It may be the dead of Summer, not exactly when most Americans are thinking about elections. But they were thinking about them last week in Tennessee and Ohio. No matter what these days, Americans are still thinking about Donald Trump. We cover all of that and more on today's busy BradCast. [Audio link to full show follows below this summary.]

Among the stuff covered on today's program...

  • Another victory for Americans and our current President. Months earlier than expected and ordered by Congress, Joe Biden signed a landmark Presidential order just over a week ago that officially updates the Uniform Code of Military Justice (UCMJ) for the first time in decades. The update changes the way the military handles sexual assault cases and other violent crimes, many of which, advocates of the new system have argued for some twenty years, were swept under the rug in the military chain of command.
  • In somewhat related-ish news, the Promise to Address Comprehensive Toxics Act [or PACT] Act has an important deadline this week that former Daily Show host Jon Stewart wants you to know about. The PACT Act greatly expanded medical benefits for veterans harmed by toxic burnpits, agent orange and other toxins while in service to the country. The landmark measure was signed by President Biden in 2022 --- also after years of advocacy by proponents --- and, while eligible vets can sign up anytime, those who either sign up or offer their intent to sign up by Wednesday, August 9, will be able to get full benefits going back to August of 2022. So make sure you let anyone you served and may have been sicked while on duty know about it! Learn more and sign up at VA.gov/PACT.
  • Remember the Two Justins --- Tennessee State Rep. Justin Pearson of Memphis and Justin Jones of Nashville --- the two young, black, progressive Democratic lawmakers [pictured above] who were expelled by Republicans from the TN State House for supporting children and teachers protesting for new gun safety legislation following the mass school shooting in Nashville in March? Both Justins just won back their seats in the state House of Representatives during special elections held last Thursday. They were expelled by the racist white Republican House super-majority last April when an older white woman --- Rep. Gloria Johnson of Knoxville --- was spared from expulsion by the same lawmakers, despite participating in the same protest on the House floor with the two Justins. Jones reportedly won his race with a whopping 78% of the vote. Pearson won his election to his old seat with 94% of the vote. Well done, Tennessee voters!
  • Meanwhile, in Ohio, far-right Republicans in that state's gerrymandered state legislature and their dark money supporters have been lying to voters for weeks now about Issue 1, which will be decided tomorrow (Tuesday, August 8th) at polls across the Buckeye State. The statewide ballot measure would make it harder for citizens to adopt citizen led initiatives to amend the Constitution by, among other things, requiring 60% for passage. Just a few months ago, in May, just weeks after adopting legislation to outlaw August special elections, GOP lawmakers voted to hold a special election for this ballot measure (which would only need a simple 50% majority for passage, just like all other ballot measures in state history) in hopes of pre-empting a citizen-led Constitutional ballot measure scheduled for this November that would enshrine reproductive freedoms into the state Constitution. Rightwingers have reportedly been blanketing the airwaves with false claims about Issue 1, telling voters that a "yes" vote will prevent your daughter from receiving a sex change operation without your approval. (Seriously.) But, again, democracy rising? Early voting turnout is through the roof, surpassing even last year's 2022 mid-term primaries. But we'll see how it turns out. A number of counties are reporting poll closures and precinct changes just days before tomorrow's Election Day.
  • Finally, after awarding our kudos to the latest member of the corporate media to be brought to our attention correctly describing Donald Trump's multiple failed attempts to "STEAL" the 2020 election, we open up the phone to callers. Many of whom want to talk about Donald Trump, his latest four-count federal indictment [PDF] last week, and how the hell the guy is even allowed to run for President after inciting an insurrection (he shouldn't be), much less serving as the front-runner for the 2024 Republican nomination. I still believe it's possible that he will not ultimately be the GOP nominee next year, for a number of reasons I suspect we'll be discussing in the days ahead. For today, however, it was great to talk to a number of very good callers about all of the above!

Newsom makes good on vow to manufacture generic drugs, highlighting Big Pharma's long manipulation of Intellectual Property laws for profit...

The state of California is embarking on a ground-breaking effort to manufacture and distribute a life-saving drug. The plan also deals a first major blow to private pharmaceutical companies that have long abused the nation's legal system for profit at the expense of the health of the citizenry.

"On my first day in office I signed an Executive Order to put California on a path towards creating our own prescription drugs," Democratic Governor Gavin Newsom declared in a July 7 video posted to Twitter, referencing his inauguration promise in January of 2019. "And now it's happening".

Newsom's statement came in the wake of his approval of a Golden State Budget Proposal that will invest $50 million into development and $50 million more into a State-owned facility that will manufacture and distribute generic (aka biosimilar) insulin to Californians at slightly above cost.

If it succeeds, California, which has the world's 5th largest economy, will not only become the first State, but also the only government, other than Cuba, to embrace the socialized production of generic medications. (Although Cuba develops and manufactures its own generic medications and provides free "preventative medical care, diagnostic tests and medications for hospitalized patients", Pharmacy Times reported, "Cubans pay out-of-pocket for outpatient medications.")

