Today on The BradCast: Analysis (and giddiness) continues amid the fallout from Election 2025, during which the bottom appeared to drop out for Team Trump --- at least for now --- pretty much everywhere that voters turned out in some 30 states holding off-year local or statewide elections. [Audio link to full show follows this summary.]

We're joined today by listener faves and fellow old-school bloggers HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo and 'DRIFTGLASS' of the Professional Left Podcast in the wake of Tuesday's remarkable elections, in which Democrats and other anti-Trump voters made their opposition to the failed first year of the second Donald Trump presidency crystal clear --- even to Republicans who care to take notice.

Not only did Democratic candidates --- from the left to the center --- win, so did ballot initiatives supported by them. And, not only did they all win, they all won by huge margins in virtually every jurisdiction across the country holding elections on Tuesday, in both high and low profile contests and ballot initiatives from Maine to New York City to New Jersey to Virginia to Georgia to Mississippi to Pennsylvania to California and beyond.

"Trump and Trumpism, and this style of politics that he has brought into the Republican Party, the cult of personality that has been dominating our country over the last decade --- I think we can see a light at the end of the tunnel here," Digby argues. "Trump is now officially a lame duck. It's earlier than people thought it would be. It sent a shock-wave, I think, through the Republican Party that he's on his way out. And now, let the games begin. Because the fighting within the Republican Party is going to be a glorious thing to see."

"I was surprised how deep the coattails were, how deep the 'blue' ran in all these elections," observes Driftglass. "I am very confident now that a bunch of 'blue' states can redistrict with confidence." Rooting on Texas Republicans to please proceed with their gerrymandering, he continues: "Please, go ahead and do that. Because I think they did not understand that lots of large blocks of voters were not theirs permanently. We saw huge shifts in almost every demographic [on Tuesday]. 'Blue' won everywhere. And that should send a signal to Democrats everywhere it's okay to take risks, it's okay to be who you are, say what you believe and swing for the fences, because that is now being rewarded."

Guest: John Nichols of 'The Nation' on Election 2025, Mamdani, Trump, Newsom and what it all portends moving forward into 2026...

We've covered a lot of Election Nights on The BradCast over the years. But it's difficult, if not impossible, to remember one where Democrats (and anti-GOP, anti-Trump voters) won pretty much everything in every corner of the country. [Audio link to full show follows below this summary.]

True, it was an off-year election. Only about eight states even had statewide contests. But there were also local races in about 30 states. And, wherever voters voted, Team Trump lost on Tuesday. Badly. From "blue" California, to "purple" Virginia, to rural Maine, to battleground Pennsylvania, to deep "red" Mississippi and everywhere in between. And they lost by a lot in almost every case, whether it was for a candidate or an initiative on the ballot.

We run through as many reported results as we can fit in today --- both high profile contests and some that were deep under the radar --- before sharing an excerpt of the electrifying victory speech from Democratic New York City Mayor-elect Zohran Mamdani, who just blew the roof off the Brooklyn Paramount Theater with one of the best victory speeches I have ever seen. Actually, one of the best political speeches, of any kind, I have ever seen.

Then we're joined by longtime progressive journalist and author JOHN NICHOLS of The Nation magazine, where has been covering Mamdani, and many other progressives up and down the ballot --- along with the more centrist candidates in between --- for many months now, during the run-up to Tuesday's elections: the first time since Donald Trump took office for his failing second term that voters have been able to register their opinions about him at the ballot box in a whole bunch of states at once.

"We have had so many conversations where we are trying to find the straw" of good news following an election, Nichols observes, referencing our many post-election conversations. "But now we are in the bizarre, reverse position where, when you look across the entire United States, you are very hard pressed to find any disappointing results. And the reason for that is pretty simple. Donald Trump, a year after his election, nine months into his second presidency, it has been an unmitigated disaster."

"Last night, you got the confirmation that across this country, from New York to Virginia, to New Jersey to California --- but also to Mississippi, where they took away the Republican supermajority in the state Senate; to Georgia, where they were winning Public Service Commissions that they never win; to the Pennsylvania Supreme Court, Mayoral races in Iowa --- it was just across the board that Democrats won and won and won."

Beyond that, however, there are a lot of details to discuss, regarding why it happened and what message both Republicans and Dems need to take from what happened on Tuesday and, in particular, from the landslide election of the charismatic, 34-year old, Ugandan-born, Muslim, Democratic socialist immigrant whose charm offensive, good humor and promises of a tangible Affordability Agenda for NYC have now made him its next Mayor. And how, incredibly, it is even possible that many establishment Democratic Party leaders --- including U.S. Senate Minority Leader Chuck Schumer of New York --- couldn't bring themselves to endorse the Democratic nominee for Mayor of NYC.

Are they most fearful that Mamdani will be a failure? Or that he will be a success?

Today was Election Day for major contests in New York City, New Jersey, Virginia and California, not to mention about 30 other states which also held either statewide or local off-year contests. We'll have full reported results for you, of course, on tomorrow's BradCast. [Audio link to full show follows this summary.]

In the meantime, there was a whole lot going on today, while America votes...

