We're back! Both on today's BradCast and even in L.A., after fleeing the state last month to avoid weeks of construction on the roof of the apartment housing our home studio. To no one's surprise, the work is taking longer than we were told, so please pardon our efforts this week to work around it as best as possible after taking last week off to both avoid it and to enjoy the last days of Summer 2023 before the 2024 fight for Democracy (represented this year by Democrats) and Autocracy (represented by a lawless Republican party) begins in earnest.

Among our stories today...

  • Enrique Tarrio, former head of the far-right Proud Boys gang was sentenced to 22 year in federal prison on Tuesday following his conviction for Seditious Conspiracy for his role in the January 6th, 2021 U.S. Capitol insurrection. It's the longest sentence for any of the MAGA insurrectionists to date. Also, of note, Tarrio wasn't even in Washington D.C. that day. Point taken: One didn't need to be personally smashing windows and storming the Capitol to be held to serious account for what happened that day. Got it. Hopefully other jurors in other upcoming related cases will get it as well.
  • The federal Courts are still holding. Mostly. For now. On Tuesday, a three-judge panel found that Alabama Republicans blatantly defied an order from the U.S. Supreme Court to add another Black-majority district to their U.S. House map. The SCOTUS order to do so --- after finding the state violated both the U.S. Constitution and Voting Rights Act with their racially gerrymandered districts --- came in Allen v. Milligan [PDF] in early June. Alabama didn't care. In an unprecedented move, they gave the finger to the Court and drew up a new map with the very same deficiencies featuring just one Black-majority district out of seven, in a state where some 27% of residents are Black. The federal court panel has now assigned a Special Master to draw U.S. House districts for the state, after a lawless Gov. Kay Ivey joined with lawless legislators in the gerrymandered statehouse to defy SCOTUS, the Rule of Law and the U.S. Constitution. Alabama is now appealing the ruling to the same U.S. Supreme Court Justices who rejected their arguments barely three months ago.
  • The story is similar in authoritarian Governor and Presidential candidate Ron DeSantis' lawless state of Florida this weekend. In this case, a state court judge on Saturday ordered the state legislature to draw a new U.S. House map restoring a Black-majority district in Northern Florida that DeSantis had personally ordered state lawmakers to break into pieces and divvy up its Black voters into White Republican districts. The weekend's court order would seem to be good news. However, the State will now appeal the ruling directly to its Supreme Court where DeSantis has hand-picked a majority of the Justices. As we have long been warning, the fight between Democracy and Autocracy (or Fascism, as one of our longtime listeners insists), continues into 2024.
  • Next, I finally catch up with a bunch of news on a growing story --- some of which we've been discussing over the past two years --- that I've otherwise been trying to get to for weeks, but for all of the various indictments, hurricanes, wildfires, debates, etc. continually sidetracking me. The news has to do with the continuing feeling I have that Donald Trump will ultimately not be on the ballot come next November. As noted, that's not a prediction or an inside scoop. It's simply a feeling for now, but one that I can't shake as an increasingly swelling body of evidence seems to support its possibility.

    Today, that evidence includes polling last month finding nearly two-thirds of Americans say they will either "definitely" (53%) or "probably" (11%) not support Trump in 2024. Might such numbers begin to grab the notice of Republican Primary voters? (So far, the answer is largely no. But we've got a long way to go --- and a lot of criminal trials --- before the GOP's nominating convention next July.) There are already a number of high profile Republicans calling on Trump to drop out of the race or noting that he very well may be Constitutionally disqualified entirely from the ballot.

    It is that part of this story today --- disqualification from the ballot via Section 3 of the 14th Amendment of the U.S. Constitution for his role in the January 6 Insurrection --- that we focus on today. Namely, the far-right, Federalist Society legal scholars who recently issued a 126-page law review paper [PDF] finding Trump to be Constitutionally ineligible for the ballot --- "cannot be president --- cannot run for president, cannot become president, cannot hold office" --- due to his roll in the January 6 insurrection.

    And now, there is a host of state Secretaries of State --- both Republican and Democratic --- around the country who are currently or soon to be grappling with the decision as to whether Trump is even eligible to be on their state ballots in 2024.

    Among those Secretary of State's discussed today, after they recently offered various opinions on the matter: New Hampshire's David Scanlan (R); Ohio's Frank LaRose (R); Arizona's Adrian Fontes (D), New Mexico's Maggie Toulouse Oliver (D); Maine's Shenna Bellows (D) and Michigan's Jocelyn Benson (D). (Benson gets credit for the first part of today's headline. REO Speedwagon gets credit for the alternate hed.)

It's January 6 again, so our "weird annual tradition," as our guest describes it today, continues on The BradCast. Sadly, so does the GOP's continuing threat to American democracy, two years after the deadly assault at the U.S. Capitol. [Audio link to full show follows below this summary.]