California's progressive Democratic Governor pointed to the extraordinarily high cost of insulin as a form of "market failure" that justifies his embrace of socialized medications. His decision to allow the Golden State to produce its own generic insulin also highlights the immoral manipulation of the nation's patent laws by for-profit drug companies...

One thing I think we can all agree on is that the last 2-3 years have been really rough. (OK, it's more like the last 5-6 years, but you get the gist of what I'm saying.) But it has prompted me on more than one occasion to long for some words of wisdom --- or biting philosophical commentary from the late great comedian, social satirist George Carlin.

Sadly, we lost him in 2008, but his work has lived on. Somehow, Carlin seemed to know what was ahead of us, and his bits regularly trend on Twitter even now as people re-discover his prescient comedy.

George Carlin's American Dream, a new two-part documentary directed by Judd Apatow, debuted on HBO last week. Carlin's only child, KELLY CARLIN, joins me on the show today to talk about this very personal project and about her father, the voice of an era (actually, several), George Carlin.

Yesterday was Memorial Day. As much of our military seems to be entrenched in right-wing politics, I was pleased to learn about a veterans group called Common Defense because it's made up of progressive veterans! Republicans and conservatives do not have a monopoly over our military, so I was happy to speak with NAVEED SHAH, the group's political director, to learn a bit about the progressives who also serve our nation...

We're back on today's BradCast, after surviving a long hot holiday weekend here in California (with huge thanks to Nicole Sandler for covering for us for a few days!) [Audio link to today's show is posted below summary.]

Amid record heat in Southern California --- with one city in L.A. County city topping out at a record 121 degrees on Sunday! --- fires raged and continue to do so, up and down the state. Nearly 300 people stranded by smoke and fires in various parts of the Golden State needed to be rescued by helicopters over the past four days as climate change-fueled blazes have, so far, chewed through a record 2 million acres in the state, destroying more than 3,300 structures in 900 different fires since mid-August. The scariest part: the worst months for California's ever-lengthening fire season are usually September and October. So, even after the worst fire season now on record, the worst may still be yet to come this year, as our climate crisis continues to intensify and a climate change denier is once again heading up the Republican Party's Presidential ticket.

It would be nice if we weren't one of the few media outlets connecting those particular dots. Absentee ballots have now begun to ship out to voters in states like North Carolina which has, itself, been ravaged in recent years by various climate related crises, from hurricanes to toxic coal ash spills to ever-rising sea levels. As voting for the general election finally begins there and in other battleground states, the corporate media would help us all if they focused (or even mentioned!) so many of the very real issues that are at stake in this year's critical Presidential election, including the devastation of climate change!

Speaking of which, a new story today gives me reason once again to cite one of my worst fears for this November's elections, as the Hartford Public School District in Connecticut was forced to cancel its first day of classes today. The cancellation was not due to the continuing COVID crisis, but caused by a ransomware attack that crippled the District's computer networks. That attack echoes a series of attacks against the Miami-Dade County Public School system in Florida last week, and could foreshadow trouble to come on November 3rd. Because so many voting jurisdictions now foolishly rely on computer networks and the Internet to cast, count and even check people in to vote on electronic pollbooks, a ransomware attack before or on Election Day would be devastating.

But don't worry! Your U.S. Dept. of Justice in on the job! Ya know, the one led by Donald Trump's fixer and Attorney General Bill Barr who lied to CNN's Wolf Blitzer last week about massive absentee ballot fraud, claiming a 2017 "indictment" in Texas for the theft of 1,700 mail-in ballots. After the actual state prosecutors called BS on Barr's claim's, the DoJ was forced to admit it was false. Ironically, Barr also claimed that "people have to have confidence in the results of the election and the legitimacy of the government." That would be more likely, of course, if we didn't have a U.S. Attorney General willing to casually forward two year old false claims about election fraud on major cable news networks.

Then we move to the biggest story over the holiday weekend, the report from The Atlantic's Jeffrey Goldberg that Donald Trump regards members of the military, including those were killed or captured and tortured during their service, as "losers" and "suckers". Goldberg's reporting has now been independently confirmed by multiple other media outlets, including even Fox "News", while Trump and the White House unconvincingly describe the detailed and independently corroborated reporting as "fake news". In his attempt to distract from that story on Monday, Trump attacked his own top military brass, claiming that too much is spent on defense contractors --- even after Trump has spent years citing his own increases to defense spending as one of his Administration's top accomplishments.

