Guest: NatSec, cybersecurity and voting system journalist Kim Zetter; AND BREAKING: MUELLER GIVES REPORT TO ATTORNEY GENERAL...
By Brad Friedman on 3/22/2019 6:54pm PT

Today's BradCast kicks of with the breaking news of the announcement, just minutes before air, that Special Counsel Robert Mueller has finally wrapped up his two year investigation into alleged Russian interference in the 2016 Presidential election, cooperation in the effort by Team Trump and any obstruction of that probe by the President of the United States. Though that may be the least troubling news on today's show. [Audio link to complete shows is posted below article.]

Mueller's confidential report has now been delivered to Attorney General William Barr, as per statute, and Trump's new AG promptly notified Congress [PDF] to say he plans to release a summary of the report as soon as possible, potentially as early as this weekend. We share what we know (and don't) from that freshly breaking news at the top of today's program. Then it's back to, at least some of, our previously scheduled program...

On the day that Jimmy Carter officially becomes the longest living President in U.S. history, we're reminded of a warning he issued while serving as co-Chair, with Bush Family consigliere James Baker, of the so-called "Commission on National Election Reform" formed by a group of Republican operatives after the highly disputed 2004 Presidential election in Ohio. The Blue Ribbon panel was, ostensibly, formed to make recommendations on how to improve elections after the second disastrous Presidential election in a row, following the 2000 debacle in Florida. But while the Republicans who created the private commission had hoped for a recommendation for photo ID voting restrictions at the polling place, the one we've cited most often over the years is the Commission's unambiguous finding that the greatest threat posed to elections comes from insiders, such as election officials and private voting system vendors. "There is no reason to trust insiders in the election industry any more than in other industries," the Carter/Baker panel warned in their final report.

That warning is particularly trenchant today, with, as we recently reported, the Democratic National Committee now calling for some form of remote or online voting during their 2020 Presidential nominating caucuses next year and what has just happened with the online voting system that Switzerland has used for some time in parts of the country.

The Swiss had planned to roll out their system nationally this year, but as longtime cybersecurity and voting system journalist KIM ZETTER of MotherBoard and the New York Times reports, things did not go as well as planned.

Zetter joins us to discuss the alarming story of what happened when Switzerland, last month, opened up a month-long public hack challenge for the system which, they previously boasted, had easily passed many regular internal security checks and even several they had contracted from KPMG, an international auditing giant.

But, as Zetter recently detailed at MotherBoard, the Swiss system, designed by Barcelona-based Scytl --- "a leader in developing various internet and other voting solutions for national or regional elections in 42 countries, including at least 1,400 counties in the US" --- was almost immediately found by independent researchers to feature "a critical flaw in the code that would allow someone to alter votes without detection ... in a part of the system that is supposed to verify that all of the ballots and votes counted in an election are the same ones that voters cast." That flaw, Zetter details, "could allow someone to swap out all of the legitimate ballots and replace them with fraudulent ones, all without detection."

As she tells me today, the failure is even more troubling than that, as it allows for a single insider to exploit a "back door in the cryptography scheme, that would allow someone to alter votes but make it look like the votes haven't been altered at all." In other words, "the system is supposed to have a check in it that's designed to ensure that the ballots that go into that encryption process and come out of that de-cryption process are the exact same ballots. But there's a flaw in that proof that verifies that those ballots are the same. Therefore, that would allow someone to swap out the votes and ballots while the proof still seemed to show that the ballots were the same."

Swiss Post, which runs the system, and Scytl who sells it, claim the exploit could "only" be carried out by an insider, so why worry?

So how are those plans coming for remote voting in the DNC's 2020 Presidential caucuses next year? And how can it be that we keep attempting these same unworkable electronic and online voting schemes from private vendors and election officials who swear by the "certified" security of their systems, only to find they are anything but secure once independent experts are allowed to test them in any way?

"We should have a voting system where we're not required to trust anyone --- we're not required to trust election officials, we're not required to trust the vendors, we're not required to trust the voting machine itself," Zetter, who has been covering electronic voting and tabulation systems on her national cybersecurity beat for more than a decade, tells me. "We should have a system that can be audited independently of all of those parties in order to verify the election results. That's really in the best interests of everyone." What such a system should be, of course, is another matter, which we also discuss, and even debate a bit, on today's important program...

From Smartmatic to Diebold: Responding (yet again) to partisan worries of vote flips and voting machine ownership...
By Brad Friedman on 10/25/2016 6:40pm PT

It's that time of the election cycle again. Happens every four years. (Every two, actually.) On today's BradCast: That moment when partisans on the Right declare Democrats are stealing the election with voting machines owned by George Soros and Democrats worry that Republicans are doing the same via private companies actually owned by big GOP supporters. [Audio link posted below.]

