Look at the faces in that photo. Those are the faces of people grappling to understand a profound truth that they simply had no idea about prior to Tuesday night. Those faces should serve as inspiration for every Democrat and/or progressive on the ballot in every race in all 50 states between today and November 8. And as a warning for every Republican.

On today's BradCast, selective, noteworthy, curated results --- or what is known about them, unofficial, incomplete or otherwise --- from Tuesday's primary elections in six states, Arizona, Kansas, Michigan, Missouri, Washington and Ohio. (And several problems for voters in Pinal County, AZ.) [Audio link to full show is posted below this summary.]

Of course, the biggest news from Tuesday, hands down, was the stunning landslide rejection of a state constitutional amendment in Kansas that would have allowed the state's Republicans to restrict and/or ban abortion rights. (That's what the folks in that photo were just learning about.) It was the first statewide vote on the matter anywhere in the nation since the newly extremist, far-right, radical, activist, corrupt, Republican U.S. Supreme Court majority overturned 50-years of Constitutionally protected rights and freedoms by striking down 1973's Roe v. Wade decision.

Even in the theoretically "conservative" state of KS, voters soundly rejected that proposed Amendment with their "NO" votes by a stunning 18 points over "YES" as of airtime. The "NO" vote did well in large and small, rural and urban, Democratic and Republican counties alike. Turnout, thanks to this measure --- in a midterm primary where Republicans assumed few would notice --- was enormous and at levels normally seen in Presidential primaries or even mid-term general elections in the recent past.

The question now is whether Democrats will finally have the confidence and courage to run on this issue, following the overturning of Roe in June, in every state in the country and for virtually every office on the ballot from Governor to Attorney General to District Attorney to County Sheriff to state Judge to state Supreme Court Justice. And, whether Democrats will be able to capitalize on Josh Marshall's "Roe and Reform" campaign that he's been pushing hard at Talking Points Memo, calling for a very specific promise to voters from Democrats on the federal level: Let us hold our House majority and give us two more seats in the Senate and we vow, come January 2023, to reform the Senate filibuster to codify the protections of Roe into federal law, guaranteeing privacy rights and reproductive freedom in all 50 states.

Nothing short of that very specific "You give us that, we'll give you this" promise will do, as Josh has smartly been explaining for weeks now. We have long argued ourselves that candidates must give voters something very clear and specific to vote for. When they do, as proven on Tuesday in Kansas --- where the stakes were crystal clear, and voters knew exactly what they would get from their one single vote --- they will respond in large numbers.

Of course, all of this also further underscores the argument I've been making for months that Democrats and progressives must ignore the "conventional wisdom" from so-called political professionals about the historical odds of impending doom this November. These are decidedly UNconventional times, proven once again in KS yesterday.

Beyond that very encouraging news on Tuesday, there was still more good news in both the Secretary of State and Attorney General races in KS; Somewhat disappointing news in the MO race to fill the U.S. Senate seat being vacated by retiring Republican Sen. Roy Blunt; Potentially concerning news out of MI's Republican gubernatorial contest, where a well funded, Trump-backed loon will run against the state's popular Democratic Governor; And wildly troubling news out of AZ on the Republican side in the contests for the Gubernatorial and Sec. of State nominations, in what could turn out to be two of the most critical races in the nation this November.

All of that and many other races covered and explained, with context, on today's busy show.

Finally, we close with some tragic news on the death this afternoon of Indiana's 58-year old Republican Congresswoman Jackie Walorski and two of her young staffers in an automobile accident. And, some pleasant thoughts following the passing on Tuesday night of Hall of Fame broadcasting legend Vin Scully at age 94. He served as the inimitable and nationally recognized voice of Dodger baseball --- in both Brooklyn and Los Angeles --- for 67 incomparable years...

Today on The BradCast we try to reach out to so many of those Republicans and Trump dead-enders that we hear from usually only after the show. That, before Tuesday primaries and runoffs in in Virginia, Arkansas, Alabama, Georgia and Washington D.C., and amid the short pause before hearings in the House J6 Committee return (tomorrow), and as the number of those who believe Trump should be charged with a crime for his attempt to steal the 2020 election continues to grow.

If we are going to save American democracy from the minority autocratic rule now sought by the bulk of the Republican Party, we need to try, at least, to speak to each other again. Even to those who have been so thoroughly groomed, for so many years --- by Fox "News", by rightwing talk radio, by elected Republican officials --- to actually believe the GOP lies that have convinced those Americans to vote against their own best interests in election after election. We must reach out, somehow, to those that still buy into Donald Trump's evidence-free claims that the 2020 election was stolen from him (as he, himself, had tried to steal it) or who were duped into sending part of the quarter of a billion bucks to his "Official Election Defense Fund" even though, as we recently learned thanks to the bipartisan J6 Committee, doesn't even exist.