First up, it is also Day 4 of the House Republicans' failures to select a Speaker. There were some breakthroughs for GOP leader Kevin McCarthy on Friday, however, after 13 unsuccessful ballots (for the first time in 134 years). His desperation to give away pretty much everything in exchange for winning the weakest Speakership in history earned him another 15 votes or so from his GOP opponents. And, with that, he was finally able to get more votes than Democratic House leader Hakeem Jeffries. Nonetheless, he was still shy of a majority as we went to air today. So, the "Never Kevins" are still winning the day and the 118th Congress is still unable to get underway.

As one Democratic member, elected last November for a third term, noted about his time, so far, in Congress: "1st term started with a GOP-led govt shutdown. 2nd term started with a deadly insurrection incited by the former Republican president. And my 3rd term has yet to begin due to @HouseGOP’s failure to elect a speaker. Notice a pattern?"

All of this on the second anniversary of the deadly, Donald Trump-incited insurrection at the U.S. Capitol back in 2021, as one of his last, desperate, failed attempts to steal the Presidency from the American people.

A memorial was held by House Democrats outside the Capitol today, in remembrance of those law enforcement officials who lost their lives while, and just after, defending it on January 6, 2021. We observed no Republicans at the ceremony.

At the White House, President Biden marked the occasion by awarding 14 individuals with the Presidential Citizens Medal. The awardees including three law enforcement officials who lost their lives and five who were critically injured that day. Also, a collection of bipartisan election officials, poll workers and others who defended the 2020 election at great personal threat, after being personally targeted by the former President of the United States and his supporters were honored as well. We share an excerpt from Biden's remarks today on the need to continue defending democracy and recognizing those who "stand watch" over it.

Finally, our "weird annual tradition" of visiting with the author and longtime Philadelphia Inquirer national columnist WILL BUNCH on January 6 continues today. He was with us on the program as the Capitol was under attack back in 2021, initially to talk about a different insurrection of sorts by Republicans at the state Senate in Pennsylvania.

Today was the third January 6 in a row he was able to be with us, and we focused today on the still-missing accountability for the ringleaders of the 1/6/21 attack, and on his latest column tying together that assault on democracy with this past week's GOP chaos and failure to select a Speaker in the U.S. House. They are all, it seems, of a piece, suggests Bunch, noting "the irony of this going on during the January 6 anniversary."

"No matter what sound minds want to get done, this band of obstructionists is in control," he argues. Citing them as "the spoiled children of Trumpism," Bunch says, "I would call them nihilists. They really believe in nothing other than their own air time, raising their own profile."

"Everybody in this [GOP House] leadership group voted to throw out people's votes in the 2020 election," Bunch, a resident of Pennsylvania, whose vote they tried to steal from him on January 6, 2021, notes. And it's not only those who tried to undermine democracy two years ago who have still failed to be held accountable. "The five freshmen who voted against McCarthy all ran as Trumpified election deniers."

"I mean, is it against the law to overthrow the government or not?," Bunch quips today, only somewhat rhetorically.

"The common thread is minority rule," he goes on to observe. "They believe they have some kind of divine right. It's really linked to these hierarchies of American life --- white supremacy, or white privilege, the patriarchy and other things. Running for office as the protectors of that. You're not going to do anything affirmatively to help people. You're just going to stop these people you see as destroyers of your way of life, your culture. It doesn't matter who gets the most votes, because the culture is more important than democracy. I think that motivates these people."

We discuss all of that and much more, as both Bunch and I share our frustration and hope that those who created all of these messes may finally face accountability some day soon...

Just another day on Democracy Watch...cuz someone's gotta...

It's 'Super Duper Tuesday' Midterm Election Day today in Iowa, Mississippi, Montana, New Jersey, New Mexico, South Dakota and California. The good news on today's BradCast? So far, no noteworthy reports, as of airtime, of voting system disasters that we've heard about or been able to find. But the night is young. Results from today's elections, such that we have them, on tomorrow's show. But, don't worry, we've got tons of elections and democracy related news for you nonetheless. [Audio link to full show is posted below this summary.]

Among our many stories covered today...

