now."

It is all of a piece, he explains, with "many things that are going on at the Justice Department that just breaks the hearts of those of us who worked there and love it."

Finally, breaking news just before airtime today on Trump's FCC Chairman Brendan Carr's outrageous threat last week against Disney/ABC and their affiliate stations to take away their broadcast licenses unless they cancel Jimmy Kimmel's late night show after comments Kimmel made that they didn't care for regarding the recent murder of Republican activist Charlie Kirk. After enormous public blowback against Disney following last week's "indefinite suspension" of Jimmy Kimmel LIve, news broke late today that Kimmel will now be returning to air as of Tuesday night. Looks like public pressure, a torrent of cancelled Disney+ subscriptions and the U.S. Constitution's First Amendment may have won this round, at least partly...at least for now. Since getting off air, Sinclair Broadcasting, a rightwing outlet that owns more than 35 ABC affiliate stations and is seeking favors from the FCC, has announced they plan to air news programming instead of Kimmel's show beginning on Tuesday night...

FIRST UP... At a lively rally at the Democracy Center here in Los Angeles on Thursday, California's Democratic Governor Gavin Newsom unveiled the "Election Rigging Response Act", legislation meant to push back against Donald Trump and the state of Texas' attempted mid-decade gerrymander of its already-gerrymandered U.S. House map. The new TX map, if enacted, would steal five Democratic House seats from largely minority voters in the Lone Star State in next year's midterms.

"We can't stand back and watch this democracy disappear district by district all across the country," Newsom declared at the boisterous rally, announcing his plan to ask the Golden State legislature to quickly approve a ballot measure for November 4th that would allow CA to temporarily override the state's U.S. House map. Unlike in Texas, our maps are drawn by an independent redistricting commission. If Newsom's scheme overcomes several hurdles, a new map would be drawn by the Legislature to flip five currently Republican seats in CA. The Act must first be approved by two-thirds of the CA state Legislature. It would then have to pass muster with voters on November 4, and wold only take effect if Texas successfully rigs their map.

The attempted heist in Texas is currently on hold, with state Democratic lawmakers breaking quorum by leaving the state. But Republican Gov. Greg Abbott has insisted that he will call Special Session after Special Session until he is able to rig the map for Trump and Republicans who fear they will otherwise lose their slim U.S. House majority next year.

"We are not bystanders in this world. We can shape the future," Newsom told the crowd on Thursday, adding: "Donald Trump, you have poked the bear and we will punch back."

"We're giving the people of this state the power to save democracy, not just in California, but all across the United States of America. I hope we are waking up to this reality. Wake up, America. Wake up to what Donald Trump is doing," the Governor concluded. We share his remarks in full on today's show.

THEN... We're joined by veteran, award-winning journalist turned media reform champion SUE WILSON of the Media Action Center, for an update on a remarkable story she has been covering at The BRAD BLOG for at least five years.

Wilson initially reported in 2020 on a citizen Petition filed at the Federal Communications Commission (FCC) seeking to deny renewal of Sinclair Broadcasting's TV stion license in Baltimore. The complaint alleged that Sinclair, one of the nation's largest (and most right-leaning) station owners, was violating FCC rules that limit the number of stations that can be owned in a single market by secretly controlling two other television stations in Baltimore. Those two stations are run, according to the well-documented Petition, by sock-puppet companies actually controlled by Sinclair.

Filed in late 2020, the Petition wasn't heard by the FCC during the remaining months of Donald Trump's first term. Over the ensuing four years, for reasons we discuss today, Joe Biden's FCC failed to review the matter as well. In the meantime, in 2023, the Petitioner passed away. Another Baltimore resident was quickly substituted on the paperwork.

Fast-forward to 2025 and the FCC in Trump's second term, now led by his hand-picked Chair Brendan Carr, dismissed the original complaint on the basis that the substitute Petitioner missed the chance to file a petition on her own back in 2020. Her substitution for the man who waited five years for a hearing --- and died waiting --- was not allowed, Carr ruled, even though the well-documented facts of the matter hadn't changed. The Sinclair stations in question have since been re-licensed, despite the companies apparent violations of both FCC rules and federal law.

The lawyer for both the late Petitioner and his substitute, has filed an Application for Review, hoping to appeal the Commission's absurd ruling. Wilson detailed the latest remarkable chapter in this long-running story at The BRAD BLOG this week, and joins us to both break it down, and light up a warning about the next scheme that the FCC's Carr now has in place to undermine federal ownership rules of local television stations nationwide.

