National Security Adviser tossed; More big court losses via Republican-appointed judges; Also: 2028 Dems rising?..

On today's BradCast: If the 101st Day is any indication, it doesn't look like the second hundred are gonna go any better for him than the first. [Audio link to full show follows this summary.]

Among our coverage today...

  • On our roundtable program yesterday with Digby and Driftglass, we discussed who was likely the first top Trump Administration official to be tossed under the bus in the wake of Donald Trump's dismal and worsening approval ratings. Today we know: Trump National Security Adviser and Signal group chat enthusiast, Mike Waltz. At least he outlasted Trump's first (of four) NSAs in the first term. The disgraced and loony Lt. Gen. Michael Flynn survived just 24 days before being tossed and eventually pleading guilty to criminal charges of lying to the FBI about his contacts with Russians. At least Waltz gets a consolation prize. Trump tapped him to be U.N. Ambassador.
  • Last week, Senior U.S. District Judge Royce Lamberth --- a Reagan-appointee --- ordered the rehiring of staffers and contractors at the Congressionally-mandated and funded Voice of America and its similarly critical global sister networks Radio Free Asia and Middle East Broadcasting after the Trump-order shutdown in March of its parent agency, the U.S. Agency for Global Media. This week, Judge Lamberth ordered the Administration to restore $12 million in funding to another VOA sister network, Radio Free Europe/Radio Liberty --- broadcasting to dozens of countries in dozens of languages since the Cold War --- while issuing both a history lesson and an important Constitutional lesson for the Trump Administration (and, arguably, for Congress) about the important roles of the three co-equal branches of Government in his order [PDF].
  • In still more Trump-is-a-Loser news today, a Trump-appointed federal judge in South Texas, issued a first-of-its-kind permanent injunction on Trump's "unlawful" use of the wartime Alien Enemies Act of 1798 --- in peacetime --- to deport alleged gang members from Venezuela to a gulag in El Salvador. "The President's invocation of the AEA...exceeds the scope of the statute and is contrary to the plain, ordinary meaning of the statute's terms," U.S. District Judge Fernando Rodriguez Jr. wrote in the order [PDF], concluding that Trump's attempt to falsely proclaim the U.S. was being "invaded" by Tren de Aragua gang members at the direction of the Venezuelan government was patently false, "exceeds the scope of the statute and, as a result, is unlawful."
  • Also of note today, the Board and shareholders of one of the companies most closely associated with America, Coca-Cola, flatly rejected two proposals to abolish the company's anti-discrimination programs, often smeared by Trump and fellow wingnuts as "DEI". Shareholders and the Board of Directors at yet another iconic American company, Levi Strauss, reportedly did the same last week.
  • It's not just courts and a few iconic U.S. companies that are pushing back at Trump's nonsense of late. Even Democrats, if you can believe it --- at least a couple who are clearly eye-balling Presidential runs in 2028 --- are now more aggressively doing the same, especially now that the public has turned so clearly against out tinpot dictator-wannabe. Last night, at an event in San Francisco, former Vice President and Presidential nominee Kamala Harris offered her first substantive public remarks since losing to Trump last year, deriding his "wholesale abandonment" of American values. That came on the heels of a stem-winder by Illinois' Democratic Governor J.B. Pritzker, taking on Trumpers and go-along, get-along, "do nothing" Dems alike, at a fundraiser on Sunday in New Hampshire. We share extended excerpts from both speeches today.
  • And finally, Desi Doyen is here with our latest Green News Report to help us close things out near the end of a week that began with a huge loss for our failing President, as his attempts at hectoring our neighbor to the north and meddling in Canada's elections completely backfired, producing not just another Liberal Party Prime Minister, whose election might have been unthinkable last December, but a climate and energy action champion at that...

I've got no clue why so many in the media decided yesterday (Tuesday) was the 100th Day of Donald Trump's second term in office, when it is actually today (Wednesday). Am I missing something? No matter how many times I checked, counted, re-checked, recounted, asked AI, the 100th day --- not that any of it actually matters, unless you find accuracy from your media to be helpful --- is today. So, today is when we officially "celebrate" it on The BradCast. [Audio link to full, rollicking show follows below this summary.]

As we are wont at landmark moments in the second Trump Presidency, we are joined again today by two of our old school blogger friends who have been right about almost everything over the past 20+ years, whether the rest of the world wanted to notice or not. HEATHER DIGBY PARTON is the award-winning columnist at Salon and proprietor of Digby's Hullabaloo blog, and 'DRIFTGLASS' is the notorious eponymous blogger and co-host of the weekly Professional Left Podcast. They've both got plenty of thoughts to share at this particular "landmark moment".

Trump's approval ratings are plummeting on virtually every single issue via every single legitmate poll released over the past few days. Perhaps most notably, for the moment --- and for his own softening supporters --- his self-induced tanking economy is top of mind today. But, he's a loser on his immigration and mass deportation policies as well. Now, why would that be, given that he was supposedly elected for his great economic prowess ("Tariff is the most beautiful word in the dictionary of words!," he declared repeatedly in last year's campaign and right on up through his fateful "Liberation Day" on-again, off-again worldwide tariff proclamation earlier this month) and to "solve" the immigration issues that he and Republicans and Fox 'News' have been stoking and worsening for political purposes over so many years?

