And why SCOTUS has given us no choice but to elect Democrats in 2022 to save democracy itself in 2024...

We had a bunch of excellent callers on today's BradCast. It sounds like many of them heard my warning today. Hopefully you will too. [Audio link to full show is posted below this summary.]

But, first up, on our first show after taking several much-need days off last week, we catch up with just a few of the most noteworthy items from what turned out to be another very busy news week. Among those items...

  • the Independence Day mass shooting in IL;
  • the popular and political uprisings resulting in agreements by both British Prime Minister Boris Johnson as well as Sri Lanka's Prime Minister and President to resign;
  • the horrific assassination of Japan's longest-serving Prime Minister Shinzo Abe (in a nation where just one person, out of population of 125 million, was killed by a gun in 2021);
  • the excellent jobs and unemployment numbers released by the Labor Department last Friday (and, as usual, ignored by the bulk of the corporate media due to everything else);
  • the good news that Rudy Giuliani, Sen. Lindsey Graham and 5 others who served as attorneys for Donald Trump in 2020 have now been subpoenaed to testify by the Special Grand Jury in Atlanta, convened by Fulton County District Attorney Fani Willis, in her criminal investigation of the disgraced former President's attempt to steal Georgia's election in 2020.
  • All of that in advance of another public hearing to be held on Tuesday by the bipartisan U.S. House Select Committee probing the Jan. 6 insurrection and Trump's multiple failed attempts to steal the election from Joe Biden and the American voters.

Then, its back to the issue that I haven't been able to get out of my head since we previously WARNED about it on our last show before taking a break. Specifically, the corrupt, extremist, illegitimate U.S. Supreme Court's announcement that they intend to hear Moore v. Harper next term, in a case that will give the stolen and packed far-right Court majority the opportunity to undermine American electoral democracy as we know it. That is not an overstatement.

If you thought what the Supremes did at the end of this past term --- ignoring the text of the Second Amendment in order to block states' rights to well-regulate firearms; stripping away previously protected Constitutional privacy rights and reproductive freedoms to overturn Roe v. Wade; all but ending Constitutionally-required Miranda Rights for those detained by law enforcement; further eroding what's left of our Constitutional separation between Church and State; and gutting the ability of the EPA to regulate carbon emissions driving our deadly climate crisis, as mandated by Congress --- well, you ain't seen nothin' yet.

As explained, SCOTUS is now set to undermine any and all elections laws for federal elections enacted by state Boards of Elections, Secretaries of States, Governors, state constitutions, state Supreme Courts or even ballot initiatives adopted by voters themselves. The corrupt Republican Court is likely to do this by declaring that Article II, Section 1 of the Constitution mandates that state legislatures --- and only state legislatures --- may determine laws regarding the "manner" of federal elections. Specifically of note in 2024, the way each state appoints Electoral College votes, as the Constitution says, "in such Manner as the Legislature therefore may direct".

In other words, in 2020, while most swing-states had rules, laws and state Constitutional mandates in place declaring that voters shall determine who will win the state's Electoral votes, an opinion by the Court, likely to come as early as 2023 in Moore v. Harper, will free up the gerrymandered GOP-controlled state legislatures in our nation's half a dozen or so swing-states to name anybody they like as the winner of their Electoral College votes, no matter what the Governor, state Courts or, crucially, the voters of those states have to say about it.

It's called the "Independent State Legislature" theory (or doctrine, as the GOP autocrats supporting it describe it.) As we noted in our last show on this, this is not a drill. This is very real, and now even very likely to happen.

While we were away, our friend and colleague Thom Hartmann posted a chilling Twitter thread on the ISL theory/doctrine, detailing just one potential scenario --- which includes thousands of dead bodies in the streets --- which he describes as not "just plausible" but now "probable".

We agree. Thus, we explain the importance of electing Democratic majorities in 2022 in both the U.S. House and Senate as our only hope of defeating this "probable" scenario. If 52 Democrats can be elected in the Senate and the Party is able to hold the House (both tall lifts), then the possibility of filibuster reform in the upper chamber and the expansion of the Supreme Court in order to unpack and uncorrupt it becomes a reality.

As discussed on today's show, the luxury of pretending that "both parties are equally bad" is over, as I see it. And not because I give a damn about protecting Democrats, but because I believe we must protect --- indeed, SAVE --- democracy itself at this point.

We're old enough on The BradCast to remember the days when the news got really slow during the summer months after Memorial Day. These are no longer those days. [Audio link to full show follows summary below.]

Among the many and various stories covered on today's program...