  • Several polling places were temporarily closed in more than half a dozen New Jersey counties on Tuesday following threats, reportedly via email, ultimately determined by officials to be "non-credible". One local official suggested the emails may have originated "abroad", bringing to mind the emailed bomb threats that resulted in temporary evacuations of a number of polling places in at least five different battlegrounds states on Election Day during the 2024 Presidential election. Those threats were reported, at the time, to have come from IP addresses in Russia.
  • Former Vice President Dick Cheney died on Monday at the age of 84. His family announced the news today. We share some thoughts.
  • The Trump Administration has fired yet another government watchdog whose job it was to root out waste, fraud and abuse at a federal agency. This time, according to a Reuters exclusive, it was the acting Inspector General at the Federal Housing and Finance Authority (FHFA), whose Trump-appointed activist Director, Bill Pulte, has been issuing bogus criminal referrals to the DoJ about "mortgage fraud" purportedly committed by Donald Trump's political foes, such as New York Attorney General Letitia James, Federal Reserve Board Governor Lisa Cook, and Sen. Adam Schiff (D-CA). The IG in this case, a 40-year veteran DoJ prosecutor, was said to have been in the process of notifying Congress that FHFA leadership was violating the law by refusing to cooperate with the Office of the Inspector General. To date, the Administration has fired almost 20 IGs at almost every major (and not-so-major) federal agency or department.
  • Trump's corrupt Attorney General Pam Bondi filed legal documents on Friday in hopes retroactively fixing some pretty huge problems with the weaponized political indictments of former FBI Director James Comey and NY A.G. Letitia James. The filings attempt to rewrite history regarding the corrupt and almost certainly unlawful appointment of Trump's former insurance lawyer, Lindsey Halligan, as Interim U.S. Attorney in the Eastern District of Virginia. She was expressly appointed to the position after Trump's previous USA either resigned or was fired for refusing to file the politically motivated charges demanded by Trump, due to lack of evidence.
  • Trump, almost certainly looking at an embarrassing loss tonight in California's Prop 50 initiative --- which would temporarily rewrite the state's Congressional map in response to a Trump-ordered U.S. House gerrymander in Texas over the summer --- was already falsely claiming this afternoon that the contest was somehow "rigged". CA's Sec. of State called out his evidence-free bullshit in a statement late today.
  • Speaking of the Gerrymandering Wars kicked off by our desperate and incredibly unpopular President, Gov. Wes Moore, in the Democratically-controlled state of Maryland, announced a new Commission to consider jumping into the redistricting game before 2026. Maybe.
  • Voting Rights advocates had a big victory on Friday, as one of two federal judges overseeing different lawsuits against Trump's bogus election-related Executive Order, issued a permanent ban on his attempt to mandate proof of citizenship documents by those registering to vote with the national voter registration form. The judge made clear --- as we did when Trump originally issued his dumb EO --- that Presidents have zero legal or Constitutional authority regarding elections.
  • Finally, Desi Doyen joins us for our latest Green News Report, with a grim humanitarian crisis brewing in Jamaica and elsewhere in the Caribbean following last week's monster Hurricane Melissa; record rainfall in New York City; incredibly alarming glacial retreat in Antarctica; and the Trump Administration's Godfather-like thuggery used to block the world's first-ever emissions rules for international shipping...

As the Federal Government shutdown enters its second month --- now almost certain to become the longest in U.S. history --- it's Election Day tomorrow in the first major elections since our ridiculous and criminal President's disastrous second term began ten hellishly long months ago. It is the first chance for a whole lotta folks to ring in on what theythink of this President and his corrupted Party. So, this week on The BradCast, we continue to keep our eyes on both tomorrow's major off-year elections in several states and next year's critical midterms in all 50, as that election is also already underway in more ways than one. [Audio link to full show follows this summary.]

Tuesday is the last day to vote in statewide elections for Governor and the state House of Delegates/Representatives in Virginia and New Jersey, respectively; Mayor in New York City; and for (or against) Prop 50 in California, among other contests of note that we've been discussing and/or previewing in recent days on the program.

After a few news headlines today, we zero in on the Prop 50 statewide ballot referendum in CA, asking voters if they would like to temporarily allow the state to set aside the U.S. House map drawn by CA's Independent Redistricting Commission in order to allow the Democratic state legislature to create a new one meant to flip five Republican seats to Democratic next year. That effort is in direct response to the Republican state Legislature in Texas, earlier this year, gerrymandering their already-gerrymandered Congressional map to steal five Democratic U.S. House seats for Republicans next year at the orders of Donald Trump who, justifiably, believes his Party will otherwise lose their slim House majority next year due to their terrible, unpopular policies.

(I also share today my amusing, bemusing and confusing experience in the parking lot of an L.A. County Voting Center on Sunday, where I went to vote and was troubled to notice a County voting system IT support truck with TEXAS license plates on it?! WTF?!)

