With unspeakable devastation from Florida to Ukraine, the stakes couldn't be higher for our upcoming midterm elections. We cover all of that on today's BradCast, even while tending to some long overdue accountability and grotesque conflicts of interest in Congress. The horrifying death toll from last week's climate change-fueled Hurricane Ian continues to rise. More than 100 were confirmed dead in Florida alone as of airtime. That number is likely to keep growing, along with the growing questions about why state officials did not call for evacuations before they finally did. Put those questions into the same file that may explain the state's years of climate crisis denial and its now collapsing insurance industry.

At the same time, corrupt authoritarian regimes elsewhere are similarly ill-serving their citizens. We get caught up a bit today on Russia's sham referendums and unlawful annexation of four regions in eastern Ukraine last week. That, as Russia's military offensive continues to collapse and lose ground to Ukrainians defending their sovereign homeland; as Vladimir Putin faces growing unrest after announcing the forced draft of hundreds of thousands of Russians; and as he continues to threaten the use of nuclear weapons as his political and military fortunes devolve.

Then, we move to Brazil, where far-right President Jair Bolsonaro lost in the first round of voting on Sunday to the nation's former leftist President known to the people simply as "Lula". While Lula defeated Bolsonaro over the weekend, neither candidate received the votes necessary to avoid a run-off later this month. Lula's victory was much narrower than expected based on pre-election polling showing that he was likely to defeat Bolsonaro by about 14 points. He won by just less than 6 points in what should serve as another object lesson for U.S. voters before our own critical midterm elections in just 35 days.

Next, we're joined by longtime government affairs and ethics lobbyist CRAIG HOLMAN of Public Citizen to discuss the Combatting Financial Conflicts of Interest Act that he had hoped to see passed in the House before next month's midterms. Holman helped shepherd passage of 2012's STOCK Act. It was hoped that the decade old measure --- requiring immediate disclosure of stock trades by members of Congress and ending their exemption from insider trading laws --- would shame members into avoid conflicts of interest when trading stocks in companies which they also oversaw in Congressional committees.

As Holman details today, the STOCK Act failed in that regard for several reasons. As a New York Times analysis found last month, at least 97 members of the House and Senate, of both parties, continue to hold stocks in companies that they oversee on Congressional committees. But it is hoped that the new measure will end that as well. It would bar members and their direct family (spouses and children) from buying and selling stocks at all, and require them to divest their portfolio entirely or place such assets into blind trusts.

"Prior to the STOCK Act in 2012," Holman explains, "insider trading was illegal for you and I and Martha Stewart, but it was perfectly legal for members of Congress. And they were making use of it. There was one economist who came out with a study that showed members of Congress enjoy a 12% higher rate of return than the rest of us on the stock market. Which means either they're geniuses at trading in the stock market, or they know something that we don't know. Quite obviously, it's the latter."

While the STOCK Act did reduce members' trading in stocks by about two-thirds, he says, the other third "are still out there trading. They are sitting on the same committees and in their same official capacities overlooking the same businesses that they're buying and selling stocks in."

The new bill, however, would finally end those bipartisan conflicts of interest, and/or the appearance of same, once and for all. But, Holman also explains how the bill he had hoped to see passed by both chambers before this year's midterms was derailed last week He tells us whodunnit and how he hopes to see the measure adopted nonetheless in the lame duck session after the elections. Here's hoping!

Does Holman have any concerns that this new law would prevent qualified folks from running for Congress in the first place? "Not on my end," he responds. "That is one argument that you always run into. But, quite frankly, if you've got a huge financial conflict of interest with your official duties of serving in Congress, I don't want you here. If you're not going to get rid of that conflict of interest, you pose more of a threat to the integrity of our legislative process, no matter how competent you are."

Finally, President Biden visited Puerto Rico on Monday in the wake of the devastation of Hurricane Fiona (the storm that took out power across the island, yet again, just two weeks before Ian's devastation in Florida). He didn't throw paper towels at residents, as the former guy did following Hurricane Maria, though he did vow to help get their infrastructure back up and hardened to withstand many more of these storms that will be coming their way as the climate crisis worsens. We share some of Biden's remarks today...

Our long national nightmare may be over in about 28 days...but it ain't over yet. Not by a long shot. And, as detailed on today's BradCast, it's becoming more unnerving by the second, with Donald Trump's mental health seemingly devolving rapidly with each and every one. [Audio link to show is posted below.]

