We'll just have to keep saying it on The BradCast: Republicans are pro-murder and anti-democracy. It's just that simple. And we've got too much more evidence of that today. [Audio link to full show follows this summary.]

First up, the fallout continues following Monday's school shooting in Nashville, Tennessee, where three 9-year olds and three adults were killed by an AR-15 wielding shooter at a private Christian elementary school. The U.S. Congressman representing the district where The Covenant School is located is Republican Congressman Andy Ogles.

Last year, Ogles sent out Christmas cards featuring himself, his wife and his children in front of a Christmas tree, proudly posing with their AR-15 style assault rifles. Since the shooting in his district, he has apparently taken down his social media posting of the festive card. A reporter from Sky News confronted him this week to try and learn why he hadn't taken it down previously, after other similar massacres, and why he seems to favor guns and murder over the lives of children and their right to be safe at school.

Jon Stewart, earlier this month, also had a related conversation with a Republican state lawmaker in Oklahoma by the name of Nathan Dahm. The GOP state Senator has authored bills to loosen restrictions on firearms and apparently believes that drag shows that may be seen by children must be banned, because "the government does have a responsibility to protect" them. But, as Stewart points out, Dahm appears to have no similar concerns about protecting kids from being murdered with guns, which is now the leading cause of death for U.S. children and teens.

In a similar vein, Big Government Republicans in Kentucky's legislature today voted to override the veto of Democratic Governor Andy Beshear, to enact a law that will ban health care for trans kids and mandate that doctors begin "detransitioning" children currently on puberty blockers and hormones, despite the alarming rate of suicide by such kids. The bill also bars all discussion of sexual orientation and gender identify in schools for students of any age, as the Nanny State Republican party continues to pretend they favor free speech.

Meanwhile, this is an election year in Virginia, where the entire state legislature comes up for reelection in odd-numbered years and where the commonwealth's 1902 constitutional provision created to prevent black people from voting remains in place. The measure in question allows VA's Governor to decide, on any criteria they may like, whether or not to re-enfranchise former felons.

Under processes enacted first by former Republican Gov. Bob McDonnell and then broadly expanded and automated by subsequent Democratic Governors Terry McCauliffe and Ralph Northam, the voting rights for hundreds of thousands of Virginians were restored. But, since taking office last year, VA's new, so-called "moderate" Republican Gov. Glenn Youngkin has re-enfranchised almost nobody. Moreover, his office has finally informed state lawmakers that he will be using a secret process to personally decide, on a case-by-case basis, who will and won't be allowed to vote.

We're joined today by voting rights, criminalization and justice reporter ALEX BURNESS, staff writer at the progressive Bolts Magazine. He has been reporting on Youngkin's appalling, anti-democracy policy, and how it is harming those who are simply hoping to return to civil society after imprisonment in Virginia.

"We still don't know what the criteria is going to be, but it is clarifying in the sense that the policy is 'I'm going to do whatever I want and, at least for the moment, I'm not going to tell you what that means,'" Burness tells me, adding that the commonwealth's constitution mandates the Governor "literally has the power to make up criteria, based on whether you own a dog or a cat, or anything."

Burness explains why Democrats in the state have yet to pass a constitutional amendment to change this absurd, Jim Crow relic, despite the heartbreaking stories from so many who have served their time and simply want to have their rights as citizens fully restored. "This is one of a million reasons why Virginia's upcoming elections matter. Particularly with what Youngkin has done now, there is some renewed passion by folks to settle this once and for all and not leave it up to the whims of the Governor," says Burness.

The pathetic vote suppression by Youngkin comes on the heels of Minnesota's Democratic Governor signing a law this month to re-enfranchise some 55,000 citizens of voting age who are no longer incarcerated, whether they are on parole or probation or not; New Mexico's Democratic Governor signing a similar law that will restore voting rights to about 11,000 New Mexicans; and a recently advanced measure by Democratic lawmakers in Oregon to allow voting even for those still in prison, akin to the rights afforded to the incarcerated in Maine, Vermont and Washington D.C.

Finally today, more voter suppression is enacted by Arkansas' new Republican Gov. Sarah Huckabee Sanders. Yesterday, we detailed her newly signed law adopted by Republican state lawmakers that will make it much much harder for Democrats to place citizen initiatives on the statewide ballot. (Even though the statute appears to be a violation of the state constitution.) Today, the American Democracy Minute's Brian Beihl details three other new bills recently signed by Huckabee Sanders to make absentee voting much more difficult in the state...

Ya know, if their ideas were popular, Republicans wouldn't have to work so hard to undermine democracy, would they? An example or three of that on today's BradCast.

Among today's many stories...

