Today's BradCast is perhaps better listened to than explained. But here's a quick summary and some links for more details. [Audio link to full program follows this summary.]

We focus today on the largely peaceful pro-Palestinian protests that have sprung up on college campuses across the U.S. over the past week or two in response to Israeli Prime Minister Benjamin Netanyahu's punishing, ongoing assault of Gaza and the Biden Administration's facilitation --- reluctant or otherwise --- of that effort. Our central focus is on the responses to the protests here in the U.S. by counter protesters, media, politicians (including remarks by Joe Biden today), and, most disturbingly, armed riot police who seem to be touching off the bulk of the violence, or at least the eye-catching "if it bleeds it leads" scenes of chaotic confrontations that are easy to show on television news, whether they capture the truth of the moment or not.

As noted, today's program is better listened to than explained, I think. But, among the source material referenced in our coverage...

Democracy can reverse the damage wrought by corrupt, right-wing Supreme Court ideologues...

When our corrupted U.S. Supreme Court, in June, handed down their closing opinions for last year's term, it became clear that we are facing a dark judicial hour in this nation.

Dark for women whose reproductive liberty and very lives have been placed at risk; dark for those who are drowning in seemingly insurmountable student debt; dark for those in the LGBTQ+ community who are seeing their very existence and right to medical care being challenged; dark for young African-American students hoping to acquire a higher education so as to overcome our nation's legacy of systemic racism; dark for the families of the ever-growing number of victims of mass shootings.

Our judicial institutions, for the moment, are still holding when it comes to accountability for the scoundrel who served as our 45th President. But, for too many others, the High Court has wrought a darkness brought on by the corrosive influence of the billionaire class and the "dark money" that billionaires and corporations use to corrupt our political and legal institutions.

That darkness comes courtesy of the Supreme Court's infamous 2010 Citizens United decision. It is a darkness also facilitated by political chicanery resulting in a Republican Party, which lost the popular vote in seven of the last eight Presidential Elections, packing a "corrupt" supermajority of six right-wing ideologues onto the nine-member High Court.

Their dark, radical interpretations of the Rule of Law have done more than simply endanger democracy's survival. By inventing a Second Amendment right of an individual to bear arms unrelated to military service in a State's "well-regulated" militia, the Roberts Court has become "destructive" of the first of the "unalienable Rights" listed in our nation's Declaration of Independence --- the right to "Life"!

Early last month, for example, CBS published a jaw-dropping U.S. statistic, citing "26 mass shootings in the first five days of July."

Yet, it is the dark and oppressive nature of the immensely unpopular decisions handed down by six unelected "radicals in robes", that, ironically, may help to facilitate a new dawn. The bright side of their decisions can be found in an incensed electorate, whose approval of the Court, as presently constituted, has plunged to a dismal 29%.

Democracy, as the late British MP Tony Benn described it, is "more revolutionary than socialist ideas." It is the light that can drive out the darkness.

The very existence of public revulsion towards the dark turn by the Court in recent years, such as overturning abortion rights and much more, make a 2024 Blue Tsunami possible. If the source of the darkness lies in the decisions of a corrupt and radicalized Supreme Court, then Democrats must convey a clear and coherent message that a vote for their candidates will serve to restore the light...including with reform of the Court itself...

If there is anyone more uniquely qualified than to discuss to discuss several issues of note on today's BradCast, I don't know who it could possibly be.

But FIRST UP, President Biden released a video today titled "Freedom", officially declaring his intention to run for a second term in 2024. The announcement comes four years to the day after releasing his video declaring his successful 2020 run. He faces long-shot Democratic primary challenges, so far, from vaccine opponent Robert F. Kennedy Jr., and self-help author/spiritual guru Marianne Williamson, who also ran in 2020 but dropped out before primary voting began.

We share Biden's video today and discuss the challenges he will be facing, which mostly include his age and health, according to many Democratic and other voters who say they'd prefer someone younger. Recent polling, however, shows that most of those voters will likely support Biden if he becomes the party's nominee.

The RNC and their most likely (for now) 2024 GOP nominee, Donald Trump, responded somewhat predictably with apocalyptic statements and AI video renderings of a dystopian nation wracked by disaster under a second Biden term, ironically describing Biden, ironically enough. as "out-of-touch". The disgraced former President, as recent polling reveals, will likely be the easiest nominee for Biden to defeat.

NEXT UP, since it's a day that ends in "y", we have yet another revelation of corruption by Clarence Thomas, almost certainly the most corrupt Supreme Court Justice in U.S. history. Bloomberg News and CNN report today that, despite previous claims to the contrary by both men, Thomas did, in fact, sit on a case at the high court in which Harlan Crow --- billionaire GOP megadonor and longtime giver of lavish worldwide travel and luxury vacations that went unlawfully undisclosed for decades by Thomas --- had business before SCOTUS in the 2000's. Thomas failed to recuse himself from the case involving the company of his "personal friend".

We're joined today to discuss the seemingly endless decades of both unethical and unlawful corruption by Thomas (and his corrupt, far-right activist wife Ginni), by LISA GRAVES. She previously served as Deputy Asst. Attorney General at the U.S. Justice Department, Chief Counsel for nominations in the US Senate, and as a Deputy Chief of the Article III Judges Division for the U.S. court system. Graves is now a muckraking political researcher and founder of Truth North Research. She has been exposing massive corruption of our electoral system by folks like Thomas, Crow, the Koch Brothers, wealthy rightwing federal court operative Leonard Leo and many others for years.

