On today's BradCast: A longtime investigative journalist who has documented the rise of the radical right has been suspended from Twitter for a ridiculous reason. Should that be cause for alarm for some of those on the left who applauded the recent removals of right-wingers from that and other social media platforms? [Audio link to show follows below]

But, first up today: Don't fall for it. The Trump Administration is making all sorts of evidence free allegations that Iran is attacking shipping tankers in the Persian Gulf. The Japanese owner of one of those tankers offers evidence that directly contradicts the U.S. claims and, so far, no other country is backing up Sec. of State Mike Pompeo's litany of evidence-free charges that Iran is behind a number of recent attacks. Of course, that didn't keep Donald Trump from telling Fox "News" on Friday: "Iran did do it and you know they did it, because you saw the boat." He was referring to a grainy, black and white video released Thursday night by U.S. Central Command purporting to show an Iranian vessel removing an unexploded mine from one of the tankers. Funny how easily Trump is convinced by remarkably thin evidence about something he wants to believe, versus mountains of evidence, gathered over years by independent sources, on things like climate change and his own obstruction of justice. Don't fall for it. Not again.

Then, we're joined by award-winning investigative journalist DAVID NEIWERT who, since Tuesday, has been "temporarily suspended" from Twitter due to a profile graphic he's used for two years on his account there, without incident, as taken from the cover of his 2017 book Alt-America: The Rise of the Radical Right in the Age of Trump. Neiwert, who has been a contributing writer for the non-profit Southern Poverty Law Center's "HateWatch" blog, as well as for MSNBC where his 2000 reporting on domestic terrorism earned him the National Press Club Award for Distinguished Online Journalism, was informed by the popular social media platform that the profile graphic from his book --- a cleverly designed image of KKK hoods atop each of the white stars on the American flag --- violates Twitter's "sensitive media policy" rules barring "symbols historically associated with hate groups" in profile or header images.

Obviously, his use of the graphic is meant as commentary on those symbols, rather than in support of them. Still, his "temporary suspension" has resulted in all of his tweets being unavailable and a restriction on posting any new ones until he removes the graphic in question. He is refusing to do so, though he is still in contact with Twitter and hopes to negotiate a solution to what he describes at Daily Kos today as an ill-conceived policy that fails "to distinguish hate speech from the efforts to oppose it".

"Literally, they can set any standards that they want, because they are private platforms," he tells me, correctly noting that the U.S. Constitution's First Amendment free speech clause applies only to the Government, not private businesses. "Twitter has announced that it wants as its standard to remove hate speech. But it isn't distinguishing between hate speech and actual efforts to fight hate speech. It's not making that distinction. And it's supposed to be doing this on behalf of the effort to fight hate speech, because this is its standard."

"The problem is they're basically trying to replace human judgment with an algorithm. And algorithms are stupid. They can't figure this stuff out. They lack the human judgment." Nonetheless, as we discuss, even after his graphic may have been pinged by an algorithm --- likely set off by folks on the alt-right who dislike him --- human intervention has yet to result in his account being unlocked again.

With some 500 million tweets a day, he recognizes, the platform must "use algorithms to flag these things, that's just the nature of the beast. But how many suspensions for hate speech do they make? Probably not very many. Probably in the hundreds. That's something that's manageable on a human level, and it's something that requires human judgment to make those calls. And they just need to bite the bullet and recognize that they need to employ smart, well-trained humans to do that job. That they can't rely on an algorithm to do it."

Neiwert has supported the recent deplatforming across a number of the most popular social media outlets such as Twitter, Facebook and YouTube of conspiracy theorists like Alex Jones of InfoWars, right-wingers like Milo Yiannopoulos and White Nationalists like Richard Spencer, though he notes that others, such as former KKK Grand Wizard David Duke have not been removed. Nonetheless, while the removal of far right figures has been met with cheers from many on the Left, should Neiwert's case give pause to some of those cheering progressives? Isn't fascist speech still free speech after all? And what happens if a right-winger were to take over ownership of outlets like Twitter? We discuss that and much more, including Neiwert's very early and astonishingly prescient warning about Donald Trump way back in late 2015.

