On today's BradCast we're hoping to help you get acclimated to the tsunami of "fraud" claims --- both real and fake, and what they mean and don't --- that are most likely about to come our way over the next few days and weeks...at least if Donald Trump loses to Kamala Harris in 2024 as he did to Joe Biden in 2020. Pardon us, however, for beginning with a brief victory lap following our L.A. Dodgers' big World Series win last night, and a related sidebar as to what history tells us (or doesn't) about who is going to win the Presidential election based on who won the World Series.

Then, as to the coming "fraud" storm...among the many stories cited along the way today...

• A Minnesota woman this week was charged with three felony counts of voter fraud after forging her dead mother's signature on an absentee ballot to vote for Donald Trump.

• Six people were charged over the summer for submitting nearly two dozen fraudulent absentee ballots on behalf of a Republican City Council candidate in New York. How they got away with it and how they got caught. The candidate's 19-year old daughter was among those charged.

• In the battleground state of Michigan, election officials in August indicted four voters who allegedly voted twice --- first by absentee and then again at the polls --- in the state's Presidential primary earlier this year. Once again, as in all of these cases, they were caught and charged thanks to safe-guards built into the system. Of the more than 11.7 million votes cast in the state over the past several elections, according to Michigan's State Auditor General, 99.99% of ballots cast were NOT from double voters.

• In Mesa County, Colorado this week, officials announced they blocked an effort in the very Republican-leaning county to cast about a dozen absentee ballots, apparently stolen out of mailboxes in the Vote-by-Mail state. The state's signature-matching procedures uncovered the fraud scheme, though three fraudulent ballots slipped through the system before the crime was discovered. Mesa is the same county where former County Clerk, Tina Peters, was earlier this month sentenced to 9 years in prison on felony charges related to helping her MAGA friends break into the County's voting systems in the middle of the night after the 2020 election to copy proprietary software and distribute it across the Internet to other Trump supporters.

• Last month we reported on the story out of Arizona where both the RNC and the state Republican Party went to court to argue against the removal of some 98,000 voters from the state voting rolls who, due to a years-old glitch in Maricopa County's voter database, had no record of presenting Proof of Citizenship with their registrations, as required by state law. In that case, Republicans opposed the systematic voter purge that the state's Democratic Sec. of State didn't want to do, but felt he had to under state law. The Republicans correctly argued to the AZ Supreme Court that such purges, within 90-days of an election, were in violation of federal law. They made that argument after the SoS revealed that the majority of the potentially "non-citizen" voters to be removed were registered Republicans.

  Yet, this week, on Wednesday in Virginia, after a U.S. District Court Judge and federal Appeals Court last week blocked an attempt by the state's Republican Governor to purge some 1,600 registered voters under the premise that some might be non-citizens, the corrupted Republican U.S. Supreme Court majority allowed the unlawful systematic purge, ordered by Gov. Glenn Youngkin, to move forward. All three Democratic-appointed SCOTUS Justices dissented. One of the purged Virginians, a U.S. citizen who has lived there her entire life, called it "a very bad October surprise."

All of these stories today help us understand the difference between real and fake fraud claims; the difference between voter fraud and election fraud; how easily most such penny-ante fraud is caught and often prevented before it happens; and how Republicans this year, from Donald Trump on down through his minions and back up through his corrupted SCOTUS, are hoping to use phony or exaggerated fraud claims to help sow the seeds to steal the election, if necessary, as of Tuesday night.

Get ready! Because that is coming --- if Harris is declared the winner.

Finally, Desi Doyen joins us for our latest Green News Report, with horrific "welcome to the future" news out of Spain this week, where extreme drought was followed up with a year's worth of rain and deadly flash flooding this week that swept through one town in a matter of hours, killing more than 150 so far; and some words of warning about Tuesday's election from Sen. Republican Ken Paxton, the ethically challenged Texas Attorney General, who paid nearly $300,000 in restitution to plea bargain his way out of a securities fraud indictment that had been pending since 2015, is vehemently opposed to the effort by state county election officials to encourage voter registration via the unsolicited mailing of voter registration forms to likely eligible voters.

Paxton's effort at voter suppression in two of the Lone Star State's most populous --- and Democratic-leaning --- counties, has now resulted in several lawsuits. A suit in state court filed by Paxton against Bexar County (San Antonio), and two filed in federal court, one each by Bexar and Travis (Austin) Counties charging the Attorney General is attempting to suppress the vote in violation of long-standing federal law...

We're all over the place on today's BradCast, as things seem to be speeding up exponentially as Election Day draws near. [Audio link to full show follows this summary.]

Among our stories today...

• On Wednesday, the Dept. of Justice filed an indictment against two members of the Russia's state media outlet known as RT for their part in a scheme that covertly paid some $10 million to rightwing media influencers to help spread Russian propaganda via an American-looking website media company based in Tennessee. Among the willing dupes or useful idiots, take your pick, who profited from the scheme to the tune of millions of dollars: popular rightwingers like Tim Pool, Benny Johnson and Dave Rubin (who actually used to call himself a "progressive" when we worked with him years ago at The Young Turks!) Their Kremlin-approved-and-encouraged lies about Russia and Ukraine and much more were spread far and wide from them to Elon Musk, Donald Trump and many others (including far too many on the Left!), in a far-reaching plot meant to cause division in the U.S. and disrupt our electoral system to the benefit of Trump. It was all helped along by those who are apparently all too willing to sell out the U.S. in exchange for power and/or money and/or just to be one of the cool anti-establishment rebel kids out there. We break it all down for ya today.