  • Thanks to the Biden Administration's COVID vaccine efforts, infection rates in the U.S. are now as low as they have been since March of 2020 --- the very beginning of the pandemic --- and are still dropping. Death rates have plummeted as well. Infection and death rates elsewhere in the world, however, are still soaring. So, even while upping their efforts to get folks vaccinated in the U.S. in June, the Biden Administration is finally taking action to help the rest of the world as well, vowing to distribute 80 million doses to nations in need --- near and far --- over the next month.
  • On our Green News Report earlier this week, we reported on Big Oil's very bad day last week, which is now being referred to as "Black Wednesday" for the fossil fuel industry. It was the day that Shell, Chevron and Exxon each got very bad news in either the courtroom or the boardroom. While the news was bad for them, it was great for the planet and those of us concerned about global warming amidst our worsening climate emergency. For Exxon, the bad news was that two "activist" candidates for its Board of Directors were elected by shareholders to push the company toward a more sustainable business model. Two other climate advocate candidates, also backed by large, forward thinking hedge funds, were also on the ballot last week. But their contests, we were told, were too close to call. As of last night, Exxon announced a third activist candidate was indeed also elected to the company's 12-member board.
  • Bad news for Donald Trump's Postmaster General Louis DeJoy (who, unfortunately, is still somehow in charge of the U.S. Postal Service, despite his best efforts to dismantle it.) The FBI is now said to be investigating DeJoy for unlawful campaign fund raising for Trump and the GOP, after a report last year by the Washington Post revealed he had allegedly pressured employees at his company (before being appointed Postmaster) to give contributions to Republicans for which he would later paid them back. "Straw-donor" campaign finance schemes like that are unlawful. But while DeJoy has previously denied violating any campaign finance laws, his defense, since reportedly being subpoenaed recently by the FBI, has changed in a noteworthy way, which we explain.
  • That, of course, was just a preamble today for our coverage of the ongoing Texas Republican attempt to pass a massive new voter suppression law, known as Senate Bill 7 (or SB7). Yes, that's the measure that was blocked over the weekend, at least temporarily, when Democratic state lawmakers walked out at the end of the year's legislative session over the weekend, denying Republicans a quorum in the House and final passage of the bill for this session along with it. Nonetheless, Gov. Greg Abbot has vowed to call an "emergency" special session to get it passed in the near future.

    In the meantime, the GOP claims that the new law is needed to combat "voter fraud" in the state, even after their own Secretary of State in March declared the 2020 election to have been "smooth and secure". That, after the state's Lt. Governor Daniel Patrick offered a $1,000,000 reward for evidence of voter fraud (still no takers, apparently), and the state's Attorney General Ken Paxton (indicted on multiple felony counts of securities fraud, but still somehow in office), logged 22,000 staff hours to sniff out voter fraud, coming up with barely a handful of cases out of more than 11 million ballots cast in 2020.

    The TX GOP's "voter fraud" claims are --- as they always have been --- built on a house of blatant lies. We walk you through the real facts about their phony "voter fraud" claims today and explain why they're really hoping to get this bill passed, above and beyond hoping to disenfranchise voters of color. Also, we offer a big hat-tip to CNN's Brianna Keilar who shut down some serious bullshit lies this week by her guest, Republican state Sen. Bryan Hughes, the bill's lying lead sponsor.

  • Finally, Desi Doyen joins us for our latest, very busy, Green News Report, including news of a major ecological disaster in Sri Lanka; bad news about global warming and heat deaths; bad news regarding water in the U.S. Southwest; tragic news about the REAL death toll from Texas' winter storm and completely avoidable power blackouts; but good news for Alaska (and the nation), as the Biden Administration is now blocking the Trump-era scheme to lease oil and gas wells in the pristine Arctic National Wildlife Preserve...

Finds Russians implanted malware, but didn't check if results affected

On today's BradCast, new details from Special Counsel Robert Mueller's report supporting the argument we've been trying to make for the last two years: Nobody ever checked the results of the 2016 election to make sure they were correct! [Audio link to show is posted below.]

But, first, we open with an avalanche of important news headlines breaking today and over the weekend, including the deadly Easter bombings in Sri Lanka; A TV comedian becoming the next President of Ukraine by a landslide; Trump's latest vow to impose sanctions on allies who purchase oil from Iran; Woefully unqualified Federal Reserve Board candidate and alleged sexual harasser Herman Cain withdrawing his name from Trump's consideration; The GOP's stolen Supreme Court announcing plans to take up cases to determine whether LGBTQ people may be covered by anti-discrimination civil rights employment laws this Fall; and Massachusetts Congressman Seth Moulton jumping into the crowded Democratic Presidential nomination contest.

