Today on The BradCast: His various attempts to undermine the Constitution and American civil rights law continue to be blocked by judges in the courts. But that isn't stopping the President and his lackeys from gutting civil rights protections and environmental justice enforcement at key federal agencies...for the moment. Nor is it stopping our guest today, a 30-year EPA veteran, from continuing the good fight at her agency. [Audio link to full show follows this summary.]

FIRST UP... Donald Trump proved to be a loser again on Thursday in three different federal courtrooms, in three different civil rights-related law suits, as determined by three different federal district judges (one of whom was appointed by him.) Two of the judges, one in New Hampshire, the other in Maryland, blocked his Dept. of Education's attempt to cut funding to K-12 schools with anti-discrimination or DEI (diversity, equity and inclusion) programs.

The third civil rights-related court loss for Trump today was in D.C., where a federal judge blocked his attempt to mandate proof of citizenship when registering to vote, as per his recent attempted power grab via an Executive Order meant to undermine democracy, U.S. elections and the right to vote.

In the meantime, Harmeet Dhillon --- a rightwing culture warrior clown and former Trump 2020 "Stop the Steal" attorney --- has been appointed to oversee the Dept. of Justice's Civil Rights Division, where she has reportedly unleashed a "bloodbath" among senior officials at the office which oversees, among other things, voting rights. Current and former employees at the division charge that Dhillon is turning civil rights law upside down, by using it, as one former department employee familiar with the new changes said, to "victimize the very people it was created to protect."

THEN... In related-ish news, we reported earlier this week that Trump's new EPA Administrator, Lee Zeldin, sent letters to some 450 staffers at the Agency's Environmental Justice and External Civil Rights office, notifying them that they are being fired or reassigned as the office is being shut down. The firing letters to longtime staffers --- including scientists, researches and attorneys --- were sent on Monday night, Earth Day eve.

The EPA's Environmental Justice office, created during the Administration of Republican President George H.W. Bush, is tasked with protecting minority communities who are often most vulnerable to toxic emissions from chemical plants and oil refineries. Down in Louisiana's "Cancer Alley", for instance, there are about 150 plants and refineries concentrated along a stretch of land between New Orleans and Baton Rouge. The population in the area is mostly Black, and multiple studies have found that nearly every census tract in the area ranks in the top 5% nationally for cancer risk.

Since taking office, however, Team Trump have pledged to "end the use of 'environmental justice' as a tool for advancing ideological priorities" and have been unwinding the unit's work under previous Presidents. For example, under Joe Biden's Administration, the EPA sued the owner of a Cancer Alley chemical plant where cancer cases were found to be 44% higher for those who lived within one mile of the plant than the national rate. The Biden Administration sued the company to clean up their act. The Trump EPA recently withdrew the lawsuit.

Amidst those horrors, we're delighted to be joined today by JOYCE HOWELL, 30-year veteran EPA senior attorney and Executive Vice President of the American Federation of Government Employees (AFGE)'s Council 238, representing some 8,400 EPA workers nationwide.

"'Environmental justice' is just another extension of the fundamental American right to equal protection under the law," she tells me when I ask her to explain what the phrase actually means. "To ensure that, no matter where you live, the laws that protect human health and the environment will apply to you. Environmental justice gives people the avenue for their voices to be heard when determinations are made about where to put a factory that spews so much pollution, relative to where they live. Or, if they are already living there, and there's someplace nearby that impacts them, that they would be able to, as members of the public, have their voice heard with regard to the permitting of that plant, to the number of inspections that take place [and] the oversight of programs that are delegated from EPA to the state."

Howell finds it "disconcerting" that EPA Administrator Zeldin has shut down the Environmental Justice office, removing its history from the Agency's website, dismissing the work of the office as ineffective and "an excuse to fund left-wing activist groups". That, as Zeldin vows to slash the EPA budget by 65%.

She tells me that while work is continuing at the EPA nonetheless, its "enforcement program has slowed down tremendously." More than even "under Trump 1," when she also served. Explaining how she, and her colleagues at the Agency, survived his first term, Howell says, "We do what we always do: we put our heads down and we did our work. That's what carried us through."