Following TX's gross mid-decade gerrymander over the summer and CA's response to it, Republicans in Missouri and North Carolina have also drawn new Congressional maps to steal two more seats from Democrats next year. So, Virginia Democrats --- in the midst of their statewide election for the entire House of Delegates --- announced a complicated, surprise plan just over a week ago that, if successful, could flip as many as three U.S. House seats in the Old Dominion from "red" to "blue" next year. It's a complicated scheme in VA, requiring two affirmative votes by two consecutive sessions of the State Legislature and then approval from voters on a statewide ballot referendum next year. All in time to redraw VA's Congressional map before primaries begin next year.

Last week, Virginia Dems in the Legislature successfully completed Phase One of the plan, as the measure was adopted by the Senate on Friday, following approval by the House two days earlier. To proceed to Phase Two, Dems must retain their majority in the 100 seat state House on Tuesday, which they currently control with just 51 votes.

Also last week, Ohio's bipartisan redistricting commission redrew the Buckeye State's U.S. House map to make it harder --- but not impossible --- for two Democratic Congressmembers to hold on to their seats in the 2026 midterms.

Guest: Harold Meyerson of 'The American Prospect'; Also: Trump's ballroom blitz; Hurricane Melissa's long, deadly, climate-driven tail...

As the November 4th off-year elections are now just days away, New York City voters appear likely to elect a young, charismatic Democratic socialist vowing to raise taxes on the wealthy as their new Mayor. But, as discussed on today's BradCast, that's not the only place where voters may finally have a chance to begin to even the score against the runaway wealth gap between the rich and...everyone else. [Audio link to full show follows this summary.]

FIRST... A few quick news items today, including...

  • Hurricane Melissa's record-shattering path of destruction through the Caribbean --- including Jamaica, Cuba, Haiti and The Bahamas --- and now on toward the Canadian Atlantic coast (with effects likely to be felt across much of the U.S. Northeastern Seaboard this weekend.)
  • Breaking news on Donald Trump firing all six members of one of the federal commissions that was otherwise set to review the building plans for his threatened, privately-funded 90,000 square foot ballroom at the White House --- for which he has already demolished the East Wing with neither approval nor permission from anyone --- and a giant "Arc d'Trump" that he wants to build somewhere on the National Mall in D.C.

THEN... Just days from Tuesday's off-year Election Day, New York City's Democratic candidate for Mayor, Zohran Mamdani, appears to be well ahead in pre-election polling. If those polls are correct, it seems that NYC voters are offering enthusiastic support for the "Affordability Agenda" on which Mamdani's remarkable campaign has been built, including promises for a rent freeze, universal child care, free buses and for city-owned grocery stores in food deserts across the city's five Boroughs. Some of those programs, according to the candidate, will be paid for by a small surcharge on the income taxes of those earning more than $1 million per year. Though, even if he wins next week, many of those programs --- including the new surcharge on millionaires --- would need approval from the City Council and/or State Legislature before implementation.

Meanwhile, out here in California, some progressives are already looking toward a straight-on wealth tax for the state's 200 billionaires that voters would need to approve in 2026. But there are some unique elements to this ballot proposal that may distinguish it from other such programs forwarded by progressives in the past.

Last week, one of the state's largest unions, SEIU's United Healthcare Workers West, along with U.C. Berkley economist Emmanuel Saez and former Labor Secretary Robert Reich, unveiled what our guest today, HAROLD MEYERSON of The American Prospect, described last week as "The First Politically Viable Wealth Tax" in the nation.

The proposal, which its proponents are hoping to place onto next year's statewide ballot, would levy a one-time, 5% tax on the state's billionaires to help fund California's Medicaid program (known as Medi-Cal) following the massive, historic, trillion dollar cuts to the program enacted by Trump and Congressional Republicans in their so-called "Big Beautiful Bill" this past summer.

Meyerson is careful to delineate between Mamdani's income tax proposal of the wealthy (which he also supports), and the one in CA which would tax wealth itself, including assets owned such as stocks, etc. So, why does he see this one as the "first politically viable" such tax? For one reason, one of the well-worn critiques of such programs is that it would lead wealthy residents to flee or deter other wealthy people from moving in. In fact, Mamdani's main opponent in the NYC mayoral race, former state Gov. Andrew Cuomo, running as an independent after losing the Democratic primary, has repeatedly made that case against Mamdani's plan.

But, whether Cuomo's attack is true or not (Mamdani calls it exaggerated), the CA proposal introduced last week undercuts the critique entirely.

"First, it only applies to the wealth of people from this year, calendar 2025," explains Meyerson. And the "5% tax on wealth can be paid, spread out, over the next five years. It takes effect [if adopted by voters next year] in 2027. If you move into the state and you're ridiculously wealthy anytime after the end of this year, this doesn't apply to you. It only applies to the wealth of this year. If you move out of the state, you're still liable, under the terms of this tax, for paying it. So it is structured in such a way that it eliminates the argument that it will cause billionaires to move out --- because it only applies to billionaires in the state as of this year --- and that it will keep billionaires from moving in because, assuming they move in after Dec. 31st of this year, it doesn't apply to them."