But none of it is working, as it turns out China is refusing to cower in the face of Trump's 145% tariffs because, as their Foreign Minister explained this week, "it will only make the bully want to push his luck more." There are quite a few elite American law firms, universities and media outlets that may wish to take notice of that response from the largest exporter of goods purchased by Americans, as ships will soon no longer be arriving and shelves at stores may be bare by the time we get to Christmas. That, as new economic numbers out today find that American GDP in the first quarter has fallen by 0.3% after increasing by 2.4% in the final quarter of last year under the economic guidance of President Biden, and more than two-thirds of Americans now predict a Trump Recession on the near horizon.

As to the violence, recklessness and fecklessness of his mass deportation policy, both of our guests concur that is backfiring as well. His supporters also seem to have begun to take notice. As Driftglass argues, they are seeing that "if anyone without a visa can be locked up and deported overnight, you can be, because now we have no Due Process." As Digby observes, "this is happening to people just like you who voted for Trump. And it could be you. They are not discriminating."

But there is much more on our plate to discuss today --- from why all of this is happening and whether it meets or exceeds our guests expectations; to what each of them expect to be Trump's response to his plummeting polls; to who they expect to be the first Trump cabinet member to fall; to what sort of Democrat is needed out there to guide the party back to relevance and put Humpty-Dumpty back together again --- if it can be.

Digby says she's "aged 10 years in the last 100 days" --- me too! --- as Driftglass breaks down what he describes as Trump's "fascist death spiral". Let it be true.

So, what's their real purpose? Why wasn't Russia included? How does this idiocy end?; Also: Good news for voters from GOP-appointed federal judges in PA, TX...

Who coulda foreseen it? Oh, yeah. Everybody in the world other than the idiot who did it and his weird cult followers working desperately to justify it today. As you might expect, we've got a lot to try and make sense of on today's BradCast. [Audio link to full show follows this very brief summary.]

So, Donald Trump pulled the trigger during his rambling "Liberation Day" remarks in the White House Rose Garden, just after the close of markets on Wednesday. The trade tariffs would be slapped on virtually every country in the world and would be, as one tech investment manager described it just after the announcement, "worse than the worst case scenario."

Today, Wall Street reacted. Poorly. The Dow fell over a cliff by more than 1,600 points. The S&P 500 plunged nearly five percent. The tech-heavy NASDAQ plummeted almost six percent. That's what happens when 54% tariff on China suggest that your next iPhone may soon cost $2,300. (The price of Apple stock crashed by nearly ten percent). In all, today amounted to the biggest nosedive for the markets since the mishandling of the COVID pandemic in 2020...the last time this idiot was in the White House.

Nobel Prize-winning economist Paul Krugman asserted that Trump's numbers announced on Wednesday included "false claims about our trading partners" and simply make no sense, suggesting he's "gone full-on crazy." Though, no matter how many times reality and facts are likely to be pointed out to him --- that we are not, for example, "subsidizing Canada by $200 billion a year" --- he "will never drop that claim."

Trump's made-man and Senior Trade Advisor Pete Navarro, fresh out of prison, defended the tariffs, claiming they will raise $6 trillion in revenue for the U.S. over the next ten years. They won't. But if they did, that would amount to a new 25% tax on American consumers, the largest tax hike in U.S. history, since U.S. consumers, not foreign governments, will be paying higher prices to cover the huge new import taxes on just about everything.

Trump's new taxes are likely to result, as well, in reciprocal tariffs from virtually every nation in the world against the U.S. Every nation in the world, that is, except Russia, which was curiously left off the list of newly sanctioned nations for some odd reason.

But, as our friend David Dayen, investigative financial journalist, author and Executive Editor of The American Prospect explained on this program last year, these tariffs are better seen as a means by which Trump hopes to bend companies, industries and, yes, entire foreign governments, to his will. "Look at these tariff threats more as like sanctions," Dayen told us in early December. "'If you do things we don't like, you're going to get higher tariffs.' That's not really about trade policy. That's really about doing what the United States says. It's really about policing the world through economic terms."

"Businesses are going to come to this President and say, 'Give me a waiver from your tariff.' The mind boggles at the potential for corruption here," Dayen said at the time. "This is what oligarchies look like. This is what Russia looks like. If you're closer to the king, you're going to do better."

"He wants to use tariffs and, more generally, the role of the United States as an economic hegemony, to bully other countries to do our bidding," Dayen foretold, in what now appears to be exactly what Trump is doing. He reiterated and added to some of those thoughts at TAP today. "Stop trying to place coherence on a policy that’s really just a mob boss breaking legs and asking for protection money."

Sen. Chris Murphy (D-CT) smartly explained it in very similar terms last night in a social media thread. "Those trying to understand the tariffs as economic policy are dangerously naive," Murphy argued, citing how "British kings used taxation to reward loyalty and punish dissent. ... The tariffs are a tool to collapse our democracy. A means to compel loyalty from every business that will need to petition Trump for relief."