  • As Philadelphia Inquirer's Will Bunch described it in his email newsletter today, "the multi-millionaire celebrity doctor from New Jersey officially defeated the multi-millionaire hedge fund CEO from Connecticut to become the Republican nominee for U.S. Senate from Pennsylvania." He's mostly correct. The Connecticut hedge fund millionaire, Dave McCormick, did concede late last week to the New Jersey millionaire TV doctor, Mehment Oz amid Pennsylvania's recount in the very close May 17 race to become the GOP nominee for the Keystone State's U.S. Senate contest to replace retiring Republican Senator Pat Toomey. But a concession doesn't actually mean anything. Oz will not become the "official" nominee until the recount is finalized over the next day or so. Then, the Trump-endorsed celebrity TV doctor, who is not a resident of Pennsylvania, but is a Turkish citizen, will become the GOP's "America First" nominee to run against PA's Democratic Lt. Gov. John Fetterman this November. Presuming Fetterman's health holds out. Dems see the seat as among the most flippable this fall...assuming Fetterman's health etc...
  • In other very close primary news, two Democratic recounts in U.S. House primaries now await in Texas. In the state's 28th Congressional District, rightwing, pro-gun, anti-choice Democratic Rep. Henry Cuellar ended the canvass period up by just 281 votes (out of about 45,000 cast) over progressive favorite Jessica Cisneros after their May 24 runoff election. Today, Cisneros officially requested a recount --- and must pay for it, unless she ends up winning it --- despite some obnoxious comments from Cuellar who, himself, ended up winning a 2004 primary recount against his Democratic opponent when he first went to Congress. Back then, he had lost by 145 votes after the canvass, but ended up winning the race by 58 votes after a recount. So, you'd think he'd be a bit less obnoxious in this case...but you'd be wrong. Whoever wins the recount will probably take the House seat in the "blue"-leaning district.
  • In another Democratic primary race for U.S. House in Texas, there was an even closer race, with progressive Michelle Vallejo topping the more conservative Ruben Ramirez by just 30 votes (out of about 12,000 cast) in the state's 15th Congressional District. Ramirez says he too will seek a recount. Whether either of these races will be recounted by hand in the state is unclear. But if the candidates want to know who really won or lost, they will fight for a count by hand, rather than by the same computers that tallied the results in the first place. The winner of the race will face off with Republican Monica De La Cruz in November, in what is expected to be one of the most competitive House races in the state after this year's round of gerrymandering.
  • And speaking of gerrymandering...last month, a state court in Florida found Republican Gov. Ron DeSantis' new U.S. House map to be in violation of the state Constitution after voters, in 2010, added an Amendment that outlaws partisan maps and specifically those that diminish the ability of minority voters to elect their chosen candidate. The DeSantis map was enacted after he vetoed the GOP legislature's already-gerrymandered map and made it even worse by removing a district currently represented by Democratic African-American Rep. Al Lawson. Last month, the state court ordered a new, fairer map, but a state appeals court blocked that order. The appellate decision was quickly appealed by voting rights groups. But late last week the state's GOP state Supreme Court allowed the appeals court's stay to remain in place. That means that DeSantis' extremely gerrymander U.S. House map --- found to have been in violation of the state Constitution --- will almost certainly be used anyway this year. The unconstitutional map allows a GOP advantage in 20 of the state's 28 districts, despite DeSantis having barely won his own election in 2018 in the closely divided state by less than one-half of a percentage point.
  • In somewhat brighter gerrymandering news (at least until the ruling is overturned by the very rightwing 5th U.S. Circuit Court of Appeals), a federal judge in Louisiana on Monday found the state GOP's U.S. House map in violation of the Voting Rights Act. The map --- originally vetoed by Democratic Gov. John Bel Edwards, but overridden by the GOP state legislature --- includes just one black majority Congressional District, out of six, even though the state's population is almost one-third black. LA's Republican Sec. of State has vowed to appeal the court ruling which bars the use of the gerrymandered map. But, given the corrupt 5th Circuit Appeals Court and the GOP's corrupt, stolen and packed U.S. Supreme Court above them, it's a safe bet the state's unconstitutional map will be allowed for the critical 2022 midterms anyway. It'd be nice if we're wrong about that. But don't bet on it.
  • Next, we've been covering, in great detail in recent months, the many schemes by Republican election insiders across the country, in the wake of the 2020 election, to breach proprietary computerized voting systems, make copies of the sensitive software, and even release it to the public in some cases. (See the Mesa County, Colorado County Clerk Tina Peters, who is now facing criminal charges for what she did, or the GOP Board of Elections in Coffee County, Georgia, for just two examples.) While Reuters reports that there have been at least 17 such incidents nationwide, their new exclusive finds that 11 of them took place in Michigan. Based on public records requests, the new outlet found discovered that there has been "a flurry of efforts by state authorities to secure voting machines, poll books, data-storage devices and phone records as evidence in a probe launched in mid-February." Luckily, the state has a Democratic Governor, Attorney General and Secretary of State, the latter of whom tells Reuters that law enforcement officials are now probing whether the broad election system breaches by GOP "fraud" dead-enders are coordinated. This in a state where even the GOP state legislature issued a report finding no evidence of widespread fraud and called for the prosecution of those who fraudulently claimed that there was. "If there is coordination," Sec. of State Jocelyn Benson told Reuters, "whether it's among those in our state or reaching up to a national level, we can determine that and then we can seek accountability for all involved." Rogue Republicans and rogue Democrats on today's BradCast. [Audio link to full show is posted below this summary.]

First up, the rogue --- and really dumb --- Republican in Michigan's Adams Township. The Township Clerk there, Stephanie Scott, was elected last November and is certain that the election must have been fraudulent, even though she won and Trump was certified as defeating Joe Biden in the County by 48 points. (That's more than Trump won by in 2016!) Scott was a QAnon loon before the 2020 election and even more so since then. This week, she was removed by the State Elections Bureau from her job and replaced, for now, by the Republican County Clerk in Hillsdale County (home of Adams Township), who discovered on Tuesday that the Township's tabulation computer, the "brains" of the whole system, is now missing in advance of next week's local elections.