So, today, in hopes of at least trying to reach some of those voters, we thought we'd share the thoughts of some longtime conservative Republican voices. Among them, the very conservative former federal appeals court judge, J. Michael Luttig who, for years, had been compared to Justices Scalia and Thomas, who 33 of Luttig's former clerks would eventually clerk for. Last week, Luttig testified to the House Select Committee, warning that Donald Trump and the Republican party remain a "clear and present danger" to American democracy, not only because of the January 6th insurrection or due to Trump's attempt to, as Luttig wrote [PDF], "steal the 2020 presidential election from the American people," but because "the former President, his allies and supporters pledged that they would attempt to overthrow that 2024 election, but succeed in 2024 where they failed in 2020." He is now calling on Republican leaders to step up to end their "war on democracy."

Also, we share a critical, must-listen commentary from former young Republican James Killen (pictured above) hoping to reach current young Republicans to keep them from making the same mistakes he did by letting them know how they've been lied to by the GOP about...well, pretty much everything, from top to bottom over the past 40 years.

Then, after an invitation to the many rightwingers who do listen to The BradCast --- which we know, because they so frequently contact me right after the show via Email or Twitter --- we open the phone lines to at least one long time Republican who is still buying in to the lies....apparently all of them, as we discuss. If we don't at least try to have these conversations, we will never end this new American uncivil war.

And where will it go from here if we don't? Well, a new campaign ad from the disgraced former Missouri Governor turned GOP primary candidate for U.S. Senate, Eric Greitens --- in which he wields a firearm and calls on fellow Republicans to go "RINO (Republican in Name Only) hunting" --- should give you a pretty good, and chilling, idea...

What's the difference between a white supremacist mass murderer in Buffalo, NY and a GOP candidate for the U.S. Senate? Well, in terms of their racist rhetoric not a heck of a lot, it seems. That and many more reasons to both pay close attention and be skeptical of "conventional wisdom" regarding this November's critical midterm elections on today's BradCast, as American Democracy v. Violent Strongman Authoritarianism is most definitely on the ballot in every state this year. [Audio link to full show follows this summary.]

Among the stories underscoring all of that on today's program...

• A number of the attorneys who helped Donald Trump try to steal the 2020 election have had their law licenses suspended or are facing permanent disbarment. One attorney who has yet to be held accountable in any way, however, is Sen. Ted Cruz, who volunteered to represent Trump in two different bogus election challenges before the U.S. Supreme Court; knowingly spread false claims of fraud; and then voted against certification of Joe Biden's Electoral College victory even after Trump's deadly insurrection at the U.S. Capitol. A bipartisan group is now hoping to change that. This week, they filed a complaint with the State Bar of Texas, seeking an investigation into possible disbarment for the sleazy Texas Senator/still-licensed attorney.

• Speaking of sleazy still-licensed Texas attorneys, the state's chief law enforcement officer, Attorney General Ken Paxton now says he has been sued by the Texas State Bar for misconduct. Paxton has already been charged with several securities fraud felonies; is being investigated by the FBI for abuse of power and bribery after a federal criminal complaint by eight of his top former deputies; and brought a laughable case to the U.S. Supreme Court seeking to toss the 2020 election results in four states that were not Texas. It is for his help in trying to steal the election for Trump at SCOTUS that has resulted in the state Bar's lawsuit against him. Paxton is running for re-election anyway. On Tuesday he's in a runoff election with the state's Land Commissioner George P. Bush (the very Trumpy son of Jeb and nephew of the guy who made "one of the biggest Freudian slips of all time" at Southern Methodist University yesterday.) No sooner did Paxton get sued by the state bar then he turned around and opened an investigation into the Texas Bar Foundation for "facilitating mass influx of illegal aliens" --- ya know, the stuff that racist "great replacement" conspiracy theories are made of.

• And speaking of the racist "great replacement" conspiracy theory, as repeatedly cited by the white supremacist domestic terrorist who murdered 10 and wounded 3 others in a Buffalo supermarket in a predominantly black neighborhood last weekend, a whole bunch of Republicans running for the U.S. Senate this year have been using nearly identical rhetoric to that racist murderer for a very long time. The once-fringe, now mainstream rightwing theory claims that Democrats are hoping to replace white American voters with immigrants, Jews and people of color to control the electorate with one-party rule. Or something. And, in the wake of Trump's embrace of white nationalism as President, AP highlighted a bevvy of mainstream GOP Senate candidates this year --- either running for reelection or for the party's nomination --- whose rhetoric on immigration directly echoes the same baseless, racist fear-mongering. Their list includes Blake Masters in Arizona; A.G. Eric Schmitt and disgraced former Gov. Eric Greitens in Missouri; GOP Senate nominee J.D. Vance in Ohio; and two-term U.S. Senator Ron Johnson of Wisconsin. The full list of elected and hopeful GOP officials who also espouse rhetoric shared by rightwing domestic terrorists is obviously much, much longer.

