Once again, on today's BradCast, we've got a mid-week "ketchup" for you, with everything you need to know about the disgraced former President's still-ongoing, first criminal trial. And it's been a very big week in that regard. [Audio link to full show follows this summary.]

But, first up today, interesting results out of Indiana on Tuesday, where the "zombie campaign" of Nikki Haley, who quit the race two months ago, still racked up nearly 22% of the vote in the Republican Presidential Primary against Donald Trump. (Joe Biden ran uncontested on the Democratic side.)

Next week's primaries will be in Nebraska, Maryland and West Virginia, where former coal baron and federally convicted criminal Don Blankenship --- a hard-right loon --- has decided to run in the Democratic primary to fill the U.S. Senate seat being vacated by rightwing Democrat Joe Manchin. Blankenship lost as the Republican nominee against Manchin in 2018. This year, as a "Democrat", he'll be running next week in WV against staunch pro-union candidate Glenn Elliot and Marine Corp vet and grassroots organizer Zach Shrewsbury. The winner will likely be taking on current Governor and coal baron billionaire Jim Justice who ran for Governor as a Democrat in 2016 before flipping to Republican in 2017 just after he was elected.

Then, it's on to today's coverage of the past week's criminal Trump Trial in New York, where the former (and future?) President faces 34 felony charges related to hush-money payments made to porn star Stormy Daniels to help him win the 2016 Presidential election. Daniels was called by the Prosecution for testimony on Tuesday and, as you likely know by now, it was a bit of a blockbuster.

We're joined today by our old friends HEATHER DIGBY PARTON, award-winning columnist at Salon and longtime blogger at Hullaballoo, and former attorney and former Republican KEITH BARBER, who now blogs on legal and Constitutional matters as "KeithDB" at the progressive Daily Kos website.

Among the topics of today's conversation...

  • Daniels' disturbing testimony about her disturbing, apparently "quasi-non-consensual" (as Barber describes it) sexual encounter with Trump during a celebrity golf event in Lake Tahoe and why specific details of that counter either are or are not important to the Prosecution's case. (Barber: "If Trump invites you to a dinner date, don't expect dinner.")
  • Why Trump's attorneys sought a mistrial on Tuesday, but were rejected by the trial judge.
  • How Team Trump's various over-ruled objections are likely working against them.
  • How the Defense is doing in its attempt, so far, to cross-examine Daniels. (Barber: Trump's team was "too ham-fisted" and "outsmarted by the adult industry star.") The cross continues on Thursday.
  • Why last week's testimony by former, longtime Trump aid Hope Hicks was so important to the State's case, and why she broke down in tears as the cross-examination began. (Parton: "A devastating blow to his defense.")
  • Why Monday's testimony from the Trump Organization's former Controller and its current chief of Accounts Payable was so important to the Prosecution's case.
  • How all of this is being reported (or not) by mainstream media and rightwing media (Parton: "Fox is not covering it. Neither is Newsmax or OAN.") and heard by voters in both cases.
  • Whether the lack, so far, of testimony describing Trump himself as ordering the falsification of business records is going to be a problem for the Prosecution, and whether upcoming testimony by Michael Cohen can fix that.
  • Whether Trump will be held in criminal contempt by the judge for the eleventh time and if he'll actually be given jail time for his next violation of the court's gag-order. (Parton: "Trump doesn't want to go to jail. They don't have hair and makeup people in there." Barber: "He doesn't want to go to jail, no matter how much he'll tell his stupid MAGA followers that he does.")

Special Coverage of panel's final public hearing; Also: Callers ring in...

Well, Merry Christmas from The U.S. House and The BradCast, Mr. Trump! [Audio link to full show follows this summary.]

In their finale hearing on Monday, the bipartisan House Select Committee investigating the former President's incitement of insurrection on January 6, 2021 and his multiple failed attempts to steal the 2020 Presidential election, voted unanimously to send criminal referrals for the former President on four different, very serious crimes to the U.S. Dept. of Justice.

Those criminal referrals include:

  • Obstruction of an official Proceeding. For corruptly attempt to block the peaceful transfer of power at the joint session of Congress on January 6, 2021.
  • Conspiracy to Defraud the United States. For his efforts to block Joe Biden's victory by lying about fraud, despite being told by all his top White House legal advisors and his own DoJ there was no evidence to support his false claims.
  • Conspiracy to Make a False Statement to Congress. For participating in the scheme to send phony certificates in support of fake Electors on January 6th.
  • Insurrection. For inciting, assisting, or giving aid or comfort to those attempting to overthrow the United States government.