  • Cowardly Mike Pence's attempt to avoid testifying about Donald Trump's January 6th insurrection to Special Counsel Jack Smith's grand jury is denied by a federal judge.
  • Yet another white Republican in Florida is charged with election fraud. Yet again, he was not arrested at gunpoint on camera and hauled to jail like the people of color who Gov. Ron DeSantis ordered rounded up before last year's election, even though they had no idea they had voted unlawfully. The white Republican voter turned himself in to authorities at his own convenience.
  • Our corrupt, stolen and packed rightwing U.S. Supreme Court majority has declined to review a ruling by the state Supreme Court in Kansas which found that intentionally discriminating against minority voters was just fine, after state Republicans gerrymandered Kansas City by cutting it into two different Congressional districts in order to dilute the power of black voters.
  • In Arkansas, voters have repeatedly made clear through recent rejections of GOP ballot initiatives, that they really really oppose making it more difficult for citizens to put stuff on statewide ballot initiatives and see it adopted by voters. So now, Republicans in the state legislature, giving the finger to voters, have simply passed a new law to make it virtually impossible for Democrats to place measures on the statewide ballot. AR's new democracy-hating Republican Governor, Sarah Huckabee Sanders, happily signed the measure which, on its face, seems to blatantly violate the state's own Constitution. The League of Women Voters of Arkansas and other fans of democracy are now suing to block what the League's President accurately describes as "an attack on direct democracy."
  • The 28-year old shooter in Monday's mass shooting --- the 130th of the year so far --- reportedly purchased SEVEN weapons from five local guns shops in Nashville, Tennessee before using at least two of them to kill three 9-year olds and three adults at a private Christian elementary school. All of that while the assailant was said to have been under a doctor's care for an emotional disorder, according to the Nashville police chief. Seven guns, at least two of them semi-automatic assault weapons, and none of it triggered any red flags to authorities. Nonetheless, Republicans in Congress today, according to media reports, still lack the courage to support any new gun safety laws that might make such massacres less likely or more difficult. They are, as Rep. Ted Lieu (D-CA) correctly noted today, "cowards". AND PLEASE NOTE: This is not a problem with "Congress" or "lawmakers in D.C." The problem is Republicans. Period. They do not want to make it more difficult to murder people, while Democrats do. It's as simple as that. If media outlets are unable to call out Republicans, specifically, for fear of sounding "partisan", they are doing a grave disservice to their readers, viewers, listeners and country.

For the first time in a long time on today's BradCast, we're happy to feature a Special Coverage episode of something that isn't actually horrible. In fact, it's something that turned out to be an unexpected amount of fun to watch and cover, while including what was, as I described it on today's show, "the greatest Rope-a-Dope Moment in the all-time history of State of the Union addresses." [Audio link to full show follows below this summary.]

We've got full post-speech team coverage today of Joe Biden's second SOTU as President (actually his third address to a joint session of Congress), and it was a humdinger! Both the speech and today's coverage. In fact, as our panel appeared to agreed today, it was likely the most enjoyable SOTU any of us had ever witnessed!

We're joined today by the great HEATHER DIGBY PARTON, award-winning columnist at Salon and founder of Digby's Hullabaloo blog (which just celebrated it's 20th anniversary!) and "DRIFTGLASS", otherwise known as @Mr_Electrico on Twitter and as simply Bill at home, where he produces The Professional Left Podcast each week with his wife Fran/"BlueGal". Like Digby and me, he too is a longtime, old-school progressive blogger!

Biden's lively remarks on Tuesday --- and his surprisingly brilliant off-the-cuff responses to jeers and obnoxiously inaccurate heckles from members of the new Republican House majority --- cannot be described as delivered by "Sleepy Joe". The 73-minute speech actually flew by, surprisingly enough.

During the address, he, justifiably, sang his Administration's praises for what has amounted to one of the most successful first two years of any Presidency going back to at least FDR. (That, as we discuss, is particularly surprising given the narrowest of majorities he had to work with for the past two years in Congress. And is true, whether or not you liked his many accomplishments, had hoped for still more, or preferred entirely different policies.)

Snap polling following Tuesday's SOTU revealed a whopping 72% of Americans who watched it reacted positively, with some of the most favorable reactions coming from those who, prior to the speech, disapproved of Biden or felt his policies would not move the country in the right direction. So will his remarks on Tuesday make any difference in his approval ratings moving forward?

How the Uvalde school shooting came to happen, who must be held accountable, and what must come next; Also: Noteworthy results from Tuesday's midterm primaries in AL, AR, GA and TX...

On today's BradCast: While seemingly separate issues, the school shooting in Texas on Tuesday and the same day's midterm primary elections aren't separate issues in the least. [Audio link to full show follows this summary.]

On Tuesday, at least 19 fourth graders and two teachers were murdered at the Robb Elementary School in Uvalde, Texas. As in Buffalo, New York just over a week ago, the shooter in TX was 18-years old, armed to the teeth with sophisticated semi-automatic weaponry, wearing body armor and able to easily overcome "a good guy with a gun." In Buffalo, the "good guy" was an ex-cop turned grocery store security guard who was killed trying to stop the gunman. In Uvalde it was a school security guard and two local cops --- three law enforcement officials in all --- who were unable to prevent the gunman from battling his way into the school to use the two AR-15 style assault rifles and nearly 400 rounds of ammo that he'd just purchased immediately upon turning 18 this month. All of that, thanks to the Republicans in Texas, from the Governor to the state Legislature to the Attorney General to the state's voters, who made it all not just possible, but easy.

While so much of this has become normalized, none of it actually is. We cover a lot of territory on all of this today, from the Federal Assault Weapons Ban that worked well from 1994 to 2004, before Republicans, by then fully captured by the gun lobby, allowed it to end; to President Biden's emotional and at times angry remarks in response; to the horrific increase in recent years in crimes carried out with these types of weapons; to the pathetic statements from Texas' chief law enforcement official Attorney General Ken Paxton and its Governor Greg Abbott who both worked hard to make all of this carnage not just possible but much more likely; to responses from Abbott's Democratic opponent this November, Beto O'Rourke and even the Golden State Warriors head coach Bill Kerr; to a sobering reminder from Richard Nixon's conservative Republican U.S. Supreme Court Chief Justice Warren Burger in 1991, when he made it clear that 2nd Amendment has been the subject of "one of the greatest frauds every committed on the American people."

