Guest: David Roberts, climate and energy journalist; Also: Senate Repubs don't think much of McCarthy's Impeachment Inquiry either...
By Brad Friedman on 9/13/2023 6:59pm PT

The landmark federal climate bill called the Inflation Reduction Act, adopted last year without a single Republican vote when Democrats held majorities in both chambers of Congress, has a long way to go before we can determine its full success or failure.

On the other hand, as discussed on today's BradCast, if it is going well, but few Americans know it's going well --- as corporate broadcast media spend nearly 24 hours a day on various crises both manufactured and real (ironically, many caused by climate change!) --- can it or will it make a difference in next year's elections? [Audio link to full show is posted below this summary.]

But, FIRST UP today, one (or more) of those manufactured crises. House Speaker Kevin McCarthy's desperate attempt on Tuesday to win over his own far-right caucus in the House by unilaterally declaring an impeachment inquiry of President Joe Biden doesn't seem to be going over very well. He had to break his own vow, made just 11 days ago, to do it only after a full vote of the House. It doesn't seem to be winning over enough colleagues to help him avoid a federal Government shutdown at the beginning of the new fiscal year on October 1. And even fellow Republicans in the U.S. Senate apparently see no evidence of High Crimes or Misdemeanors by the President to warrant impeachment.

On the other hand, he hasn't been pushed out of Speaker job by his own party this week...yet. So there's that!

NEXT: Biden and the Democrats' landmark Inflation Reduction Act --- featuring the largest single investment in history in climate change mitigation and clean energy manufacturing and jobs --- is now one year old. It has already begun to "turbocharging" a massive investment in new manufacturing plants and jobs in the U.S. to help reduce fossil fuel carbon emissions causing our climate crisis. It will soon be funding billions of dollars in home improvement projects to allow low and middle-income homeowners to electrify, solarize, upgrade and simply increase energy efficiency to save money. (NOTE: Not currently applicable in states like Florida, Kentucky, Iowa or South Dakota, apparently, which have failed to join the federal program to help their own residents save money and improve their home values while fighting climate change.)

Our guest today to discuss all of this is the great DAVID ROBERTS, longtime climate, energy and politics journalist and podcaster at Volts.WTF. We last spoke to him a year ago, just after passage of the critical legislation.

He explains today that it is still "too early to tell" whether the legislation is a success or not given all of its many practical objectives, which include vastly lowering emissions, creating millions of good paying jobs, sparking a manufacturing renaissance in the U.S. to bring supply chains home for renewable energy technology and overtaking China's dominance in the sector.

"Because the IRA's goals are so vast," Roberts explains, "it will only be over the course of five to ten years that we really have any understanding of whether it pulled it off. It's trying to do enormous things."

"What we definitely can say," however, is "that one of the goals --- which was to spur private investment into these products and supply chains in the U.S. --- is absolutely working. Last I looked, it's like $270 billion-worth of private investment flooding into the U.S."

But the yardstick for success here may be even longer than you think, according to Roberts. He tells me there is yet another goal for the legislation that is "not as public, but, if you talk to some Biden people behind the scenes, they will tell you that this apocalyptic terror you have about the future of democracy is not crazy."

"We are in a perilous, perilous moment. And part of the thinking behind IRA was that it is these parts of the country that were hollowed out by globalization, hollowed out by decades of reflexive 'free trade' dogma --- it's these parts of the county that have experienced this reactionary backlash that we've all been living through over the past little while. And if that goes on, U.S. democracy is in serious, existential trouble. People are freaked out about that all the way to the top. So, part of the goal of IRA was to channel investment into those areas. And that is happening."

Roberts says that much of the new investment "is coming into Southern and Midwestern states," including by companies like First Solar, which is "investing $1.2 billion into a facility in Louisiana. That is the single largest private investment in that state's history." Similar projects are happening in states like Georgia, West Virginia and elsewhere.

So, all we need to assess success of this enormous new law is whether it helps solves both of the nation's most existential crises: Democracy and Climate Change.

"Spurring investment, yes, it is succeeding. Is it succeeding in muting that reactionary backlash? Is it succeeding in muting these horrendous politics we've dealt with? Is it succeeding in turning a few swing voters in those swing states to help Joe Biden get back into office? That we don't know yet. And part of the problem is that our media ecosystem is broken and dysfunctional, and people just don't know about [the law]."