If eventually indicted and found guilty of that final "very grave charge," as Committee member Rep. Jamie Raskin (D-MD) described it today, Trump would become ineligible to hold any future federal office.

In our Special Coverage of today's hearing, we step through extended clips highlighting the Committee's case, as presented and summarized on Monday, including additional information from new witnesses interviewed by the panel since their last public hearing in mid-September.

The meeting ended with the presentation of the Committee's final report (Introductory Summary: PDF, HTML) and their unanimous, 9 to 0 vote to send the unprecedented criminal referrals to the DoJ for the former President of the United States, one of his corrupt attorneys (John Eastman) and others.

Whether these referrals result in actual criminal indictments is, of course, a separate matter. But, as discussed today, they will at least force the DoJ to review the evidence of these serious crimes as collected by the Committee from hundreds of witnesses over the past two years.

We close today with a few callers ringing in on what (if anything) happens next, and if these referrals may finally result in real accountability for the unspeakably corrupt Donald John Trump...

Brad and Desi sure picked a fine day to take a day off! It's NICOLE SANDLER in today to guest host the BradCast, and it figures that this is when Donald Trump is diagnosed with Covid-19.

It was bound to happen sooner or later as the "commander-in-chief" has completely screwed up our nation's response to the deadly pandemic and has been downplaying every aspect of it to the public since it began. Although the White House and Trump himself both insist that he's doing fine, he was taken to Walter Reed Medical Center today, and reports say that he's completely freaked out by the diagnosis.

DAVID DAYEN is executive editor of the American Prospect magazine, and he joins to me to talk about what it all means. (Hint: we don't really know as nothing like this has ever happened before!)

We're now in a waiting mode... waiting to see if Trump's condition improves or worsens, whether or not there will be any more debates, and for whatever inconceivable event could possibly happen next. Perhaps an asteroid hurling toward us will crash into the Earth... or we'll see more and more irresponsible Republicans come down with the 'rona.

Here's a question for you in the same vein as "if a tree falls in a forest and there's no one around to hear it, does it make a sound?": If Donald Trump wasn't president and causing diversion after diversion to prevent us from focusing on how truly awful he really is, would the big news stories stop falling through the cracks? I ask because what should have been one of the biggest stories of the year is barely registering. BuzzFeed News released the first of many installments in a massive series of articles under the heading The FinCEN Files. It even has its own website.

Based on thousands of "suspicious activity reports" and other US government documents culled over by BuzzFeed reporters and the International Consortium of Investigative Journalists, it exposes the scope of global financial corruption, the banks who enable it, and the government agencies that have failed to stop it. BuzzFeed News senior investigative reporter JASON LEOPOLD joins me to talk about how this massive project came together and some of what they uncovered.

My guest is journalist ASAWIN SUEBSAENG of the Daily Beast, whose first book, Sinking in the Swamp: How Trump's Minions and Misfits Poisoned Washington is newly released and full of the kind of stories you'd expect from Donald Trump's White House.

Today is February 14. Yes, it's Valentines Day, but it's a sad day where I live. Two years ago today, a former student entered Marjory Stoneman Douglas High School in Parkland, Florida --- about 10 minutes from my home --- with an AK47, killing 17 people and seriously injuring another 17. And nothing has changed since.

And thirty years ago today, as the Voyager-1 was passing Neptune heading out of the solar system, it took the first picture of Earth from outer space. Carl Sagan wrote about it famous "Pale Blue Dot." Neil deGrasse Tyson read it, so we share it today to try to end the week on a positive note...

Trump Admin cutting nuclear reactor safety inspections, killing scientific analyses, hollowing out agencies from Interior to USDA, more; Also: Feds end Trump hush-money conspiracy probe, release damning docs...

On today's BradCast, we cover a number of disturbing new stories highlighting how Donald Trump's Administration --- while everyone is distracted by his is obnoxious, racist tweets and occasionally by his felonious criminal behavior --- is absolutely hollowing out the U.S. Government to the detriment of public safety and the cheers of industry special interests. Oh, and we cover some of his criminal behavior as well. [Audio link to show follows below.]

Among the stories covered on today's show...