Both sides see votes flipping on touch-screen systems to their opponents. Both sides declare it only happens to their chosen party. Both sides have reason to worry about private ownership of our electoral systems. Both sides tend to be very selective about their concerns. And both sides do nothing about it until it's time to start freaking out again just before the next election.

The old, previously debunked charge that the progressive billionaire Soros is somehow controlling voting machines across the U.S. re-appeared yet again in the Rightwingosphere over the weekend, only slightly modified from its 2012 version. This time it has resulted in a petition to WhiteHouse.gov --- so far, signed by more than 70,000 since it was posted late last week --- demanding "congress meet in emergency session about removing George Soros owned voting machines from 16 states."

But, of course, as we noted back in 2012, when Democrats were concerned about the actual ownership of voting machine company Hart Intercivic by associates of Mitt Romney, Soros does not own any companies with voting machines in the U.S. He doesn't own any companies with voting machines used elsewhere either, to my knowledge. But the original seed for the persistently false rumor seems to have been planted, in no small part, by The BRAD BLOG's exclusive coverage way back in 2008 of a Venezuelan voting machine company named Smartmatic --- once believed linked to Hugo Chavez --- and their secret ownership of the Intellectual Property (IP) used in voting machines made by Sequoia Voting Systems. Many of those machines are still used in about 15 states across the country.

Sequoia has since been purchased by a Canadian firm named Dominion Voting, which, like Sequoia before it, lied about Smartmatic's ownership of IP used in Sequoia's machines. But, as I explain on today's program, it could hardly be further removed from Soros who, as it turns out, has absolutely no stake in Smartmatic or any of the other vote counting companies deployed in the U.S..

But, like Democrats, Republicans have every right and reason to be concerned about the obscene private corporate ownership of our nation's public voting and tabulation machinery. (Please petition Whitehouse.gov about that!) As I noted to a reporter seeking comment about the concerns about Romney's ties to Hart Intercivic around this same exact time before the 2012 Presidential Election...

Once again, we're reminded of the dangers of the privatization of our once-public electoral system. The company's ties to Romney aren't the only disturbing ones we've seen with similar companies over the years. The fact is, that nobody other than the public should have any sort of control of our elections. The proprietary voting systems now in use in all 50 states, whether owned by Romney associates, a George W. Bush associate (as with Diebold in 2004) or even a company tied to Venezuela's Hugo Chavez (as with Sequoia Voting Systems which blatantly lied about that tie to public officials, and the Canadian firm Dominion which purchased Sequoia and also immediately lied about the fact that Intellectual Property of their voting systems used all across the U.S. is still owned by the Venezuelan firm), continue to be a grave threat to American democracy and confidence in U.S. Elections.

And, like similar clockwork, once again this year we are now hearing the shouts about touch-screen voting machines flipping Democratic to Republican and Republican to Democratic --- and the claims from partisans on both sides that "this only ever happens to Republicans/Democrats!" --- as early voting gets underway in a number of states. Is there legitimate reason to worry about such votes flipping? The answer is both yes and no, with reason for all of us to be ashamed, as I explain on the show today.

Also, not unrelated on today's program: Volkswagen's record billion dollar settlement for programming their cars' software to cheat on emissions tests; GOP Senator in close election warms up to climate change; Desi Doyen joins us for the Green News Report as pipeline protests rage, China closes coal-fired power plants, Sen. Marco Rubio looks the other way as Florida faces rising seas, and the corporate media ignore all of it during each of this year's Presidential debates...

Or, how Politico summarizes much of BRAD BLOG's 15 years of e-voting coverage in 8,500 smart words....
By Brad Friedman on 8/5/2016 1:15pm PT

Please read the cover story of Politico Magazine today headlined "How to Hack an Election in 7 Minutes". Ben Wofford's excellent, comprehensive feature summarizes a great deal of almost 15 years of our work here at The BRAD BLOG. He focuses his piece on the core of computer science and cybersecurity experts initially working out of Princeton University back in 2005 or so, who have, since that time, gone on to publicly hack virtually every electronic voting system and tabulator still in use around the country (and even, looking forward, hacking at least one planned Internet Voting scheme.)

We've covered and/or broke the news about many of those landmark exploits, both here and on the radio, going back through 2005 or so. I don't have time to collect all the links here at the moment, but it's very nice to see so many of them rounded up so thoroughly in Wofford's piece.