But there is a way out. There is a way to end this madness. Trump only enjoys the unilateral power to issue economy-killing, job-crushing, 401k-flattening sanctions because Congress gave him that power. They can also take it away. There was an attempt by every Democrat and a handful of Republicans in the U.S. Senate yesterday to do exactly that, when it came to sanctions against Canada. The measure was successfully adopted by the Senate, but is unlikely to receive a vote in the U.S. House, where it would likely also be adopted if members were allowed to vote on it. So, Speaker Mike Johnson will make sure they can't.

With all of that in mind, "these tariffs won't stand," writes Josh Marshall at TPM today. Anyone running for Congress or thinking of doing so has all they now need to take down any Republican who would support this insanity --- and the harm it is now causing to their own constituents. "It’s malpractice for anyone challenging a Republican member of Congress not to be on this today," he detailed this morning.

So, yeah. Once again, it all comes down to democracy and elections. To that end, a Trump-appointed federal judge in Pennsylvania this week ruled in favor of voters, believe it or not. And a George W. Bush-appointed federal judge in Texas did the same thing late last month. We break down both rulings today before Desi Doyen joins us to close with our latest Green News Report, including a bit of bad news for the coal industry, thanks to good news from voters in Illinois this week as, once again, still more evidence that, yes, elections matter!...

Today on The BradCast: Congrats, America! Bribery, influence peddling, petty corruption, money laundering, fraud, conflicts of interest, even attempted cop-killing and much more is all, effectively, now legalized in these United States! At least if you're on the right team. [Audio link to today's show follows this summary.]

In his Inauguration speech, just three (looong) weeks ago, Donald Trump declared: "The golden age of America begins right now." Apparently he meant the Golden Age of Corruption. For him. And his chosen pals.

But, first up today, a correction to one point from yesterday's show (see the quick version of that correction at the bottom of yesterday's show posting).

Then, we step quickly through a few crime-related turns for Trump and his cronies today alone. Steve Bannon pleaded guilty to one New York state felony charge related to a fraudulent scheme in which he helped steal millions from hundreds of thousands of Trump supporters to supposedly build a wall on the U.S. southern border during Trump's first term. The plea agreement, if he behaves, will result in no jail time for Bannon who was previously charged [PDF] with related felony crimes at the federal level until preemptively pardoned for them by Trump on the last day of his first term. Repeat offender Bannon served four months in federal prison last year after being convicted of contempt of Congress for refusing to answer subpoenas from the House January 6 Committee. After his sentencing today, he called on Trump's Attorney General, Pam Bondi, to weaponize the DoJ against New York prosecutors Alvin Bragg and Letitia James.

Today, Trump also gave a full pardon today to Illinois' corrupt former Democratic Governor Rod Blagojevich, who was convicted on felony charges related to trying to sell Barack Obama's U.S. Senate after he won the Presidency in 2008. Trump previously sprung Blago from his 14-year prison sentence with a commutation, six years early, during his first term.

Also today, Trump's personal defense attorney turned Acting Deputy A.G. corruptly ordered the DoJ to drop all charges against NYC's Democrat-ish Mayor Eric Adams on charges related to doing favors for Turkey in return for free airplane trips and hotel stays around the world.

Both Blago and Adams have each cozied up to Trump in recent months and today, they received their prize. The rest of us received the message that criming --- particularly public corruption --- is just fine as long as you say nice things about Donald Trump after getting caught.

But, if you didn't get the message, our quick summary of just some of Trump's most corrupt, pro-crime, anti-rule of law activities from just his first three weeks in office, from Day 1 right up until today, should help. Including...

  • Pardoning all of the violent January 6 offenders on his first day in office;
  • Firing Inspectors General from more than a dozen government agencies;
  • Dropping DoJ prosecutions in progress for Republican elected officials (and even some Democratic ones that have cozied up to him);
  • Firing scores of senior DoJ and FBI officials so far (he will be removing many more in the days ahead);
  • Ordering all work at the Consumer Financial Protection Bureau (CFPB) --- the folks who police Big Bank, Credit Card and Payday Lender fraud on behalf of American consumers --- immediately stopped over the weekend;
  • Signing a new Executive Order on Monday halting all enforcement of the Foreign Corrupt Practice Act (FCPA), the law meant to prevent bribery by Americans and American Companies of foreign officials. (Trump's order describes the federal law as an "excessive barrier" to U.S. commerce!);
  • Quietly removing the head of the Office of Special Counsel at the Justice Department last Friday, (That's the office in charge of overseeing whistleblower complaints against the government and enforcing laws meant to tamp down on undue political influence);
  • And, the removal of the Director of the Office of Government Ethics (OGE) just last night. (That's the office that polices integrity and conflicts of interest of Executive Branch officials.)

There is much more, of course, including, I'm sure, much we don't even know about yet. But there's a starter. And, of course, many of the acts summarized above --- in addition to making Trump's personal criming much easier --- are also, themselves, unlawful, even if that may take some time for the courts to sort out. Whether Trump obeys court orders that he doesn't like, or chooses to trigger a full blown Constitutional Crisis instead, remains to be seen.