Curiously, corporate media are sounding more and more like The BradCast with each passing day. Among the stories underscoring that point as Trump's days in the White House continue to wane (whether he is able to admit that out-loud or not)...

• CNN's Stephen Collinson on Trump's "30-day reign of destruction on the way out of office";

• "Trump turns on everyone," reports Jonathan Swan at Axios. "Everyone" now appears to include "Vice President Pence, chief of staff Mark Meadows, White House counsel Pat Cipollone, Secretary of State Pompeo and Senate Majority Leader Mitch McConnell." (With a hat-tip to Lincoln Project, for their video getting inside Trump's head regarding Pence);

• Pentagon Correspondent Barbara Starr reports anxiety is rising at DoD, with one officer telling her "We don't know what he might do" in these final days. They were particularly alarmed after talk from disgraced and pardoned former National Security Advisor, Lt. General Michael Flynn's call for Trump to invoke Martial Law and order the military to "re-run" the election in some states that Trump lost. The military, according to Starr, wants nothing to do with any of it. We hope her reporting is accurate;

• Amid all of this, Trump unleashed another wave of Presidential pardons for his friends and the friends of his friends on Tuesday night. This time for 4 war criminals charged with murder for carrying out a massacre of Iraqi civilians while employees for Blackwater, the mercenary company owned by Eric Prince (brother of Trump's Education Secretary, Betsy DeVos); 3 corrupt, felonious Republican former Congressmembers (including the first two members of Congress to endorse him, Chris Collins of NY and Duncan Hunter, Jr. of CA); and 2 Campaign staffers who plead guilty to felonies tied to the Robert Mueller Special Counsel probe into Russian interference during the 2016 election. (And, after getting off air tonight, Trump has issued still more pardons for still more of his friends, including for his former campaign manager Paul Manafort, former campaign advisor Roger Stone, and for Charles Kushner, father of his son-in-law Jared, all convicted of multiple felonies);

• But wait, there's more. Much more! During an unhinged, pre-taped White House video posted to Twitter last night, Trump threatened to veto the $900 billion COVID relief bill attached to the government's must-pass annual spending bill to avoid shutting down again. The long-overdue emergency relief was finally passed by Congress after eight months of Trump refusing to participate in negotiations. He's now pretending to be upset that stimulus checks to be sent to many Americans will only be $600. Congressional Republicans and White House negotiators insisted it could be more no more than that. But Trump now suggests he may veto the measure unless payments are increased to $2000. Dems, who had been trying to increase the amount of payments for months immediately joined Trump's call. Congressional Republicans (and the two incumbent Republican Senators running in the January 5th runoffs) are apparently furious, confused, and not sure how to fulfill the demands of their Frankenstein's monster;

• And, just before airtime, Trump vetoed another long-negotiated must-pass bill, the $790 billion Military Authorization spending bill which was enacted last week by veto-proof majorities in both houses of Congress;

• That's only a taste of what, according to the Washington Post today, has now "plunged" the GOP "into open warfare over President elect Joe Biden's election victory --- with President Trump taunting Senate Majority Leader Mitch McConnell and threatening primary challenges against other Republicans, House lawmakers egging on senators to contest the counting of electoral college votes next month, and senior GOP senators rebuffing that effort as a pointless political exercise";

• All of which, as the New York Times reports today, has resulted in Trump at the "most unleashed...and...most unpredictable point in his presidency," while he is desperately "focused on the one area in which he is powerless to get what he wants: a way to avoid leaving office as a loser";

With that nightmarish backdrop, our guest today, HEATHER DIGBY PARTON of Salon and Hullabaloo joins us to explain why Trump's final days are "more frightening than Nixon's" as he "seems to be having a very public nervous breakdown."

"We knew he wasn't going to act like a normal President and be gracious and have Biden over coffee. I didn't expect that," she tells me. "But this? He's so incredibly afraid of being called a loser that he's turned himself into the greatest sore loser in world history!"

"He's clearly melting down," she adds. "As far as I am concerned, when you have a President who is melting down, who has this capacity to launch a nuclear war, we're in a very dangerous situation."

She also has a number of thoughts on where this all goes "beyond Trump," after the (theoretically) inevitable Inauguration of Joe Biden, if we manage to get there. "The rationalization of these people. The brain-poisoning...The absolutely servile Republican Party that has completely abdicated all responsibility," observes Parton. "He is the Republican party. They are part of it, if they choose to be. But there is no Republican Establishment. There's only him."

