For all of the legal experts on TV and Twitter helping the nation understand a flood of ridiculous rulings by corrupt, rightwing, Federal Society-approved judges and Justices, it might also be helpful if they started pointing out the desperate need for structural change in our federal judiciary. We can't lawyer our way out of this mess, but we can reform it. But we're gonna need their help. One of those legal experts joins us on today's BradCast to help make exactly that case. [Audio link to full show follows below this summary.]

First up, however, the Republican "Never Trumpers" of the Lincoln Project are back. And their latest ad is another doozie, pointing out how Trump's sleazy Save America PAC is little more than a "sucker's game" meant to scam his own supporters. "Trump told you the election was stolen to rip you off, to sucker you, to take your hard-earned money and shovel it into his pockets ... It was the biggest scam in political history. ... It was a sucker's game all along."

Apparently, Lincoln Project is running the ad on Fox "News" and it appears to be driving The Former Guy crazy. So much so that he's threatened to sue the Lincoln Project. And now the group's co-founder, Rick Wilson, is begging him to. We share the ad, Trump's pathetic (though hilarious) social media tantrum and Wilson's acerbic (though hilarious) response.

While Trump is unlikely to actually sue Lincoln Project --- and open up his corrupt Save America PAC to the discovery process! --- one of his most recent impotent lawsuits, filed against Hillary Clinton, former FBI Director James Comey, and bunch of other folks at the FBI and DoJ claiming a "conspiracy" against him regarding Russia's interference in the 2016 election, spectacularly crashed and burned before a federal judge in South Florida on Thursday. It was a real judge. Not one that Trump appointed.

As to the federal judge in South Florida that Trump did appoint, Judge Aileen Cannon, who issued the absurd, unprecedented and completely unworkable order on Monday in response to the FBI's court-ordered seizure of thousands of government documents stolen by Trump and stored at Mar-a-Lago, the DoJ pushed back on Thursday night. On Monday, Cannon ordered an injunction against the DoJ's use of the stolen documents, many of them highly classified, in their criminal investigation of Trump's theft until a Special Master examined all of the documents for potential attorney-client and executive privilege conflicts. (There can be no executive privilege conflicts since Trump hasn't asserted it and, no longer the Executive, he is not entitled to any such privilege.)

In their filing [PDF] on Thursday night, however, the DoJ offered a compromise and an off-ramp to Cannon, before they otherwise plan to appeal her ruling in full to the 11th Circuit Court of Appeals next week. Hopefully, Cannon takes the off-ramp to allow the critical criminal investigation and national security damage assessment to continue. But, otherwise, the DoJ may have a long slog before the appeals court which has now been packed with Trump-appointed judges.

All of this --- not to mention the unprecedented rulings by the packed, stolen and corrupted U.S. Supreme Court majority at the end of their term earlier this summer --- underscores how broken our federal judicial system has become. And while there is no shortage of well-meaning legal experts on TV and social media explaining how best to respond to corrupted rulings by corrupted courts, these are problems that the nation cannot litigate itself out of, as our guest argues today.

We're joined again by the great DAHLIA LITHWICK, longtime legal analyst at Slate, MSNBC contributor, podcast host, and author of the new book, LADY JUSTICE: Women, the Law, and the Battle to Save America.

Writing this week with our other legal reporter friend from Slate, Mark Joseph Stern, in an article headlined "The Solution to the Trump Judge Problem Nobody Wants to Talk About" the pair reference the court battle over the stolen documents retrieved from Mar-a-Lago: "The problem is not just the extreme and heinous flaws in Cannon’s ruling. It’s also the Trump-shaped world in which Cannon operates, with impunity, which we will all have to endure for the foreseeable future. It’s the brutal reality that we may face a steady stream of depraved decisions like Cannon’s for the rest of our lives --- and the pain of hearing from every quarter that nothing can be done to remedy it."

"There are too many things wrong with the Cannon order to litigate," they conclude. "And there are too many things wrong with Trump’s judicial dominion of every part of our lives --- for years to come --- to litigate. So maybe it's time to stop litigating them and start fixing them."

How to start fixing them? Well, that's at the center of my discussion today with Lithwick, beginning with the need for "big-swing structural reform" of our courts and how to start making the noise needed to help make it happen.