Michigan State Police are said to have launched a criminal investigation, and Scott seems to admit to a Michigan news outlet that she stole it, claiming that the vendor, Hart Intercivic, was coming in to perform routine maintenance that was actually a secret scheme to delete all of the evidence of fraud on behalf Joe Biden in the 2020 election. Or something. The Township votes on hand-marked paper ballots. So if the new Clerk had any actual concerns about whether the computer accurately tabulated results last year, she might have tried hand-counting those paper ballots to find out. The population of the entire Township is only about 2,500 people. But apparently Scott is not particularly bright, despite all of her QAnon "research".

We unpack the entire insane incident, which echoes one from a few months back, where the Republican County Clerk in Mesa County, Colorado also had to be replaced by the Sec. of State after she brought two people with her into the secure area where voting systems are stored in the middle of the night, turned off the security cameras, made full, unlawful copies of the hard drives of the Dominion Voting System's Election Management software and then released it to the Internet during MyPillow CEO and failed conspiracy theorist Mike Lindell's so-called "cyber symposium" in South Dakota. The unlawful release wreaked havoc and a call for "emergency action" before California 's Gubernatorial Recall election just weeks later. The Mesa County Clerk is also facing a criminal investigation because, ya know, they're all "law and order conservatives" who think it's just fine to steal voting systems and software when they feel like it.

Of course, there are very real concerns about vulnerabilities in such voting systems, though zero known evidence to date that any of them were used to steal any election last year. But these lamebrains don't seem to have a clue what the vulnerabilities actually are or what to legally do about them, even though many of us real Election Integrity advocates have been showing them how to do exactly that for nearly 20 years.

As to the Democratic rogues in our stories today, we're joined again by the great HEATHER DIGBY PARTON of Salon and Hulaballoo to talk about Senators Joe Manchin (WV) and Kyrsten Sinema (AZ) and if their real game is actually to undermine the entire Biden agenda by weakening, stalling and then ultimately just killing the Build Back Better bill.

The pair have already succeeded in gutting a number of the most popular key provisions of the bill favored by progressive and centrist Dems alike, and even by Republican voters (if not members of Congress). Though there are a boatload of critical, long-overdue and progressive programs still left in what the White House described as the bill's new "framework" [PDF] on Thursday. But do Manchin and Sinema intend to let even that much go through to full passage? Or are they playing a different game entirely? We discuss it all with Digby today.

We also discuss the painfully disinformed, so-called "progressives" out in the Twittersphere and beyond who are actually either gullible enough or disinformed enough to believe that Biden and Pelosi and Progressive Caucus Chair Pramila Jayapal --- not to mentioned Bernie Sanders and Alexandria Ocasio-Cortez(!) --- have all been coopted by "corporatists" (or something) to undermine Biden's own agenda and the bill that the entire Democratic caucus, save for Manchin and Sinema, would have approved months ago when it was twice the size in dollars.

The corporate media also come in for criticism again today, for their failure to accurately inform the American people of the wildly popular provisions that were and still are in the still-transformative Biden agenda (even as Democrats themselves share some of that blame). Instead, the media have turned the negotiations over Build Back Better into a misleading game of (paid for) spending numbers and a "showdown" between "progressives" and "centrists". In fact, it's always been a no-choice effort by Congressional and White House Dems to win the must-have votes of Manchin and Sinema --- ("The Diva Twins" as Parton calls them) --- who have opposed many of the bill's most popular programs in a 50/50 Senate.

House passes H.R.1., so now what?; MI audits find 2020 results accurate, so now what?; AZ Senate finally gets ahold of Maricopa County's 2020 ballots, so now what?; GOP Congressman admits to three counts of felony voter fraud...so guess what?!...

We've got mostly democracy-related stories to report on today's BradCast. Some good news, and some bad. But there's a whole bunch of anti-democracy GOP fraud throughout, because what democracy story in the U.S. these days doesn't include Republican fraud and/or attempted voter suppression? Among the stories covered on today's show...

