We pick up on today's BradCast with several new developments in stories we covered on yesterday's show plus much more, thanks to another insane day in Trump World. [Audio link to full show follows this summary.]

Among our coverage today...

  • On yesterday's show, we spoke with former DOJ Public Corruption chief Randall Eliason about reporting over the weekend, confirmed by multiple outlets, that Donald Trump's so-called "Border Czar", Tom Homan, accepted $50,000 in cash inside of a takeout food bag last year in exchange for a promise to "facilitate" future contracts if Trump won the election. According to internal DOJ documents and multiple sources at each outlet, Homan was caught on tape receiving the money from undercover law enforcement agents posing as businessmen. But after Trump took office, the bribery probe into Homan was summarily dropped by Trump associates leading the FBI and DOJ, on the supposed basis that no crimes were committed by Homan in the payoffs during the investigation begun during the Biden Administration.

    But, by last night, White House Press Secretary Karoline Leavitt took the DOJ denials a step further, claiming that Homan "never took the $50,000." That denial was not made by the DOJ when the story was first reported over the weekend. And even Homan himself, when asked about all of this on Fox "News" last night, didn't make that claim. Here merely said "I did nothing criminal. I did nothing illegal." Tune in for the full update on that wild story, before it disappears into the Trump news cycle ether. (Though Congressional Dems, to their credit, are trying to prevent that from happening.)

  • In another follow-up to another story we covered, if only briefly, yesterday... The news broke just before airtime that Disney/ABC announced Jimmy Kimmel's late night show would be returning to air on Tuesday, after it had been "indefinitely" sidelined last week following threats by Trump's sleazy FCC Chair Brendan Carr to rescind broadcast licenses from local affiliates who carried the show. The wildly inappropriate, unprecedented (and perhaps unlawful?) threats from Carr (and Trump) came after they decided they didn't like a fairly benign (and accurate) remark that Kimmel made on his show last week regarding the assassination of far-right Republican activist Charlie Kirk. The decision by Disney to bring Kimmel back was clearly based on massive public opprobrium, including massive cancellations of Disney's streaming services, etc.

    That good news, however, was tempered last night by an announcement from local station conglomerate Sinclair, declaring they would be pre-empting Kimmel's how with news programming. Broadcast behemoth Nexstar joined Sinclair on Tuesday, meaning that tens of millions of Americans in dozens of major markets will still be unable to watch Jimmy Kimmel Live! Both of those corporate conglomerates --- which own dozens of local stations all over the country (even if most Americans don't even realize it) have major mergers pending before Trump's corrupted FCC. So this very public fight, with serious First Amendment implications, will apparently continue. That, explains Josh Marshall today, is not necessarily a bad thing.

  • Our twisted President rambled for nearly an hour today to the U.N. General Assembly in New York. It was as insane as you might have imagined, only more so. From lies about his domestic accomplishments during his second term, to lies about his having "ended seven wars", to threats to the world's nations regarding migration, energy and climate change, about which he took particularly hilarious zeal in lying about in virtually every aspect, describing it as a "con", a "scam" and a "hoax". Desi Doyen helps us debunk just some of the most obnoxious lies from Trump at the U.N. on Tuesday. And, as also discussed: Please wary of the claims reported late today that Trump has somehow flipped his position on Russia's war on Ukraine.

So much Team Trump criming, so little time to cover it all on today's BradCast. But we try. [Audio link to full show follows this summary.]

Over the weekend, MSNBC broke the news, followed by confirmation from New York Times, that Donald Trump's so-called 'Border Czar', Tom Homan, was caught on tape last September accepting $50,000 in cash --- in a takeout food bag --- from undercover law enforcement officials posing as businessmen. The sting came about after the target of a separate corruption probe tipped off officials that Homan was accepting bribes in exchange for lucrative border security contracts in a new Trump administration, presuming he won last year's election.

After Trump took office, he tapped Homan to oversee his mass deportation of migrants, a scheme that, they had promised, would focus on removing "the worst of the worst" criminals. Instead, the majority of deportees have no criminal record, but the guy running the program has apparently been caught on tape accepting a cash payoff before returning to office.

The investigation into Homan, which reportedly began in the summer of 2024 under the Biden Administration's DOJ, was summarily closed after Trump returned to power by Trump's former criminal defense attorney turned Deputy Attorney General, Todd Blanche, and his FBI Director, Kash Patel. One of Trump's other personal attorneys, Emil Bove, who served as a top DOJ official until recently being confirmed by Republicans in the U.S. Senate as a federal judge, also reportedly had a hand in shutting down the probe of Homan.

A DOJ spokesperson described the investigation as "blatantly political" and an effort to target "President Trump’s allies rather than investigate real criminals and the millions of illegal aliens who flooded our country," claiming the investigation "found no evidence of illegal activity."

Over the same weekend that story broke, Trump sent what appears to have been meant as a private message to his Attorney General Pam Bondi, effectively ordering her to bring criminal charges against three of his top political foes, New York Attorney General Letitia James, former FBI Director James Comey, and California U.S. Senator Adam Schiff. The message addressed to "Pam", seemingly meant to be private, was instead posted publicly by Trump on his own failing social media website.

We're joined today for insight on all of this by RANDALL D. ELIASON, former chief of the DOJ's Fraud and Public Corruption Section at the U.S. Attorney Office in the District of Columbia. He now teaches white collar crime at George Washington University Law School and pens the Sidebars Blog newsletter.

Is there any reason to believe the DOJ and FBI were right to drop the bribery probe against Homan, in which it seems he was caught dead to rights taking a cash bribe according to multiple reports?

"It's really impossible to know without knowing exactly what's on the tape. It would all come down to what he said and what he agreed to do in exchange for the cash," Eliason tells me today. "But I will say that accepting $50,000 in cash in a fast-food bag is kind of an indication of corrupt intent, that the recipient knows something shady is going on. So you've got to say at a bare minimum, there's a substantial basis to conduct additional investigation." Reportedly, that's exactly what DOJ was doing until Team Trump shut it all down.