Our long national nightmare may be over in about 28 days...but it ain't over yet. Not by a long shot. And, as detailed on today's BradCast, it's becoming more unnerving by the second, with Donald Trump's mental health seemingly devolving rapidly with each and every one. [Audio link to show is posted below.]

Curiously, corporate media are sounding more and more like The BradCast with each passing day. Among the stories underscoring that point as Trump's days in the White House continue to wane (whether he is able to admit that out-loud or not)...

  • "Trump turns on everyone," reports Jonathan Swan at Axios. "Everyone" now appears to include "Vice President Pence, chief of staff Mark Meadows, White House counsel Pat Cipollone, Secretary of State Pompeo and Senate Majority Leader Mitch McConnell." (With a hat-tip to Lincoln Project, for their video getting inside Trump's head regarding Pence);
  • Pentagon Correspondent Barbara Starr reports anxiety is rising at DoD, with one officer telling her "We don't know what he might do" in these final days. They were particularly alarmed after talk from disgraced and pardoned former National Security Advisor, Lt. General Michael Flynn's call for Trump to invoke Martial Law and order the military to "re-run" the election in some states that Trump lost. The military, according to Starr, wants nothing to do with any of it. We hope her reporting is accurate;
  • Amid all of this, Trump unleashed another wave of Presidential pardons for his friends and the friends of his friends on Tuesday night. This time for 4 war criminals charged with murder for carrying out a massacre of Iraqi civilians while employees for Blackwater, the mercenary company owned by Eric Prince (brother of Trump's Education Secretary, Betsy DeVos); 3 corrupt, felonious Republican former Congressmembers (including the first two members of Congress to endorse him, Chris Collins of NY and Duncan Hunter, Jr. of CA); and 2 Campaign staffers who plead guilty to felonies tied to the Robert Mueller Special Counsel probe into Russian interference during the 2016 election. (And, after getting off air tonight, Trump has issued still more pardons for still more of his friends, including for his former campaign manager Paul Manafort, former campaign advisor Roger Stone, and for Charles Kushner, father of his son-in-law Jared, all convicted of multiple felonies);
  • But wait, there's more. Much more! During an unhinged, pre-taped White House video posted to Twitter last night, Trump threatened to veto the $900 billion COVID relief bill attached to the government's must-pass annual spending bill to avoid shutting down again. The long-overdue emergency relief was finally passed by Congress after eight months of Trump refusing to participate in negotiations. He's now pretending to be upset that stimulus checks to be sent to many Americans will only be $600. Congressional Republicans and White House negotiators insisted it could be more no more than that. But Trump now suggests he may veto the measure unless payments are increased to $2000. Dems, who had been trying to increase the amount of payments for months immediately joined Trump's call. Congressional Republicans (and the two incumbent Republican Senators running in the January 5th runoffs) are apparently furious, confused, and not sure how to fulfill the demands of their Frankenstein's monster;
  • And, just before airtime, Trump vetoed another long-negotiated must-pass bill, the $790 billion Military Authorization spending bill which was enacted last week by veto-proof majorities in both houses of Congress;
  • That's only a taste of what, according to the Washington Post today, has now "plunged" the GOP "into open warfare over President elect Joe Biden's election victory --- with President Trump taunting Senate Majority Leader Mitch McConnell and threatening primary challenges against other Republicans, House lawmakers egging on senators to contest the counting of electoral college votes next month, and senior GOP senators rebuffing that effort as a pointless political exercise";
  • All of which, as the New York Times reports today, has resulted in Trump at the "most unleashed...and...most unpredictable point in his presidency," while he is desperately "focused on the one area in which he is powerless to get what he wants: a way to avoid leaving office as a loser";

With that nightmarish backdrop, our guest today, HEATHER DIGBY PARTON of Salon and Hullabaloo joins us to explain why Trump's final days are "more frightening than Nixon's" as he "seems to be having a very public nervous breakdown."

"We knew he wasn't going to act like a normal President and be gracious and have Biden over coffee. I didn't expect that," she tells me. "But this? He's so incredibly afraid of being called a loser that he's turned himself into the greatest sore loser in world history!"