• Lifelong rock-ribbed Republican conservative, former top member of House GOP Leadership, and daughter of Dick, Liz Cheney announced her intention in North Carolina on Wednesday to do the right thing by voting for Kamala Harris this year. I say "right thing" because, for those Republicans who truly oppose Donald Trump, if they really want to help keep him out of power, the best way is to cast their vote for Harris, as opposed to feebly writing-in Ronald Reagan or some such cowardly measure that only ultimately serves to help Trump regain power.

• Aside from standing up for democracy, the rule of law, and the Constitution by voting for Harris, Cheney might also have noticed that Kamala Harris popular economic policies are more likely to grow the economy than Trump's various schemes. His poor economic showing during his term in office makes that clear enough. But, if you need further encouragement that Harris' policies will be better for the economy than Trump's moving forward, check out what the economists at that lefty, pinko outfit Goldman-Sachs had to say about it this week. Turns out, "Comrade Kamala" (as Trump absurdly likes to call her), is the worst communist ever!

• The U.S. House returns from its August break on Monday for a short session before breaking again for the election. But they've got another "fiscal cliff" ahead of them, with a government funding deadline at the end of this month. Apparently, Donald Trump is encouraging House Speaker Mike Johnson to threaten another shutdown before the election, unless Dems agree to adopt the SAVE Act, a bill that would require proof of citizenship when registering to vote, despite the fact that it is already unlawful for non-citizens to vote in federal elections (and ID is already required for all voters who register in all 50 states under federal law). But, sure, go for it, Mike! I'm sure it'll work out just fine for you guys.

• Pretending there is massive voter fraud being carried out by non-citizens appears to be the GOP's fake news claim of this election year (helped along by all of those folks getting sweet sweet Russian money to lie to that end, and those who choose to believe them). In North Carolina last week, the state and national Republican Party filed yet another lawsuit in hopes of popularizing that claim, despite the complete lack of evidence for it. In this suit, they are claiming that some 225,000 voters in the state's voter registration database did not supply a driver's license or social security number when they registered and, therefore, might be "illegal aliens" voting. They want them all to be removed from the rolls and forced to re-register, even though the election is now just weeks away and Mail-in voting begins this weekend in NC. But there are a few (a whole bunch, actually) problems with their claims and suggested remedy, as we explain on today's program. That said, Republicans know about those problems --- and don't care. They aren't filing these lawsuits to win them. They are filing them to help them try and steal the election, if necessary, next January 6th.

On today's BradCast: Democrats are appealing to voters with popular policies, while joyfully bringing down the rafters at the DNC in Chicago. Trump and Republicans, by contrast, are scheming to steal an election they sure seem like they are counting on losing at the ballot box. [Audio link to full show follows this summary.]

Among our coverage on today's program...

• Democrats are cleaning Donald Trump's clock of late on a number of quantifiable metrics: television ratings for their national convention, versus the GOP's last month; polling numbers; crowd sizes; fund raising; and volunteer get-out-the-vote efforts. As silly as it seems to compare some of those things between the two parties, it's more important than you may realize that we do so. Because Trump is now lying about all of them. It's part of laying the groundwork to use lies about all of those things in support of a post-election effort --- if he loses at the ballot box --- to claim it was stolen from him, "again". To then inject chaos into the certification of Electoral College votes in hopes of tossing the decision to state legislatures or the courts or, most likely, the U.S. House where Republicans are likely to control enough state delegations to install Trump into office, even if they don't hold a majority of seats in the chamber. Yeah, I realize it all sounds like conspiracy theory nonsense. But, we were told the same back in back in late 2020 and early 2021 when warning about what was likely to happen on January 6th. Plus, Trump and his allies are essentially explaining the ploy out loud each and every day at this point, as when Trump told supporters in North Carolina on Wednesday: "Our primary focus is not to get out the vote ... We have all the votes ya need."

• On Tuesday's show I detailed how Republicans were hoping that the corrupted, activist, rightwing U.S. Supreme Court majority, in an emergency ruling, would give them the okay to purge more than 40,000 voters from Arizona's rolls just weeks before early voting begins in the critical battleground state where Joe Biden won in 2020 by just over 10,000 votes. Today SCOTUS came back with their decision, which is mostly --- but not entirely --- good for the state's voters, blocking the worst of what the GOP had hoped to do. For now. We break down the, somewhat confusing (and poorly reported) details of their brief shadow docket ruling [PDF], along with the observation that Justices Thomas, Alito and Gorsuch would have overturned decades of precedent to allow all of the voter suppression Republicans sought. And that Republican Justice Amy Coney Barrett, interestingly, voted along with all of the Court's liberal Justices (who are all now women) to block the worst of the purging, and who would have blocked the GOP scheme in its entirety if it was up to the four of them.

• It was another rollicking, superstar-studded Day 3 at the Democratic National Convention in Chicago on Wednesday night, where Minnesota Governor Tim Walz formally accepted the party's nomination as Kamala Harris' Vice-Presidential running mate. He brought down the house in his joyful, pitch-perfect acceptance speech, becoming both America's Dad and America's Coach in the bargain. But not before folks like Oprah Winfrey shook the rafters and even joined a number of Republican heroes, like Georgia's former Lt. Gov. Geoff Duncan, who was there on Wednesday to reach out to undecided, independent and even Republican voters to help, as Walz put it, "turn the page" on the Trump era. We share extended excerpts today.

• Finally, Desi Doyen joins us for our latest Green News Report, as Democrats have woven issues of climate change and climate action into the very fabric of this week's DNC and, as she also reports, not a moment too soon...