Then we move to our all too brief commemoration of Earth Day's 49th Anniversary on Monday, wherein our own Desi Doyen details how and why the annual celebration first came about beginning in 1970. Of course, as we like to say on our Green News Report, every day is Earth Day for us! Nonetheless, sticking with that theme today --- for those who only notice it once a year --- we share "A Message from the Future from Alexandria Ocasio-Cortez" in which the freshman NY Democratic Congresswoman, from a couple of decades in the future, looks "back" on the world-changing successes of her Green New Deal program, as recently introduced with veteran Sen. Ed Markey (D-MA). The charming animated video, with illustrations by Molly Crabtree, is a thought experiment of sorts worth watching and/or listening to, as it helps explain how the GND would work to curb many of the worst effects of climate change, while providing millions of jobs and healthcare for all, as climate scientists have repeatedly warned the world must do within the next decade or face unstoppable consequences that threaten the entirety of human civilization.

Then, we move on to the revelation from the redacted Mueller Report [PDF] which has caused my Twitter feed to go somewhat bonkers since I cited it over the weekend. As the Special Counsel's report reveals (Vol. 1, pages 51-52, in the section entitled "Intrusions Targeting the Administration of U.S. Elections"), Russian intelligence operatives at the GRU targeted and infiltrated "individuals and entities involved in the administration of the [2016] elections. U.S. state and local entities, such as state boards of elections, secretaries of state, and county governments, as well as individuals who worked for those entities. The GRU also targeted private technology firms responsible for manufacturing and administering election-related software and hardware, such as voter registration software and electronic polling stations."

In other words, voter registration databases AND voting systems, such as voting machines and tabulators. Mueller's report goes on to concede that though the GRU was successful in implanting malware on a number of the targeted computers, "the [Special Counsel's] Office did not investigate further [and] did not, for instance, obtain or examine servers or other relevant items belonging to these victims." Instead, as Mueller writes, "The Office understands that the FBI, the U.S. Department of Homeland Security, and the states have separately investigated that activity".

Only problem with that? As we have reported repeatedly over the past two years, Jeanette Manfra, the top DHS official in charge of overseeing cyber-intrusions of critical infrastructure such as voting and tabulation systems, conceded during a June 2017 Senate Intelligence Committee hearing to Sen. Ron Wyden (D-OR) that her department had not, in fact, conducted any forensic analyses of computer voting and tabulation systems or servers following the 2016 Presidential election. We play a clip from her Senate testimony to that end.

As far as we can tell, this means that nobody has ever conducted such an analysis, despite the stunning results of the 2016 Presidential election. That remains very troubling, considering that Trump reportedly won, very narrowly, by less than 80,000 votes total in the key swing-states of Michigan, Wisconsin and Pennsylvania, none of which had voted GOP in a Presidential election for decades until 2016. The margins --- as reported by computers, but never verified by humans --- were close enough in each of those states that, had an average of just two votes in each precinct in each of those states been recorded for Hillary Clinton instead of Donald Trump, she, not he, would be President now.

Moreover, as the Mueller Report also documents, Trump's then Campaign Chairman Paul Manafort offered briefings and internal polling data to his business associate Konstanin Klimnik, a Ukrainian national tied to Russian intelligence, "on the state of the Trump Campaign and Manafort's plan to win the election," including what Manafort's partner Rick Gates described to the Special Counsel as "discussion of 'battleground' states, which Manafort identified as Michigan, Wisconsin, Pennsylvania, and Minnesota."

So, at this point, that means nobody still knows whether Donald Trump was actually the legitimate choice of the voters who comprise the Electoral College. (We already know he lost the popular vote by some 3 million votes.) Most of those very same computer systems will be used once again in the 2020 Presidential election, though some --- for example in Philadelphia, the entire state of Georgia, Los Angeles County and elsewhere --- are being replaced with newer systems that are even more difficult for the public to oversee to ensure reported results reflect actual voter intent.

And, with all of that today, we open up the phone lines to listeners for thoughts on whether --- given the findings of the Mueller Report, including Trump's well-documented and repeated attempts to unlawfully obstruct the investigation itself --- Democrats in Congress should begin impeachment hearings or not. So far, Democrats are somewhat split on the issue, with a number of freshmen in the House calling for impeachment proceedings to begin and, so far, only Sen. Elizabeth Warren (D-MA) among the current Presidential candidates offering a clarion call for members of Congress to meet their Constitutional duties by officially investigating Trump's alleged high crimes and misdemeanors via an impeachment inquiry in the U.S. House and a vote on whether to convict and remove Trump from office in the U.S. Senate. Our callers offer somewhat mixed feelings as well, as you'll hear on today's very busy and fast-moving BradCast!...