Dead man tell no tales. But the evidence submitted to the FCC before he passed away, challenging dodgy, unlawful television station ownership by a major national broadcasting conglomerate, is still alive and well. Or, at least, it should be.

As covered at The BRAD BLOG in September of 2020, Baltimore resident Ihor Gawdiak and his attorney Arthur Belendiuk filed a Petition to Deny (PtD) the FCC license renewals of three TV stations controlled in Baltimore by Sinclair Broadcasting in apparent violation of both FCC ownership rules and federal law.

In brief, Gawdiak's petition detailed a complicated shell game carried out by Sinclair, one of the nation's largest owners of local television stations, to carry out the plot while staying beneath the FCC radar.

Sinclair claims ownership of Baltimore's WBFF-TV Channel 45, (which shares news reports from the Baltimore Sun newspaper, owned by Sinclair's Executive Chairman, David Smith, son of Sinclair's founder, Julian Sinclair Smith.) The David Smith family also controls both Cunningham Broadcasting and Deerfield Media which operate Baltimore's WNUV-TV and WUTB-TV, respectively. Both companies have very deep and direct ties to Sinclair. (Belendiuk found the "official" owner of Deerfield was Smith's personal banker, Stephen Mumblow, and the "official" owner of Cunningham is the company's former banker, Michael Anderson, who has no broadcast experience and actually served as a paid employee of Sinclair.)

The elaborate shell game, Gawkiak's complaint argued, is an effort to monopolize the information U.S. television viewers can access in their own local towns, by skirting FCC ownership limits in a single market. Petitioner Gawdiak's license challenge first went to Trump's Republican-controlled FCC during his first term, then was taken over by Biden's FCC. Now it is back in the hands of Trump's heavily-controlled Commission once again.

The FCC likely breathed a sigh of relief when Gawdiak passed away in 2023 before the matter was ultimately adjudicated. But then another petitioner, Baltimore resident Eleanor Goldfield, signed on to take his place. Finally, it would seem, someone at the FCC would have to take a formal look at the complex Sinclair scheme of forming sidecar companies under their complete control, designed to flaunt FCC rules with tacit approval of federal regulator.

After five years, Trump's Sinclair-friendly FCC finally responded formally to attorney Art Belendiuk on June 27, 2025, informing him that one FCC petitioner may not be substituted for another and, therefore, the Commission would not be taking up this longstanding case.

This is despite the FCC's own administrative law judge, in a related proceeding, demanding such an inquiry take place.

In 2018, Ajit Pai, Trump's Republican FCC Chair at the time, called an unprecedented public Hearing about deliberate untruths Sinclair made to the FCC in its effort to acquire Tribune Broadcasting. The hearing was scuttled after Sinclair went behind closed doors with the Commission. But it resulted in a stunning $48 million dollar fine. Still, the judge in that hearing, Jane Halprin, demanded these conflicts be thoroughly examined in a future hearing at the Commission, stating: "This alleged deception was ostensibly aimed at allowing Sinclair to bypass the Commission's multiple ownership limitations. ... the behavior of a multiple station owner before the Commission may be so fundamental to a licensee's operation that it is relevant to its qualifications to hold any station license."

The 2020 Petition from Gawdiak could have provided for the scrutiny Halprin called for in the earlier matter.

In 2021, Belendiuk filed a Freedom of Information Act request on my behalf to discover just what was said in those closed door meetings between the FCC Media Bureau and the FCC. It took two years, but following an appeal to the Federal District Court in Washington DC, the FCC finally caved and released those files, a treasure trove of an extremely complicated shell game. (I detailed the full story for Project Censored here.)

Later in 2023, Gawdiak passed away. In early 2024, Goldfield signed on to take his place in the case.

Lo and behold, on June 27, 2025, the FCC finally responded [PDF] by agreeing with the arguments from Sinclair's attorneys that "Goldfield missed her opportunity to participate in the proceeding when she failed to file by the September 1, 2020, deadline and that permitting the substitution here would 'make a mockery of the Commission's deadlines and processes.'"

(As if the FCC waiting four years 10 months and 27 days to respond to a legal petition doesn't alone make a mockery of Commission deadlines and processes.)

In the bargain, the FCC subsquently allowed Sinclair to renew its Baltimore licenses.

