Welp, Election 2022 continues into its second week of counting on today's BradCast. But it's our first chance to open up the phones to listeners after last week's historic midterm face-plant by Republicans and its associated very very good news for Democrats and American democracy itself. [Audio link to full show follows this summary.]

Before we go to the phones today, a bit of a monster "rant" on the accomplishments of Joe Biden and the Democrats after two years in office; a few updates on races called since we signed off last Friday; what they all mean; and some of the races still being tallied (which will also determine, among other things, which party controls the House of Representatives next year.)

The big races called since our final show last week include the U.S. Senate contests in Arizona and Nevada, both of which went to the incumbent Democrats in each state (Sen. Mark Kelly in AZ and Sen. Catherine Cortez Masto in NV). Those victories ensure majority control for Democrats in the upper chamber of Congress once again in January. Dems will have at least a 50/50 majority with Vice President Kamala Harris as the tie vote, even before the December 6 Senate runoff in Georgia between incumbent Sen. Raphael Warnock (D) and Herschel Walker (R).

But there are a ton of reasons for Democrats in GA to not let down their guard. Dante Atkins, over the weekend, detailed just some of the reasons why a 51-49 Senate is much better for Dems (and democracy) than a 50-50 Senate.

While Dems were celebrating retaining their Senate majority over the weekend, we were celebrating the fact that the last of the 2020 Election liars running for Secretary of State in battleground states were declared to have lost. In AZ, Democrat Adrian Fontes will become the new Sec. of State after defeating Trump-endorsed insurrection enthusiast and voting opponent Mark Finchem. And in NV, Democrat Cisco Aguilar was declared the winner over Trump-backed election liar Jim Marchant, founder of the "America First Secretaries of State coalition," featuring all of those Republican SoS candidates who, thankfully, were rejected by voters in last week's elections across the country in every single swing-state in which they ran. That alone will make the 2024 Presidential election indescribably safer.

Throughout the program, we also take care to call out a few of the folks from the Republican Party, the corporate media, and the even some on the lazy, knee-jerk far-left who ignored the available data and facts in order to misinform American voters that the GOP see a red wave, or even red tsunami, in last week's midterms. They didn't. They lost a seat in the Senate; will be lucky to win the narrowest of majorities in the House; lost Governorships in Maryland and Massachusetts (and, perhaps, Arizona, which is still close); took full control of both the Michigan and Minnesota state governments and may do the same in New Hampshire and Pennsylvania, just to detail a few of the GOP's remarkable failures in a year that Conventional Wisdom suggests they should have owned the night.

Also, mid-hour today, we get an update in the tallies of the very right Los Angeles Mayoral race where progressive Rep. Karen Bass just got a big boost from the latest numbers in her contest against "former" Republican billionaire real estate developer Rick Caruso.

Then, we turn to the phones for the first time since last week's midterms to get some thoughts from listeners on what the lack of "red wave" means for both Democrats and Republicans and whether any of it will help break the GOP's Trump Fever that is destroying both them and our democracy along with it (though not this week, at least!)...

On today's BradCast: It's no surprise that Fox 'News' deluded itself for months and even years about a "red wave" or "tsunami" coming for the 2022 midterm elections. It shouldn't be a surprise that the theoretically legitimate media got it wrong as well, given that they seem to make the same errors election after election. And yet, it's both surprising and disappointing, given that the data to counter their erroneous narrative was right there in front of their face the whole time...if they simply bothered to, or had the courage to, listen to it. [Audio link to full show follows this summary.]

"There was nothing magical about what I did," our guest today, TOM BONIER of the Democratic data research firm, TargetSmart, explains. "It was, as you say, seeing the numbers and reporting the numbers and, in the end, trying to stay away from predictions or projections, but to say, 'Look, this is what we're seeing'."

Bonier's well-documented Twitter threads on the data over the past many months spelled out what shouldn't have been a surprise to anyone. In the face of extremism from the right and, in particular, the Supreme Court, there was a backlash against Republicans which served to boost Democrats across the board.

Prior to today, Bonier joined us twice in recent months to discuss his analysis of data and what he was seeing and tweeting about to anyone who might have wanted to listen. In late August, after voters in deep red Kansas decisively rejected a ballot initiative that would have rewritten the state constitution to allow abortion to be banned, he joined us to explain what he saw as a "jaw-dropping" spike in new voter registrations for young, Democratic women following the Supreme Court's Dobbs decision in late June, overturning Roe v. Wade. Bonier saw similar spikes in new registrations all over the map, in "red" and "blue" states alike, but particularly where reproductive rights were most threatened.