The 8,500+ word article is far too detailed to adequately summarize, or even quote from in detail here. So please go pour a tall drink or cup of coffee (you may need several, there's a lot there) and go read about the "parabola of havoc and mismanagement that has been the fifteen-year nightmare of state and local officials", as he accurately describes it, following the horrifically misguided and ill-advised move to computerized voting and tabulation systems following the 2000 election. I suspect we've filed almost as many articles on this topic as Wofford has words in today's piece!

But there's one element of his piece I want to ring in on specifically, as I think it represents something a bit more encouraging from the computer scientists who are discussed in the report than I have seen over the years...

By Brad Friedman on 10/12/2012 2:15pm PT

Late last month, Gerry Bello and Bob Fitrakis at FreePress.org broke the story of the Mitt Romney/Bain Capital investment team involved in H.I.G. Capital which, in July of 2011, completed a "strategic investment" to take over a fair share of the Austin-based e-voting machine company Hart Intercivic.

"Several tanker trucks full of political ink have been spilled on Mitt Romney's tenure as a vulture capitalist at Bain Capital," Bello and Fitrakis wrote. "A more important story, however, is the fact that Bain alumni, now raising big money as Romney bundlers are also in the electronic voting machine business. This appears to be a repeat of the infamous former CEO of Diebold Wally O'Dell, who raised money for Bush while his company supplied voting machines and election management software in the 2004 election."

Lee Fang at The Nation recently confirmed the FreePress reporting in a story of his own on the "crony capitalism" of Tagg Romney, whose father's money and high-profile connections present a number of troubling corporate conflicts of interest should Mitt Romney become President. The Daily Dolt also followed up with a very well-documented article on the H.I.G. group, their connections to Bain, and their takeover of Hart Intercivic.

Hart's announcement of the deal describes H.I.G.'s role as as "co-investors", though the financial services firm which brokered the deal described it in their own announcement as a full-fledged acquisition: "Hart Intercivic was acquired by HIG Capital late last week. The deal caps off a 2+ year relationship with Hart! Congrats to both Hart and the HIG team….its going to be a great partnership!"

Also this week, in a video that has gone a bit viral, The David Pakman Show expressed understandable concerns about Romney's close business partners having this type of corporate control over a large e-voting company whose, extremely vulnerable and insecure [PDF] --- and often 100% unverifiable --- voting and tabulation systems are now used, according to VerifiedVoting.org's database, in all or parts of California, Colorado, Hawaii, Illinois, Indiana, Kentucky, Ohio, Oklahoma, Oregon, Pennsylvania, Texas, Virginia and Washington. [Pakman's video is embedded below.]

When the story initially broke, I spoke about it on the radio with Fitrakis, but didn't comment on it at The BRAD BLOG for a number of reasons. One being the time we've been spending, during the same period, consumed by the continuing breaking story of the RNC/Romney consultant Nathan Sproul and his companies at the center of the national GOP Voter Registration Fraud Scandal which we've been covering in detail since it first broke several weeks ago. Secondly, and not to downplay this story, because it's a very good and important one, the fact is that, though the names of the corporate titans and companies are different, it is essentially the same story that we have been telling here, over and over again --- and warning about with hair afire --- at The BRAD BLOG for nearly a decade.

Moreover, I've been on the road all this week for a conference, with much less time online than usual. But since so many folks have picked up on the Romney/Bain/H.I.G./Hart Intercivic stories and have sent email and Twitter queries to me about it, allow me to very quickly share a few thoughts, on this, some of which I sent to a reporter who also raised this issue with me late this week...

Also allows ink for 'Internet Voting' voting shill, lobbyist...
By Brad Friedman on 9/20/2012 4:33pm PT

Meanwhile, as the War Over Which Americans Get to Exercise Their Right to Vote rages on, concern about how the votes of those who do get to vote, will (or won't) be tabulated, goes largely unnoticed. Again.

USA Today takes a moment to mention that point in an unbylined editorial headlined 'Electronic voting is the real threat to elections'. Their headline may understate the very real concerns about access to the polls, because these two issues --- both access to the polls and accurate, transparent tabulation of ballots --- have always been two sides of the same coin.

Both issues must be assured for an election with anything close to integrity.

But, given the, necessarily, extraordinary focus on the first issue this year, access, it's nice that the paper has taken a moment to highlight just a few of the continuing causes of concern for the actual tabulation of votes. Nothing has gotten better since 2010 or 2008 or even 2004. We've covered all of the examples for reasons to be concerned that they point to in the editorial, of course, and many more, over the years here at The BRAD BLOG.