"This line coming out from the White House and the DOJ that there was no evidence of any criminal wrongdoing, that doesn't hold water," he argues. "There's clearly something fishy going on here when you're taking fifty grand in cash in a Cava food bag. So there's certainly some smoke there." But, he further explains, "the Supreme Court has made the federal bribery statute so narrow" there are a number of ways Homan could get off the hook. Of course, the fastest way is to have friends at the DOJ willing to corruptly dismiss the entire matter.

We discuss that in detail, along with what Eliason describes as an extraordinary break from decades of norms and tradition with Trump's "private" message to his A.G. regarding bringing charges against his perceived political foes.

"Trump sees the Justice Department as a tool that he can use to punish his enemies and reward his friends," charges Eliason. "And this historical, very important norm that politics is kept separated, that the Justice Department is kept independent from the White House because we don't want politics to influence criminal investigations and criminal prosecutions, has just been flipped completely on its head and thrown out the window. It doesn't exist anymore under this administration."

"He is trying to use the Justice Department to go after his political opponents. And he also uses it to reward his friends. Whether it's Homan, or [Mayor] Eric Adams in New York City, or all the January 6 rioters, pardoning all of them. It's one of the most discouraging things that is happening in this administration --- the complete gutting of the law."

"This is really scary stuff," adds Eliason. "This idea that the President can order a prosecutor to bring criminal charges, and if he doesn't, he'll fire you and put someone in place who will. It's unthinkable to anyone who has worked as a federal prosecutor. It's directly contradictory to the mission and ethical obligations of a federal prosecutor. It would have been completely unheard of before now."

It is all of a piece, he explains, with "many things that are going on at the Justice Department that just breaks the hearts of those of us who worked there and love it."

Finally, breaking news just before airtime today on Trump's FCC Chairman Brendan Carr's outrageous threat last week against Disney/ABC and their affiliate stations to take away their broadcast licenses unless they cancel Jimmy Kimmel's late night show after comments Kimmel made that they didn't care for regarding the recent murder of Republican activist Charlie Kirk. After enormous public blowback against Disney following last week's "indefinite suspension" of Jimmy Kimmel LIve, news broke late today that Kimmel will now be returning to air as of Tuesday night. Looks like public pressure, a torrent of cancelled Disney+ subscriptions and the U.S. Constitution's First Amendment may have won this round, at least partly...at least for now. Since getting off air, Sinclair Broadcasting, a rightwing outlet that owns more than 35 ABC affiliate stations and is seeking favors from the FCC, has announced they plan to air news programming instead of Kimmel's show beginning on Tuesday night...

Today on The BradCast (my last until next week, see "NOTE" below), a full week after the awful murder of Republican activist Charlie Kirk, the political ramifications --- and opportunism --- is becoming quite clear. And it all has a very familiar echo to those of us, including my guests today, who were around and paying close attention 24 years ago this month. [Audio link to full show follows this summary.]

Back then, an unpopular President in the first eight months of his term saw his political fortunes reversed in the aftermath of the horrific terror attacks on September 11, 2001, as much of the nation "rallied around the flag" in support of that President, in response. His Administration, however, ran way too far with its presumed mandate in subsequent months and years. Innocent Americans themselves came under suspicion and paid a price (sometimes large, sometimes small) for their words and their political beliefs. The nation ended up committing itself to (at least) two, years-long, unwinnable foreign wars. And actions taken against Americans in the name, supposedly, of national security would bend norms, laws and Constitutional rights beyond recognition at times.

Charlie Kirk has yet to be buried. And yet, his most powerful ally, a very unpopular Donald Trump, his Administration and their supporters are already targeting their fellow Americans for retribution --- for a crime they had nothing to do with.

After years of describing Democrats as "fascists" and "the enemy within", Trump now claims that Kirk's death was the "tragic consequence of demonizing those with whom you disagree...in the most hateful and despicable way possible." In making his case, he cites "radical left" "scum" and unnamed "leftist organizations" as being responsible, vowing to target, prosecute and defund them for a crime that nobody other than the shooter seems to have carried out.

On Monday, Trump's Vice President, J.D. Vance, declared "left-wing extremism" was to blame and that "the data is clear" it is "not a both sides problem." It is "people on the Left" that are to blame for rising political violence. That, after the Trump Dept. of Justice removed a National Institute of Justice report from its website that finds white supremacist and far-right violence "continues to outpace all other types of terrorism and domestic violent extremism" in the United States. The study (now archived here) was there on the day that Kirk was killed. It was disappeared by the Trump Administration thereafter.

Speaking to Vance on the very same show on Monday, Trump's top White House political czar, Stephen Miller, furiously vowed "to uproot and dismantle these terrorist networks" and to "use every resource we have at the DOJ, Homeland Security and throughout this government to dismantle and destroy these networks."

Of course, there are no known "networks", at this time, tied to Kirk's murder in any way. But that's okay. Trump's Attorney General, Pam Bondi, promised on Monday to "absolutely target" anyone who uses "hate speech" that she doesn't like in the wake of Kirk's death. When asked about Bondi's remarks by an ABC News reporter on the White House lawn, Trump accused him of having "a lot of hate in your heart" and threatened: "Maybe I'll come after ABC."

(Shortly after we wrapped today's program, news broke that ABC was "indefinitely" pulling its popular late-night show, Jimmy Kimmel Live!. The announcement came after Trump's FCC chair threatened to "take action" against ABC and its owner Disney, and suggesting he might pull broadcast licenses from affiliate stations. The threats were apparently in response to Kimmel's charge on Monday that MAGA was "doing everything they can to score political points from" Kirk's death. Today, it seems, they scored another point. Though, to be fair, Trump said back in July, after taking credit for the recent cancellation of Stephen Colbert's top-rated late night show on CBS, "I hear Jimmy Kimmel is next." So, obviously all of this is just opportunism.)