To discuss America's new Golden Age of Corruption, we're joined today by longtime public corruption and ethics expert CRAIG HOLMAN, Ph.D., Capitol Hill lobbyist on Government Affairs for the nonprofit watchdog Public Citizen. He steps us through some of Trump's most recent corrupt acts, such as the Friday firing of OGE Chief David Huitema who was finally confirmed by the U.S. Senate to a 5-year term in December, after Republicans blocked a vote for more than a year following his nomination by President Biden. Holman, last year, was instrumental in finally helping to push Huitema's confirmation through GOP obstruction in the Senate.

"The Office of Government Ethics serves a very fundamental purpose," Holman explains, "to try to educate and make everyone in the administration --- over 140 different federal agencies --- understand what the ethics rules are, understand what the conflict of interest code is all about, and then help public officials comply with those types of rules." Well, no wonder Trump hopes to neuter that office!

"What we're seeing here --- besides utter chaos on Capitol Hill --- is a full-scale assault on accountability, oversight, and the checks and balances. It goes way beyond the Office of Government Ethics. It's already affected the Office of Special Counsel, 17 independent IGs have been fired," Holman tells me, before adding: "And, by the way, almost all of these firings have a direct financial impact on Elon Musk. So we're seeing the conflict of interest code being torn apart. Every agency he's gone into, all those agencies were overlooking Elon Musk's business practices. The people who were in charge of that have since been fired from these agencies."

We cover much more today in my conversation with Holman, including what interest Congress (specifically, the Republicans who currently control both chambers) may have in all of this, as their own Constitutional powers are being stripped away from them; whether Trump will actual obey court orders as they come down against him; and whether the Humpty Dumpty of our Constitutional order will ever be able to be put back together again, after all of this is finally, mercifully over.

The situation is "dire," warns Holman today. "We are on the very precipice of losing American democracy here. In the first Trump Administration, he sounded like he wanted to end democracy, and by the end of it he actually tried throwing a coup d'etat on Jan. 6th. This time around, he knows what he's doing. That's why we've seen this flurry. He's just marching unrestrained over our democratic norms and our democratic institutions. This is a very dire situation we are seeing here."

From top to bottom, the Federal Judiciary, as evidenced several times this week alone and discussed in detail on today's BradCast, seems to be coming undone. [Audio link to full show follows below this summary.]

But, first up today, a quick review of Tuesday's Primary and Special Election results in Arizona, Florida, Illinois, Kansas, Ohio and California. Both Joe Biden and Donald Trump have already won enough delegates to clinch their respective party's nomination, but there are still a several interesting data points of notes to be gleaned from Tuesday's results.

Among them, Trump is consistently losing a far larger share of Republican votes than Biden is losing on the Democratic side. On Tuesday, for example, Biden's reported margin of victory in the states where he was on the ballot was anywhere from 74 to 88 points, while Trump's margin never cracked even 70 points, ranging from 59 to 67. In short, Biden seems to be far more popular among Democratic primary voters than Trump is among Republicans.

We've got other noteworthy tales of the tape today, along with Senate Primary results out of Ohio, where both Democrats and Donald Trump appear to be very happy that Trump-backed Bernie Moreno will be the GOP's nominee running against three-term progressive Democratic U.S. Senator Sherrod Brown in November. And, in California, Democrats are no doubt happy to see that nobody won more than 50% of the vote in the Special Election to fill the seat left vacant by ousted Republican House Speaker Kevin McCarthy on Tuesday. That means his seat in the closely divided U.S. House, which will almost certainly go to a Republican eventually, will remain empty until at least the Special Election runoff in May.

Also of note today, what the Washington Post is describing as the Biden Administration's "biggest climate move yet". Desi Doyen joins us to explain the EPA's new final rule that is set to increase the speed of the nation's transition to cleaner Electric and Plug-in Hybrid Vehicles; how rightwing media are already lying about the EPA's new rule; and how Republican states and the fossil fuel industry will soon be seeking out friendly judges in the federal judiciary to try and undermine the new rule and its billions of dollars in life-saving new vehicle emissions standards for the American people and the planet.

Then, speaking of friendly rightwing judges, two cases that came before the corrupted U.S. Supreme Court this week --- when, in fact, neither of them should have --- serve to highlight our increasingly brittle judicial system and how it is being gamed by the far-right.

We're joined today by Slate's great legal journalist, MARK JOSEPH STERN to discuss both cases and what they might tell us about a court system, and perhaps a U.S. Supreme Court, nearing a breaking point.

We originally invited Stern for today's show to discuss Monday's absurd case brought by Republican-run states falsely claiming the Biden Administration is somehow violating First Amendment free speech rights by forcing social media companies like Twitter and Facebook to take down posts they don't like regarding COVID, election fraud and more. Of course, the government is not doing that at all. Stern describes the case at Slate --- Murthy v. Missouri (originally Missouri v. Biden) --- as "brain-meltingly dumb", "asinine", and "what happens when a lawless judge and a terrible appeals court embrace the dopiest First Amendment claim you’ve ever heard out of pure spite toward a Democratic president."