  • The U.S. Nuclear Regulatory Commission is now cutting back on safety inspections for the nation's 90-plus nuclear reactors, along with legal notices that previously had to be given to the public regarding plant safety issues. The nuclear industry, facing stiff competition from cleaner, cheaper, safer renewable energy, is applauding the "cost cutting" (some would say safety cutting) measures. Public interest groups are very concerned;
  • Out in California, where, last October, Donald Trump issued an executive order to force more water to be released from the Sacramento-San Joaquin Delta in Northern California down to farmers in the state's agriculturally rich Central Valley after years of demands by the powerful agricultural industry, the administration has paused the process just days before what was to have been a legally mandated scientific analysis of potential harm to endangered species such as salmon and delta smelt. An investigative report from Northern California's KQED finds the administration is replacing biologists from two federal agencies, NOAA Fisheries and the U.S. Fish and Wildlife Service, who had spent months preparing a "biological opinion", as required by law, with a team of attorneys and so-called experts in policy and regulations from outside the state. Apparently, the Administration didn't like the findings by the actual government biologists, so have paused the process for two months to allow an entirely new analysis Bureau of Reclamation's water plan by hand-picked ringers;
  • At the same time that the Interior Department is undermining their own scientists on the California project, the Department's Bureau of Land Management is planning to move its headquarters from D.C. to Grand Junction, CO, along with hundreds of federal employees, including many senior managers, who will either be forced to move or retire. The planned hollowing out of the BLM comes with little public notice or explanation, and echoes a similar recent move by the U.S. Department of Agriculture which is forcing hundreds of the agency's top scientists to either pick up and move to a new headquarters in Kansas City, or be let go. Most of those USDA scientists are reportedly unwilling to uproot their lives and families to make the move. Similar processes, according to Washington Post, are said to have resulted in thousands of civil service jobs being cut at the Departments of Labor, Education, and Housing and Urban Development to name a few, as the Trump Administration continues to gut the U.S. Government (well, all but the Defense Department, where they have added jobs) at the expense of public safety and to the benefit of industrial profit motives;
  • Then, we move to some of those Trump crimes mentioned earlier. A federal judge in Manhattan ordered the release today of previously redacted files regarding Trump's illegal hush-money payoffs to two women with whom he is said to have had affairs before his election as President. The judge's order comes after federal prosecutors indicated they had suddenly ended investigations into the Trump Organization and Trump himself regarding the payoff scheme in the campaign finance felony conspiracy for which Trump's former lawyer Michael Cohen is now serving time in federal prison. Both Cohen and federal prosecutors, when Cohen pleaded guilty, had said the conspiracy was "directed" by Trump himself. The newly unredacted documents underscore Trump's involvement in the conspiracy both before and after his election, as well as those of others in his campaign, such as longtime Trump aid and then Communications Director Hope Hicks. Setting aside the entirely of the probe by Special Counsel Robert Mueller --- and the 10 or so instances of unlawful obstruction of justice detailed in his report --- this hush-money matter alone is more than enough to merit impeachment and removal from office (not to mention federal prosecution). At least it would be for any other President --- or if there were real leadership among Democrats in Congress;
  • Finally, Desi Doyen joins us for the latest Green News Report, as much of the country will be sweltering for days under the latest, dangerous, climate change-fueled heatwave, and with more on the Trump Administration's latest plans to hollow out protections against pollution and the ability for local authorities to have a say in the matter. You didn't need all of that forest land near you to be saved from clear cutting by the logging industry anyway, right?...

On today's BradCast, after what seems like a too-long absence, we're joined again today by Slate legal reporter MARK JOSEPH STERN for insight on the first batch of U.S. Supreme Court opinions issued at term's end this week. [Audio link to show follows below.]

But first today, mercifully brief coverage of Donald Trump's re-election campaign launch in Orlando, Florida on Tuesday night. While the rally followed the same tired pattern of pretty much all of the campaign rallies he's held non-stop since becoming President --- (Remember when the GOP and Fox 'News' used to complain that Obama was holding campaign rallies as President, rather than governing? That was darling.) --- the usual recitation of Trump lies and nonsense also included a fascinating reference to Republican opposition to "socialism" just one mere breath before Trump (falsely) touted GOP support for protecting much-beloved socialist programs such as Social Security and Medicare. The irony, no doubt, was lost on most of his brain-poisoned followers on hand or watching via the Fox "News" disinformation channel.