The DNC kicked off with a mighty bang on Monday in Chicago, amid lively speeches from a joyful, rollicking cavalcade of Democratic Party superstars, both longtime and upcoming. Before we share a few of our favorite and/or most newsworthy moments today, however, we've got to focus on some "track condition" business for this November, rather than the horse race.

The Arizona Republican Party, now joined by the RNC, is asking the corrupted rightwing U.S. Supreme Court for expedited help in purging some 40,000 perfectly legal American voters from the rolls in the critical battleground state in advance of November's Presidential election. Early voting begins there in a matter of weeks, and ballots must be printed even sooner.

At issue is a fight that AZ Repubs have been waging --- and losing --- over and over again over the past two decades. But they're still trying, clearly hoping that the current, Trump-packed, rightwing activist SCOTUS may be more friendly to their pleas. When the state was almost fully controlled by Republicans back in 2004, they adopted a law to require "documentary proof of citizenship" for those newly registering to vote. That, even though some 13 million Americans do not have access to birth certificates, etc.

But the National Voter Registration Form --- created as part of the National Voter Registration Act of 1993 to make it easier to register to vote in all 50 states, particularly those with a history of suppression --- requires only an attestation to citizenship, rather than documents. Courts determined years ago that AZ's state law is preempted by the NVRA.

Despite the lack of any evidence of any non-citizens registering or voting in AZ, petulant Republicans in the state then instituted a two-track registration system after losing at SCOTUS in 2013. The new system would allow those who registered to vote with the federal form (without proof of citizenship) to vote only in federal races --- for President, for example --- but not in state or local contests.

In 2018, the state agreed to a consent decree that would allow those "federal only" voters to vote in all races where Arizona was able to determine the voters' citizenship status via their own records at the department of motor vehicles. But now, AZ Republicans are suing yet again, and are being joined by the RNC, to prevent those "federal only" voters --- more than 40,000 of them in the state --- from voting either for President or by mail. And they are asking SCOTUS to decide by this Thursday, given that ballots need to be printed shortly thereafter.

All of that idiocy in a state where Joe Biden won in 2020 by just over 10,000 votes and where Republicans (as in many states) would rather prevent (certain) people from voting, than actually offering popular policy ideas for them to vote in favor of.

Then, it's back to the horse race today --- or, at least the horses in the stable preparing for the race --- as we share a number of clips from Monday's rousing Day 1 of the Democratic National Convention in Chicago. There was a lot to choose from on the first night, but we share just a few of the highlights today, including Kamala Harris' surprise appearance on the evening's torch-passing from the current President; Reverend Sen. Rafael Warnock (D-GA) on taking care of our neighbors, including those in Gaza; Joe Biden's call to end Israel's war in Gaza once and for all; superstar Congresswoman Alexandria Ocasio-Cortez (D-NY) on Harris' support for the working class versus "two-bit union buster" Donald Trump; UAW President Shawn Fein bringing down the house again with his declaration that "Donald Trump is a scab!"; rising freshman superstar and former public defender Rep. Jasmine Crockett (D-TX) comparing resumes of the two Presidential candidates. ("She became a career prosecutor while he became a career criminal, with 34 felonies, two impeachment and one porn star to prove it."); Hillary Clinton blowing out the United Center with her impassioned recitation of the history of those women working toward finally breaking "the highest, hardest glass ceiling" of them all (amid unstoppable, if satisfying, chants of "LOCK HIM UP!"); and finally, Joe Biden's moving, heartfelt closing stem-winder, detailing an impossibly long list of accomplishments by the Biden-Harris Administration, and his vow to become the top volunteer for the Harris-Walz ticket...

And finally, as if that wasn't enough, Desi Doyen joins us for our latest Green News Report, as environmental groups line up to endorse the Harris-Walz ticket; another catastrophic flooding event unfurls, this time in Connecticut; and new evidence finding that climate change has dramatically exacerbated both the likelihood and severity of wildfires around the globe...

Tomorrow is a so-called "off-year" election in a number of states. But several of those elections may tell us quite a bit about the 2024 elections, and not necessarily in the way you may think, as reported on today's BradCast. [Audio link to full show follows this summary.]

Among today's stories...

• First up, some quickish news updates. Donald Trump took the stand on Monday in court in Manhattan for three and a half hours of contentious testimony in his losing battle to save his fraudulent company and his children's inheritance in New York State's $250 million fraud lawsuit against them for falsely inflating Trump Organization assets to the tune of $2.2 billion dollars each year from 2011 through 2021. He's already lost the case. Now the question is how much it will cost him (and his children.)

• Next, a few quick updates on Israel's relentless war against the people of Gaza following the Hamas attack against Israel on October 7, which killed at least 1,300. Now, more than 10,000 have reportedly been killed in response in Gaza, including more than 4,000 children. Calls for a ceasefire are getting louder in the U.S. and around the world. The Biden Administration's calls and Sec. of State Antony Blinken's shuttle diplomacy in the region for a "humanitarian pause" to speed additional humanitarian aid into Gaza and allow the release of some 240 hostages, have yet to gain much traction from Israel's hard-right government.

• Then, it's on to Tuesday's elections, first with a focus on two Gubernatorial contests in the Deep South, with one popular incumbent Democrat (Kentucky's Andy Beshear) seeking a second term, and another Democrat (Mississippi's Brandon Presley) vying for a long-shot victory now that his state, where 40% of the population is black, has finally done away with a Jim Crow law that has dampened African-American turnout for generations.

