It's received almost zero attention or notice, but the Republican appointees to the Federal Election Commission on Thursday tried to overturn a bedrock principle of American democracy: transparency of contributions and the identities of donors to political campaigns. The move caught us here at The BradCast by surprise, but we feel slightly better after hearing that our guest today, one of the nation's foremost experts on campaign finance, also just learned about this unprecedented effort. [Audio link to full show follows this summary.]

BUT FIRST UP... Two unusual rulings from the packed, stolen and corrupted U.S. Supreme Court. Unusual for several reasons. One, because both oppose rightwing advocacy. Two, because a majority of rightwingers on the Court voted in favor of both of them. And three, because the Court's liberals voted in a bloc against one of them! We try to make sense of all of that for you today in each of the two rulings.

One came late on Wednesday, when the Court invoked the so-called Purcell Principle, which prevents changes to election rules, laws and district maps too close to an election, theoretically in order to avoid confusion by voters or election administrators. But this principle is opportunistically invoked by the rightwing Court when they feel like it --- even it means allowing, for example, the use of a U.S. House District map that has been found unconstitutional by the courts --- and ignored when they don't.

Their unsigned shadow-docket ruling [PDF] on Wednesday, however, invoked Purcell to allow a U.S. House District map that was newly approved by Louisiana's GOP-controlled legislature. It adds a second Black-majority voting district in the state after its previous map was found to be in violation of the Voting Rights Act following a years-long legal fight. But after the new map was approved by the state earlier this year, a group of self-described "non-Black voters" sued, claiming the new map was an unlawful racial gerrymander. A 3-judge panel on the 5th Circuit agreed and ordered a new new map. That is the order that was blocked on Wednesday by SCOTUS, allowing the second Black-majority district to stand as is, at least for 2024, even as the Court's liberal Justices, to the surprise of many, voted in against the rightwing majority. The other unusual SCOTUS ruling came today, via a 7 to 2 majority opinion [PDF] written by Justice Clarence Thomas(!) and opposed only by fellow rightwing Justices Sam Alito and Neil Gorsuch. The majority opinion rejected an effort by the sleazy payday lending industry to kill the federal Consumer Financial Protection Bureau (CFPB).

The CFPB was the brainchild of Elizabeth Warren during the Obama Administration, before she became a U.S. Senator. It was created on the heels of the subprime mortgage crisis that led to the Great Recession. To avoid industry influence on funding of the federal government's only consumer-oriented agency, it was housed inside of the Federal Reserve and allowed to draw up to $600 million per year for its budget, rather than go through the Congressional appropriations process each year. The payday lender group filed suit to argue the CFPB's funding mechanism ran afoul of the Constitution's Appropriations Clause and, therefore, all of the CFPB's actions since its 2010 founding, including billions of dollars in fines leveed against their industry, must all be rolled back and the agency dissolved.

Thomas, the Court's liberals, and three more of its Republican appointees flatly rejected the lender's case. They held that, though its funding mechanism is somewhat outside the norm, Congress may still change the way it is funded at any time. Also, as the majority opinion notes, there have been other agencies, such as the Customs Service and USPS, which have had similar, non-annual standing appropriations since the founding of the country.

NEXT... On Thursday, the Federal Election Commission (FEC) held an historic vote on a new rule to allow campaign donors to remain anonymous if they claimed that allowing their identities to become public would lead to harassment. The Federal Election Campaign Act (FECA) already allows some very rare exceptions for members of groups who are shown to have been historically harassed by the U.S. Government itself. Beyond that, however, allowing for campaign donors to remain anonymous challenges the very basis of our system of open, transparent, democratic elections.

We're joined today by CRAIG HOLMAN, longtime government affairs and ethics lobbyist at the non-profit watchdog Public Citizen. He is helping to lead the fight against this startling effort headed up by Trump-appointed FEC Commissioner Alan Dickerson.