On Capitol Hill today, Democrats in the House Judiciary Committee finally heard testimony from a former Trump official in the aftermath of the damning Robert Mueller Special Counsel report. Longtime Trump aid Hope Hicks --- who worked with him before his campaign, during it, during the transition and in the White House --- cooperated with the Mueller probe and is cited within it as a witness about 180 times. She agreed to testify today, though only behind closed doors, with a transcript to be released later. However, White House and DoJ Attorneys were also on hand to continue what Committee member Rep. Ted Lieu (D-CA) described as "obstruction of justice in action". The lawyers issued objections to any and all questions related to Hicks' service with Trump as President, asserting "absolute immunity" from such questions. That is a newly invented "privilege" from the White House and DoJ which Lieu described as "not a thing. It doesn't exist." Lawmakers suggest the result will be court action to force Hicks' testimony on her time at the White House, now that she is a private citizen (who works for Fox "News"). Even House Speaker Nancy Pelosi, who is still opposed to opening an official impeachment inquiry, reportedly described the new White House offensive as "obstruction of justice", which --- in case she needs a reminder --- is one of the offenses included in the Articles of Impeachment for both Richard Nixon and Bill Clinton.

Also in D.C. today, the Trump Environmental Protection Agency, now headed by "former" coal industry lobbyist Andrew Wheeler, officially replaced President Obama's Clean Power Plan, meant to curb global warming greenhouse gas emissions from coal-fired power plants, with a new rule that makes the reduction of emissions optional for states. Even while coal plants have been shutting down across the country over the past two years in favor of cheaper, cleaner natural gas and renewable energy production, the Administration is implementing the new rule which, according to the EPA's own analysis, will result in thousands of unnecessary deaths per year. The new rule parallels a similar effort by the Trump Administration to roll back new mileage standards implemented by Obama with the cooperation of the auto industry, which the National Highway Traffic Safety Administration (NHTSA) says will save thousands of lives as well. So, yes, Trump is now purposely killing Americans and lying about it by claiming U.S. air and water has never been cleaner. That, according to actual findings from the Government, is also untrue, as pollution has increased over the past two years since Trump became President.

We're then joined by Slate's Stern for a review of this week's SCOTUS rulings and an explanation for some of the "strange bedfellow" partnerships found in several of them. Among the opinions discussed today...

  • A Supreme Court "punt if I've ever seen one," according to Stern, on a case involving yet another bigoted baker, this time in Portland, who refused to sell a wedding cake to a same-sex couple. The Justices sent that case back down to the lower court for review, though Stern suggests they are largely buying time before being forced to determine, once and for all, whether discrimination against LGBTQ people is Constitutional. "The Court can't duck this forever," says Stern;
  • The largely good news ruling of the week is for voters in Virginia, where a 5 to 4 majority opinion results in new, fairer, more competitive legislative districts in advance of the Commonwealth's statewide elections this November. The Justices held that the GOP-gerrymandered House of Delegates did not have standing to appeal new legislative maps implemented by lower courts to correct 11 districts found to have been unlawfully and unconstitutionally racially gerrymandered following the 2010 Census. Only the state's Attorney General, a Democrat, who initially challenged the ruling on behalf of the state but later declined to appeal the lower court's ultimate ruling, has such standing, the majority determined.

    But the majority opinion, written by Justice Ruth Bader Ginsburg was joined, unsurprisingly, by Justices Elana Kagan and Sonia Sotomayor, and much more surprisingly by Justices Clarence Thomas and Neil Gorsuch! Moreover, the minority dissent, penned by rightwing Justice Samuel Alito was also joined by the normally progressive Stephen Breyer. Stern offers an explanation for what appears to be very strange bedfellows on this opinion, and whether the ultimate outcome --- while very good news for Democrats who hope to take control of one or both chambers in the VA legislature this November --- will be good news or bad news for Democrats and Republicans in the future;

  • We then move to what Stern describes as "a tough but interesting case", for his explanation of the Court's affirmation of what has long been considered a loophole in the U.S. Constitution allowing an exception to its restriction on double-jeopardy cases. In fact, as the Court held in a 7-2 decision, virtually identical indictments may be brought against the same person, for the same crime, so long as they are brought in separate State and Federal jurisdictions, which are considered to be "separate sovereigns". On the minority in this case was another odd couple, Ginsberg and Gorsuch, while Thomas --- who previously decried the Double-Jeopardy Loophole by calling for a "fresh examination" of it --- chose not to vote for ending it when he had the opportunity. He did, however, take the opportunity to write a concurrence in the case, calling for reversing other long-held SCOTUS precedents, such as those which allow women the right to choose to have an abortion. "He used his opinion to launch into this crazy attack on precedent, that was clearly laying the groundwork for an attack on cases like Roe. vs. Wade" and marriage equality;
  • Finally, Stern offers some thoughts on the Court's expected opinion, due any day now, regarding the Administration's attempt to add a question on citizenship to the 2020 U.S. Census. That determination is still expected, despite evidence unearthed after oral argument that proves the Administration lied about their reasons for adding the question, which, according to the Census Bureau itself, will reduce participation. That, in turn, is expected to radically shift government funding and citizen voting power from Democrats and minorities toward white Republican jurisdictions. We discuss that bizarre matter --- and how SCOTUS can possibly rule on the case now, given the new evidence revealed from the hard drive of a now-deceased GOP gerrymandering expert following the Court's hearing months ago --- and a few of the other expected important decisions to come in the next two weeks before the Justices leave town for Summer vacation...