But it ain't over until it's over. July 28, 2025, Belendiuk, the original attorney on the case, filed an Application for Review of the FCC's "decision." He raises the following three questions:

1. Did the FCC Media Bureau err in denying the Motion, given Gawdiak's inability to survive the almost five years the Commission waited to act on the Petition?
2. Did the Media Bureau err in failing to address the Petition as an informal objection to the Applications?
3. Did the Media Bureau err in granting the Applications without addressing the substance of the Petition?

It is entirely possible the FCC will not be the ultimate arbiter of this case. It could go to the U.S. Court of Appeals. (If we live that long.)

Aside: In April 2025, public interest watchdog and advocacy group Frequency Forward and Wisconsin member Randy Bryce put still more pressure on Sinclair when they filed their own Petition to Deny the license transfer applications of Wisconsin and other TV station licenses held by Sinclair Broadcasting, using much of the information gleaned from my FOIA.

The FCC swiftly denied that challenge on July 1, 2025. Says petitioner Bryce, who ran for Congress in the Badger State in 2018 and is running again next year: "It's outrageous that the FCC has been changed from a nonpartisan entity to a political arm of the extreme right. Their purpose should be to protect free speech, not stifle it."

On today's BradCast: As you know, much of what we hold dear in these United States is under assault right now, thanks to the man we were collectively dumb enough to elect as President last year. But, for countless reasons, no single institution may be more important to help protect than our nation's free press, which is under far greater fire than I think most Americans realize. [Audio link to full show follows this summary.]

Sadly, that attack has now been joined by too many of the major corporate outlets that control far too many of our previously independent mainstream news sources, all the way down to the local level. And the worst of them, as we've recently learned, are all too willing to hoax their own customers into unknowingly joining the battle.

We've got a number of U.S. media-under-attack stories for you today, from international U.S. media to national media to local media.

First, a bit of encouraging news on the international level. On Tuesday, a federal judge ordered [PDF] the restoration of the 83-year old, Congressionally-mandated and funded Voice of America. The international news outlet, originally created by the U.S. to counter Nazi propaganda in Europe, had been broadcasting continuously since 1942, until Donald Trump ordered its parent agency, the United States Agency for Global Media (USAGM) shut down last month. Some 1,300 VOA staffers and contractors were sidelined, as the airwaves of VOA and its USAGM-overseen sister networks such as Radio Free Asia and the Middle East Broadcasting fell silent. A number of VOA journalists sued, and on Tuesday, the court ordered USAGM to return employees and contractors to their pre-March 14 status. That's good news, though VOA is not fully back yet, and the Administration is expected, of course, to appeal the ruling.

Nationally, corporate pressure super-charged by Trump is also threatening another American broadcast institution. 60 Minutes' longtime executive producer, Bill Owens, quit on Tuesday amid pressure from CBS' corporate owners Paramount, as the company is seeking approval from the Administration for a corporate merger with an outfit called Skydance. That approval, however, is threatened by Trump, who filed a laughable, $20 billion suit against the top-rated, long-running newsmagazine after he didn't like an interview they aired with Kamala Harris before last year's election. Since then, Trump has similarly bristled at tough reports from the notoriously independent new program, charging that they will "pay a big price" for daring to report accurately on his Administration. We don't yet know the full story of what happened at 60 Minutes. But as Paramount is hoping to settle Trump's ridiculous suit, Owens told staffers that the program's independence is threatened, so it was time for him to leave. That, even as he told the show's employees that it is "too important to the country" for them to quit in protest.

From attacks against the U.S. international free press to the national level, we finally arrive on today program at still more threats newly underway against highly-trusted local news outlets, thanks in no small part to collusion between giant corporate broadcasters and the Trump Administration's corrupted FCC.

Last month, Trump's newly-seated Federal Communications Commission Chair, Brendan Carr, announced a new initiative to gut FCC radio and television rules that he described in a notice seeking public comment as his "Delete, Delete, Delete" plan [PDF].

As The Desk detailed earlier this month, the nation's largest owner of local television stations, Nexstar Media Group --- which controls more than 200 TV stations in more than 160 markets across the country --- ordered the local newsrooms at all of the stations it operates (including affiliates of NBC, CBS, ABC, Fox, CW, etc.), to create a "news" story from deceptive, misleading talking points that suggest that the FCC was seeking comment from the public on regulations that "threaten the growth of your local TV news stations". Each, nearly identical report, voiced by local anchors, aired on dozens of stations, instructing viewers to visit a weblink that resolves to a Nexstar-run page instructing them how to let the FCC know that viewers are "worried about the long-term health of my local television stations" and want to "eliminate the regulations that are threatening the growth of my local TV station."