Also today, the DNC announces the results of its random drawing to determine which ten 2020 Democratic Presidential candidates will appear together on each of the two nights of the first Presidential debates set for June 26 and 27 in Miami. And then we close with an excerpt from candidate Bernie Sanders' recent policy address at George Washington University in which he calls for a 21st Century Economic Bill of Rights modeled on one sought by FDR to guarantee a living wage, affordable housing, health care and a complete education for all, as he makes the case that democratic socialism is the only way to offer "true freedom" from corporate oligarchy and rising authoritarianism...

On today's BradCast, some facts --- real ones, not Mitch McConnell's --- about our nation's healthy history of changing the number of seats on the U.S. Supreme Court, which we have done seven different times over the past 238 years since our founding. [Audio link to full show is posted below.]

But, first up quickly today, Donald Trump has taken yet another hit from the courts on his attempt to undermine the Affordable Care Act and the U.S. healthcare system. It's the second such court loss he's faced over the past week, with the first court nixing his attempt to allow work requirements under Medicaid in Kentucky and Arkansas, and the second on Thursday night finding his allowance of cheap health insurance policies that don't meet the standards of the Affordable Care Act ("Obamacare") to be unlawful. That second ruling comes courtesy of a well-respected George W. Bush-appointed federal judge who is rarely reversed by appellate courts.

Next, a preview of a very important election on Tuesday in Wisconsin for its state Supreme Court. Its the first of two elections to the high court in the Badger State (one on Tuesday and the other next year on the same day as the Democratic Presidential primary election in WI) that could result in a progressive-leaning majority, at long last, being restored to WI's high court. Control of that court is wildly important for both the state and the nation on a number of fronts, which we discuss today, including voting rights before the 2020 election, redistricting for the next decade after the 2020 Census, and the rollback of a host of anti-union and other hard-right policies enacted during the gerrymandered Scott Walker years.

Tuesday's match-up is between progressive-backed Judge Lisa Neubauer and Koch Industries/Chamber of Commerce-backed Judge Brian Hagedorn, a protege of former Republican Gov. Scott Walker. Hagedorn has called Planned Parenthood a "wicked organization" devoted to "killing babies", described the NAACP as "a disgrace to America", and argued "The idea that homosexual behavior is different than bestiality as a constitutional matter is unjustifiable."

But while voters in WI directly select their Supreme Court at the ballot box (which I am no fan of), the U.S. Supreme Court is a different matter. After Senate Republicans stole what should have been a Democratic majority on the court in 2016 by refusing to even hold a vote on Judge Merrick Garland, Barack Obama's nominee to replace the late Justice Antonin Scalia, GOP Senate Leader Mitch McConnell held the seat vacant for a year before unilaterally changing Senate rules to do away with the filibuster to allow Neil Gorsuch to be seated on the high court. Later, under those same changed rules, the far-rightwing, accused sexual-predator Brett Kavanaugh was similarly added to the Court, likely cementing a generation of GOP-control.

In response, many progressives --- even Presidential candidates --- are now calling for the expansion of SCOTUS if Democrats can regain control of the U.S. House, Senate and White House next year, in order to restore a liberal-leaning majority that arguably should have been theirs in 2016. Naturally, McConnell is already decrying the idea, describing it on Thursday, ironically enough, as "an unprincipled power grab...that would threaten the rule of law and our American Judicial system." He cites the attempted court packing by Franklin D. Roosevelt in the 1930s to support his notion that changing the size of the Court is "a thoroughly discredited idea".

We're joined today by Wisconsin attorney and former state Supreme Court nominee TIM BURNS for both thoughts on Tuesday's crucial election in the state ("The stakes are huge," he explains) and the little-known history of "court packing" in the U.S. More specifically, Burns, who wrote about the issue recently at The New Republic, discusses the seven different times since the founding of our republic when the number of seats on the U.S. Supreme Court has been changed by Congress, including under one of our founders Thomas Jefferson and even under Republican Party icon Abraham Lincoln.