That means we've got a lot to discuss with Graves today, including Thomas' long history of corruption and failure to disclose stuff like his wife's annual salary for about twenty years from the rightwing Heritage Foundation back in 2011, and the undisclosed sponsorship of Leo and the group Citizens United that helped him win his controversial nomination to SCOTUS back in 1991. (That was well before Thomas failed to recuse himself from the infamous 2010 Citizens United case.)

"This new revelation is really important because it does show that there were cases, at least one case [at the Supreme Court] that directly affected Harlan Crow's company," Graves explains today. "But I think that's just the tip of the iceberg. Because the reality is that you have a number of instances that have been documented by the press where Clarence Thomas has failed to disclose to the American people his financial ties to Harlan Crow, who also has ties to Leonard Leo, who has been the architect of moving the Court to the far right. Including the fact that Leo cut his teeth trying to get Clarence Thomas confirmed in the first place. So these are deep and long relationships."

It's not only Thomas on the High Court who has recently been revealed as playing fast and loose with ethics rules and laws. Today, Politico reports that Justice Neil Gorsuch sold a nearly 3,000-square foot log home and a 40-acre tract of land in Colorado for nearly $2 million to the top executive of one of the nation's largest law firms just days after being nominated by Trump to SCOTUS in 2017. While Gorsuch disclosed the property sale, he failed to identify the purchaser on his disclosure forms, leaving that box blank. Since then, the firm has been involved in at least 22 cases before the Court.

And it's not only corrupt Republican appointees to the High Court. CNN recently unearthed interviews by a Christian talk radio outlet with far-right U.S. District Court Judge Matthew Kacsmaryk, the corrupt judge who banned the popular abortion pill, mifepristone, earlier this month. During the interviews he describes his opinion that being gay is "a lifestyle" and criticizes both "no-fault divorce" and "permissive policies on contraception." He failed to disclose those interviews during his 2017 confirmation process.

Perhaps more disturbingly, Washington Post recently reported what would appear to be out and out fraud by the controversial judge. He not only failed to disclose a law review article he authored, in which he criticized President Obama's protections of transgender people and those seeking abortions, but, after being nominated by Trump, he instructed the journal to remove his name as author and substitute the names of two junior colleagues at his activist law firm who appear to have had nothing to do with the article.

Graves charges Kacsmaryk should be held to account by the DoJ for possible prosecution under Section 1001 of Title 18 of the US Code, which deals with giving materially false statements to Congress. "You have someone who affirmatively, deceptively, actively, willfully hid from the Senate that he wrote this article. He did so purposely. He did so knowing he was about to be nominated for this position. He affirmatively deceived Congress," she tells me.

"Kacsmaryk deceived Congress in his quest to become a judge, and then he had no restraint on his efforts to impose those various same types of personal anti-abortion views in a case where he has now injected himself in overturning nearly a quarter century of law in defiance of long-standing Supreme Court precedence."

Given the massive corruption of both the federal bench and Republicans in Congress, what, if anything can be done about any of it? We discuss what can and should be done by Congress, by the U.S. Judicial Conference which oversees operations of the federal courts, and by the U.S. Department of Justice, all of whom Graves has worked with in various capacities over the years...

It could have been much worse. That seems to be the message from our guest on today's BradCast after yesterday's oral argument in the U.S. Supreme Court case that could blow up everything we know about American elections, including some 233 years of otherwise settled election laws in all 50 states. We'll hope he's right. [Audio link to full show follows this summary.]

But, first up today, some less ambiguous good news to kick things off. WNBA star Brittney Griner is on her way home from Russia, where she has been held as a prisoner for at least 8 months after authorities found less than a gram of cannabis oil in a vape cartridge in her suitcase. Her release comes as a swap for a notorious Russian arms dealer, but fails to include the release of Paul Whelan, an American imprisoned by Russia for nearly four years, who many hoped would also be included in the trade.

Griner's wife joined President Biden at the White House on Thursday to announce the good news, while urging the release of Whelan, whose brother praised the Administration for making "the right decision to bring Ms. Griner home, and to make the deal that was possible, rather than waiting for one that wasn’t going to happen."

Also on Thursday, more good news in D.C. as the U.S. House approved the Respect for Marriage Act (RFMA) with all Democrats voting in favor with almost 40 Republicans. Shamefully, 169 Republicans voted against recognizing the marriage rights of same-sex and interracial couples. The bill was passed by the U.S. Senate last week (also by all Democrats and opposed by the majority of Republicans) and now heads to the President's desk for his signature. Even though 2015's Obergefell ruling at the U.S. Supreme Court made marriage equality the law of the land in all 50 states, federal lawmakers determined a statutory backstop was necessary after far-right activist Justice Clarence Thomas called for reconsidering the Obergefell decision when he voted with the Court's corrupted rightwing majority to overturn Roe v. Wade earlier this year.

We're joined today by Slate's longtime legal journalist and SCOTUS expert MARK JOSEPH STERN. Last month, he responded to progressive critics of the RFMA who felt it should have gone farther to require all states to license same-sex marriages --- as Obergefell currently does --- rather than simply mandating that states legally recognize such marriages. Today, Stern breaks down his legal argument for why he believes those critics are wrong about the new, landmark federal statute and notes that, "as a progressive in a same-sex marriage, I feel like I have some skin in the game here."

But, our initial reason for booking Stern today was to discuss Moore v. Harper, the ridiculous --- if wildly dangerous --- case heard by the Supremes on Wednesday. As discussed on yesterday's show with FairVote's David Daley, who attended the oral argument, if a majority on the Court agrees with North Carolina Republican petitioners, the fallout for American elections from Moore will be "seismic".