Her union, AFGE, may have plans to challenge the recent layoffs and reassignments in court, though she did not yet want to give away their thinking on that. But, when I asked why she was willing to speak on the record on these matters, --- while many of her current and former EPA colleagues have been speaking to the media under condition of anonymity due to concerns of retaliation --- Howell notes that, since she speaks on behalf of the union, she may have some protections under federal labor law that others may not, protecting her "speech on behalf of workers."

But, she adds, she recently "attended an organizing meeting and someone said, 'Cowardice is contagious. So is courage.' And I thought to myself, yeah, that's true. For me, it's important. I haven't been at EPA for all these years just to get a salary. I am there because I believe in the mission. I will tell you every single person there feels strongly the same way. We don't do it on behalf of ourselves. We do it on behalf of the American people."

EPA chief Zeldin lies about U.S. energy dominance, 'EV mandate', vows to increase pollution, cancer, deadly toxins; Also: Judge orders thousands of fired federal workers back to work 'immediately'...

We've got a few explainers on today's BradCast. But I thought you might find it useful to be armed with some facts, truth and understanding right about now. [Audio link to full show follows this summary.]

Among our explainer coverage today...

  • Not long after we got off air today, Democratic Senate Minority Leader Chuck Schumer signaled he would allow Donald Trump and Congressional Republicans to adopt a bad six-month spending bill rather than fight them, because that fight would results in a government shutdown as of midnight on Friday. It's certainly a dilemma for the Dems, many of whom seemed to come around to the decision to fight rather than fold today. Even the nation's largest federal workers union --- whose members would arguably be first and most directly effected by a shutdown --- persuasively called on Dems to do just that, arguing: "With thousands of federal workers either fired, placed on administrative leave, or at immediate risk of losing their jobs, AFGE members have concluded that a widespread government shutdown has been underway since January 20 and will continue to spread whether senators vote yes or no on H.R. 1968." Schumer's announcement that he will vote with Republicans to end debate on the Continuing Resolution Friday, suggests the GOP is likely to get the support of at least eight Democrats Senators that will be needed to overcome a filibuster tomorrow. But, we'll see if a few more Dems find the spine to stand up against Trump and stand up for Americans before then.
  • Speaking of AFGE, they and a few other unions won a big victory today. They had sued the federal government to restore the jobs of thousands of "probationary" federal workers unlawfully fired by the Trump Administration. Today, a federal judge ordered those workers, at the Departments of Veterans Affairs, Agriculture, Defense, Energy, Interior and Treasury to be rehired "immediately". U.S. District Judge William Alsup excoriated the Trump Justice Department's legal justification for the layoffs and their refusal to present evidence to support their case. "It is a sad day when our government would fire some good employee and say it was based on performance when they know good and well that’s a lie," railed Judge Alsup from the bench. "That should not have been done in our country. It was a sham in order to try to avoid statutory requirements."
  • Yesterday, you may have seen headlines about Trump's EPA chief Lee Zeldin declaring a rollback of more than 30 important health, safety and environmental regulations. (Eg: "Trump takes an ax to more than a dozen pollution rules in rapid-fire deregulation".) In fact, none of those regulations have actually been rolled back. Yet. "Today I'm pleased to make the largest deregulatory announcement in U.S. history," the new EPA Administrator dramatically declared in a two-minute video filled with one lie after another, falsely describing "suffocating rules that restrict nearly every sector of our economy and cost Americans trillions of dollars." The video was released to accompany Zeldin's Wednesday essay in the Wall Street Journal offering more false and misleading details on those lies.

    Today, we step through the key lies, explain the truth about them, and what Zeldin's announcement really amounts to. No, there is no "EV mandate" and the U.S. is already "energy dominant" as it was when Trump took office after America long ago became the world's leading producer of oil, gas, coal and renewable energy under President Biden, who also adopted a number of landmark climate initiatives that increased manufacturing, boosted the economy, produced clean energy and made America safer for everyone.

    It will be a long and difficult path for Trump's EPA to overturn dozens of health and safety rules long in place, as well as the agency's landmark 2009 scientific "endangerment finding" on the adverse health effects of planet warming carbon pollution on which a number of those regulations, adopted under the Clean Air Act, are based.