How to solve that? Well, as you can tell, we've got much to discuss today with Roberts along those lines as well, as he characterizes that part of issue as "the six million question" given "how broken the media is, and how difficult it is to get it to focus on these things."

He's got a few ideas, however, some involve "a huge role for NGOs, for the green movement" and even for you, as the climate, economic and political effects of the IRA one year on are still "TBD"...

But the accountability is only just beginning...
By Brad Friedman on 12/6/2022 6:04pm PT

Let's enjoy the good news on today's BradCast --- and we've got quite a bit of it --- because things may or may not be as bright tomorrow, as returns come in from the U.S. Senate runoff in Georgia and the corrupt rightwing U.S. Supreme Court hears a case they may use to undermine American democracy as we have known it for more than 200 years. [Audio link to full show follow this summary.]

But, for tonight, at least, there is a whole bunch of good news regarding a whole bunch of bad news for our disgraced former President...which is great news for everyone else...

  • A New York jury in Manhattan took little more than one day to find the Trump Organization guilty of all criminal state tax fraud charges brought against it --- 17 counts in all. That follows its longtime Chief Financial Officer, Allen Weisselberg's guilty plea on 15 counts of fraud. He's set to receive about five months in prison after his plea and agreement to testify against the company. A company, however, can't be sentenced to prison, so a fine will be levied instead. But the Manhattan D.A.'s office may have other plans for criminal charges against Donald Trump, which we discuss as well today.
  • Meanwhile, Trump is now claiming that he didn't say what everybody saw him say, when he called for the "termination" of the U.S. Constitution over the weekend. It was, of course, part of his continuing effort to pretend the 2020 Presidential election that he lost was actually stolen from him. More disturbing, however, is the lack of elected Republican officials who, while pretending to be "Constitutional conservatives", are unable to say whether Trump's comments disqualify him from becoming President again.
  • But, back to brighter news as we continue to try and keep track of accountability for at least 56 known criminal violations of law by the former President since he first ran for office. (That doesn't include all of the civil violations, such as the $250 million lawsuit filed by New York Attorney General Letitia James against him, his company and his three oldest children on state tax fraud violations.) The Manhattan D.A.'s office of Alvin Bragg, which successfully prosecuted the criminal tax fraud cases against the Trump Organization, has made a new hire that suggests the office may be eyeing new criminal charges against Trump himself this time. We 'splain.
  • Also on Tuesday, the Chair of the bipartisan U.S. House Select Committee investigating the January 6 insurrection and Trump's many failed attempts to steal the 2020 election, said that the panel will be making criminal referrals to the U.S. Dept. of Justice before year's end. That may or may not be bad news for Trump himself and many others in the MAGA Cinematic Universe. But it almost certainly ain't good news for any of them.
  • Also also on Tuesday, it is being reported that Jack Smith --- newly tapped by Attorney General Merrick Garland as Special Counsel overseeing the DoJ's federal criminal probes into January 6, the documents stolen by Trump from the White House, and any other matters related to either of those cases --- has issued his first subpoenas since taking his new position. Officials in Wisconsin, Michigan and Arizona according to Washington Post, as well as in Pennsylvania, as confirmed by AP, have all recently received demands from Smith for "any and all communications with Trump, his campaign, and a long list of aides and allies."

It's going to be a very long rest-of-his-life for Donald Trump --- unless he pulls a Ken Lay first. Of course, we wish him nothing but the best.

  • And, finally, we finish up today with Desi Doyen and our latest Green News Report, including news on the electric grid attack in North Carolina; Russia targeting energy infrastructure in Ukraine (a war crime); and EV sales now surging in U.S. and across the globe...

Trump attorneys claim immunity for shooting someone on Fifth Ave.; WH attacks Bill Taylor; House RWers 'storm' Impeachment hearing; Facts keep undercutting Ukraine quid pro quo excuses; Also: Exxon scientists undercut oil giant on Capitol Hill...
By Brad Friedman on 10/23/2019 6:47pm PT

On today's BradCast, Donald Trump needs a LOT of defending --- on virtually every front today. Lucky for him he's still got quite a few willing chumps, suckers and patsies willing to go down with his ship, from elected officials in Congress, to entire media networks invested in his criminal wingnuttery, to the best team of shameless lawyers his dirty money can buy. [Audio link to full show follows below.]

