Democrats are hoping for a "Blue Wave" in next year's critical mid-term elections, as Trump's approval numbers continue to fall around the nation. But Republicans, at their corrupt President's direction, are working on a scheme to hold on to their slim House majority next year, come hell or high voter turnout. Our guest on today's BradCast explains why the GOP plot may work. [Audio link to full show follows this summary.]

BUT FIRST... Last week, Republican House Speaker Mike Johnson called for full transparency in the case of Jeffrey Epstein, the late pedophile, sex-trafficker and years-long best friend of Donald Trump. "I'm for transparency. We're intellectually consistent on this," Johnson told a rightwing podcaster after being asked about releasing the Epstein Files, as Trump had long promised during last year's campaign. "We should put everything out there and let the people decide," the Speaker said.

That was before, apparently, he'd heard that Trump had reversed course, and was now blocking the release of those files, for some reason, despite considerable push-back from his own MAGA supporters.

Today, rather than allowing a vote on a non-binding resolution calling on the Dept. of Justice to release the files in question, Johnson ditched plans to hold votes on a number of issues and announced instead that the House would recess early for their planned August recess. They will finish business tomorrow and not return until September.

A number of MAGA Republicans in Congress, such as Marjorie Taylor Greene (GA) and Thomas Massie (KY), are none too happy about that. Suffice to say, Johnson's plan is unlikely to give Trump the "space" that he said the President deserves to figure out how to proceed on this "delicate" matter. So much for Johnson's continuing promises lies to provide "maximum transparency."

THEN... Texas' Republican Gov. Greg Abbott has convened a Special Session of the state's Legislature this week. Not in order to respond to the chain of failures in the state that resulted in the flash flooding deaths of at least 135 people on July 4th, including dozens of children camping on the banks of the Guadalupe River. Lawmakers may discuss that as well. But Abbott, at the command of Donald Trump, has called them back to Austin for the "emergency" of redrawing the state's already-gerrymandering U.S. House maps in order to elect more Republicans in advance of next year's mid-term elections.

The GOP state delegation already holds twice as many seats as Democrats in the U.S. House. But, with a razor-thin margin in the lower chamber in what could be a rough year for Republicans, Trump, Abbott and the GOP are hoping to flip as many as five more seats from "blue" to "red" in the Lone Star State next year. The plan is to further disenfranchise state voters by preventing even more of them from electing representatives of their choosing --- particularly minority voters.

Some Democrats are suggesting the TX scheme could backfire. They argue that the Republican plan to adjust Congressional district lines to move more GOP voters into Democratic districts may result in otherwise safe Republican seats flipping to Dems in a wave election, a concept recently referred to as "dummymandering".

Moreover, Dems are said to be considering answering the Republican effort by carrying out their own mid-decade gerrymandering in states they control state, such as New York, New Jersey, California, Minnesota, Washington state and/or Illinois.

We're joined today by longtime redistricting expert, historian and author, DAVID DALEY of the nonprofit FairVote. He details the GOP plan and why he believes that the Democratic Party's efforts to respond to it is likely too little and too late.

Daley, the author of three books on gerrymandering, including last year's best-seller, Antidemocratic: Inside the Right's 50 Year Plan to Control American Elections, throws cold water on the idea that GOP 'dummymandering' may ultimately benefit Democrats. He authored a detailed article explaining his position this week at Salon, where he formerly served as Editor-in-Chief.

"Democrats are talking about dummymanders, not because they think it is actually going to happen," he tells me today, "but because they have no other ability to stop this except to try to scare [Republicans]."

But, he continues, "this is not going to scare Republicans, because they've got the best map-makers on the planet. Not a single Republican map has backfired in a single election in any Republican gerrymandered state in the modern era of redistricting, ever since technology and voter data supercharged these lines. It hasn't happened once, anywhere. The lines are too strong, the mapmakers are too good, too smart, too specific, and too precise. If Democrats are counting on Republicans to enact a dummymander, the dummies are them."

Okay. Then how about the Dem plan to carry out mid-decade gerrymanders in states that they control in order to flip some seats from "red" to "blue"? Tune in for Daley's full thoughts on that, and why he believes that "it's the Democrats that would risk a dummymander" in the process.

We also discuss the legal underpinnings for all of this ("It's always a delight to me to see exactly when it is that Republicans and a Republican Dept. of Justice get upset about gerrymandering. It tends to be when they think that districts might actually be drawn that gives somebody other than a white dude a chance of winning."); how the corrupted U.S. Supreme Court has supercharged the ability for Republicans to undermine democracy itself; and what, if anything, can possibly be done in the future to end this apparent race to democracy's bottom.