• We discussed the critical fight for control of the Virginia Senate and House of Delegates last week with former VA Delegate Mark Levine. But it was worth revisiting today for a reminder of how much is stake in the Commonwealth on Tuesday, including the right to abortion, which its Republican Governor, Glenn Youngkin, is vowing to restrict if he can hold the House and flip just two seats in the Senate on Tuesday. Every seat in the General Assembly is up for grabs this year, in what is likely to be seen as a bellwether ahead of the 2024 Presidential contest.

  But the biggest battle of the day is likely to be Ohio's Constitutional amendment to protect reproductive freedoms. Republicans are pulling out all the stops to lie, cheat and, yes, even steal it if they must, to block the popular ballot initiative in hopes of instituting a six-week ban on abortions in the Buckeye State with no exceptions for rape or incest. To that end, Republican Sec. of State and U.S. Senate nominee-wannabe Frank LaRose recently purged some 26,000 voters from the rolls. He did so after overseas and military voting had already begun (which would have been unlawful during a federal election) and without giving a heads up to voting rights groups as he has in the past. Those nonpartisan groups have frequently discovered and prevented thousands of errors in such purges. Last week's shocker, as discussed on Thursday's show, wherein I learned from an obituary on the Internet that I had died (even though, I assure you, I haven't) is a reminder of how easy it can be to wrongly remove "dead" voters from the roles who are, in fact, quite alive. At least when you do it as LaRose has done. But, of course, that's why he did it.

  And, in what may be a bit of a sleeper "bellwether" for next year's elections, one county in Northern California may be bracing for potential political violence, as rightwingers in Shasta County are insisting on hand-counting ballots after prematurely ending their contract with Dominion Voting Systems. But the elected registrar --- the only county-wide elected Dem in the County --- believes it wise to follow state law and tally with new Hart-Intercivic tabulators instead. Tune in for details. And keep your eyes on Shasta over the next few days, as we will.

We've got a grab bag of news items on today's BradCast, though almost all of it ends up making the same case: 'Both sides' are decidedly not the same. [Audio link to full show follows this summary.]

We kick off with some listener mail, critical of our recent show discussing why it's so deadly important to elect Democrats in 2022 in order to have any chance of saving American democracy itself --- and much more along with it --- before 2024. The listener argues that, in fact, democracy no longer exists in the U.S. following 2010's Citizens United ruling by the Supreme Court. He argues that "both of the two major parties" are now so corrupted that "the chances of non-corporate funded candidates" being elected to national office are now "equivalent to nil". While that may come as a surprise to folks like Rep. Alexandria Ocasio-Cortez and Sen. Bernie Sanders, just to name a couple, there are many other reasons our correspondent couldn't be more wrong. We explain why.

The bulk of the news items in the rest of today's program underscore why that lazy "both sides are the same" notion (while founded in fragments of cynically misreported truths) is dangerously wrong. They also underscore how those on the Left who buy into that self-defeating nonsense are being played as assuredly as Donald Trump and his MAGA buddies have played their own gullible supporters.

• Elected Republicans members of the Texas state House, ironically calling themselves the "Texas Freedom Caucus," have sent a letter to a Dallas law firm threatening them with legal "consequences" including "felony criminal prosecution and disbarment" for reimbursing their own employees for out-of-state travel as needed to obtain an abortion, now that Texas Republicans have ended such rights and personal freedoms for residents of the Lone Star State.

• A Donald Trump-appointed federal judge has laughed Steve Bannon's attempt to delay his pending federal trial out of the courtroom. The trial, on two counts of Contempt of Congress in response to the former Trump aide's unlawful refusal to respond to subpoenas from the bipartisan U.S. House Select Committee investigating the January 6 insurrection and Trump's many failed attempts to steal the 2020 election, is scheduled to begin next week and could result in up to two years in prison for Bannon.

• At the same time, Mother Jones has obtained leaked audio of Bannon speaking to supporters of his Chinese billionaire pal/funder three days before the 2020 election, explaining that Trump planned to declare victory, whether he won the election or not, and pretend to be the victim of fraud. "He's gonna say they stole it...he's not going out easy...Trump is gonna do some crazy shit," Bannon promised (sound familiar?), as they all laughed about what would become the most dangerous assault on American democracy in our history.

• DoJ has sued Arizona for violations of the National Voter Registration Act and Civil Rights Act, following the signing of a new voter suppression law earlier this year. Adopted by the state's GOP-dominated state legislature and signed by its Republican Governor, the new measure would block voters from voting in the 2024 election without first presenting documents proving their citizenship.

• Wisconsin's GOP-dominated state Supreme Court finds absentee ballot drop-boxes are now illegal in the Badger State. Donald Trump declares the ruling to be proof that he actually won Wisconsin in 2020! (He didn't.) And a Republican state lawmaker running for Governor vows to reverse the state's election results in response.

• In Georgia, a pathetic audio clip from the Republican Party's U.S. Senate nominee, Hershel Walker, discussing climate change --- ("Since we don't control the air, our good air decided to float over to China's bad air. So when China gets our good air, their bad air got to move. So it moves over to our good air space. Then...now we got we to clean that back up.") --- underscores, once again, the sad, cynical (and ill-considered) scheme by GOPers to push this seemingly mentally ill former football star as their candidate to run against Democratic Sen. Raphael Warnock this fall.

• And finally, Desi Doyen has our latest Green News Report, as wildfires once again threaten California's iconic Giant Sequoias; Utah's Great Salt Lake is drying up; and offshore wind power is booming...in China...

As their first official bills in each chamber of Congress --- H.R.1 in the House and S.1 in the Senate --- Democrats are proposing a remarkably ambitious election, campaign and ethics reform measure which would go a long way towards enhancing our system of democracy. At least one important rewrite is needed, however, in order to close a loophole in its mandate regarding hand-marked paper ballots.