We're joined today by WILL GOODWIN, U.S. Army veteran, West Point grad and now Director of Government Relations for VoteVets.org, the nation's largest progressive veterans organization, founded in 2006, and now representing more than 500,000 vets, families and supporters. In the wake of the stunning (if not surprising) reports of Trump's disparagement of military members --- from the captured and tortured Vietnam War prisoner of war John McCain, to the shot down WWII fighter pilot George H.W. Bush, to the 1,800 U.S. Marines who lost their lives at Belleau Wood during WWI --- as "losers" and "suckers" all, VoteVets has now released several different video ads in response.

In one, family members of those who lost loved ones in recent wars respond to the President's remarks and, in another, a 98-year old WWII veteran, captured and forced into slave labor for 42 months, encourages Americans to vote for Joe Biden and against "other politicians if they continue to support Donald Trump."

For his part, Goodwin shares his thoughts in response to the reported insults by the Commander-in-Chief --- who he regards as "a maniac in the Oval Office" --- and how they are likely to affect the votes cast by members of the nation's armed forces this year. Despite popular belief that the military tends to support the Republican candidate, Goodwin cites polling to suggest the opposite --- polling completed before last week's news from The Atlantic. He says that Goldberg's report "is nothing new from Donald Trump when it comes to his hatred toward the military, towards military families, and towards our veterans, but somehow it's a new low." Goodwin goes on to describe Trump's tenure as "four years of failed leadership as Commander-in-Chief," before detailing a seemingly endless list of ways in which Trump has failed our troops, our veterans, our Gold Star Families, as well as the nation's security and standing on the world stage.

"Our allies have turned away from us --- they do not know how to work with a maniac in the Oval Office like Donald Trump --- and our enemies and adversaries are emboldened. They're emboldened to continue attacking the very integrity of our democracy and going after our elections infrastructure. And, frankly, they have taken more direct actions, escalating military tensions. The Russian buzzing US Navy ships, intercepting our aircraft. The continued expansion of the Chinese footprint in various places around the world," Goodwin argues. "We have seen Democrats across the board, including in [Congressional] seats where Donald Trump may be popular, standing up once again and speaking the truth on how disgusting this is. And we're seeing the same failure from Republicans to speak up at all. Republicans who represent massive military and veteran populations...refusing to condemn the President."

Finally today, we close on a very sad note, with the news that Kevin Zeese, longtime progressive activist, attorney, fighter for universal healthcare, fair elections, racial and economic justice and peace, passed away suddenly on Sunday from what appears to have been a heart attack as he slept. Kevin was also a friend of both The BRAD BLOG and The BradCast, having joined on us on air on many occasions while taking on our nation's worst failures and most insidious corporate oligarchs. We share several thoughts on his passing from a number of other progressive activists today. Zeese was 64 and will be dearly missed...as his good fight for a better and more just world will, and must, continue...

We've got a whole lot jammed into one single hour of The BradCast today. So let's take this one step at a time and hope for the best. You may wish to stay away from anything that is breakable over the course of the hour. [Audio link to show is posted at end of summary.]

Among the stories covered on today's program...

  • Hydroxychloroquine, the magical "100% cure!" for COVID-19 that Fox "News" promoted endlessly for weeks on end along with their stooge President in the White House, is, according to a new study of hundreds of patients at Veterans Health Administration medical centers across the country, not a cure at all. In fact, 28 percent of infected patients given the malaria drug along with regular care died, while only 11 percent who received the same care but without the hydroxychloroquine died. That's just one of the reasons you likely haven't heard either Fox or Trump, who encouraged folks to take it ("What do you have to lose?," he repeated over and again) mention it at all lately;
  • A new analysis of UK data by the Financial Times finds the number of coronavirus-related deaths there are likely more than twice as high as the officially confirmed count, which only tallies those who have died in hospitals after testing positive for the virus. The analysis confirms other similar studies of inexplicably high death rates (for any reason) in countries around the world, far in excess of average numbers this time of year, even after official COVID-19 are removed from the statistics;
  • While that study and others like it suggest the NUMBER of deaths, both directly and indirectly attributable to the pandemic, are likely at least twice as high as officially recognized, the death RATE for the coronavirus may be much smaller. A new study by USC and Los Angeles County, examining those with antibodies for the virus present in their systems, suggest that infections are far more widespread than previously understood. Infection rates appears to be as much as 28 to 55 times higher than previously understood in L.A. That study appears to confirm a similar one in Santa Clara County in Northern California, finding the rate of infection there to be as much as 50 to 80 times higher than previously known;
  • In short, there is a LOT that is not understood about this deadly virus, making it all the more insane that Georgia's Republican Governor Brian Kemp (now followed by several other GOP Governors across the country) is planning to re-open the state's hair salons, tattoo shops, bowling alleys, massage parlors and other places of business this Friday, with movie theaters and restaurants set to be opened on Monday. During his stunning Monday announcement, Kemp claimed that "health care professionals" agreed with his action, even though members of his state's own COVID-19 task force and the mayors of its largest cities were never consulted and are reportedly furious. CNN reported on Wednesday morning that both Trump and Vice President Pence called Kemp on Tuesday to express their support for the move (even though mere seconds after we got off air today, Trump apparently flip-flopped during the White House briefing to claim he "strongly disagreed" with Kemp and thought it was "too soon" to reopen.);
  • Definitely not consulted in any of this were the state's front-line health care workers like Lawrenceville, GA physician Dr. Karla Lorraine. We share her moving "viral" video --- shot at work, while still in some of her personal protective equipment after hearing news of Kemp's announcement --- in which she begs people, through her own tears, to "please stay home!";
  • Next, as we do, we turn to what the hell people can do about all of this madness, beginning with VOTING these madmen out of office this year. To that end, we're joined today by attorney COURTNEY HOSTETLER, counsel at Free Speech for People, one of the groups representing the NAACP in a new lawsuit filed in North Carolina to prevent the use of new, "insecure, unreliable, unverifiable, and unsafe" (yes, now infectiously dangerous) touchscreen voting systems in more than 20 counties across the very closely divided battleground state this November.