• And speaking of domestic terrorists, the U.S. House passed the Domestic Terrorism Prevention Act (again) on Wednesday. All Democrats voted for it. Every Republican, except for retiring Illinois Rep. Adam Kinzinger, voted against it. Democrats vow to bring it up in the Senate next week. It may be a heavy lift over the undemocratic 60-vote filibuster threshold in the upper chamber. Too bad it wasn't called the Domestic Terrorism by Non-White People Prevention Act. It might have easily passed in both chambers, as most legislation related to terrorism that doesn't target white supremacists tends to.

• And, speaking of extremism, on Thursday, the Oklahoma legislature passed a new law that, if signed by the Governor, would ban nearly all abortions starting at fertilization, which would make it the nation's strictest abortion law. It would also, in turn, make certain forms of birth control --- like IUDs, The Bill, Plan B, which don't necessarily prevent fertilization, but prevent implantation of a fertilized egg --- a form of "abortion" or, in Oklahoma, a homicide. More Republican-controlled states are likely to follow suit, despite the vast majority of Americans who support abortion rights. Please keep all of this in mind in November.

• And, speaking of this November, polling last month from the Harvard Youth Poll suggests --- contrary to "conventional wisdom" --- that young voters are very eager to vote this year. The number who say they are "definitely" voting in the 2022 election is almost identical to the number who said same before the 2018 "blue wave" election. That could be good news for Democrats. Again, please ignore "conventional wisdom" in these decidedly unconventional times.

• And, speaking of young people, even in deep "red" Wyoming, they don't dig attacks on LGBTQ+ people --- yes, even trans people --- as the state's U.S. Senator Cynthia Lummis found out the embarrassing way during a commencement address she gave over the weekend at the University of Wyoming. It took a while, but now she "apologizes" if she offended anyone with her remarks that were broadly booed during the speech at the school once attended by Matthew Shepard, the young gay man who was brutally beaten and left to die on a fence nearly 25 years ago. He became one of the namesakes of the landmark Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act.

• And, speaking of civil rights for all --- and of keeping Big Government and the GOP's stolen and packed Supreme Court out of our bedrooms and doctor's offices --- support for abortion rights has reached a record high in a new NBC News poll following the leak of SCOTUS' draft opinion overturning Roe v. Wade and its 50 years of protection for reproductive rights. The poll also finds support for same-sex marriage (perhaps next on the chopping block after Roe's Constitutionally established right to privacy is killed) at an all time high, while approval for the High Court is at an all time, 30-year low in this particular poll.

On today's BradCast: Five arrests and a massive, $61 million criminal bribery scheme allegedly headed up by Ohio's Republican House Speaker in cahoots with GOP lobbyists and dirty energy company payouts help explain, yet again, why we can't have nice things. That's especially true for residents of the Buckeye State who keep electing Republican officials who play them for chumps, take all their money, and make them sick in the bargain. It's also true for Floridians, Georgians, Texans and now Missourians, but we'll get there as well today. [Audio link to show follows below.]

"We're here today to announce the arrest of Larry Householder, the speaker of the House of the state of Ohio and four other defendants for racketeering in relation to what is likely the largest bribery, money laundering scheme every perpetrated against the people of the state of Ohio," announced U.S. Attorney David DeVillers during a news conference in Columbus on Tuesday afternoon. "The conspiracy was to pass and maintain a $1.5 billion bailout in return for $61 million in dark money that was used for various things. One: to line the pockets of defendants. Two: to build a power base for Larry Householder. And three: to further the conspiracy. That is to further the affairs of this Enterprise."

The explosive story is rocking Ohio today, though many should have seen it coming. A year ago, in July of 2019, Vox's longtime energy and climate reporter David Roberts wrote a must-read deep-dive article on the passage of House Bill 6 (HB 6) --- the legislation at the center of this massive con --- describing it at the time as "the most counterproductive and corrupt piece of state energy legislation I can recall in all my time covering this stuff."

The measure forced Ohio's ratepayers to subsidize bailouts of two supposedly failing nuclear plants (the Davis-Besse plant near Oak Harbor and the Perry plant east of Cleveland) owned by FirstEnergy and two failing coal plants owned by the Ohio Valley Electric Corporation (a collective owned by several large utilities), while wiping out previously successful state incentives for renewable energy and efficiency projects that saved the state's ratepayers both money and lives.

"Despite a tsunami of dark money supporting the bill," Roberts reported last year, "HB 6 was overwhelmingly opposed by ratepayer groups, business groups, free market conservative groups, environmental groups, and Ohioans generally. Its only support came from its only beneficiaries: the utilities that own the bailed-out plants, the employees of the bailed-out plants, the communities where the bailed-out plants are located, and possibly President Trump, who doesn't want to see coal plants closing during his reelection campaign."

