A whole lotta Trump Accountability News going on all at once again on today's BradCast. Too slowly, to be sure, but going on nonetheless. Even if not (yet) at the DoJ. [Audio link to full show is posted below this summary.]

On Monday night, the bipartisan House Select Committee on the January 6th attack on the U.S. Capitol voted unanimously to refer criminal contempt charges to the Dept. of Justice for Donald Trump's former Chief of Staff Mark Meadows. During their hearing, Committee Vice Chair Liz Cheney (R-WY) read a number of texts from Fox "News" personalities and from Don Jr., sent to Meadows during the hours the Capitol was under attack after Trump incited the riot in his last gasp effort to steal the 2020 election. The messages were pleas to get Meadows to convince Trump to call it off. Those same Fox personalities would soon go on the air and pretend that "antifa" was behind the deadly assault. The texts prove they knew otherwise and, according to Cheney, serve as more "evidence of President Trump's supreme dereliction of duty during those 187 minutes" when he failed to act while the U.S. Capitol was under assault by domestic terrorists.

Committee member Adam Schiff (D-CA) shared several damning text messages from unidentified members of Congress that were sent to Meadows as well, noting that, due to the ongoing investigation, the lawmakers were not being named "at this time." Separately, Committee Chair Bennie Thompson (D-MS) said those names would eventually be made public, as the Contempt referral for Meadows also referenced several "members of Congress" who participated in phone calls and White House meetings to help strategize before the eventual bloody insurrection.

Meanwhile, another House Select Committee investigating the coronavirus crisis may be heading toward separate contempt charges against former Trump official and prominent COVID denier, Peter Navarro. He says he cannot cooperate with that Committee's probe because Trump gave him a "direct order" not to, claiming Executive Privilege (which former Presidents do not have), and that because of it, "this matter is out of my hands."

"Trump's supreme dereliction of duty" in 2020 is unspeakable in many cases, but it's only part of his unspeakable legacy and a seemingly unending list of criminal culpability.

But never mind 2020. Some good government groups are still seeking accountability for the 2016 campaign that put the disgraced former President into the White House in the first place. Last week, Free Speech for People (FSFP) and the Campaign for Accountability filed suit [PDF] in D.C. federal court against the Federal Election Commission (FEC) for failing to take action on a complaint they filed in December of 2016. That complaint alleged unlawful "coordination" between the Trump Campaign and the Russian Federation.

"Even today, despite multiple investigations, critical information about the money spent in the 2016 election is still unknown," said RON FEIN, Legal Director of FSFP, in a statement announcing the new lawsuit. "How much did the Russian Federation spend? When and for which efforts did it make the payments? How much (and which) of that spending was ‘coordinated’ with the Trump campaign? Answering these questions is the FEC’s job, and they’ve sat on it for almost five years."

Now, says Fein, who joins us on today's program, the groups have no choice but to take the FEC to court to force the government's long-dysfunctional federal campaign regulator to investigate the complaint. Fein explains how "coordination" has a very different meaning in campaign finance law than it does in the matters that Special Counsel Robert Mueller looked at in his two-year probe. "Congress passed a law specifying that coordination 'shall not require agreement or formal collaboration,'" he says. "It could be a wink and a nod. Put that into the context of things like Trump saying, 'Russia, if you're listening, I hope you find those emails'," after which Russia attempted to hack the Clinton campaign, and the question of unlawful coordination under campaign finance law becomes plain to see.

"I don't mean this as a personal attack on Mueller or anyone who worked on that team," Fein clarifies, "because they're not campaign finance experts, but they missed an important area of the law that the Federal Election Commission has the authority to investigate, and the obligation to at least make a decision on our administrative complaint that alleged this."

FSFP's "2016 administrative complaint alleged that the Russian government paid for computer hacks, social media posts, and paid political advertisements to influence the 2016 election, and that the Trump campaign engaged in 'coordination' with the Russian government," the group notes in their statement announcing the new suit.