Oh, and Rep. Clay Higgins, Chair of the Federal Law Enforcement subcommittee of the House Oversight Committee, sent a letter this week to the CEOs of six social media companies, (falsely) instructing them that they are required, by law, to remove comments regarding Kirk's assassination that Higgins and his compatriots might find offensive. He claimed the "restriction of public statements...is not an oppression of free speech [but] the protection of free speech." [Emphasis added for Orwell's sake.]

All of this sounds both familiar and chilling to those of us who lived through the aftermath of 9/11, including my guests today, HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo and the notorious 'DRIFTGLASS' of the Professional Left Podcast.

"This isn't surprising," says Digby. "They've been telegraphing this since Donald Trump started running back in 2022, that they were going to go after 'the Left' and his enemies, 'the enemies of the state.' After the Kirk shooting there were MAGA people who were saying out loud, 'This is our Reichstag Fire,' looking for that moment they could use as an excuse to do what they were always going to do anyway."

"They have to start targeting people online who they said were insufficiently reverent toward Charlie Kirk, and getting them fired. So much more free speech. But that's the first step you take in this," she adds, citing similar threats from Republicans in the George W. Bush Administration back in 2001.

"I would like to thank the Reichstag Fire comparators for acknowledging they are Nazis," quips Driftglass, "because that's what the Reichstag Fire was. Way to go, guys!"

Citing similar blowback against those who disagreed with Bush and his wars after 9/11, Driftglass adds: "This didn't start with Donald Trump. They have been demonizing the Left as responsible for everything wrong with this country for at least the last 35 years. And the rhetoric has finally caught up with actual action being taken at the highest level of the White House."

"In Neuromancer by William Gibson," Driftglass observes, "he coined a phrase called the 'consensual hallucination.' That's what they [MAGA] are all engaged in. They have hallucinated into existence a vast leftwing conspiracy, sneaky liberal media, lots of awfulness that justifies everything they do. This has been set up for 40 years now, that the Left is always worse, always a threat, and always a justification for escalation against the 'enemy within.'"

First up, a few interesting results reported today from both special elections and primaries held on Tuesday in a number of local jurisdictions across the country, including Detroit, Seattle, Delaware and Rhode Island. In short, the news, as we have seen in elections virtually everywhere so far this year, was largely very good for both Democrats and democracy.

The news was less good out of D.C. last night, where the nation's embarrassing Secretary of Health and Human Services, Robert F. Kennedy, Jr. --- a man with no professional background in either science or medicine --- announced the Department is now cutting $500 million in grants for the development of new mRNA vaccines of the type that recently, arguably miraculously, helped the planet emerge from the most deadly pandemic in a century.

Of course, if you either didn't hear about that disturbing news from HHS or had no idea how many people are now likely to die unnecessarily because of it, you may have your own favorite corporate media outlet to blame.

Following Donald Trump's gutting of the 80-year old Voice of America earlier this year, his and the Republican Congress' ending of federal funding for NPR and PBS a week or so ago, and the absurd $16 million dollar settlements of ridiculous defamation lawsuits filed by Trump against the corporate owners of Disney/ABC and Paramount/CBS, the largest media conglomerates in the nation continue to rollover in fear, in hopes of placating and/or currying favor with our press-freedom hating, tyrannical man-baby President.

All of that in strict contradiction with the intentions of the U.S. Constitution's framers, who specifically wrote protections into our founding document for just one industry: a free press. All of that is detailed in a new report published last week by FreePress.net entitled "A More Perfect Media: Saving America’s Fourth Estate from Billionaires, Broligarchy and Trump".

That report is meant as a companion to the nonprofit media watchdog's newly released "Media Capitulation Index", grading the independence --- or, far more often, lack thereof --- of the nation's 35 largest corporate media conglomerates.

We're joined today to discuss both reports and the chilling state of our formerly free press, by TIMOTHY KARR, Senior Director of Strategy and Communications at Free Press. We've got a lot to dig into, including how we might finally dig our way out of this disaster.

His group's Media Capitulation Index, amusingly, scores each of the 35 American media conglomerates examined by Karr's group from 1 to 5 Chickens, rating them from "vulnerable" to "compromising" to "capitulating" to "obeying" to "propaganda," respectively. There is one other possible score, a single Star representing "independent". Remarkably, only two of the 35 media giants examined received a Star. For the rest? A whooole lotta Chickens.

So, what distinguishes what we are seeing now under Trump from what we've seen these companies do in years past in hopes of currying favor with previous Presidents of both major parties? Karr explains that what we are witnessing now is of an entirely "different order" than anything we have ever seen in our nation's nearly 250-year history.

"Wealthy media companies were aligning themselves with an authoritarian-minded leader who had little regard for the First Amendment --- that he swore on the Bible to uphold and defend --- on January 20th," observes Karr. "This is capitulation of a different order. It's not a bending to prevailing political winds. It's a complete caving to an authoritarian, and abdicating their responsibility --- the responsibility protected under the First Amendment --- to act as a check against abuses of power, to speak truth to power. That has pretty dangerous consequences for democracy."

As we are now seeing those dangerous consequences play out, we've got a lot to discuss along that score, along with how might eventually emerge from this long national nightmare with even stronger protections for a free press. Perhaps even, with news organizations that might not find it necessary to bend over in order for their corporate owners to receive government approval in completely different industries in which the owner is massively invested. (Hint: Look to the states, not the federal government...for now.)

Anyway, far too much in our conversation today to adequately summarize here. So, I won't even try to go much further. I will urge you, however, to tune in to today's show if you value a truly independent media, and appreciate --- as our founders did --- how crucial that idea is in preventing the rise of a monarch of the very type they were hoping to break free from. (And, how did that work out?...)

