A study in contrasts across two different U.S. wars in the Persian Gulf, and shadows of accountability emerge into view on today's BradCast. [Audio link to full show follows below this summary.]

FIRST UP... It has arguably taken far too long, but this week it became final. John Eastman, the sleazy attorney who helped conjure up much of Donald Trump's bonkers "legal" argument for stealing the 2020 electoral college vote in Congress on January 6, 2021, no longer has a license to practice law in his home state of California. He is officially disbarred after the state Supreme Court declined to hear his appeal this week. The disgraced former lawyer, a speaker at Trump's insurrectionist rally in front of the White House on January 6, now vows to challenge the California State Bar's final ruling to the U.S. Supreme Court. Good luck with that, John.

Also today, hints of somewhat more timely accountability in Minnesota, as an ICE agent is charged with assault under state law for pointing a gun at motorists from his unmarked car during Trump's so-called Operation Metro Surge immigration offensive in Minneapolis. The case will be a test of whether state charges may be brought against federal agents by state officials. Prosecutors say they are still investigating at least 18 more related cases in the Twin Cities region following the ICE shooting deaths of U.S. citizens Renee Nicole Good and Alex Pretti earlier this year.

NEXT... We're joined today by former U.S. Army Captain, former lifelong Republican and attorney KEITH BARBER, who now writes frequently at the progressive Daily Kos website as "KeithDB".

More than 30 years ago, Barber penned a 39-page article for the Fall, 1994 volume of the Military Law Review (pp. 235-274), examining evidence behind allegations of war crimes then made by former U.S. Attorney General Ramsey Clark against the U.S. during the first Gulf War under President George HW Bush.

Barber, at the time, found that Clark's evidence of widespread war crimes failed to hold up to legal scrutiny. Last week, with few changes to International Law over the past three decades in regard to such crimes, he compared similar allegations regarding the lawfulness of Donald Trump's war in Iran.

His original article for the Military Law Review was titled "No Fire This Time: False Accusations of American War Crimes In The Persian Gulf." His follow-up last week: "The Real Fire This Time: American War Crimes In the Iran War".

The two headlines tell the tale, but we walk through --- as Barber does in his recent piece --- the central allegations of whether the two different offensives were considered lawful under International Law, and whether the conduct of each meets established legal principles of discrimination and proportionality. (Don't worry, we explain what all of that means.)

Also of note during our conversation, Barber's thoughts on whether the change in his personal political leanings may have colored his findings, either then or now, and about whether the Military Law Review would have published his findings had they come to a different conclusion 30 years ago. Tune in for some revealing answers in a sobering discussion today on those points and more.

Trump call to 'HANG' members of Congress an impeachable High Crime...

Senator Mark Kelly (D-AZ) actually didn't go far enough when he told members of the U.S. military: "Our laws are clear. You can refuse illegal orders." In fact, as fellow armed services veteran Rep. Chris Deluzio (D-PA) emphasized in the same video, service members "must refuse illegal orders."

Under the provisions of the Uniform Code of Military Justice (UCMJ), which was passed by Congress after the post-WWII Nazi tribunals at Nuremberg, the "I was just following orders" defense was officially discredited for the U.S. military as well. All members of the U.S. armed forces have, as "reported by The Military Times, a duty to disobey "illegal" orders. Any member of the military who carries out an "illegal" order, The Military Times observed, may become the subject of a court martial. Depending on the nature of the illegal order, a member of the military who obeys an illegal order could later be tried for crimes against humanity by an international tribunal.

Neither the UCMJ, nor any existing case law, carves out an exception for "illegal" orders issued by the Commander in Chief. Thus, Donald Trump's effort to label an accurate quote of military law as "sedition" and the "announcement" by Trump's renamed "Department of War" that it is investigating Kelly, are patently absurd.