The case argues that a fringe, so-called "Independent State Legislature" theory found in the U.S. Constitution's Elections Clause, means that only State Legislatures may craft specific state rules and laws for federal elections and may not be overruled or even reviewed by gubernatorial vetoes or state court review to ensure those laws meet requirements of state Constitutions. Even voter-approved ballot initiatives would be considered unlawful.

It would, in the case of Moore, allow North Carolina Republicans who control the gerrymandered majority in the evenly-divided state Legislature to gerrymander U.S. House districts however they like, even after the state Supreme Court determined their partisan gerrymander violated the state Constitution. By the same theory, a majority opinion in favor of the NC GOP, by the rigged 6 to 3 SCOTUS, could also allow state Legislatures to simply choose whichever Presidential Electors they preferred, even when voters voted otherwise. Yes, it's just that insane and, arguably, should never have even been heard at the High Court.

The good news today, is that, after yesterday's hearing --- when the "Court's most conservative justices got outplayed," as Stern reported at Slate --- he now believes the worst-case scenario is far less inevitable. "Those of us who’ve been ringing the alarm over this dangerous theory --- and who've been disgusted by the campaign to drag it from the far-right fringe all the way to the Supreme Court --- can take solace that these capable lawyers exposed [the Independent State Legislature theory] as an utter fraud," he wrote last night.

"Even though we have a ton of rules in every single state's Constitution that have been enforced for 230+ years, this theory says that all of those are invalid, we've been doing it wrong the whole time," Stern told me today, adding that he "heard maybe two votes for that position" during oral argument on Wednesday.

"But then, once you get into the more compromise positions, it gets harder to gauge," he warns. "I don't think the Court is going to totally cut out state Constitutions and state statutes from federal elections. I don't think that the Court is going to go as far as Republicans want. I think that there's a chance that the Court could issue a decision that is bad but not catastrophic, that essentially says that, as a general principle, state courts can regulate elections, but that federal courts get to double-check their work and decide if they got it wrong."

"But we have to be, when this decision comes down, really vigilant about drawing any conclusions before we figure out exactly where they land." If Federal courts can review state court rulings that are regarded as "egregious," Stern says he could live with that. But if they allow state courts only "mild deference," he explains, "that's no good, because that is really not how we do things in this country. State courts have the final say over the meaning of state law in almost all circumstances. And if we take that away, then it is just empowering this conservative super-majority on SCOTUS to decide all these cases in favor of Republicans."

Given the ridiculous basis for the Independent State Legislature theory --- that we've been doing it all wrong for more than 230 years since the nation's founding, but nobody noticed until now --- there would be hundreds of election laws in all 50 states that could then be challenged in federal courts. It's all somewhat ironic given that this fringe interpretation of the Elections Clause was, itself, built on "a fraudulent document that purported to be an account of the Constitutional Convention" that, as early as the 1800's, was described as "fake" by James Madison, "who actually did write the definitive account of the Constitutional Convention," notes Stern.

Much more on all of that today and, before he leaves, a quick explanation of how "stupid" the case heard earlier this week by SCOTUS regarding a web designer in Colorado who refuses to design a website for same-sex marriages actually is. Hint: She "has never been asked by any couple, gay or straight, to make a wedding website for them. Yet she sued before anyone could ask her, and argued that Colorado's civil rights law was infringing on her freedom of speech."

Finally, we're joined by Desi Doyen for our latest Green News Report with both good and bad news, as per usual, when news broke late from CNN that, according to their sources, the U.S. Dept. of Justice has asked a federal judge to hold Donald Trump in contempt for failing to comply with a subpoena ordering him over the summer to turn over classified records he stolen upon leaving the White House.

It turns out that it may have been an even better day today than we originally thought...

Senate confirmation hearings begin for Ketanji Brown Jackson; Russia's ground war on Ukraine nears 'stalemate' as deadly air bombardment continues; Callers ring in on Biden's response to Russia's aggression...

We're becoming too used to it by now, but it was another jarring start to an already busy week on The BradCast today, as we lurch once again between domestic politics and the hope for peace to somehow emerge in Ukraine. Among the stories covered on our program today...

  • 73-year old judicial activist and corrupt dark money champion Justice Clarence Thomas was hospitalized on Friday with an "infection" and "flu-like symptoms". The Supreme Court waited two days before announcing his hospitalization on Sunday night, claiming that his antibiotic treatment was working and that Thomas should be out of the hospital in a few days. They also report he plans to participate in this week's cases, even though he'll not be present for oral argument. But, since when did hearing the facts of a case ever have any sway on the opinions of the wildly corrupt Thomas? (Or his equally corrupt wife?)
  • After four hours of opening statements and opining by the 22 members of the U.S. Senate Judiciary Committee, Judge Ketanji Brown Jackson, President Biden's nominee to fill the seat on the U.S. Supreme Court being vacated by Justice Stephen Breyer this summer, offered her own brief opening remarks. Jackson, vowing to carry out her new role on SCOTUS with transparency and "without fear or favor", would be the first African-American woman on the Court, as well as the first one to have served as a public defender. Unlike Justice Thomas --- and the rest of the Republican appointees on the GOP's packed and stolen majority --- her nomination is, happily, not the culmination of years of dark money spent by activist political hustlers. We share Jackson's opening statement today, just in case you missed it.
  • Next, it's an update on the latest in Russia's horrific war on Ukraine, which is really devolving into two separate wars. One, a ground war which is grinding down to a stalemate for both sides, with Ukraine even winning back a bit of ground in recent days. The other, an aerial bombardment campaign which Russia is brutally winning with long-range missiles launched from within their own borders and an increasing number of criminal attacks by their air force on Ukraine's battered and besieged --- but still determined --- civilian population. There are also new concerns about radiation levels in the 1,000 square mile Exclusion Zone surrounding the cite of the 1986 nuclear disaster at Chernobyl, some 60 miles from the Ukrainian capital. We discuss.
  • Then, new polling finds that Biden's actions in response to Ukraine --- rallying sanctions against Russia by the West, defensive armaments given to Ukraine, otherwise keeping U.S. military troops out of the fighting --- are wildly popular among huge majorities of Americans, both Democrats and Republicans alike. So, why are Biden's approval ratings still so low? So far, there is no indication of a rally-around-the-flag effect that would normally be expected during wars and disasters (and this is both). If there's one guy you really don't want vowing to dog you, it may be Rhode Island's Democratic Sen. Sheldon Whitehouse, easily one of the most persistent Senators in the upper chamber. If you're Trump's FBI Director or, especially, Supreme Court Justice Brett Kavanaugh, that's probably not good news. But it's just one of the stories covered on today's BradCast. [Audio link to full show is posted below this summary.]

