We're covering 2024 election news in at least four different states on today's BradCast --- track conditions, not horse race --- and only one of those stories is particularly good news as GOP dirty tricks and voter suppression seem to be getting an early start this year. [Audio link to full show follows this summary.]

Among our main stories today...

  • Voters in Maryland, Nebraska and West Virginia headed to primary polls on Tuesday, with critical U.S. Senate and other races on the ballot. Noteworthy results and/or problem reports on tomorrow's program.
  • We first began reporting on this story early last month, when it seemed utterly ridiculous to even contemplate. It still does, frankly. Nonetheless, Ohio's wildly dysfunctional, partisan-gerrymandered Republican state legislature missed last week's deadline for a legislative fix to allow Joe Biden on the Buckeye State ballot this year. Ohio has a state law that requires Presidential candidates be officially certified by their party 90 days before the general election to be included on the state ballot. But the Dems' convention this year is just 74 days before the election. In past years --- for example, for Donald Trump in 2020 --- lawmakers simply changed the deadline to cure the problem as needed when conventions are held later in the Summer. This year, however, petulant state Republicans are demanding a pound of flesh from Democrats to make any such changes. And now, with last week's deadline past, its going to be even more difficult to do so. Tune in for the full --- and still ridiculous --- skinny.
  • Speaking of ridiculous, a rightwing activist in the state of Washington placed two Democratic candidates for Governor named Bob Ferguson on the ballot last Friday, just hours before the state's August 6th primary deadline. The state's longtime Democratic Attorney General, and front-runner to win the Governorship this year, is also named Bob Ferguson. And so the GOP's dirty tricks chaos for 2024 officially begins.
  • If they can't keep Democratic candidates off the ballot for no good reason, or add several candidates with the same name to the ballot to wreak confusion, Republicans still remember how to do it with good old fashioned voter suppression laws, like the newest one signed last week by Georgia's Republican Governor Brian Kemp.
  • Meanwhile, Democrats are still in court fighting back Republican voter suppression from years ago. On Monday, the newly liberal majority on the Wisconsin Supreme Court heard oral argument to reverse a ridiculous ruling by the high court's previous rightwing majority that bans the use of secure absentee ballot drop-boxes. That, even as they've been used for years without incident or fraud in the Badger State (or anywhere else, for that matter.) The hearing was encouraging, as even the defendants --- the bipartisan Wisconsin Elections Commission --- agree there is nothing in state law that actually bans their use. "The Commission fully agrees that drop boxes are permitted under Wisconsin statutes," said the Asst. AG representing them at the hearing. But it sure was amusing to hear Republicans argue in favor of stare decisis (respect for legal precedent and settled law) to keep the 2022 ruling in place from the rightwing partisan court just two years ago. Especially when one of the court's liberal justices at the hearing cited none other than U.S. Supreme Court Justice Sam Alito's majority opinion in Dobbs that overturned 50 years of Roe v. Wade legal precedent. Using Alito's precise language from the SCOTUS ruling, the WI Justice asked what Republican plaintiffs thought the court should do if they found the previous ruling to be "egregiously wrong".

Once again, on today's BradCast, we've got a mid-week "ketchup" for you, with everything you need to know about the disgraced former President's still-ongoing, first criminal trial. And it's been a very big week in that regard. [Audio link to full show follows this summary.]

But, first up today, interesting results out of Indiana on Tuesday, where the "zombie campaign" of Nikki Haley, who quit the race two months ago, still racked up nearly 22% of the vote in the Republican Presidential Primary against Donald Trump. (Joe Biden ran uncontested on the Democratic side.)

Next week's primaries will be in Nebraska, Maryland and West Virginia, where former coal baron and federally convicted criminal Don Blankenship --- a hard-right loon --- has decided to run in the Democratic primary to fill the U.S. Senate seat being vacated by rightwing Democrat Joe Manchin. Blankenship lost as the Republican nominee against Manchin in 2018. This year, as a "Democrat", he'll be running next week in WV against staunch pro-union candidate Glenn Elliot and Marine Corp vet and grassroots organizer Zach Shrewsbury. The winner will likely be taking on current Governor and coal baron billionaire Jim Justice who ran for Governor as a Democrat in 2016 before flipping to Republican in 2017 just after he was elected.