Well, apparently there were a few more "beneficiaries": Ohio's House Speaker Householder and his political allies inside and out of the state legislature. That "tsunami of dark money", as it turns out, was used to blanket the airwaves with propaganda in support of HB 6 --- describing it misleadingly as a fight for jobs and "clean energy" in a battle between "Big Oil and Ohio" --- by a group calling itself Generation Now. That dark money group, as it turns out, was run by Householder himself with "bags of cash" from the nuke plants' supposedly bankrupt owners, FirstEnergy of Ohio. According to today's criminal complaint [PDF], his "Enterprise" used a series of unregulated passthroughs to move millions and "freely spent the bribe payments to further the Enterprise's political interests and to enrich themselves" with "unlimited" funds that came in to Generation Now from FirstEnergy in payments described by one of the defendants as "Monopoly money."

Despite the wildly unpopular HB 6's narrow passage in the state legislature, Republican Gov. Mike DeWine signed it quickly after passage. He was not indicted today, though he did cancel a scheduled COVID-19 press conference after the announcement, before calling for Householder's resignation.

It's an incredibly sordid story which we report in detail today. It's also one that should remind everyone exactly what they can expect when they put corrupt politicians like this in power who did the bidding of major corporate interests, rather than the public's.

In not entirely unrelated news today, Couy Griffin, the idiot who heads up a group called "Cowboys for Trump", is calling for Americans to take their masks off because they --- as opposed to the coronavirus --- are making everybody sick. And while we'd love to ignore Griffin and the "Cowboys," it turns out he's also an elected Republican official in New Mexico and the same jerk who posted a video back in May which began by announcing that "the only good Democrat is a dead Democrat." And while we'd love to ignore that as well, that video was then retweeted by the President of the United States that month, along with the message "Thank you Cowboys. See you in New Mexico!"

Idiot elected "cowboys" and Presidents of the United States may be one thing we've come to expect by now. But with the coronavirus smashing records in at least 31 states, we'd hoped we'd get better from the Governors who have been left to handle the pandemic after Trump decided he had better things to do, despite some 4 million infected Americans and 144,000 U.S. deaths now from COVID-19 over the past six months.

But our hopes have been dashed. By Florida's very Trumpy Governor Ron DeSantis who's made a jackass of himself over the past month as cases, hospitalizations and deaths skyrocket in his state --- now overwhelming hospitals with at least 50 having run out of ICU beds --- while ordering kids back to in-person classes next month; By Georgia's Trumpy Governor Brian Kemp, who is suing cities in the state for instituting mask mandates as the Peach State also breaks single-day case records and death records; By Texas' Trump-loving Governor Greg Abbot, who wonders where he went wrong in reopening up the state so early, now that hospitals in Houston, Dallas, San Antonio and elsewhere are overwhelmed and calling in refrigrator trucks to serve as overflow morgues to hold all of the extra dead bodies.

But now we now have Missouri's woeful Governor Mike Parson declaring he's just fine with kids in his state becoming infected in the classroom. "These kids have got to get back to school," Parson told a local radio station recently. "They're at the lowest risk possible. And if they do get COVID-19, which they will --- and they will when they go to school --- they're not going to the hospitals. They're not going to have to sit in doctor's offices. They're going to go home and they're going to get over it."

Whether Parson, who replaced the state's previous Republican Governor after he resigned in a sexual coercion, abuse and blackmail scandal, realizes that those kids go home to parents and grandparents who they will infect in turn (not to mention all of the teachers and staff at those schools) is unclear. Hopefully Missourians, however, understand it by now, and will consider replacing Parson this November with state Auditor Nicole Galloway, the Democratic candidate for Governor. Maybe then the good folks of Missouri can begin to have nice things again.

Among the stories covered on today's post-Memorial Day weekend BradCast. [Audio link to show is posted below]...

First up, some accountability news. Missouri Governor Eric Greitens (R) finally announces his resignation, after two separate indictments (one related to allegedly blackmailing a woman he has admitted to having had an affair with, and the other for unlawfully using a veterans charity contact list during his 2016 run for Governor) and after the GOP-majority legislature convened an historic special session to consider his impeachment.

Also, hit ABC sitcom reboot Roseanne is cancelled just hours after its titular star tweeted a racist comment about a longtime friend and adviser to former President Obama.

Then, why at least some of Trump's obnoxious, inaccurate, and sometimes dangerous tweets actually matter (as much as we try to avoid them). A new poll finds alarming numbers of Republicans (and, yes, Democrats!) actually buy the President's evidence-free claims that as many as 5 million fraudulent votes were cast in the 2016 Presidential election, as his new --- and similarly evidence-free --- tweets targeting Special Counsel Robert Mueller's probe now claim the investigation is "rigged" and is meant for "MEDDLING with the mid-term elections now that Republicans...are taking the lead in Polls".

In fact, while there is no evidence that Mueller's probe is "rigged" or that he is "meddling" in the mid-terms, Republicans are now said to be nearly tied or even taking the lead in some generic U.S. House polling on the heels of Trump's increasingly strident and inaccurate Twitter torrent. (Here, however, is a more skeptical look at those numbers.)