  • We start with one story that has little to do with democracy, though it should be enough to ensure these two idiot Governors are never elected to anything ever again. In case you are unclear just how idiotic the Governors of Texas and Mississippi are, after they lifted all COVID restrictions in each state this week in hopes that folks won't notice how horrifically they failed their own constituents following the winter storm there three weeks ago, Axios reports today that, while COVID infections rates are still falling in most states, the rate in Texas is up 27 percent over the past week and Mississippi's is up a nation-leading 62 percent! Luckily, both states are islands, so the idiocy of their Republican Governors won't effect everyone else's efforts to get beyond this pandemic once and for all, right?
  • House Democrats, as expected, passed H.R.1 --- the "For the People Act" --- on Wednesday night with zero Republican votes. The massive, landmark, once-in-a-generation voting rights, campaign finance reform and ethics reform bill now moves to the Senate. In that undemocratic body, however, where a simple majority is NOT enough to pass a democracy reform bill as of now, it will likely die, unless enough pressure is applied on Democratic Senators Joe Manchin of West Virginia and Kyrsten Sinema of Arizona to do the right thing, reform the filibuster, and allow this critical (if imperfect) measure to pass while Democrats have a brief opportunity right now to do so. The measure is long overdue and, according to new polling, wildly popular with the American people of all parties. 68% of likely voters favor the bill, and even a majority of Republicans (57%), back it as well.
  • The sad (and dangerous) Trump/GOP effort to con Americans into believing last November's election was stolen from the disgraced former President --- despite all evidence to the contrary --- continues.  And the massive evidence to the contrary continues to mount. This week, Michigan's Secretary of State announced that the results of a second statewide post-election audit once again confirms the initially reported results. "All of Michigan’s more than 250 election audits are now complete, and each and every one of them affirmed the integrity of the November election and the accuracy of the results," Sec. of State Jocelyn Benson said on Thursday. The audits were carried out by "More than 1,300 Republican, Democratic, and non-partisan election clerks...working across the aisle to review one another's procedures, ballots and machines in coordination with the state Bureau of Elections." Full hand-counts were carried out in some places, such as Antrim County, where Republicans pretended that Dominion Voting Systems machines were used to try and steal the election from Trump.  And, in heavily populated cities like Detroit, election officials determined that, of 174,000 absentee ballots tallied in the city, only 17 votes were ultimately "out of balance" (where the number of ballots cast in a precinct differed from the number of envelopes or signatures accounted for.)
  • But the most embarrassing state GOP idiocy of the week may belong to the Republican-controlled state Senate in Arizona. After months of subpoenas to elections officials, ordering them to turn over all 2.1 million ballots cast in Maricopa County (Phoenix) last year --- and even coming within one vote of throwing elections officials there in jail for following state law by securely retaining custody of the ballots cast in the County last November --- a state judge finally ordered Maricopa officials to obey the subpoena to deliver all ballots to the Senate, so they could count them themselves. They were all delivered, 73 pallets of them, this week. And guess what? Senate Republicans have no idea what to do with them now.  The story is even worse than it sounds, as we discuss today.
  • But at least officials in Kansas were finally able to find some voter fraud. Specifically, voter fraud by now-former Republican U.S. House Rep. Steve Watkins of Topeka. The one-term Congressman was defeated last year. But not before he lied about his residence, using the address of a UPS store on his voter registration, voted in an election he was not entitled to vote in, and then lied to state investigators about it all.  He was charged with three felonies related to voting. This week, however --- because, luckily, he is a white, male Republican from Kansas --- prosecutors are allowing him to enter a diversion agreement that delays his trial for six months, and drops the charges entirely if he's a good boy through September. We compare his treatment to that of Crystal Mason, an African-American mother of three in Texas, who, unlike the Kansas Congressman, had no idea she was violating the law when she cast a provisional ballot that was never counted in the 2016 election. She received a sentence of five years in prison for her "crime".
  • Finally, we're joined by Desi Doyen for our latest Green News Report, as climate change has resulted in the weakest Gulf Stream in about 1,000 years; carbon emissions are rising again as COVID restrictions are loosened; Joe Biden raises U.S. targets under the Paris Climate Agreement; and another major carmaker announces plans to stop selling all gas burning, internal combustion engine vehicles in their line in very very short order...

Another weekend of sore-loserism, lost court battles, phony fraud claims, unlawful election interference by the President of the United States; Also: Trump Admin ignores own EPA scientists to assure more U.S. deaths...

If you think the monster is actually, truly dead now, it's only because you still need to watch more horror movies. You'll have to listen to today's show for most of the juiciest details, but among the stories covered today on today's very busy BradCast [Audio link to show is posted below summary.]