While the demons at the NRA and in the Republican party and on the GOP's stolen and packed Supreme Court all share in the blame, so do we the people for continuing to elect the (mostly) Republican lawmakers who have helped to ensure these unspeakable tragedies will continue by refusing, for decades now, to take any legislative action at all to prevent them.

The ballot box is now our only way out.

To that end today, we also cover noteworthy results from Tuesday's critical primary elections in Alabama, Arkansas, Georgia and, yes, the very bloody state of Texas...

On today's BradCast, it seems to be the day when we are now officially tumbling over the Constitutional Crisis cliff.

The day began with Donald Trump's Dept. of Justice issuing a letter to the House Judiciary Committee informing them that the President was formally asserting Executive Privilege to block the release to Congress of the unredacted report by Special Counsel Robert Mueller as well as all of its underlying evidence, such as witness testimony, grand jury information, etc.

That, as the Committee held its scheduled session to consider a vote on a resolution [PDF] finding Trump's Attorney General turned personal fixer William Barr in contempt. The vote recommending the full House consider citing Barr came after weeks of Chairman Jerrold Nadler's repeated attempts, to no avail, to find good faith accommodation with the DoJ to release the subpoenaed Special Counsel materials. Nadler's thanks came today when the DoJ notified the Committee that, due to Trump invoking Executive Privilege, they would not be allowed to see any additional material from the Special Counsel investigation of Donald Trump's obstruction of justice and his 2016 campaign's involvement with alleged election interference by Russia. In an amusing sidebar, the White House statement today on this charged: "Faced with Chairman Nadler's blatant abuse of power...the President has no other option than to make a protective assertion of executive privilege."

And, as all of that was going on, House Speaker Nancy Pelosi, at a Washington Post event, declared cryptically that Trump's "obstruction, obstruction, obstruction" means that he is "becoming self-impeachable," whatever that might mean.

We're joined to try and make sense of all of this today --- including last night's blockbuster New York Times exposé finding Trump's tax records from 1985 through 1994 reveal that the self-proclaimed "greatest businessman of all time" personally lost more than $1 billion over that decade --- by our friend and award-winning journalist HEATHER DIGBY PARTON of Salon and Hulaballoo.

Among the many questions raised and (some of them) answered today with the great "Digby"...

  • Did the Times' report have anything to do with Trump's blanket use of Executive Privilege today to block a report that he had previously waived the privilege on? ("The bigger picture here," argues Parton, "is that it exposes Trump as the greatest liar and conman of all time.")
  • Is Trump's legally dubious (to say the least) strategy of attempting to block any and all Congressional access to documents and witnesses really meant only to run out the clock until election season begins in earnest?
  • Is there a group of non-elected Republicans who might finally step in to end this madness?
  • Will the Democrats' attempt to refer a contempt citation for Barr be any more successful than the Republicans' attempt to cite Obama Attorney General Eric Holder in 2012 when, as we discuss, they made the exact same arguments against Holder that Dems are making against Barr today?
  • Are the Dems moving too cautiously in their attempts to hold Trump and his Administration accountable?
  • Are we any closer to an actual impeachment inquiry of the President, given (as 1998's Lindsey Graham helpfully reminds us today), the very same obstruction of Congress by a President for which Articles of Impeachment were issued against both Richard Nixon and by Graham and the Republicans against Bill Clinton?
  • What the hell does Pelosi's "self-impeachable" remark actually mean?
  • And should we all be concerned about what Trump might do next when things get even worse for him and his Presidency --- as his Administration continues to beat drums of war against Venezuela, Iran and other nations?

And, as if all of that isn't enough to squeeze into one very fast moving hour, as we got off the air today we received the breaking news that the GOP-controlled Senate Intelligence Committee has now subpoenaed Donald Trump, Jr., regarding his previous Congressional testimony on the Trump Tower Moscow project...as the walls appear to be tumbling down...

New study finds rich guys lie the most; WaPo finds Trump lies constantly; CNN finds Mueller found Trump and associates lied like crazy; Legal experts find Team Trump learned nothing from 'Russia-gate'; Trump and Barr find out if they can obstruct Congress; And many other findings...

Why tell the truth and follow the rule of law when BS'ing and obstructing truth and justice (and Congress) now appear to be a far more successful way to get ahead in life...and in the Presidency of the United States? As Donald Trump recently reached a new milestone of having told more than 10,000 lies while in office, according to Washington Post's fact-checker database, these are among the related stories covered on today's BradCast. [Audio link is posted below]...