We've got some interesting follow-up on today's BradCast, following the disturbing story we broke on air earlier this week regarding the "master passwords" for North Carolina electronic voting systems --- and more --- found online, unprotected, and downloadable by anybody since at least early 2016, at the NC Board of Elections website. [Audio link to show is posted below.]

But first up, some quick news updates: A second U.S. House committee has now voted to hold Donald Trump's new Attorney General and fixer William Barr in contempt. The House Oversight Committee on Tuesday voted to recommend holding both Barr and Commerce Secretary Wilbur Ross in contempt for refusing to turn over subpoenaed documents regarding the lies told by both Commerce and DoJ about adding a question on citizenship to the 2020 U.S. Census. Ross previously claimed he was asked by DoJ to add the question to help better enforce the Voting Rights Act, but new documents from the hard drive of a recently deceased GOP gerrymandering operative reveal the real intent was to shift resources and Congressional districts to white Republican jurisdictions.

In other Constitutional Crisis news, Hope Hicks, Trump's former Communications Director and longtime aide --- before his run for office, during the campaign and transition, and while in the White House --- has reportedly agreed to testify before the House Judiciary Committee next week about her cooperation with Special Counsel Robert Mueller's two-year probe. Hicks was a key witness on a number of the criminal obstruction charges detailed in Mueller's report. She has agreed, however, to testify to Judiciary only behind closed doors next week, presuming the White House doesn't move to block her in some way.

In elections news, new Quinnipiac polling shows six of the current top contenders for the 2020 Democratic Presidential nomination --- Biden, Sanders, Harris, Warren, Buttigieg and Booker --- all handily defeating Donald Trump in a head-to-head match-up in NATIONAL polling, if the election were held today. That new poll and others out today still show Biden atop the pack in the primary contest, though slipping since he entered the race last month. Two new polls show Warren leaping into second place above Sanders since last week. We offer some thoughts and WARNINGS about all such polls today.

And then, some surprisingly good news for progressives in Virginia, where two criminal justice reformers ousted long time state prosecutors in elections on Tuesday.

Next, we're joined by Dr. WILLIAM BUSA of EQV Analytics, a Democratic campaign consulting and technology firm in North Carolina, though Busa is likely better known to many on the Internets as "DocDawg" from Daily Kos. Busa has been doing some excellent follow-up work on the startling recent disclosures by cyber risk researcher Chris Vickery, who explained on Monday's BradCast how he discovered "master passwords" for some of NC's electronic voting systems, and much more, on the state Board of Elections website last year. Hundreds of files and screenshots, he said, were all left vulnerable on the Internet, in a directory set as public, to anyone who felt like downloading them, at least since early 2016 in advance of that year's Presidential election and its stunning, razor-thin conclusion.

Busa, as a well known elections maven in NC, tells me he was contacted following Vickery's revelations this week by the SBOE's spokesperson with a vague explanation for the exposed files --- which were subsequently set to private after Vickery notified the Board about the vulnerability last year in advance of the 2018 mid-terms. But, as he documented at Daily Kos on Tuesday, the explanation by the Board's Public Information officer Pat Gannon only made the case "murkier". Gannon, according to an email he sent to Busa, claimed the files were old passwords that were no longer in use and that, in any event, they were encrypted when posted online. Busa studied the claims regarding encryption and finds them to be untrue based on evidence revealed by the unencrypted screenshot of the passwords posted by Vickery.

For his part, Vickery --- who previously told me he found evidence the passwords had been in other jurisdictions as well as the one county the state claims --- politely suggested that Gannon appears to be uninformed about the details of what was left online. "Both of these issues," Busa observes, "being told that they were encrypted when clearly they're not encrypted, being told they were posted in 2012 when pretty clearly they were posted in 2016 --- goes to the question of 'Are we being told what's going on?'"

