Some breaking news just before airtime helped, once again, threw off our best laid plans for today's BradCast. But, given this particularly huge breaking news, we're just fine with that. [Audio link to full show follows below this summary.]

The New York Judge in state Attorney General Letitia James' $250 million civil fraud lawsuit against Donald Trump, the Trump Organization, his eldest sons, Don Jr. and Eric, and two top company executives, ruled [PDF] that they all committed years of "persistent and repeated fraud" to the tune of billions of dollars by inflating the value of company assets when applying for bank loans. They also decreased the value of the same properties to receive favorable terms on both insurance and taxes, according to the ruling.

Judge Arthur Engoron found in favor of the state's key contention during the summary judgment phase of the landmark case on Tuesday, before the non-jury trial is slated to begin next Monday. Trump's attorneys had also sought summary judgement, hoping to see the case thrown out entirely. Instead, the key issue has already been decided against them and Engoron, in a brutal ruling, has stripped the former President, his company, his sons and execs, of control over several of his main New York properties. The Trump Organization and its various LLCs were placed into receivership to be controlled by court-appointed officers!

In the massive fraud suit, James seeks to permanently revoke the Trump family's license to do business at all in New York state. The trial, set to begin next week, will now determine the other issues at stake and the full breadth of penalties. Of course, Trump will appeal everything. But, make no mistake, this is a huge verdict against the failed former President and current 2024 GOP frontrunner who, as validated by Judge Engoron today, has built his business empire on decades of fraud and lies.

Among the many other important stories also covered on today's program...

  • Cassidy Hutchinson, star witness at last year's House January 6 Committee hearings and the former top aide to Trump's final Chief of Staff, Mark Meadows, warns that Trump "almost destroyed democracy in one day and he wants to run for President do it again."
  • This week's second GOP Presidential Primary debate, at the Reagan Library here in Southern California, will feature the same candidates as last month's debate in Milwaukee, other than former Arkansas Gov. Asa Hutchinson, who apparently did not meet the RNC's criteria. Trump was also not invited for refusing to sign the party's loyalty pledge, but he had already announced he wouldn't participate in any of their debates.
  • Labor economist Kathryn Anne Edwards offered a must-listen response to Louisiana's loopy U.S. Senator John Kennedy during a Senate subcommittee hearing last week on post-pandemic child care concerns. While Kennedy suggested he really really wanted to help, he had no idea where, oh, where the federal government could possibly find the money to do so. Edwards' straightforward, well-supported answer: Raise taxes on the wealthy that you've been lowering for the past two decades if you really care about children in need.
  • In a related matter on Tuesday, Joe Biden became the first sitting U.S. President, incredibly enough, to join a picket line with striking workers. In this case, he called on striking United Auto Workers members in Detroit to "stick with it," as he rallied workers with UAW President Shawn Fain. On Wednesday, the former President is set to speak at a non-union facility in a "red" county outside of Detroit.
  • California Governor Gavin Newsom signed a bill into law today that doubles the tax on sales of guns and ammunition in the state to help pay for increased school safety measures. While the federal government already charges a 10% tax on guns and ammo, California doubled it with one of their own, becoming the first in the nation to do so.
  • Bona fide good news today from our corrupted, packed and stolen U.S. Supreme Court. They rejected Alabama's attempt --- once again --- to violate the Voting Rights Act with a racially gerrymandered U.S. House map. Last June, in a surprising 5 to 4 ruling, with Chief Justice John Roberts and Justice Brett Kavanaugh joining the Court's three liberals, SCOTUS ordered the state to create a second majority black U.S. House District. Just 1 of 7 districts is currently a majority minority district despite African Americans comprising more than a quarter of the state's population. But Alabama Republicans, blatantly defying the U.S. Supreme Court, redrew their districts without including a second black majority district as mandated. A federal court panel then ordered a Special Master to draw up a new map instead. Alabama tried to stay that decision at SCOTUS, which unanimously rejected the state today in a one sentence ruling. That is good news for voters and bad news for several other GOP-controlled states trying the same gambit to cheat their way to a Republican majority in the House again next year.
  • Speaking of the Republicans' narrow majority in the U.S. House, it appears next to impossible at this hour to believe they will be able to agree amongst themselves on a spending bill to keep the federal government open as of Saturday. At least not without either Democrats saving them and/or House Speaker Kevin McCarthy losing his job as Speaker.
  • New Jersey's Democratic Sen. Bob Menendez, federally indicted for a second time late last week on charges of bribery and corruption, maintains his innocence. But the flood of fellow Democratic U.S. Senators calling for his resignation seems all but unstoppable now, with at least six of them --- including fellow NJ Senator Corey Booker --- calling for Menendez to step down. The charges, by the way, would seem to dramatically undercut Trump/GOP claims that the DoJ has been "weaponized" by Democrats against them.
  • Finally, Desi Doyen joins us for our latest Green News Report, as New Orleans declares a drinking water emergency; Fracking is "devouring American's groundwater" amid persistent drought in a number of states; and FEMA girds to suspend critical recovery operations in several states if Republicans shut down the federal government as of this Saturday...