    The lawsuit [PDF] is one of many being filed in state after state as jurisdictions move to change voting procedures in the wake of a global pandemic. Aside from being a vector for spreading disease in many rural and urban counties (including Mecklenberg, the state's largest, most diverse and Democratic-leaning) Hostetler explains how the specific new systems in question, the ES&S ExpressVote, creates barcoded "paper ballot" summary cards that can never be verified as accurately reflecting the intent of any voter. The same systems, she explains, are also insecure and prone to failure, as seen in several states where those systems and very similar ones made by ES&S --- the nation's top supplier of voting systems and the largest private vendor in the country --- have failed in recent elections and were found vulnerable to hacking and manipulation in test labs.

    She also details a number of other maddening reasons that these expensive, dangerous, insecure and unverifiable new voting machines must be replaced with hand-marked paper ballot systems before the state's critical Presidential election this November.

  • Finally today, a few thoughts on crashing oil prices amid a worldwide glut that has led producers to literally pay people to take oil off their hands for lack of storage. One analyst suggests this moment is "probably going to be the final dagger in the heart of the U.S. shale oil industry." Yes, he means this could be the end of fracking in the U.S., at least for oil, if not natural gas. So, maybe something good after all can come out of all of our ongoing disasters...

Just as we were speaking, word came down about Trump threatening to pull Bruce Ohr's security clearance. He had some choice words about that, too.

At long last, we're beginning to see shades, shadows, clouds of accountability rolling in across D.C. and even elsewhere in the country. Many of those clouds seemed to roll in all at once today for some reason, but we cover as many as we can on today's BradCast. [Audio link to full show is posted below.]

Among the stories on today's busy program...

  • Huge explosions, a raging fire, and 10-mile evacuations at another oil refinery today, this time in Wisconsin;
  • Bill Cosby is found guilty on three felony counts of drugging and sexually assaulting a woman and now faces the rest of his life in prison;
  • Tens of thousands of teachers walked out in Arizona and Colorado on Thursday, demanding increased funding for education after years of slashed state budgets to help pay for tax cuts to the rich and corporations;
  • A spate of new polling suggest Senate Republicans may face a storm of accountability this November, with encouraging numbers for Democratic candidates in at least three different states --- Arizona, Tennessee and Nevada --- where they hope to flip "red" seats to "blue" to regain majority control of the upper chamber of Congress this fall. (And also in a fourth state, if you include Texas, where Sen. Ted Cruz' challenger Rep. Beto O'Rourke is now within "too close to call" striking distance, according to new polling, even as the Democrat is refusing corporate and super PAC funding, even from billionaire Tom Steyer);
  • No accountability to date, however, for the anti-gay, anti-Muslim, anti-environment, pro-war CIA Director Mike Pompeo, who was narrowly confirmed in the U.S. Senate today as Donald Trump's new Secretary of State;
  • The Senate Judiciary Committee voted to approve a bi-partisan bill to protect Special Counsel Robert Mueller from being fired by Trump, though obstructionism from GOP leadership in the full Senate and U.S. House will likely prevent the legislation from going any further;
  • Admiral Ronny Jackson, Trump's personal White House physician and his nominee to head the Dept. of Veterans Affairs finally withdrew his name from consideration following a host of damning allegations from current and former White House and military co-workers unearthed by Sen. Jon Tester (MT), the ranking Democratic member of the Senate Veterans Affairs Committee;
  • Trump's wildly corrupt and scandal-plagued EPA chief Scott Pruitt finally faced a bit of accountability, at least from Dems, as he testified before two separate House Committees on Thursday and refused to answer many direct questions, threw much of his staff under the bus, and denied responsibility for the mountain of personal corruption scandals he continues to face --- even as bi-partisan calls for his resignation continue;
  • And, finally, Desi Doyen joins us for the latest Green News Report, with more on Pruitt's anti-climate perfidy, French President Emmanuel Macron's blistering swipes at President Trump's environmental record during a joint session of Congress, and much more.