Nonetheless, many Democrats still seem very confident that a "blue wave" is in the making to flip one or both chambers of Congress from GOP control this November in response to Trump, as suggested by a surge in Democratic turnout during the 2018 primaries. It should be noted, however, that there are also signs that GOP turnout is increasing as well.

All of that is before the usual GOP voter suppression kicks into high gear. To that end today, the lawsuits have begun already. Last week, a suit was filed by the League of Women Voters and others against Florida's Republican Gov. Rick Scott and his hand-picked Sec. of State Ken Detzner's refusal to allow early voting centers at public universities.

And, in Ohio, the ACLU has now filed suit against the state's Republican drawn U.S. House districts, charging that the maps, drawn up in secret by the national GOP after the 2010 Census, violate the U.S. Constitution as an extreme partisan gerrymander.

We're joined by ACLU Ohio's Legal Director FREDA LEVENSON, who explains the case, why it's taken so long to be filed after resulting in 12 GOP U.S. House members to the Democrats' 4 over each of the last three elections in the swing-state, and how related cases from other states, now pending decisions at the U.S. Supreme Court, may effect this one.

Levenson also updates us on another case awaiting a decision any day from SCOTUS, regarding Ohio Sec. of State Jon Husted (R)'s attempt to purge voters from the roles after failing to vote in two consecutive federal elections. She explains why the ACLU sees that as a violation of the National Voter Registration Act (NRVA) and how SCOTUS' ultimate decision in this case could result in similar mass voter purges being carried out in states across the country.

Finally today, a new scientific study finds that some 5,000 Puerto Ricans may have been killed by Hurricane Maria, rather than the 64 officially attributed to it, and Desi Doyen joins us with troubling details on deadly storms and flooding in Maryland and North Carolina over the holiday weekend, as subtropical storm Alberto, the first named storm of the new Atlantic hurricane season, rolls ashore days before the new season even officially begins...

On today's BradCast: Another reminder that the nation's elections officials remain woefully unprepared for and under-informed about threats to this year's crucial mid-term elections, and clear examples of where our governmental institutions currently work to combat blatant corruption by top officials (Missouri) and where they don't (D.C.).

First up, an election night cyberattack in Knox County, Tennessee's local primaries on Tuesday should have officials there (and elsewhere) far more concerned than they appear to be. We discuss why this latest attack echoes similar incidents we've seen previously (including at the end of election night during the 2004 Presidential election in Ohio), why such attacks are likely to become more frequent, and how election and cyber-security officials continue to woefully underestimate and misunderstand the very real dangers to our elections when they (falsely) tell the public, as they are doing in Knox County this week, that their computerized voting, registration and tabulation systems are "never connected to the Internet, so can't be hacked." They are wrong.

Next, Missouri's Republican governor Eric Greitens is now facing three different felony charges, two separate court trials, and the GOP-majority state legislature has now overwhelmingly decided to call a special session to consider impeachment. Greitens maintains his innocence in both a sexual blackmail scandal and campaign finance scandal. We explain why the extraordinary historical moment --- despite the Show-Me State's Governor refusal to resign, echoing Donald Trump in calling the well-documented evidence against him the result of a "witch hunt" by prosecutors (and his own party?) --- is actually, at least so far, an example of how the system is supposed to work.

Contrast that to the quickly devolving mess in D.C. today, where Republicans in the House and Senate who ought to be demanding accountability from a corrupt President, are looking the other way and/or undermining prosecutors, and where prosecutors seem to (falsely) suggest they cannot indict a sitting President, no matter the evidence of serious crimes. That, even as whatever credibility this Administration may have once had, has now disintegrated so much amidst Trump's latest flip-flops on a number of scandals, that even one top Fox "News" anchor unloaded on the President on Thursday, with an astonishing smack down of Trump lies, which ends: "I guess you’re too busy draining the swamp to ever stop and smell the stink you’re creating. That’s your stink. Mr. President, that’s your swamp." When you've lost Neil Cavuto...

We've got a lot of news to cover from over the weekend, and breaking today on today's BradCast, even as we try to focus on the continued undermining of our electoral system, and the lack of accountability for certain lawbreakers versus others. [Audio link to full show is posted below.]

Among the stories we cover today, along with some great calls from listeners...

• As we predicted last week, Republican Senator Rand Paul (KY), who had been pretending to oppose the nomination of CIA Director Mike Pompeo as the next Secretary of State, has flipped his position (as usual), and is now voting in favor of Pompeo, virtually guaranteeing the pro-war, anti-gay, climate science denier as the nation's next top diplomat.