Then, it's on to today's coverage of the past week's criminal Trump Trial in New York, where the former (and future?) President faces 34 felony charges related to hush-money payments made to porn star Stormy Daniels to help him win the 2016 Presidential election. Daniels was called by the Prosecution for testimony on Tuesday and, as you likely know by now, it was a bit of a blockbuster.

We're joined today by our old friends HEATHER DIGBY PARTON, award-winning columnist at Salon and longtime blogger at Hullaballoo, and former attorney and former Republican KEITH BARBER, who now blogs on legal and Constitutional matters as "KeithDB" at the progressive Daily Kos website.

Among the topics of today's conversation...

  • Daniels' disturbing testimony about her disturbing, apparently "quasi-non-consensual" (as Barber describes it) sexual encounter with Trump during a celebrity golf event in Lake Tahoe and why specific details of that counter either are or are not important to the Prosecution's case. (Barber: "If Trump invites you to a dinner date, don't expect dinner.")
  • Why Trump's attorneys sought a mistrial on Tuesday, but were rejected by the trial judge.
  • How Team Trump's various over-ruled objections are likely working against them.
  • How the Defense is doing in its attempt, so far, to cross-examine Daniels. (Barber: Trump's team was "too ham-fisted" and "outsmarted by the adult industry star.") The cross continues on Thursday.
  • Why last week's testimony by former, longtime Trump aid Hope Hicks was so important to the State's case, and why she broke down in tears as the cross-examination began. (Parton: "A devastating blow to his defense.")
  • Why Monday's testimony from the Trump Organization's former Controller and its current chief of Accounts Payable was so important to the Prosecution's case.
  • How all of this is being reported (or not) by mainstream media and rightwing media (Parton: "Fox is not covering it. Neither is Newsmax or OAN.") and heard by voters in both cases.
  • Whether the lack, so far, of testimony describing Trump himself as ordering the falsification of business records is going to be a problem for the Prosecution, and whether upcoming testimony by Michael Cohen can fix that.
  • Whether Trump will be held in criminal contempt by the judge for the eleventh time and if he'll actually be given jail time for his next violation of the court's gag-order. (Parton: "Trump doesn't want to go to jail. They don't have hair and makeup people in there." Barber: "He doesn't want to go to jail, no matter how much he'll tell his stupid MAGA followers that he does.")

We barely made it for today's BradCast, after a nightmarish computer crash. So, if today's show is an odd, disjointed mess that makes no sense at all, feel free to blame Microsoft. But if it's great, I'll take all the credit! [Audio link to full show is posted below summary.]

Among the stories covered on today's program...