That element alone of this proposal is likely to take the wind out of the sails of many of those who will certainly oppose the measure next year, if it qualifies for the ballot (supporters have until June to gather enough signatures). Meyerson believes that, especially in this blue-leaning state, the idea will be so popular that even conservative billionaire (and former Republican turned Democrat) Rick Caruso, who is likely to run for Governor, would have little choice but to support it. "It would look awfully self-interested, and against the interests of those Californians --- of whom there are gazillions --- reliant upon Medi-Cal, if he were to oppose it, or not take a stance on it," Meyerson tells me. "The optics would look pretty damn bad."

But there are other critiques that wealthy opponents will try to levee as well. Socialism! If it passes, Dems will just want to make it permanent! etc. etc. Meyerson speaks to all of those and offers his insights into the NYC election next week (and establishment Dems such as Senators Chuck Schumer and Kirsten Gillibrand, who have remarkably failed to back the city's Democratic candidate for Mayor), the Prop 50 redistricting referendum in CA, and the gubernatorial contests in both New Jersey and Virginia...

Our first-ever call-in game show! Also: Hurricane Melissa looks very bad for Jamaica; Trump cutting U.S. food assistance amid shutdown; DoJ interfering in Nov. 4 election?...

We've done quite a bit on The BradCast over the years, from investigative reporting, to deep dive explainers and interviews with experts and news makers, to ranting monologues, to taking calls from listeners on all manner of things. But, unless I'm mistaken, I believe this is the first time we've turned the show into a game show! [Audio link to full show follows this summary.]

FIRST UP... Before we get to our fun (if disturbing?) game today, a few news items of note...

  • Category 5 Hurricane Melissa looks to be a monster deadly storm in the Caribbean on several different levels. It's slamming smack-dab into Jamaica overnight tonight. In addition to record wind speeds (satellite records showed the storm, in record warm waters, topping 190mph for a time last night according to satellite records, which would be a Cat 6 if there actually was such a thing on the Saffir-Simpson Hurricane Wind Scale), it's also incredibly slow moving. That means it is likely to dump a lot of water --- as much as 40 inches of rain in some places --- as it slowly swamps the entire island. Desi Doyen also joins us for a few insights on how climate change has worsened just about every aspect of this deadly storm.
  • Earlier this year the U.S. Dept. of Agriculture (USDA), detailed how "multi-year contingency funds" would be used to fund the Supplemental Nutrition Assistance Program (SNAP) to "continue operations during a Federal Government shutdown." Last week, however, as the shutdown drags on, a USDA memo explained that, despite already appropriated Congressional funding to be used for such a contingency, federal SNAP money would no longer be made available to states after November 1 if the shutdown was still ongoing. That, after Republicans already slashed some $186 billion from the program in Trump's so-called "Big Beautiful Bill" earlier this year. More than 40 million people rely on SNAP to put food on the table --- the vast majority of them employed, by the way --- but the Trump Administration is now planning to help starve people (including millions of their own voters) rather than even negotiate with Democrats who are refusing to help Republicans keep the government open until hundreds of millions (in fact trillions) of dollars in Trump/GOP health care cuts for Americans are restored.
  • Next Tuesday is Election Day in Virginia, New Jersey, New York City, California and elsewhere. On Friday, Trump's Dept. of Justice announced that federal monitors were being deployed to polling places in five counties in California and one in New Jersey (which both have Democratic governors), though none to Virginia, which has the most contests on the ballot next week...and a Republican Governor. DOJ has yet to explain why monitors are being deployed or under what law they are doing so. Election experts --- and CA's Governor --- warn this may be a trial run for what the Administration is planning for next year's critical midterms.

THEN... It's on to "Who Wants to be a U.S. Citizen?", the first BradCast call-in game show!

U.S. Citizenship and Immigration Services (USCIS) recently announced that it was making it more difficult to pass the test required for those applying to become U.S. Citizens. They are doubling both the number of questions asked PDF on the Naturalization Civics Test and the number of correct answers that need to be given to pass the test.

According to experts, the questions are also more difficult than they were previously. So, today, we open up our phone lines to listeners --- most of them, presumably U.S. citizens! --- to see if they could answer the questions now being asked of prospective citizens by this Administration.

Like the Trump Administration, we make up the rules of the game as we go. And our listeners did fairly well! But I'll bet they did a helluva lot better than our current President would have been able to had he been forced to pass this test!

It's all so stupid and ridiculous. But, as discussed on today's BradCast, the stupidity and ridiculousness knows no bound now that he's won a criminal immunity ticket from the Supreme Court. So we will all pay the price until voters change the score. [Audio link to full show follows this summary.]

To that end, Gubernatorial primary elections were held in New Jersey on Tuesday for this November's general election. Democratic U.S. Rep. Mikey Sherrill, a Navy pilot and former prosecutor, will face off with Trump-endorsed Republican Jack Ciatterelli, who came within just about three points of unseating the state's now termed-out Democratic Gov. Phil Murphy four years ago.