"There were many aspects of what happened in the 2016 election that were extremely troubling, from a legal as well as from a broader, democracy-preservation standpoint," Fein tells me today. "For example, even illegal political spending is required to be disclosed. That's what both the Russian government and the Trump Campaign failed to do. And that's the information that we would have if they disclosed it."

The six member FEC, with three Commissioners appointed by each major party, is notorious for tie votes that end up killing action against campaign finance violations that even the FEC's own staff argues should be pursued. In this case, Fein says, the FEC didn't even hold a vote on their complaint over the past five years. Their lawsuit is meant to force the Commission to hold that vote. If the court orders them to do so and the complaint then fails to receive the necessary four votes to proceed with a full investigation, FSFP can sue the Commission again. It's potentially a long road, but one that could actually be short-cutted.

"Because it takes four votes to do anything in the FEC, if there is not a four-vote majority to appear in court --- this has happened several times recently --- the FEC has simply defaulted," explains Fein. "And then the statute provides --- and this was rarely, if ever, used until just the past year or so --- the statute provides that if there's a default judgement, then the plaintiff can just go ahead and sue the parties that they filed the administrative complaint against directly. In other words, if that plays out that way, then we'd be in a position to sue the Trump Campaign and the Russian government and cut the FEC out of the picture entirely."

Still a long road, but a much shorter one that doesn't rely on the corrupted FEC.

In the meantime, FSFP --- as we discussed with its co-founder and President John Bonifaz early last month --- is continuing its campaign calling for the resignation of Attorney General Merrick Garland for failing to meet the moment in taking action on the endless list of criminal allegations against Trump and his minions before, during and after his Presidency. When I inquire with Fein as to whether the recent criminal Contempt indictments against former Trump lackey Steve Bannon has changed the group's outlook, he notes that, if anything, "the call for Garland to resign is even stronger right now."

You'll need to tune in to find out why.

And then, one more bit of breaking Trump Accountability that came in during today's show, as a Trump appointed federal judge rejected the former President's lawsuit seeking to block House Ways and Means Committee Chair Richie Neal (D-MA) from obtaining Trump's tax records. The ruling is the latest in a roller-coaster legal battle that begin in April of 2019. Trump's Treasury Department refused to turn over the documents to Congress, as required by law. Biden's has agreed to. Trump sued to stop them. Trump now has 14 days to decide if he will appeal.

Finally, we close with Desi Doyen and today's grim Green News Report following the deadly, climate change-fueled tornado swarm that slammed Kentucky and several other states over the weekend. Though she also has some slightly brighter news at the same time, as the Biden Administration reveals its new, electric vehicle charging strategy, made possible by the recent passage of the $1.2 trillion infrastructure bill...

Today's BradCast should serve as yet another wake up call for those of us who may need one. [Audio link to full show is posted at end of this summary.]

First up, Washington Post revealed on Friday that Donald Trump, late last year, attempted to order his acting Attorney General to declare that the 2020 election was "corrupt". To his credit, the acting AG refused to, since there was no evidence of systemic fraud that might have reversed Trump's painful loss to Joe Biden. And, to the credit of the acting AG's staff, all of this was documented in real time with contemporaneous hand-written notes --- from that call and similar ones that reportedly took place on a near daily basis --- with the desperate loser President calling with fraudulent information from the Internet about "fraud". Those notes from the DoJ have now helpfully been handed over to Congress, so there will likely be more to come.

Of note, however, was Trump's response when he was told there was no evidence that would "change the outcome of the election." According to the hand-written notes of senior DoJ staff, Trump replied: "Just say the election was corrupt [and] leave the rest to me and the [Republican] Congressmen."

It was enough, for Trump's dishonest purposes, for the DoJ to simply say the election was "corrupt", even though there was no such evidence to support such a claim. It was similar to how, as we learned during his first impeachment, he wanted the President of Ukraine to say they were investigating Joe Biden and his family for corruption, even though they actually weren't. This is how a liar and a con-man and, yes, how a wannabe autocrat works.