We kick off today with the remarkable argument offered by one his shameless attorneys in a federal appeals court in Manhattan, where a lower court judge recently ruled against Trump in his suit to block his longtime tax accountants at Mazars USA from turning over eight years of his tax and other financial documents as subpoenaed by state prosecutors. The probe is into payments made while Trump was in the White House to reimburse his then-attorney, now-convicted felon Michael Cohen for hush-money payoffs to porn star Stormy Daniels just prior to the 2016 Presidential election.

After the lower federal court judge virtually laughed the Trump attorneys out of court earlier this month, finding their argument that a President may not be indicted or even investigated at the federal OR state level to be "repugnant to the nation's governmental structure and constitutional values," Team Trump quickly appealed to the U.S. Second Circuit Court of Appeals, which heard his argument today.

During today's hearing, the 3-judge federal panel, citing an infamous quip about Trump's ability to shoot someone on Fifth Avenue without losing any supporters, queried Trump attorney William Consovoy on whether law enforcement officials would be Constitutionally allowed to investigate or do anything about it, if that literally occurred. The President's attorney said no, they could not. It's a hypothetical that I've raised several times in the past, in response to the absurd, Constitutionally-weak, decades-old DoJ Office of Legal Counsel (OLC) opinion memo asserting that a sitting President may not be criminal indicted. That OLC memo, never tested in a court of law, though cited by Robert Mueller when he failed to bring criminal Obstruction of Justice charges against the President despite mountains of supporting evidence, will now almost certainly have its day before the Republican's stolen U.S. Supreme Court in this matter.

Then, the many desperate attempts made by Republicans last night and today to try and defend the President following Tuesday's "damning" testimony to House impeachment investigators by Bill Taylor, Trump's acting Ambassador to Ukraine. The veteran diplomat rocked D.C. with his meticulously detailed recounting of how he learned that Trump was personally behind the quid pro quo pressure campaign to withhold nearly $400 million in military assistance to Ukraine unless its recently elected President, Volodymyr Zelensky, publicly promised an investigation into Joe Biden and the 2016 election.

With no clear messaging campaign to push back against the explosive charges at the heart of the ongoing impeachment inquiry, Republicans from the White House to Congress to Fox "News" have been flailing over the past 24 hours. The White House Press Secretary released a statement attempting to tar the longtime civil servant and military veteran Taylor as a "radical unelected bureaucrat waging war on the Constitution"; Trump's former Acting Attorney General Matt Whitaker took to Fox "News" to declare that "abuse of power" is not actually a crime; and Trump's far-right allies in the U.S. House stormed a secure room in the basement of the Capitol in a faux "riot" (reminiscent of the infamous "Brooks Brothers Riot" in Florida in 2000) to stall the planned impeachment deposition of Defense Department official Laura Cooper, the Deputy Assistant Secretary of Defense for Russia, Ukraine and Eurasia. It is believed Cooper was to testify on the Pentagon's finding that the White House's withholding of Congressionally-allocated military assistance to Ukraine was, in fact, unlawful.

Some of Trump's defenders today have been arguing that Taylor's testimony highlighted that Zelensky didn't know about the withheld U.S. military assistance and, therefore, the Administration's pressure campaign could not possibly have amounted to a quid pro quo. That argument, however, was neatly eviscerated late today via an exclusive from Associated Press, reporting that Zelensky was aware of the White House pressure campaign and the potential of losing U.S. aid if he didn't play ball in Trump's political scheme, as early as May of this year.

Finally today, the stalled impeachment deposition was not the only hearing on Capitol Hill today. Desi Doyen joins us for some highlights from a House Oversight Committee hearing on Wednesday in which Exxon Mobil scientists testified about the oil giant's knowledge, decades ago, that the use of their product was endangering humanity by warming the globe, even as Exxon invested millions in an "immoral" public relations campaign to convince the world that the science on the matter was in doubt...