  • A fascinating new study finds that wealthy men are more likely than women and those of lesser means to simply make stuff up. That's right, lying appears to work for many, and is carried out far more frequently in North America than in other English speaking countries around the world. Or, as WaPo's headline summarizes the academic survey: "Rich guys are most likely to have no idea what they're talking about, study suggests". (Though, as you'll also learn, both Desi and Canada should be ashamed of themselves);
  • That may also help us understand today who our President is and why he and his supporters do what they do, as a new CNN analysis catalogs 77 different "lies and falsehoods" by Trump and his associates, documented in Robert Mueller's redacted Special Counsel report. The lies were told by Trump, his "campaign staff, administration officials and family, Republican backers and his associates" who all "made false assertions to the public, Congress, or authorities," according to the analysis. While a handful of those lies were prosecuted as crimes (for example, some of those told to the FBI by Trump's former National Security Adviser Michael Flynn and to Congress by his former personal lawyer Michael Cohen), most went unprosecuted for varying reasons, including the fact that lying to the public and the press is not a crime, even when the White House does it, repeatedly, apparently. Among the many lies cataloged, a plurality of which were told by the President himself, many concerned his dealings with Russia and those of campaign staff and administration officials;
  • Speaking of which, in March, Trump's 2020 Campaign Manager Brad Parscale flew to Romania to deliver a paid speech to Romanian politicians and policy experts, raising questions among U.S. legal experts about conflicts of interest and whether Team Trump has learned anything after their extensive dealings with Russia during the 2016 campaign. They paid little price for that, however, so why worry about a Trump/Romania Special Counsel investigation now?;
  • Mid-show today we covered some breaking news regarding today's U.S. support for a military coup being called for by Valenzuela's opposition leader and self-declared "President" Juan Guaido, and claims by U.S. Sec. of State Mike Pompeo that the nation's actual President Nicolas Maduro was preparing to leave the country in response. At the last minute, however, according to Pompeo, Maduro was talked out of it by Russia. But, of course, our Sec. of State is a huge and very successful liar as well, so there's no particular reason to believe any of his assertions regarding the attempted U.S. overthrow of Venezuela today;
  • In other breaking news, a federal judge today determined that a lawsuit filed by some 200 Congressional Democrats against Donald Trump charging he is in violation of the Constitutional Emoluments clause may move ahead, allowing plaintiffs to gain access to information about Trump's private business dealings;
  • And, in related news, Trump's private attorneys on Monday night filed a lawsuit on behalf of him, his company and his children's behalf against Deutsche Bank and Capital One in hopes of forcing them to not respond to lawful subpoenas for Trump financial documents as issued by a number of Congressional committees. Normally we'd say "good luck with that", but for Trump's stolen Supreme Court majority who have proven themselves capable of doing anything on his behalf at this point;
  • The obstruction also continued today by Trump's Attorney General William Barr, who, the Justice Department has said, still plans to appear before the Republican-majority Senate Judiciary Committee on Wednesday to give testimony regarding the Mueller Report, but that he is objecting to a planned appearance before the Democratically-run House Judiciary Committee on Thursday, where members may allow counsel from both the majority and minority to question Barr during the scheduled testimony. House Judiciary Chair Jerrold Nadler asserts it's not up to Barr to determine who gets to question him or how the hearing is to be carried out, suggesting he may ultimately need to subpoena the A.G. to force his testimony. But if Barr defies that subpoena, as other Administration officials have been ordered by Trump in recent days, then what? Who would enforce a Contempt of Congress citation against the nation's top law enforcement official? And how would it even be done? Well, there is a House Sergeant-at-Arms and, reportedly, a jail in the basement of the Capitol Building. We discuss;

Guest: NBC 7 San Diego's Ramon Galindo; Also: Callers ring in...

Saturday's Passover shooting at a synagogue in Poway, California, just north of San Diego, was only the latest in a rising spate of Rightwing extremist hate crimes --- rising even over the past week alone! --- as discussed on today's BradCast. [Audio link to show follows below.]

We're joined today by NBC 7 San Diego reporter RAMON GALINDO, who spent the weekend covering the shooting at Chabad of Poway, which took the life of 60-year old Lori Gilbert-Kay and injured three others, including the congregation's Rabbi, after a 19-year old armed with a military-style assault rifle opened fire during Shabbat services. The alleged shooter, who was arrested while fleeing, is said to have been inspired by both the recent attack on two Muslim mosques in New Zealand, where 50 were killed, and the Tree of Life synagogue shooting in Pittsburgh which killed 11 worshipers exactly 6 months ago.

The shooter at Chabad, who posted a "manifesto" just prior to the attempted massacre, is also said to have been responsible for an incident of arson at a nearby Muslim mosque in late March, according to Galindo who broke the story of that fire for NBC San Diego last month. In addition to bringing us up to the latest, including charges that have now been filed, Galindo offers insight on a number of the heroes in the story who he spoke with over the weekend, including both Gilbert-Kay and Oscar Stewart, an Iraq vet and congregant who reportedly ran toward the shooter to stop him as others were fleeing. It was, in fact, a good guy WITHOUT a gun who appears to have prevented far more carnage, though an armed Border Patrol officer at the service reportedly fired shots at the shooter's car as he was speeding away.

We've got a lot to unpack on all of this today, with both Galindo and listeners who call in with their own thoughts and reactions to the shooting (including one woman who lives in the neighborhood), the White House response (denying Donald Trump's obvious responsibility in helping to hasten the rise of white supremacists and other rightwing extremists) and even some thoughts on the Obama Administration's willingness to fold to reactionaries on Fox 'News' and in the Republican Party by withdrawing his own Dept. of Homeland Security's dire draft report [PDF] on the dangerous rise of lone wolf rightwing domestic terrorism in April of 2009.

That (shamefully) withdrawn report stated: "DHS has concluded that white supremacist lone wolves pose the most significant domestic terrorist threat because of their low profile and autonomy --- separate from any formalized group.” (No such fury was issued by the right after a similar report on the dangers of leftwing extremism was issued before it. Both reports were begun during the George W. Bush Administration. Moreover, as Daily Beast reported earlier this month, the Trump Administration has been disbanding DHS efforts to work with state and local officials on issues of white supremacy and domestic terrorism.)