But where Trump's pathetic attempt to stay in power failed last time, that may not be the case in the near future, as many respected voices are now warning. Fox "News" may say the Left is a bunch of autocrats and fascists, but that's only because they hope you won't notice that the Republican Right actually is, and becoming more so by the day. Many respected scholars and pundits from both the Left and the not-insane Right, such as David Frum and Steve Schmidt, are trying to warn about exactly that in advance of the 2022 mid-terms. Schmidt, John McCain's former Campaign Manager, asserted in a Twitter thread this past week, for example, that Trump will be the GOP nominee in 2024, adding that "the Pro-Democracy coalition is sleep walking into the ‘22 election and the stakes couldn’t be higher."

U.S. Naval Academy and Air Force Institute of Technology graduate BRYNN TANNEHILL, who served as a longtime naval aviator, with deployments to the Adriatic, Middle East and North Atlantic, says today that she shares a number of Schmidt's concerns. Her recently published book, hoping to call attention to the unprecedented perils the nation is now facing, is called American Fascism: How the GOP is Subverting Democracy. She joins us on today's show for a chilling, if insightful conversation.

As an investigator of shoot-downs in the military, she explains that she decided to approach this topic not unlike the NTSB might investigate a crash scene, examining every single potential factor that could have played a role in the disaster. "My book traces back some of the roots of the modern Republican Party all the way back to slavery and the Civil War," she explains, "to kind of give an historical sense of where this came from. [It] looks holistically at a lot of the different factors, including the media, loss of faith in science, how white evangelicals are different, how the system has been manipulated, the role of wealth inequality," examining "like an NTSB investigation, as many of the driving factors behind where we are today as possible."

But her clarion warning of where we now are is as chilling as her comparison of the Trump-incited failed insurrection at the U.S. Capitol on January 6th with Hitler and the Nazi's failed Beer Hall Putsch of 1923. "What Republicans can take away from [Jan. 6] is that even when there is a naked attempt at a coup, it costs them nothing. If they attempt to steal democracy by simply overturning an election, there's going to be even less consequences. That's our lesson."

Her book documents (and explains) what she describes as the rise of "competitive autocracy" in the U.S. or "managed democracy" as Russian President Vladimir Putin refers to it. "It's a type of government that has emerged since the end of the Cold War. Essentially, you have a democracy, or something close to a democracy, and then one party wins an election and then changes the rules, such that the incumbent party can essentially never be removed from power.  There are still elections. They are still very often 'free' in the sense that anybody can vote, and there's not just one person on the ballot. But the election through various means has been rigged such that the playing field has been so tilted that you can't remove the incumbent party from power."

We are seeing exactly that, as GOP-controlled states are changing the rules of elections right now, not only to make it harder for Democratic-leaning voters to vote next year and in 2024, but to allow them to replace election officials with partisans who can reverse election results no matter how the electorate actually votes. (See, for example, my conversation last week with now-former Morgan County, Georgia Board of Elections member and longtime voting rights champion Helen Butler who was just removed from her seat on the Board by the partisan County Board of Supervisors after 10 years, following the approval of the state's Republican Governor Brian Kemp.)

Citing similar democracies-turned-autocracies, she points to Russia, Hungary, Poland and others countries, noting that once a nation has headed down the path we are now on, historically, none of have been able to reverse course. "Hungary is absolutely a fascist movement," Tannehill points out, following the 2010 election of Victor Orbán, "and they have absolutely ended democracy there. That's a real danger, in the sense that we have a party that regards democracy as a hindrance to their goals, and their goals of establishing a particular kind of country is more important than the democracy itself."

So does the U.S. stand a chance of turning the tide? "The problem is the system is broken," she argues. "it is so easy to thwart solutions, via Congress, the Presidency, the courts, that it's really unlikely that a lot of the necessary solutions could ever happen.  For example, Senators representing only 19% of the American population can block virtually any legislation that they want to in the Senate."

"To an extent," Tannehill tells me today, the Founders, who thought their system of democracy would prevent a wholly unqualified person from being able to become President, "never dreamed that their vision for a country would be so corrupted that you would have legislators who would overturn elections based off of lies. They also never dreamed that the parties would become so powerful that they would pick the electors for the Electoral College.  The Electoral College was meant to prevent people like Trump."