The new rule "cuts into the very fabric of a functional democratic society," argues Public Citizen in its public comment against the rule. They note it would "vastly expand the donor [disclosure] exemption far beyond its original purpose, would undermine effective disclosure of the sources of political spending, deprive voters of critical election information, swamp the FEC under a wave of new paperwork, and runs contrary to the core mission of the agency." Other than that, it's great!

"What I really find astounding is that people of all partisan persuasions, Democrats and Republicans, have always believed in disclosure," Holman tells me today. "That's the one pillar of campaign finance law that no one has really come out against. The Republicans may come out against contribution limits, regulation of money in politics, but they always say to have transparency so we know where the money is coming from. This is the very first time that the FEC has encroached upon that principle."

The good(ish) news for now, is that he reports the Commission deadlocked, in a three-to-three vote along partisan lines today. That kills it for the moment. Though, in a second vote today, Holman says they agreed to ask the FEC's General Counsel to study the matter and report back in 75 days. That, he says, is likely to result in a second attempt by Dickerson later this year. Holman says he knows Dickerson to be a "hardcore deregulation" supporter. But "this is the first time the FEC has addressed the actual issue: 'Should we just get rid of disclosure altogether?'"

"Fortunately the FEC deadlocked," Holman says. But "that means three Republicans were saying 'Yes, let's get rid of disclosure!' That's frightening. We only defeated this resolution by a deadlock vote."

Holman has much more on "how absurd" Dickerson's proposal is, and the fact that "it caught us all by surprise." He also fills us in on a petition that he has filed for a new FEC rule that will be voted on next month regarding mandatory disclosure by campaigns when they use deepfake audio and video, created by Artificial Intelligence, to mislead voters.

And we thought the real news sites were bad enough. Now, as discussed on today's BradCast, fake ones, aided by Artificial Intelligence and funded by shadowy rightwingers to surreptitiously promote candidates and rightwing propaganda, are springing to life across the country in advance of this year's critical election. Ain't that all that we need? [Audio link to full show follows this summary.]

But first up, a few news headlines of note today...

The Trump Organization's long-time Chief Financial Officer, Allen Weisselberg returned to Rikers Island today after serving a 100 day sentence just last year on tax fraud charges related to unreported perks he received over many years from the company. Today, the 76-year old Weisselberg was sentenced to five more months in the pen after pleading guilty to perjury for lying to state prosecutors in testimony and on the witness stand in Donald Trump's recent $454 million civil fraud trial about the size of the disgraced former President's New York apartment. The lie inflated the value of the Trump Tower penthouse on financial statements by some $200 million.

And, in Arizona, the state's all-Republican Supreme Court unleashed havoc on Tuesday --- for both abortion supporters and opponents alike --- when it reinstated a 160-year old near-total abortion ban originally adopted in 1864, before Arizona was a state or women had the right to vote. Many state Republicans, like U.S. Senate candidate Kari Lake, are now in full panic mode on the heels of the Court approving the law she previously claimed to support. Now, for some reason, she doesn't, as revealed in an incoherent (and hilarious) statement demanding that AZ's Democratic Governor somehow roll it all back, even while Lake also still claims to oppose abortion.

For his part on Wednesday, Donald Trump, who on Monday bragged yet again about his role in overturning Roe v. Wade, both claimed that the abortion issue was now settled to everyone's satisfaction as a states' rights matter, while calling out the AZ Supreme Court for "going too far" in reinstating the 1864 ban on all abortions in the state, with an exception only for saving the life of mother. He insists that the GOP-controlled (for now) state legislature will repeal the ban. But Republicans leaders in both the state House and Senate on Wednesday insisted otherwise, thwarting attempts by Democrats to repeal the antiquated law.

It is all as mad as it sounds. But, despite the havoc this is causing for women and doctors in the state, all of it may turn out to be very good news for Democrats in the battleground state this November. Arizona, and other states, will see ballot initiatives to protect reproductive rights. That is likely to have a remarkable effect on turnout by angry voters.

Of course, that also depends on an educated --- not disinformed --- electorate. And, right now, as the Financial Times recently reported, there is a well-funded scheme underway by rightwing billionaire activists, the Republican Party and fossil fuel interests, among others, to confuse as many people as possible about real news by using real looking "pink slime" websites that push political propaganda while masquerading as legitimate local news sites.