H.R.1 or the For The People Act of 2021, was introduced by Rep. John Sarbanes (D-MD) with hundreds of Democratic co-sponsors on January 4. It is supported by both Democratic House Speaker Nancy Pelosi and Senate Majority Leader Chuck Schumer.

With the exception of partisan gerrymandering as applied to State legislative offices --- which is out of the hands of federal lawmakers --- the bill would, for all intents and purposes, outlaw a wide array of voter suppression, intimidation and deceptive practices that have, for decades, been used to undermine American democracy.

The massive bill, clocking in at nearly 800 pages, also includes Congressional ethics reforms and other important measures, but we focus here on the statute's provisions to help outlaw suppressive measures and improve election security, transparency and the verifiability of results.

As presently written, the measure appears to mandate the use of "voter verified permanent paper ballots" in all federal elections. That aspect, however, must be improved with minor, but very important revisions to mandate the availability of hand-marked paper ballots --- the only type that can be known to be "voter verifiable" --- for all voters at the polling place for both early and Election Day voting.

H.R.1 also includes provisions for either hand-counting of paper ballots or the use of optical scanning computers accompanied by Risk Limiting Audits. It includes mechanisms to fund those post-election activities.

The bill provides for minimum periods during which States must make early voting available in federal elections and promotes, streamlines and secures mail-in voting. It tightens ethical standards and also takes a stab at reducing the role of dark money in campaigns, while prohibiting the presence of foreign money and interference in our elections. This includes a mandate that TV, radio and online platforms "make reasonable efforts to ensure that [election-related] communications...are not purchased by a foreign national".

The real question isn't whether H.R.1, if appropriately amended, should become law. The question is whether a sufficient number of Senators are willing and able to do what is necessary to ensure it becomes law...

On today's BradCast: The gears of American democracy continue to grind and wheeze toward November 3rd. On Tuesday, Massachusetts held its late season state primary elections featuring at least two noteworthy races. One, a somewhat bizarre challenge by an ambitious 39-year old Rep. Joe Kennedy III for the Democratic U.S. Senate nomination against incumbent, 74-year old progressive climate champion Sen. Ed Markey. The other, a challenge by the 31-year old progressive Mayor of Holyoke, Alex Morse, against powerful, 16-term establishment Democratic Rep. Richard Neal in the state's 1st Congressional District. One progressive won, the other lost. Both races were fascinating for different reasons. [Audio link to show follows below.]

To help us understand both races and more, we're joined once again today by HOWIE KLEIN, creator of the enduring "Down With Tyranny" blog and co-founder of the progressive BlueAmericaPAC. He's been helping us in recent weeks to make sense of results from a number of key, late season primary races. (There are still three states left to go --- Rhode Island, New Hampshire and Delaware --- over the next two weeks.) The Markey/Kennedy contest, however, was one of the most curious this season.

Markey, who has served in the House and Senate for some 45 years, remains one of its most progressive and beloved lawmakers as a supporter of Medicare for All and the Senate sponsor, with Rep. Alexandria Ocasio-Cortez in the House, of the landmark Green New Deal proposal. Kennedy's attempt to unseat Markey, as endorsed by House Speaker Nancy Pelosi, unsettled a number of Democrats and appeared, for a while, that it might have been successful. Alas, Markey appears to have won the day, and fairly easily, on Tuesday against the first Kennedy to ever lose an election in Massachusetts.

Klein explains why Kennedy was running in the first place and why he ultimate lost.

He also walks us through the challenge against Neal, a long-serving Democratic corporatist in the House who faced criticism from many Dems for slow-walking the Congressional attempt to review Donald Trump's tax returns. As the powerful Chair of the House Ways and Means Committee, Neal has the exclusive, statutory right to review the tax returns of any American in the nation. He took months, however, after Democrats regained the majority in the U.S. House in 2018, to even begin the process. Bu that's hardly the only critique of Neal by progressives, as we discuss today with Klein.

Nonetheless, Neal easily defeated Morse in Tuesday's primary, after what appear to have been dubious, if ultimately effective, charges of sexual misconduct whipped up against him by questionable sources. Klein explains that ugly campaign, as well as why his BlueAmericaPAC decided not to endorse Morse or either of the two progressive candidates running in the crowded field for the nomination to fill Kennedy's vacated seat in the state's 4th Congressional District.

Also today: The Pennsylvania Supreme Court has announced it is taking up a case filed by the state Democratic Party seeking to expand and clarify the state's new mail-in ballot law amid the coronavirus pandemic. The Trump Campaign and state Republicans are challenging absentee voting in the battleground by, for example, suing to prevent the use of secure drop-boxes for absentee ballots.

And, in Texas, a federal judge has, for the second time, found the state in violation of the National Voter Registration Act for refusing to make online voter registration available along with online drivers license applications as required by the NVRA. And, in another court case, Texas' Republican Sec. of State and Attorney General are now suing the Harris County (Houston) County Clerk to prevent him from sending out absentee ballot applications to the county's more than 2 million registered voters...

Lots of news (for a change?) on today's BradCast after a tremendously busy news weekend (for a change?) [Audio link to today's show is posted below.]

Among the stories covered on today's program: In a fairly transparent attempt to distract from all of his Administration's --- and his own personal --- scandals, Donald Trump announed today that he plans to pull the U.S. out of the North American Free Trade Agreement (NAFTA) between the U.S., Canada and Mexico, and is striking a new trade agreement with Mexico only. We caution to be very aware of that claim.