• The alleged shooter who killed 4 and injured several others at a Waffle House in Nashville on Sunday morning is finally apprehended and taken in peacefully by local officials. But why was the suspect, a 29-year old white guy with a long record of mental issues and run-ins with police, even in possession of four semi-automatic weapons that were taken from him, for a short time, following his arrest by Secret Service outside the White House, where he is said to have identified himself as a "sovereign citizen" (a rightwing domestic extremist movement, according to the Southern Poverty Law Center and law enforcement officials.) The mass shooting was ended on Sunday morning, not by "a good guy with a gun" but, in fact, by a potential African-American victim without a gun. James Shaw Jr. burned his hand as he grabbed the muzzle of the shooters AR-15 and wrestled it away from him.

• Despite going to court to successfully stop Green Party Presidential candidate Jill Stein's attempted post-election "recount" in the state of Michigan after the 2016 election, state Republicans have now passed a number of bills in the state legislature to make it even more difficult for candidates and the public to oversee their own elections to ensure that computer-tallied results have been accurately reported. The measures heading to Republican Gov. Rick Snyder's desk follow Stein's attempted 2016 count, in a state which hadn't gone to a Republican Presidential candidate in nearly 30 years, where Trump is said to have won by just over 10,000 votes (out of more than 5,000,000 cast), and where terrible state "recount" laws prevented some 60,000 hand-marked paper ballots from even being considered for "recounting" in Detroit alone.

• Meanwhile, down in Fort Worth, Texas, a Tarrant County Justice of the Peace, after submitting fraudulent signatures to appear on the Republican primary ballot last March, resigned from office after pleading guilty and receiving, essentially, five years probation. It appears disgraced Judge Russ Casey won't won't spend a day in a jail, despite his guilty plea and a previous record of an "improper sexual relationship" with a former clerk. We also contrast the gentle treatment of Casey, a white elected Republican judge, with that of Crystal Mason and Rosa Maria Ortega, both of them in Tarrant County. Mason is a 43-year old African-American mother sentenced to five years in prison just last month for voting in 2016 while on supervised release from her three-year sentence on a 2011 fraud conviction for helping tax clients receive larger refunds than they deserved. She was not told by her probation officer, or anyone else, that she was not allowed to vote while on probation in Texas. Ortega, a mother of four, voted unlawfully in both 2012 and 2014, thinking she was allowed to do so as a Green Card holder from Mexico. She received an eight-year prison sentence for her crime (and likely deportation after it), despite testifying that she believed she was allowed to vote as a permanent U.S. resident. Too bad for the black woman and the immigrant. But fantastic news for the white elected Republican Judge, who had received a $125,000/year salary since his initial election in 2007, before he knowingly committed his election fraud crimes!

• Also today, speaking of accountability --- or, perhaps, lack thereof --- for powerful white Republicans, Missouri's embattled GOP Governor Eric Greitens was charged with a second felony late Friday, though he refuses to step down, despite the two charges. One is related to tying up a woman with whom he was having an affair, photographing her naked, and threatening to blackmail her, and the second for unlawfully using a veterans charity mailing list during his 2016 run for Governor. Top GOP lawmakers and the state's Attorney General have called for Greitens' resignation. But he, just like President Donald Trump, describes the investigation of his alleged felony crimes as nothing more than a "witch hunt...by the liberal media and their allies".

On today's BradCast: Yes, the kids are alright. And, if this past week has been any indication --- along with the results of a fascinating social experiment by my guest today --- they may well save us all. I hope they hurry. [Audio link to today's show follows below.]

First up, however, a boatload of news broke shortly before air today, and we scramble to cover as much of it as we can. Among those stories...

• New indictments are filed by Robert Mueller's Special Counsel probe against two former Donald Trump campaign officials. His former campaign chair Paul Manafort and his business partner Rick Gates, who also served on the Trump transition team saw 32 counts added to the 17 felony counts leveled against them in October. The new charges relate to some $30 million in money laundering and tax fraud, based on funds said to have been received while Manafort worked for a Russian-backed Ukrainian President prior to joining the Trump campaign;
• U.S. House Speaker Paul Ryan and the White House have reportedly pushed out, Matthew Masterson, the Republican Chair of the U.S. Election Assistance Commission (EAC) for reasons that remain unknown The EAC, formed by Congress after the 2000 election debacle to help state election officials with e-voting system standards, has failed in many ways over the years, as we discuss (and as we've reported at The BRAD BLOG for many years.) Still, they remain the only federal agency tasked with that role, even while Republicans have been attempting, for years, to shutter the Commission entirely. Masterson, said to be highly regarded by state election officials, was overseeing cyber-security standards for new voting systems before the 2018 mid-terms, in light of concerns of foreign manipulation of U.S. voting, registration and tabulation systems;
• And, also breaking just before air, Missouri's new "family values" Republican Governor Eric Greitens was indicted late Thursday on a felony charge related to allegations that threatened to blackmail a woman he had tied up and photographed nude in his basement during an affair in 2015, prior to his 2016 election.