The more serious questions are: (1) Did Trump's call for Kelly and the five other Democratic members of Congress who publicly called upon members of the military to comply with their "duty to disobey illegal orders" to be "hanged" amount to a criminal violation of 18 U.S. Code §115, which makes it a crime to threaten to assault a member of Congress in retaliation for their performance of their official duties --- (here using their office to remind members of the military of their obligations under the UCMJ)? And (2) whether his amplification of calls for them to be "hanged" amounts to a high crime that warrants impeachment"¦

Today's BradCast is, necessarily, a bit dark. There are, however, a few bright spots here and there if you listen closely enough. [Audio link to show follows this summary.]

Very briefly, these are some of the stories covered today...

  • The Philippines former strongman President Rodrigo Duterte was arrested by Philippine law enforcement officials on Tuesday, on an arrest warrant issued by the International Criminal Court (ICC) on charges of Crimes Against Humanity. Interpol reportedly participated in his detention, after which he was flown to The Hague in The Netherlands to face the charges. Duterte is known for his extra-judicial, often point-blank, shot-to-the-head killing spree of supposed "drug suspects" during his six years as President and two decades as Mayor of one of the nation's largest cities. The government acknowledges some 6,200 killings during Duterte's reign in office. International human rights groups, however, put the bloody total closer to 30,000. Elected to the Presidency in 2016, the same year as Donald Trump, our President had congratulated Duterte (pictured together above) in 2017 for his "unbelievable job on the drug problem," congratulating him for "what a great job you are doing." In addition to victims' families finally seeing some justice, there are a few other perhaps dark, but perhaps hopeful lessons we may learn from this incident regarding our own President.
  • Tune in, at least for this part, because I can't even begin to adequately summarize the roller coaster ride today on Wall Street touched off by Trump's threat to double-down on 25% tariffs --- to 50% tariffs --- against our ally Canada last night in retaliation for a threat by Ontario's conservative Premier Doug Ford to cut off electricity to several U.S. states. As the day progressed, both Ford and Trump appeared to back down from the worst of it. For now. But the disaster Trump's tariffs (and threatened tariffs) has made of the markets --- along with increasing inflation and his mass firing of federal workers --- has economist worried about a coming "Trumpcession". If things continue to tank, it could leave a very serious mark --- perhaps even one that MAGA will notice --- given that Trump's "superpower" was supposedly his brilliant business acumen and genius ability to strengthen the U.S. economy. Oops.
  • Elliot Higgins, journalist, founder and creative director of Bellingcat, a Netherlands-based investigative journalism group, founded in 2014, specializing in fact-checking and open-source intelligence investigations by both professional and citizen journalists, has a few thoughts on what happens when "disordered discourse" captures a political party (like the Republicans) and "then the state itself" (like the U.S.) and the destabilizing, and perhaps deadly effect it has on democracy itself.   • And with that in mind, a few thoughts about a friend, mentor and occasional on-air guest over the years, Kevin Drum, who, we learned on Monday night, lost a long battle with cancer. He was a pioneering OG blogger, originally of Calpundit (2002-2004), then Washington Monthly's Political Animal (2004-2008), then Mother Jones (2008 through 2020) and, finally, beginning in 2021, his last blog, the independent Jabberwocking. His last appearance on The BradCast was in early 2023, on how to face down Republicans' threat at the time to not raise the dumb debt without sending the U.S. into default on its debt. Today, a brief tribute, including a few personal remembrances of Kevin, one of them an hours long discussion on election integrity in the cold on my back porch. We're back on today's BradCast after an unavoidable extended weekend due to a family funeral. We've got a lot to get caught up on today. [Audio link to full show follows this summary.]

Before we get to today's guest, a few quick headlines from over the weekend and through today...