The case should never have even made it out of the lowest District Court, but for a Trump-appointed judge who "completely butchered the record and, I think, willfully misrepresented a huge amount of communications between federal officials and social media companies," Stern tells me. "He would pluck individual little clauses from those emails, rearrange them to make it sound like coercion, and then use that to develop what is frankly a conspiracy theory that the federal government strong-armed these companies into silencing their users and censoring speech. It's just not true." (See this article for just some of the gobsmacking examples of ways in which U.S. District Judge Terry Doughty "butchered the record" by falsely representing the evidence record in his ruling.)

Making matters worse, the nation's most extreme appellate court, the 5th U.S. Circuit Court of Appeals, further butchered the record to accomplish what corrupt Supreme Court Justices Thomas, Alito and Gorsuch laughably described when the case came up to SCOTUS as "extensive findings of fact" that "showed the existence of ‘a coordinated campaign’ of unprecedented ‘magnitude orchestrated by federal officials that jeopardized a fundamental aspect of American life.'"

Monday's Oral Argument at SCOTUS, however, pulled the rug out from under pretty much all of that, as the phony allegations met skepticism from even the bulk of the Court's rightwingers. But before we could get to that case today, as previously planned, we had to get through the 5th Circuit Court of Appeals' other recent clown show (which the rightwingers on SCOTUS were happy to play along with last night): their attempt to allow Texas' new law that overturns a century of legal precedent and the U.S. Constitution itself to grant powers to state and local police that override federal immigration law, allowing them to arrest and deport suspected undocumented immigrants.

Stern unpacks the bizarre twists and turns the case has seen over the past 24 hours, and charges that the procedural nonsense from the 5th Circuit and subsequent acquiescence by SCOTUS simply "boggles the mind."

So, what might we learn from all of this --- and all that has come before it --- regarding corrupt Trump-appointed judges, a corrupt 5th Circuit Court of Appeals, a corrupt and increasingly volatile SCOTUS, and the rightwing judge shopping that exploits all of it? We discuss all of that and more with Stern who details "a kind of terrifying intramural war within the judiciary," as some of the courts are pushing back against an attempt by the U.S. Judicial Conference (headed up by Chief Justice Roberts) to rein in judge shopping, and, ultimately, how restoring confidence in the High Court itself may "all come down to what Brett Kavanaugh and Amy Coney Barrett want to do with the courts and want their legacy to be."

"Until they take a harder line here, it's going to remain just as broken as it looks," Stern asserts. "It's going to be even worse behind the scenes, based on what I'm hearing about how these judges' relationships are breaking down over this stuff --- and we're going to have different factions within the judiciary that are fighting for power, not unlike the Kremlin at the height of Soviet-era madness"...

I should be in bed nursing my illness (whatever it is), rather than doing today's BradCast. But given the firehose of news, some of it huge, that broke after yesterday's guest-hosted show with Nicole and Desi (thank you, guys!) and today, I felt I had to come in for this one. Nasal congestion be damned. [Audio link to full show follows this summary.]

Back in 2018, as Trump-nominated Supreme Court Justice Brett Kavanaugh was lying his way through his Senate Confirmation hearings, he made what sure sounded like a threat at the time. "This confirmation process has become a national disgrace," he whined through angry tears. "And as we all know, in the United States political system of the early 2000s, what goes around comes around."

There has been a boatload of important news over the past 24 hours. But what may have been Kavanaugh's long-promised "comes around" moment may have finally occurred last night. The U.S. Supreme Court came up with at least 4 votes to hear Oral Argument of Donald Trump's ridiculous claim that Presidents enjoy "absolutely immunity" for any and all crimes they may commit while in office --- including ordering Seal Team Six to murder domestic political opponents, as Trump's lawyer's argued in this case at the lower D.C. Court of Appeals.

The federal appellate court, as well as the trial court below it, unanimously rejected the argument. But, rather than taking up the case three months ago, when Special Counsel Jack Smith asked them to, the corrupt SCOTUS waited more than two months before deciding, in a terse, one-page order [PDF], to "expedite" the matter by hearing it...seven weeks from now. The question will be: "Whether and if so to what extent does a former President enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office." --- Which "official acts" they may be referring to are uncited.

In the bargain, Trump's previously scheduled May 4th federal trial date for attempting to steal the 2020 election remains on on pause and may not now even begin before the 2024 election.

At the same time, in New York state court on Wednesday, an appellate judge, within hours after Trump's filing, rejected his attempt to offer a $100 million bond to prevent Attorney General Letitia James from beginning seizure of his assets in about 30 days for failure to post cash or a bond for the full $454 million penalty he faces for a decade of massive fraud via his corrupt real estate company. And Trump's criminal trial in the state, on 34 charges related to cheating to win the 2016 election with hush-money payments to a porn star, is set to begin at the end of next month.

Given my physical condition of late, we called in our good friends and very wise longtime fellow bloggers HEATHER DIGBY PARTON of Salon and Hullabaloo, and 'DRIFTGLASS' of The Professional Left Podcast, to help make sense of these key, historic events. They each offer context and analysis of what appears --- to them at least --- to be one of the most corrupt actions ever taken by our corrupted, far-right, Trump-appointed supermajority on the High Court.

Driftglass argues the news from the Court on Wednesday is that "It's a corrupt court. And that corrupt court has rendered a corrupt decision," underscores his belief that Trump will never see a day in prison. Digby reminds us that true accountability was always going to come from only one place: the voters at the ballot box this November. "I'm sorry to have to tell you," she tells me, "but it's going to have to be a grinding out of a Presidential campaign and people are going to have to vote this guy out."