  • Not satisfied with helping to assure the deaths of nearly 300,000 Americans during the COVID crisis so far, the swamp-filled Trump Administration ignores their own EPA scientists to join the polluters of the fossil fuel and chemical industries to block a rule that would require a slight decrease in particulate soot that would save more than 10,000 American lives a year. Because of course they do;
  • Loyal Trump henchman and Attorney General Bill Barr reportedly considering quitting before he's fired by Trump for having the temerity to admit there is no known evidence that would turn the loser Trump into a winner in the 2020 election;
  • More than 1,500 lawyers --- some of them former former federal judges, prosecutors and law professors --- call for bar associations to investigate the "historic abuse of the legal system" by Team Trump attorneys, like the COVID-stricken Rudy Giuliani and the execrable Joe diGenova (who called for a former federal official to be "shot" because he believed the 2020 election was secure) to be held accountability for their behavior. The letter cites false claims of "massive fraud" by Trump's attorneys, even as those same attorneys concede in court case after court case --- they and their allies have lost about 50 cases at this point --- that they have no actual evidence of fraud;
  • After losing at least five different cases in five different swing-states on Friday alone, Trump continues his record as a loser on Monday, with an Obama-appointed federal judge in Michigan tossing one case, and a George W. Bush appointed-judge in Georgia tossing the other. Both rulings were brutal dismissals;
  • The President's false claims of a stolen election continue to have very serious consequences, as an armed MAGA Mob on Saturday night descended on the personal home of Michigan's Secretary of State to terrorize her and her children as they were preparing for Christmas;
  • Also down in Georgia today, the state's Trump-supporting Secretary of State Brad Raffensperger --- who, along with the state's Trump-supporting Gov. Brian Kemp, has been mercilessly attacked by Trump --- re-certified the state's Presidential election finding Biden won it by about 12,000 votes. The new certification comes after the election night machine count, a statewide hand count, and a third statewide count by machines as requested by the Trump Campaign. He lost every single time by about the same numbers in all three tallies;
  • On Saturday morning, the President of the United States violated the law in a call to the Republican Governor of Georgia to try and convince him to take action to toss out the election results and direct the state legislature to declare the loser Trump to be the winner. To Kemp's credit (a phrase I thought I'd never type), he refused to do what Trump demanded. To Trump's wrap-sheet, he has added yet another violation of law in trying to interference with an election. 45 days until legal accountability for Trump's many crimes should begin;
  • On Saturday night, Trump went down to Georgia --- where he's in a bind, cause he's way behind --- to hold a rally for the two incumbent Republican Senators facing a tough challenge in their U.S. Senate runoffs on January 5th, where controls of the U.S. Senate is at stake. Trump spent most of the nearly two-hour long rally whining about losing the election as he repeated phony, long-ago debunked claims to continue hoaxing the MAGA Mob into believing it was stolen from him and that they are all "victims". The two U.S. Senators spoke for about 30 seconds each;
  • Finally, despite Trump's unsullied record of embarrassingly losing case after case, trying to overturn the will of the voters in both state and federal courts around the country --- in cases overseen by Republican and Democratic judges alike, including several that he himself appointed --- U.S. Supreme Court Justice Samuel Alito took an action over the weekend that has a few Court watchers justifiably unsettled. As we reported on last Friday's BradCast, Alito agreed to consider an appeal to a case filed by U.S. Rep. Mike Kelly (R-PA), seeking to toss out Pennsylvania's results and award the state's electors to Trump. The matter was correctly dismissed by lower courts, but Alito has agreed to consider it and, late last week, scheduled this Wednesday, Dec. 9, as the deadline for defendants to file their rebuttal. That was key, because Wednesday is the day after the so-called "Safe Harbor" date under federal law, when all state Electoral College contests are supposed to be settled, at least at the state level, on Tuesday, Dec. 8. Last week, election law experts saw Alito's late date for defendants to reply as a message that he would not be taking any actions that might change the electoral count. But on Sunday morning, Alito changed that deadline to the morning of Tuesday, "Safe Harbor" day. What does that mean? And should we be worried that the monster isn't really, truly dead just yet? We discuss...

We've got a lot to get to on today's BradCast, as voters in Massachusetts go to the polls today with a couple of very interesting primary races (results tomorrow!), and as the rest of us are now counting the days (63 of them), until general Election Day, with both hope and trepidation. Among the mountains o' stuff covered on today's program...

  • After years of our reporting on the very successful, perhaps irreversible, decades-long effort by the Right to brainwash its followers, we open today with a few thoughts about a similar, if not quite as successful (though it's getting closer), effort to brainwash those on the Left. That effort to brainwash the Left, like the scheme on the Right, is also carried out by folks on the Right or those who support them. (And yes, that means we have a few words today about the still-misreported facts regarding the Hillary/Bernie race from 2016);
  • We have more evidence of attempts to manipulate the Left in today's announcement from Facebook that, based on a tip from the FBI, the social media outlet has shut down several fake accounts created to support a Russia-related propaganda scheme targeting the Left in hopes of undermining Joe Biden and Kamala Harris. The operation reportedly included a phony media outlet calling itself "Peace Data", in hopes of appealing to progressives in advance of this year's election;
  • Information of that sort, as we discuss, is --- or should be --- useful to voters. Nonetheless, with just over two months until Election Day, with Donald Trump's top intelligence officers having recently warned that Russia is taking active measures, once again, to undermine the Presidential election in support of Trump, his recently-appointed Director of National Intelligence John Ratcliffe notified Congress over the weekend that he will no longer offer in-person briefings to lawmakers regarding foreign attempts to interfere in the election. The claim, offered by Trump himself without facts to back it up, is that members of Congress were illegally leaking certain information from the intelligence community, and that the information leaked was also "wrong". No evidence was given to support that charge, and while Trump claimed the decision to end intelligence briefings to Congress was made by him and Ratcliffe, evidence suggests that it was, instead, a directive from Trump himself. For some reason;
  • Speaking of the November 3rd election, the dirty tricks are now underway, as revealed by a new robocall to some Democratic-leaning Michigan voters falsely warning that signing up to vote by mail will result in voters contact information being added to a database for tracking down arrest warrants, credit card debt collection and "mandatory vaccines". None of that is true. Though you should expect much more of it in the weeks ahead;
  • Also in Michigan, the state's Democratic Secretary of State Jocelyn Benson, recently won a court case filed by rightwingers attempting to prevent her from sending absentee ballot applications to all of the state's 7.7 million voters. The ruling --- in a state which Trump is said to have won by just over 11,000 votes in 2016 --- comes in the wake of his misfired threat to withhold federal funding from Michigan in a tweet in which he falsely claimed the "rogue Secretary of State" was planning to send out actual ballots (as opposed to applications) to all voters;
  • And while Trump and his minions have been suing in state after state in (usually failed) efforts to make voting more difficult during the global pandemic that he failed to control --- even attempting to block the use of secure absentee ballot drop-boxes in key battleground states like Pennsylvania --- another newly elected Democratic Sec. of State, Jena Griswold in Colorado, announced today that her state will offer "at least 368 mail ballot drop boxes for the General Election, an increase of 49% since I was elected in 2018!";
  • Also today, a somewhat bizarre comment from a reader/listener in response to our coverage yesterday of L.A. County's disastrous, unverifiable new touchscreen voting system, in which the commenters offers several odd allegations amid of my nearly 20 years of critical coverage of e-voting and asks "whose side are you on?";
  • Finally, Desi Doyen joins us for our latest Green News Report in the wake of catastrophic week for the climate and the Republican National Convention...