Perhaps more interesting on Tuesday were six state legislative special elections held in three different states. Democrats outpaced expectations in five of them, including one in Tulsa, Oklahoma, where a native American candidate trounced her Republican challenger by a landslide 69 points! The results amounted to a 50-point over-performance by the Dem as compared to their results in the Presidential election in the same district last November. In all, Dems are now running an average of about 16.4 points ahead of their 2024 results in special elections in 2025.

Then, it's back once again to the mess here in Los Angeles, which isn't really a mess at all. Or, at least, it wasn't until tough guy Donald Trump decided to pretend that largely peaceful protests against his immigration policies required him to violate the law to federalize California National Guard troops and deploy them with the U.S. Marines to support the ICE round-ups of hard-working, non-criminal migrants in the city including, apparently, children.

In a televised address on Tuesday night, CA's Governor Gavin Newsom, who, along with L.A. Mayor Karen Bass, opposed Trump's federalization and deployment of troops in the city, described the President's "authoritarian", wannabe "dictatorial" tactics. He warned that Trump is now waging war on democracy and the Constitution itself, and that Americans outside of California can expect to see much the same thing soon in their own hometowns. Will Americans heed his warning?

We're joined today by fellow L.A. resident HEATHER DIGBY PARTON, award-winning Salon columnist and longtime Digby's Hullabaloo proprietor, and another OG blogger friend known simply as 'DRIFTGLASS', co-host of his weekly Professional Left Podcast. As usual, they are here for a roundtable discussion to help us make sense of it all...as senseless and stupid as it all is.

Both share thoughts on what they see as the real point of Trump's dumb but dangerous incitement of violence here in L.A., what it is meant to distract from, and where all of this is headed. Is there any chance this doesn't lead to an invocation of the Insurrection Act by Trump, so he can really violate the law, American values, rights, and the Constitution itself?

"Donald Trump simply has no reason to obey the law anymore, of any kind, for any reason," argues Driftglass. "They feel no compunction about breaking the law because there's no one to stop them" Because he was elected, after receiving criminal immunity from SCOTUS, he believes "he can do whatever he wants. It's an ugly, terrifying fact that we warned people about for years. We begged people not to do this. We still came up short, because 77 million or so people voted for exactly this."

But, will even MAGA support the deployment of U.S. troops on American streets? Something that Republicans, including MAGA, have pretended for years to oppose? "As long as Trump is doing it, they'll be for it," asserts Digby. "The minute it's not him, they'll be against it. They retired the concept of hypocrisy a long time ago."

It is going to worse before it gets better, she warns, citing Trump's top henchman Stephen Miller who, she says, "has given interviews saying that they have plotted this out. Plan B, Plan C. They've been thinking this stuff through. This is actually part of their plan. They're testing the electrified fence here to see what they can get away with."

There is, of course, much much more from both of them today, including on a couple of stories you may have forgotten about for some reason, from just days ago. For example, last Friday, less than a week ago, Elon Musk publicly accused Trump of being named in the unreleased Epstein Files. Also, if you remember, Congressional Republicans passed a bill to slash $1.4 trillion worth of health care and food assistance from low-income Americans to help defray the cost of some $4 trillion in tax cuts mostly for the wealthy, at the cost of a $3 trillion spike to the national debt.

Remember when Republicans used to care about such things? As Digby sez: "They retired the concept of hypocrisy a long time ago"...

Dem landslide in SC; Catholic outlet eviscerates Trump GOP's 'big shameful bill'; Bipartisan judges oppose Dugan indictment; Much more...

There's probably not enough popcorn in the world for the hilarious madness that's blown up over the several hours or so, since we wrapped today's BradCast. Oh, well. I guess that's what next week is for. In the meantime... [Audio link to full show follows this summary.]

Somewhat less amusing, if still very interesting and actually of much more importance (I think)...from today's program.....

  • Lincoln Project unleashes a killer 60-second ad against Donald Trump and the Congressional Republicans' "MAGA Murder Budget".
  • Democratic "landslide" in South Carolina in Tuesday's special election for the statehouse, and what the "eye-popping win" may foretell for the forces opposed to authoritarianism in the year ahead.
  • SCOTUS begins its month of long-awaited decision releases before Summer recess. They start with an easy one: a unanimous decision regarding a Catholic charity in Wisconsin.
  • But, as long as Republican officials are continuing to pretend they care about religion, particularly Catholicism, will the Congressional Republicans pay attention to what the editorial staff at the 60-year old, independent National Catholic Reporter outlet has to say about their so-called "One Big, Beautiful Bill"? In its unsparing and historical accurate piece, the authors describe the measure as "one big shameful bill" and "one of the most immoral pieces of legislation in recent memory," before going on to explain why. And it's brutal. That's before they close this way: "Jesus weeps over this cruelty. So do we. We must reject this heartless bargain and instead pursue policies that honor the dignity of every citizen and the collective well-being of our nation."
  • Newark, New Jersey's Democratic Mayor Ras Baraka is pushing back this week against the Trump Administration with a lawsuit against Trump's former defense attorney turned Interim U.S. Attorney for NJ Alina Habba for “false arrest and malicious prosecution". That, after Baraka was handcuffed and detained last month outside of a private facility contracted by DHS to house migrants. The charges were dropped just days later due to a complete lack of merit. Or, as Habba ridiculously described it, "for the sake of moving forward."
  • And, catching up with a story that broke late last week while we were off...138 bipartisan, retired, state and federal judges submitted an amicus brief last Friday calling for a federal court to drop charges against Milwaukee County Circuit Court Judge Hannah Dugan. She was arrested by federal officials in late April after, they claim, she helped a migrant avoid arrest in her courthouse. Her own subsequent arrest and the charges against her, according to the former judges, undermine "centuries of precedent on judicial immunity."
  • Finally, Desi Doyen is here for our latest Green News Report, with disturbing news on understaffed National Weather Service offices along the Gulf Coast as hurricane season begins; officials sounding the alarm about Trump's gutting of FEMA; and dirty deeds, done dirt cheap for the fossil fuel industry recently by our corrupted SCOTUS...