Then, we're joined by STUART NAIFEH, Senior Counsel at Demos to discuss the lawsuit recently filed by his group and a number of Hispanic-American organizations against 32 counties in the state of Florida. Following last year's catastrophic Hurricane Maria in Puerto Rico, more than 133,000 U.S. citizens living on the island relocated to the Continental U.S., according to the Center for Puerto Rican Studies, which estimates [PDF] more than 54,000 of them now live in Florida. These U.S. Citizens, many of whom speak Spanish only, can now re-register and vote in the state, but the counties named in the lawsuit make election materials available in English only, in violation, the groups argue, of Section4(e) of the 1965 Voting Rights Act. The groups are suing to force those counties to produce election materials in Spanish before the November 2018 midterms and argue that the English-only procedures have led to lower than expected registration by these potential voters in the Sunshine State. Naifeh says this has been a longstanding issue in Florida, but even more of an issue since Maria, since there are suddenly "a lot of people coming all at once with limited English," he says.

Naifeh also explains another lawsuit just filed by the group against the state of Arizona, where the Secretary of State is not properly re-registering voters who have changed their addresses on their drivers licenses through the DMV. That, he argues, means that some 500,000 registered voters, whose registrations should be automatically moved, may find themselves unable to vote or will have their provisional ballots tossed out this November, because "Arizona has been systematically failing to update voting addresses," as required by 1993's National Voter Registration Act. Voters in both states --- Florida and Arizona --- are heading to the polls on Tuesday for their state's midterm primary elections.

Then, some breaking news out of North Carolina, where a federal court panel has found the state's U.S. House Districts to be an unconstitutional partisan gerrymander. That, after the federal courts found the previous maps were unconstitutional racial gerrymanders. The court may order new maps to be redrawn in advance of the November election! If they do, and if the U.S. Supreme Court is deadlocked 4 to 4 on an emergency appeal by the state before a new Justice is seated, then the lower court's order to use new maps for the November 6th election would stand!

Next, over the weekend, the DNC voted to change their bylaws to restrict the role of so-called SuperDelegates (party insiders, activists and elected officials) in the nominating process for Presidential candidates. Under the new scheme, adopted by an overwhelming voice vote at the weekend's annual Summer meeting in Chicago, SuperDelegates would have no vote for the party's Presidential nominee on the first ballot at the Democratic National Convention, leaving the selection of the nominee (if he or she can get a majority on the first ballot) up to state primary and caucus voters, rather than party insiders, before the Convention.

Also today, the Government's student loan ombudsman at the Consumer Financial Protection Bureau (CFPB) has resigned, charging in a scathing resignation letter that the Trump Administration is using the Bureau "to serve the wishes of the most powerful financial companies in America" by allowing private for-profit colleges, universities and student loan companies to run roughshod over American families, despite mandates from Congress to end the decades-long ripoffs by such companies.

On today's BradCast: GOPers in D.C. try to overcome Trump's wildly unpopular new border policy and Kansas' Secretary of State loses again in court and faces what may be his most humiliating moment to date. But that's very good news for voters! [Audio link to program is posted below.]

First up, the panic for Republicans on Capitol Hill continued to mount on Tuesday as GOP lawmakers scrambled to find a legislative way out of the family separation crisis created by Donald Trump at the southern border, where more than 2,300 children have now been separated from their parents since his "zero tolerance" policy was first implemented just two months ago. Also today, the Administration announced their intention to pull the U.S. out of the U.N. Human Rights Council the day after its outgoing head blasted the United State's new border policy as "unconscionable" for "inflicting such abuse on children". We discuss the latest on all of the above.

Then, after a quick recap of the 8-year ignominious history of Kansas Sec. of State Kris Kobach's inglorious tenure as the nation's top elected GOP "voter fraud" fraudster, we're joined by attorney SOPHIA LIN LAKIN of the ACLU's Voting Rights Project, to discuss Kobach's latest brutal humiliation. In a victory for the state's voters on Monday, U.S. District Judge Julie Robinson (a George W. Bush appointee), struck down Kobach's extreme "Proof of Citizenship" voter registration law, finding it in violation of the National Voter Registration Act and the Constitution.

The KS Sec. of State has repeatedly defended the law in court, and has been defeated in virtually every battle over it for years, since persuading the state legislature to adopt the measure. But Robinson's ruling on Monday permanently enjoins the law, which had kept tens of thousands of legitimate state registrants in various forms of electoral limbo as Kobach continued to insist their was a massive (if, apparently invisible) epidemic of non-citizen voters jeopardizing the integrity of KS elections.

Kobach, who originally ran for office in 2010 almost solely on the false and misleading promise to "STOP VOTER FRAUD" in Kansas, has failed to find virtually any such fraud during his eight years in office. As Lakin, a member of the ACLU's trial team explains today, during the trial earlier this year, wherein Kobach chose to represented himself and his state, he was unable to show evidence of almost any non-citizen registrations or votes cast in Kansas, despite millions of legal ballots cast during the same period.

"From 1999 to 2013," she tells me, "Kobach was able to present just 39 confirmed non-citizens who were able to successfully get on the rolls, and of those 39, only 11 voted." Most of the registrations, she explains --- as did the judge in her 118-page ruling [PDF] --- were due to administrative errors.

"The judge pretty much agreed that Kris Kobach has been peddling a xenophobic lie that non-citizens are engaging in rampant election fraud. And this was his chance. This court battle that we just had was his chance to put on the record his evidence that this is what was happening. The judge saw that evidence, and she agreed that there was very little evidence of non-citizen voting in Kansas --- certainly not enough to justify the tens of thousands of individuals that have been disenfranchised by that requirement."

