On today's BradCast, a brief if welcome respite (mostly) from the embarrassment of Donald Trump's pathetic, ongoing denial about his election loss, for a look at some under-reported news from last week's election, and the worsening crisis that Trump really needs to eventually face Crimes Against Humanity charges for. [Audio link to show is posted below.]

The COVID-19 crisis continues its stunning surge in the U.S., with new daily case numbers now clocking in at 150,000 after reaching 100,000 for the first time only last week. Hospitalizations are also now shattering all time records, with some 65,000 admitted across the country. It's all getting much much worse, including (perhaps, especially) at the White House, following Trump's maskless super-spreader Election Night "Victory" Party last week. One senior official after another is now testing positive there, along with RNC officials who have reportedly been spending time spreading the virus while shuttling between the White House and various states in which the Trump Campaign is pathetically contesting election results. Sadly, the oldest member of Congress, 87-year old, 24-term GOP Congressman Don Young of Alaska also announced he tested positive on Thursday.

But perhaps of even more note to BradCast listeners, the wife of Georgia's hapless wingnut Sec. of State Brad Raffensperger says she is positive. That means the Secretary himself will now be forced to quarantine as his state is set to kick off the unprecedented --- and likely disastrous --- mess that Raffensperger described yesterday as "an audit, a recount, and recanvass all at once" in the statewide Presidential contest. Joe Biden appears likely to have defeated Donald Trump in the state by more than 14,000 votes.

We explained in great detail on yesterday's BradCast why Raffensperger's newly-announced statewide hand-count is likely to be a mess (and end up increasing Biden's margin if it's legitimately carried out). But now, with Raffensperger in quarantine, it will be even more of a mess --- or it could run much more smoothly now that he won't be there to screw everything up!

Either way, we're happy to associate with Karl Rove, of all people, today. He opined in the Rupert Murdoch-owned Wall Street Journal last night that "This election won't be overturned," arguing persuasively that Trump's "efforts are unlikely to move a single state from Mr. Biden's column, and certainly they're not enough to change the final outcome." If even Rove is unwilling to play along with Trump's hapless scheme to steal the White House for a second term, then you can probably rest easy that none off this is ultimately going to amount to anything more than anxiety, bluster and noise from our cry baby President.

But, in a welcome break today from our deranged, wannabe tyrant and outgoing President-in-denial, we catch up on just a few of the noteworthy contests and issues from last week's ballot concerning criminal justice reform and voting rights. Despite disappointing losses for Democrats in the U.S. House and Senate, there was quite a bit of very encouraging news for progressives in down-ballot races for District Attorney and County Sheriffs, as well as measures that take on mass incarceration and over-policing. We also saw voters approve the legalization of recreational marijuana in every state where it appeared on the ballot (including, yes, so-called "deep red" states), along with other very progressive decriminalization measures to begin winding down our long, failed War on Drugs.

We're joined today to discuss all of this and more by DANIEL NICHANIAN, popularly known as simply @Taniel on the Twitters. He is the Editor of The Appeal: Political Report and a Senior Fellow at the Justice Collaborative, where he reports on the local politics of criminal justice reform, mass incarceration and voting rights, among other important matters.

"When you look at the county level, at the state level, there are a lot of opportunities for progressives to push the conversation forward, to push policies in a more progressive direction, specifically on criminal justice," he tells me. "If you do care about mass incarceration or about law enforcement, about racial injustices that accompany all that, then the local level, the county level is really where you should be looking. Because prosecutors, sheriffs and officials that are elected locally are going to be some of the most important actors that are going to be deciding what practices and policies are going to be implemented. And that's where we saw some big flips this year."

He now faces federal felony fraud charges for stealing $1 million from a supposedly non-profit donor-driven wingnut effort that raised $25 million to build fencing on the U.S. southern border. We're happy to see yet another Trump-enabled con-man and grifter held accountable, but it comes with a warning about what this likely means for other federal indictments that could drop in the coming days ahead of the November 3rd election;

It's a somewhat dejected NICOLE SANDLER, once again guest-hosting the BradCast.

I'm dejected because of what I saw in today's House Judiciary Hearing on Trump’s Obstruction of Justice. Corey Lewandowski, the only one of the three witnesses subpoenaed to show up, might as well have stayed home for how forthcoming he was during the hearing. (Read: not at all). When Congressman Cicilline of Rhode Island suggested holding Lewandowski in contempt for his refusal to answer questions, Chairman Jerry Nadler said he’d "take it under advisement". Seriously? He should have sent the Sargent at Arms to arrest Rob Porter and Rick Dearborn, the two former White House staffers who ignored a congressional subpoena, and arrest Lewandowski for contempt of Congress.

So, let's talk about something we can change… er… or try to change. This Friday officially kicks off Climate Week with the Global Climate Strike, followed by a week of protests and activities, and the UN General Session and its climate summit. Today, I'm joined by TAMARA TOLES O'LAUGHLIN, North America Director of 350.org who filled us in on many of the events planned for the week and beyond.

To see just how far we've come (or, for the pessimists among us, not), I dipped back into my radio archives for a short interview I did with 350.org co-founder BILL MCKIBBEN from October 2009, as the organization was in its infancy, on the eve of the first Global Day of Climate Action. In nearly seven hours of long-awaited, halting responses from the former Special Counsel, the need for impeachment became clearer than ever...