We continue the impossible balancing act on today's BradCast between coverage of the chilling news out of Ukraine and the somewhat less grim --- but still (mostly) grim --- news out of the federal judiciary in our own teetering democracy. [Audio link to full show is posted below this summary.]

FIRST, in our quick round-up of the latest developments in Russia's horrific assault against Ukraine:

  • Some good-ish news as the second round of peace talks results in a "possible temporary ceasefire" to establish humanitarian corridors in some areas of Ukraine to allow safe evacuation out of the country and for food and medical supplies to be brought in.
  • The UN says 1 million refugees have already fled Ukraine over the past week, a record for number to leave any nation that quickly this century. But, they warn, the number of displaced residents could rise to more than 4 million, and potentially as high as 10 million as the unspeakable violence continues.
  • More good-ish news in that the Pentagon has reportedly established a direct line of communication with the Russian defense ministry. The so-called "de-confliction line" has been established "for the purpose of preventing miscalculation, military incidents, and escalation," as AP is reporting.
  • The International Criminal Court is said to have opened an investigation into Russian war crimes and atrocities.
  • French President Emmanuel Macron, after a "not-so-friendly" call with Vladimir Putin, reports "the worst is yet to come" in the conflict.
  • According to its Mayor, Russian troops have finally taken control of a major city in Ukraine, the city of Kherson on the Black Sea near Crimea. Russian troops are said to be "laying siege" to the key nearby Ukrainian city of Mariupol.
  • Ukrainian President Volodymyr Zelenskyy is pleading for more international assistance and calling on NATO to establish a no-fly zone over the country. That, however, would directly pull both U.S. and NATO into direct military conflict with Russia, sparking WWIII in the bargain.
  • And, in the U.S. House on Wednesday, a bipartisan, non-binding resolution "Supporting the people of Ukraine" and its sovereign territory, condemning Russia, was approved by an overwhelming 426 to 3 vote. The three members voting against were all Republicans: Reps. Paul Gosar of Arizona, Thomas Massie of Kentucky and Matt Rosendale of Montana. The explanations from all three are appalling.

NEXT, it's back to U.S. news focused on the federal judiciary, with the great MARK JOSEPH STERN, legal journalist at Slate, who, on the day that Justice Stephen Breyer announced his retirement from the U.S. Supreme Court back in January, told us that his "likely" successor would be Judge Ketanji Brown Jackson. Last week, she was nominated by President Biden to the High Court.

Among the many court-related matters discussed with Stern today (including several of them in a lightning round, as we tried to catch up with a boatload of news that has otherwise been overshadowed by the war in Eastern Europe)...

  • His thoughts on Judge Jackson, why he predicted back in January that she'd be nominated, what difference she can make on the GOP's stolen and packed Court, and what, if any, roadblocks may stand in the way of her confirmation as the first black woman to sit as a Justice.
  • This week's SCOTUS hearing on West Virginia v. EPA, a challenge by "red" states and the fossil fuel industry to President Obama's Clean Power Plan (which never went into effect) and Trump's subsequent program that replaced it (which was rolled back by the Court and also never went into effect). So why did the GOP's stolen and packed SCOTUS shock Court watchers by deciding to hear this case at all, since nobody has actually been harmed in any way? We discuss. But it's about not only gutting the EPA's statutory ability in the near future to regulate greenhouse gas emissions causing our deadly climate crisis, but also about undermining regulatory actions by all Executive Branch agencies (at least when a Democrat is in control of them.)
  • While the role of dark money in campaigns and elections is fairly well understood, how dark money affects appointments to the federal judiciary and the cases they hear is much less appreciated. Stern explains some of the many ways this has poisoned the U.S. judicial system.
  • Last week, SCOTUS turned away a challenge to Maine's COVID-19 vaccine mandate for healthcare workers, filed by plaintiffs seeking a religious exemption. Why has the Court been allowing some state and local mandates to proceed, even without religious exemptions, while blocking others imposed by the Biden Administration? Stern explains.
  • Remember that 2018 decision by SCOTUS regarding a baker who didn't want to bake a wedding cake for a gay couple in Colorado? His bigotry was allowed, but for largely technical reasons. Now the Court has decided to hear yet another challenge to Colorado's anti-discrimination law from a woman who is considering expanding her web design business to create wedding sites. But, if she does, she doesn't want to create them for same sex weddings, in violation of CO's law. Stern explains that idiocy as well.
  • And, finally, in perhaps the most insane court story we discuss today, this one out of the far-right 5th federal Circuit. The lede from Stern's coverage at Salon this week should give you a taste of just how insane it actually is: "On Monday, the 5th U.S. Circuit Court of Appeals issued a stunning decision transferring control over the Navy’s special operations forces from the commander in chief to a single federal judge in Texas. The 5th Circuit’s decision marks an astonishing infringement of President Joe Biden’s constitutional authority over the nation’s armed forces, directing him to follow the instructions of an unelected judge—rather than his own admirals—in deploying [Navy] SEALs. High-ranking military personnel have testified under oath that this power grab constitutes a direct threat to the Navy’s operational abilities. As Russia invades Ukraine and declares a nuclear alert, Donald Trump’s judges are actively threatening America’s national security."