  • Huge news today from the CDC! "This is a great day for America," President Joe Biden proclaimed in the Rose Garden, after his mask free meeting with vaccinated Republicans in the Oval. The fully vaccinated may now take off their masks in most places both indoors and out, and end social distancing protocols, according to the CDC's surprise announcement. There are a few caveats, as we discuss, and, of course, even though this weekend marks two weeks since the second COVID shot for Desi and me (and the "fully vaccinated" status that comes with it), we've still got a few reservations.
  • Even the friends on Fox and Friends admit they are all vaxxed up now! But even that hasn't kept them from continuing to pump disinformation about vaccines into the veins and brains of their horrifically misinformed viewers.
  • The quest continues to get shots into arms of the hesitant --- many of whom not-coincidentally-at-all happen to be Republican male and Fox "News" viewers. Some GOP state Governors are now coming up with clever incentives. West Virginia's Jim Justice is offering $100 savings bonds to residents age 16 to 35 who get their shots. Ohio's Mike DeWine announced on Wednesday that vaxxed up Buckeye Staters will be eligible to win 1 million dollars in a lottery, five weeks in a row! (But why not 10 winners each week of $100,000? We discuss.) In both cases, the payoffs are coming courtesy of the federal government, via Joe Biden and the Democrats' American Rescue Plan, which no Republicans voted for. But it's nice to see Republican Governors enticing their residents with "socialist" cash prizes!
  • And then there's Georgia's embarrassing Republican Rep. Marjorie Taylor Greene who "aggressively confronted" New York's Democratic Rep. Alexandria Ocasio-Cortez on Wednesday night in the halls of Congress. She followed her, stalked her, and called her a "terrorist" and a "chicken" for refusing, apparently, to debate her about...whatever. It was some top-notch 5th grade level bullying, but nothing new for the loathsome Greene. Her caucus, apparently, has no problem with her behavior, even as they voted this week to remove Rep. Liz Cheney from her leadership position because she refuses to participate in the Big Lie about a stolen election and believes Donald Trump should be held accountable for inciting an insurrection on the U.S. Capitol.
  • And, yes, it was an insurrection, despite the attempts by House GOPers in recent days to pretend that it was not. (Here's some fresh video evidence if you need it.)
  • Speaking of accountability (or lack thereof), Politico offers a fascinating scoop today --- for some reason --- regarding extradition statutes in two different states in the event that, for example, someone who is staying at a resort in Palm Beach, Florida or Bedminster, New Jersey finds themselves criminally indicted by a District Attorney from Manhattan within the next few months. Hmmm....
  • And, speaking of a bit more accountability --- let's say, at the federal level --- on Wednesday night, the U.S. House Judiciary Committee struck a court-approved deal with the U.S. Dept. of Justice for Donald Trump's White House Counsel Don McGahn to finally answer his 2019 subpoena to testify about his starring role in the 448-page report [PDF] issued by Special Counsel Robert Mueller concerning at least 10 documented instances of apparent criminal obstruction by the disgraced former President. No extradition charges are needed for federal indictments...unless the perp flees the country.
  • Finally, Desi Doyen joins us for our latest Green News Report as the Colonial Pipeline restarts after a ransomware attack shut down the nation's largest pipeline network (and, yes, as I asserted in the GNR, we learned later today the company did pay a ransom to the hackers!); as gas hording Americans on the Eastern Seaboard have been panic-buying; as the Biden Administration greenlights the first major offshore wind farm in the U.S.; and as Tesla dumps Bitcoin due to its massive carbon footprint...

COVID-19 surging in U.S. at record rates as hard evidence confirms that yes, Trump told his 'people' to 'slow the testing down, please'...

Seriously, at some point American officials will need to be prosecuted for mass murder for their criminal delinquency and deceit in dealing with the coronavirus pandemic, which has, so far, in just four months, cost the lives of more than 122,000 Americans. Those prosecutions should begin (if not end) with the man currently serving as President of the United States. That is particularly true in the wake of his criminal admission at his Death Rally in Tulsa last week, when he admitted that he told his "people...slow the testing down, please!" The White House later said Donald Trump was just joking, but when asked if he was kidding, he publicly admitted otherwise. "I don't kid," he said, "let me just tell you, let me make it clear." And we now have hard evidence on today's BradCast to prove that, perhaps for the first time, he was finally telling the truth. [Audio link to full show is posted below.]

On Wednesday, confirmed new coronavirus cases in the U.S. set a single day record of more than 38,000. At the same time, hospitalizations are rapidly increasing in a number of states around the country, including states such as Florida, Texas, Arizona and Oklahoma, where denialist Republican Governors reopened for business far too quickly, in direct contradiction to almost all health experts.

As states like New York, New Jersey and Connecticut --- hit hardest and earliest at the beginning of the pandemic --- have seen case numbers and hospitalizations plummet, they've instituted quarantine restrictions on travelers from some of the currently hardest hit states. As of Wednesday, the list included Alabama, Arkansas, Arizona, Florida, North Carolina, South Carolina, Utah and Texas.

When asked what he would say to the leaders of some of those states, including Florida, whose Republican Gov. Ron DeSantis had issued a quarantine on travelers from the NY metro area early in the pandemic (while failing to mandate appropriate restrictions in his own state), New York's Democratic Governor Andrew Cuomo said today: "You played politics with this virus and you lost. You told the people of your state and you told the people of this country, White House, don't worry about it. Just open up, go about your business, this is all Democratic hyperbole. Oh, really? Now you see 27 states with the numbers going up. You see the death projections going up. You see the economy going down. It was never politics, it was always science. And they were in denial."

Well, many of them are still in denial. And not just denial, but taking purposeful, affirmative efforts to lie to their people about COVID-19 numbers in their own states. The expert who ran Florida's once-lauded COVID-19 tracking website, but was fired because, she says, she refused to manipulate the data, sent out a warning this week. She charges that officials have been "instructed this week to change the numbers and begin slowly deleting deaths and cases so it looks like Florida is improving next week in the leadup to July 4."