There is much more to today's conversation, including a bit of hope. No, all is not necessarily lost, as grim as all of this sounds. But unless folks begin to appreciate the dangers of this moment in history, things could get very much worse --- and soon --- before they get better...if they ever do.

Finally, following that dark (if enlightening) conversation, some slightly more encouraging news. After Trump's DoJ spent years ignoring the plain text of the rule of law --- as authoritarian administrations do --- in refusing to enforce the federal statute requiring the IRS to share Trump's tax returns with Congress, Biden's DoJ has reversed course. In a memo issued today by the DoJ's Office of Legal Counsel (OLC), the Department has declared that, in fact, the Treasury Dept. must turn over those long-sought documents to the House Ways and Means Committee after their lawful requests beginning in 2019. Better late than never anyway. And it's nice to see an Administration with some apparent actual respect for law and order once again.

Donald Trump was found guilty by a huge, bipartisan 57 to 43 verdict in the U.S. Senate of having incited the deadly, attempted January 6th insurrection at the U.S. Capitol. On discuss on today's BradCast, 7 Republican Senators joined all of the Democrats in that majority finding on Saturday, affirming that Trump attempted to overthrow the U.S. Government and the 2020 Presidential election. Nonetheless, due to the U.S. Constitution's requirement that a two-thirds vote of the Senate is needed to secure a conviction under the rules for Impeachment, our disgraced former President was "acquitted" of the charge he was found guilty of during his second Senate Impeachment Trial. We discuss what happened on Saturday in detail today, and take a bunch of calls from listeners on the matter. But first up, we cover the catastrophic winter storm --- featuring crippling snow, record cold and power outages for millions, particularly in Texas --- amid the ongoing COVID pandemic and attempt to distribute vaccinations to tens of millions of Americans. Native Texan Desi Doyen, co-host of our Green News Report, joins us to explain what's going on and why scientists tell us that it is happening.

Also, even while still on the Trump Accountability beat (as we've previously noted, this is going to take a while), we cover a bit of Biden Administration news today, including the quiet weekend withdrawal of Trump-era work requirements for Medicaid, as pushed and allowed to some states by the previous Administration, and the re-opening of the Healthcare.gov exchange to accommodate new "ObamaCare" signups during massive unemployment wrought by the pandemic. That, as the very popular American Recovery and Reinvestment Act, Biden's $1.9 trillion COVID relief and stimulus package, moves toward passage with or without Republican support in the Senate and (thanks to pushback from the House Progressive Caucus) without the potential cuts to the promised $1,400 relief checks which Republicans and some of the more conservative Democrats were previously considering.

Though an occasional kick to the head is required, it does seem like --- at least for now --- Democrats are "getting it" when it comes to the nation's bipartisan desire for big and bold action from lawmakers in D.C. Even conservative Democratic Rep. Richie Neal, Chair of the powerful House Ways and Means Committee, is now calling for new, monthly cash payments totaling $3,600 per year for every child under age 6, and $3,000 for children from 6 to 17. We hope Dems continue to offer the progressive policy the country yearns for, and we're glad to see progressives pushing Democrats when they need to.

Of course, Democrats have yet to learn all of the lessons they need to, as revealed by the Saturday snafu when House Impeachment Managers easily won a bipartisan vote to call witnesses at Trump's second Senate Impeachment Trial, only to cave shortly thereafter. There were arguably legitimate reasons to not call witnesses --- even if we would have preferred to see that happen. But to get everyone's hopes up, only to dash them --- without figuring out the concerns in advance --- was an inexcusable self own.

Nonetheless, Democrats won an historic 57-43 majority in the conviction votes, with an unheard of seven Senators from the opposing party joining all of the Democrats and independents in finding Trump guilty. Even the snake Mitch McConnell was forced to admit that, yes, Trump incited the violence at the Capitol. Though he still voted "not guilty", falsely and ridiculously claiming that it was unconstitutional to hold a trial after the impeached Executive Branch official was already out of office. His claims were even more grotesquely absurd given that he was the one that prevented the trial from happening while Trump was still in office.