Burns, who serves on the board of the progressive Wisconsin Justice Initiative and the national board of the American Constitution Society, argues that contrary to misleading claims by McConnell and fellow Republicans, changes made to the size of SCOTUS by the Legislative and Executive Branches, as called for by the U.S. Constitution, have been healthy for the nation, often coming "hand in hand with some of the most vibrant periods of our democracy," and in response to the out-sized growth of corporate power.

"There have always been these predictions of the utter ruin of our democracy if the size of the Court is changed," Burns tells me. "The truth is, the Court's been viewed favorably even after its size has changed." And while he says that it's "entirely possible" that Republicans could then do the same thing once they regain power, "that doesn't spell the doom of our democracy. It says that our democracy is working. The political power rests with the voter instead of nine lawyers, judges on a Supreme Court."

Perhaps that's why Senate GOPers this week have introduced a measure calling for a Constitutional Amendment to keep the number of seats on the Court at nine. Good luck with that, boys.

Most interesting, however, may be Burns' fascinating recounting of what happened when FDR attempted unsuccessfully to expand the Court in what McConnell falsely described as an historic event that resulted in the idea of "Court Packing" becoming "synonymous in American history with the idea of an unprincipled power grab". What actually happened in the 1930s, and why the Court was ultimately not expanded under FDR is a fascinating bit of lost history and quite different from the way it has been described in lore. The truth places new calls to expand the Court today, during this period of unprecedented partisanship and class-divide under a hard-Right SCOTUS, into a very different light and perspective as this debate kicks off both in the nation and among Democrats vying for the 2020 Presidential nomination....

On today's BradCast, our week of exploding ridiculous GOP myths continues. On Tuesday, we debunked the absurd notion that they oppose "big government" in favor of state and local control. Yesterday, the decades-long scam that they oppose debt and deficit spending. Today, their opposition to "socialism" is exposed for the lie that it remains. [Audio link to show follows below.]

But, first up today, Tuesday's primary runoff in Georgia offered yet another stark reminder of what could go terribly wrong in the Peach State --- and all of the others --- this November, as voters were, again, prevented from casting ballots due to a failure in the state's voter registration database and its computerized electronic pollbook system. That, of course, is on top of the 100% unverifiable touch-screen voting systems that voters are still forced to use in Georgia on Election Day --- at least when they are allowed to vote.

But, don't worry. Brian Kemp, the Republican Sec. of State who "oversees" both systems --- including during the several years when the entire registration database and administrative passwords for the tabulation systems were left unprotected online for downloading --- is now the GOP's nominee for Governor in the state. He'll make certain the public has confidence in the results of his race this November between him and Stacey Abrams, who could become the nation's first African-American female Governor.

Then, it's onto Donald Trump's socialist --- yes, socialist --- scheme to bailout farmers in the Midwest who are being devastated by Trump's trade war with China. But, again, don't worry. He's found an old FDR-era New Deal program that the White House plans to use to give farmers $12 billion in tax-payer money to make some of the losses he has caused them a bit less stinging. In response, Republicans in Congress this week pretended to be outraged about the bailout, while taking no actual action to reverse either it or Trump's trade wars with the world.

Of course, the GOP only pretends to oppose socialist programs, which are otherwise wildly popular with the American public. When needed, they are more than happy to privatize profits and socialize losses when they control the reins of government. By way of yet another example today, we share a remarkable story along those lines, about a very powerful Republican family from Indiana who has been enjoying local, state and federal government bailouts for years --- to the tune of some $20 million --- following the failure of their once-formidable gas station empire and the toxic trail it has left behind.

After three Presidents, trillions spent and hundreds of thousands killed, it's time to end the endless war...

There have been occasions during the history of our Republic where a traumatized Congress has, under the gravity and stress of a calamity, made a hasty decision without sustained debate or thoughtful consideration of its consequences. One of those occurred just three days after the September 11, 2001 terrorist attack.

Over the singular objection of Rep. Barbara Lee (D-CA), the only member to vote against it in either chamber, Congress passed a joint resolution --- the 2001 Authorization for Use of Military Force (AUMF). This joint resolution differed markedly from the formal Declarations of War that were issued in the aftermath of Pearl Harbor.