Hand-count reverses results in Ashtabula County; FBI informant pleads guilty to Russian lies about Ukrainian bribes (not) paid to Bidens; Trump Cabinet picks donated millions; Tech/media billionaires pay tribute...

Still trying to make sense of it all on today's BradCast. But at least we've got confirmation today on a few different stories that we've been yelling and screaming about for years now. [Audio link to full show follows below this summary.]

Among our stories today...

  • A hand-count of ballots in Ashtabula County, Ohio last week found that two contests on the ballot --- one, a tax levy to fund city schools, the other, to fund a cemetery district --- were actually adopted by voters on November 5th, after previously being reported, inaccurately, as having failed. The hand-count in the contests took place after errors were discovered in the tabulation for all County Issues on the ballot during a hand-count of a fire district levy, which also flipped from NO to YES, thanks to the hand-count.

    Tomorrow, the 2024 Presidential Electors, chosen by the popular vote in each state, will meet in each state capital to cast their vote in the Electoral College. A majority of those votes will be cast for Donald Trump, based on the computer-tallied results in each state. Those results either accurately reflect the intent of the majority of the electorate --- or they do not. Without the publicly-overseen hand-counts that cybersecurity and voting system experts were strongly recommending this year in particular (we think it's a good idea for every election), Americans are unlikely to ever know one way or the other if Trump actually defeated Kamala Harris. At least in Ashtabula they now know that their levy issues were tallied as per voter intent, and the local high school which saw its roof collapse in early December under five and a half feet of snow, will now be able to afford to fix the damage.

  • Former FBI informant Alexander Smirnov pleaded guilty on Monday to lying to federal agents about a supposed $10 million in bribes he falsely claimed were paid by Burisma, an energy company in Ukraine, to Joe Biden and his son Hunter. Those lies, which Smirnov said were peddled to him by members of Russian intelligence, were at the center of House Republicans' failed attempt to impeach President Biden, after they and Trump and his other supporters laundered that disinformation from Russian intelligence operatives into the American media and chambers of the U.S. Congress.
  • Over the weekend, CNN reported that nearly three dozen of Donald Trump's nominees for his incoming Administration were donors to his campaign or to "outside" groups supporting him. Eight of Trump's nominees to Cabinet positions, so far, donated more than $37 million dollars. That doesn't even include the $277 million dollars spent by Elon Musk to help buy Trump's Presidency and his position of power within it. Musk has been named to head up Trump's so-called "Department of Government Efficiency." Compare that to the seemingly paltry $100,000 in donations to the 2020 Biden Campaign or super PACs supporting him, from a dozen members of Biden's Cabinet. As Sen. Bernie Sanders (I-VT) noted this weekend on Meet the Press, "Never before in American history have so few billionaires, so few people, had so much wealth and so much power. And never before, in American history, have the people on top had so much political power. We can't go around the world saying, 'Oh, well, in Russia, Putin has an oligarchy.' Well, we've got an oligarchy here too!"
  • Of course, it's not just those hoping to abuse positions of power in Trump's next Administration. Over the past week, Amazon founder (and Washington Post owner) Jeff Bezos and Facebook CEO Mark Zuckerberg each announced their companies were giving $1 million to Trump's inauguration fund. And over the weekend, ABC News --- owned by the Goliath, $200 billion Disney corporation --- announced they were settling a defamation case filed against them and George Stephanopoulos after the ABC anchors' on-air assertion that Donald Trump "had been found liable for rape" in the lawsuits filed against him by writer E. Jean Carroll, in which juries found Trump liable for some $88 million dollars after guilty verdicts for sexual abuse and defamation. The case they chose to settle would likely easily have been won by ABC for a number of reasons, including the fact that the Judge in Carroll's defamation case against Trump told the jury that the jury in the sexual assault case found Trump was indeed found guilty of what "many people commonly understand the word 'rape'" to mean. Instead of fighting, however, the Disney-owned company bent the knee, agreed to issue an apology, give $15 million to Trump's future Presidential Library fund as a "charitable contribution", and $1 million to his law firm. Why would they do that? Josh Marshall offers an excellent explanation, citing how legacy media outlets like ABC News and Washington Post (along with CNN, NBC, MSNBC and others) amount to a drop in the bucket to the major corporations which own them. While those corporations are willing to sacrifice their money-losing news outfits, they are willing to pay tribute to the "King" to help dissuade him from abusing his power to go after the rest of their multi-billion dollar corporations that are far more vulnerable to abuses of power by a corrupt President.
  • Finally, we open the phone lines to listeners on all of the above --- or whatever else is on their minds today --- in what is likely to be our last call-in show of the year. And, for reasons I cannot explain, they were all suspiciously kind today. Hmmm....

A California three-way; Polls shift toward Biden; Republican scam artists pay the price; Trump rejected again in NY criminal fraud case, facing trouble for phony $175M bond in NY civil fraud case...

Keep hope alive. We've got a bunch of mostly good news stories for you on today's BradCast! [Audio link to full program is posted at the end of this summary.]

Among those stories today...