So, what happens next? Will Trump ever face real accountability for his many crimes, including an attempt to overthrow the U.S. Government itself? If so, how, when and by whom? On today's BradCast: The gears of American democracy continue to grind and wheeze toward November 3rd. On Tuesday, Massachusetts held its late season state primary elections featuring at least two noteworthy races. One, a somewhat bizarre challenge by an ambitious 39-year old Rep. Joe Kennedy III for the Democratic U.S. Senate nomination against incumbent, 74-year old progressive climate champion Sen. Ed Markey. The other, a challenge by the 31-year old progressive Mayor of Holyoke, Alex Morse, against powerful, 16-term establishment Democratic Rep. Richard Neal in the state's 1st Congressional District. One progressive won, the other lost. Both races were fascinating for different reasons. [Audio link to show follows below.]

To help us understand both races and more, we're joined once again today by HOWIE KLEIN, creator of the enduring "Down With Tyranny" blog and co-founder of the progressive BlueAmericaPAC. He's been helping us in recent weeks to make sense of results from a number of key, late season primary races. (There are still three states left to go --- Rhode Island, New Hampshire and Delaware --- over the next two weeks.) The Markey/Kennedy contest, however, was one of the most curious this season.

Markey, who has served in the House and Senate for some 45 years, remains one of its most progressive and beloved lawmakers as a supporter of Medicare for All and the Senate sponsor, with Rep. Alexandria Ocasio-Cortez in the House, of the landmark Green New Deal proposal. Kennedy's attempt to unseat Markey, as endorsed by House Speaker Nancy Pelosi, unsettled a number of Democrats and appeared, for a while, that it might have been successful. Alas, Markey appears to have won the day, and fairly easily, on Tuesday against the first Kennedy to ever lose an election in Massachusetts.

Klein explains why Kennedy was running in the first place and why he ultimate lost.

He also walks us through the challenge against Neal, a long-serving Democratic corporatist in the House who faced criticism from many Dems for slow-walking the Congressional attempt to review Donald Trump's tax returns. As the powerful Chair of the House Ways and Means Committee, Neal has the exclusive, statutory right to review the tax returns of any American in the nation. He took months, however, after Democrats regained the majority in the U.S. House in 2018, to even begin the process. Bu that's hardly the only critique of Neal by progressives, as we discuss today with Klein.

Nonetheless, Neal easily defeated Morse in Tuesday's primary, after what appear to have been dubious, if ultimately effective, charges of sexual misconduct whipped up against him by questionable sources. Klein explains that ugly campaign, as well as why his BlueAmericaPAC decided not to endorse Morse or either of the two progressive candidates running in the crowded field for the nomination to fill Kennedy's vacated seat in the state's 4th Congressional District.

Also today: The Pennsylvania Supreme Court has announced it is taking up a case filed by the state Democratic Party seeking to expand and clarify the state's new mail-in ballot law amid the coronavirus pandemic. The Trump Campaign and state Republicans are challenging absentee voting in the battleground by, for example, suing to prevent the use of secure drop-boxes for absentee ballots.

And, in Texas, a federal judge has, for the second time, found the state in violation of the National Voter Registration Act for refusing to make online voter registration available along with online drivers license applications as required by the NVRA. And, in another court case, Texas' Republican Sec. of State and Attorney General are now suing the Harris County (Houston) County Clerk to prevent him from sending out absentee ballot applications to the county's more than 2 million registered voters...

We've got a lot to get to on today's BradCast, as voters in Massachusetts go to the polls today with a couple of very interesting primary races (results tomorrow!), and as the rest of us are now counting the days (63 of them), until general Election Day, with both hope and trepidation. Among the mountains o' stuff covered on today's program...