We also talk with Galindo about the editorial decision by some in the media to not share --- or, at least, over use --- the suspects name and why neither of us did so today. As noted, there is much to discuss on today's program...

Bernhardt slithers to the top of Interior; Another deadly chemical fire in Houston; White House security whistleblower steps forward; Chinese national arrested with 'malware' at Mar-a-Lago...

On today's BradCast: Donald Trump's D.C. swamp isn't getting any less swampy, but it all does make chants of "Lock her up!" over Hillary Clinton's personal email server appear quite quaint. [Audio link to show follows below.]

Among the many stories covered on today's program...

  • It's Election Day in a number of places today, including for a very important state Supreme Court seat in Wisconsin, where the results will have ramifications (for the state and nation) for the next decade. And voters are also at the polls near Pittsburgh, Pennsylvania today for a special election for that state's Senate in a contest which may serve as a bellwether before the 2020 elections. We'll have reported results and other analysis of that and others contests, no doubt, on tomorrow's program;
  • More disaster today near Houston, Texas where yet another deadly chemical fire broke out, killing one as of airtime, with two others airlifted to hospitals. Emergency officials issued shelter-in-place warnings to schools and residents within a 1-mile radius, advising residents to stay indoors, turn off all ventilation systems and seal all doors and windows. It's the second major toxic chemical plant explosion near Houston within as many weeks. Given the state's shameful history with chemical facilities --- and a dangerous, years-long lack of transparency, even for first responders --- the latest tragic incident is, sadly, not all that surprising;
  • Donald Trump's latest nominee to head the Dept. of Interior is near confirmation in the U.S. Senate after his confirmation hearing last week in the Energy and Natural Resources Committee. But David Bernhardt --- currently Deputy Secretary and Acting chief of the agency following the resignation of Trump's first disgraced and corrupt Secretary Ryan Zinke --- is a longtime, top lobbyist for the oil and gas industry and has been instrumental since arriving at the agency in 2017 in reversing loads of environmental regulations long opposed by the fossil fuel and chemical industry.

    In fact, as a recent investigative report by Reveal illustrated, at an executive meeting of the Independent Petroleum Association of America (IPAA), a top industry group, after Bernhardt was tapped to be the top Deputy at Interior in 2017, the hundred or so oil industry executives at the conference were caught on tape laughing and applauding after the IPAA's CEO bragged about Bernhardt as "the guy that actually headed up" their legal team challenging federal endangered species rules being "now the No. 2 at Interior," adding, "So that's worked out well." Now Bernhardt will be No. 1 at Interior.

    We share some of the audio from last week's Senate Committee hearing in which Bernhardt said he would decline to recuse himself from issues at Interior involving companies for whom he lobbied, because, he said, he'd be "basically handcuffed and not in the game for the American people if I am recusing myself" and prevented from unleashing his awesome "skillset" on behalf of "the American team". Bernhardt, of course, is just one of many deeply-conflicted swamp creatures now inhabiting Trump's "drained" swamp;

  • Speaking of which, a whistleblower with 18 years of experience in the White House Personnel Security Office, where she worked for Democratic and Republican administrations alike, has stepped forward to expose what she describes as at least 25 Trump appointees who failed security clearance checks, but were ultimately granted clearances anyway after intervention by more senior officials. According to Tricia Newbold's recent testimony to the U.S. House Oversight Committee, many Administration security clearances had been rejected for a number of reasons including "foreign influence, conflicts of interest, concerning personal conduct, financial problems, drug use, and criminal conduct."

    She testified that two currently-serving Senior Officials in the White House were granted clearances despite failing their background checks. Though the names of the officials whose security clearances were granted only after intervention were not specified, House Oversight Committee Chair Elijah Cummings has sought "adjudication summaries" from the White House for Trump's son-in-law Jared Kushner, his daughter Ivanka Trump, former National Security Advisor Michael Flynn, currently National Security Advisor John Bolton and a host of other top appointees.

    On Tuesday, the Committee voted to subpoena Carl Kline, Newbold's superior, believed to be behind a number of the questionable approvals. White House Press Secretary Sarah Huckabee-Sanders today described the Congressional oversight of the matter in partisan terms, bizarrely characterizing it on Fox "News" today as "sad and shameful" and, somehow, ironically enough, "dangerous" to national security;

  • That statement came just hours before court documents were released today revealing that the Secret Service arrested a Chinese national at Mar-a-Lago over the weekend, during the President's latest visit to his Palm Beach resort, with four cell phones, two Chinese passports, a hard drive, and a computer thumb-drive said to contain "malicious malware". Court documents describe the woman telling the Secret Service, after she had initially been allowed inside the resort, that she was sent there by a Chinese friend who instructed her to travel from Shanghai to make contact with a member of Trump's family. But, why worry about security checks for those family members, eh?;
  • Finally, Desi Doyen joins us for the latest Green News Report, with more on Bernhardt's enormous conflicts of interest, the White House's latest unprecedented scheme to jump start the stalled Keystone XL pipeline, more bad news for Trump's environmental rollbacks in federal court, and the Green New Deal has its first town hall discussion...

Guest: Will Bunch of Philly Inquirer/Daily News; Also: Trump blows up both federal deficit AND foreign trade deficit; House Dems seek vote suppression docs from GA's GOP Governor, Sec. of State...