In late September he joined us again after analyzing specific voter data from that failed Kansas referendum. Hard evidence of an incredible spike in women voters that, he told us at the time, "just doesn't happen in elections." He posited that any suggestion that Democrats would be swamped in November, as the so-called Conventional Wisdom offered by pundits would have it, was simply ignoring the available data. He argued the election would be very close and almost certainly not a "wave" for the GOP.

He was right. Even though, over the past month in the run-up to Election Day, the corporate media were, largely in lock step, warning that Dems were done for, soon to be swamped by a red wave or even tsunami! How much of that erroneous punditry "blunted" the final results, Bonier laments, citing races like Mandela Barnes' in Wisconsin, where the Democratic candidate for U.S. Senate fell just shy of unseating incumbent Republican Ron Johnson by a single point.

"I like to think of myself as an optimist, but it was difficult over the last few weeks and months," he tells me. "In reality, what we do at TargetSmart is we listen to the data. That's all we were doing. Along the way I was looking at the voter registration data, looking at the early vote data, looking at it in the context of the polls and trying to draw some conclusions. But mostly providing context and questioning the hard-set assumptions that were really leading everyone."

We discuss, among other things, the "flood of Republican polling" in the last few weeks of the campaign and how it warped forecasts from poll aggregation sites like FiveThirtyEight, and how his fellow traveler, Simon Rosenberg, who also had it right, was "mocked" when he highlighted how forecasts were being swamped by those bad GOP polls.

By itself, the media failure "doesn't happen. It took some level of complicit behavior from those who should be guards against it," Bonier insists. "People are mocking Fox News at this point. We know it is a very biased Republican media platform. But the bottom line is most of cable and these other outlets had a level of certainty about this outcome in a very similar way. I have to say, as I spoke with reporters in the closing weeks, I would be telling them 'Look, this is going to be a close election. I don't see a Republican wave. I don't see that in the numbers.' And I was just short of mocked by reporters."

But, why? Is it a lack of courage to stray from the pack journalism and group think? Or, as media critic Dan Froomkin argued today, a symptom of systemic "rot" in the political media? Bonier offers his frank thoughts on that and much more as we dig deep in today's discussion. I strongly urge you to tune in for it in full.

Also today, in addition to our own mocking of Fox "News", we've got plenty left over to mock folks like HBO's Bill Maher and Spotify's Joe Rogan and CNN's Fareed Zakaria and NYTimes' Maggie Haberman who all got it wrong as well --- and misled the American electorate in the bargain --- for many of the reasons discussed on today's program. And, we've also got the latest reported results out of still uncalled critical races for U.S. Senate, Governor, Sec. of State and Attorney General in Arizona and Nevada...

On today's BradCast: If the Republican Party wins a narrow majority in the U.S. House following this week's nowhere-near-a-red-wave midterm elections, will it have been because of gerrymandering? Our guest today explains why the answer to that question is unequivocal. [Audio link to full show is posted below.]

First up, however, a few observations on how Fox "News" uses its smartphone app to insidiously further brain-poison followers with rightwing propaganda and disinformation. Today's example: How very encouraging news from the federal government on the economy, with signs that inflation may be easing, sent the stock market soaring. But for duped users of the Fox "News" app, it became just more terrible news about the economy injected straight into their brains.

Next, we get caught up on the latest reported results from the ongoing tabulation of very tight Senate (and Gubernatorial) races in Arizona and Nevada, which, along with the critical December 6th U.S. Senate runoff election in Georgia will determine control of the upper chamber of Congress for the next two years.

Also, an update on the vote counting in Colorado's 3rd Congressional District where far-right Rep. Lauren Boebert --- listed in the New York Times' "Republicans expected to win easily" column this year --- has regained a razor-thin 0.38% lead over Democratic challenger Adam Frisch. That, after she was losing by just 64 votes overnight out of more than 300,000 counted.