Our esteemed guest on today's BradCast argues "Donald Trump is literally a threat to the planet and to all living things on the planet." He is right and has the evidence to prove it. So do we all. [Audio link to today's show is posted below.]

Statewide stay-at-home orders are still in place in Michigan, even as the state was forced to order more than 10,000 residents to evacuate their homes amid record rain and flooding and two "catastrophic dam failures" in the central part of the state on Tuesday and Wednesday. That disaster comes on top of the ongoing COVID-19 crisis, presenting an impossible challenge for Michiganders and their Governor, Gretchen Whitmer. And, all of it could be made far worse thanks to the Dow Chemical company headquarters in swamped Midland, MI and some 50 miles of toxic SuperFund cleanup sites along the banks of the swollen Tittabawassee and Saginaw Rivers where the company dumped poisonous, cancer-causing waste for years.

Amid all of that then, our President of the United States felt today would be the perfect moment to attack the state on Twitter with completely false claims about absentee voting fraud (which he knows a thing or two about, having committed absentee voter fraud himself in the state of Florida this year), while threatening to cut off federal funding to Michigan in the bargain if their Sec. of State dares to lawfully send absentee ballot applications to all registered voters this year.

Interestingly enough, Donald Trump has made no similar threats to states with Republican Secretaries of States doing the very same thing this year to help keep voters safe during a global pandemic.

Meanwhile, speaking of absentee voting, Oregon's primary election was Tuesday, in a state with a Republican Secretary of State that mails actual, postage-paid ballots out to every single registered voter in the state in every election, including the primary Trump won there (without any competition) on Tuesday. We cover that and the other noteworthy, if less than surprising reported results today, including a doozy of a U.S. Senate nominee that Republicans have decided to put up against popular incumbent Democratic Sen. Jeff Merkley.

There has been one, let's call it, "bright" spot amid the ongoing coronavirus crisis, and that has been the unprecedented plunge in global carbon emissions and other dangerous pollutants as restrictions implemented to fight the virus resulted in abrupt reductions in driving, flying and industrial output across the globe. The effect on the climate, according to a new study by the Global Carbon Project, published in the Nature Climate Change journal this week, has been a record breaking daily drop in emissions of some 17% at the peak of global shutdowns in April. That stunning reduction of more than 1 billion tons of carbon dioxide output, according to the researchers, is likely to result in as much as a 7% reduction in dangerous greenhouse gas emissions in 2020, depending on the pace at which ordinary life resumes across the planet. The annual reduction would be about the amount that climate scientists have long urged we must cut every year --- for many years in a row --- in order to avoid the worst effects of man-made global warming.

We're joined today by climate science expert and author DR. MICHAEL E. MANN, Distinguished Professor and Director of the Earth System Science Center at Pennsylvania State University, to discuss the new study; the climate crisis-fueled disaster in Michigan ("As we warm up the planet, as we warm up the surface of the oceans, we put more moisture into the atmosphere. ... So you get more of these extreme rainfall events. This isn't rocket science. It is a basic prediction that we made decades ago. And, unfortunately, we're seeing that prediction has come true."); the climate crisis-fueled SuperCyclone currently pummeling the poorest regions on Earth in India and Bangladesh ("It drives home another pernicious aspect of climate change --- that many of the worst impacts are being felt by those with the least resources in the Third World...That's one of the inequities of climate change that we're literally watching play out right now."); and whether it is actually possible for society to cut enough emissions to mitigate the many future climate crisis-fueled disasters that await as greenhouse gas production continues to threaten the future of human civilization.

As the new study warns, even with the startling --- if temporary --- decline in emissions over the past two months, we have only reverted to 2006 levels at the moment. If this virus-driven decline were to stay in place --- which it won't --- it seems impossible that society would be able to do the same thing, year after year, to meet the targets even of the conservative 2015 Paris Climate Agreement.

"It's impossible through individual behavioral change alone. That's what this really drives home," Mann warns. "In fact, it's a bit more of a challenge because we probably need to decrease our carbon emissions by more like 10% a year, year after year for the next decade, to have any degree of confidence in avoiding dangerous warming of the planet."