On today's BradCast, the heat continues to grow on the Trump Administration, as Democrats ramp up their oversight efforts after taking back a majority in the U.S. House. But, with another Presidential election around the corner, should they already be pursuing Articles of Impeachment, particularly with what we already know about Donald Trump's unprecedented crimes and corruption both before and after becoming President? [Audio link to full show follows below.]

But, first up today...A new report from Donald Trump's U.S. Treasury Department on Tuesday confirms that the Trump/GOP tax cuts have blown up the federal deficit to record levels. In the first four months of the budget year (which began in October) the deficit is up an astonishing 77 percent over the same period the previous year, thanks in no small part to a vast reduction in revenue on the heels of the tax cut, including a 23 percent drop in corporate taxes paid to the Government compared to last year. So much for the Republican repeated lie that their tax cuts would "pay for themselves!"

Then, on Wednesday, the Commerce Department followed up that news with the announcement that the foreign trade deficit has exploded, even after Trump's "American First" tariffs and trade wars that were supposed to shrink the imbalance with foreign nations that Trump has long (falsely) blamed for the loss of American manufacturing jobs. As a candidate, he described the U.S. foreign trade deficit as a "politician-made disaster" that he said he could "turn around fast". But his tariffs have only made things worse.

Moreover, as recently as this past weekend at CPAC, he repeated his line about "billions of dollars...pouring into our Treasury" due to his new tariffs on imported goods, but failed, as usual, to mention that those "billions" are paid by American consumers, not foreign nations. A recent study [PDF] found Americans are footing the entire bill for Trump's tariffs and that it is costing more for those in Republican-leaning counties. A separate study [PDF] from a different set of economists found that if Trump's tariffs somehow resulted in the creation of 35,000 new manufacturing jobs (the total number of jobs lost in the steel and aluminum industry over the past decade) they would still have cost tax-payers $195,000 per job.

Those, of course, are just some of Trump's failures as President. His high crimes and misdemeanors are another matter. With Democrats back in the majority in the U.S. House, oversight of the Executive Branch is finally beginning again. Trump and the White House and their TV operation called Fox "News", describe the Constitutional mandate oversight as a "fishing expedition", a "disgrace" and "PRESIDENTIAL HARASSMENT!" But, citing the House Judiciary Committee's request for documents from over 80 Trump associates or entities this week, our guest today, longtime Philadelphia Inquirer/Daily News national columnist WILL BUNCH, describes the effort as a "shadow impeachment".

He tells me the effort now underway in the House is "exactly like" the process we would see if Articles of Impeachment had already been introduced, but without Democrats having to use "the i-word". But will that process be enough to bring accountability, much less put the brakes on this out-of-control, unprecedentedly corrupt Presidency? Especially with the next Presidential election already baring down on us? A "shadow impeachment" that could become a real one is fine, but shouldn't we have a real one already? We discuss those questions and many others with Bunch on today's program.

Finally, speaking of long-overdue and much-needed federal oversight. Democratic leadership in the House Oversight and Reform Committee today sent letters [PDF] to Georgia's new Republican Governor and former Sec. of State Brian Kemp, along with new Sec. of State Brad Raffensberger, seeking documents surrounding the massive vote suppression that tainted Kemp's reported narrow victory in the Governor's contest over Democrat Stacey Abrams last November. Among the documents sought by the House Dems in their new investigation are those related to Peach State government actions to purge voters (1.4 million were removed from the rolls during Kemp's tenure as SoS), shut down polling places (200 have been closed since 2012); keep newly-registered voters off the rolls (the registrations of 53,000 disproportionately black voters were suspended under the state's so-called "exact match" requirement); the "sequestration" of un-deployed voting machines (which resulted in long lines on Election Day in three key counties); and other related concerns over which Kemp was sued (and lost) countless times while overseeing his own election last year.

All of that as both Kemp and Raffensberger are pushing hard this week to hoax state lawmakers into voting to spend at least $150 million on new, unverifiable touchscreen voting systems. Republicans are rushing through legislation this week in the state Senate to purchase the new computer-marked "paper ballot" systems, despite being virulently opposed by computer cybersecurity and voting machine experts who describe the new systems as unverifiable [PDF], unauditable [PDF] and vulnerable to hacking [PDF]. The experts recommend hand-marked paper ballot systems instead.

Cites violations of Constitutional First and Fifth Amendment rights
UPDATED: Court temporarily reinstates Acosta press pass citing 'due process' rights...

On Tuesday, CNN, along with its Chief White House Correspondent, Jim Acosta, filed a federal complaint alleging President Donald J. Trump and high level White House personnel, including Press Secretary Sarah Huckabee Sanders and the U.S. Secret Service, violated their First Amendment free press rights to access White House press facilities.

They also allege the Trump administration violated their Fifth Amendment rights to due process when, without notice or a compelling reason for doing so, the White House rescinded Acosta's press credentials and seized his "hard pass" following a contentious November 7 Presidential press conference.

The complaint goes on to charge that the news organization's First Amendment rights were violated a second time on November 9, when Acosta traveled to France to cover the President's visit and to interview French President Emmanuel Macron during the centenary events commemorating the end of World War I. "The Secret Service refused to allow Acosta to attend an allegedly 'open' press event whose attendees included journalists from around the world," according to the CNN complaint. They did so even though "the French government issued credentials to Acosta." (Ironically, as they also note, Trump did not attend the event "due to inclement weather.")