In all of those states --- Arizona, Nevada and Colorado --- Democratic advocates are suggesting confidence that remaining untallied votes will secure victories for their candidates in most of those races, including those in which tallies show them trailing at the moment or just barely ahead. I'm dubious about some of those claims, but we'll see if they're right and which of the races end up in recounts as the grueling battles for narrow control of both chambers of Congress continues.

When it comes to the House, however, given the limp performance by Republicans on Tuesday, it's become clear that if they regain a majority there, it will only be due to gaming the electorate through both extreme partisan and racial gerrymandering...with the help of corrupt courts at both the state and federal level.

We're joined once again today by redistricting expert and author DAVID DALEY, a Senior Fellow at FairVote. In an article on this today at The Nation he describes how aggressive --- and frequently unlawful and unconstitutional --- gerrymandering by GOP legislatures in several "red" states following the 2020 Census, in concert with corrupt rulings from the U.S. Supreme Court and several state high courts, is to be credited for what most currently see as a likely, if very narrow, GOP takeover of the U.S. House. He calls it a "rigged House majority.'

"Republicans really won the redistricting wars," Daley tells me today. "Their partisan and racial gerrymanders won them more than enough seats to make up the difference between the two parties in what was essentially a jump ball election. By having gerrymandered maps in Florida, Ohio, Texas, Georgia; by having courts put a thumb on the scales for them in Alabama, Wisconsin, Louisiana and elsewhere; and by having blue state courts not allow Democrats to engage in the same kind of anti-democratic behavior, Republicans were able to take enough seats to take the House."

He explains: "Once you start adding up all of the states that Republicans claimed either through extreme partisan gerrymandering, and what the federal courts and the state courts gifted them; when you take the four seats in Florida, a couple seats in Ohio, a couple in Texas, in Tennessee, and Wisconsin; when you take the seats that Republicans bulldozed or hijacked from independent commissions in Arizona and Iowa, you're looking at somewhere between 12 and 14 seats --- which, I think, will probably end up being something close to twice what the ultimate majority in the House ends up being."

We're just over one week from the most critical midterm elections in these United States since the Civil War. So, we've got a lot to discuss on today's BradCast. And the phones are finally fixed at KPFK, so we were actually able to hear from callers today as well! [Audio link to full show is posted below this summary.]

Among the stories covered on today's program before listeners ring...

  • Why it really matters: A few thoughts on why, exactly, these elections are so critical, in all 50 states, for the future of American democracy itself; why you need to vote in whatever state you live in by Tuesday; and why, depending on how it all goes, this could be the last democratic election in this country. An overstatement? I don't think so in the least. But tune in for much more on all of that and for listner calls from folks who may or may not agree with me.
  • If they can do it in Brazil: Great news! The far-right, Donald Trump-supported autocrat Jair Bolsonaro was deposed in a runoff election on Sunday to Brazil's former leftist President, Luiz Inácio Lula da Silva, popularly known as "Lula". The race was closer than polls had predicted, but it was the first time since the nation became democratized in the 1980s that an incumbent President went down to defeat. That is good for workers, that is good for the planet (given Bolsonaro's destruction of the Amazon rainforest), and, as Lula said up winning, good for democracy itself. "This isn’t a victory of mine or the Workers’ Party, nor the parties that supported me in the campaign," said the once and future President. "It's the victory of a democratic movement that formed above political parties, personal interests and ideologies so that democracy came out victorious."
  • After all that: New polling out today from New York Times and Siena College finds four key U.S. Senate races are still polling pretty much where they were several weeks ago, despite recent breathless corporate media reports that Dem support was tanking and a "red" wave was forming. Perhaps it is, but that's not what today's new polling suggests. The Democratic Senate candidates in Arizona, Pennsylvania and Georgia all still lead their Republican opponents, if by slim margins, and the race in Nevada is said to be a dead heat. At least, if you believe pre-election polling. (And I wouldn't, if I were you.) It's all likely to be very close. All of it. Everywhere. Please get out and vote, as they did in Brazil...for democracy.
  • Another assassination attempt on the Speaker of the House: We were off on Friday, so didn't get to ring in on it, but we've learned more over the weekend about the attacker who, echoing January 6, 2021 insurrectionists, was hunting for Nancy Pelosi as he hoped to use zip ties to restrain her 82-year old husband Paul last Friday morning at their house in San Francisco. The attacker ended up cracking Paul Pelosi's skull with a hammer before he was tackled by police. By way of contrast with the "outrage" expressed for weeks by Republicans at peaceful protests outside the homes of corrupt Supreme Court Justices several months ago, many of those same GOPers made jokes over the weekend about the attack on the Pelosis by a man who appears to have been a supporter of QAnon conspiracies and far-right commentators and who believed Trump's lie that the 2020 Presidential election was stolen from him. Critical lessons (and warnings) from primary results in AZ, KS, MI, MO, WA, OH; Also: IN Rep. Walorski killed in crash; A farewell to Vin Scully...