Well, it's our last BradCast for a week or so, as we prepare for a muuuch-needed stand-down next week after Memorial Day. But we make up for it by packing a lot into today's program, with two of our favorite (and your favorite) guests. [Audio link to full show follows this summary.]

We're joined today again for one of our semi-regular (irregular?) round tables with our old-school, right-about-everything-for-20-years blogger pals, HEATHER DIGBY PARTON, award-winning columnist at Salon and her own Digby's Hullabaloo blog; and the notorious 'DRIFTGLASS', blogger and co-host of the weekly Professional Left Podcast from Flyover Country, Illinois.

As noted, we cover a whole lot of ground today, including both important and incredibly dumb news alike! Among the important news...

  • DoJ Team Trump attorneys are upbraided in court by a U.S. District judge in New Jersey for indicting Newark's Democratic Mayor Ras Baraka on ridiculous trespassing charges, vowing last week to bring him to trial, only to drop all charges this week. At the same time, they then went on to indict Democratic Congresswoman LaMonica McIver on ridiculous charges stemming from the same incident two weeks ago at an ICE detention facility in Newark. Those charges will also likely be dropped eventually, and Trump's former loser defense attorney, now interim U.S. Attorney in NJ, Alina Habba, will likely find herself upbraided again.
  • After Trump spent years campaigning on promises to not touch Social Security, Medicare or Medicaid, House Republicans earlier today barely passed Trump's budget bill that --- you guessed --- will slash both Medicare and Medicaid by more than a trillion dollars, taking away health care from as many as 14 million Americans. That, in order to help pay for tax cuts to wealthy people while ballooning deficit spending by about 4 trillion dollars. (Digby: "It's a complete travesty, and I think everybody knows it.")
  • The Trump Regime's ongoing horrors and errors and blatant, thuggish, authoritarian violations of court orders regarding his clownish yet cruel and unlawful mass deportation efforts. (Driftglass: "This is a mass weapon attack, like raining missiles down on an enemy target. Some of it is going to get through. And they'll get most of what they want.")
  • Qatar's $400 million bribe to Trump in the shape of a Boeing 747 "flying palace" that may never be used as Air Force One, but that he hopes to keep for his own personal use after his Presidency. "Emoluments," like "groceries," is such an old-fashioned word. (Driftglass: "He's just a giant greed hole of need and narcissism." Digby: "It sure sounds like 'I'd like you to do us a favor though...'")
  • And, oh, yeah, Republicans on Thursday also nuked the filibuster in the U.S. Senate by ignoring the Senate Parliamentarian to pass a law with a bare majority that, according to Senate rules, requires 60 votes for passage. And they did so in order to ban California's clean air laws. So much for states' rights. That, despite the fear by many Democrats of nuking the filibuster to protect Voting and Reproductive Rights for all Americans when they last controlled the Senate. (Digby: "Senate rules are dead. So get ready. We are in such untrod territory.")

As you might imagine, both Digby and Driftglass have quite a few thoughts on all of the above, as well as on the Dumb News we cover today as well (apologies in advance)...

  • Trump's Director of Homeland Security, Kristi Noem, doesn't know what "habeas corpus" means.
  • Republicans are pretending to be horrified by former FBI Director James Comey posting a photo of someone spelling out "86 47" in seashells on a beach. (Ya know, just like those "86 46" t-shirts rightwingers used to pimp. Says Digby: "This is a Republican thing, and they've been doing it forever." See her "Art of the Hissy Fit" from 2007 for more.)
  • Trump is attacking and threatening Bruce Springsteen. Bruce Springsteen!
  • And the dumbest news of all this week: Jake Tapper has a book about Joe Biden and a super-duper, totally important right now, conspiracy cover-up of his physical --- and, allegedly, cognitive --- decline while in office.

Don't worry. I didn't give away the best lines or hottest takes on either the important or dumb news, so tune on in!

I'm sorry to have to add to our "And Then They Came For..." series on today's BradCast. [Audio link to full show follows below.]

First it was "And Then They Came For the Judges..." last month, as Trump's goons arrested, hand-cuffed and frog-marched Milwaukee County Judge Hannah Dugan off to face criminal charges, alleging she helped a migrant evade arrest by ICE in her courthouse. She is now challenging that indictment with a motion last week arguing she enjoys absolute immunity for official acts, citing the U.S. Supreme Court's absurd --- but binding --- "Presidential Immunity" ruling in Trump v. United States last year.