Here's a quick summary of many more of them...

  • No, the disappearance of 350,000 votes from CNN's California Recall Election Night live ticker is not proof that it was stolen. Especially when there is a perfectly plausible (and checkable) explanation for it.
  • After the well-publicized testimony of U.S. gymnasts in the Senate Judiciary Committee on Wednesday, regarding the FBI's years-long failure to adequately investigate hundreds of allegations of sexual assault against now-convicted team physician Larry Nassar, Sen. Sheldon Whitehouse had a few related questions for Trump-appointed FBI Director Christopher Wray about another similarly flubbed investigation --- perhaps more accurately described as a Trump Administration/FBI cover-up --- regarding serious allegations of sexual assault against a young girl by a now sitting Supreme Court Justice. After alleged sexual assaulter Brett Kavanaugh, Donald Trump's second nominee to be packed onto the U.S. Supreme Court by Republicans, Whitehouse vowed to Christine Blasey Ford, Kavanaugh's main accuser, that he would get to the bottom of the FBI's clearly whitewashed pre-confirmation "background check" probe of Kavanaugh. It's three years later and Whitehouse has not forgotten. As he explained while pressing Wray during Wednesday's hearing, he has been waiting all of that time for answers and documents from the FBI. He made clear to Wray that he will not stop until he gets them. As evidenced by his nearly ten years of weekly "Time to Wake Up" climate addresses on the floor of the U.S. Senate, the Rhode Island Senator does not back down easily.
  • The COVID pandemic continues to worsen in the U.S., with no end in sight. That, of course, thanks to the voluntarily unvaccinated. Hospitals across the entire state of Idaho are now rationing care under "critical care standards" that allow them to try and save the lives of those most likely to survive, while offering comfort and best wishes to those unlikely to make it. Similar "death panels" are now in place or "imminent" in other states with similarly low vaccination rates, mostly run by Trumpy, denialist, Republican Governors. While the vast majority of those paying the worst price are the unvaccinated, their selfishness comes at an unspeakable to cost to many who are vaccinated, as we detail today. Those include the Alabama man who died last week in Mississippi after his Trump Country Alabama hospital had to call 43 hospitals before finding one, 200 miles away, that could give him care; the Illinois woman with a comorbidity who died after becoming infected with a breakthrough COVID case after visiting a family friend in Mississippi whose husband had died in the state with one of the lowest vaccine uptake rates; the man in Hawaii who remains in excruciating pain today, because he can't get a non-emergency operation for kidney stones due to lack of oxygen supply for all but COVID patients on all of the islands. Yes, the voluntarily (and selfishly) unvaccinated continue to bring pain, harm, sadness and death to far more people than just themselves...which is already bad enough.
  • Finally, Desi Doyen joins us for our latest Green News Report, featuring news on Nicholas, the latest storm to make landfall in our latest record hurricane season, exacerbating recovery in Louisiana, where folks are just beginning to recover from Hurricane Ida the week before last; Biden's continuing push for his landmark climate infrastructure plan; States now beginning to hold plastic producers to account for their pollution; and Vermont stepping up as the latest state to sue fossil fuel giants for decades of deadly lies about climate change...

Guest: Migration Policy Institute's Sarah Pierce; Also: More 'Clean up on Aisle 45' news on the FBI, Kavanaugh and the Vindman family...

We've got quite a bit of 'Clean up on Aisle 45' news on today's BradCast, particularly at the U.S. southern border. [Audio link to today's full show is posted below this summary.]

But first, a few noteworthy 'Clean up" news items. Rhode Island's Democratic Sen. Sheldon has written a letter to Joe Biden's newly confirmed Attorney General Merrick Garland, requesting an investigation into what he describes as the "fake" investigation the FBI apparently made into sexual assault allegations against Brett Kavanaugh before his confirmation to a lifetime appointment as a U.S. Supreme Court Justice. That confirmation, by the way, happened only thanks to Senate Republicans willingness to do away with the filibuster on Supreme Court Justices. Of course, it wasn't only sexual assault allegations against Kavanaugh that deserved a real probe by the FBI. There is still the matter of what happened to the $60,000 to $200,000 worth of credit card debt that Kavanaugh carried the year before his nomination, which magically disappeared by the time he was tapped by Trump to help pack the stolen Republican majority on the U.S. Supreme Court.