Look at the faces in that photo. Those are the faces of people grappling to understand a profound truth that they simply had no idea about prior to Tuesday night. Those faces should serve as inspiration for every Democrat and/or progressive on the ballot in every race in all 50 states between today and November 8. And as a warning for every Republican.

On today's BradCast, selective, noteworthy, curated results --- or what is known about them, unofficial, incomplete or otherwise --- from Tuesday's primary elections in six states, Arizona, Kansas, Michigan, Missouri, Washington and Ohio. (And several problems for voters in Pinal County, AZ.) [Audio link to full show is posted below this summary.]

Of course, the biggest news from Tuesday, hands down, was the stunning landslide rejection of a state constitutional amendment in Kansas that would have allowed the state's Republicans to restrict and/or ban abortion rights. (That's what the folks in that photo were just learning about.) It was the first statewide vote on the matter anywhere in the nation since the newly extremist, far-right, radical, activist, corrupt, Republican U.S. Supreme Court majority overturned 50-years of Constitutionally protected rights and freedoms by striking down 1973's Roe v. Wade decision.

Even in the theoretically "conservative" state of KS, voters soundly rejected that proposed Amendment with their "NO" votes by a stunning 18 points over "YES" as of airtime. The "NO" vote did well in large and small, rural and urban, Democratic and Republican counties alike. Turnout, thanks to this measure --- in a midterm primary where Republicans assumed few would notice --- was enormous and at levels normally seen in Presidential primaries or even mid-term general elections in the recent past.

The question now is whether Democrats will finally have the confidence and courage to run on this issue, following the overturning of Roe in June, in every state in the country and for virtually every office on the ballot from Governor to Attorney General to District Attorney to County Sheriff to state Judge to state Supreme Court Justice. And, whether Democrats will be able to capitalize on Josh Marshall's "Roe and Reform" campaign that he's been pushing hard at Talking Points Memo, calling for a very specific promise to voters from Democrats on the federal level: Let us hold our House majority and give us two more seats in the Senate and we vow, come January 2023, to reform the Senate filibuster to codify the protections of Roe into federal law, guaranteeing privacy rights and reproductive freedom in all 50 states.

Nothing short of that very specific "You give us that, we'll give you this" promise will do, as Josh has smartly been explaining for weeks now. We have long argued ourselves that candidates must give voters something very clear and specific to vote for. When they do, as proven on Tuesday in Kansas --- where the stakes were crystal clear, and voters knew exactly what they would get from their one single vote --- they will respond in large numbers.

Of course, all of this also further underscores the argument I've been making for months that Democrats and progressives must ignore the "conventional wisdom" from so-called political professionals about the historical odds of impending doom this November. These are decidedly UNconventional times, proven once again in KS yesterday.

Beyond that very encouraging news on Tuesday, there was still more good news in both the Secretary of State and Attorney General races in KS; Somewhat disappointing news in the MO race to fill the U.S. Senate seat being vacated by retiring Republican Sen. Roy Blunt; Potentially concerning news out of MI's Republican gubernatorial contest, where a well funded, Trump-backed loon will run against the state's popular Democratic Governor; And wildly troubling news out of AZ on the Republican side in the contests for the Gubernatorial and Sec. of State nominations, in what could turn out to be two of the most critical races in the nation this November.

All of that and many other races covered and explained, with context, on today's busy show.

Finally, we close with some tragic news on the death this afternoon of Indiana's 58-year old Republican Congresswoman Jackie Walorski and two of her young staffers in an automobile accident. And, some pleasant thoughts following the passing on Tuesday night of Hall of Fame broadcasting legend Vin Scully at age 94. He served as the inimitable and nationally recognized voice of Dodger baseball --- in both Brooklyn and Los Angeles --- for 67 incomparable years...