"The judge very much wanted Kris Kobach to have his day in court, to put his evidence of non-citizen voting to the test, to see what he was able to actually muster," Lakin tells me. "We even re-opened discovery for the very purpose of him doing that. So, the proof is in the pudding here. He utterly failed."

Of course, Kobach has vowed to appeal the ruling, as he does. But, aside from the verdict's very good news for voters, there was another extraordinary aspect to Robinson's ruling on Monday. In what amounted to a third set of judicial sanctions against him during the long course of the 2016 case and this year's full bench trial, Judge Robinson admonished Kobach in a newly humiliating way. After previously sanctioning him to pay some $50,000 in ACLU legal bills, due to his contempt in having misled the court, Robinson ordered Kobach to attend 6 hours of law school to study up on federal and state courtroom procedures!

Lakin details how, during the trial, the judge repeatedly --- and embarrassingly --- was forced to explain basic rules of evidence and other standard courtroom procedures to Kobach.

"Judge Robinson essentially ordered Kobach to go back to school" in her ruling, she says, explaining that Kobach's performance in the courtroom and repeated reprimands from the judge were likely even worse than the clownshow that the media reported them as, at the time. When I asked how unusual these type of sanctions are against a trial lawyer, she says: "To be honest, I don't think I've ever seen so many sanction rulings against an attorney at all," much less one where they were ordered to attend legal classes.

And, as if that wasn't enough, the ACLU launched yet another lawsuit today against Kris Kobach, this time over his so-called "Crosscheck" system to help (inaccurately) purge voting rolls in some 26 states.

On today's BradCast: Happy birthday, Mr. President! To celebrate today, the New York Attorney general filed a civil lawsuit [PDF] against Donald J. Trump, his so-called "charitable foundation", and his children Eric, Don Jr. and Ivanka, charging that his foundation was used as little more than a personal and business slush fund, and to benefit his 2016 Presidential campaign. [Audio link to show follows below.]

All of that, NY Attorney General Barbara Underwood alleges in her suit, is in violation of both state and federal law. Many of the allegations against Trump's unlawful use of his foundation were reported in the run-up to the election, though much more self-dealing was discovered in the course of the AG's 2-year investigation, including that the Trump Foundation's board of directors had not met since 1999, that some board members had no idea they were even on the board, and that Trump's then-campaign manager Corey Lewandowski personally directed checks to be written from the foundation for campaign purposes.

Underwood's petition seeks nearly $3 million in reparations and to bar both Trump and his children from sitting on the boards of other nonprofit charitable organizations. She also refers the matter [PDF] to the Federal Elections Commission and the Internal Revenue Service for further investigation.

In other important news today, the U.S. Supreme Court issued a 7 to 2 opinion finding that Minnesota's polling place ban on t-shirts and buttons with political slogans, such as those worn by 'Tea Party' members at the polls in 2010, is overly broad and violates Constitutional First Amendment free speech protections. Slate legal reporter MARK JOSEPH STERN joins us to explain the Court's opinion, as well as the far more disturbing ruling from the GOP's stolen SCOTUS earlier this week, when the Court found 5 to 4 in favor of Ohio's voter roll purge scheme by Republican Sec. of State Jon Husted.

That scheme begins the process for removing voters from the rolls after a voter fails to vote in one single federal election. Stern discusses the troubling opinion which overturns the 6th U.S. Circuit Court of Appeal's 2016 finding that the Buckeye State's scheme directly violates the 1993 National Voter Registration Act's restriction against removing a voter from the rolls "by reason of the person's failure to vote."

On today's ruling, I am somewhat less sanguine about what the Court ruled than Stern is, but it's a close call. On the Ohio case, I think we're both in agreement. As he notes: "First, you are identified for a purge because you didn't vote just one single time, and second, you are purged because you failed to cast a ballot. Again, that would seem to go against not just the text but the express purpose of both [the National Voter Registration Act and the Help America Vote Law]. So for Alito to claim that he's just following the text of the law, and dissenters are trying to enact their own policy --- that rings absolutely false to me."

Sterns explains the largely semantic trick that Justice Samuel Alito used to, essentially, flip the provision written by Congress onto its head on behalf of the court's five Republican appointees; how the state's massive purges have disproportionately affected minority and low-income voters; and how Trump and Jeff Session's Dept. of Justice has reversed an unprecedented number of positions on federal laws since taking office.

Finally today, Desi Doyen joins us for the latest Green News Report, as even some Republicans appear to finally be turning against wildly corrupt fossil fuel industry "swamp monster" and EPA Administrator Scott Pruitt...

The crazy train continues. And gets crazier. Among the stories covered on today's BradCast. [Audio link to show follows below.]...

• The stolen Republican 5 to 4 majority [PDF] on the U.S. Supreme Court on Monday found in favor of Ohio's radical voter purge scheme that begins to remove voters from the rolls for failing to vote in one single federal election, in what voting rights advocates (and the 6th U.S. Circuit Court of Appeals) found to be a direct violation of the National Voter Registration Act. According to a 2016 Reuters analysis, the scheme resulted in 144,000 voters being removed from the rolls in Cleveland, Cincinnati and Columbus alone, and affected voters in Democratic-leaning neighborhoods at roughly twice the rate as in Republican neighborhoods. Other GOP-controlled states are now believed likely to adopt similar voter purge schemes;

• The Los Angeles County Registrar of Voters says he cannot yet rule out hacking as the cause for 118,000 voters being left off the printed rosters at the polls during last week's midterm primaries in California. Registrar Dean Logan has announced that an independent analyst will be hired to try and determine why it happened and how to prevent an even worse disaster this November;