Next it was "And Then They Came for the Mayors..." last week, after Trump's goons hand-cuffed and frog-marched Newark, New Jersey Mayor Ras Baraka off to jail, ridiculously charging him with "criminal trespass" after he arrived at a private facility contracted by ICE as a detention center, which the Mayor says the company doesn't have proper city permits to operate. After his dubious arrest, Trump's former defense lawyer turned Acting U.S. Attorney for NJ, Alina Habba declared Baraka's guilt on social media, claiming: "NO ONE IS ABOVE THE LAW".

But, on Monday, she dropped all charges against Baraka and announced new charges instead against NJ's Democratic Congresswoman LaMonica McIver. Habba had previously claimed the Representative had "body slammed" one of the masked federal agents who had shown up to arrest Baraka last week during a scrum when supporters had surrounded him. Apparently, McIver refused to plead to a lesser charge, so an 8-page indictment [PDF] was filed yesterday on two counts of felony assault, including "assaulting, impeding and interfering with law enforcement" during the incident.

The first-term Congresswoman decries the charges as "purely political" and vows to fight them. I suspect she will win and that her charges will also soon be dropped, just as Baraka's were. But we'll see.

We're joined today by attorney (and former Republican) KEITH BARBER, who has been covering these matters over at DailyKos, where he writes under the name of "KeithDB". He has reviewed much of the publicly available video of the incident in Newark, reviewed the charging document against McIver, released this afternoon, and sees a lot of problems with the federal government's case --- and the prosecutor overseeing them. "Alina Habba couldn't find her way around a court room with the help of GPS," he tells me.

Barber says he has seen no evidence of a "body slam" by McIver, and is critical of the public statements made by Habba about both the Baraka and McIver arrests. He explains the remarks are in violation of DoJ rules and guidelines "designed to protect the due process rights of the defendant."

He also describes both of the incidents as nothing less than "fascism" meant to intimidate those who would stand up to Trump. "This is a tyranny of an autocratic President, something that the founders of the United States of America worked hard [to avoid] when they developed the Constitution, to make sure that this country did not have an autocratic President. We had a bad history with kings, and we didn't want another king in this country with a different name."

Barber charges that Trump is "using the powers of his office to suppress opposition" and, he argues, his thuggery IS WORKING. Tune in for much more on that and all of the above!...

NEXT... While Trump's team of incompetent law enforcement officials are rounding up those who would oppose his mass, unlawful detention and deportation regime, the head of his own Dept. of Homeland Security, Kristi Noem, literally does not know the meaning of habeas corpus as guaranteed by the Constitution. A stunning exchange today in the U.S. Senate Homeland Security Committee with Sen. Maggie Hassan (D-NH) reveals that Noem believes "Habeas corpus is a Constitutional right that the President has to be able to remove people from this country."

As it turns out, it means almost the precise opposite of that, as we discuss.

THEN... A few thoughts on Paramount Global owner Shari Redstone's pressure on CBS News and 60 Minutes to settle Trump's pathetic $20 billion lawsuit against the venerable investigate news program regarding an interview last year with Kamala Harris that Trump didn't like. But the pressure from Redstone to settle the suit --- so that the Trump Administration might approve a pending Paramount merger with Skydance Media --- comes after Redstone hypocritically declared two years ago, at an award ceremony celebrating Freedom of the Press, "that press freedom is never guaranteed, that it must constantly be defended, and that it often comes at a significant cost, both personal and professional."

Given the topics on today's BradCast, it was a pretty lively show anyway. Thanks mostly to the callers, I suspect. Especially the one who loves Trump and doesn't believe in the evolution. [Audio link to full show follows this summary.]

Among our stories today...

  • The three-term Mayor of Newark, New Jersey was arrested by masked federal thugs on a public street on Friday. Mayor Ras Baraka was hand-cuffed and frog-marched (as seen above) outside a newly reopened federal detention center that, reportedly, doesn't have its state or city permits in order to operate. He was there to inspect it. The arrest happened as three Democratic members of Congress were eventually allowed to tour the privately run ICE facility that same afternoon. DHS and Donald Trump's former defense lawyer turned top federal prosecutor in NJ, subsequently took to the airwaves to apparently lie about the arrest. They have since doubled down by threatening to arrest the three members of Congress who were there as well, claiming they and Baraka "broke into" and "stormed" the federal facility. Video and eye-witness testimony of the incident, so far, suggests otherwise.
  • After 45 days in detention, Tufts University grad student, Rümeysa Öztürk, was finally released from custody over the weekend, at the insistence of a federal judge. She was snatched off the street by masked federal goons in March, as seen on a chilling viral video, after her student visa was revoked (without her knowledge), apparently in response to her daring to exercise her First Amendment right to co-author an op-ed in the student paper calling for the University to divest from Israel.
  • On Sunday, ABC broke the news that Trump intends to accept a tricked-out 747 Boeing jet from the Royal Family of Qatar to use as Air Force One, and then keep it as his own at the end of his term. The plane is reportedly worth about $400 million before it was decked out to serve as "a flying palace". All of which is wildly unconstitutional, if the literal words of Article I, Section 9, Clause 8 (the Emoluments Clause) actually still mean anything. For the record, it reads, "...no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State." Seems pretty clear. Unless you are a lawless grifter or one of his duped supporters.
  • Then, we open up the rest of the show to callers. Lots of them. Kicking off with a MAGA fan named "Denise", who believes Öztürk was in the country unlawfully, was a "terrorist" who wrote an op-ed in support of Hamas. None of those things, as reality would have it, are true by any measure. Then again, Denise also doesn't understand that First Amendment rights apply to all "persons" in the U.S., and says she knows that Darwin was a total con-artist is a total scam. So, ya know... Her call, and the many that followed, were all fun, however!