Controversial partisan hand-count in Maricopa County also found 2020 margin increased for Dem over Repub in U.S. Senate race; Plus: GOP Senate now threatening to force unprecedented default on U.S. debt...

Now, even the Cyber Ninjas agree that Donald Trump lost, and by more than originally thought. The full, final, long-awaited report is set to be released on Friday in three different "volumes" in which they hope to bury the lede. But we've got the breaking skinny, exclusively reported for you on today's BradCast. [Audio link to full show is posted below this summary.]

According to a months-long, so-called "forensic audit" and hand-count of more than 2.1 million ballots in Maricopa County (Phoenix), Arizona from the 2020 election, not only did Joe Biden defeat Trump, as previously reported by the County and the state, the private partisan company hired by the GOP state Senate to carry out the exercise, found that Biden actually received more votes over Trump than originally reported.

Information obtained just minutes before airtime today, reveals that the months-long "audit" by the far-right, partisan, conspiracy-promoting Florida company named Cyber Ninjas, headed up by CEO Doug Logan, determined that Biden's vote total in the state's most populous county was actually larger, by about 100 votes, than the certified numbers, while Trump's total decreased by more than 200.

The certified results in Arizona determined that Biden defeated Trump by about 10,000 votes statewide, and by some 45,000 votes in Maricopa.

The Ninjas' "clown show" hand-count was paid for partially with Arizona taxpayer dollars, along with millions in private donations raised from duped Trump supporters who believed his claims that the election was somehow rigged in the state with the help of Dominion's voting and tabulation computers. The post-election review was carried out largely without public or media oversight, but it found numbers remarkably similar to those initially tallied by the County's Dominion tabulators, as previously reported by Maricopa County and certified by the state.

Similarly, the Ninjas' hand-count of the U.S. Senate race between Democrat Mark Kelly and then Republican Senator Martha McSally --- the only other statewide race won by Democrats last year --- found an increase in the margin of the Democrat over the Republican. In the Senate contest, both candidates lost a small number of votes compared to the County's certified computer tally, according to the numbers the Ninjas are set to report publicly on Friday. While Kelly lost fewer than 100 votes in the private hand-count, McSally lost more than 500.

The final report, scheduled for its long-awaited release tomorrow, will include three different volumes. Volume I is said to include the Ninjas' "Executive Summary & Recommendations". Their recommendations, as we have learned, are fairly standard recommendations for ways to improve local procedures, similar to recommendation often made by actual longtime Election Integrity advocates in previous elections in both Arizona and other states. The second volume of the report details "Operations and Methodology" claimed to have been used by the Ninjas. And the third, by far the largest and most detailed, is titled "Results Details".

It is not until the third volume of the report that the Ninjas finally get around to detailing the actual results of their hand-counts as compared to the County's tally. They almost precisely confirm the originally reported official results of both the 2020 Presidential and Senatorial races in Maricopa County. There still may be some changes made to the report before the final version is released on Friday.

I suspect we'll have more details on all of this in the coming days, since today's program began just minutes after we obtained a large amount of the data, which we work through on air.

What is clear, however, is that Republicans who were told that the election in Arizona was somehow manipulated, were lied to. From our review of the Ninja's information, there remains zero evidence of fraud that might have altered the ultimate results in either the county or the state. Nonetheless, based on the theatrical performance put on by the Ninjas beginning in April and continuing over the past five months, Republicans in states across the country are now planning similar, taxpayer funded exercises to review the results of the 2020 election. They may be as disappointed as the Ninjas and those who gave them their money.

If the Arizona findings are echoed elsewhere, the Republican Party is on the verge of wasting a whole lot more taxpayer money, along with millions in private donations that their "forensic audit" proponents are currently raising to fund those similar investigations.

Beyond that on today's program, we cover, in some detail, the Congressional GOP's dangerous threat to force a default on the good faith and credit of the U.S. Government. Senate Republicans are currently vowing to block an increase in the nation's allowable statutory debt limit before the U.S. runs out of borrowing power to cover bills for stuff approved by Congress (both Republicans and Democrats) long ago. That, as Republicans in the Senate also threaten to force a full government shutdown as the new fiscal year begins on October 1.

We've got a lot of detail on that shameful, reckless and under-reported mess today, as Republicans, once again, hold a nation hostage to their demands...even if, this time, they don't seem to actually be making any. They appear to simply be causing havoc and potentially costing the U.S. economy trillions, simply because they can.