"He's clearly melting down," she adds. "As far as I am concerned, when you have a President who is melting down, who has this capacity to launch a nuclear war, we're in a very dangerous situation."

She also has a number of thoughts on where this all goes "beyond Trump," after the (theoretically) inevitable Inauguration of Joe Biden, if we manage to get there. "The rationalization of these people. The brain-poisoning...The absolutely servile Republican Party that has completely abdicated all responsibility," observes Parton. "He is the Republican party. They are part of it, if they choose to be. But there is no Republican Establishment. There's only him."

This, she cautions, is "Trump's last stand," before adding ominously: "At least, we think it is."

We've tried to touch base with Parton at many of the landmark moments throughout the nightmarish Trump Presidency (and candidacy --- she was also with us the day he descended the gilded escalator at Trump Tower to announce his run for office in 2015.) So, with all of this madness swirling and our long national nightmare before Christmas continuing, it seems like today was another perfect moment to check in with her for our last interview before standing down for the holidays. On today's BradCast, the grifts continue --- huge new ones that few yet know about --- but too many are focused on Donald Trump's latest distractions to notice. [Audio link to show follows below.]

First up today: Please stop taking Trump's bait. His tweet on Thursday suggesting the postponement of the November election was little more than an attempt to distract from the day's very real news, including the horrific numbers from the Commerce Department (finding that the U.S. economy had plunged a record, unprecedented, staggering annualized 33% in the second quarter.). It worked. Media fell for it, and so did you, even though the President of the United States has no power to change the date of the Presidential election. The tweet not only helped to flip the entire day's news cycle, it also further terrorized the nation and helped to reinforce his desperate narrative that the 2020 election will be "the most INACCURATE & FRAUDULENT Election in history."

Democrats need to stop cowering in fear at Trump's wannabe dictatorial pronouncements. As Josh Marshall correctly wrote in response, "I understand everyone is afraid. But this is loser talk." The anti-Trump Republicans at the Lincoln Project ain't buying it. And the co-founder of the far-right Federalist Society has called for Trump's immediate impeachment because of it. Media need to learn to stop allowing Trump to hijack the news cycle and Americans need to learn to stop cowering in fear of Trump, despite his only actual talent: masterfully tricking both you and the media into falling for his pathetic manipulation.

Next up, the powerful Republican Speaker of the House, Larry Householder, who was arrested and charged last week by federal prosecutors in a massive, $60 million bribery, money laundering and racketeering scheme, has now been removed from the Speaker position in a unanimous bipartisan vote of the Buckeye State's House of Representatives. Householder and four others (including a senior aide, a former state GOP chair, and two top energy industry lobbyists) were charged in a racketeering scheme funded by FirstEnergy. The scheme was used to force a wildly unpopular bill through the state legislature last year that raised electricity bills on Ohio ratepayers to bail out two failing, hyper-polluting coal plants and two failing nuclear plants, while gutting the state's successful renewable energy and efficiency programs.

Despite the felony charges and lost speakership, Householder has yet to resign, the corrupt $1.5 billion House Bill 6 is still on the books, and Ohio's Republican Governor, Mike DeWine, who quickly signed the measure, still has some explaining to do. But while that scheme, described by federal prosecutors last week as the "the largest bribery, money laundering scheme ever perpetrated against the people of the state of Ohio," allegedly netted Householder some $60 million in bribes from FirstEnergy, laundered through a non-profit front group, it may pale in comparison to what one good government group now charges the Trump reelection campaign is doing.

Earlier this week, the non-partisan watchdog Campaign Legal Center (CLC), headed up by a former Republican Chair of the Federal Elections Commission, filed a new complaint with the FEC charging that the Trump Campaign and a joint fundraising committee is violating federal law by "laundering" nearly $170 million in campaign spending through firms headed up by Trump's former campaign manager, Brad Parscale (pictured above). The money, according to my guest today, CLC's Director of Federal Reform, BRENDAN FISCHER, is secretly being funneled to Trump associates and even family members.