In West Virginia, the state's Republican Gov. Jim Justice, a billionaire coal baron, has forced out the commissioner of the state's public health bureau because he didn't like the numbers she was reporting, as cases rise in at least 11 counties. He had previously lauded her at regular COVID-19 press briefings where she spoke. She was not at his latest briefing on Wednesday and released a statement upon her forced resignation that night, urging state officials "to stay true to the science".

Meanwhile, as the head of the U.S. Centers for Disease Control and Prevention (CDC), conceded that the infection rate in the U.S. is likely 10 times higher than the number of cases currently reported (that's 23 million probably infections, instead of the official 2.3 million reported as of today), states like Texas are seeing not just increased cases, but spiking hospitalizations, which have doubled over the past week. In Houston, ICU beds were 97 percent full by Wednesday. (In Florida, Gov. Ron DeSantis has barred hospitals from reporting those numbers anymore.) Even Republican Gov. Greg Abbott is now warning of the state's "massive outbreak", while still failing to mandate masking or even allowing local officials in Houston or anywhere else to do so on their own.

And yet, with all of that, Donald Trump really has told his "people" to "slow the testing down." Talking Points Memo's Josh Kovensky has been documenting the refusal by the Dept. of Health and Human Services (HHS) and the Federal Emergency Management Agency (FEMA) to approve extensions for federally funded testing at 13 sites across five states, including Texas. Where more than 40 such sites were once funded by the federal government across the country, only 13 sites remain, and they have been told by the Trump Administration that those resources will end on June 30th, despite desperate requests from officials in Texas, Illinois and Pennsylvania for the much-needed aid to continue.

That's just a taste of today's program, which raises the very serious question: Should these people be held accountable for the thousands --- perhaps tens of thousands --- of American citizens who are likely to die, thanks to their purposeful efforts to ignore science and health officials for purely brazen political purposes?

The deadly denial about the coronavirus is a fast-motion mirror of the Republican denial, for brazen political purposes, regarding climate change. Today we close with some accountability and/or attempts at accountability on that front in our latest Green News Report, in which Minnesota's Attorney General has now filed a consumer fraud lawsuit against Exxon, Koch, and the American Petroleum Institute, citing, by way of just one example, a "proprietary" document from Exxon warning about the dangers of "CO2 concentrations in the atmosphere...due to fossil fuel combustion" that "will cause a warming of the earth's surface" and "dramatic environmental effects before the year 2050." That prescient, on-the-money document is dated October 16, 1979, before Exxon went on to spend millions of dollars over decades to misinform the public that climate change due to the burning of fossil fuels was little more than a hoax. Desi Doyen joins us for that attempted accountability and a bit more that has actually succeeded in a refreshingly encouraging GNR today. And it comes not a moment too soon...

On today's BradCast: If you think the way the Republican Party has rigged and stolen the U.S. Supreme Court is appalling, just wait until you see what they're trying to do of late at a few of the state Supreme Courts! [Audio link to show is posted below.]

But, first up today: Donald Trump says the Crown Prince of Saudi Arabia told him he had nothing to do with the disappearance --- and, likely, murder --- of Washington Post journalist, Saudi citizen and U.S. resident Jamal Khashoggi at the Saudi consulate in Turkey. The Prince's word appears to be good enough for Trump, who went on to compare the situation to the allegations of sexual assault against now-U.S. Supreme Court Justice Brett Kavanaugh

Meanwhile, the midterm elections are now exactly three weeks away and early voting got underway on Monday in Georgia where, you'll be shocked to learn, it didn't go well. After our previous coverage of ongoing racially disproportionate voter suppression schemes under the command of GA Sec. of State and Republican gubernatorial candidate Brian Kemp (who is in a tight election contest with Democrat Stacey Abrams), and after very serious and years-long concerns about their completely unsecure, wildly hackable, and 100% unverifiable touchscreen voting systems, it appears that the electronic pollbook systems failed across Fulton County (Atlanta) on the first day of early voting.

In not entirely unrelated news, the GOP appears to now be a wholly owned subsidiary of Las Vegas billionaire Sheldon Adelson.