    Bottom line: the Trump Administration plan, as detailed by Zeldin, will increase pollution, worsen the climate crisis, allow more deadly cancer-causing toxins into our air and water, and force Americans to pay the bill for all of it through what Desi Doyen describes as a "pollution tax". You may support Zeldin and Trump's scheme to do all of those things, but let's be clear about what their announcement yesterday is calling for.

    The fossil fuel industry --- already the most profitable industry in the history of civilization --- immediately declared their support for the effort. Few others have done so and many have vowed to challenge it in court. Now it's up to all of us to fight against these unpopular plans. They are whipping up disinformation echo chambers to convince themselves that it was something other than climate change-fueled dry weather and hurricane force winds to blame for the past week's unspeakable disaster and death. I've got a word or two in response on today's program, including some thoughts about the fact that California gives five times more to the federal government in tax dollars than we receive back in return. You're welcome, Senators --- and all of your loser MAGA buddies banging that same pathetic, loathsome drum.
  • Speaking of fossil fueled climate change deniers, Donald Trump's nominee to head up the Dept. of Energy, fracking company CEO Chris Wright, doesn't believe wildfires have anything to do with climate change. And Trump's pick to lead the Environmental Protection Agency, former Rep. Lee Zeldin of New York, used to call for reducing our reliance on fossil fuels. Now tapped for Trump's EPA, he's singing a different tune, as Desi Doyen reports today in her coverage of Zeldin's U.S. Senate confirmation hearing on Thursday.
  • In what suffices for good news today, you may recall that, just before Christmas, President Biden, who vowed during his 2020 campaign to end the federal death penalty (he didn't), mercifully and morally commuted the sentences of 37 of the 40 people on federal Death Row to life in prison without the possibility of parole. (He should have done the same for the other three, as reprehensible as they may be. The Government shouldn't be in the business of killing its own citizens.) But on Wednesday, according to a scoop from LAW DORK's Chris Geidner, Attorney General Merrick Garland officially withdrew federal approval for the use of single-drug lethal injections of pentobarbital in federal executions. That may slow down, at least, another killing spree by Donald Trump, who ordered the executions of 13 federal Death Row inmates during the final six months of his first term in office. That, after a total of just three people had been executed under all previous Presidents from the years 1975 through 2020.
  • And, speaking of warnings of what is coming --- or already here --- in a 17-minute prepared speech (transcript) from behind the Resolute Desk in the Oval Office, President Joe Biden issued his Farewell Address to the American people on Wednesday night. He briefly touted his Administration's substantive (and, so far, wildly under-appreciated) record, noting that "It’ll take time to feel the full impact of what we’ve done together, but the seeds are planted and they’ll grow and they’ll bloom for decades to come." He then went on to issue a series of dire warnings that echoed President Eisenhower's 1961 Farewell Address, in which he famously warned of the menace of the then-burgeoning Cold War Military-Industrial Complex. In this case, Biden warned of the dangers of a Tech-Industrial Complex and explained that "an oligarchy is taking shape in America of extreme wealth, power and influence that literally threatens our entire democracy, our basic rights and freedoms and a fair shot for everyone to get ahead." He hearkened back to the push-back against the Gilded Age of the robber barons over a century ago, while charging that Americans are now "being buried under an avalanche of misinformation and disinformation enabling the abuse of power." We share an extended excerpt of those warnings and others --- "the existential threat of climate change", unchecked A.I. development, our corrupted U.S. Supreme Court, a "crumbling" free press --- from Biden's final Oval Office address before Monday's Inauguration of the first convicted felon, adjudicated rapist and adjudicated insurrectionist to ever be sworn in as President of the United States.
  • Finally, Desi Doyen joins us for our latest Green News Report with more on the L.A. Fires and the long recovery ahead; more on Trump's Energy Secretary nominee; more on Joe Biden's encouragement to Americans in his Farewell Address to hold the line on climate action in the years ahead...

Today on The BradCast: He hasn't even been sworn in and he's already violating federal law. Surprised? In this case, the law that he's violating is one that he himself signed into law in 2019. [Audio link to full show follows this summary.]