"We've never seen anything like this. The scope and scale of this secrecy scheme is unprecedented," Fischer says, explaining how tens of millions of dollars in campaign ad buys and other large campaign expenses are all being run through two companies created by Parscale. One is called American Made Media and the other is Parscale Strategies. The campaign has claimed the companies are being used to save money by cutting out middle-man vendors, but CLC has discovered that the companies are being used as pass-throughs, and that sub-contracted vendors are making ad buys on behalf of the Trump Campaign anyway. Moreover, those vendors are not being disclosed, as required by campaign finance law, on the Campaign's financial disclosure forms. That, as Fischer tells me, means that payments are being hidden for campaign work, including potentially millions of dollars siphoned to groups with whom it is unlawful for the Campaign to coordinate efforts, and even to Trump associates and family members like Lara Trump (Eric Trump's wife) and former Fox "News" host Kimberly Guilfoyle (Donald Trump Jr.'s girlfriend).

"These two Parscale firms are being used only as pass-throughs to disguise the ultimate recipients of the money," Fischer and the CLC complaint alleging civil violations of campaign finance laws charge. "If the Trump Campaign gets away with this, it's just going to become a common practice. It's going to get replicated by campaigns, both Democrat and Republican, to disguise all of their political spending," he warns, adding that "if there was evidence that the violation was knowing and willful, there potentially could be criminal penalties."

Fischer offers many more details on what CLC knows and, due to the purposeful obfuscation through campaign finance records, what they still don't know, but hope that FEC investigators will be able to find out. We also discuss the dysfunction of the impossibly broken FEC and how that may affect action on this new and very serious complaint.

Looks like we gotta lot of fact-checking to do today...

The good news for today's BradCast is that, thanks to so much breaking news on yesterday's show, we've got at least one encouraging new piece of news on a story that we had to bump yesterday regarding Donald Trump's absentee voter fraud felony in the state of Florida. Between that and the false claims made by him and U.S. Attorney General Bill Barr and Arkansas Sen. Tom Cotton (in the pages of the New York Times, shamefully enough) charging that "antifa" is behind the violence seen at some of the mostly peaceful protests across the country over the past week and a half, we've got a lot of fact-checking to do on today's program. [Audio link to full show is at bottom of summary.]

First, Times staffers are livid that that the paper of record gave space to Cotton for an editorial on Wednesday calling for U.S. military troops to be deployed across the country against U.S. citizens under the Insurrection Act. The far-right Republican Senator charged in the piece that "cadres of left-wing radicals like antifa [are] infiltrating protest marches to exploit [George] Floyd's death for their own anarchic purposes." His remarks echo those of Trump, who, on Sunday, declared (falsely) that antifa will be designated as "a Terrorist Organization". In fact, antifa is not an organization. It's a movement of people who oppose fascism and authoritarianism and there is no such federal designation for domestic organizations, even if antifa was one. But the calls of Trump and Barr and Cotton echo what the Times itself described as "misinformation" just two days earlier in an article debunking that myth and several others related to the protest and being circulated widely (and falsely) on social media.

Moreover, the charge that antifa is behind the violence at protests is contradicted by intelligence reports this week from both the FBI and DHS, which find little evidence of antifa involvement, but seem to find plenty of evidence that rightwing white nationalist groups have organized to instigate chaos at otherwise peaceful demonstration around the nation. Continuing video tape evidence of police violently abusing peaceful protesters, including on Wednesday night after many of the demonstrations had otherwise calmed down, doesn't help either. But this week Twitter reported they'd shut down a European white nationalist group posting as "@ANTIFA_US" and tweeting out, for example, messages with a brown raised first emoji and declaring: "Tonight's the night, Comrades. Tonight we say 'F--- The City' and we move into the residential areas... the white hoods.... and we take what's ours."

While that account has been shut down, the white nationalists on the street have not all been. We still do not know the identity of the white man with full face gas mask (pictured above) and a black umbrella, who strolled down the sidewalk in front of the Minneapolis AutoZone last week with a hammer by his side, casually smashing each window of the store. Protesters tried to stop him and to identify him before he slipped away, leading Minnesota Attorney General Keith Ellison to post the video of the man on Twitter, along with the remark: "This man doesn't look like any civil rights protester I have ever seen. Looks like a provocateur. Can anyone ID him?"