Guest: Legal journalist Mark Joseph Stern; Also: FCC appointee arrested for fraud and forgery, Trump nominee for VA appears to be in trouble...

On today's BradCast: After a months-long drought of one of our favorite guests, legal journalist MARK JOSEPH STERN of Slate returns today! And we make up for the deficit with a legal lightning round on a number of big cases being heard this and in recent weeks at the U.S. Supreme Court, as well as a number of important cases from elsewhere around the country.

Among the cases covered with Stern today: The years-long challenge to Texas Republicans' racial gerrymandering of Congressional and statehouse districts, which were struck down as unlawful by several lower courts, and Donald Trump's controversial anti-Muslim travel ban(s), which were also blocked by lower courts. The U.S. Supremes, however, may be on the verge of restoring both laws, according to Stern, despite previous findings of unconstitutionality. We also discuss the pending fate of two separate challenges to partisan gerrymandering heard recently by SCOTUS.

In both cases, Stern notes, referring to the stolen GOP majority on the Court after Obama's nominee Merrick Garland was blocked for a year, before Trump appointed Justice Neil Gorsuch: "I hope against hope that my predictions are wrong, but Republicans stole this seat for a reason."

But that's not all! We also hit several other important recent cases from federal courts around the country, which prove to offer a bit more encouraging news. Stern details the "complete train wreck" seen in a federal court in Kansas earlier this month, as their Sec. of State and top-shelf GOP "voter fraud" fraudster Kris Kobach disastrously attempted to defend his "proof of citizenship" voter registration law at trial. Kobach's humiliating effort resulted in a George W. Bush-appointed federal judge slapping him with the second of two contempt of court sanctions during the long case, and may signal, as Stern posits, the near end of the Republican Party's years-long disingenuous claims about a "voter fraud" epidemic.

"Kobach had committed a major self-own," Stern tells me. "He had gone into that trial thinking he was going to prove once and for all that 'voter fraud' was real, and he left that trial having inadvertently proved that it wasn't. He undermined all of the evidence that he had worked so hard to build up."

That, as one of Kobach's longtime colleagues in the long GOP "voter fraud" con, J. Christian Adams, finds himself as the defendant in a new lawsuit filed in Virginia by a number of U.S. citizens who were inaccurately accused by Adam's group, the Public Interest Legal Foundation (PILF), in error-riddled reports titled "Alien Invasion of Virginia" and "Alien Invasion II", of committing voter fraud. Adams is accused by the lawful voters of violations of the Constitution, the Voting Rights Act, and even the Ku Klux Klan Act of 1871.

"It's satisfying to see these guys have to answer in court for all that they've said and done for so long, and it's great to see the victims of their slander fighting back in such a powerful way," Stern argues.

We finish up our legal lightening round today with a case decided last week by the Supreme Court, in which Justice Gorsuch, who enjoys the seat stolen for him by Senate Republicans last year, actually joined the Court's four liberal Justices in striking down a law that allows the deportation of immigrants accused of "violent crimes". While Stern applauds Gorscuh joining the liberal justices in this case, given the vague statutory language used for defining "violent crimes", he also cautions that Gorsuch's interest here may signal a broader, more disturbing scheme down the road by Trump's far rightwing appointee.

Also today: The Trump Administration doesn't appear to do any vetting of any of their nominees for any office, it seems. Last week, Elizabeth Anne Pierce, a corporate member of a public commission created by Trump's FCC Chair Ajit Pai, purportedly to help expand broadband Internet access, was arrested on allegations of fraud to the tune of $250 million for forging signatures on contracts on behalf of her startup high-speed fiber-optic company. And, on Capitol Hill today, Navy Admiral Ronny Jackson, Trump's personal physician turned nominee to head the Dept. of Veterans Affairs, comes under fire from Senators of both parties, regarding his complete lack of experience for such a role, but also for reports of fostering a "hostile work environment", "excessive drinking on the job" and "improperly dispensing meds" among other things. In the bargain, today at the White House, Trump appeared to begin the process of throwing Jackson --- who he reportedly had to convince to accept the nomination to head the VA and its 360,000 employees --- under the nearest bus.

And finally, Desi Doyen joins us with the latest Green News Report, and for a tribute or two to Schoolhouse Rock creator Bob Dorough, who died today at the age of 94...

Lots of breaking news on today's BradCast, and a look at the real reasons the Trump Administration has now added a new question on citizenship to the 2020 U.S. Census. But, don't worry. It all ends with a song! [Audio link to today's show follows below.]

First up: the never-ending Executive Branch shakeup continues as Trump fires embattled Veterans Affairs Secretary David Shulkin and announces his intention to replace him with White House physician Ronny Jackson.