As a number of employees at some of those stations told The Desk on background, however, they were uncomfortable running the reports as "news", but were given no choice by their corporate parents at Nexstar.

Given the national power company, which already rakes in some $5 billion per year, it's hardly a surprise that we haven't heard much about this story in the corporate media. We do our best to make up for that today.

Our guest is the longtime award-winning broadcast journalism veteran turned media activist SUE WILSON, who described some of this earlier today in an article at The BRAD BLOG headlined "Trump's FCC on Precipice of Ending All Limits on Corporate Control of Local TV News Stations". In it, she explains how Nexstar already controls two --- and sometimes three (with FCC permission) --- TV stations in virtually every major media market in the country. But now, with the FCC's Carr looking to "delete, delete, delete" as many regulations as possible, the company is hoping to do away with remaining restrictions on how many stations any single company may control both nationally and at the local market level.

Wilson details how Nexstar and fellow broadcast goliath Sinclair, a far-right outlet who ordered a similar "must-run" package for its nearly 200 stations in support of Trump back in 2018, have long been gaming the system meant to limit corporate control of local stations. Today she details how they are colluding with the new FCC Chair to simply gut regulatory ownership limits while ignoring, or somehow working around, those that have been implemented statutorily by Congress.

"What we are seeing more and more across the United States is that you can turn on your TV set, and you can watch a local news reporter do a report," she tells me today. "You turn to the next station and it's the same reporter doing the exact same report." And that, of course, is with the limits currently in place --- the ones that Nexstar are misleading their own viewers into helping them make it worse. Worse for viewers, anyway, if not more profitable for Nexstar, Sinclair and the others.

Wilson also details today --- as she did in her article earlier --- how you can, and should, respond yourself to the FCC's call for comments. But you will need to do it quickly. Final comments are supposed to be filed --- either by Twitter/X or via the FCC's Comment site --- by Monday, April 28.

"We are fighting a juggernaut in the Capitol. They want to deregulate the media. They want to take over the media, is what they are really after. We have to stop them," argues Wilson, urging listeners to remind the FCC in comments that the "publicly-owned airwaves belong to us."

It's time to speak up loudly to the FCC to save our local TV news! The newly captured and Trump-led Federal Communications Commission is taking comments right now from the public about any and all broadcast regulations we think should be changed or removed entirely. It sounds innocuous enough, but...the so-called "Delete, Delete, Delete" initiative is aimed at nothing less than destroying all competition in local TV news, effectively destroying local news itself...

There are two issues of note here, both designed to prevent a single giant corporation from having too large of a voice in both our local communities and our national zeitgeist. Nationally, the 1996 Telecommunications Act provides that one TV broadcaster may reach no more than 39% of the total U.S. population. Locally, FCC Rules mandate that broadcasters may license One network TV station (ABC, CBS, FOX, NBC) plus one non-network (think CW) station in a single local TV market unless they obtain a waiver from the Commission. The National Association of Broadcasters are trying to upend both (and falsely claiming the 39% cap is an FCC rule, when it is actual statutory law.)

How many of you switch from one local TV station to another, only to see the exact same report? Not just the same reporter, but the exact same report? It's happening all across the nation. I have witnessed it, and so have millions. This is the model Big Broadcasting (Sinclair, Nexstar, Tegna and others) are already using. Now, potentially with the help of their own regulators on a captured FCC, they're trying to expand that model.

This pattern plays out in dozens of local TV markets across the United States, and not just with Sinclair, a notorious right-wing outlet. As my organization, Media Action Center, pointed out in Comments to the FCC and an Amicus Brief to the U.S. Supreme Court, when Nexstar, Sinclair, Tegna and others control two or three stations in the same town, they merely broadcast the exact same stories across all of their stations.

Last month, the new Trump-confirmed FCC Chair Brendan Carr put out a statement on X/Twitter describing his deregulatory "Delete, Delete, Delete!" initiative. The text of the tweet with the attachment statement trumpeted: "NEW: Chairman Carr has announced a massive new deregulatory initiative, opening up a docket to seek comment on every rule, regulation or guidance document that the FCC should eliminate to alleviate unnecessary regulatory burdens." The statement itself explains: "The FCC is committed to ending all the rules and regulations that are no longer necessary. And we welcome the public's participation and feedback throughout this process."

Isn't this great? A Federal Agency asking We the People what we think! Except...Most people don't know that much about broadcast policy or regulations, burdensome or otherwise. Most don't know that We the People own the airwaves and Big Media must be licensed to broadcast over our airwaves, and there are laws and rules protecting our interests.