• After years of our reporting on the very successful, perhaps irreversible, decades-long effort by the Right to brainwash its followers, we open today with a few thoughts about a similar, if not quite as successful (though it's getting closer), effort to brainwash those on the Left. That effort to brainwash the Left, like the scheme on the Right, is also carried out by folks on the Right or those who support them. (And yes, that means we have a few words today about the still-misreported facts regarding the Hillary/Bernie race from 2016);

• We have more evidence of attempts to manipulate the Left in today's announcement from Facebook that, based on a tip from the FBI, the social media outlet has shut down several fake accounts created to support a Russia-related propaganda scheme targeting the Left in hopes of undermining Joe Biden and Kamala Harris. The operation reportedly included a phony media outlet calling itself "Peace Data", in hopes of appealing to progressives in advance of this year's election;

• Information of that sort, as we discuss, is --- or should be --- useful to voters. Nonetheless, with just over two months until Election Day, with Donald Trump's top intelligence officers having recently warned that Russia is taking active measures, once again, to undermine the Presidential election in support of Trump, his recently-appointed Director of National Intelligence John Ratcliffe notified Congress over the weekend that he will no longer offer in-person briefings to lawmakers regarding foreign attempts to interfere in the election. The claim, offered by Trump himself without facts to back it up, is that members of Congress were illegally leaking certain information from the intelligence community, and that the information leaked was also "wrong". No evidence was given to support that charge, and while Trump claimed the decision to end intelligence briefings to Congress was made by him and Ratcliffe, evidence suggests that it was, instead, a directive from Trump himself. For some reason;

• Speaking of the November 3rd election, the dirty tricks are now underway, as revealed by a new robocall to some Democratic-leaning Michigan voters falsely warning that signing up to vote by mail will result in voters contact information being added to a database for tracking down arrest warrants, credit card debt collection and "mandatory vaccines". None of that is true. Though you should expect much more of it in the weeks ahead;

• Also in Michigan, the state's Democratic Secretary of State Jocelyn Benson, recently won a court case filed by rightwingers attempting to prevent her from sending absentee ballot applications to all of the state's 7.7 million voters. The ruling --- in a state which Trump is said to have won by just over 11,000 votes in 2016 --- comes in the wake of his misfired threat to withhold federal funding from Michigan in a tweet in which he falsely claimed the "rogue Secretary of State" was planning to send out actual ballots (as opposed to applications) to all voters;

• And while Trump and his minions have been suing in state after state in (usually failed) efforts to make voting more difficult during the global pandemic that he failed to control --- even attempting to block the use of secure absentee ballot drop-boxes in key battleground states like Pennsylvania --- another newly elected Democratic Sec. of State, Jena Griswold in Colorado, announced today that her state will offer "at least 368 mail ballot drop boxes for the General Election, an increase of 49% since I was elected in 2018!";

• Also today, a somewhat bizarre comment from a reader/listener in response to our coverage yesterday of L.A. County's disastrous, unverifiable new touchscreen voting system, in which the commenters offers several odd allegations amid of my nearly 20 years of critical coverage of e-voting and asks "whose side are you on?";

• Finally, Desi Doyen joins us for our latest Green News Report in the wake of catastrophic week for the climate and the Republican National Convention...

There were a number of important elections held around the country on Tuesday, so on today's BradCast, we've got some of the reported results from the key races, including both good and bad news for Democrats and progressives. Oh, and some stuff happened in D.C. today as well. [Audio link to show is posted below.]

We start with the good news out of Chicago, where former federal prosecutor Lori Lightfoot will become the Windy City's first black female Mayor, as well as the city's first openly gay chief executive. Lightfoot, who has never held elective office, ran as a progressive reformer to clean up Chicago's notorious old-school, insider politics after Democratic Mayor Rahm Emmanuel chose not to seek a third term. She is said to have easily bested Toni Preckwinkle, another African-American woman and a longtime elected official. by a nearly 50-point margin in Tuesday's final runoff contest.

There was still more good news for Democrats in the key swing-state of Pennsylvania on Tuesday, where Democratic Navy vet and former Dept. of Veterans Affairs official Pam Iovino is said to have defeated Republican D. Raja in a special election for a state Senate seat representing a suburban district outside of Pittsburgh. Republicans have held that seat for most of the past half-century, and the district (which uses 100% unverifiable touchscreen voting systems) reportedly went to Donald Trump by 6 points in 2016, when he took the state's 20 electoral votes for the first time since 1988.