We've got a lot of ground to cover on today's program, with smart insights from both of them as usual, even if I don't have the energy to document much of it here for you today. So, please tune in.

There's one point, however, that I didn't get to on the show --- blame the cold medicine --- in response to the somewhat grim and arguably cynical (if accurate) assessments from Digby and Driftglass. That is, that even if Trump's federal trial for attempting to steal the 2020 election had moved forward, as scheduled, well before this November's election, I think the magic bullet moment that had been applied to that trial --- as if a guilty conviction would be an elixir that finally woke up the nation to how corrupt he truly was, leading supporters to abandon him --- was always, in my estimation, somewhat overblown.

When (not if) Trump is found guilty on any of the 91 criminal counts he is currently facing at both the state and federal level, his supporters will find a way to justify it and continue their support nonetheless. It'll be a evidence of a "corrupt system" or "Joe Biden's witch hunt" against Trump, etc.

I have never quite bought into the prodigious polling which suggests his 2024 support would crater once he was finally found guilty of a crime. His supporters know what he did. We all do. It's obvious. A criminal conviction is unlikely to change many opinions of him either way. This was and still will be --- as both Digby and Drifty point out --- about the VOTERS showing up and VOTING to save our democracy from the clutches of a fascistic, sociopathic, narcissist hell-bent on destroying it for revenge. Whatever happens between now and November 5, nobody else was ever gonna do it for us.

Finally today, Desi Doyen joins us for our latest Green News Report, as winter heat in the center of this nation blew away records for February, topping out in the 80s and 90s in huge swaths of the region over the past week. That helped touch off what is now the largest wildfire in Texas history. In February! That, and much more on today's GNR.

We're still fighting COVID, but we think we're almost over the hump on today's BradCast, just as a long awaited voting system trial in a critical swing-state is finally set to begin. [Audio link to full show follows this summary.]

On Friday, just as Desi had days earlier, I too tested positive for COVID. After avoiding it for four years, we both finally got hit. But, thanks to keeping up with our boosters, free rapid home tests and the miracle anti-viral drug Paxlovid, both she and I are almost back to normal this week. She is now testing negative and I am, very faintly, still positive, but suspect I'll be fully clear by tomorrow. Most of our symptoms are gone and, most importantly --- because we were both positive --- we're able to be in the same room again! So, I think we're finally back to our usual schedule after an unexpectedly long holiday break and a bumpy start to what is likely to be a very bumpy new year.

As it turns out, we're not the only ones swept up among the largest spate of cases in the U.S. since the initial Omicron wave back in late 2021. Cases, hospitalizations and deaths are still on the rise. If you haven't already, please get your COVID and flu shots this year, as that is also seeing a big bump right now. And, if you want to get over COVID quickly, ask your doctor for Paxlovid as soon as you test positive, because it must be taken right away. It has certainly worked wonders, so far, for us.

With that medical sidebar out of the way, for now, we're back to the grind of the 2024 elections and the former President's threat to American democracy itself on today's program. Last week, Donald Trump failed to sign a pledge against advocating for the overthrow of the government in his Illinois candidacy paperwork, despite signing the optional pledge when he ran in both 2016 and 2020.

And, on Friday, President Biden, in his campaign launch in Valley Forge, Pennsylvania, called out Trump, by name (44 times), including as an "insurrectionist". During his remarks, marking the third anniversary of Trump's deadly January 6, 2021 U.S. Capitol attack, Biden also finally took our advice in calling out Trump in plain language for what he tried to do in 2020: "In trying to rewrite the facts of January 6th, Trump is trying to steal history the same way he tried to steal the election."

Thank you, Mr. President.

As to helping to prevent another attempted election theft in 2024, the long-awaited federal trial finally begins in Georgia this week in Curling v. Raffensperger, the 2017 lawsuit led by our friend Marilyn Marks of the Coalition for Good Governance. The suit seeks to the block the use of Georgia's insecure, unverifiable touchscreen voting systems made by Dominion and see them replaced with verifiable hand-marked paper ballots in the battleground state.

In 2019, the federal judge overseeing the case, U.S. District Judge Amy Totenberg, blocked the further use of the state's old touchscreen voting systems made by Diebold, finding them to have unconstitutional security infirmities. Unfortunately, against the advice of cybersecurity and voting system experts, GA's Republican Sec. of State Brad Raffensperger then moved the entire state to touchscreens made by a different manufacturer with many of the same problems featured in the old systems.

This is also the case which uncovered, during the discovery phase in 2022, the now-notorious Coffee County, GA voting system software breach by Team Trump. That unprecedented theft and distribution of sensitive voting system software resulted in the indictment [PDF] of Trump attorney and breach organizer Sidney Powell as part of Fulton County, GA District Attorney Fani Willis' criminal conspiracy charges against the disgraced former President and 18 co-conspirators.