Then, we move to some of the insanity of several attempted state Supreme Court coups this week with Slate's legal reporter MARK JOSEPH STERN. Stern joins us to detail both some good news from the Florida state Supreme Court, regarding that state's Supreme Court, and an apparent Constitutional Crisis in West Virginia after a decision by that state's Supreme Court, regarding their state Supreme Court. If it all sounds nuts, it's because it is.

First, in Florida, outgoing Republican Gov. Rick Scott had vowed to name three new Justices to the Court, even though the Democratic-appointed Justices he planned to replace will not be vacating their seats, because of term limits, until after Scott officially leaves office in January. Stern reports the largely good news --- with a caveat or two --- regarding the Sunshine State's Supreme Court's unambiguous ruling last week that will leave the job of appointing three new Justice to Scott's successor instead (who will be either Democratic gubernatorial candidate Andrew Gillum or Republican Ron DeSantis, depending on how things go on November 6th.)

Then, things get far crazier at the West Virginia state Supreme Court, where the Republican state legislature, along with Republican Gov. Jim Justice, have been attempting a coup by impeachment of all five Justices on the state's 3 to 2 Democratic-majority Court. This story has more jaw-dropping twists and turns in it than I can possibly describe here --- including five temporary replacement Justices determining that at least one of the impeachments was unconstitutional under state law and the GOP-majority state Senate which hopes to move forward with a trial anyway...if only they could only find a Justice willing to preside over it, as required by the state Constitution.

Just tune in for the insane details on how, as in Florida, West Virginia Republicans are doing anything and everything they can to blatantly steal a Democratic-majority high court.

And, as if that's not enough, Stern then reports on the wildly hypocritical decision by the U.S. Supreme Court last week that will leave a new voter suppression law --- enacted by North Dakota Republicans --- in place for the November midterms. The ruling effectively changes the state's election law at the last minute before this year's general election and is likely to disenfranchise thousands of Native American voters. The ruling threatens to undermine this year's re-election chances of Democratic Sen. Heidi Heitkamp, who won her previous election in 2012 by just 3,000 votes, and could assure Republicans hold their control of the U.S. Senate along with it.

Yes, elections and Supreme Courts --- be they at the federal or state level --- matter!

Finally, Desi Doyen joins us for the latest Green News Report, as the long road to recovery begins and the death toll increases after the catastrophic Hurricane Michael, and as a bought-and-sold Republican Party --- from Marco Rubio in Florida to Donald Trump in the White House --- continue to deny the deadly and costly impacts of climate change on behalf of their fossil-fueled corporate owners...

On today's BradCast: Details on the extraordinary court ruling out of North Carolina on Monday, and the judicial coup being staged in West Virginia. But first, voters went to the polls for Tuesday's primary elections in Arizona and Florida and in Oklahoma for primary runoff elections. It did not go well in Arizona. [Audio link to full show is posted below.]

Maricopa County (Phoenix)'s paper ballot optical-scan computer systems failed in at least 100 precincts, according to the County Recorder. Many polling places were closed entirely this morning, and it was nearly noon before the systems were said to finally be working in all precincts. It's still unclear what the precise failure was, but the new County Recorder Adrian Fontes (who won his election after the previous, long-time Recorder was booted out for shutting polling places during the 2016 Primaries), tied it to pre-election tests that failed on Monday, and then a lack of contractors from the voting machine company (Dominion Voting) on hand to properly set up the systems before polls were to open today. "The contractor responsible for the voting machines was supposed to provide more than 100 technicians to assist with issues, but only 70 were available," the Arizona Republic reports Fontes as telling them at a news conference this morning. If we learn more, of course, we'll share it on tomorrow's show along with noteworthy problems and results in all three states holding elections today.

Then, following up on a story that broke minutes before airtime on Monday, we're joined today by Slate's excellent legal reporter MARK JOSEPH STERN to detail the extraordinary ruling issued by a three judge federal court panel finding all of North Carolina's U.S. House districts --- for a second time --- to be partisan gerrymanders in violation of the U.S. Constitution. Remarkably, the judges are considering ordering new maps to be drawn up before this November's elections, after already having found last January that Republicans had unlawfully gerrymandered the state's U.S. House districts. That ruling, however, was appealed to the U.S. Supreme Court which punted in June by ordering the lower court to review matters of standing. After having done so, the three-judge panel found the same Constitutional infirmities.