Citing both facts and case law, the CNN complaint sets forth the argument that the President's actions against both Acosta and the news outlet amounted to an unlawful "attempt to censor the press and exclude reporters from the White House who challenge or dispute the President's point of view". However, that compelling argument, which is now supported by the White House Correspondents' Association, the ACLU and even by Fox "News", may not carry the day at the District Court level given that the case has been assigned to Judge Timothy J. Kelly, a Trump appointee...

Of course, we have to start off with a lovely story: the Wall Street Journal reports that Donald Trump's been caught red-handed, connected directly to the hush money sent to former mistresses.

Then it's onto the two ongoing big stories: horrific fires in Northern and Southern California, and the elections grinding on in Florida, Arizona, and Georgia. Both the NAACP and a passel of retired generals have weighed in against GOP interference.

A review of the numerous headlines on Trump's efforts to alter immigration policy by presidential proclamation, and his loss in the 9th Circuit court on his efforts to undercut DACA.

On today's BradCast: Like clockwork the righwing conspiracy theories regarding pipe bombs begin, as do the voting system failures around the country, less than two weeks before this year's crucial midterm election. [Audio link to show follows below.]

First up today, a few quick updates on the mail bombs sent to several of the many vilified political critics of Donald Trump. In addition to explosive devices sent this week to former President Obama, Hillary Clinton, Eric Holder, John Brennan, Rep. Maxine Waters, George Soros and CNN, additional similar packages were reported today to have been delivered to former Vice President Joe Biden and actor Robert DeNiro. Where Trump and the White House called for unity and an end to divisive rhetoric on Wednesday, for about 5 minutes, both Trump and WH Press Secretary Sarah Huckabee Sanders quickly renewed their vitriolic attacks on the media shortly thereafter and again on Thursday.

Also on Thursday, as investigators reportedly focus on Florida as a possible source for the packages, the rightwing quickly cranked up conspiracy theories about the explosive devices being "fake bombs" meant to discredit the President in advance of the November 6 midterms.

Meanwhile, voting is already underway for those elections, as are the lawsuits aiming to prevent voter suppression and election fraud. A federal judge on Wednesday determined that Georgia may not discard absentee ballots on the basis of "signature mismatch" as determined by partisan officials with no training in hand-writing analysis. The state's legal defense for that statute was rather amazing, as we discuss. Happily, it was thoroughly dismissed by the U.S. District Court judge.

Also, the NAACP has filed official complaints with the state regarding reports of votes flipping in at least four counties on the state's 100% unverifiable touchscreen voting systems. Votes are reportedly hopping repeatedly from Democratic gubernatorial candidate Stacey Abrams to her opponent, Republican Secretary of State Brian Kemp, who oversees and has long defended the states easily-hacked and oft-failed Diebold touchscreen systems. We explain, however, why the reported flips are not likely to be hacks, but why that also doesn't really matter.

Similar, completely predictable voting system and ballot programming failures are beginning to rear their ugly head in other states as well with early, in-person voting now underway in some 30 states. The name of the Democratic candidate for Secretary of State in Arkansas was discovered left off of the touchscreen ballots in one Arkansas county, leading to lost votes and poll closures. And in DuPage County, Illinois, a fiasco erupted this week surrounding the appearance on the ballot (or lack thereof) for a Democratic candidate for the state House of Representatives, resulting in election officials scrambling to distribute paper ballots to early voting locations where, normally, only touchscreen systems are available to voters.

We're joined today by longtime DuPage County election integrity champion and government watchdog JEAN KACZMAREK, who is now the Democratic candidate for County Clerk in DuPage. She joins us to explain what is only the latest mess in a years-long stream of computer voting and tabulation system boondoggles by the Election Commission in the heavily Republican-leaning suburban county west of Chicago, where she has now been endorsed by the local Daily Herald.

Kaczmarek also details the County's astonishing refusal to provide her with serial numbers for the replacement paper-ballot scanners scavenged from unknown sources and recently supplied to the County by its private voting system contractor to replace more than 100 of the machines (originally purchased from Diebold in 2001) after they were damaged by an astounding failure during this year's March primary. The County has told the County Clerk candidate that their refusal to provide her with the serial numbers --- so she may try and determine where the machines were previously used --- is due to a bizarre "security risk" claim.

"I'm concerned mostly because of the lack of a chain of custody. At least the old machines that are in DuPage County have been stored here, and have been maintained here. Yes, I do have issues with those machines, but we do have that," Kaczmarek tells me. "But these other machines, we have no idea where they've been, who has maintained them, how much mileage they have. And I'm concerned there might be problems on these machines, perhaps a virus."

Her concerns are not without warrant, and are similar to such replacement schemes by mystery machines in other states, such as Wisconsin and elsewhere. Earlier this year, for example, at the DefCon hacking conference in Las Vegas, attendees discovered Chinese pop tunes and other software on voting systems recently discarded by elections officials around the country. "Here we are again," she says. "We have no transparency and accountability, and we're told to trust the results."

Finally today, we're joined by Desi Doyen for our latest Green News Report, with a bunch of pretty major environment news regarding a massive hurricane striking U.S. territories in the Pacific, a record year for tropical cyclones, New York state's new lawsuit against ExxonMobil charging the company defrauded investors regarding climate change, and a landmark new carbon tax announced this week by Canadian Prime Minister Justin Trudeau...