Then, with the incredibly impressive students of Marjory Stoneman Douglas High School in Parkland, Florida speaking up, marching, organizing and protesting unapologetically to demand new legislation on guns after a former student killed 17 at their school last week with a legally-purchased semi-automatic AR-15 rifle, President Trump unleashed a Twitter rant on Thursday morning calling for teachers across the country to be armed in response. That call has not gone over well with the Stoneman Douglas students, though many Republican officials and their paymasters at the National Rifle Association (NRA) support the measure to place even more guns into our nations schools.

But, as my guest today, Philadelphia area high school teacher and writer DINA LEYGERMAN argues, the current generation of high schoolers across the country are fierce, a force to be reckoned with and not to be underestimated.

In her recent article headlined "The Teens Will Save Us", Leygerman documents a fascinating social experiment that she has run for a number of years while teaching George Orwell's 1984 to her English class. After similar results of the experiment year after year --- in which, without informing the students, she basically turns her classroom into an Orwellian totalitarian regime over a matter of days, with her as the dictator turning students against each other --- she says that this year, for reasons she discusses, the response by the students was completely different from previous years. The students, she explains, were having none of it, and actually stood up, organized with their classmates and other students in rebellion against her. As she wrote, "For the first time since I've done this experiment, the students 'won.'"

Leygerman joins us for what turns out to be a very hopeful segment, as she explains what happened, why, and how this generation may be very different from the slacker image many have painted them with. "They are participating in marches. They are participating in their student government. They are listening to the news. They're reading the news more, everyday. They are involved. And I think in our current political climate, where everything is so hostile and divisive, they are learning. I walk around and, even in the cafeteria, I'll listen to them talk about DACA, they'll talk about issues that I don't ever remember discussing when I was a kid," she tells me.

It's a fascinating conversation that I hope you'll tune in for. I also get her thoughts on Trump and the NRA's proposal for arming teachers, which she describes as "insane and dangerous" and a "diversion and deflection" from the actual conversation of what should be done about our nation's gun epidemic. Leygerman, who also writes for parenting website Romper, wonders: "Where's the funding coming from? And if it's coming from the government or from the state, why can't we have basic supplies instead?"

Finally, Desi Doyen joins us for the latest Green News Report, as a chemical giant settles a decades-long water contamination lawsuit, global temperatures continue to sky-rocket, sea levels rise at an ever-quickening pace, and another western state becomes the latest to block Donald Trump's scheme to expand off-shore oil drilling...

Did Donald Trump or the Trump Campaign or the Trump Organization violate federal law in a hush money payoff to a porn star? On today's BradCast, we speak with the lawyer from a good-government group that has now filed complaints with the Federal Elections Commission and Dept. of Justice to that end, which he describes as "a very obvious and very clear violation of federal campaign finance law." [Audio link to full show is posted below.]

But first up today, the latest news on the latest school shooting, this time in rural Kentucky, where 12 students were shot, two of them killed, after a 15-year old student unleashed a barrage of gunfire at Marshall County High School just before classes were set to begin on Tuesday morning. It was the first fatal school shooting of 2018, though reportedly the 9th since the first of the year, and 283rd since 2013. In related news, a 19-year old apparent Trump supporter was arrested after repeatedly threatening CNN's Atlanta headquarters earlier this month on the heels of the President's continued targeting of the news network as "fake news".

Then, we discuss some of the newly reported details outlining how it is that Senate Democrats caved on Monday in their government shutdown standoff with Trump and Republicans in regard to protecting some 800,000 "Dreamers" from deportation, including evidence to strongly suggest we are quickly heading towards another shutdown and/or cave in just over two weeks time when the stop-gap spending measure passed on Monday night runs out.

Next, we're joined by PAUL S. RYAN, Vice President of Policy & Litigation at Common Cause, to discuss the two complaints filed on Monday with the FEC [PDF] and with the DoJ [PDF] regarding the payoff made via a shell company set up by Trump's attorney Michael Cohen, allegedly to buy the silence of adult film actress Stephanie Clifford (aka Stormy Daniels) just before the 2016 Presidential election. Trump is alleged to have had an affair, according to the Wall Street Journal, with Clifford/Daniels in 2006, shortly after his wife Melania had given birth to their son.

Ryan and Common Causes' complaints contend that the $130,000 payout appears to have been an unlawful, unreported in-kind donation to the Trump campaign, funded either by the Trump Organization, another person or corporation or Trump himself which, in any of those cases, would be a violation of the Federal Elections Campaign Act (FECA). The longtime campaign finance attorney explains the law in question and handicaps the odds of whether the FEC or DoJ will take action in response.

"At a minimum here," Ryan tells me, detailing who may be culpable, "we seem to be looking at a campaign finance disclosure violation --- because the Trump Campaign Committee didn't report any of this --- and, unless the money came from Trump's own pocket, then we're also talking about a contribution violation, as well."