"The real villain here, in a sense --- aside from the Republicans, who obviously drew these incredibly gerrymandered maps --- is the Supreme Court and Justice Anthony Kennedy," says Stern. "A virtually identical ruling came down in January, at which point the US Supreme Court could have and should have acted on this question of partisan gerrymandering. Instead, the Supreme Court punted [and] sent this case back down for reconsideration. Now the [lower] court has reached the same conclusion it did in January."

The map in question was the one drawn up in 2016 after the state's previous GOP-drawn map, used in 2012 and 2014, was found to have been an unlawful racial gerrymander. So, Stern explains, the federal judges in North Carolina seem to have had enough and may now order new maps "on this incredibly compressed timetable where the election is looming" in just over 70 days, ballots need to go out to overseas voters 45 days in advance, and the state's primaries were already been held in May.

The unconstitutional maps have resulted in a wildly unbalanced 10 to 3 GOP majority in the state's Congressional delegations, despite North Carolina's status as a very divided swing state which narrowly elected Obama in 2008, Trump in 2016, and a Democrat to be its Governor in that same election. If the matter is appealed to SCOTUS by the state (as it almost certainly will be), the Supremes could deadlock 4 to 4, if Justice Kennedy's seat has yet to be filled, and the lower court ruling would stand. We could be in for a lot of chaos ahead (as if we need any more this year.)

Stern also explains the astonishing situation in West Virginia, where that state's Republican-majority House of Delegates recently impeached all four sitting members of the state's Supreme Court. (Its 5th member had already resigned after been charged with a felony crime.) The move, Stern reports, was timed in such a way to avoid allowing voters to replace the justices at the ballot box this year. That means the previously 3 to 2 Democratic-leaning court may soon become a 5 to 0 Republican court, and stay that way through 2020. Following impeachment trials of the justices in the state Senate, any vacancies will be filled by the appointments of Trump-loving Republican Gov. Jim Justice, a Democrat when he ran and won the Governor's race in 2016, but who flipped parties shortly thereafter.

"There are no good guys, per se, in this story," Stern notes. However, it serves as yet another example of Republicans blatantly hoping to pack the courts, and could prove to be another useful example that Democrats could cite in the future. If they ever re-take control of the U.S. House, Senate and White House, they'll be able to cite such moves when and if they decide to move to add seats to the U.S. Supreme Court in order to restore a majority that should have been theirs, until Senate Republicans stole a vacant seat in 2017 after holding it open for nearly a year following the early 2016 death of Justice Antonin Scalia.

Speaking of that stolen U.S. Supreme Court, Stern also offers his thoughts on whether Senate Democrats will be able to block --- or even stall --- the seating of Donald Trump's second nominee to the Court. Judge Brett Kavanaugh's Senate Judiciary Confirmation hearings are currently scheduled to begin next week and, Stern argues, "he owes an explanation as to why he thinks it's perfectly valid and legitimate and acceptable to be nominated by a racist and openly corrupted President to the Supreme Court."

Finally, we're joined by Desi Doyen for our latest Green News Report on, among other things, the record rainfall in Hawaii following Hurricane Lane over the weekend, and the complicated climate legacy of the late Republican U.S. Senator and former GOP Presidential nominee, John McCain.

On today's BradCast: The President is an extraordinarily accomplished liar, and real journalist should unambiguously report as much. And, oh, yeah, he doesn't give an actual damn about coal miners or their families, either. [Audio link to show follows below.]

First up today, following Donald Trump's wildly unhinged and indescribably embarassing campaign rally in Phoenix on Tuesday night, a few words on the unapologetic liar who has become President of the United States, and the responsibility that journalists have --- not just "commentators", but actual, hard news journalists --- to call him out as such.

Then, the UN calls out the United States with an "early warning" regarding the rise of racist demonstrations and the failure of "high-level politicians" --- wonder who they're referring to? --- "to unequivocally and unconditionally reject and condemn racist hate speech". And, a science envoy at the U.S. State Department publicly resigns following Trump's response to Charlottesville and the Administrations' ongoing War on Science.

Then, speaking of that "war", we're joined by West Virginia's own Bob Kincaid of the Coal River Mountain Watch, in response to the Interior Department's halt of a study by the National Academies of Sciences regarding the dangers of Mountain Top Removal coal mining to residents of West Virginia and Kentucky's Appalachian communities. Kincaid, co-founder of the Appalachian Communities Health Emergency Campaign (click the link to watch their :30 second video, and get more info about contacting your members of Congress!) is furious over what he describes as an attempt by the Administration and the coal industry to keep the well-established science linking Mountain Top Removal to cancer, death and birth defects from becoming widely known.