Then, Trump's never-ending legal woes continue to quickly mount and worsen on several fronts beyond the Special Counsel probe (where he is still having trouble finding attorneys willing to represent him, after his latest lead attorney quit last week.) Porn star Stormy Daniel's has now added a defamation charge against Trump business partner and lawyer Michael Cohen, to her civil suit against the President, and is now seeking to depose both Cohen and the President under oath.

That, on the same day a federal judge in D.C. allowed a case filed by Maryland and the District of Columbia against Trump to move forward based on claims that the President's continued ownership of the Trump International Hotel in D.C. violates the Emoluments Clause of the U.S. Constitution, barring gifts from states and foreign nations.

Up in Wisconsin, in the meantime, the GOP received its second rebuke from a state court in less than a week, for attempting to avoid calling Special Elections for two vacant seats in the state Senate. Gov. Scott Walker was ordered a second time by the court on Tuesday to call those elections immediately. Republicans in the state legislature, however, were hoping to convene a special session in order to change the law which Walker was found to have violated, as they try to avoid calling the elections in two GOP districts they fear they may lose to Democrats. (An appeals court, later on Wednesday, has now also rejected a motion to overturn the initial ruling.)

Then, we're joined by Mother Jones' Senior Reporter ARI BERMAN to discuss the GOP's war on judges who find against them, and the Commerce Dept. Secretary Wilbur Ross' approval this week of a new, last-minute, untested question on citizenship, to be added, by request of the Dept. of Justice, to the 2020 U.S. Census.

Critics, including the last five directors of the U.S. Census Bureau among others, charge the question will unlawfully depress responses to the Constitutionally-mandated decennial survey of all U.S. residents (whether they are citizens or not), as Berman reports in his new feature article for MoJo.

The DoJ, Commerce and White House all falsely claim that the new question is "necessary for the Department of Justice to protect voters [and] comply with the Voting Rights Act". Berman, author of the recently published Give us the Ballot, the landmark book on the history of the VRA and the long struggle for voting rights in the U.S., scoffs at those claims and details what he sees as the real reasons for the change, and the decade-long effect on the nation that it will have if it is not blocked by the courts. California has already sued to block the question from being included, and more than a dozen other states and advocacy groups are expected to file complaints as well.

On the GOP's war on courts following adverse rulings against them in Wisconsin, Pennsylvania and North Carolina, Berman says: "There's a very disturbing trend going on. When Republicans don't like court rulings that constrain their power, they try to nullify those rulings...What I think is so noteworthy about this is that everyone always says how much of an outlier Donald Trump is within the Republican Party. But if you just look at what Republicans are doing, in Wisconsin or North Carolina or Pennsylvania, they're following the Trump playbook, which is if you don't like a law, just ignore it."

On the Census controversy, he tells me: "We are seeing the rigging and corruption of one of the most important, mandated tasks in our Constitution...If you decide to rig the Census, then you've essentially rigged everything that follows" for the next decade. He adds: "The bigger picture here is that a failed Census is going to hurt everybody."

On today's BradCast, health advocacy organizations say they are shocked by Donald Trump's proposed cuts to the National Institutes of Health (NIH) and the Centers for Disease Control and Prevention (CDC) among other federal agencies being slashed or eliminated in order to pay for a massive increase in military spending. But even some veterans organizations, whose members might otherwise stand to gain from increases to the budget of the Dept. of Veterans Affairs, are slamming the cuts being proposed everywhere else. [Audio link to show is posted below.]

Groups such as the American Heart Association, the American Society of Clinical Oncology (representing Cancer specialists) and the American Lung Association are charging that Trump's budget would have a "devastating" effect on both the health of the nation and its economy, both now and into the future. Even some Republicans in Congress are pushing back against the cruelest of cuts in Trump's proposal, such as slashing programs that fund Meals on Wheels and school lunch programs which, the White House continues to maintain, have not proven themselves to work.

The draconian cuts to science, arts, diplomacy and services for the poor are supposedly proposed in order to pay for huge increases in spending on military and veterans programs. Today, as Trump held a "Listening Session" with veterans groups at the White House, we're joined by Will Fischer of VoteVets.org, the largest progressive veterans organization, representing some 500,000 veterans and their families and which has come out strongly against Trump's proposed budget.

Fischer, a U.S. Marine, decorated Iraq War combat vet and VoteVets' Director of Congressional Relations joins us from Capitol Hill to argue that, while increased spending on VA issues is fine, the loss of domestic and non-military programs (not to mention repealing the Affordable Care Act, or "ObamaCare") is likely to be exceedingly damaging to vets. "This is un-American, and a blatant attempt to try to divide military and veterans and everyone else," he argues. "Nobody is going to leave unscathed by the Trump budget."