CORRECTION 9/23/2021: In the article above, I initially misidentified Cyber Ninjas' CEO Doug Logan as Doug Jones, who, unlike Logan, is an actual voting system and cybersecurity expert. Another Doug Jones is the former Senator from Alabama. Also, while going through the just obtained information live on air, I misspoke at one point to say there were some 4 million ballots cast in Maricopa. In fact, as I noted elsewhere during the show, there were 2.1 million ballots cast in the County last November. I had misread, on the fly, some of the data showing 2.x million votes tabulated by the County originally and 2.x million tabulated by the Ninjas. I read that on the fly on air as 4 million votes total (incorrectly seeing those numbers as one row for Trump and the other for Biden, when they actually were for each of the two different tallies.) My apologies for both errors!

Among the stories, many of them still breaking as we went to air, covered on today's program...

  • High-rise condominium building collapses in South Florida near Miami Beach. As of air-time, 1 person was announced as dead and 99 others currently unaccounted for, as rescuers continue to comb through the deadly rubble searching for survivors.
  • President Biden declared "we have a deal" on an infrastructure package. It's a $1.2 trillion bipartisan "compromise" deal in the U.S. Senate on his proposed $2.25 trillion American Jobs Plan. That proposal is one part of his infrastructure plan for things like roads, bridges, the electrical grid, and broadband Internet. The other part of his two-part proposal is the $1.8 trillion American Families Plan, which includes the "human infrastructure" part of the package, focused on childcare, education and healthcare. While Biden lauded the "compromise" struck among Republicans and conservative Democrats in the Senate, House Speaker Pelosi promised she would not bring up the compromise proposal for a vote in the House until the other part of the package --- the American Families Plan and, presumably, whatever is being left out of the "compromise" bill --- is passed with a simple majority vote in the Senate under Budget Reconciliation rules which allow lawmakers to avoid the anti-democratic Senate filibuster rule. "Make sure you understand this," the Speaker vowed during her presser today, "there ain't gonna be no bipartisan bill unless we are going to have the Reconciliation bill."
  • Pelosi, who has seen her fair share of Republicans reneging on deals at the last minute, also announced that she intends to create a House Committee to investigate the deadly, Trump-incited attack on the U.S. Capitol on January 6th. That, after House Dems had struck a deal with Republicans earlier this year for a bi-partisan, evenly divided, independent Commission, only to see Republican leadership, after the deal was already struck, go on to vote against the bill in the House and kill it entirely with the filibuster in the Senate.
  • Speaking of the filibuster, which would need to be reformed if Democrats hope to pass their sweeping elections, voting rights and campaign finance reform bill known as the For the People Act through the Senate, three moderate Senate Democrats (Mark Kelley of Arizona, Michael Bennett of Colorado, and Catherine Cortez-Masto of NV) spoke to the need to do exactly that during a private conference call this week. The audio, obtained by the Colorado Newsline, reveals each moderate Dem discussing the need to reform the filibuster and suggesting that intra-caucus negotiations are well underway to try and figure out how to do exactly that.
  • In New York, an appeals court has accepted the recommendation of a state committee of attorneys to immediately suspend Rudy Giuliani's license to practice law, citing "uncontroverted evidence” that he “communicated demonstrably false and misleading statements to courts, lawmakers and the public at large in his capacity as lawyer for former President Donald J. Trump and the Trump campaign in connection with Trump’s failed effort at reelection in 2020." That conduct, the court agreed, "immediately threatens the public interest and warrants interim suspension from the practice of law." While the disgraced former U.S. Attorney and NYC Mayor will be allowed to argue against the suspension in an upcoming hearing, experts believe the action today, however, is likely to lead to permanent disbarment. "The seriousness of respondent's uncontroverted misconduct cannot be overstated," the court wrote [PDF]. "This country is being torn apart by continued attacks on the legitimacy of the 2020 election and of our current president, Joseph R. Biden." That, after Giuliani spent months on behalf of Trump, following the November election offering one false claim after another to one state legislative committee after another, pretending to cite evidence that the election was stolen from the disgraced former President.
  • Those unsubstantiated and false claims, at least in Michigan, were devastatingly rebutted and debunked on Wednesday, by a Republican state Senate committee on Wednesday. In their unsparing 35-page point-by-point report [PDF], the lawmakers absolutely eviscerate Giuliani's, Trump's, Sidney Powell's, Jovan Pulitizer's and all of the other GOP grifters and con-artist's evidence-free claims about "voter fraud" and theft by computer voting and tabulation systems. Every Republican on the state's Senate Oversight Committee signed on to the brutal report, compiled over the past eight months, and responding to each and every phony claim suggesting systematic fraud in the state. The Committee found no basis for any of the wild accusations and even calls for a legal investigation and potential prosecution by the state's Attorney General for "those who have been utilizing misleading and false information...to raise money or publicity for their own ends." Ouch.
  • Finally, Desi Doyen joins us for our latest Green News Report with, well, not much good news today. The worsening drought in the West is now threatening drinking water; The Siberian Arctic(!) is facing a record heatwave, with temperatures topping out above 110 (in the Arctic!); A new report finds climate change is making heat waves hotter; And a whole bunch of other news that I don't have the heart to share with you here...