Guest: Columnist Harold Meyerson on history and how 'the reality of a Trump Presidency will concentrate the mind'

On today's BradCast, long time Bernie Sanders supporter Harold Meyerson, a former Washington Post columnist and now Executive Editor of The American Prospect magazine, argues Bernie Sanders supporters would betray both their candidate and history by staying home this November (or voting third-party or, worse, for Donald Trump) if their preferred candidate fails to win the Democratic nomination. Meyerson, who quips that there was a time decades ago when Sanders and he were the only "out-of-the-closet" Democratic Socialists in D.C., offers two historic parallels to the current divide seen in today's Democratic Party during its contentious nominating contest between Sanders and Clinton. One concerns the Democratic Party's fate after the 1968 convention and the other, perhaps more disturbing and enlightening, concerns Germany in 1932, as described in his recent American Prospect column headlined "How the Bros Are Undermining Bernie".

"What's really crucial," Meyerson tells me on today's program, "is that the forces [Sanders] has put into action continue to operate --- and continue to push the limits of the possible in the United States --- once his campaign is over, whether that is in July or in November."

"I would hope that the Sanders campaign generates a lot of people who want a more democratic, equitable economy and society, and stick around after the Sanders campaign is over this year," he says. "But it takes staying power. You don't change a political party by coming in and then going out."

Meyerson is optimistic, however, that so-called "Bernie or Bust" folks will eventually come to see that they have far more to gain from Hillary in the White House than they do if Trump wins this November. "I think the number of Sanders supporters who ultimately will not vote for Hillary, if she's the nominee and it comes down to her vs. Trump, is a lot smaller than we're seeing now. Confronting the reality of a Trump presidency will concentrate the mind."

"We need to remember the greater goal and the greater narrative, of really changing economic and political power in this country, and that's the main goal here. While there are legitimate distinctions between the Sanders and the Clinton camps, we should also remember there are a lot of lefties in the Clinton camp, too," he adds, citing, for example, progressive Rep. Barbara Lee (D-CA)'s inclusion on the DNC Platform Committee, along with a number of other progressives just named this afternoon.

Yes, the Democratic Primary cycle continues to continue, as Bernie Sanders wins in Oregon, obtains a "virtual tie" with Hillary Clinton in Kentucky, and the less-than-transparent electoral process in both states triggers more cries of "election fraud!" from Sanders supporters.

On today's BradCast, we look at the results and the concerns about them (debunking some, though not all), along with several important breaking news items. [Audio link to the complete show is below.]

Before diving into Tuesday's primary, we start with the horrific climate change-related mudslides that have buried hundreds in Sri Lanka. Then, some encouraging news for all voters as Connecticut becomes the fifth state to institute automatic voter registration and as a federal judge orders GOP "voter fraud" fraudster and Kansas Sec. of State Kris Kobach to restore full voting rights to 18,000 state voters "suspended" by Kobach's "proof of citizenship" requirement.

Then, the battle between Clinton and Sanders grinds on through two more primary states, with Sanders earning a reported 12 point victory in OR, while battling to a reported margin of less than one-half-of-one percent in KY and vowing to stay in the race through the July convention. We warned earlier this week about the possibilities of a close race in KY, where the state (shamefully) still uses enough 100% unverifiable touch-screen voting systems that it will now be impossible to know who the voters actually hoped to be the winner. The same was true, as we reported at the time, after the Missouri Primaries on both the Republican and Democratic sides, and the same is true in KY whether Clinton or Sanders ultimately end up being declared the official winner in the Bluegrass State. As of airtime today, though AP has appropriately refused to call the state, Clinton is reportedly ahead of Sanders by just under 2,000 votes.

But throughout Primary night on Tuesday, and continuing today, concerns of "fraud" are being heard very loudly from Sanders supporters once again. Some of their concerns are justified, as we explain. Others are decidedly not. For example, some news outlets irresponsibly reported "More than 76 reports of election fraud from 31 counties were called into the Kentucky Attorney General's hotline". That is incorrect. (Happily WSAZ NewsChannel 3 has finally modified their initial bad reporting. Others, like Bipartisan Report, have not.)

Other concerns we examine are from Pike County, KY, where results were, in fact, "zeroed out" for a time last night, resulting in thousands of "disappearing" votes for both Sanders and Clinton, as well as 11,000 thousands votes said to have been added to Clinton's totals in Marion County, OR. (Evidence suggests a typo by AP, as I explain on today's show.) Some concerns, however, for example the evidence from little-known Democratic candidate Rocky de la Fuente suggesting some of his votes simply vanished in recent Democratic contests in NH, MI and SC, cannot be so easily explained away.