On today's BradCast: One reason after another why Democrats needs to step up and offer a bold and fearless vision for a more progressive, safer, healthier, more equal and prosperous America as we look beyond the dark, corrupt era of Donald Trump. [Audio link to show is posted below after summary.]

But we start today with what Trump tweeted out as "Great News!" on Thursday, a new poll he saw on Fox "News" labeled on screen as "TRUMP'S SOARING APPROVAL" finding him with an overall 55% approval rating! Only trouble, the poll from Georgetown University found him with a 55% DISapproval rating (and just 41% approval.) Don't hold your breath for Trump to delete the Tweet.

Why should he? He's gotten away with just about everything he and Fox could ever hope for, including the complete regulatory capture of the federal government which --- following Thursday's Senate confirmation of a longtime oil and gas industry lobbyist to lead the Interior Department --- now includes corporate executives and lobbyists heading virtually every Executive Agency meant to oversee and regulate the very industries they previously worked for. Do Fox viewers not mind that Trump has filled the D.C. "swamp" like it's never been filled before? Or do they not know? Or do they just not care? Given Trump's latest, impeachable behavior regarding the southern border, and the cheers he receives from supporters for it, it's a good guess that his Republican base couldn't care less. They vote as they are told (by Fox).

Next, on the same day that New Zealand's new ban on military-style assault weapons officially goes into effect --- after being approved by a 119 to 1 vote in Parliament this week, less than one month after a massacre by a white supremacist at two mosques in Christchurch killed 50 and wounded 50 others --- many in the U.S. are left wondering why any action to improve gun safety here remains seemingly impossible.

We're joined today by IGOR VOLKSY, founder of Guns Down America and author of the brand new book Guns Down: How to Defeat the NRA and Build a Safer Future with Fewer Guns. Volsky explains what lessons we might learn from New Zealand and why changing gun laws in the U.S., where more than 30,000 Americans are killed by guns each year, is so difficult.

He is calling for bold new platforms from 2020 Democratic Presidential candidates who, he says, have offered grand visions for the environment, health care and even taking on major corporations, but not when it comes to guns, where they beg for table scraps and barely incremental improvements --- if they even raise the issue. Volsky argues that, despite broad majority support for a host of common sense gun measures across all parties --- including for the banning of military-style assault weapons --- a new political framing is needed which isn't "designed to talk to some kind of mythical moderate voter".

"I am calling on the 2020 Presidential candidates to fundamentally reframe the conversation around guns, to establish a long term goal to establish a future with fewer guns, and to talk about the ways we need to raise the standard for gun ownership, for gun production," he tells me. "And by the way, when I say gun production, I mean actually regulating the firearm industry --- that it stops producing militarized weapons for the civilian market, both in terms of the assault weapons and the much more militarized handguns that use larger rounds." How to do that without flinching against the politically powerful NRA and its even more powerful rightwing propaganda outlets will not be easy, nor quick. He argues that it will require a bold, long term vision that is still absent from Democratic politics and messaging.

Finally today, two must-listen clips from Congressional hearings this week. The first features freshman Rep. Katie Porter (D-CA)'s absolutely shaming Jamie Dimon, CEO of the nation's largest bank, JPMorgan Chase, for the paltry salary he pays his own employees, even after the bank reported a more than $9 billion PROFIT in just the first quarter of 2019 alone. Many of his employees, she details, are actually losing money each month, even while working full time for Chase, while Dimon enjoyed a $31 million salary last year.

As Paul Waldman observed at WaPo after watching the instructive colloquy between Porter and Dimon, "JPMorgan Chase could give every one of its 250,000 employees a $25,000 raise, and it would cost the bank only about two-thirds of the profit it made just in the first quarter of this year." He too is hoping that Porter's point becomes a central theme for Democrats running for office. Other Democrats in Congress --- including those running for President in 2020 --- have a lot to learn from the new crop of first-term progressives in the House.