So what did Nexstar Media Group do in response?...

When we allow a felon to become President of the United States (thanks, in no small part, to extreme rightwing activists on the Supreme Court ignoring and rewriting the 14th Amendment), it's not surprising that he'd quickly begin violating laws and undermining the U.S. Constitution. When that felon also hopes to be a dictator, we certainly shouldn't be surprised that one of his first targets is the Constitution's landmark guarantees of a free press, as discussed on today's BradCast. [Audio link to full show follows below this summary.]

FIRST... Unfortunately, the First Amendment isn't the only one Donald Trump is hoping to dismantle. According to nonprofit news outlet CalMatters, ICE has already begun rounding up migrant workers in Central California, resulting in about 75% of farm-workers staying home this week during peak harvest season for oranges and other produce in America's "Salad Bowl". If that continues longer term, economists are predicting "absolute economic devastation" locally, skyrocketing food prices and shortages across the country nationally, along with a "recession-level event if this is the new long-term norm."

In related news, Trump's Executive Order signed on Monday, seeking to redefine, by fiat, the text and clear meaning of the 14th Amendment's very first sentence establishing birthright citizenship to anyone born here, regardless of the citizenship status of the parents, ran into its first legal roadblock in Court on Wednesday. A Reagan-appointed federal judge declared today that the Order "boggles the mind," calling it "blatantly unconstitutional". He temporarily paused the Order nationwide in the first of five different challenges brought by 22 state Attorneys General. If allowed to be enacted, as one of the challengers argued in court today, it would "impact hundreds of thousands of citizens nationwide who will lose their citizenship under this new rule."

THEN... Trump doesn't seem to much care for the First Amendment either. And, shamefully, a number of mainstream broadcast news outlets owned by major corporations have been all too eager to help him dismantle it. See Disney-owned ABC News' pathetic agreement in December to settle Trump's absurdly frivolous lawsuit with blatantly unconstitutional claims. Instead of fighting the defamation suit, they agreed to contribute $15 million to Trump's Presidential Library fund. See also the reports last week that Paramount-owned CBS News is in talks to do the same thing over another ridiculous complaint that 60 Minutes edited an interview with Kamala Harris in a way that Trump didn't like.

While those outfits are settling private lawsuits, Trump's new Federal Communications Commission Chair, Brendan Carr is weaponizing the FCC to go after the same news outlets. Last week, President Biden's outgoing Chair dismissed several specious complaints against ABC, CBS and NBC that echoed Trump's private lawsuits, declaring "the FCC should not be the President's speech police" and that "the FCC should not be journalism's censor-in-chief." This week, however, the newly seated Carr un-dismissed those complaints (if not the ones against a Fox affiliate, for some reason).

We're joined today by JOHN BERGMAYER, the Legal Director at good government group Public Knowledge. He charges that "Chairman Carr has made it plain he intends to weaponize the FCC to threaten political speech and news coverage he disagrees with." You're not surprised right?

"We have things like defamation law against a public figure, but you can't just prove that they are wrong, or you disagree with them, or they're being unfair or 'mean to me'. You have to prove they are 'actively deciding to harm me' through conscious deception," Bergmayer explains today. "That's a very hard standard to meet. I don't think any of these cases meet the very tough requirements for the FCC to decide in the complainants favor."

He also adds: "It's really notable that Chairman Carr did not reinstate a complaint that was against a Fox affiliate in Philadelphia, that was based on the Fox affiliate airing information that it knew, that was judged to be, defamatory."

"It really is a troubling sign that the current Chairman views these regulatory tools as a means to advance his cultural and partisan agenda," Bergmayer tells me. "What's particularly disturbing is that the Chairman wants to pick fights with the First Amendment rights of broadcasters or use dubious theories of law to go after perceived slights by Big Tech."

We also discuss the 6th U.S. Circuit Court of Appeals' ruling earlier this month that appears to end the FCC's ability, as a federal agency, to ensure Net Neutrality and an Open Internet (not that Trump or his FCC would have any particular interest in doing so.)

FIRST UP... The fight over Donald Trump's absurd selection of alleged statutory rapist Matt Gaetz as the next U.S. Attorney General continued in Congress today, as Republicans on the House Ethics Committee appeared to block the release of the report from a years-long investigation into the former Florida Reps' well-documented record of alleged sex trafficking of minors, paying some $10,000 for sex, and illicit drug use, among other (previously) disqualifying issues for someone tapped to head the Dept. of Justice as the nation's top law enforcement official.