Guest: Julian Brave NoiseCat of Data for Progress and the Canim Lake Band Tsq'escen; Also: Biden announces enough vaccine for all U.S. adults by May; Abbott lifts ALL masking, business restrictions in TX...
By Brad Friedman on 3/2/2021 6:42pm PT

As Washington State's Democratic Senator Maria Cantwell suggested last week, the phony GOP uproar over Rep. Deb Haaland (D-NM)'s nomination by Joe Biden to become the first Native American Secretary of the U.S. Interior Department is a 'proxy fight' over something else entirely. It might be over the dim future for fossil fuels. It might be over the fact that Haaland would be the first indigenous cabinet member for any Presidential Administration in U.S. history. Or it might be the fact that the GOP, without any real governing philosophy or values, is simply flailing to find relevance. We discuss all of the above with our guest on today's BradCast.  [Audio link to full show is posted below summary.]

But first up today, some late breaking news following on our conversation on yesterday's show with Dr. Karl Krupp of the University of Arizona's Zuckerman College of Public Health. He argued that, while COVID numbers have (thankfully) fallen precipitously in recent weeks from our horrifically deadly surge in the Fall, we may now be on the verge of "screwing it up all over again." Both he and top federal officials at the CDC see the previously-declining numbers beginning to plateau and/or tick back up in recent days, as states and cities are, once again, prematurely lifting restrictions.

Late news today both supports his worry on one hand, and somewhat mitigates it, a little bit anyway, on the other.  This afternoon President Biden announced that he has helped to broker a deal between Johnson & Johnson and Merck, the two pharmaceutical giants, to speed manufacture of J&J's newly-approved one-dose vaccine. Aided by his implementation of the Defense Production Act, he declared on Tuesday, the two companies, along with Pfizer and Moderna, will create enough vaccine for every American adult by the end of May. That is two months earlier than the Administration previously projected.

While that is certainly encouraging news, it is somewhat blunted by the idiot Governor of Texas, Greg Abbott's announcement today that, in direct contravention of warnings from scientists and federal health officials, the Lone Star State is immediately ending its statewide ask mandate and allowing all businesses to reopen to 100% capacity again. That, even as TX is still seeing about 7,600 new cases each day and averaged 227 COVID-19 deaths a day over the past week.

As Dr. Krupp warned on this program yesterday, we could see new record highs in the near future if we begin "screwing it up all over again". Both he and I, hoped his fears would be wrong. We'll find out soon enough.

In the meantime, Republicans continue to slow-walk top appointments to the Biden Administration, including his new head of Health and Human Services, despite the historic (and once again worsening) pandemic we are still battling.  Clearly, Republicans don't care. But what they do care about is fossil fuel production by the companies which fund their campaigns. To that end, last week's confirmation hearings for Rep. Haaland in the U.S. Senate's Energy and Natural Resource Committee were both revealing and maddening, especially for those in the Native American community.

Members of Indian Country have been watching her grilling in dismay and occasional fury as the first Native American nominated to head up any Cabinet level federal agency was falsely derided during her confirmation hearings last week as a "radical," largely by white, male GOP Senators who are, themselves, radically out of touch with even their own constituents' desire for more renewable energy and less fossil fuel development. Louisiana's Sen. John Kennedy went so far as to deride Haaland as a "neo-socialist, left-of-Lenin whack job" (before attacking Biden's now-abandoned nominee to head the Office of Management and Budget, Neera Tanden, for posting mean tweets some years ago.)

But are the almost-certainly futile attacks on the New Mexico Congresswoman about more than her not-radical-in-the-slightest position on fossil fuels? We're joined today by journalist, activist, and artist JULIAN BRAVE NOISECATVice President of Policy & Strategy at Data for Progress, as well as a member of the Canim Lake Band Tsq'escen and descendant of the Lil'Wat Nation of Mount Currie. We discuss what lies behind the pathetic pushback against Haaland's nomination and why it is such a monumental moment for so many Native Americans around the nation.

NoiseCat has recently written about the pointless and embarrassing attacks on Haaland in her confirmation hearings at both The Nation and Washington Post, where he charged that  "Republicans’ depiction of the first Native American ever nominated to the Cabinet as a 'radical' threat to a Western 'way of life' revealed something about the conservative id: a deep-seated fear that when the dispossessed finally attain a small measure of power, we will turn around and do to them what their governments and ancestors did to us."