During World War II, there were specific nation-state enemies and an attainable, concrete goal --- the defeat of the Axis powers. Congress did not authorize and Presidents Franklin D. Roosevelt and Harry S. Truman did not embark upon a fool's errand --- the permanent elimination of any and all future threats to our republic created by the very existence of Nazi and fascist ideologies.

The 2001 AUMF, however, was not confined to specified nation-state enemies. Congress authorized the President to use military force against "nations, organizations or persons" as part of an impossible task: the prevention of any and all "future attacks of terrorism against the United States."

As astutely observed by Retired U.S. Army General William Odom in 2002...

On today's BradCast: 75 years ago this past weekend, FDR issued Executive Order 9066, sending 120,000 Japanese-Americans to concentration camps in one of the most shameful moments in American history. Today, we fight to keep history from repeating itself as Trump offers big lies about terrorism, voter fraud and the media, among other things --- for a reason. While Trump's Executive Order attempting to ban Muslims and refugees from seven different countries has been blocked by the federal courts, another one is promised to take its place soon. And in order to do so, the Administration continues to offer lies about terror attacks to justify its actions, this time with the President citing a non-existent terror incident in Sweden --- fake news that he heard about (and misreported) from Fox "News" the night before his campaign rally in Florida on Saturday.

That dangerous lie comes on the heels of a week of another big lie from Trump and his top advisers concerning false claims of "thousands" of cases of "voter fraud" in New Hampshire and elsewhere --- and as Trump declares the media to be "the enemy of the American People."

While the lies are now non-stop, ridiculous and, at times, hilarious, the insidious reason behind them is chilling, dangerous, shameful and about as un-American as possible. Why all of it matters, and more, on today's BradCast...

On today's BradCast, while Hillary Clinton and Donald Trump are busy smearing Bernie Sanders as "extreme" and even "communist", the broad and progressive social programs the Vermont Senator is calling for in his campaign are, as my guest explains today, as American as apple pie and Thomas Paine.

First, however, voters head to the polls for crucial Presidential primary elections in OH, IL, MO, NC and FL and run into a few problems; Massive flooding hits climate deniers in the south, shutting down major interstates and requiring the costly rescue of thousands in TX and LA; And, February global heat records "shock" even climate scientists.

Then, we're joined for today's interview by Univ. of Wisconsin-Green Bay Professor of Democracy and Justice Studies Harvey J. Kaye to discuss the rich history of social democracy (or, as Sanders calls it, "democratic socialism") in the U.S. and how, as noted in the headline of his article for Moyer's & Company, "Social Democracy is 100% American".

"Social democracy means that we harness the powers of democratic government to make American life freer, more equal and more democratic," he tells me. "That stands in contrast to a conservative approach, which is either to empower a hyper-individualism in the libertarian sense, or, as we've seen so often in the Republican Party, empowering big capital and corporations to pursue their interests with some idea that it will all trickle down."

Kaye, author of the books Thomas Paine and the Promise of America and The Fight for the Four Freedoms: What Made FDR and the Greatest Generation Truly Great, details how "the original visionary of Social Democracy was the American revolutionary Thomas Paine," oft-embraced by the modern Tea Party and other Republicans, even as they fail to notice his loud and frequent calls for "social security and other public initiatives" that would benefit all.

From Paine through Lincoln through FDR, Eisenhower and beyond --- at least until Ronald Reagan --- U.S. leaders helped "pioneer" a vast number of landmark social programs akin to the ones Sanders is now calling for in his Presidential campaign and on which our nation has been built from the beginning. Kaye, a supporter of the Democratic underdog, explains how and why he believes that "democratic socialism" has been turned into a pejorative over the years, thanks to both "red-baiting" Republicans hoping to tie it "communism", but also thanks to Democrats who have been playing into the same "class war from above."

"The Republican onslaught has been predictable," Kaye says, after detailing example after example of wildly popular socialist programs in the U.S. ever since our founding and through recent decades. "The corporate class war from above was predictable. But where are the Democrats to challenge it?"

Fear of such programs of social justice and economic prosperity, particularly by theoretically "progressive" Democrats, is a fairly new phenomenon in the U.S., which, he tells me, young people may not realize. "These last forty years we have seen this Republican-conservative ascendance that has so limited political possibilities. It has also limited our political imagination."