And yesterday, in Las Vegas, AP reported on terrorism charges filed against three Nevada men with ties to a rightwing extremist group. They were arrested on Saturday heading to a protest on the Strip after "filling gas cans at a parking lot and making Molotov cocktails in glass bottles," according to the criminal complaint obtained by AP. Two of the men, according to an informant, "discussed causing an incident to incite chaos and possibly a riot, in response to the death" of George Floyd. They are all said to be members of the anti-government "boogaloo" movement, advocating for a new civil war.

It seems its easier to find strawmen to blame for years of systemic racism rather than take responsibility for it. That seems to be what Trump, Barr, Cotton, Fox "News" and all the rest of those looking for someone else to blame for Floyd's death and the resulting outrage seem to be doing. It doesn't seem to be working. But that won't stop them from trying to play a whole bunch of folks just months before the next Presidential election.

Speaking of...as we reported several weeks ago, Donald Trump --- who has been making myriad false claims about absentee voter fraud for weeks now --- is, himself, a voter fraud criminal after illegally voting in Florida this year, by absentee ballot, despite having no lawful permanent residence in the state.

While he claimed late last year to have moved his permanent residence from New York to his Mar-a-Lago club in Palm Beach, his original 1993 agreement with the city when he purchased the property and turned it from a single-family residence into a commercial club, required that nobody could actually live there. So, yes, that is voter fraud, and people in Florida have been charged and even jailed for much lesser infractions of the Sunshine State's elections code.

Yesterday, the Washington Post reported another noteworthy point or two on this story, with yet another update to it today. On Wednesday, the paper reported that Trump, when he filed his Florida voter registration [PDF], listed the White House at 1600 Pennsylvania Ave. as his "legal residence". That means his legal residence is not in Florida and he is, therefore, not allowed to vote there. A month later it appears he tried again, this time specifying Mar-a-Lago's address as his "legal residence." It's unknown what happened in the 31 days between the first and second registration, but maybe Florida generously granted him a mulligan. Of course, that still doesn't make his declared residence at his commercial property in Palm Beach a legal domicile in the state.

Making his case even worse, on Monday, during his infamous phone call with the nation's Governors (in which he described peaceful protesters as "terrorists" and instructed the Governors to "dominate" them or he would send in U.S. troops to do so), he stated: "I live in Manhattan". Oops. That prompted Democratic election attorney Marc Elias to tweet: "Sounds like New York may have a good claim for taxes. And Florida for voter fraud."

And, on that point, the Post updated its story today with the news that a Florida resident has now filed a formal election fraud complaint against Trump, which is what we've been calling for weeks! Under Florida law, the state is now required to investigate the complaint. And because it's a violation of state, not federal, law there is nothing to my knowledge that should prevent the President from being charged with felony voter fraud there. He did it. He should be charged with fraud.

When we painstakingly detailed the voter fraud by former GOP superstar Ann Coulter more than a decade ago after she illegally lied about her address in Palm Beach on her registration application and then unlawfully voted at a precinct she was not entitled to vote in, the state slow-walked their investigation until the statute of limitations ran out. (She also got a helping hand from a former FBI boyfriend). We'll hope that Florida Law Enforcement doesn't try something similar here. Though it would be much harder to do in this instance, given that the crime happened just months ago in this case.

On today's BradCast: Rural America is under siege from the coronavirus, as the Mayor of one of the hardest hit small towns in the nation joins us to explain how they are coping with the massive outbreak and an unprecedented lockdown barring all traffic into the town. [Audio link to full show is posted at the end of this summary.]

Vice President Mike Pence announced today that the White House Coronavirus Task Force may be disbanded within the month, due to the "tremendous progress we've made as a country." Actual reality, however --- as represented by statistics, health experts and scientists --- suggests otherwise. For example, a new analysis from Associated Press today finds that, with the New York metro area removed from the statistics, the rate of both infections and deaths across the country are increasing, not decreasing. Another study from the Kaiser Family Foundation also finds that infection and death rates, particularly in rural areas, are spiking. Infection numbers are up in recent days by 115% and the COVID death rate has jumped 169% in rural areas, with many of the worst outbreaks occurring in states where Republican Governors are now foolishly relaxing stay-at-home restrictions and allowing business to reopen prematurely. The increasing numbers are in line with private calculations from the CDC and FEMA obtained yesterday by the New York Times.