We discuss all of that and more today with NoiseCat, who explains the horrendous historic role that Interior has held in the genocidal treatment of American Indians, and the important mission that it now carries out for all Americans, but especially those in the West. (It is also home to the Bureau of Indian Affairs.) "Never before in the history of Interior have we had a Native person on the other side of the desk," he tells me. "And I think Native tribes are very hopeful we can make some further headway in correcting the nation-to-nation relationship between the United States and its first peoples."

He also explains, by the way, why "Republicans might actually be burning their own wagon" in attacking Haaland.

Finally, Desi Doyen joins us for our latest Green News Report, as hundreds of thousands in Abbott's "free" Texas are still fighting to obtain water, two weeks after a winter storm knocked out power and water in the Lone Star State; the battle for water for thousands in Jackson, Mississippi after the same storm; and the natural gas industry's desperate attempt to keep their aging empire from collapse...

Northam calls special session in VA; GOP's 'Mexican standoff'; Hicks' nix fix; 2020 Dems seek climate solutions, Admin offers 'freedom gas'...
By Brad Friedman on 6/4/2019 6:25pm PT

As usual, on today's BradCast, everything you need to know --- whether you want to know it or not --- in 57 minutes or less...or your money back! [Audio link to full show follows below.]

  • First up today, Virginia's Democratic Governor Ralph Northam announces a plan to convene a special session of the state legislature this summer to respond to last Friday's massacre at a municipal building in Virginia Beach which killed twelve people. Republicans, who have long controlled both chambers of the gerrymandered state legislature, have nixed a panoply of popular gun safety measures year after year in subcommittees, such as measures to place limits on extended magazines like the type used in Friday's shooting, barring the purchase of more than one hand-gun per month, and background checks for all gun sales. Northam says he is asking for "votes and laws, not thoughts and prayers" from state lawmakers just months before the entire General Assembly will be on the ballot for the Commonwealth's November 2019 off-year elections;
  • The GOP establishment appears to be pushing back hard today against Donald Trump's promised new tariffs on all goods imported from Mexico, which Sen. John Kennedy (R-LA) recently predicted Trump won't actually implement. "He 's been known to play with fire, but not live hand-grenades," Kennedy opined regarding a new 25% tax that Americans would have to pay on all products from Mexico under the President's promised new scheme to, somehow, stop immigration across the southern border. Even members of his own Administration, however, don't appear to understand how Trump's proposed trade war would lead to an end of migration. But, in London today, Trump said it would be "foolish" to try and stop his plan to declare another "national emergency" to unilaterally impose the tariffs. Republicans are indicating they may have enough votes to override a Presidential veto. (We'll believe it when we see it.);
  • Meanwhile, our Constitutional Crisis continues, as the White House has now instructed former White House Communications Director Hope Hicks and former White House Counsel Chief of Staff Annie Donaldson to defy a Congressional subpoena for documents by claiming Executive Privilege over materials that have already been shared with Special Counsel Robert Mueller (and thus, have already had Privilege waived). With the persistent drumbeat calling for an official impeachment inquiry growing louder each day against the scofflaw President while the White House fights "all of the subpoenas" as per Trump's instructions, Democrats are preparing a number of votes in a number of Committees to hold current and former Administration members in contempt. In addition to possible votes of contempt in a number of committees, Dems have votes scheduled next week for the full House to declare both Attorney General William Barr and former White House Counsel Don McGahn in contempt;
  • In 2020 Presidential election news today, Joe Biden released a 22-page, $5 trillion climate plan that includes $1.7 trillion in federal spending over the next ten years, to be paid for by reversing the GOP's 2017 $1.5 trillion tax cut and ending subsidies for fossil fuel companies. We share Biden's introductory video for the plan, which vows to create millions of jobs and protect the retirement and pensions of fossil fuel industry workers. And we compare it to those of other 2020 candidates, including Elizabeth Warren who released her own "aggressive" $2 trillion plan to take on our climate crisis today as well. Biden's new proposal to make America carbon neutral by 2050 is receiving mostly high marks from environmentalists and comes in the wake of a much-derided recently reported comment from a campaign spokesperson claiming that the former Vice President was seeking a "middle ground" on climate that might be joined by Republicans. Climate hawks and supporters of Rep. Alexandria Ocasio-Cortez' Green New Deal resolution characterized Biden's new proposal as an encouraging response to activism and pushback from their ranks;
  • Finally, Desi Doyen joins us for our latest Green News Report, with news of Republican obstructionism finally giving way to a long-awaited $19 billion disaster relief package in Congress, the Trump Administration's newest scam to try and suppress climate science, Colorado's new plan to go big on renewable energy, and....yes...the Administration's promise of "freedom gas" for the world!...