  • EVERY VOTE MATTERS: The great state of California has finally wrapped up its month-long tabulation and canvassing following its March 5th Super Tuesday primaries. And, in one race, there's a bit of a first-of-its kind surprise. Ever since 2012, the state has run a top-two primary system, where candidates from all parties run in the same primary race and the top two vote-getters, regardless of party, go on to compete in the general election. This year, however, in a U.S. House race for an open seat in the state's 16th Congressional District, there was an exact tie among the 2nd and 3rd place candidates, who each received exactly 30,249 votes. So, three candidates --- in this case, all Democrats --- will go on to the November general election and its anybody's guess who may win.
  • BIDEN RISING: After months of polls showing Joe Biden trailing Donald Trump in national polling, now that the general election is in sight with Americans finally beginning to understand that --- like it or not --- it will almost certainly be a Biden v. Trump match-up, the polls are finally turning in favor of the President. It's a fairly small shift, but a meaningful one, with a bevy of high quality polls almost all finding Biden either ahead of or tied with Trump. There are lots of caveats for these numbers, as discussed today (for example, it's only April and these numbers could change, and they don't include third-party candidates, etc.), but the general news should come as an encouraging turn of events for those who have been freaked out for months about Biden's performance against Trump in early polling.
  • RIGHTWING DIRTY TRICKSTERS PAY THE PRICE: Bufoonish rightwing clowns Jacob Wohl and Jack Burkman, who sent misleading robocalls to thousands of Black voters, lying to them about being arrested and more if they voted in the 2020 election, continue to pay a price for their dumb, offensive, dirty tricks. The pair will now have to pay as much as $1.2 million for their violations of civil rights laws in New York, according to a consent decree struck with the state's Attorney General Letitia James. That follows previous penalties for the pair of a more than $5 million fine by the Federal Communications Commission last year, and two years of probation plus 500 hours of voter registration to which they were sentenced in Ohio, another of several states where their scam played out.
  • MORE RIGHTWING DIRTY TRICKSTERS PAYING A PRICE: A woman named Aimee Harris who pleaded guilty to stealing a diary belonging to President Biden's daughter Ashley Biden before the 2020 election, when she sold it for $40,000 to rightwing dirty trickster James O'Keefe and his nearly-defunct fake "news" outfit called Project Veritas, was sentenced to a month in prison, three in home confinement, two years of probation and to return the money she raised from her crimes. Her partner in the scam, who was smart enough to cooperate with federal authorities, will be sentenced later this year, suggesting that criminal charges may still be in the offing for the disgraced Republican operative O'Keefe. His home was searched by the FBI after the crime initially came to light. Keep hope alive.
  • NOPE: Yet another New York appeals court judge has rejected yet another last-ditch legal attempt by Donald Trump to delay his trial on 34 felony fraud counts related to his hush-money payments to porn star Stormy Daniels to help him cheat to win the 2016 election. That criminal trial is now still set to begin with jury selection this coming Monday. In this latest court denial, the NY appellate judge dismissed Trump's motion regarding the partial gag-order against him --- expanded after he identified and attacked the daughter of trial Judge Juan Merchan on social media --- charging the order was somehow "unconstitutional". The bad news for the disgraced former President comes just one day after his bid for a change of venue for the trial was similarly denied by a different appellate judge.
  • YOUR MONEY IS NO GOOD HERE: Last week it appeared that Trump successfully avoided, for now, the seizure of his property as he appeals his liability in New York's $454 million civil fraud judgment against him. He was allowed to file a reduced bond for just $175 million with the state. As it turns out, however, there are a lot of problems with that bond, as secured from a sleazy California outfit known as Knight Specialty Insurance Company. A LOT of problems. More and more of which have been coming to light ever since NY A.G. Tish James, last week, informed the judge in the case that Trump's bond appears to be deficient. Among those problems: the surety company is not licensed to issue bonds in New York; the company does not have enough "capital and surplus" to meet state standards (or even cover the amount of the bond!); and the bond itself appears to suggest Trump is responsible for the $175 million dollars, rather than Knight, which is not an actual bond at all. A hearing on the matter is scheduled in NY civil court for April 22.

Guest: Former federal prosecutor Randall D. Eliason; Also: How DeSantis robbed freedoms and weaponized Big Government 'cancel culture' in FL...

After more than twenty years of rolling back corruption and bribery statutes, is it any wonder, as our guest on today's BradCast observed in his latest op-ed, that the U.S. Supreme Court is now "blind to its own corruption"?

BUT FIRST, Florida Governor Ron DeSantis is announcing his 2024 Presidential run today, and corporate media outlets are focusing on his horse race with the disgraced former President. We mark the day, however, by focusing on several of the latest victims of DeSantis' Big Government weaponization against people of color and the LGBTQ+ community. That, by a guy whose 2022 re-election slogan in Florida was, laughably, "Freedom Lives Here".

DeSantis deserves credit for leading the way for other, similarly gerrymandered and GOP-controlled states which have begun to adopt many of the same, hateful, Big Government "cancel culture" statutes that, in Florida, have resulted in banned books, muzzled teachers, lost rights, vile threats against those who support freedom and travel warnings issued for those visiting the Sunshine State.

Today, the effort is playing out in terroristic threats against Target employees; an investigation of a Florida grade school teacher for showing an animated Disney film to her class; and the removal of The Hill We Climb --- a poem by Amanda Gorman which she read at Joe Biden's 2021 inauguration --- from a grade school library. That's just a sampling of some of the latest victims of DeSantis' cruel agenda during his tenure as Governor.

As California's Democratic Gov. Gavin Newsom tweeted in response to Target's removal of items from its Pride Month collection under threats from the MAGA right, "Wake up America. This doesn’t stop here. You’re black? You’re Asian? You’re Jewish? You’re a woman? You’re next."

THEN, it's back to the seemingly never-ending, decades-long corruption of U.S. Supreme Court Justice Clarence Thomas and some similar, recently revealed corruption by Justice Neil Gorsuch and even Chief Justice John Roberts who, by and large, refuses to do anything about any of it.

There's an explanation for that, argues RANDALL D. ELIASON, George Washington University Law School professor and former chief of the fraud and public corruption section at the U.S. Attorney’s Office in D.C.

"Over more than two decades, the Supreme Court has gutted laws aimed at fighting corruption and at limiting the ability of the powerful to enrich public officials in a position to advance their interests. As a result, today wealthy individuals and corporations may buy political access and influence with little fear of legal consequences, either for them or for the beneficiaries of their largess," Eliason argued in a New York Times op-ed over the weekend, adding: "No wonder Justice Thomas apparently thought his behavior was no big deal."