As documented by today's BradCast special coverage, former FBI Director Robert Mueller finally offered his long-awaited testimony in the U.S. House during nearly 7 hours of hearings before both the Judiciary and Intelligence Committees. [Audio link to show is posted below.]

The Republican former Special Counsel confirmed key details of his two-volume, 448-page report [PDF] on Russia's alleged interference in the 2016 election, the Trump Campaign's coordination with that effort and, in most detail, multiple instances of both indictable and impeachable criminal corruption of justice laid out by the report. In frequently halting and often terse responses to members of the two House panels, Mueller, as promised, refused to stray from the "four corners" of his report, issued earlier this year following his two-year probe.

Nonetheless, as heard on today's program, his responses made clear that both Donald Trump and Attorney General Bill Barr --- not to mention the bulk of the Republican Party and their rightwing media outlets --- have been completely misleading the American public with their claims that Mueller's report somehow "exonerated" the President. It did anything but.

"Did you actually totally exonerate the President?" Judiciary Chair Jerrold Nadler asked during his opening round of questions. "No," Mueller flatly replied, later adding that "the President was not exculpated for the acts that he alleged committed." When Rep. Adam Schiff, the Democratic Chair of the Intel Committee, asked, "Your investigation is not a witch hunt, is it?," Mueller dryly responded: "It is not a witch hunt."

In fact, as Mueller's testimony made clear to those who watched --- especially to those who didn't bother to read his actual report --- any other American who committed the crimes detailed in the Special Counsel's report would have been indicted on multiple felony counts, as more than 1,000 former federal prosecutors have now stated. But for the Dept. of Justice Office of Legal Counsel's (unsupportable) opinion that a sitting President cannot be indicted, Trump would most likely have been charged long ago for his repeated, unlawful attempts to quash the Special Counsel's investigation.

Moreover, near the close of today's long hearings, Mueller offered a chilling warning about what he describes as still-ongoing efforts by Russia and other foreign powers, "as we sit here", to interfere with and manipulate upcoming U.S. elections.

We hold most of the commentary and analysis on all of this for another day in order to bring you extended excerpts on today's program from the detailed questions and answers with members of Congress from both parties and in both the Judiciary and Intelligence Committees. Guest: Legal reporter Mark Joseph Stern of Slate...

On today's BradCast: Happy birthday, Mr. President! To celebrate today, the New York Attorney general filed a civil lawsuit [PDF] against Donald J. Trump, his so-called "charitable foundation", and his children Eric, Don Jr. and Ivanka, charging that his foundation was used as little more than a personal and business slush fund, and to benefit his 2016 Presidential campaign. [Audio link to show follows below.]

All of that, NY Attorney General Barbara Underwood alleges in her suit, is in violation of both state and federal law. Many of the allegations against Trump's unlawful use of his foundation were reported in the run-up to the election, though much more self-dealing was discovered in the course of the AG's 2-year investigation, including that the Trump Foundation's board of directors had not met since 1999, that some board members had no idea they were even on the board, and that Trump's then-campaign manager Corey Lewandowski personally directed checks to be written from the foundation for campaign purposes.

Underwood's petition seeks nearly $3 million in reparations and to bar both Trump and his children from sitting on the boards of other nonprofit charitable organizations. She also refers the matter [PDF] to the Federal Elections Commission and the Internal Revenue Service for further investigation.

In other important news today, the U.S. Supreme Court issued a 7 to 2 opinion finding that Minnesota's polling place ban on t-shirts and buttons with political slogans, such as those worn by 'Tea Party' members at the polls in 2010, is overly broad and violates Constitutional First Amendment free speech protections. Slate legal reporter MARK JOSEPH STERN joins us to explain the Court's opinion, as well as the far more disturbing ruling from the GOP's stolen SCOTUS earlier this week, when the Court found 5 to 4 in favor of Ohio's voter roll purge scheme by Republican Sec. of State Jon Husted.

That scheme begins the process for removing voters from the rolls after a voter fails to vote in one single federal election. Stern discusses the troubling opinion which overturns the 6th U.S. Circuit Court of Appeal's 2016 finding that the Buckeye State's scheme directly violates the 1993 National Voter Registration Act's restriction against removing a voter from the rolls "by reason of the person's failure to vote."

On today's ruling, I am somewhat less sanguine about what the Court ruled than Stern is, but it's a close call. On the Ohio case, I think we're both in agreement. As he notes: "First, you are identified for a purge because you didn't vote just one single time, and second, you are purged because you failed to cast a ballot. Again, that would seem to go against not just the text but the express purpose of both [the National Voter Registration Act and the Help America Vote Law]. So for Alito to claim that he's just following the text of the law, and dissenters are trying to enact their own policy --- that rings absolutely false to me."

Sterns explains the largely semantic trick that Justice Samuel Alito used to, essentially, flip the provision written by Congress onto its head on behalf of the court's five Republican appointees; how the state's massive purges have disproportionately affected minority and low-income voters; and how Trump and Jeff Session's Dept. of Justice has reversed an unprecedented number of positions on federal laws since taking office.