The flood of wholly-unqualified appointments to cabinet level posts and other top appointments, since Donald Trump barely won a plurality (not a majority) of the national popular vote two weeks ago, continues. You're probably well familiar by now with the nominations of alleged child sex trafficker Rep. Matt Gaetz for U.S. Attorney General, the nation's top law enforcement official, and of Fox "News" weekend host Pete Hegseth as Defense Secretary.

Neither have any experience leading huge organizations (or even medium-sized ones) with millions of employees --- or even any experience at all at the organizations they have been tapped by Trump to lead. And Hegseth, who was disqualified from serving in the National Guard during Joe Biden's 2021 inauguration as a potential "insider threat" due to his White Supremacist tattoos, was also revealed over the weekend by Washington Post to have paid off a woman to settle her accusations of sexual assault. He reportedly denies the rape allegation, if not the settlement.

The Trump Transition team claims they knew nothing about any of it when they selected Hegseth to head DoD. That should give you chills. Perhaps that's because the Transition team hired a private firm to vet Trump's nominees, rather than rely on the FBI, as they would be doing, had Trump complied with the bipartisan amendment to the Presidential Transition Act that he himself signed into law during his first term.

The measure also requires Presidential candidates to sign agreements with the White House and General Services Administration by October 1 before an election to begin the transition process with a publicly disclosed ethics policy and a public statement of how the future President plans to avoid conflicts of interest while serving, if elected. It allows for FBI vetting of incoming officials to grant access to classified documents and other material from the previous Administration at the nation's 438 Executive Branch agencies that they will control. Signing the agreement, as required by law, also includes a vow that Transition teams may take no more than $5,000 from any one person for certain transition costs, and that they will publicly disclose the names of those donors, among other things.

Donald Trump has, so far, refused to sign any of those agreements, alarming ethics, national security and legal experts as he begins defying federal law (again) even before taking office for a second term as President.

Joining us to explain the national security and other serious consequences and ramifications of all of this is LISA GRAVES. She is uniquely qualified to discuss these issues, given her service in all three branches of the federal government, as a Former Deputy Asst. Attorney General at the U.S. Justice Dept.; former Chief Counsel for nominations in the U.S. Senate; and former Deputy Chief for the Article III Judges Div. of the U.S. Court system. She now heads up the government watchdog and political research organization, True North Research.

We've got a lot to discuss with Graves today, beginning with what alarms her most about Trump's refusal to sign the Presidential Transition Act agreements. She identifies the avoidance of the FBI background investigation process as a "huge red warning flag."

"He does not want his cabinet appointees to go through the regular clearance process. The FBI background process is a long-standing part of the process," she tells me. It's "designed to help look at whether you have any issues that could made you blackmailable. That's part of it. For people who are seeking access to our most sensitive information, there are additional national security assessments. The investigators are looking at: do you have stability, trustworthiness, reliability, discretion. Do you have good character and judgment, honesty, and unquestionable loyalty to the United States to ensure that people who get positions of trust, with access to our most sensitive information, have unquestioned loyalty to the United States and not a foreign power."

Graves argues that "many" of Trump's nominees "have serious deficits in more than one of those categories." She also tells me that Trump's own "track record would raise serious concerns about his trustworthiness, his reliability, about his fitness for having access to information."

As to Trump's plans to force the U.S. Senate into recess, so that he may avoid the Constitution's mandate for "advice and consent" on top-level appoints, she describes the scheme as "un-American, unconstitutional, and unprecedented."

What should be done --- what can be done --- to shore up advances made in recent years in the fight against climate change before "a climate denier Fascist-in-Chief" takes office? And what can be done to slow down his promised destruction thereafter? Those are just some of the questions discussed on today's BradCast. [Audio link to full show follows this summary.]

FIRST... A few updates on some key races still being tabulated and/or called, unofficially, by media...

  • Democratic Rep. Ruben Gallego has been called as the winner over Republican election denier Kari Lake for the U.S. Senate seat in Arizona.
  • Republican hedge fund CEO Dave McCormick's lead over incumbent three-term Democratic U.S. Senator Bob Casey has narrowed to about 30,000 votes out of seven million cast in Pennsylvania. Crucially, that gap is currently less than one half of one percent, meaning it would trigger an automatic recount in the Keystone State if it holds.
  • As of now, if the current numbers become official in all "called" races, Republicans will hold at least 52 seats in the U.S. Senate majority next year, and Democrats will hold at least 47.
  • Majority control of the U.S. House is still up for grabs, with 16 uncalled races (depending on who you're asking) , though Republicans need just four more seats to win what, as of now, appears likely to be a very narrow majority in the lower chamber of Congress next year. A smaller one than even the thin majority they've been embarrassingly wrestling with over the past two years.