On her historic, nation-changing legacy and the unspeakable GOP hypocrisy over her replacement; Also: Callers ring in on what Dems must do next and on expanding the stolen SCOTUS...

On today's BradCast: I suspect you know what we'll be covering. [Audio link to show follows below.]

But, briefly today, before we get to the titanic battle over what may happen in the next 43 days before Election Day, we begin with a few words of warning from Desi Doyen on the latest incoming Hurricanes/Tropical Storms. In the most immediate case, Tropical Storm Beta (so named because we've run out of alphabetical names in this record, climate change-fueled storm season), is set to make landfall near flood-prone Houston on Monday night before a very slow and dangerously wet roll up the Gulf Coast toward New Orleans.

But every tragedy and disaster steps on another one these days (even as our COVID-19 disaster has now resulted in at least 200,000 Americans dead, and a Trump Administration that has politicized the CDC so much that once world-respected federal agency removed its warning that the coronavirus is airborne from its website today, with little explanation.) Despite all of that, we are forced to move in short order to the story of the day --- and perhaps of the next 43 days or more --- the death of U.S. Supreme Court Justice Ruth Bader Ginsberg from metastatic pancreatic cancer, as announced on Friday evening.

We discuss her extraordinary historic legacy both on the Court and before she became a federal jurist 40 years ago, all too briefly today, as the fight over filling her vacant seat began within seconds of her death being announced late last week. Nearly as quickly, Republican Senate Majority Leader Mitch McConnell vowed to hold a vote in the Senate on Donald Trump's nominee this year --- either before or after Election Day --- despite spending a full year in 2016 disingenuously claiming that "the American people should have a voice in the selection of their next Supreme Court Justice" after Justice Antonin Scalia's death in February of 2016. Back then, Obama nominated centrist jurist Merrick Garland a full 237 days before the Presidential election, while McConnell --- holding fast to his dishonest line that the "vacancy should not filled until we have a new President" --- refused to even hold a hearing on the nomination, much less an up or down vote on the Senate floor.

But now, in this case, following the death of a Democratic appointee with a Republican now in the White House, just 46 days before the 2020 Presidential election, McConnell and most of his Republican caucus in the Senate appear ready to move ahead with their rank hypocrisy at lightning speed. That includes Sen. Judiciary Chair Lindsey Graham, who repeatedly said over the years since 2016 that he would never support seating a new SCOTUS Justice during a Presidential year --- and that we should remember his comments and hold him to them, if the need ever arises. Nonetheless, with the death of RBG on Friday, the unmatched world-class hypocrite Graham declared the very next day, on Saturday, that he would indeed "support" Donald Trump "in any effort to move forward regarding the recent vacancy created by the passing of Justice Ginsburg."

It appears it will now be up to the voters of South Carolina to hold Graham accountable. According to the latest polling in the state, he is said to be tied in a tough re-election challenge this year against Democratic U.S. Senate nominee Jaime Harrison.

So far, just two Republican Senators have gone on record to say they would not support a vote to replace Ginsburg before this year's election (does that mean they'd support it afterward, even if Biden wins? Unknown at the moment.) Those two are Sen. Lisa Murkowski of Alaska and Sen. Susan Collins of Maine. Collins is also facing a tough reelection battle in her own home state this year against Democrat Sara Gideon. While there are boatloads of Republican Senators who previously vowed they'd not support the seating of a new Justice in 2020, it remains to be seen which, if any, will be able to avoid an appalling, Lindsey Graham-like flip-flop. As of now, just two more Republican Senators would have to dig deep enough to find the courage and intellectual honesty to do the right thing in order to stop any appointment until after the next President is determined by the American people.