Today, Eliason tells me, "the Court itself has contributed to a legal environment over the last twenty years, where, at least as far as the Court is concerned, many of the things that are going on are not, in fact, corrupt, because they've taken this extremely narrow view of what corruption is." Essentially, he explains, cases such as Citizens United v. FEC; United States v. Sun-Diamond Growers; Skilling v. U.S.; and McDonnell v. U.S. have all greatly narrowed the definition of corruption to largely nothing less than a very specific quid pro quo bribe where a politician promises a very specific official act in exchange for payment.

That means, as some on the Court may now see it, long-term relationships where a GOP megadonor like Harlan Crow has sponsored hundreds of thousands of dollars in undisclosed luxury travel for Thomas, or purchased his mother's house, improved it, and allowed her to live there rent-free to this day, or even paying private school tuition for Thomas' grand-nephew, is not seen as "corruption" if it wasn't in return for a specific thing. Even Thomas' wife Ginni can receive tens of thousands of dollars in payoffs by far-right activists, and it's not considered corruption.

"These long term relationships, where wealthy donors can shower a politician or a Supreme Court justice with huge gifts over years --- that's okay. At least it's not criminal, unless prosecutors can prove beyond a reasonable doubt that one particular gift was because of one particular thing they did," Eliason explains, detailing how the Court has cloistered itself into a world where all of this is somehow okay.

"The reality of corruption is usually much more subtle that that, and pervasive than that. It's a long-term 'You scratch my back and I'll scratch yours' kind of arrangement. 'I'll give you these fancy trips and gifts and things over time, and then when things happen to come up that I'm interested in, you'll do the right thing for me, and we don't even have to talk about it. We don't have to have an explicit deal, it's just an understanding between us.' That's what real-world corruption is like. But for more than twenty years, the Court has issued a series of opinions that have largely put arrangements like that --- like the arrangement between Harlan Crow and Clarence Thomas --- out of the reach of the law."

We've got a lot to discuss on these matters with Eliason today, including his suggestions for how Congress could fix this clearly broken and corrupt system, even as the Chief Justice suggests (inaccurately) that doing so would somehow be a violation of the Constitution's Separation of Powers doctrine. Ironically enough, if Congress finally does manage to legislate ethics reform for the Court and someone did challenge it as unconstitutional, guess who would get to be the final arbiter? "I wonder how they are going to rule?," quips Eliason...

Today on The BradCast: Their positions on actual issues are wildly unpopular. Their phony culture war issues are bombing. Is it any wonder the GOP's best chance may now simply be to prevent their opponents from being able to cast a vote at all?

On today's program...

MICKEY MOUSE GOVERNOR: The Walt Disney Co. sued Florida Gov. Ron DeSantis today in response to "a relentless campaign to weaponize government power against Disney in retaliation for expressing a political viewpoint unpopular with certain State officials." That, after the company dared oppose the official state position in favor of banning free speech in schools.

COW GOES MOO: A Donald Trump-appointed federal judge has tossed out libel lawsuits filed by doofus Rep. Devin Nunes (R-CA) against an Esquire journalist and its publisher for reporting that the wingnut former Congressman turned Trump social media CEO's family farm "knowingly" employed hundreds of undocumented workers. The judge found the reporting to to be "substantially, objectively true." Almost all 10 of the similarly ill-considered suits Nunes filed against perceived opponents in 2019 have now been dismissed. Only two of them, against anonymous Twitter accounts named "Devin Nunes' Mom" and "Devin Nunes' Cow" remain.

BOARD SILLY: While progressives scored big in marquee contests during the April 4 elections --- liberals won a majority on the Wisconsin Supreme Court for the first time in 15 years, and former teacher and union member Brandon Johnson became Chicago's mayor --- far-right MAGA school board candidates running on phony culture war issues "flamed out", according to Politico, in both Illinois and Wisconsin. They didn't do much better last November, even in "red" states like Missouri and Oklahoma. But GOP operatives apparently plan to keep choking the same chicken in elections later this year and in 2024, even as voters appear to prefer funding schools and keeping kids safe at them, over banning books, stifling free speech, and cancelling LGBTQ kids.

WOULDA WON BUT FOR THOSE MEDDLING (VOTING) KIDS!: Last week, longtime GOP attorney and vote suppressor Cleta Mitchell was caught in an audio recording obtained by Undercurrents' Lauren Windsor at a GOP donor event in Nashville, discussing plans to "combat" young voters by preventing them from voting on campuses in Virginia, North Carolina and elsewhere. She even vowed that Republican lawmakers may be able to eliminate 45 days of early voting and same day voter registration if they played their cards right, and kept giving money to her insidiously named "Election Integrity Network". If Mitchell's name is familiar, it's because she was on that infamous January 2021 phone call with Donald Trump hoping to strong-arm the Georgia Sec. of State into "finding" 11,000 votes to steal the state's Presidential election from Joe Biden.

SEND IN THE CLOWNS: It's bad enough to push secret vote suppression schemes to GOP donors. It's reprehensible for top state Republican election officials to participate in such schemes. But that's exactly what happened at a so-called "Secretaries of State Conference" sponsored by the far-right Heritage Foundation and other anti-democracy groups in February. Documented, a nonprofit watchdog organization, obtained the agenda for the secret conference in which only Republican Secretaries of State were invited to participate.

It was led by longtime, notorious GOP "Voter Fraud" fraudsters and liars like Hans Von Spakovsky, J. Christian Adams, J. Kenneth Blackwell and perhaps most shamefully, current U.S. Election Assistance Commissioner Donald Palmer (appointed to the bipartisan federal agency by Trump). They all schemed with top election officials from 13 GOP-controlled states --- including the chief election officials from Indiana, Florida, Mississippi, Missouri, Montana, Tennessee, Virginia and West Virginia --- in a secret, off-the-record two-day confab.