Also today, Army Lt. Col Yevgeny Vindman --- twin brother of Lt. Col. Alexander Vindman, who testified against Donald Trump during his first impeachment --- will now be promoted to Colonel under the Biden Administration. That, despite a revenge campaign leveled against the Vindman family by the former disgraced President, which resulted in some negative job reviews for Yevgeny during his time as deputy legal advisor on Trump's National Security Council. Shortly after the impeachment, Trump fired both men from their NSC posts and Yevgeny filed a whistleblower complaint over the retaliation with the Pentagon's Inspector General. The IG's report has not yet been released.

Then, for the biggest 'Clean up on Aisle 45 ' news of the day, we move down to the U.S. Southern Border, where Republicans have been taking a cue from the former disgraced President to claim a massive "Biden border crisis!" is current under way, not two months into the new President's tenure. Sadly, corporate media have taken that cue as well. As they do.

House minority leader Kevin McCarthy (R-CA) traveled to the border this week and, among other apparent lies, claimed that terrorists from Yemen, Iran and Turkey were "rushing" the border "all at once." While that is almost certainly untrue, there has been an increase over the past two months in unaccompanied children, seeking asylum at the border, after making the arduous journey from beleaguered Central American "Northern Triangle" countries of El Salvador, Guatemala and Honduras. Thanks to the influx of unaccompanied kids, a hollowed out asylum system left behind by the previous administration, along with pandemic social distancing requirements, Custom and Border Patrol (CBP) facilities meant to house children before they are handed over to the Dept. of Health and Human Services to find sponsored shelters are running out of space. The influx is also leading to many being held in the CBP facilities beyond the 72-hour legal limit, even as the Biden Administration has, for the time being, left many of Trump's policies in place, expelling families and single adults fleeing from gang violence, climate change and poverty in their troubled nations.

So, what is actually going on at the border right now? Is it really a crisis? And how much is the Biden Administration, not even two full months on the job, to blame? We're joined today by SARAH PIERCE, immigration attorney and Policy Analyst for the U.S. Immigration Policy Program at the Migration Policy Institute to help us separate fact from breathless, GOP/media-inflated fiction.

"I think there is a significant challenge at the southern border," she explains. "I don't think we can call it a crisis yet. But we could certainly be moving in the direction of a crisis.  We had a really fast acceleration in the number of unaccompanied child migrants arriving at the southern border between January and February. But we still haven't reached record numbers of children arriving at the southern border. We saw records during 2019 and 2014 that we haven't yet broken."

"But our facilities are limited because of the pandemic," she continues, "and so that is making what would already be a challenge even more difficult as the administration scrambles to bring beds back online, and move children out of Border Patrol custody as quickly as they possibly can."

Pierce explains how bad the situation currently is; whether she believes the Biden Administration is taking the appropriate measures to handle it; whether GOP claims about terrorists rushing the border or becoming "super-spreader caravans" are in any way true; and whether the situation can be handled at all without Congressional action (which seems a long shot while the filibuster remains in place, with Republicans seeking distraction from their failure to vote for the COVID relief bill and relying on alarmist rhetoric about the border to try and hold on to their base).

The Biden Administration "inherited a really, really big challenge and a system that was just gutted by the prior administration. So, whether or not they'll be able to do this all, while also dealing with what could very well be a crisis in the near future at the southern border, is a really big question."

She also offers, among other direct answers, a response to my question about the oft-repeated spurious claim that Trump's infamous family separation policy that resulted in those horrific "kids in cages" photographs was was actually begun by the Obama Administration. The answer will probably not shock you.

On today's BradCast: It's full speed ahead for Senate Republicans' desperate attempt to further pack the U.S. Supreme Court while they still have the chance. And it's anything but feel speed for voters forced to wait in hours-long Early Voting lines in Georgia. [Audio link to show follows below.]

The Peach State could very well turn "blue" this year, according to Nate Silver at Five Thirty Eight, in both the Presidential election and not one, but two U.S. Senate races there this year. But voters will have to work like hell to make that happen. The Atlanta Journal Constitution reports today that the state's new voting check-in computers --- needed to operate the state's new unverifiable touchscreen voting machines --- appear to be the main cause of intolerably long lines for voters since Early Voting began on Monday. Some voters have reportedly left without voting, others waited as long as 12 hours to cast their votes. Now that AJC has identified the check-in computers to be a main bottleneck, Georgia's terrible Secretary of State Brad Raffensperger --- who previously attributed the hours-long lines to "voter enthusiasm" --- has apparently told the private software vendor responsible for those check-in computers at Voting Centers to increase network bandwidth to speed up the process. Early reports in Atlanta suggest the expanded bandwidth may be helping to speed things up, but we'll see.

In the meantime, as voters in Georgia must now navigate at least 4 different computer systems (programmed by private companies) to cast their one vote, the FBI and Cybersecurity and Infrastructure Security Agency (CISA), a division of the Dept. of Homeland Security, are warning they are aware of "some instances" in which malicious actors (most likely foreign, they suggest) have obtained "unauthorized access to elections support systems." They quickly note, however, they have "no evidence to date that integrity of elections data has been compromised." Feel better?

Our guest today, Slate's great legal reporter, MARK JOSEPH STERN, is definitely not feeling better after a week of hearings in the U.S. Senate Judiciary Committee, meant to further pack the Republicans' already-stolen Supreme Court with Amy Coney Barrett before Election Day. The hearings revealed little or nothing about Donald Trump's third far-right nominee to the highest court in the land, Stern reports. "It was a terrible week. It was one of the worst on record," he tells me, describing the proceedings as a "deranged power grab" and the nominee as establishing a new low for such hearings.

"Amy Coney Barrett has established a new rule for Supreme Court confirmations, which is that the nominee doesn't just have to be kind of evasive or squirrelly. The nominee can literally say nothing of substance and simply announce a rule at the outset that she won't say anything of substance, and then just swat down questions that try to get her to say anything meaningful."