"No one is questioning that we need to have a military that is ready and equipped for the modern century," Fischer tells me. "What we don't want to see happen is this ridiculous notion that somehow we need to be forcing the American people to make a choice between having a strong national defense and having heating assistance for someone on hard times --- who very well may be a veteran. Choosing between having new equipment at a VA or scientists investigating climate change --- we need all these things, and we need to ensure everyone is paying their fair share so we can realize and have all of these things."

He also explains why his group rejects Trump's "national security" claims to justify a travel ban from Muslim countries. "It is absolutely not in line with the oath that I swore," Fischer says. "Donald Trump is deploying troops into Syria. Now, how in the world are our commanders on the ground supposed to go to Syrians and say, 'Hey, work with us, help us out, and we'll be sure to take care of you', when all they have to do is turn on the TV and see us turning away Afghanis who helped us, turning away Iraqis who helped us, and sentencing those people to death? People who kept Marines from walking into ambushes, these are people who served right alongside us, and Donald Trump is saying, 'no, you're not welcome here.'"

On today's BradCast, it looks like "Giant Meteor" could win after all! With one week to go, the race could be back up in the air, as polls tighten, Democrats sue Republicans in federal court, and we take a look at some key statewide ballot measures in California and elsewhere. [Audio link for show is posted below.]

The reverberations from FBI Director James Comey's unprecedented and (so far) evidence-free announcement last week concerning a potential new aspect of the agency's investigation of Hillary Clinton's emails continues to rock the 2016 Presidential Election, just one week before Election Day. Polling is moving back in Donald Trump's direction and we discuss other concerns that are not reflecting by polling numbers. Oh, and it turns out there is "voter fraud" at the polls, at least in Iowa, and you'll never guess who the alleged perp was caught voting twice for! (Sound familiar? Seems to happen a lot this time of year.)

Then, attorney and Vietnam veteran Ernest A. Canning, long time BRAD BLOG legal analyst now back from his Primary advisory role with Veterans for Bernie, joins us to discuss a number of California ballot initiatives he's been writing about here, as well as the several lawsuits filed by Democrats over the weekend charging "voter intimidation" by the Trump campaign and state GOP operations in Nevada, Ohio, Pennsylvania and North Carolina, in violation of both the Voting Rights Act of 1965 and the Ku Klux Klan Act of 1871.

All of that follows on a decades-long consent decree barring the Republican National Committee from certain racially targeted "poll watching" and "ballot security" activities. That is a restriction they agreed to after getting caught using race-based intimidation tactics at polling places in the early 1980s, when one of the named defendants, Roger Stone --- a long time advisor to Trump and GOP dirty trickster going back to the Nixon era --- actually worked on the "ballot security" operation that got the RNC in trouble in the first place back in NJ in 1981.

Then, Canning details a number of state initiatives on the California state ballot next week --- and some well-funded lies about them --- which could have a major effect on prescription drug prices, legalized marijuana (and ending the disastrous "War on Drugs"), the death penalty (two different, competing measures), Citizens United and much more...even porn is on the CA ballot this year!

Speaking about one of the initiatives, Prop 61, which he wrote about over the weekend, and which the pharmaceutical industry is spending tens of millions to defeat by falsely claiming that it will harm veterans, Canning explains: "This proposition, more than any other, shows you the problem with money in our political system. They put these [false] ads on --- and naturally, the TV station should say, 'We should fact-check that. That's not true.' But they're not going to do that because that would be like biting the hand that feeds them. These ads have become a major source of revenue for our commercial media" which, he ads, are "the ultimate beneficiaries of Citizens United, which is perhaps one of the reasons why they don't ask questions in the debates about repealing Citizens United!"

Extremist 'Tea Party' Republicans like to pretend they are patriots --- so much so that when Sen. Ted Cruz (R-TX) complained this week that the government shutdown he helped engineer had forced the elimination of Veteran's Administration healthcare services, he belatedly discovered that he had painted himself into an impossible corner.

Well, he didn't discover it on his own. Sen. Debbie Stabenow (D-MI) helped him to notice that he was ardently advocating on the Senate floor for the Veteran's Administration health care system, which, unlike "ObamaCare", is an actual government run healthcare system of the type that Cruz pretends to abhor so much he was willing to lead his party to shutting down the entire government to block it.

"I just wanted to be clear," Stabenow asked Cruz during his floor speech advocating re-opening the VA as part of the GOP's desperate effort to re-open only those parts of government they approve, "Because the Senator from Texas has, in fact, made the ending of a private sector, competitive health care system for up to 30 million Americans part of what he wants to stop. I just wanted to be clear that the fully government-funded, government-run --- with government doctors --- system through the Veteran's Administration system is something that you are advocating we continue to fund through the federal government?"

Cruz couldn't say much more in response than: "The answer is yes. I believe we should fully fund the VA." (Full video here.)

Unlike "Obamacare", a private health insurance operation merely overseen by the government, the VA healthcare system that Cruz was advocating for, actually is a full-blown, government-run healthcare system. Or, as the heroic Republicans now like to deride it: A government takeover of healthcare!