Despite all of that, Donald Trump declared today that "It's time to open it up. ... Will some people be affected badly? Yes. But we have to get our country open." Opening the country prematurely is likely to costs tens of thousands of lives, but Trump has a re-election to worry about, after all.

Right now, one of the worst coronavirus outbreaks in the nation is happening in Gallup, New Mexico, in the rural western part of the state bordering the Navajo Nation, the country's largest Indian reservation. "As of Sunday," the Times reports today, "the Navajo Nation had reported a total of 2,373 cases and 73 confirmed deaths from the virus." The infection rate in the area is the third-highest of any metropolitan area in the U.S., following only New York City and Marion, Ohio, where there is a mass outbreaks in a large prison cluster. Over the weekend, Democratic Governor Michelle Lujan Grisham invoked, for the first time in state history, the state's Riot Control Act. That has locked down the entire city, including the closure of all roads leading in to the town of 22,000 where the virus, she said "is running amok".

We're joined today by Gallup's MAYOR LOUIE BONAGUIDI, who was sworn into office just five days ago. When I joked about his trial by fire upon becoming Mayor, he quipped: "In fact, the Governor called me and said, 'Congratulations on your win. But, then again, I have to tell you we're locking down your city.'" Nonetheless, Bonaguidi, as well as former Mayor Jackie McKinney and Navajo Nation tribal President Jonathan Nez, all support the extreme measure that includes city, state and county police as well as National Guardsman blocking exits off the freeway and smaller roads into the town from the Navajo Nation, where, on the first of the month, thousands flood into the city for supplies.

"We had to do something," he tells me, in explaining the reasons for the "drastic" action. "The numbers are unbelievable. Between thirty and fifty thousand people come into the community. That's a major influx. We're thinking to ourselves, well, if the virus is here, then they're going to be taking it home to their families. So that's one of the reasons we thought maybe we'd better do it now. We'd better stop it on the first of the month when all of these people are coming into the community."

Bonaguidi says, however, that the community has been very supportive of the roadblocks, bringing drinks, water and food to the officers. A lack of water, however, is perhaps one of the reasons for the outbreak in McKinney County that, by itself, accounts for 30% of the state's infections. Much of the tribal reservation still lacks running water --- a new waterline is under construction, but will take years to be completed --- so careful hygiene amid the epidemic is not easy for many in the Native American community.

The Mayor explains that their two local hospitals are now at capacity and a local high school was converted into a hospital with the help of the U.S. Corps of Engineers. They do not have enough masks or sanitizer, he tells me, and the slow pace of receiving test results has made things much more difficult. "The sad part about it is the tests take so long. They take two, two-and-a-half days before they get back to you whether you're positive or negative. If the tests were quicker, we could get a handle on this virus. But it really makes it rough when you have to wait that long. ... I understand there are faster tests coming out, but we definitely have not been able to get enough of them. There are 70,000 people in the county, and they've basically only tested about 6,000 at this point."

Bonaguidi cautions that many in his community and others around the state and country are not taking the threat seriously enough. "We're doing everything we can. And the Governor has gone way out of her way for us here. It's too bad we had to be as drastic as we are. But, if anything, it's going to get the awareness out to the rest of the communities --- rural, for that matter --- that it's a serious situation, and we've got to address it."

When I ask what, if anything, the rest of us in the country can do to help, he told me: "We're all in this together. The whole world is fighting a virus, and there's just so little known about it. We're doing whatever we can to curb it, to stop it. I guess we can ask for your prayers, if anything."

Also on today's program: Apparently Trump is really really REALLY upset by a new :60 second ad called "Mourning in America" from The Lincoln Project, a group of anti-Trump Republicans touting his disastrous and deadly failures in response to the crisis. And the USDA finally invokes their 1930s-era authority that allows for food purchases to help both farmers and people in need after millions of tons of fresh food and milk has been dumped by food producers unable to sell it to schools, restaurants and other facilities that have been shut down due to the crisis.

While that bailout actually helps both the industry and regular Americans in desperate need of food, the Administration's secretive big bailout for Big Oil is another matter all together, as Desi Doyen reports in our latest Green News Report to close out today's show...