Barrett refused to (or couldn't?) answer even simple, non-political questions and matters of basic federal law, such as whether it is illegal to intimidate voters at the polls. (It is.) "I don't understand why we all had to go through this entire experience. It was a psychic wound, it was demeaning to all of us. She won't even say whether this federal law exists, whether it is real," Stern observes. "Will she acknowledge that gravity exists?"

Among the many related points we discuss today...

  • While Barrett allies herself with the great myth of the late Justice Antonin Scalia's so-called "Constitutional originalism," is she in fact "a legal lightweight"?;
  • Do Republicans even care about her "remarkable paucity of experience"? (Stern charges: "I don't think that she's necessarily being picked on the merits of her own scholarship.");
  • If SCOTUS nominees are now going to refuse to answer any question on virtually anything, have these hearings and the Advise and Consent clause itself become little more than a meaningless joke at this point?;
  • Is Barrett's bizarre assertion that Roe v. Wade is not a "super-precedent" --- apparently meaning a ruling that cannot be overturned --- actually a real legal concept in any way, shape or form?;
  • What, if anything, was the impact of Sen. Sheldon Whitehouse's stunning thirty-minute detailing on Tuesday (video here, transcript here) of the decades-long, $250 million, rightwing dark-money court-packing conspiracy? And did it help Americans appreciate the insidious scam that wealthy rightwingers have been running with the GOP for years now to capture our entire federal judicial system? ("Amy Coney Barrett didn't just magically appear in that seat. She didn't just find herself nominated to the Supreme Court. She has been elevated, propped up, by this massive dark money machine," Stern notes.);
  • Did Democrats do all that they could to highlight the outrage of how Republicans are undermining the very legitimacy of our federal courts, even as Dems have little or no way to stop it right now?;
  • Will Joe Biden and Democrats in Congress have the courage to do the right thing for justice and the American people by expanding the Supreme Court to save cherished American rights and the court system itself IF they are able to win the White House and Senate majority this November?;
  • And, why the hell was ranking Democratic Sen. Diane Feinstein (D-CA) hugging the Judiciary Committee Chair, Sen. Lindsey Graham (maskless!), at the end of today's final day of hearings?

All of those questions asked and mostly answered on today's lively --- if maddening --- program...

We begin today's BradCast with some good news from the courts, for a change, regarding voting rights in several states today, as the GOP's trench warfare to suppress the vote wherever they can continues, now 20 days out from Election Day. Then, it's on to the $250 million dark-money scheme that a closely interconnected conspiracy of mostly low-profile rightwing groups have orchestrated with Republicans in the U.S. Senate to pack the federal courts --- specifically the U.S. Supreme Court --- and push specific cases to them that are similarly rigged by "orchestrated amicus flotillas" to help achieve very specific results that just happen to benefit all of the well-moneyed interests involved in the well-orchestrated and well-funded conspiracy that made it all happen. [Audio link to show follows below.]

First, we go light before we go "dark". In Virginia, where a severed fiber optic cable knocked out online voter registration for the entire state on Tuesday, the last day to do so this year, a federal judge has granted an extra 48 hours for residents in the Commonwealth to sign up. You've now got until 11:59pm Thursday, Virginians! Get busy!

In Texas, where desperate Republicans are challenging absolutely every new measure instituted to make voting easier and safer amid the pandemic --- even going so far as to sue their own Republican Governor for extending early voting by one week --- a state court of appeals has tossed a case filed Monday by the GOP to block Harris County's plan for "drive-thru" voting. The case was filed just one day before Early Voting began in the state yesterday. Some 11,000 votes were reportedly cast from vehicles via curbside voting centers in Harris County's Houston on Tuesday, as implemented by the County's new, 34-year old County Clerk, Chris Hollins. Dem-leaning Houston has a population of 4.7 million and a geographical area larger than the state of Rhode Island. It is the nation's third most populous voting jurisdiction. A total of 10 drive-thru sites are planned for use during Early Voting. The court win comes as another too-rare victory for voters in the Lone Star State, where the GOP is desperately trying to block the demographic writing on the wall against them.

And, in Alaska, the state Supreme Court has upheld a lower court ruling that nullifies the state's witness signature requirement for mail-in ballots during the pandemic. The suit was brought by Alaskan Native Americans and voting rights groups who successfully argued that the requirement "impermissibly burdens the right to vote" while many Alaskans are quarantining alone during the crisis. The state's top election official, Republican Lt. Gov. Kevin Meyer, had appealed the lower court ruling all the way to the state Supremes...and has now lost. But voters have won.

Then, we head into the "darkness" following Sen. Sheldon Whitehouse (D-RI)'s remarkable, must watch revelations (transcript here) on Tuesday during the U.S. Senate Judiciary Committee's appalling and hypocritical push to ram through the confirmation of U.S. Supreme Court nominee Amy Coney Barrett before Election Day. In short, Whitehouse summarized the broad and insidious network of interconnected rightwing dark-money groups that select federal court judges for Republicans to nominate to the bench; quietly fund the PR campaigns to push for their confirmations; seek out specific cases to bring to those same judges for a desired outcome that enriches their well-moneyed interests; and then bury the Supreme Court with amicus briefs spelling out that desired outcome.

Whitehouse details the remarkable success that the groups have seen in recent years in not only packing the federal judiciary, including the Supreme Court, but in an 80 to 0 record of wins at the high court with partisan 5 to 4 victories in each and every case.