According to media watchdog NewsGuard, as of April 1, there were as many fake "pink slime" websites operating in the U.S., pretending to be real local news outlets, as there were actual, real, local news sites!

We're joined today by ALEX MAHADEVAN, Director at the non-profit Poynter Institute's MediaWise project, which seeks to "empower diverse communities with the skills to identify misinformation."

"The word 'pink slime' encompasses a lot of different types of these algorithmically-generated or poorly reported news websites," Mahadevan tells me. "To me, the 'pink slime' news websites that worry me the most are the ones that aren't necessarily fake news, but have a lot of real news in it. Most of it has been scraped by algorithms from press releases, but then within some of those articles are very biased, misleading articles that favor one candidate or another candidate."

The websites have names like "Chicago City Wire", a cite which doesn't disclose its funding or political purpose other than to say, "Funding for this news site is provided, in part, by advocacy groups who share our beliefs in limited government." At least if you bother to dig deep enough on the site to find that statement.

One of the largest networks of "pink slime" sites is run by an outfit named Metric Media, which claims to feature about 1,000 "local" sites, most of which, according to FT, "do not disclose any political funding or partisan stance, saying that they provide 'data-driven information without political bias.'" Metric Media is reportedly run by a web of shell companies, non-profits and corporate entities linked to three men, "conservative businessman and publisher Brian Timpone, Texas oil billionaire Tim Dunn, and Republican Party adviser Bradley Cameron."

Creation of these sites, according to researchers, is now easier than ever thanks to Artificial Intelligence apps, and comes at a time when social media outlets have cut back on their moderation teams that might otherwise prevent links to such propaganda outlets from proliferating. Instead, the "pink slime" sites are spending millions to advertise on those same social media sites like Facebook, Twitter/X and Instagram.

Mahadevan explains how he was able, in February of last year, to use the free version of the AI app, Chat-GPT, to create such a fake cite. "In about a half hour I was able to generate fake news articles, along with fake news reporters, fake editors, and fake publishers --- along with their headshots --- and create the code and launch a fake news website completely out of thin air. To me, that was really frightening."

All of it, in fact, is frightening --- not only the fake news that is taking the place of real local news reporting, but the loss of those critical local outlets in the first place and what happens to "the soul of these communities when we lose local news outlets," laments Mahadevan, who goes on to warn that all of this is "terrible for democracy."

Okay. I'm back. COVID free! (Again!) Hopefully for good this time, as discussed --- along with many other things --- on today's BradCast. [Audio link to full show follows this summary.]

Among the news we begin to get caught up with today after my rebound sidelining last week...

  • My surprise COVID rebound last week and lessons learned in the bargain. If the news out of the federal courtroom in New York today in the second E. Jean Carroll defamation trial is to be believed, our disgraced former President may have his own new infection again soon.
  • After, just last week, condemning those Republicans who "kiss the ring" of Donald Trump in order to save themselves, Florida Governor and failed 2024 Presidential candidate Ron DeSantis dropped out of the race on Sunday. And, yes, he kissed the ring in hopes of saving himself for 2028 by endorsing Donald Trump. DeSantis also used a fake quote from Winston Churchill when doing so, just so he could fail as spectacularly as possible on his way out the door.
  • New Hampshire's first-in-the-nation primary is Tuesday and former South Carolina Gov. Nikki Haley is the last GOPer left in the race other than the twice-impeached, four-time criminally indicted former President. If one believes the pre-primary polling, the race will be over by Wednesday. And the guy who was, literally, praising the idea of a "strongman running the country" during rallies in New Hampshire over the weekend, and telling supporters that U.S. Presidents must have complete immunity to commit any and all crimes, will be on a glide path toward becoming the 2024 Republican nominee for President of the United States.
  • While the DNC has not authorized a Democratic Primary in New Hampshire this year --- choosing instead to make South Carolina's February 3 contest the first official one for the Dems --- that hasn't stopped a write-in effort for Joe Biden in New Hampshire UNsanctioned Democratic Primary, in which Biden does not appear on the ballot. It has also resulted in what appears to be the first (known) dirty trick of 2024. NH voters began receiving robocalls over the weekend from "Joe Biden" instructing them not to vote at all on Tuesday. The incident is being investigated by law enforcement, but may give us an idea of what the abuse of Artificial Intelligence may have in store for us in this unprecedented 2024 election season.
  • On Monday, the U.S. Supreme Court --- in a 5 to 4 ruling --- sided with the Biden Administration's Border Patrol and said that they may, in fact, remove razor-wire placed on the Rio Grande by Texas Governor Greg Abbott, after Abbott's actions have already resulted in the death of a mother and her two young children drowning in the river. But four Justices (Thomas, Alito, Gorsuch and Kavanaugh) apparently have no use anymore for the U.S. Constitution's Supremacy Clause which gives deference to federal law over state law.
  • Finally, after weeks away from our flagship station (KPFK in L.A.) over the holidays and then during our multiple brushes with COVID, we were finally live in studio again and able to open the phone lines today to listeners on anything they wanted to discuss. Even if one of them felt like they had to lie to get on the air to say it.