While the question of who put up the $130k is still unknown, he argues that there is no legitimate way to argue that the payout --- given its timing, shortly after the Access Hollywood "grab 'em by the pussy" tape came out, and the multiple allegations of sexual misconduct from nearly 20 women --- was not meant to influence the election by keeping Daniels from talking to the press. "The timing, with the imminent threat by Stormy Daniels that she was going public with her story, to me, makes this clearly stand as a payment that was all about the election and keeping her quiet up to and until the election."

In related matters, Ryan also offers a few quick takes in response to some questions I had on several other recent news events from the past 24 hours or so, including whether the Trump Administration violated the law with their partisan outgoing voice message on the White House comment line during the shutdown over the weekend; whether any laws were violated by a Monday night dinner meeting on what are said to have been "important issues facing our country", between several Republican Senators, members of Trump's cabinet and U.S. Supreme Court Justice Neil Gorsuch; and whether Republicans in Pennsylvania have a leg to stand on in their promise to make a federal case out of a Monday ruling by the state Supreme Court ordering the GOP-controlled state legislature to immediately redraw the state's U.S. House district maps, in time for the 2018 primaries, after the maps were found to have been illegally gerrymandered under Pennsylvania's Constitution to discriminate against non-Republican voters.

On today's BradCast: Donald Trump and his Great American Shitshow continues today, though he has now received a very helpful hand from Congressional Democrats, for reasons that may beggar the imagination. [Audio link to show is posted below.]

First up today, a quick word on the allegations regarding $130k in hush money said, by the Wall Street Journal, to have been paid by Donald Trump to a porn star just before the 2016 election, reportedly to hide a sexual liaison during his marriage with the now-First Lady, and on the sordid sex and blackmail scandal now roiling Missouri's new "family values" Republican governor, Eric Greitens. In normal times, of course, both stories would be huge news everywhere and we'd be discussing impeachment and/or resignation of both men. These days, however, each scandal is barely breaking the national news radar.

Then, more encouraging election news for Democrats this week in Tuesday's special elections around the country, with Dems flipping another long-held Republican seat in a deeply "red' area, this time in the Wisconsin State Senate. The results seem to be freaking out the state's controversial GOP Governor Scott Walker in advance of his own re-election contest later this year and signals a possible Dem takeover of the state Senate in advance of 2020 redistricting!

Next, Congress is on the verge of reauthorizing a warrantless mass surveillance program that civil libertarians on the right and left have long opposed and characterize as a blatant violation of the U.S. Constitution's 4th Amendment privacy protections against unwarranted search and seizure. Last week, after Trump made it clear he had no idea what Section 702 of the FISA Amendments Act actually was --- despite his administrations' long time lobbying of Congress to reauthorize and, indeed, expand it, it for another 6 years --- Republicans in the U.S. House passed it with the help of several Democrats (including House Minority Leader Nancy Pelosi).

This week in the U.S. Senate, a bi-partisan group lead by Senators Rand Paul (R-KY) and Ron Wyden (D-OR) fell one vote shy of blocking the measure through a filibuster. So it now appears the legislation will clear both houses and sent to Trump for his signature.

We're joined today by ELIZABETH GOITEIN, former Dept. of Justice attorney, now co-director of the Liberty and National Security Program at NYU's Brennan Center for Justice, to explain Section 702, the efforts to lobby against its reauthorization, and why it is that many Congressional Democrats are willing to join Republicans in granting the Trump Administration's NSA, DHS, FBI, DOJ, CIA, etc., extraordinary new powers to secretly spy on every American citizen's phone calls and emails without warrant, due diligence or even probable cause.

While the legislation was "driven primarily by Republican leadership," she says, there were "enough Tea Party style Republicans who have really rallied in support of greater privacy protections" that some marginal reforms were added. Though, she explains, they aren't really reforms at all, and the entire dangerous package could not have moved forward had Dems stuck together in opposition.

"It's a failure of Democratic leadership," Goitein tells me. "At the last minute, [Senate Minority Leader] Chuck Schumer said he would vote no on cloture [to end the filibuster] --- but he hedged that and said, 'Amendments should be in order and we should have the chance to look at amendments, but the bill itself is not that bad, it makes improvements to the law'. Which is not true. It actually takes the law backwards. Minority Leader Pelosi in the House did even more damage...coming out in support of the bill and opposing the amendment that would have made these improvement. And then a whole bunch of Democrats went along with her."

Goitein argues "there was a full court press by intelligence officials" to pass this measure. So, even Trump's cluelessness about it was unable to prevent it from moving forward, even as it allows for the emails of two American citizens speaking to each other --- with no foreign target in the mix --- to be indexed, searched and read by the FBI without an order from any court. She explains the horrible details in depth on today's show, and why it has been so difficult to challenge this provision in a court of law.

Finally, nearly every member of the bipartisan National Park Service Advisory Board has resigned en masse this week, citing the Interior Department and its Secretary Ryan Zinke's failure to hold any meetings with the board, as required by law, during the entire first year of Trump's Presidency. The Administration's response to the mass resignation today is almost as disturbing, if not more so, than the resignation itself.