(And a few sugar plums, too!)
By Brad Friedman on 12/21/2017 6:09pm PT

On today's BradCast: He's a mean one. But you already knew that. So, we'll try not to let him ruin Christmas, at least if we can help it. [Audio link to today's show follows below.]

As Christmas nears, why not become even more of a pariah to the rest of the world by literally threatening friends and foes alike at the United Nations over Trump's unpopular plan to move the U.S. Embassy in Israel from Tel Aviv to the divided city of Jerusalem? That's what UN Ambassador Nikki Haley did on Thursday, and it wasn't taken kindly --- by friend or foe. She also repeatedly lied about support from Americans for the dangerous scheme. (They're strongly against it, including a plurality of American Jews, though Trump and the GOP's big donors are in favor of it.) The move is just the latest by this Administration to cause U.S. standing in the world to plummet even further since taking office. So much for making American "great again".

But, there is some good news today for Americans who favor health care, as the Administration is forced to admit that sign-ups for the Affordable Care Act ("Obamacare") this year were nearly as high as they were under President Obama last year, despite the Trump Administration defunding advertisement and assistance for the Open Enrollment period, cutting its length in half, and Trump's repeated lies that is Obamacare is "dead", "gone", "imploding", etc. In the bargain, as many Americans now favor government-run healthcare as those who prefer a private healthcare system. That, after Americans had previously preferred a private insurance system by nearly 30 points in the same poll back in 2010, before Obamacare was initially enacted.

And more good news before the holidays: another completely unqualified nominee for a lifetime appointment to the federal bench has withdrawn, though the GOP is still jamming similarly unqualified nominees through the Senate confirmation process at a record pace.

Next, Desi Doyen joins us for another busy Green News Report with some discouraging news, with the passage of the GOP tax bill, for the pristine Alaska National Wildlife Refuge (ANWR) and for victims of our quickly increasing climate-fueled natural disasters, but also some encouraging news elsewhere in the world.

And, finally, since it's Desi and my last show before Christmas --- (Though not the last BradCast before Christmas! Angie Coiro sits in for tomorrow's show with her exclusive interview with AL GORE!) --- it seems only fitting today to end today with a dramatic holiday reading of How the Trump Stole America.

Merry Christmas, Bedford Falls!...

By Brad Friedman on 12/15/2017 6:21pm PT

On today's BradCast, a spoonful or two of sugar where we can find it, along with much too much bitter medicine. [Audio link to show follows below.]

Among the stories covered on today's jam-packed 'BradCast'...

First up: The massively unpopular Republican tax scam lurches toward the finish line after the last of the pretend GOP hold-outs in the U.S. Senate now seem to be on board. They all know it's a scam, of course, one that will not, as they pretend, "pay for itself". And most predict the tax bill will gravely hurt the GOP's chances of holding on to the U.S. House in 2018. But they don't seem to care for some reason Moreover, they are openly admitting publicly that they are coming for cuts to Social Security, Medicare and Medicaid almost as soon as the largest redistribution of wealth from the poor and middle class to corporations and the wealthy in the history of the nation is completed before Christmas.

Then: Earlier in the week, Trump's beleaguered Sec. of State Rex Tillerson had announced that the U.S. was ready to meet with the North Koreans for peace talks without preconditions. By week's end, however, that hopeful message of potential peace took a drastic u-turn, as Tillerson appears to have reversed course at the last minute during his remarks at the U.N. on Friday.

Meanwhile, even though they have, up until now, failed to enact any major legislation to date, Trump and the Republicans have been wildly successful at ramming lifetime appointments of radical right-wing jurists to the federal bench through the U.S. Senate. Some of those appointees have been ridiculously unqualified, though at least one Senate Republican is beginning to put the brakes on those nominees. We share part of the astonishing Senate Judiciary Committee colloquy this week between Sen. John Kennedy (R-LA) and Mark Spencer Petersen, Trump's embarrassingly unqualified nominee for a lifetime post on the U.S. District Court for the District of Columbia.

Finally, we get to at least a spoonful of sugar with a musical tribute to the apparently failed U.S. Senate candidate Roy Moore of Alabama, plummeting approval ratings for the President, the Vice-President and the entire Republican Party, and the hilarious case of pretty much every member of the Trump family in D.C. successfully suppressing their own votes in last month's New York mayoral election.

All of that and much more in today's BradCast. Enjoy!