As Washington Post detailed in its own lengthy preview on Sunday, the trial, set to begin this week, has already resulted in MAGA election deniers and conspiracists like MyPillow CEO Mike Lindell pretending to be vindicated by one of the judge's earlier rulings finding that the Curling plaintiffs, unlike Lindell, are not "conspiracy theorists of any variety" and that, as Judge Totenberg found, they have the support of "some of the nation's leading cybersecurity experts and computer scientists."

Those scientists and experts have documented how the touchscreen systems used across the entirety of Georgia (and in jurisdictions in more than a dozen states) are wildly "vulnerable" to hacking and system failure, even as no evidence has been found that the 2020 or 2022 elections were actually hacked. As Judge Totenberg noted in a 2020 ruling, the plaintiffs "convincingly present evidence that this is not a question of 'might this actually ever happen?' - but 'when it will happen,' especially if further protective measures are not taken."

We're joined today by SUSAN GREENHALGH, Senior Advisor on Election Security at Free Speech for People. She has worked very closely on this case with the plaintiffs from Coalition for Good Governance and has joined us on the program many times to discuss it since it was initially filed seven years ago.

Among the details discussed in today's "curtain raiser" before trial: How Democrats have become frightened of challenging unverifiable voting systems in the wake of the MAGA election denial movement. The gob-smacking ruling on Friday from the 11th Circuit Court of Appeals that Raffensperger does not have to testify as a witness, despite the lower court judge ordering him to do so, and Raffensberger's insistence [PDF] in his own recent book, amusingly titled Integrity Counts, that "the ultimate fact-check in the United States...occurs in courts of law, where witnesses swear to tell the truth or risk imprisonment and where lawyers must also tell the truth or risk disbarment. If you want to know the truth, watch what happens in court."

Sadly, we won't be able to watch Raffensperger in court. He fought tooth and nail up to the appellate level to avoid 75 minutes of testimony as a witness in the Curling case.

Also, as Greenhalgh explains today, Raffensperger has now ordered the election security reviewer at the Sec. of State Office's "not to provide any reports in writing any longer, to only give them orally." She describes the order as "really strange," begging the question, yet again, as to why the rightwing 11th Circuit would allow Raffensperger to avoid testifying.

"There are a lot of questions that Raffensperger should be answering," she argues, while noting that despite the absence of the guy who, in defiance of experts, ordered the use of these machines in the first place --- and then failed to investigate the 2021 MAGA breach and distribution of statewide voting system software in Coffee County for more than a year --- there is still plenty of evidence for plaintiffs to make their case against these godforsaken, unreliable, unnecessary voting computers in advance of the 2024 general election.

"There are a lot of questions that really should have been answered by Raffensperger," Greenhalgh laments, before adding : "But they still have overwhelming evidence."

The trial is scheduled to begin in federal court in Atlanta on Tuesday...

U.S. 7th Circuit Court of Appeal panel finds civilians' right to 'bear arms' doesn't apply to weapons intended for military use...

Assault weapons bans are still not unconstitutional. For now.

By way of a 2 - 1 decision [PDF] last Friday, a three-judge panel of the U.S. 7th Circuit Court of Appeal has temporarily upheld an Illinois assault weapons ban.

The Illinois Act makes it "unlawful for any person [except "trained professionals" and "grandfathered individuals"] within Illinois knowingly to 'manufacture, deliver, sell or purchase…an assault weapon, assault weapon attachment, .50 caliber rifle, or .50 caliber cartridge." The Act expressly applies to the AR-15 and to high-capacity magazines.

The issue came before 7th Circuit via three consolidated cases: Bevis v. City of Naperville, Herrera v. Raoul and Barnett v. Raoul. In two of the cases, Bevis and Herrera, federal district court judges denied motions for the issuance of a preliminary injunction whereas the district court, in Barnett, granted a preliminary injunction.

The 7th Circuit decision, authored by Judge Diane Wood, a Clinton appointee, and joined by Judge Frank Easterbrook, a Reagan appointee, overturned the Barnett preliminary injunction upon the grounds that the plaintiffs in all three cases had failed to establish a strong likelihood of success on the merits. (Michael Brennan, a Trump appointee, dissented.)

In order to show a likelihood of success on the merits, the plaintiffs in each of these cases…have the burden of showing that the weapons addressed in the pertinent legislation are Arms that ordinary people would keep at home for purposes of self-defense, not weapons that are exclusively or predominantly useful in military service…

While it doesn't amount to a final determination on the constitutionality of the assault weapons ban deployed in the Land of Lincoln, at a time of unbridled carnage --- there have been more than 565 mass shootings in the U.S. over the first 10 months of 2023 --- the reasoning applied by the 7th Circuit majority offers a glimpse, at least, of sanity...

It was another necessarily grim BradCast today, as conditions worsen and the death toll rises in Gaza while Israel continues relentless airstrikes in the wake of Hamas' horrific attack over one week ago. [Audio link to full show follows below this summary.]

Hundreds of innocent civilians, including women and children, have been killed over the past week in the Gaza Strip in advance of Israel's likely ground invasion. Food, water, medical supplies and fuel remains cut off to the territory of 2.3 million, with supplies now running dangerously low. The U.S., along with the U.N. and human rights organizations are calling for humanitarian aid to be allowed in, and for innocent victims and foreign nations to be allowed out of the region. The death toll is now in the thousands and 30 Americans have been confirmed as killed.