  • Iran's President and Foreign Minister were killed over the weekend in a helicopter crash in foggy conditions in the northern part of the country.
  • The top prosecutor at the International Criminal Court is seeking arrest warrants for Israel's Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant, as well as three Hamas leaders for war crimes and crimes against humanity in both Gaza and Israel.
  • A British court has granted WikiLeaks founder Julian Assange the right to appeal his extradition to the U.S. on 17 espionage charges and one for computer misuse related to the publication of classified U.S. documents 15 years ago.
  • The New York Times revealed last week that rightwing Supreme Court Justice Samuel Alito flew an upside down American flag --- a MAGA "stop the steal" symbol --- at his home for several days following the Trump-incited January 6, 2021 insurrection at the U.S. Capitol. Nonetheless, the corrupt Alito has failed to recuse himself from cases involving the 2020 election, including the Court's pending opinion on "Presidential Immunity" which has held up Trump's federal trial for months in his indictment on multiple failed attempts to steal the 2020 election.
  • Rudy Giuliani and 11 others, including Kelli Ward, the former chair of the Arizona Republican Party, were arraigned on Tuesday in Phoenix for their roles in attempting to steal the state's 2020 election for Trump. Giuliani and the others face multiple counts each (nine in Rudy's case) related to conspiracy, forgery and fraud.
  • The Defense rested on Tuesday in Donald Trump's 2016 election interference trial in New York, where he is facing 34 felony charges related to the falsification of documents to hide a hush-money payment to a porn star just before that year's election day. The disgraced former President, who repeatedly vowed that he would testify in his own defense at the criminal trial, did not do so. As expected. Closing arguments are next week.
  • Voters headed to the polls on Tuesday for down-ballot primaries and special elections in Kentucky, Oregon, Georgia and California on Tuesday. We'll have any available noteworthy results and problems reports on tomorrow's BradCast.

Then we're joined by VICTORIA CADOSTIN, researcher and writer at the non-profit watchdog organization DOCUMENTED to explain who is behind the new Trump-aligned extremist group known as "Citizens for Sanity". In a weekend article at The Guardian, Cadostin and her colleague Brendan Fischer break down details from newly obtained filings by the dark money group revealing they spent more more than $90 million dollars in the final few months of 2022 alone on a flood of what have been described as "vile, racist and transphobic" ads designed to disinform, terrify, divide and incite the voting public.

"They were one of the biggest election spenders in the last election cycle," Cadostin explains. "What's really alarming about it is that our records show that Citizens For Sanity is housed at the Conservative Partnership Institute, which has been characterized as the 'nerve center' of the rightwing." She describes the group as the homebase for the Trump Administration in exile, as it's led by former Trump Chief of Staff Mark Meadows as well as one of his former attorneys (and election fraudsters) Cleta Mitchell. It also shares the same leadership with American First Legal, a rightwing extremist lawfare organization headed up by Trump's MAGA anti-immigrant henchman Stephen Miller.

"CPI represents the creation of MAGA political infrastructure," says Cadostin. "These are all folks who are in the MAGA world very deeply, and who have a lot of power in that world, who are pushing out this messaging and pushing out extremism."

The group spent tens of millions of dollars from unknown donors on ads that air heavily in battleground states and swing districts, and even during highly-viewed mainstream events such as the World Series.

The organization uses racist messaging against Blacks and Latino immigrants in its ads, even while it also targets those same communities with different ads in hopes of suppressing their voters. "It's really a targeted effort to stoke racial hostility and suppress the vote however they can for the base that they don't think will vote Republican or conservative," she says. "While at the same time pushing out messaging that will move a conservative base, a white American base, to show up at the polls. It is very sinister, the way they are twisting this, using this information to mobilize one particular base against another."

"These divisive ads and the spreading of misinformation in order to sway folks in swing districts have a real impact outside of just voting," argues Cadostin. "This kind of messaging supports the rise of anti-trans legislation and violence against trans folks, as well as the rise in anti-immigrant sentiment, legislation and violence. Powerful folks are throwing money around to manufacture racial and gendered hostility in the voting population. And it's also further evidence that attacks on equality and democracy are often coming from the exact same place."

What can be done about any of it, since, as disgusting as it all is, it's all largely been legalized by a string of rightwing SCOTUS decisions over the years? We discuss that as well on today's BradCast...