Moreover, Busa hits on what he describes as "the most troubling part of this.". The larger question --- one that we've been trying to make clear since the night that Trump was supposedly elected: Nobody --- not the states, not Mueller, not the FBI, not the DHS --- nobody has done a forensic analysis of the computer voting and registration systems and tabulators used in 2016 to assure they were not manipulated in some way, despite the many claims made by the U.S. Intelligence Community and the Special Counsel's office that Russia attempted to interference with elections systems in as many as 21 states before the 2016 Presidential contest.

If "white-hat good guys like Vickery" were able to find these vulnerable files, surely black-hate bad guys could easily have done so as well. "If DHS didn't find those things, then DHS is not as good as Chris Vickery. And if it's not as good as Chris Vickery at finding the chinks in our armor, then it's certainly not as good as Russia's GRU is," notes Busa. So, why didn't the DHS --- which, the U.S. Government has claimed has taken unprecedented steps to work with states to help them protect our elections from vulnerabilities --- already find these files and notify the state about the serious breech long before Vickery did? Both Busa and I are still asking.

"With McConnell blocking any meaningful election cybersecurity legislation in the Senate, DHS's 'band-aid' approach to 'Well, we're going to consult with the boards of elections in the fifty states and give them some assistance, it really is just that --- a band-aid. It doesn't give me any confidence whatsoever, especially now with what we've seen from the Vickery information."

Also today, since we've been covering so much GOP corruption in NC of late, (Busa quips: "North Carolina has become such an embarrassment that South Carolina is considering changing its name to 'North Georgia'), the NC elections expert and campaign consult rings in with helpful insight on the crucial, upcoming, SCOTUS opinion expected anytime now regarding unlawful GOP partisan gerrymandering of the state's U.S. House districts ("we have very little voice in North Carolina today because of those gerrymanders"); two upcoming U.S. House Special Elections in the state (one in NC-03 to replace the late GOP Rep. Walter Jones and the other to fill the NC-09 seat, which is still vacant following last year's GOP Absentee Ballot Fraud scandal that left the state BOE unwilling to certify results last November); and an important project Busa developed last year at NCGoVote.org called "Reg Watch", to automatically notify voters if their registrations have been changed or deleted for some reason. It would be very nice to see that project scaled up to all 50 states if possible! We discuss...

Northam calls special session in VA; GOP's 'Mexican standoff'; Hicks' nix fix; 2020 Dems seek climate solutions, Admin offers 'freedom gas'...

As usual, on today's BradCast, everything you need to know --- whether you want to know it or not --- in 57 minutes or less...or your money back! [Audio link to full show follows below.]

  • First up today, Virginia's Democratic Governor Ralph Northam announces a plan to convene a special session of the state legislature this summer to respond to last Friday's massacre at a municipal building in Virginia Beach which killed twelve people. Republicans, who have long controlled both chambers of the gerrymandered state legislature, have nixed a panoply of popular gun safety measures year after year in subcommittees, such as measures to place limits on extended magazines like the type used in Friday's shooting, barring the purchase of more than one hand-gun per month, and background checks for all gun sales. Northam says he is asking for "votes and laws, not thoughts and prayers" from state lawmakers just months before the entire General Assembly will be on the ballot for the Commonwealth's November 2019 off-year elections;
  • The GOP establishment appears to be pushing back hard today against Donald Trump's promised new tariffs on all goods imported from Mexico, which Sen. John Kennedy (R-LA) recently predicted Trump won't actually implement. "He 's been known to play with fire, but not live hand-grenades," Kennedy opined regarding a new 25% tax that Americans would have to pay on all products from Mexico under the President's promised new scheme to, somehow, stop immigration across the southern border. Even members of his own Administration, however, don't appear to understand how Trump's proposed trade war would lead to an end of migration. But, in London today, Trump said it would be "foolish" to try and stop his plan to declare another "national emergency" to unilaterally impose the tariffs. Republicans are indicating they may have enough votes to override a Presidential veto. (We'll believe it when we see it.);
  • Meanwhile, our Constitutional Crisis continues, as the White House has now instructed former White House Communications Director Hope Hicks and former White House Counsel Chief of Staff Annie Donaldson to defy a Congressional subpoena for documents by claiming Executive Privilege over materials that have already been shared with Special Counsel Robert Mueller (and thus, have already had Privilege waived). With the persistent drumbeat calling for an official impeachment inquiry growing louder each day against the scofflaw President while the White House fights "all of the subpoenas" as per Trump's instructions, Democrats are preparing a number of votes in a number of Committees to hold current and former Administration members in contempt. In addition to possible votes of contempt in a number of committees, Dems have votes scheduled next week for the full House to declare both Attorney General William Barr and former White House Counsel Don McGahn in contempt;
  • In 2020 Presidential election news today, Joe Biden released a 22-page, $5 trillion climate plan that includes $1.7 trillion in federal spending over the next ten years, to be paid for by reversing the GOP's 2017 $1.5 trillion tax cut and ending subsidies for fossil fuel companies. We share Biden's introductory video for the plan, which vows to create millions of jobs and protect the retirement and pensions of fossil fuel industry workers. And we compare it to those of other 2020 candidates, including Elizabeth Warren who released her own "aggressive" $2 trillion plan to take on our climate crisis today as well. Biden's new proposal to make America carbon neutral by 2050 is receiving mostly high marks from environmentalists and comes in the wake of a much-derided recently reported comment from a campaign spokesperson claiming that the former Vice President was seeking a "middle ground" on climate that might be joined by Republicans. Climate hawks and supporters of Rep. Alexandria Ocasio-Cortez' Green New Deal resolution characterized Biden's new proposal as an encouraging response to activism and pushback from their ranks;
  • Finally, Desi Doyen joins us for our latest Green News Report, with news of Republican obstructionism finally giving way to a long-awaited $19 billion disaster relief package in Congress, the Trump Administration's newest scam to try and suppress climate science, Colorado's new plan to go big on renewable energy, and....yes...the Administration's promise of "freedom gas" for the world!...