Teeing off the Senate Republicans' eagerness to push through Barrett's confirmation closer to any Presidential election in U.S. history --- despite vows from the party in 2016 that they would never support filling a Supreme Court seat during a Presidential election year until American voters have had a say in the matter --- Whitehouse observes near the beginning of his remarks that, in his "experience around politics, when you find hypocrisy in the daylight, look for power in the shadows."

Using charts and magic-markers to break down the sprawling case and evidence of the closely-allied, secretly-funded groups making up that "power in the shadows" --- from the Federalist Society (which promoted Barrett's nomination), to the so-called Judicial Crisis Network, to the Bradley Foundation to Donors Trust and the Koch Brothers --- the Rhode Island Senator neatly unfolds the very clear conspiracy that has successfully resulted in cases that benefit its dark-money funders to the tune of billions of dollars returned on their investments.

Much of Whitehouse's case cited evidence first revealed by the Center for Media and Democracy (CMD), a non-profit good government watchdog and research organization headed up for many years by LISA GRAVES, a former Deputy Asst. Attorney General at the U.S. Justice Department, a former Chief Counsel for nominations in the U.S. Senate, and a former Deputy Chief for the U.S. Court system. She still serves as President of the Board of Directors at CMD and is currently the Executive Director of True North Research.

With all of those qualifications, Graves is uniquely positioned to offer much more insight into Whitehouse's Tuesday revelations of the, yes, actual, decades-long GOP judicial conspiracy now in play; Barrett's qualifications for a lifetime appointment to highest court in the land; her performance during this week's confirmation hearings; and whether Democrats should expand not only the U.S. Supreme Court --- if they win both the Presidency and Senate majority in November --- but the lower federal courts as well.

Graves tells me that Whitehouse's remarks were "very, very important, because he was able to use this forum to shine a light on something that most Americans have no idea is going on, as part of this capture of our courts, which is really about changing our rights and doing it through judicial fiat." She explains that "that thirty minutes is really a class, a course, on understanding this puppet show that we're seeing with this nomination, of who is really calling the shots, and how this is happening."

She also offers a reaction to my own monologue from the top of yesterday's BradCast, in which I detailed the under-appreciated hypocrisy and judicial dishonesty of the late Justice Antonin Scalia, regarding his professed claims of "conservative" Constitutional "originalism" and "strict consructionism". Barrett worked hard during her opening statement on Monday to associate herself with Scalia's disingenuous judicial philosophy, citing the late rightwing extremist Justice, for whom she once clerked, as a model for own tenure as a federal jurist.

There is much ground to cover in all of the above with Graves, so I hope you'll tune in for this one!...

While it seemed impossible previously, Republicans in the U.S. Senate appear to have outdone their phony confirmation proceedings for Supreme Court Justice Brett Kavanaugh in late 2018, with their sham Impeachment "trial" of Donald John Trump. As we went to air for today's BradCast, the Senate was preparing to vote on whether witnesses would be blocked from a Senate Impeachment Trial for the first time in U.S. History. By the time we got off air, the shameful, dirty deed was done. [Audio link to full show is posted at end of article.]

The day of the fateful vote began with yet another explosive piece of breaking news from the New York Times, reporting that Trump's former National Security Advisor John Bolton's forthcoming book charges that "More than two months before he asked Ukraine’s president to investigate his political opponents" Trump directed Bolton "to help with his pressure campaign to extract damaging information on Democrats from Ukrainian officials, according to an unpublished manuscript by Mr. Bolton." Moreover, the paper reports, Bolton describes an Oval Office conversation on the matter in early May of 2019 "that included the acting White House chief of staff, Mick Mulvaney, the president’s personal lawyer Rudolph W. Giuliani and the White House counsel, Pat A. Cipollone, who is now leading the president’s impeachment defense."

Yes, that's right. The Trump attorney now leading his defense in the Senate trial, who has accused Democratic House Managers of "hiding the facts" in their arguments in favor of two Articles of Impeachment against Trump, is now allegedly a co-conspirator in the very plot that resulted in only the third impeachment of a U.S. President in history. Little wonder they'd prefer to have no witnesses testify.

Bolton has stated he would be willing to testify in the trial, as has Lev Parnas, a right-hand man to Rudy Giuliani, Trump's personal lawyer at the center of the scheme to pressure Ukraine to announce investigations of Joe Biden before Trump would agree to a White House meeting or release $391 million in military assistance to war torn Ukraine. On Friday morning, Parnas' attorney submitted a letter to Majority Leader Mitch McConnell, explaining his client's willingness to testify at the trial with relevant information that alleges Trump, Mulvaney, Vice President Mike Pence, Attorney General William Barr, Energy Secretary Rick Perry, Senator Lindsey Graham, Congressman Devon Nunes and many others worked on Trump's plot to force Ukraine to help him undermine the 2020 Presidential election. So, yes, as Gordon Sondland said weeks ago, "everyone was in the loop. So, yeah, no witnesses please and thanks.

Despite all of that astonishing news --- and all that has come before it --- by the end of today's program, Republicans in the U.S. Senate, by a vote of 51 to 49, would vote to block subpoenas for all witnesses and documents in the Impeachment Trial, for the first time in U.S. history. Only two Republican Senators, Susan Collins of Maine and Mitt Romney of Utah, were willing to cross the aisle to vote with all 47 Democrats to call for witnesses. We discuss the pathetic excuses offered by supposedly "moderate" GOP Senators Lisa Murkowski of Alaska and the retiring Lamar Alexander of Tennessee for voting against witnesses. That vote now paves the way for an acquittal vote for the President. One of the few remaining questions by show's end was when that vote may come. As of this hour, it may now happen next Wednesday, the day after the President's State of the Union Address on Tuesday night --- but we'll see.