I have no idea what this week is going to bring. As noted on today's BradCast, nobody, save for (maybe) the Manhattan District Attorney does. And I suspect even he is largely flying blind about what happens once (and if) Trump is ultimately indicted in New York State. [Audio link to full show is posted below this summary.]

Before we get to discussion about that --- and callers on the same topic --- today is the 20th anniversary of the U.S. invasion of Iraq. As we said at the time, and have been saying for the 20 years since, we were lied into war under false premises by the George W. Bush/Dick Cheney regime. In the bargain, hundreds of thousands of Iraqis were killed and about 5,000 Americans. No weapons of mass destruction were ever found. More disturbingly, no one was ever held accountable for that pointless war and the lies that were told to get us there.

Back in 2003, 66% of Americans supported the invasion, in no small part because opposition voices in the U.S. were largely shut out of the mainstream media conversation. Now, 61% of Americans, according to new polling, think that war was a mistake.

And, because there was never any accountability for the war criminals, guys like Florida Gov. Ron DeSantis are considered to be front-runners to become the next Republican nominee for President of the United States. That, despite the fact that, as Washington Post detailed over the weekend, DeSantis played a key role in torturing detainees with forced-feeding at Guantanamo Bay while he served as a 27-year old Navy lawyer there.

Meanwhile, now playing the part of imperialistic invader and war criminal is Russia and its leader Vladimir Putin, who the International Criminal Court on Friday issued an arrest warrant for, accusing him of abductions of thousands of Ukrainian children since his unlawful invasion just over one year ago.

If you're wondering just how terrible Putin actually is, please do yourself a favor soon and watch last week's Academy Award winning Best Documentary, Navalny (currently available via HBO Max and Amazon Prime). As discussed today, it is jaw-dropping. For a whole bunch of reasons. And, don't worry, it's also uplifting and hilarious at times...even as we see, live and as it happens, the attempted assassination of Russia's incredibly likable opposition leader, Alexei Novalny, and the remarkable moment when he actually tricks one of his own would be assassins into confessing to his attempted murder. All caught live on camera!

Then, we get to the story that I have a feeling we'll be covering for some time on this program: the first criminal indictment of a U.S. President in our nation's history. It may finally happen this week in New York (emphasis on "may"), thanks to Manhattan D.A. Alvin Bragg. He is believed likely to bring charges against Donald Trump related to the hush-money payments the disgraced former President made to porn star Stormy Daniels to cover up a sexual affair. That payoff, carried out at his direction by his then-attorney Michael Cohen, helped Trump win the 2016 Presidential election. Cohen went to jail for it. Trump never did. At least not yet.

Trump is almost certainly not going to be "BE ARRESTED ON TUESDAY", as he claimed in a panicked, weekend, ALL-CAPS statement on his social media site. Tuesday is seen as the earliest time he could possibly be indicted by a Grand Jury in New York. But, even if so, he will not be "ARRESTED" by New York law enforcement officials in Florida, where he now lives.

If Trump finally is indicted on criminal state charges, whether it's this week or next, will he actually go back to New York to turn himself in? Seems unlikely. But, if not, then what? Would NY ask Ron DeSantis' Florida law enforcement to arrest and extradite Fugitive Trump from Mar-a-Lago? Also seems unlikely, even with DeSantis believed almost certain to run for the GOP's 2024 Presidential nomination against Trump. Will Trump's supporters actually "PROTEST, PROTEST, PROTEST!!!" as the cowardly ex-President is begging them?

And why are House Republicans, led by House Judiciary Chair Jim Jordan --- who pretends to support law and order --- now actually weaponizing the federal government to try and undermine Bragg's case?

In fact, nobody knows what is coming next. There is no playbook for what is about to happen --- whether it happens this week, or next, or even in a different state, like Georgia. But it does seem to be a good day to open our phones to listeners on the topic, to talk about it all and get their best guess about what where things go from here.