On today's BradCast: We begin with some very brief good news today on a new automatic voter pre-registration scheme for 16 and 17-year olds in California, as signed into law by the Governor on Wednesday. That, before diving headlong into the deep dark heart of Donald Trump's seemingly, very quickly imploding White House. [Audio link to show is posted below.]

The spate of jaw-dropping news over the past 48 hours, all pointing in one direction, is remarkable, even by the standards of this particular White House. Following on Wednesday's shock news that Trump's third Communications Director, Hope Hicks is resigning, there has been much speculation as to why she is leaving. As one of Trump's closest personal confidantes and most trusted advisors --- and among the last of the original team that's been with Trump since he announced his candidacy in 2015 --- some are reporting that the 29-year old former model quit after being berated by Trump for admitting to a Congressional committee the day prior that she was required to lie on his behalf. Other reporting suggests she could be facing legal jeopardy after finding herself at the center of Special Counsel Robert Mueller's investigation into obstruction of justice by the President.

Hicks was also described as Trump's "last emotional crutch", which does not bode well for where this White House may now be heading.

At the same time, a number of blockbuster stories have broken in recent days regarding Trump's son-in-law and senior advisor Jared Kushner, whose family real estate business has long faced financial woes. Kushner's interim top secret security level clearance was recently downgraded after his FBI background check failed to clear him for permanent security clearance, a number of foreign countries were reported to have been intercepted discussing how to manipulate him based on his financial problems, two major money lenders reportedly gave his family company huge refinancing loans shortly after meetings with him in the White House, and our guest today, MARCY WHEELER, believes that Mueller could be working toward charges against Kushner for "conspiracy against the United States."

Wheeler, a longtime national security journalist at Emptywheel, detailed the reasons why Mueller may now be closing in on Kushner in a New York Times op-ed yesterday. She joins us today to explain those possibilities --- centered, in part, on his various foreign entanglements and multiple failures to properly disclose them --- on today's show.

"We've been talking about 'collusion' since before the election," Wheeler says. "Collusion is not a crime. It is a shiny object used by Trump to be able to deny something over and over again. He was never going to be indicted for it, because collusion is not a crime. He will or could, however, be an un-indicted co-conspirator in a conspiracy." And, in the broad conspiracy that Mueller seems to be documenting through his indictments to date, she argues, Kushner may well find himself indicted as one of those conspirators.

We also discuss whether and how Trump can possibly survive the apparent ongoing implosion, with Hicks soon gone and Kushner now believed to be in serious jeopardy. "Trump is losing people he trusts. And eventually he's going to be sitting there alone in the White House watching 25 screens, all of them playing Fox and Friends, and tweeting angrily in response," Wheeler tells me. "At some point, the White House becomes so hollowed out it starts collapsing, and I feel like we're pretty close to that."