Nicole Sandler is back on today's BradCast with a special interview, and otherwise taking up guest hosting duties while Brad remains out with his COVID rebound. (He's doing better and hopes to be back soon!) [Audio link to full show follows below this summary.]

Among our stories today...

  • The U.S. Dept. of Justice released a damning, 575-page report [PDF] detailing 'cascading failures' of law enforcement in responding to the 2022 mass shooting at Robb Elementary School in Uvalde, Texas. Nineteen children and 2 teachers were killed before law enforcement officers in Texas eventually shot the perpetrator. The report catalogues multiple points of failure by law enforcement officials, including a lack of leadership, training, coordination, communication, and poor decision-making that created confusion at the scene and delayed a confrontation with the gunman until a full 77 minutes after the first 911 call. The report also highlights the misinformation and poor handling of communications with victims' families in its aftermath. In a press conference regarding the DOJ's report on Thursday morning, U.S. Attorney General Merrick Garland charged: "The victims and survivors of the mass shooting at Robb Elementary School deserved better...It is now widely understood by law enforcement agencies that in active shooter incidents, time is not on the side of law enforcement. Every second counts. And the priority of law enforcement must be to immediately enter the room and stop the shooter."
  • It was another potentially expensive day in court for the disgraced former President, in the second civil trial brought against him by writer E. Jean Carroll. Today, however, as his mother-in-law was buried, Donald Trump was absent. That followed admonishments by the federal judge on Wednesday for disrupting court proceedings. An earlier jury already established that Trump sexually assaulted Carroll in the 1990's and then defamed her following his Presidency, awarding her $5 million dollars. This new jury will determine how much more he has to pay for his defamatory comments about her while serving as President.
  • Next, Nicole speaks with author KELLY CARLIN (pictured above), the only child of the late, legendary comedian George Carlin, about a disturbing new, unauthorized, AI-generated, hour-long YouTube 'comedy special' which used Artificial Intelligence to generate a fake version of her father. The video uses his likeness and signature style to say and do things her dad never said and never did. Reviews of the hour-long "special" have been brutal. But Kelly, who has also condemned the bastardized version of her father's work, details how AI is not only hoovering up and stealing the works of artists, writers and performers without permission, but also poses dangers to average citizens, whose likenesses can similarly be misused and abused with little hope for recourse under current laws. As Carlin warns in her conversation with Nicole: "This is bigger than a famous comedian, or a dead actor, or a live actor. This is about humanity having their autonomy and agency protected legally in this country."
  • Finally, we close with our latest Green News Report, as the rightwing majority on the U.S. Supreme Court signals its readiness to gut federal agency authority to craft environmental regulations; a new breed of climate denialism is flooding social media; and how, while the rest of the globe is having its warmest January on record, frigid Arctic air in the U.S. is stranding drivers of both gas-powered and electric vehicles alike...