Another major question of note is what price, if any, Republicans may ultimately pay for what Senate Minority Leader Chuck Schumer described after the vote as the GOP's act of "perfidy...where the Senate did not live up to its responsibilities, turned away from truth, and went along with a sham trial." With "no witnesses and no documents", he described the proceedings as "not a real trial" and "a tragedy on a grand scale."

We're joined today by DAVID FARIS, Associate Professor of Political Science at Roosevelt University, author of It's Time to Fight Dirty, to discuss today's historic events, and his two most recent columns at The Week, where he is a regular contributor. In one, he finds fault with the House Democrats' strategy of sending over the Articles to the Senate too quickly and, in the other, with McConnell's strategy of blocking witnesses. Faris describes the latter as a "rare blunder" for the Republican leader and explains why. I disagree with him on the latter, as he and I discuss what all of this may now mean for Republicans, for Democrats, for the President and for the voters who will kick off the 2020 Presidential Election in Iowa this coming Monday.

"I don't know that there's anybody who could look at the Senate this week and say that a fair trial happened here," Faris tells me. "What McConnell did was he handed Democrats a bat to beat them with for the next eleven months about the legitimacy of the trial in the Senate."

It may not be our most hilarious show of all time, but I think it's a very important one and includes more than a few righteous rants. [Audio link to full show is at end of article.]...

Among the stories covered on today's BradCast...

  • The New York Times finally figures out, almost a week later, that they may have been duped by Trump Attorney General William Barr's 4-page summary of Special Counsel Robert Mueller's long-awaited report, as the incurious "paper of record" confirms the full report from Mueller runs at least 300 pages. Nonetheless, Trump and his cult-member Republicans in Congress are running with the Times' original false and/or misleading assertions published the day after Barr's deceptive summary was released on Sunday. For example, the Times' top-of-page, ALL-CAPS screaming headline "MUELLER FINDS NO TRUMP-RUSSIA CONSPIRACY" and "A Cloud Over Trump's Presidency is Lifted".

    Of course, we still have no idea how many pages are in Mueller's confidential report delivered to Trump appointee Barr last Friday, or what it actually says about the two-year probe into alleged Russian interference in the 2016 election, the Trump Campaign's potential cooperation with them, or Trump's apparent attempts to obstruct the probe. But the summary compiled in less than 48 hours by Barr and then inaccurately reported by many to have somehow "exonerated" Trump, after being written by a man appointed to the job specifically because of his expressed opposition to the Special Counsel, should have been viewed much more skeptically by the Times and many others in the corporate media --- as we've been pointing out since Monday.
  • Among the fall-out from the Times' (and others') terrible and irresponsible coverage on all of this, GOP members of the House Intelligence Committee on Thursday demanded Rep. Adam Schiff (D-CA) step down as Chair and Trump is demanding his resignation from Congress. Schiff, however, is (appropriately) having none of it;
  • Speaking of not-particularly-funny behavior from Congressional Republicans, Majority Leader Mitch McConnell (R-KY) held a sham stunt vote earlier this week on the Green New Deal resolution [PDF] proposed by Sen. Ed Markey (D-MA) in the Senate and Rep. Alexandria Ocasio-Cortez (D-NY) in the House. Their landmark resolution calls for a wartime-like effort to move the U.S. economy from fossil fuels to zero-carbon energy over a decade, while creating millions of jobs in the clean energy sector and supporting those in legacy industries like coal mining to ensure new jobs and protection of their pensions from bankrupt, predator coal companies. During "debate" for McConnell's mock GND vote --- on an issue which would greatly help many coal mining constituents in Kentucky and Utah alike --- Sen. Mike Lee (R-UT) offered an embarrassingly unfunny speech that mocked the resolution, dismissed climate change as a concern, argued the Green New Deal is somehow "part of the problem" and that the real solution to deadly and ever-more costly global warming was "churches" and "babies";
  • Sen. Sheldon Whitehouse (D-RI) was not amused, as his own small coastal state directly faces a very serious threat posed from global-warming fueled rising sea levels which threaten to turn Rhode Island "into an archipelago" in coming years. "As a small state, we don't have a lot to give back to the ocean," Whitehouse rails on the Senate floor. "This is deadly serious for us."
  • But, if you think Whitehouse sounded angry, wait until you hear Ocasio-Cortez' response to the belittling of climate change concerns from Republicans in the House during an epic rant in the U.S. House Financial Services Committee, after Rep Sean Duffy (R-WI) mocked the GND as "an elitist fantasy";
  • Underscoring how NOT funny all of this is, a recent, heart-breaking special report from AP detailed how Trump, McConnell and the coal industry have conspired to allow a small tax on coal to expire, which, since the 1970s, has helped to cover the extraordinary healthcare expenses of miners suffering from deadly Black Lung Disease, as well as support for their widows. A new Black Lung epidemic has been striking younger and younger coal miners in recent years, and Republicans, including Trump, allowed the tax that funds the Black Lung Disability Trust Fund to expire during the Government shutdown at the beginning of the year.

    That, despite promises from McConnell (who represents the coal state of Kentucky) and from Trump (who has used miners endlessly as props during political rallies, while claiming to "love" them) to ensure the crucial Trust Fund doesn't go broke. Instead, both men have broken their promise and appear to be siding instead with the coal industry owners who have donated millions to them, and do not wish to see the life-saving and now-lapsed tax renewed. All of this, of course, on the same week that Trump reversed positions to support killing the Affordable Care Act entirely, while claiming "Republicans will soon be known as the party of health care";