Trump ignores immigration ruling, threatens judge; Federal workers return after two courts rule; USAID shutdown found deadly, 'unconstitutional'; Also: 'Dead' Social Security recipient fights for his benefits...

We remain on the precipice of a Constitutional Crisis on today's BradCast, as our Man Baby President has now begun defying court orders. Some reasonably argue we are there already, but we will truly be there when (and if, but mostly when) he defies an order from the corrupted U.S. Supreme Court. For now, he's testing the waters by defying lower court orders. For the most part, those courts are largely holding firm in defense of the Constitution and rule of law, as the Administration continues to lose in ruling after ruling. Sadly, that hasn't prevented people from dying thanks to our reckless, lawless President and his top fundraiser's wasteful, fraudulent, abusive and deadly closures of critical Executive Branch agencies. Among today's coverage...

  • In a pathetic, early morning, MOSTLY ALL-CAPS social media rant today, Donald Trump demanded that a federal judge --- who reasonably ruled temporarily against his invocation of the Alien Enemies Act of 1798 to deport hundreds of Venezuelans --- be "IMPEACHED!!!". The law has only ever been used during wartime, as it mandates the detention, imprisonment or deportation of non-citizens in the U.S. only from a "foreign nation or government" that has "declared war" against us or that has "perpetrated, attempted, or threatened" "any invasion or predatory incursion." Venezuela has done none of those things. The ruling against Trump followed an unusual late-night, emergency hearing on Saturday. The judge ordered the Administration to pause deportation to an El Salvador prison of alleged Venezuelan gang-member migrants until Trump's use of the war-time law could be further adjudicated. U.S. District Judge James Boasberg ordered any U.S. migrant flights en route to El Salvador be returned the U.S. The Administration appears to have ignored the court order and has been stonewalling the judge's demand for information on when planes left and landed ever since. Thus Trump called for his "IMPEACHMENT!!!" winning an unusual, if very gentle, slap on the wrist from U.S. Supreme Court Chief Justice John Roberts in a rare public response today.
  • Late last week, a federal judge in California ordered the reinstatement of thousands of federal workers at six different federal agencies, after finding that Elon Musk and his DOGE Bros unlawfully fired them without the legal authority to do so. An hour or two later, a federal judge in Maryland, in a separate lawsuit on a different legal basis, ordered that federal workers at 18 different agencies must be restored to their previous positions. The judge in CA has since made clear that rehiring the workers only to put them on immediate paid leave is also in violation of his order.
  • In a major ruling today, a federal district court judge in Maryland ordered the U.S. Agency for International Development (USAID) --- which Trump, Musk and his DOGE Bro wrecking crew shut down almost entirely in the earliest days of his second term --- to be reopened. The judge ruled that Musk "likely violated the United States Constitution in multiple ways" in shuttering the critical international aid agency, which Musk described on his social media site ïn early February as having personally fed "into the wood chipper". USAID, among other critical work, supplies food to starving children and life-saving medicine to the sick around the globe. While Musk, the world's richest man, has claimed that "No one has died as a result" of his (unlawful, unconstitutional) closure of the agency, the New York Times' Nicholas Kristof, in a must-read, gut-wrenching report (gift link) traveled to South Sudan and elsewhere to find "that is not true", before going on to document how and where "the efforts by Musk and President Trump are already leading children to die". Unless aid is somehow quickly restored, Kristoff reports, those efforts are likely to kill millions in the coming months and years.
  • The wasteful, fraudulent and abusive efforts by Trump, Musk and DOGE has not been entirely for naught, however. Turns out someone finally found a "dead" person receiving Social Security! Even if that person turned out to be very much alive and is now trying to get the funds that were suspended for some reason by the Social Security Administration in mid-February, turned back on. The DOGE dismantling of the SSA --- where field offices are being shuttered and 7,000 workers are scheduled to be laid off --- isn't helping.
  • Finally, Desi Doyen joins us for our latest Green News Report, as deadly extreme storms killed more than 40 people in the U.S. over this past weekend; Trump's mass firings at NOAA are set to undermine accurate weather forecasting; and his Interior Dept. just cancelled the six-month old permits for construction of an off-shore wind-farm in New Jersey...