And, naturally, since the paper is still a corporate media outlet, they just had to "balance" their fairly decent, fact-based editorial with an additional "opposing view" editorial, filled with a bunch of misleading, dishonest bullshit about Internet Voting, of all things, from a corporate lobbyist hack...

From The Gazette in Montreal...

OTTAWA — A large-scale cyber-attack involving more than 10,000 computers was responsible for the online polling problems during Saturday's NDP leadership vote, according to Scytl Canada, the company contracted by the party to conduct the vote.

While the attack in no way compromised the sanctity of the vote — in other words, no ballots cast by bona fide NDP members were added, subtracted or changed — Scytl indicated in a statement Tuesday that the attack was an attempt to crash or slow down websites by "saturating servers with bogus external communications requests that deny legitimate users access" — otherwise known as a distributed denial of service attack.

And we know the attack by 10,000 computers "in no way compromised the sanctity of the vote" how, exactly? Well, because they say so, silly!

We know Scytl's elections are secure because, as we noted in January when the Spanish-based company purchased S.O.E., the largest "election management company" in the U.S. (they do online results reporting, etc.), they told us so in their own press release announcing the acquisition. And they told us twice! They couldn't tell us they were secure unless they really were! Am I right, Sequoia Voting Systems?

Other than that --- oh, and other than this --- voting by Internet is a great idea! Am I right, Americans Elect and Michael Eisner?

The Gazette also goes on to note at the end of their coverage:

While voter turnout was low — only about half the NDP's 131,000 members voted in advance, online or from the convention floor — officials have insisted it wasn't related to the slowdown.

Oh, well, if officials insisted, then certainly they must be right about that.

Computer expert: 'Secure Internet Voting' is a bit like the phrase 'safe cigarettes'...
By Ernest A. Canning on 2/21/2012 8:56am PT

Guest blogged by Ernest A. Canning

Brad Friedman has often compared the task of Election Integrity (EI) advocates to a game of Whac-A-Mole. One moment they expose an "it's the machines transparency, stupid" moment when the 100% unverifiable ES&S iVotronic touchscreens announced that the unemployed and virtually unknown Alvin Greene had somehow defeated the respected circuit judge and former state legislator Vic Rawl in the 2010 South Carolina Senate Democratic Primary. The next moment we learned that DC officials had planned a live experiment to use "an untested and unverifiable Internet Voting scheme on real voters, in a real election…" --- an experiment that Friedman described as "insane."

More than 16 months after that disastrous experiment came to a crashing halt following a spectacular hack, as initially reported by The BRAD BLOG, the PBS News Hour produced a short documentary, Internet Voting: Will Democracy or Hackers Win? (see video below), which touched upon the D.C. Internet Voting Hack.

The now-legendary hack was carried out by a team of white-hat hackers, led by Univ. of MI Computer Science Prof. J. Alex Halderman. Within hours after D.C.'s 2010 Internet Voting scheme was opened to the world for a hack test (just days before it was scheduled to go live for the real thing), Halderman and his team of U. of M. students found and exploited a vulnerability which gave his group almost total control of the server software, allowing them to rewrite every single ballot and even take over command of the security cameras inside the D.C. server room. Team Halderman not only acquired the ability to change votes and install the Univ. of MI fight song to be played at the end of every vote cast, but discovered and thwarted an intrusion attempt by Chinese and Iranian computers.

Disturbingly, the new PBS documentary also reveals that, despite the spectacular failure and warnings from virtually every computer science and security expert, election and Pentagon officials are still pressing forward with what MIT Prof. of Electrical Engineering and Computer Science Ronald L. Rivest describes, as seen in the short PBS report, as an "oxytopian" solution. "'Secure Internet voting,'" Rivest charges, "is a bit like the phrase 'safe cigarettes'"...

By Brad Friedman on 1/16/2012 8:05am PT

This distressing news was flagged for us by Bev Harris of BlackBoxVoting.org late Friday...

SCYTL, the global leader in secure electronic voting technologies, announced today the acquisition of 100% of SOE Software, the leading software provider of election management solutions in the United States. The integration of these two software companies creates the industry leader in the election software market with a full range of solutions covering from Internet voting to election night reporting

And how do we know SCYTL's electronic (Internet!) "voting technologies" are "secure"? Well, they tell us so themselves -- twice --- in their press release, silly!

SCYTL is a technology company specializing in the development of secure electronic voting and election modernization solutions. Based in Barcelona and with offices in Baltimore, Toronto, New Delhi...[blah, blah, blah]

They couldn't just say it was "secure" if it wasn't! Right?!

In any case, here's a bit of the red flag Harris waved on Friday to help unpack what all of this actually means for the future of what's left of our small-d "democratic" elections...