Donald Trump screams at Iran in ALL CAPS on Twitter; Iran snarls back. The battle over the Carter Page FISA application release rages, but one thing the GOP can't really fight back on: the case made in those pages looks pretty bad for Team Trump.

A deep dive into an incredibly revealing portrait of Southern Baptist churchgoers in Luverne, Alabama. Stephanie McCrummen at the Washington Post did an amazing job on the story.

Then --- in honor of Adam Parkhomenko & Co's fantastic occupation of Lafayette Park outside the White House --- a conversation with attorney SHEILA THOMAS and Martin Luther King historian CLAYBORNE CARSON. We talk about effective protest, and how the art of protest has evolved since the civil rights revolution.

With Trump's own intel agencies warning of election hacks and the White House contradicting them, disturbing new revelations of voting system vulnerabilities may help explain a 2011 BRAD BLOG exclusive report...

As noted at the top of today's BradCast, it's worth buckling up before listening. [Audio link to show follows below.]

We begin, gently enough, with the news of California's Supreme Court temporarily nixing a billionaire's statewide initiative from this November's ballot which, if adopted, would split the state into three. We explain why the Court removed the measure, for now, thanks to a challenge by an environmental group.

Then, with Donald Trump's own Director of National Intelligence, Dan Coats, warning this past week that "the system is blinking red" in a way that hasn't been seen since just before the 9/11 attacks, the multiple and ever-changing positions by the President of the United States in recent days, regarding whether Russia interfered in the 2016 election and is actively doing so in advance of the 2018 midterms, is all the more head-spinning. Coats was referencing warning signs being reported by U.S. intelligence agencies regarding ongoing attacks and intrusions on America's critical infrastructure --- including our wildly vulnerable electoral systems.

Moreover, new reporting on Trump being read into explicit source details weeks before he was inaugurated in early 2017 regarding Russia's alleged 2016 election intrusion measures, make his ongoing denials, ever-changing positions, and dizzying White House spin to explain them all following Monday's summit with Putin in Helsinki, all the more bewildering. Nonetheless, his own intelligence apparatus and appointees continue to contradict the President, even as the GOP-controlled Congress fails to take any substantive action to either place a check on Trump or even to help protect this November's crucial elections.

At the same time, after the FBI informed Maryland just days ago that its entire election system was being hosted on a private commercial server said to be owned by a Russian oligarch tied to Putin (as discussed in detail on yesterday's BradCast), we learn this week that the top U.S. election system vendor, ES&S, has been lying about remote access software and modems installed, for many years, on systems still used by a majority of U.S. voters.

The new revelations may help explain an exclusive special report published by The BRAD BLOG back in 2011, with an officially-commissioned independent analysis finding that, among other concerns, Venango County, Pennsylvania's ES&S election management system had been accessed by an unknown and unauthorized computer for "several hours" from a remote location. As we reported at the time, ES&S and the County's Board of Commissioners went to considerable lengths, after those revelations, to block a further, independent forensic analysis of the system.

And now, perhaps, we may know why. Kim Zetter reports this week at Vice's Motherboard that the company lied to her and New York Times' fact-checkers earlier this year in advance of her February article at the paper on the inclusion of modems and pcAnywhere remote access software included with the election management systems sold to customers from 2000 to 2006. After previously insisting the company had no "knowledge that our voting systems have ever been sold with remote-access software", ES&S reversed itself in a letter to U.S. Senator Ron Wyden, she reports. But they have refused to respond to the Senator's subsequent follow-up queries or to appear at recent Senate hearings on U.S. election system vulnerabilities.

As Zetter details, pcAnywhere was found to include multiple and serious vulnerabilities over the years, which would have allowed unauthorized intruders to change election results with little chance of detection. Moreover, she explains, many questions remain about why ES&S lied, which jurisdictions around the nation may still feature the same, easily-exploitable flaws, and about electronic voting and tabulation systems manufactured by the nation's other top vendors, believed by expert to likely have included similar remote-access vulnerabilities.

All of that (and more, including our latest Green News Report), just over three months out from this November's midterm elections. Told you to buckle up...

As the GOP's stolen U.S. Supreme Court further undermined American democracy today...and as climate change-fueled extreme weather resulted in a tar sands oil train derailing and leaking hundreds of thousands of gallons of crude into the drinking water supply for Iowa (and perhaps even Nebraska)....and as the President of the United States lied about immigration facts again while calling for the violation of both U.S. and international law by ending all Constitutional Due Process rights for those seeking asylum in the U.S....many of the always-reliable hand-wringers in the corporate mainstream media and the same Rightwingers who went all the way to the U.S. Supreme Court to support a bigoted baker who refused to bake a cake for a gay couple, are just beside themselves that some Administration officials are facing public protests for their abhorrent complicity in undermining so much that the U.S. supposedly stands for.

We detail all of that on today's BradCast, and open up the phones to listeners on all of it, including calls on whether it's appropriate (and/or long overdue) to protest/shun public officials in their private lives (at restaurants, etc.); what really needs to be done regarding immigration (lots of fact-checking today to Trump's continuing lies about it), and whether, as student protester Mario Savio said, when kicking off the Free Speech Movement at Berkeley in 1964, this is a "a time when the operation of the machine becomes so odious, makes you so sick at heart, that you can't take part! You can't even passively take part! And you've got to put your bodies upon the gears and upon the wheels...upon the levers, upon all the apparatus, and you've got to make it stop! And you've got to indicate to the people who run it, to the people who own it, that unless you're free, the machine will be prevented from working at all!"...