Hopefully, as grim as it may be, today's program is an insightful one, with both accurate news and a number of spirited conversations with callers. You'll be the judge of the that.

Among the many stories both reported and explained on today's program...

  • Film and TV actors of SAG-AFTRA join the Writers Guild of America (WGA) in going on strike against producers in hopes of proper payment and residuals for streaming services and AI usage, among other appropriate demands.
  • We take another quick spin through my new favorite website --- FoxWeather.com --- where they report on all of the catastrophic effects of climate change now devastating much of the planet, but because Fox hates its duped readers and viewers so much, they never even once explain why all of these disasters are now happening. (Hint for Fox "News" dupes, if I'm lucky enough that you stopped by: It's the climate change, stupid, as caused by the burning of fossil fuels.)
  • The Biden FDA approves the first ever over-the-counter birth control pill. Happily, this should be bring the abortion rate way down. So, rightwingers will be delighted with this news, right?
  • Dumb GOP megadonors in Illinois lose their ill-considered fight to prevent the use of clean, electric leaf blowers on their 22-acre estate. But it's a win for their neighbors and for the rest of us. (And even for them, whether they too dumb to know it or not!)
  • A state court orders New York to redraw U.S. House maps before the 2024 elections. That alone could end up flipping the House back to Democratic control next year, after the GOP flipped four NY seats from "blue" to "red" last year, after the state court blocked an attempted Democratic gerrymander. It's complicated.
  • Great news for North Carolina residents! After Republicans on the corrupted U.S. Supreme Court recently blocked Affirmative Action for college admissions at the University of North Carolina (and everywhere else in the bargain), the school has announced it will be offering FREE tuition to many in-state students "as part of their continued effort to boost diversity".
  • Late last month, the corrupt rightwing SCOTUS majority used their recently invented-from-whole-cloth "Major Questions Doctrine" to block the Biden Administration from using the specific text of the federal HEROES Act to forgive up to $20,000 in student loans to borrowers. The President has announced a new plan to use a different law to accomplish even broader forgiveness, though it will take a bit more time than his initial plan. In the meantime, beginning next month, a newly restructured repayment plan for loans will allow millions to pay just $0 a month (you read that right) without seeing any interest added. Their entire loan may then be considered as paid in full after 10 years. We break down the key details of the new plan and how Republicans are already attempting to undermine it, because they hate people who aren't millionaires or billionaires.

Also: More disturbingly good news from SCOTUS and the lower courts!...

Seriously worried about what's going on at SCOTUS. Yet another good decision today. Are they okay? And what does all of this good news mean for their opinions yet to come before term's end at the end of this month? We worry about that and more on today's BradCast. [Audio link to full show follows this summary.]

Nonetheless, most of our stories today are, happily, not horrible. Among the many covered today...

  • An obnoxious Fox "News" chyron describing President Joe Biden as a "wannabe dictator" on the day of Donald Trump's federal arraignment on 37 criminal felony counts (and their ham-fisted crocodilian "cover up" thereafter) offers a telling illustration of how the Trump Mind Virus has been implanted into the poisoned brains of his cult followers.
  • The faintest of cracks may be emerging in the otherwise seemingly solid GOP support for their disgraced, criminal defendant former President, including an unmistakable plunge of some 15 points for Trump in Ipsos/Reuters polling among Republicans from April to June.
  • The attorney for 2016 Russian election interference whistleblower Reality Winner, however, has a few thoughts on our actual two-tiered justice system.
  • After stunningly good decisions last week protecting both the Voting Rights Act and Medicaid, the otherwise-corrupted U.S. Supreme Court did it again today, with a 7 to 2 ruling upholding the Indian Child Welfare Act, with Amy Coney Barrett(!) writing the opinion that rejects "all of petitioners' challenges to the statute". Still to come by the end of the month, however: SCOTUS rulings on Affirmative Action in college admissions; the Independent State Legislature theory decision that could wreak utter havoc in the 2024 Presidential election; and whether they will deign to allow Biden to waive up to $20,000 for each federal student loan borrower.
  • We've also had some very good news from the lower federal courts as well in recent weeks, including a U.S. District Court judge rejecting Tennessee's Republican Gov. Bill Lee's attempt to stifle free speech by unconstitutionally banning drag shows, and a temporary injunction on portions of Florida's Republican Gov. Ron DeSantis' unspeakably cruel law that places his state's Big Government between doctors and medically necessary treatments for trans children. That, in a state where DeSantis laughably ran for reelection last year with the slogan "Freedom Lives" in Florida.
  • Of course, as we've learned since 2016, for GOP American Idiots infected with the Trump Mind Virus, "The Cruelty is the Point". They seem to think it will somehow help them gain or hold power. Illinois' Democratic Gov. J.B. Pritzker, however, in his Commencement Address at Northwestern University this week, has some helpful advice on how to spot an idiot. (Hint: Their cruelty is a dead giveaway.)
  • Finally, Desi Doyen joins us for our latest Green News Report, with troubling news for the Summer on both sides of the Canadian border and in Texas. But, there is also a very encouraging landmark trial playing out right now in a Montana courtroom...