There are a number of other possible factors that may come in to play in the days ahead. For example, the potential election of Democratic nominee Mark Kelly over Sen. Martha McSally in Arizona on November 3rd, in what is actually a Special Election in that contest, could result in Kelly's seating in November, instead of January with the new Congress. If that came to pass, it could mean that just one more Republican vote could stop this charade. There is also the possibility that Democrats could file another impeachment (or two) in the U.S. House to force a trial in the Senate to slow down the nomination battle over whoever Trump nominates to fill RBG's seat.

And, of course, no matter what happens, Democrats need to begin making plans to expand the number of seats on the stolen U.S. Supreme Court NO MATTER WHAT happens with the GOP's attempt to ram through another rightwinger to build on their ALREADY STOLEN Court majority.

And with that, we open the phone lines today for thoughts on RBG's legacy and, much more so, what Democrats should and/or must do now...

Isaias lands; Trump goes to 11; McSally and Graham in trouble; MORE...

DEATH & DESTRUCTION

  • The latest on the record-breaking Hurricane/Tropical Storm Isaias. It slammed ashore in the southern part of North Carolina as a Cat 1 on Monday night and has been ripping straight up the East Coast ever since, drenching state after state as well as knocking out power for millions and spawning punishing tornadoes in several states along the Eastern Seaboard on its way toward New England;
  • On Monday night, Donald Trump signed an Executive Memo to slash federal funding for the National Guard's response to the crisis. The Guard has been operating testing sites, distributing food and medical supplies and helping to expand hospitals across the country, but will now receive 25% less federal funding under Trump's new order in most states. In some states, however, such as Texas and Florida (key to Trump's reelection hopes) the deployed troops will still enjoy full federal through the end of the year;
  • A stunning interview with the President by Jonathan Swan of Axios on HBO --- that many are comparing to the satirical VEEP today or even the classic mockumentary This is Spinal Tap --- aired last night. We share one of the gobsmacking portions of the interview featuring Trump's embarrassing, grade school-like excuses regarding the continuing national rise in COVID-19 deaths. And then the short, classic scene from Spinal Tap that so many are aptly comparing it to today;
  • As the virus moves from major urban hot-spots into more rural (and less medically well-equipped) areas of the nation, The Prospect's David Dayen reminds us in his latest column that consolidation of hospital networks over the past decade has resulted in the closure of hospitals in many of those same, rural, under-served areas. 120 "unprofitable" hospitals in low-income communities have been shuttered since 2010, a crushing moral failure in the current American healthcare system that began long before Donald Trump came along to break it even more...along with everything else.

HOPE & CHANGE!

  • Sen. Martha McSally remains on track to be the first Republican to lose not one but two U.S. Senate seats to Democrats in Arizona. New polling shows her trailing substantially behind presumptive Democratic nominee Mark Kelly this November, even as state Republicans appear set on Tuesday to nominate the woman appointed to fill the seat of the late John McCain in 2019 instead of her GOP primary rival who polls better against Kelly. But Kelly's lead over McSally is tightening according to some recent surveys;
  • Senator Mitch McConnell in Kentucky and Tommy Tuberville in Alabama, according to new polling, both now enjoy double-digit leads against their Democratic opponents this November. That would be Amy McGrath in KY and Sen. Doug Jones in AL. But with McConnell's national approval ratings slipping as he fails to coalesce his GOP caucus in Congress around another round of desperately needed coronavirus emergency relief, anything could still happen;
  • And, speaking of how anything could happen, one of Trump's top acolytes in the U.S. Senate, Lindsey Graham, is now statistically tied with his Democratic challenger Jaime Harrison in South Carolina. Yes, in South Carolina! The incumbent Graham currently holds just a 1-point lead over Harrison in a new Morning Consult poll released on Tuesday. That is well within the poll's 4-point margin of error. Other recent polls give Graham a wider lead over Harrison, though not an insurmountable one, as the once long-shot Democratic challenger continues to out-raise Trump's toady in the Palmetto State.