We're joined today to discuss this appalling revelation by JAMIE COREY, a Senior Researcher at Documented who, with The Guardian's Ed Pilkington, exposed the entire pathetic affair, which, as Von Spakovsky insisted in an email she obtained, was "not a public event. It is a private, confidential meeting of the secretaries." --- Well, the Republican ones anyway, the ones who are supposed to run both state and federal elections in a non-partisan way.

"According to the event invitation we obtained, this is actually the sixth year in a row that they've held this event," says Corey. "And they have privately bragged --- Hans has --- to donors that they are excited that it's just for conservative Secretaries of State. No Democrats allowed."

"Voters should be concerned when you have election officials participating in a private, confidential meeting with former Trump associates, top voter suppression proponents, and groups who have been actively pushing false claims around elections," she explains. "As the agenda pointed out, there was a cocktail reception and dinner after the first day of substantive sessions wrapped up. So what you have there is top election officials, who are going to be overseeing the 2024 Presidential Election in their respective states, wining and dining with all these problematic people."

The historic news breaks as we are on air; Also: Newly unredacted evidence from the Fox 'News' 'Brain Room' in Dominion's defamation suit; Disney hilariously out-foxes DeSantis...

On the other hand, Donald Trump's statement at his own social media website says he's been "INDICATED". But why quibble? The news caught us mid-BradCast today. We did our best to make sense of it all on the fly. [Audio link to full show follows this summary.]

First up, we were covering the newly unredacted evidence from Dominion Voting System's $1.6 billion defamation lawsuit against the wildly corrupt Fox "News" outfit, regarding the Republican propaganda outlet's knowing lies and evidence-free claims that the voting machine company somehow helped to steal the 2020 Presidential election from Donald Trump. Dominion didn't, and Fox knew as much, according to their own "Brain Room", which they ignored. (Yes, they have a "Brain Room", apparently, at Fox. So, that must be where they keep them?) As bad for Fox as the previously released evidence was, this is the stuff they had redacted from that, for some reason, until a judge ordered it released on Wednesday. So, imagine how bad this stuff is? You don't have to. We discuss it on today's show before today's big breaking news.

Then, we were covering the hilarious case of Disney out-foxing (no pun intended) Florida's Republican Gov. Ron DeSantis and his attempt to weaponize the state government against them. That, because Disney dared speak out against his "Don't Say Gay" law which was written to allow the government to ban discussion of sexual orientation and general identity in ALL public school grades. (Not just K through 3.) So, how did Disney out-fox, DeSantis? It's pretty hilarious. So, tune in to find out.

Next, we were going to cover a whole bunch of important labor union news from this past week...BUT...news then broke of Trump's indictment by a criminal grand jury in New York.

Thus, we moved our latest Green News Report with Desi Doyen from the end of the show to the middle, to buy some time to figure out the breaking news hubbub. Sadly, there's some pretty important news in today's GNR, including the fact that electricity generated renewables outpaced coal last year for the first time in the U.S. That big news will all almost certain be forgotten because...well...

TRUMP WAS INDICTED today. Reportedly, the charges are in relation to his secret hush-money payoff of porn star Stormy Daniels just before the 2016 election, in hopes of improving his chance of winning. But we don't know, because the indictment by a New York grand jury is still sealed until next week.

The charges, brought by Manhattan District Attorney Alvin Bragg, whatever they are, represent the first indictment of a U.S. President in history. Trump will reportedly surrender next week in NYC, according to his attorney Joe Tacopina. He will then be finger-printed, booked and perhaps hand-cuffed before his arraignment. We'll see if that all happens.

Guest: Media activist (and Musk's former corporate PR trainer!) 'Spocko'; Also: Oregon Guv commutes all state death sentences; Schumer says ECA reform to be included in lame duck spending bill...

So, I've sorta been trying to avoid coverage on The BradCast of the idiocy underway at Twitter following Elon Musk's takeover of the social network for a ridiculous $44 billion six weeks ago. But today, as things are quickly turning much darker and dangerous, we're jumping down the rabbit hole. [Audio link to full show follows this summary.]

First up, however, two much more encouraging stories from elsewhere. In Oregon, outgoing Democratic Governor Kate Brown, who will be replaced by Democratic Gov.-elect Tina Kotek in January, has commuted the death sentences of every prisoner in the state on death row! There are 17 of them in all. They will now face life without the possibility of parole instead of being murdered by the government. Brown has also ordered the dismantling of the state's execution chamber in hopes of ending the practice for good there, describing the gruesome punishment (correctly) as "both dysfunctional and immoral."

In other encouraging news before decks are shuffled in January following this year's midterm elections, Senate Majority Leader Chuck Schumer has announced that the long-overdue Electoral Count Act reform measure (which we discussed on this program in detail back in February), as negotiated over the summer by a bipartisan group of Senators, will be included in the omnibus spending bill that lawmakers are scrambling to adopt this week before the deadline for a government shutdown.

The ECA reform measure, a version of which already passed in the House, would clarify the poorly-written 1887 law regarding procedures for certifying Electoral College votes following Presidential elections. In addition to making clear that a Vice President does not have the power to unilaterally toss out Electoral votes during the joint session of Congress to confirm Electoral College results, the bill would also raise the requirements for lawmakers to challenge slates of Electors and make it more difficult for a state Legislature to simply select different Electors than those chosen by state voters. All of that in response to Donald Trump's various attempts to exploit the original ECA on January 6th, 2021 to steal the 2020 Presidential election.

Hopefully there are enough Republican votes to overcome a filibuster in the Senate, and House Democrats will find the Senate version acceptable during this lame duck period. Otherwise, it'll be next to impossible to adopt ECA reform in advance of the 2024 Presidential election after the GOP takes over the House majority in January.