THEN... Donald Trump's nominations to key Executive Branch posts are coming very quickly now. Among them, as of airtime today...

  • Florida Rep. Mike Waltz, a former Green Beret and China hawk for National Security Adviser.
  • Florida Sen. Marco Rubio, "Li'l Marco" as Trump derisively used to call him, as Sec. of State. He has already reportedly said he would not call for a ceasefire in Gaza.
  • Puppy killer and South Dakota Governor Kristi Noem as Chief of the Dept. of Homeland Security.
  • John Ratcliffe, Trump's former Dir. of National Intelligence is tapped to head the CIA.
  • Trump's first-term acting Director of ICE and family separation supporter, Tom Homan tapped for "Border Czar", after telling 60 Minutes last month that he intends to lead the mass deportation of millions of immigrants and that it can be done without separate families: "Families can be deported together," he said.
  • Former New York Rep. Lee Zeldin, who voted against a raft of environmental protection laws in Congress, is named to head the Environmental Protection Agency (EPA).

NEXT... All of that as Trump's transition team at EPA, led by a former oil lobbyist and a former coal lobbyist, prep to reverse every single piece of Joe Biden's climate agenda as possible, including, as the New York Times reports (gift link), "withdrawing the United States from the Paris climate agreement, eliminating every office in every agency working to end the pollution that disproportionately affects poor communities and shrinking the size of national monuments in the West to allow more drilling and mining on public lands."

This comes on the same week that climate advocates from around the globe are gathering in Baku, Azerbaijan for the 29th annual U.N. Climate Summit (COP29) and vowing to continue the global trajectory toward clean, inexpensive, renewable energy to replace the fossil fuels that are heating the globe toward ever-quickening disaster. They claim "they're ready for Trump 2.0" after facing a similar challenge in 2016. But that may be easier said than done.

We're joined today by JEAN SU, Senior Attorney at the Center for Biological Diversity and Director of their Energy Justice Program to discuss the Biden Administration's legacy, including success and failures; what his Administration can now do before leaving office to shore up its successes; and what groups like hers can do to stop, or at least slow down, the destructive attacks on the environment promised by a second Trump Administration.

"What we'll be seeing happening with the Trump Administration is that it is a total, unfettered giveaway to oil and gas. He does not care about clean energy. He does not care about the communities, at all, in any of the places that fossil fuels are being produced or shipped," says Su, whose organization vows "unprecedented resistance".

"I'll be really honest. It is just, truthfully, a dark moment at this time, in terms of our federal work. We are basically facing a trifecta of monopolization of all three branches of government under a climate-denying fascist," she tells me. "We have our Executive Branch taken over by a climate denier Fascist-in-Chief, Donald Trump. He has vowed to 'drill baby drill' with no relief for any clean energy or any care for climate. And he will strip the Environmental Protection Agency [and] the Civil Rights Division of the Dept. of Justice, an entire administrative apparatus entirely smothered, stripped bare, and not functional in any way in terms of actually protecting our environment and our health and safety."

But, she also explains, there are a number of actions that the Biden Administration can still take before leaving office; actions that legal organizations like hers can take after Trump comes in; and actions that the states must take as soon as possible to, at least, mitigate the worst of the damage as long as possible.

"The bright spot in all of this, the place where we are going to see any movement on climate is at the state level," Su argues. "What we've been hearing from different people on the ground is that the initiatives that are happening at the state level are things that people can feel. They are able to see how some climate initiatives will generate the jobs that they need in their own backyards. That gives us a bright spot of actual work to be done." She also cites local efforts to reform electricity regulators, elected Public Utility Commissions and monopoly utility companies. "Those monopoly utilities are stifling rooftop and community solar, and digging in on more fossil fuels. That's an area that is ripe for intervention and organizing. Those are the bright spots that we're going to see the most movement in climate."