THEN... The clown show of other Trump appointments to key government posts has continued over the past 24 hours with the selection of pro-wrestling's WWE co-founder Linda McMahon to head the Dept. of Education (which Trump has previously vowed to shut down) and TV doctor/snake-oil salesman Dr. Mehmet Oz to head up the Centers for Medicare and Medicaid.

But one of Trump's picks this past week has received much less attention than it deserves. Brendan Carr, author of the chapter on the FCC in Heritage Foundation's Project 2025 [PDF], was selected over the weekend to become Chair of the Federal Communications Commission, even though Trump pretended during the campaign that he wanted nothing to do with Project 2025 and the people who created it. Carr quickly took to his friend Elon Musk's Twitter/X after his nomination on Sunday to declare a war on "censorship" by Big Tech companies, before subsequently appearing on Fox "News" to suggest the FCC must review broadcast licenses granted to news outlets like CBS. During the campaign, Trump called for the censorship or complete shutdown of almost all broadcast and cable news outlets that are not rightwing propagandists.

It must also be noted that Project 2025 specifically calls (see p. 279) for reviewing the broadcast licenses to Pacifica Radio Network, which has dozens of affiliate stations across the country that air The BradCast every day, including KPFK, our flagship station here in Los Angeles.

NEXT... The New York state justice system is in completely uncharted waters at the moment, with the election of Donald Trump following his conviction earlier this year on 34 felony counts of fraud related to his hush money payment to adult film actress Stormy Daniels before the 2016 election. Sentencing in the case had been scheduled for November 26. But this week, prosecutors from the office of Manhattan District Attorney Alvin Bragg informed Justice Juan Merchan they were willing to pause sentencing to litigate Trump's assertions that, following his election this month and the U.S. Supreme Court's absurd "Presidential Immunity" ruling over the Summer, he can never be sentenced at all and the case must be dismissed in full. NY prosecutors, however, disagree and argue he should still be sentenced even if, in a worst case scenario, it must wait until after Trump is out of office.

We're joined today to help us make sense of this mess by George Washington University law school professor RANDALL D. ELIASON, who previously served as chief of the U.S. Justice Dept.'s Fraud and Public Corruption section in D.C.. Over the weekend, Eliason argued in an article at The Atlantic that New York must proceed with sentencing of Trump before he is sworn in to office next January.

"At this point," he tells me today, "it's almost less important what the actual sentence is. But I think it's important for the justice system to see that this case gets concluded, and doesn't just kind of dangle out there for the next four years. The case has already been tried and we already have a jury verdict. And it could be sentenced before he even takes office. That's not going to 'chill' him from doing anything as President, because it's over, and it's not going to take any of his time because appeals are handled by the lawyers."

While conceding "we don't have any precedent for any of this" and that a prison sentence certainly can't happen while he's in office, Eliason argues that it's "important now that A sentencing happens," even if it "can't be that meaningful or consequential. But I think it should take place just as a matter of the justice system completing this prosecution, honoring the jury's verdict, and having an official judgment of conviction entered on the record that he is, in fact, a convicted felon. Then the appeals can proceed in the normal course."

In addition to much more on that, we also discuss...

• The "extremely concerning" appointment of Matt Gaetz as U.S. Attorney General, who, the longtime DoJ veteran Eliason describes as "completely unqualified for the job" with "his only connection to the Justice Department, as far as I can tell, as the subject of a criminal investigation";
• The likelihood of Trump using recess appointments to push many of them through without Constitutionally-mandated Senate oversight. "How much Trump can get away with is going to come down to whether Senate Republicans have any backbone at all, and are willing to stand up for their Constitutional role for advice and consent." (Uh, oh);
• Whether the sprawling racketeering conspiracy case against Trump can continue in Georgia against his 18 indicted co-conspirators even if the ringleader of the attempt to steal the 2020 election in the Peach State is now either let off the hook entirely or is allowed to defer the trial until after he is out of office;
• How Eliason would like to see Special Counsel Jack Smith end the two federal indictments against Trump for his attempt to steal the 2020 election and his theft of hundreds of pages of highly classified national security documents the last time he left office in 2021;
• And whether Trump will still have to pay his civil penalties no matter what happens, including the $355 million fraud verdict against him in New York State and the $83 million jury award in the sexual assault case against him won by writer E. Jean Carroll...