Actual heroes, on the other hand, like Redge Ranyard, who fought against Nazis during World War II, are less than impressed by the claims made by Republicans like Cruz and House Speaker John Boehner (R-OH) that they are locked in an "epic battle" to save the nation...




As in similar Wisconsin law, restriction on voting rights appears to violate PA state constitution's 'fundamental right' to vote...

92-year old Viviette Applewhite, 59-year old Wilola Shinholster Lee, 72-year old Grover Freeland, 86-year old Dorothy Barksdale and 93-year old Bea Booker are just a few of the Pennsylvania residents and long-time legal voters now fighting to retain their right to vote under the state GOP's new polling place Photo ID restrictions, according to a new lawsuit filed this week in the Keystone State.

The complaint goes on to argue that "there are countless other Pennsylvanians like them [some 80-90,000 according to the state's own data], who will lose the most cherished of all rights, the right to vote, unless the Photo ID Law is declared unconstitutional."

There is now, indeed, a very good chance that the law will, in fact, be declared unconstitutional according to The BRAD BLOG's analysis of the complaint, the state constitution and prior rulings in similar cases.

PA is just the latest of more than a dozen states over the past year where Republican-controlled legislatures and executive mansions have instituted voter disenfranchising polling place Photo ID restrictions. Governor Tom Corbett signed his state's bill into law in March, and promptly lied about his reasons for supporting the removal of voting rights for those lacking Photo ID on Election Day, claiming, without evidence, that some precincts in the state had 112% voter turnout in recent elections. As we reported at the time, that charge was dismissed as "ludicrous" and without evidence by a longtime state election integrity expert.

Nonetheless, "Act 18" has become the law of the land in Pennsylvania, for now, and, unless successfully challenged, will require that voters present a state-issued Photo ID when voting at the polling place in this year's November Presidential election for the very first time.

For the identical reasons that The BRAD BLOG accurately predicted that the League of Women Voters' legal challenge to a polling place Photo ID restriction law under similar provisions of the Wisconsin's Constitution would prevail (absent a political intervention from the Badger State's extraordinarily partisan Supreme Court), we also predict that new legal challenge filed this week in PA, attempting to block the state's draconian polling place Photo ID law, will similarly succeed...

Despite VA Claim of Changed Policy, Vet Group Forced to File 'Emergency Motion' as Barriers Erected to Keep Non-Profit Group From Registering Vets at San Francisco Facility...

Despite last week's agreement by the Dept. of Veteran Affairs to follow federal law --- after months of pressure from vet groups, members of Congress, and the public --- and relent to allow voter registration drives on the department's federal facilities, The BRAD BLOG has learned that the department is continuing to block non-partisan groups access to our wounded warriors in order to sign up voters. With most voter registration deadlines for the general election just one month away, the continuing stonewall, in this case by the San Francisco VA, continues to outrage.

The non-partisan Veterans for Peace organization has now been forced to file an emergency motion with the court in order to gain access. They contacted us this morning with the following statement...

Preminger Seeks Enforcement of Court Mandate Against VA Interference with Voter Registration Drives

WASHINGTON – On September 12, 2008, the San Francisco VA prohibited Veterans for Peace (“VFP”) from registering voters, even though a recent “directive” instructs local officials to “facilitate” nonpartisan groups who wish to register voters. VFP is 501(c)(3) humanitarian and educational organization. VA officials told VFP that their visit would be delayed for at least 12 days by an investigation into each visitors “political activities” and a tuberculosis test, which requires two medical appointments. This violates a February 2008 court mandate.

In February 2008, the Federal Circuit in Washington held that VA cannot impose special requirements on visitors because of the content of their message. The Federal Circuit ruled that the VA cannot use its rule against “unauthorized demonstrations” to interfere with voter registration unless there is physical “disturbance” that also offends “decorum and decency.”

Today’s emergency motion seeks to enforce that order.

"Having registered only 414 veterans nationwide, the VA needs all the help it can get," notes the press release from VFP, which continues in full below...

In an article at Huffington Post, Paul Rieckhoff, the Executive Director of Iraq & Afghanistan Veterans of America (IAVA), has spoken out against the Bush Administration's ban on voter registration activities in our nation's Veterans Affairs facilities. Writes Rieckhoff:

The irony is almost too great. Disabled veterans, who have made such tremendous sacrifices in defense of democracy, are now being denied assistance in voting.

The VA is claiming that voter registration drives are partisan, and would interfere with the functioning of their facilities. But hundreds of nonpartisan organizations regularly participate in voter registration drives --- everyone from the League of Women Voters to the Elks Club. Helping people vote is a civic duty, not a partisan activity.

Readers of The BRAD BLOG will know, this is a very important issue for us and we thank Rieckhoff for adding his important voice to this most important of American issues.