"It's not really mountain top removal," Kincaid tells me, explaining the process that is killing not only coal miners and their families, but their jobs as well. "It's mountain removal. You take vast amounts of...high explosives...and then you set it off. Huge clouds of dust then boil off the strip mine site and roll down into the hollers and into the valleys, and onto the places where people live, who then breathe it. Nothing in the human body can stop the dust. Because it's so fine, it's so tiny."

He goes on to explain how this has now been done "to over 500 mountains. They've buried over 2,500 miles of streams. That causes poisons to run into the water, etc., etc., etc. Over 2 dozens reports have shown that there are vastly elevated rates of cancer, birth defects, genitourinary diseases, pulmonary diseases, heart diseases, in areas where this dust falls."

And, he says, even though it was the state of West Virginia which requested the National Academies' study in the first place, the state's two U.S. Senators (Republican Shelly Moore-Capito and Democrat Joe Manchin), not to mention its Repub-turned-Dem-turned-Repub coal billionaire Governor Jim Justice, have been "as silent as a graven image," after the Interior Department halted this study of those "over 2 dozen" studies late last week. "It's sort of like 'Home on the Range', where never is heard a discouraging word, and the coal dust isn't toxic all day."

"You wind up getting this downright un-American suppression of science," tells me. "I'm not kidding. This isn't American! We used to follow science. It's not always been this way. This suppression is the kind of stuff they do in North Korea or the old Soviet Union."

Finally today, breaking news on yet another federal court ruling (it's either the 6th or the 8th, I can't even remember anymore!) finding the Texas GOP's Photo ID voting restriction intentionally discriminates against minority voters, and an all-electric Tesla SUV(!) smokes a half-million dollar Lamborghini in a record-setting drag race...

On today's BradCast, there's at least one place in the country where time seems to have stopped and Donald Trump remains wildly popular. But that place isn't Washington D.C. right now. [Audio link to full show follows below.]

Some Republicans in the U.S. Senate are finally beginning to separate themselves from the historically unpopular President Trump and his similarly unpopular agenda. They've even taken steps to try and keep Trump from removing Attorney General Jeff Sessions and hiring someone willing to fire Special Counsel Robert Mueller over the August Senate recess and thereafter.

With Trump's approval ratings plummeting, even in Rightwing polls that Trump used to favorably cite (as recently as June), GOPers like Arizona's Senator Jeff Flake, whose own approval rating is now even lower than Trump's, are now hoping to distance themselves from the President, in Flake's case, even after recently voting with him to take health care away from tens of million of Americans.

But not everyone is cutting ties with Trump. In fact, West Virginia's wealthiest man --- and, not coincidentally, its newly-elected Governor and longtime coal baron --- Jim Justice, changed his party affiliation this week from Democratic to Republican. And he announced it at a Donald Trump campaign rally on Thursday night.

We're joined today by 9th generation West Virginian BOB KINCAID, host of Head-On Radio and President of Coal River Mountain Watch, to explain Justice's flip and why so many in the state still believe in Trump.

"Jim Justice earned his money the old fashioned way --- he inherited it," quips the always-colorful Kincaid, noting many more of the Governor's very Trump-like characteristics. Kincaid warned Democrats long ago about Justice, whose flip, he tells me, is "almost a killing stroke for the now-moribund West Virgina Democratic Party."

"Trump's approval ratings may be in the toilet in the rest of the country, but they're not in the toilet here --- this is still the Trumpiest place in the world."

We also discuss the surprising votes by both of WV's U.S. Senators (Republican Shelly Moore-Capito and Democrat Joe Manchin) during the Senate's recent attempt to repeal ObamaCare. ("Joe Manchin getting something right can be filed under 'even a blind hog finds an acorn now and then,'" the progressive Kincaid says. As to unseating him next year in a primary, he handicaps the odds, and details what would occur if it did, beginning with the phrase: "If pigs grew wings, and sheep were perched in trees, and leprechauns rode across the open plain on three-legged unicorns, and a progressive actually beat Joe Manchin in the primary...")