• Seemingly bowing to public pressure, The Trump Administration's Housing and Urban Development Secretary Ben Carson has now said he plans to back off his proposed scheme to increase rents by more than 20% per year on more than 8 million low-income Americans --- including millions of children, elderly and the disabled --- who live in federally subsidized housing for the working poor; (Our guest on this topic last week, former Obama HUD official Diane Yentel, warns that pieces of this proposal may find its way into other legislation being moved by Congressional Republicans to gut the social safety net for the poor.);

• Then, on to the crazy train: Trump arrived late and left early from the Group of Seven (G7) summit with our top allies on Saturday, pulled the U.S. off of the G7's traditional summit-ending communiqué, which he'd previously agreed to, and then turned against mild-mannered Canadian Prime Minister Justin Trudeau for daring to keep his promise to respond (as he'd previously announced) to Trump's trade tariffs imposed on imported steel and aluminum from Canada and other close allies last week. In turn, Larry Kudlow, Trump's top economic adviser, took to the Sunday news shows to describe Canada's response as a "betrayal" and his top trade adviser, Peter Navarro went on to charge there was a "special place in hell for any foreign leader that engages in bad diplomacy with president Donald J. Trump.";

• All of which served as a precursor for Trump's historic summit set for Tuesday in Singapore with North Korean leader Kim Jong-un. On Monday, Trump announced he planned to leave that summit --- with the potential denuclearization of North Korea and an end to the 70-year old conflict between the North and the South on the table --- early as well. What could possibly go wrong? And how bad does this all get before it gets better?

On today's BradCast: As voters head to the polls in eight states (CA, AL, IA, MS, MT, NJ, NM and SD) on Tuesday, we cover a few "sorta victories" elsewhere for now, including at the U.S. Supreme Court. [Audio link to show is posted below.]

Reports of problems at the polls have already cropped up, however, in South Dakota, where electronic pollbooks failed in eight counties, and here in Los Angeles, where a "random issue with the print job" on paper rosters at polling places, according to the County Clerk, has led to some voters needing to cast provisional ballots.

As we await election results and likely reports of more problems elsewhere, a "sorta victory" for Twitter users who had sued the President after he blocked them on Twitter. Those seven plaintiffs were finally unblocked by Trump after a federal court found last month that he was violating their Constitutional First Amendment free speech rights. But, on the same day those seven were unblocked, the Dept. of Justice appealed the court's ruling anyway.

In Alabama, another "sorta victory" as the story of Sec. of State John Merrill blocking folks on Twitter for pointing out his errors as the state's top election official, has finally been picked up by the corporate media in the state. That, just hours before voters headed to the polls, with Merrill himself on the ballot. The coverage comes after we first reported on Merrill's behavior months ago (when he blocked me for being right about the state's computerized election tabulators), and again last week after he sent me a flurry of insane emails [PDF] in response to a simple query as to whether he planned to unblock followers now that a federal court has found his behavior to be in violation of the U.S. Constitution. The Montgomery Advertiser's weak coverage, however, largely serves to offer the Sec. of State a platform to call election experts and journalists "trolls" (for being correct and polite), while still refusing to unblock them.

In Arizona, a lawsuit against the state for keeping tens of thousands of registered voters off the rolls for failing to provide "proof of citizenship" before being allowed to vote has now been settled with a consent decree that will enfranchise many voters, even if it will still result in thousands being disallowed from voting in state and local contests. So, a "sorta victory" there as well.

And, at the U.S. Supreme Court this week, a "sorta victory" for both anti-gay bigots and civil rights advocates as the long-awaited ruling in Masterpiece Cakeshop v. CO Civil Rights Commission, a case involving a Colorado baker who refused to make a cake for a same-sex couple's wedding reception is finally decided by a narrow 7 to 2 ruling in favor of the baker...sorta.

Slate legal reporter MARK JOSEPH STERN joins us to explain how Justice Anthony Kennedy, with his majority opinion. tries to "have his cake and eat it too," by largely kicking the can down the road for another day, while ostensibly siding with the baker against the state Commission on rather dubious religious freedom grounds.

The decision, however, also appears to strengthen the existing right of states to bar discrimination by similar businesses on the basis of sexual orientation. So much so, that, under the ruling, the two plaintiffs, according to their ACLU attorney, should be able to walk into Jack Phillip's Masterpiece Cakeshop in Lakewood, CO today and purchase a cake for their wedding anniversary, if they wished. If they are blocked, that would be in violation of the Constitution. Nonetheless, a definitive opinion from SCOTUS on the issue of discrimination on the basis of sexual orientation will have to wait for another day.

"If the Supreme Court applied the same standard to the [Trump] travel ban case as they have applied to Masterpiece, the Court would have no trouble striking down the travel ban as a violation of First Amendment religious freedoms," Stern tells me, when I ask whether Kennedy's weak religious liberty argument here may apply more to some religions than others. "Unfortunately, I do not think the court is going to be consistent. I think, instead, the Court's going to wind up applying a much stricter standard when it's Christians' rights on the line, than when it's Muslims' rights on the line. And we're all going to be very disappointed in this kind of inconsistent religious liberty --- 'for me, but not for thee.'"

Stern offers smart insight on the Court's opinion(s) --- which were widely misreported elsewhere on Monday --- as well as another decision this week from the Court on the Trump Administration's failed attempt to punish the ACLU for supporting a teen immigrant who sought a lawful abortion after being detained at the border. That ruling, at least, was a complete victory, he explains, not just a "sorta" one.