This, she cautions, is "Trump's last stand," before adding ominously: "At least, we think it is."

We've tried to touch base with Parton at many of the landmark moments throughout the nightmarish Trump Presidency (and candidacy --- she was also with us the day he descended the gilded escalator at Trump Tower to announce his run for office in 2015.) So, with all of this madness swirling and our long national nightmare before Christmas continuing, it seems like today was another perfect moment to check in with her for our last interview before standing down for the holidays. On today's BradCast: The Election Administrator's (and Election Integrity journalist's) Prayer was decidedly not answered on Tuesday, based on reported results in at least two key races, and problems in the four states (Kansas, Missouri, Michigan and Washington) which held midterm primaries and the one (Ohio) which held the final major U.S. House Special Election of the year. [Audio link to complete show is posted below.]

But, first up today, Republican Congressman Chris Collins of New York, the first sitting member of Congress to endorse Donald Trump's candidacy, was indicted Wednesday morning, along with his son and the father of his son's fiancee, for an insider trading scheme, after he had tipped off his son to failed testing for a multiple sclerosis treatment by an Australian company in which Collins was the top shareholder and a member of its board. According to the indictment by the Trump-appointed U.S. Attorney in Manhattan, it sure looks like they've caught Collins red-handed. Though he vows to fight the charges and remain on the ballot this November, his once-safe seat is now believed to be in danger.

Then, onto yesterday's Election Day and the very long night that followed.

In the OH-12 special election, Democrat Danny O'Connor trails Republican Troy Balderson by about 1,700 votes out of some 200,000 cast, mostly on 100% unverifiable touch-screen systems across seven Ohio counties. About 3,500 uncounted provisional and late vote-by-mail ballots could change the outcome in the days ahead, or at least lead to a state-mandated "recount" in the district that, for decades --- until Tuesday --- had been solidly "red". In 2016, Trump carried the district by 11 points and the now-resigned House GOP incumbent had carried it by 36 points. That has clearly changed with a virtual dead heat contest on Tuesday, leading to growing confidence in a "blue wave" this November by many Democrats and, yes, a "RED WAVE" in the same crucial midterms, as predicted today by Donald Trump.

In Detroit, where voters cast hand-marked paper ballots, they were able to continue voting even during power outages at more than a dozen polling places on Tuesday, following storms the night before. We have results from MICHIGAN's closely-watched Gubernatorial primaries and the somewhat bizarre, two separate Democratic primary races (one normal, one special) to fill the U.S. House seat left vacant last year by Rep. John Conyers resignation. State Dems will now host an historic, all-female slate at the top of the ticket for Governor, U.S. Senator, Attorney General and Sec. of State, and Rashida Tlaib will become the first Muslim woman in Congress.

In KANSAS, $10 million wasted on new, unverifiable touch-screen voting systems didn't help voters as some of the brand new ES&S ExpressVote ballot marking devices failed to work at all on Tuesday morning, and electronic tabulation grounded to a halt all together in Johnson County, the state's most populous, due to a problem that remains unclear at this hour. All of it resulted in another "too close to call" race today, in the GOP's gubernatorial primary between current Gov. Jeff Colyer and the controversial Trump-endorsed Sec. of State Kris Kobach. He leads, according to unverifiable touch-screen results finally reported on Wednesday morning, by just 191 votes(!) out of some 300,000 cast. A "recount" (overseen by Kobach himself) almost certainly awaits, as do future failures on the ExpressVote systems which produce unverifiable barcoded "paper trails" instead of hand-marked paper ballots. Sadly, the same systems are also being adopted by many other jurisdictions around the country as well.

In MISSOURI, a few Republicans came up with a novel new way to stop voters from voting. But that didn't deter the state which voted for Trump by double digits in 2016 from soundly rejecting a GOP anti-union (so-called "Right-to-Work") measure by a 2 to 1 margin. And, in St. Louis County, in a triumph of democracy, Bill McCulloch, the 7-term Democratic prosecutor who failed to bring charges in the 2014 police killing of Ferguson's Michael Brown, was defeated by Wesley Bell, one of the African-American leaders of the 2014 protests there. Bell had become a City Council member in Ferguson in 2015 and he will now be St. Louis County's Prosecuting Attorney.

And finally today, in WASHINGTON state, results of several U.S. House primaries suggest incumbent Republicans previously thought to be in safe "red" districts --- including Cathy McMorris Rodgers, the highest ranking female in Congress --- may not be quite as safe in this November's midterms as they had thought...