Finally today, after our discussion of Hicks' departure and Kushner's tightening noose, CNN breaks a new story reporting that the FBI is said to be eyeing financial questions surrounding business dealings by Kushner's wife Ivanka Trump, the President's daughter, close advisor, and one of the only other still-standing "originals" left, along with Hicks and Kushner, in the Administration...

On today's BradCast: Just days away from Donald Trump's artificial deadline to end Obama-era protections from deportation for hundreds of thousands of immigrants brought here as children, the attendees at last weekend's CPAC can't even come to terms with documented facts on the benefits of immigration, even when delivered to them by one of their own. [Audio link to full show is posted below.]

But, first up today, some quick news headlines of note...

  • Another top White House official, Trump's 29-year old Communications Director Hope Hicks (his third since taking office), says she's resigning, and offered a ridiculous reason for it, just one day after admitting to the U.S. House Intelligence Committee that she has been required to lie on behalf of Trump.
  • Tuesday was another Special Election day in several states --- including New Hampshire, Connecticut, Kentucky and Arizona --- and we have the reported results after still more state legislative seats in Republican districts were flipped from 'red' to 'blue' by Democrats. (And as Republicans appear to have mostly avoided another huge embarrassment in Arizona.)
  • The federal judge who Trump attacked during the campaign for allegedly opposing his border wall, as the court case for Trump's fraudulent 'Trump University' played out, decides in favor of the Administration scheme to waive environmental laws to build that wall with Mexico.

Then, we're joined by immigration policy analyst DAVID BIER of the libertarian Cato Institute, following his recent appearance at the Conservative Political Action Conference (CPAC) --- where his presentation of independently verifiable facts and data detailing how immigration is actually good for the country --- was met with derision and heckles from the audience and fellow panelists alike.

Setting our many political differences aside for purposes of this discussion, Bier offers some of that data on today's show, in hopes that we can, at least, agree on facts if we are ever to find a legislative solution to protect "Dreamers" and turn back the new Trump/GOP efforts to restrict even legal immigration to our country. Among those derided and heckled facts Bier presented at CPAC: "I talked about how some conservative outlets really like to focus on immigrant crime. But we know from the U.S. Census bureau that immigrants --- including illegal immigrants --- are about half as likely to be incarcerated in the United States for serious crime than U.S.-born adults. So they're really focusing on the exceptions to the rule. Something else that I cited is the National Academies of Sciences 2016 report on the fiscal costs of immigration, that found that the average recent immigrant will pay at least $92,000 more in taxes than they receive in benefits from the government over their lifetime."

He went on to debunk a number of other myths offered by right-wing outlets, such as on English-language comprehension and assimilation of new immigrants and the claim (even made by the host of the panel) that Democrats favor immigration because they want millions of new voters. He also detailed how new immigration is needed to help support Social Security and Medicare for many of the aging baby-boomers who were, no doubt, among the many attendees at CPAC.

Bier told me about the reaction to his remarks at the only immigration-related panel on the weekend's agenda at the annual far-right Republican gathering, how that response may have differed from previous years, and why it is that he believes attendees are so terrified of independently verifiable facts on immigration's many benefits for all Americans --- economically, politically and culturally.

He even managed to offer a fairly impressive response to my skepticism to his claim that "the data is the thing that’s going to win people over." Despite appearances from this President and his administration, he argues, immigration advocates are winning. "You and I and everyone who favors legal immigration and legalizing long-term residents of the United States, we're winning that argument. The public supports our position overwhelmingly. It's never been higher in terms of support for legalization, support for a pathway to citizenship for Dreamers, support for not restricting legal immigration. We're winning all of those things."

"It's sort of their last stand before the end," he asserts, by way of explaining the confused and fearful anti-immigrant CPAC attendees. "If Democrats do take over, I fully expect immigration reform will happen. And that will be the moment where they realize they lost the argument."

Finally, as Marjory Stoneman Douglas High School reopened on Wednesday, two weeks after a 19-year old with a legally purchased semi-automatic rifle killed 17 and injured a dozen others in a matter of minutes, the debate over what to do about it still rages. Today, amid Donald Trump's argument for arming teachers, the "top teacher" of 2012 at a Georgia high school outside of Atlanta fired a pistol in his classroom, sending students into a justifiable panic. And, one of the nation's largest sporting goods outlets announced that it would no longer sell military-style semi-automatic rifles and planned to raise the age requirement for all gun and ammo purchases at their stores to 21...