But, he says, it is not impossible. "Last year, there was actually some really good news. Global carbon emissions didn't go up at all, even though economic activity did continue to increase. The International Energy Agency looked at the reason for this, and for the first time, they were able to say that the reason for that wasn't an economic downturn --- we've seen that in the past, where there's an economic downturn and carbon emissions stop going up. No, this time they were able to attribute it to the increased deployment of renewable energy --- wind, solar, geothermal --- around the world. So we know that the structural changes that are underway are starting to flatten the curve, but flattening it isn't enough. We got to come down the other side of that curve, and we've got to do it dramatically to avert dangerous warming."

"There's rigorous academic research that provides a roadmap," Mann tells me. "It's a matter of political will. It's not a matter of physics. The laws of physics don't say that we can't do this right now. It's only our policies that are preventing us from doing this."

"But it's not going to happen if we don't have the leadership," he explains. "And that's why it's so important for people to turn out and vote in this next election. And to vote on the issue of climate and environmental sustainability. Only if people come out and indicate decisively that this is the direction they want to see us go, will it happen."

The biggest roadblock to that, right now? The man who sits in the Oval Office who is actually making things worse, instead of better. Though "this shouldn't be partisan," he says, "Donald Trump is literally a threat to the planet and to all living things on the planet. It appears we may survive a single term of Trump. But, in the sense of a continued thriving planetary environment, I don't think we can survive two terms of Donald Trump."

On today's BradCast, good news for voters in Wisconsin and Michigan, not nearly as good news for Donald Trump. [Audio link to show follows below.]

First up today, the White House is desperately scrambling for new distractions from Trump's unpopular, nearly month-long federal government shutdown and, of more pressing import for the President on Friday, an explosive report published Thursday night by BuzzFeed News. The otherwise uncorroborated article alleges that Trump instructed his former personal lawyer Michael Cohen to lie to federal investigators about the Trump Organization's proposed deal to build a Trump Tower in Moscow. The story cites two unnamed sources as "federal law enforcement officials involved in an investigation of the matter" and claims that Special Counsel Robert Mueller's office learned about the directive "through interviews with multiple witnesses from the Trump Organization and internal company emails, text messages, and a cache of other documents."

Cohen has admitted to lying to Congress and federal investigators about a number of matters and was sentenced last November to three years in prison after cooperating with Mueller's probe. If the story proves true that Trump instructed him to lie about the project --- which was reportedly still being worked on by Trump through June of 2016, much later than he had initially admitted --- it would, according to Democrats today, amount to evidence of the subornation of perjury as well as obstruction of justice, both impeachable offenses.

We also share the reaction today from Trump and the White House, neither of which denied the reporting initially, choosing to attack Cohen and BuzzFeed instead. Later, Trump's attorney Rudy Giuliani asserted that "Any suggestion --- from any source --- that the President counseled Michael Cohen to lie is categorically false." [POST-SHOW UPDATE: In a rare and carefully worded statement issued late Friday evening by Mueller's office, after we got off air, they disputed BuzzFeed's "description of specific statements...and characterization of documents and testimony obtained" by the Special Counsel.]

In other news today, a federal judge in Wisconsin on Thursday made short order of a challenge to new limits on Early Voting and allowable polling place IDs in the state after Republicans rammed through new restrictions during an extraordinary lame-duck session of the legislature last December, following Governor Scott Walker's re-election loss in the November midterm election. Thanks to heavy turnout, including record Early Voting numbers, Democrats won every statewide contest on the ballot and 54% of the votes for the State Assembly. But, thanks to partisan gerrymandering by state Republicans, they won only one third of its seats.

In a terse, 5-page ruling [PDF] on Thursday, U.S. District Judge James Peterson ruled it was "not a close question" that the GOP's newly enacted voting restrictions were an unconstitutional violation of voting rights, just as he had found nearly identical provisions to be, as passed by GOP lawmakers in 2016.

We're joined today by ANALIESE EICHER, one of the named plaintiffs from One Wisconsin Now's lawsuit challenging both the 2016 law and the late 2018 lame-duck version which Walker signed just days before leaving office. In addition to that court victory on Thursday, the non-partisan group had another on Friday, when a different court ruled that Republican lawmakers were in violation of the First Amendment by blocking the organization and others on Twitter. (Heads up, Alabama Sec. of State John Merrill!)

In neighboring Michigan, the new Democratic Sec. of State Jocelyn Benson announced she was seeking a settlement with Democratic challengers to the legislative and Congressional districts drawn by Republicans in that state. The previous Sec. of State, a Republican, was preparing to defend what Dems describe, with very good evidence, to be an extreme and unconstitutional partisan gerrymander after the 2010 Census. (One such piece of evidence are emails from GOP lawmakers discussing districts mean to "give the finger" to a former Democrat Congressman, and to "cram ALL the Dem garbage" into four districts so Republicans could control more seats across the state.)

A settlement with the newly seated SoS could result in new district maps drawn before the 2020 election. Last November, MI voters approved a ballot initiative that would put an independent redistricting commission in charge of drawing maps following the 2020 Census.