Then, it's down the Elon Musk Twitter Rabbit Hole, but with an eye toward potential solutions to the increasingly dark chaos he's unleashed since taking over the once-popular social network. While we've largely been trying to ignore the idiocy and hard-right political turn by Musk in his six weeks since taking over Twitter, what has largely been dumb has now arguably turned dangerous.

Over the past week or so, Musk has given a few journalists selective access to internal communications of former Twitter executives, resulting in online stories he refers to as "The Twitter Files". Rightwingers have pretended the published threads somehow confirm some sort of political bias against Donald Trump and fellow political travelers. Trump is pretending they prove that the 2020 election was stolen. They don't. In fact, they largely show Twitter execs wrestling in good faith with difficult internal decisions.

At the same time, Musk has restored previously suspended accounts to many on the far-right, including white supremacists, neo-Nazis, QAnon conspiracists, COVID deniers and 2020 election fraudsters.

More disturbing, however, are Musk's own recent tweets. They've grown darker and increasingly menacing, with attacks on transgender people, the revival of long-debunked COVID conspiracies and false accusations of pedophilia against named Twitter employees. One former top executive was reportedly forced to flee his home this week in response to growing threats. On the same day, Musk suddenly dissolved the company's volunteer Trust and Safety Council, an advisory group which AP describes as "around 100 independent civil, human rights and other organizations that the company formed in 2016 to address hate speech, child exploitation, suicide, self-harm and other problems on the platform."

That's just a taste of how all of this is quickly devolving. We're joined today by longtime media activist and pseudonymous progressive blogger 'SPOCKO', who has some thoughts on how people can push back against all of this. As it turns out, Spocko, who has worked to organize campaigns against a number of Rightwing media outlets and personalities over the past two decades, actually worked directly with Musk before he became unspeakably wealthy with the creation of PayPal.

At the time, Spocko was helping to train high-tech execs on how to speak to media, customers and investors. He shares his thoughts today on what he learned about Musk even back in the 1990s, when he was called in because Musk wouldn't listen to the female communications experts initially hired to help him.

Now, Spocko explains, "the thing we are talking about with Musk is what do you do when somebody has so much money and so much power, and then he gets rid of the checks and balances?" That becomes dangerous, especially for someone like Musk who he describes as a liar who "makes promises that he doesn't keep."

We discuss a number of campaigns --- both potential and underway --- to hold Musk to account for his increasingly threatening behavior, including the use of "free speech" tools that the billionaire claims to believe in (despite evidence showing he actually doesn't) to target advertisers that Twitter relies on to survive as well as companies like Apple, whose app store is critical to that survival, and the potential filing of civil lawsuits to hold Musk to account for defamation. There are also international efforts underway in places like Europe where the EU has informed social media networks that, by law, they must have measures in place to reduce potential harm or face being cut off entirely.

On today's BradCast: Disturbing news for Americans and free speech before Christmas, but great news for huge corporations enjoying record profits already. [Audio link to show follows below.]

First up, yet another media mega-merger is announced as Disney says they will purchase much of Rupert Murdoch's 21st Century Fox in a $52 billion dollar deal, even as Trump and the Congressional GOP push to give them all huge tax breaks --- at the expense of the poor and middle class. Republicans are hoping for final passage of their tax bill before Christmas and before presumptive Sen.-elect Doug Jones (D-AL) can be seated and further reduce the GOP's slim U.S. Senate majority.

On the upside today, one of Trump's wildly inappropriate industry shills nominated to the EPA has reportedly withdrawn, as have two wholly unqualified nominees for lifetime judgeship appointments to the federal bench.

Then, as expected on Thursday, Trump's Republican-led Federal Communications Commission (FCC), voted 3 to 2 along party lines to kill "Net Neutrality" rules for Internet Service Providers like AT&T, Verizon, Charter and Comcast. That, despite a letter from 18 state Attorneys General who asked the Commission to delay the vote until after a legitimate public comment period. The previous one, they charge, was manipulated by as many as 2,000,000 comments that New York's Attorney General Eric Schneiderman has found found to have been faked.

Nonetheless, right-wing FCC Commissioner and former Verizon attorney Ajit Pai did not delay the vote, and the Commission voted to kill the rules that had long prevented ISP's from blocking or slowing down certain websites or apps, or charging more for access to them. Longtime media reform activist SUE WILSON joins us today and describes the latest actions by the FCC as little more than a move toward the end of free speech on the Internet.

She argues that the move to kill Net Neutrality echoes the efforts to pass the Telecommunications Act of 1996, which was also sold by proponents at the time as a boon for competition and innovation that would result in more free speech over our public airwaves. Instead, the public radio waves have become the nearly exclusive domain of corporate right-wing political speech and propaganda in the 20 years since the measure was signed by President Bill Clinton.

"They made a lot of promises, when they consolidated radio, that we would end up with a much more diverse speech for everybody," Wilson explains. "Anybody who listens to radio knows that it's almost impossible to find a show like The BradCast on the air because it is now dominated by pro-Republican, conservative --- no, 'alt-right' --- speech, to the exclusion of all others. They flat-out lied to us, and guess what? That's what they're doing today."

A similar future may soon be in store for the Internet, unless promised lawsuits or Congressional legislation is able to block or reverse today's shamefully under-reported and disturbing turn of events.

"The claim that the Federal Communications Commission Republicans are making is that we need to give more money to broadband services so that they can invest in rural areas," says Wilson. "However, if you look at the Securities and Exchange [Commission] documents, which these corporations have to fill out --- under penalty of prosecution if they lie --- the six CEOs of publicly-traded broadband companies are telling their investors that the FCC's current Net Neutrality rules have not in any way impacted their investment strategies. Again, we're looking at the Federal Communications Commission, as headed by Ajit Pai, just making things up out of whole cloth."