Iovino's 4-point victory over Raja is being regarded as a potential bellwether for next year's Presidential contest when Democrats will need to win back Pennsylvania, Michigan and Wisconsin --- all of which went to Trump in 2016 before electing Democratic Governors during statewide elections in 2018 --- if they hope to take back the White House.

While there was good news for Dems in Pennsylvania, the news out of Wisconsin on Tuesday was decidedly less good...at least as of this hour. Progressive-aligned state Supreme Court candidate Judge Lisa Neubauer had been widely expected to win the seat of a retiring progressive-aligned state Justice, but appears to have fallen just short against GOP-aligned Judge Brian Hagedorn, according to unofficial results.

Hagedorn, who has likened homosexuality to bestiality, derided Planned Parenthood as a "wicked organization" and called the NAACP a "disgrace to America", declared victory in the early Wednesday morning hours after computer tallies gave him a lead of just under 6,000 votes out of just over 1.2 million cast across the state. Neubauer's campaign announced the race was "too close to call" and "almost assuredly headed to a recount", stating that "Wisconsinites deserve to know we have had a fair election and that every vote is counted".

With the margin less than 1% (it is currently one-half of 1%), she will be entitled to request --- and pay for --- such a "recount". State law, however, currently leaves it up to local jurisdictions to decide whether they wish to tally the state's mostly hand-marked paper ballots manually or simply run them through the same computer scanners that tallied them (correctly or incorrectly, who knows?) on Election Night.

Tuesday's state Supreme Court contest in the Badger State was particularly important for Democrats who, even if they had won, would have retained a 4 to 3 minority on the state's high court. But, with a conservative-aligned Justice retiring next year and the replacement election to be held on the same day as the state's 2020 Democratic Presidential Primary, they had hoped to finally flip the court to a more Dem-friendly 4 to 3 majority next year for the first time in years. That majority would be particularly important following the 2020 census and the inevitable subsequent court battles over redistricting in one of the most extremely GOP-partisan gerrymandered states in the country, not to mention hopes for rolling back a host of rightwing initiatives enacted under Republican Gov. Scott Walker now that voters sent him packing last November.

We're joined today by Wisconsin's own JOHN NICHOLS, Washington Correspondent for The Nation and associate editor of Madison, Wisconsin's Capital Times, to help us make sense of Tuesday's stunning reported results that appear to have taken both Democrats and Republicans alike off guard.

How and why did it happen, given Neubauer's huge fund-raising advantage over the toxic, Koch-supported former Walker protege who many Republicans chose to stay away from? Did a last minute infusion of out-of-state Republican cash make the difference? While turnout increased for both parties compared to the state's last Supreme Court election in 2018 (when the Dem-aligned candidate won by a full 12 points!), why did turnout appear to increase more for the GOP this year? And what happened that dampened turnout in Milwaukee?

Does a potential "recount" have any chance of reversing the currently reported results? And what should all of this --- an objectionably flawed rightwing candidate seen as having little chance of winning in Wisconsin, before he then goes on to narrowly win the state --- tell Democrats as they head into the crucial 2020 Presidential election looking to flip WI back into the D column? We discuss all of that and much more with the ever-wise Nichols today, who offers this "number one lesson" to progressives: "Do not assume Donald Trump is doomed."

Finally, there was also a lot of stuff that happened in Congress today for a change as well: The House Judiciary Committee voted to approve subpoenas for the Department of Justice to require Trump's Attorney General William Barr to turn over the full, unredacted Mueller Report, including its exhibits and underlying evidence; In the Senate, GOP Majority Leader Mitch McConnell unilaterally invoked the so-called "nuclear option" to change Senate rules, after failing to do so via regular Senate votes, in order to reduce the time needed to install Trump appointees to executive agencies and lifetime positions on the federal bench. The new rule will now require just 2 hours of debate, rather than 30, before holding a vote on such appointees; And, late in the day, the Democratic U.S. House Ways and Means Committee Chairman Richard Neal sent a letter to the IRS formally requesting the past 6 years of Donald Trump's tax returns as well as those for eight of his business entities. The House actions are certain to face challenges from the White House and likely end up being decided in court...