Corrupt WV Dem still undermining Dems, nation, planet; Secret Service deleted Jan. 6 texts; Arrest warrant issued for indicted CO GOP election official; NY's GOP Guv nom submitted 13,000 fraudulent signatures...

I don't relish saying "I told ya so" on The BradCast. But, in today's lead story, unfortunately, I have to yet again. [Audio link to full show follows this summary.]

Among the news stories covered on today's program...

  • We've been telling you for months that West Virginia's corrupt Democratic U.S. Senator Joe Manchin --- whose family makes millions from the coal industry and campaign rakes in millions from the fossil fuel industry --- never had any intention of allowing any environmental measures to pass that might actually help reduce the deadly emissions that are causing our climate crisis. Nonetheless, his fellow Democrats and corporate media, like Charlie Brown, seem to keep buying his BS claims that he really really wants to adopt environmental provisions and raise taxes on the wealthy to help pay for them. After months of more pretend negotiations, Lucy pulled the football away from Charlie Brown yet again on Thursday night.
  • Gas prices are finally falling. Will Joe Biden get credit for that, since he was inappropriately blamed for Big Oil's record profits from war profiteering and price gouging? (Which all Republicans in Congress refused to outlaw recently?)
  • Texas' privatized, unregulated electric grid is on the brink of collapse yet again, thanks to record heat (which is thanks to a fossil fuel industry-sponsored climate crisis that all Republicans and Democrat Joe Manchin refuse to do anything about.) Will Lone Star State voters this November finally figure out who is to blame for the outages --- and hundreds of deaths that continue to come with them --- during both extreme heat and cold in the state?
  • Oh, look! The Secret Service seem to have accidentally erased all of their text messages from January 5 and 6, 2021, even after the Dept. of Homeland Security's Office of Inspector General asked to see them. Luckily, not much happened over those days that the American people would very much like to know about.
  • Oh, look! A D.C. Metropolitan Police Officer has reportedly testified to the bipartisan U.S. House Select Committee investigating the January 6, 2021 insurrection and Donald Trump's other attempts to steal the election that there was a physical altercation with Secret Service officials inside Trump's limo when he wanted to go to the Capitol instead of back to the White House that day. The alleged under-oath corroboration has so far received much less corporate media notice than the anonymous, still-unnamed person at the Service who claimed that Cassidy Hutchinson was lying during her explosive public testimony late last month about what she'd been told about the incident just after it happened. And the Secret Service officials who were supposed to come forward to dispute her story to the Committee have still failed to do so. (Sure would have been helpful if the Service hadn't erased their text messages from that day.)
  • Mesa County, Colorado's disgraced County Clerk (and recently failed GOP candidate for Secretary of State), Tina Peters, is in yet more legal trouble. The easily-duped MAGA election fraud conspiracy theorist --- now charged with 7 felonies and 3 misdemeanors related to her orchestrating an illicit scheme to unlawfully copy and publicly distribute very sensitive voting system software last year --- had a warrant issued for her arrest by a Judge on Thursday after she left the state without court permission to speak at another evidence-free MAGA election fraud conspiracy conference in Vegas.
  • But the actual election fraud perpetrated by GOP officials running for office continues. Just a few short weeks after 5 of the 10 Republicans running for the Gubernatorial nomination in Michigan were struck from the ballot for turning in tens of thousands of fraudulent petition signatures, it's happened again. This time in New York. The GOP nominee for Governor, U.S. Rep. Lee Zeldin --- who voted against confirming Joe Biden's 2020 Electoral College victory and whose website features a "Team Zeldin Election Integrity Task Force" page, vowing to work "around the clock now and into November to ensure we have fair elections" --- apparently turned in nearly 13,000 fraudulent petition signatures, including 900 pages of photocopies of signatures, in hopes of appearing on the Independent Party ballot line this fall. The Libertarian Party challenged the fraudulent signatures and the state Board of Elections confirmed the fraud, denying Zeldin a third line on the November ballot.
  • Finally, Desi Doyen has our latest Green News Report, with a passel of climate related stories that are so grim, we can't even bring ourselves to tease them here. On the other hand, she does have one pretty good piece of news out of California...so there's that!
