After more than twenty years of rolling back corruption and bribery statutes, is it any wonder, as our guest on today's BradCast observed in his latest op-ed, that the U.S. Supreme Court is now "blind to its own corruption"?

BUT FIRST, Florida Governor Ron DeSantis is announcing his 2024 Presidential run today, and corporate media outlets are focusing on his horse race with the disgraced former President. We mark the day, however, by focusing on several of the latest victims of DeSantis' Big Government weaponization against people of color and the LGBTQ+ community. That, by a guy whose 2022 re-election slogan in Florida was, laughably, "Freedom Lives Here".

DeSantis deserves credit for leading the way for other, similarly gerrymandered and GOP-controlled states which have begun to adopt many of the same, hateful, Big Government "cancel culture" statutes that, in Florida, have resulted in banned books, muzzled teachers, lost rights, vile threats against those who support freedom and travel warnings issued for those visiting the Sunshine State.

Today, the effort is playing out in terroristic threats against Target employees; an investigation of a Florida grade school teacher for showing an animated Disney film to her class; and the removal of The Hill We Climb --- a poem by Amanda Gorman which she read at Joe Biden's 2021 inauguration --- from a grade school library. That's just a sampling of some of the latest victims of DeSantis' cruel agenda during his tenure as Governor.

As California's Democratic Gov. Gavin Newsom tweeted in response to Target's removal of items from its Pride Month collection under threats from the MAGA right, "Wake up America. This doesn’t stop here. You’re black? You’re Asian? You’re Jewish? You’re a woman? You’re next."

THEN, it's back to the seemingly never-ending, decades-long corruption of U.S. Supreme Court Justice Clarence Thomas and some similar, recently revealed corruption by Justice Neil Gorsuch and even Chief Justice John Roberts who, by and large, refuses to do anything about any of it.

There's an explanation for that, argues RANDALL D. ELIASON, George Washington University Law School professor and former chief of the fraud and public corruption section at the U.S. Attorney’s Office in D.C.

"Over more than two decades, the Supreme Court has gutted laws aimed at fighting corruption and at limiting the ability of the powerful to enrich public officials in a position to advance their interests. As a result, today wealthy individuals and corporations may buy political access and influence with little fear of legal consequences, either for them or for the beneficiaries of their largess," Eliason argued in a New York Times op-ed over the weekend, adding: "No wonder Justice Thomas apparently thought his behavior was no big deal."

Today, Eliason tells me, "the Court itself has contributed to a legal environment over the last twenty years, where, at least as far as the Court is concerned, many of the things that are going on are not, in fact, corrupt, because they've taken this extremely narrow view of what corruption is." Essentially, he explains, cases such as Citizens United v. FEC; United States v. Sun-Diamond Growers; Skilling v. U.S.; and McDonnell v. U.S. have all greatly narrowed the definition of corruption to largely nothing less than a very specific quid pro quo bribe where a politician promises a very specific official act in exchange for payment.

That means, as some on the Court may now see it, long-term relationships where a GOP megadonor like Harlan Crow has sponsored hundreds of thousands of dollars in undisclosed luxury travel for Thomas, or purchased his mother's house, improved it, and allowed her to live there rent-free to this day, or even paying private school tuition for Thomas' grand-nephew, is not seen as "corruption" if it wasn't in return for a specific thing. Even Thomas' wife Ginni can receive tens of thousands of dollars in payoffs by far-right activists, and it's not considered corruption.

"These long term relationships, where wealthy donors can shower a politician or a Supreme Court justice with huge gifts over years --- that's okay. At least it's not criminal, unless prosecutors can prove beyond a reasonable doubt that one particular gift was because of one particular thing they did," Eliason explains, detailing how the Court has cloistered itself into a world where all of this is somehow okay.

"The reality of corruption is usually much more subtle that that, and pervasive than that. It's a long-term 'You scratch my back and I'll scratch yours' kind of arrangement. 'I'll give you these fancy trips and gifts and things over time, and then when things happen to come up that I'm interested in, you'll do the right thing for me, and we don't even have to talk about it. We don't have to have an explicit deal, it's just an understanding between us.' That's what real-world corruption is like. But for more than twenty years, the Court has issued a series of opinions that have largely put arrangements like that --- like the arrangement between Harlan Crow and Clarence Thomas --- out of the reach of the law."

We've got a lot to discuss on these matters with Eliason today, including his suggestions for how Congress could fix this clearly broken and corrupt system, even as the Chief Justice suggests (inaccurately) that doing so would somehow be a violation of the Constitution's Separation of Powers doctrine. Ironically enough, if Congress finally does manage to legislate ethics reform for the Court and someone did challenge it as unconstitutional, guess who would get to be the final arbiter? "I wonder how they are going to rule?," quips Eliason...

On today's BradCast, we offer a bit of a response to those who are still under the impression, for some reason, that Trump is a "different kind of Republican", or that he's a non-ideological populist "draining the swamp" and taking on Wall Street and the Big Banks, or --- perhaps most dangerously --- that he has no coherent agenda. We also dive into the upcoming November 7 race for Governor in Virginia and questions about the corrupt past (and future?) of the GOP nominee. [Audio link to show follows below.]

As chaotic as everything he is doing seems to be, Trump's agenda is, in fact, very coherent, and little more than radical George W. Bush right-wing Republicanism on steroids --- albeit without the educated and politically correct artifice. Among the exhibits in today's argument: His administration's attempt to physically (and emotionally) prevent a teen immigrant from receiving a Constitutionally lawful abortion by keeping her locked up, despite court orders; and the Republican Senate vote late Tuesday night, with a huge assist from the Trump Administration, to dismantle a key consumer protection reform that had been five years in the making following the 2008 mortgage crisis and subsequent global economic meltdown.

That big win for Trump and Wall Street will prevent American consumers from having the right to sue huge corporations even after being screwed by deceptive, fraudulent practices. Yes, elections have consequences. And there is another big one set for just under a week from now to replace the outgoing Democratic Governor of Virginia.

The polls are reportedly tightening in the race between Democratic Lt. Governor Ralph Northam and former RNC chair, corporate lobbyist and George W. Bush Administration official Ed Gillespie. We're joined from Capitol Hill today by muckraking ShareBlue reporter MIKE STARK, who has been covering the Gillespie campaign and recently plowed through Bush-era White House visitor logs during Gillespie's term as a White House advisor, to find several instances of meetings with executives and lobbyists for big banks and energy companies that Gillespie had previously represented. The very next day after those meetings, Stark reports, the Bush Administration changed policies on issues those companies had been lobbying for.

The revelations and concerns of quid pro quo corruption come on the heels of the last Republican Governor from Virginia, Bob McDonnell, having been convicted of multiple counts of public corruption related to expensive gifts and huge sums of cash received from the CEO of a company hoping to win favors from the Governor.

Stark details his findings from those 2007 White House logs; his attempts to press Gillespie on the stump regarding his corporate lobbying work for big banks, big tobacco, big energy, and big pharma; his ties to the NRA, which, along with the Koch Brothers' Americans for Prosperity, is making huge television ad buys on Gillespie's behalf; the GOP candidate's claims to oppose bigotry and racism in all forms, despite racist ads and disgraced former U.S. Sen. George Allen (R-VA), forced out of the Senate after racist comments, serving as Gillespie's campaign chair. We also discuss Trump's role in the race and whether Democrats may be on the verge of losing what should be an otherwise easy off-year election victory in Virginia.

Finally, Desi Doyen joins us to discuss the bizarre news regarding the tiny company from Montana that was, for some reason, granted a $300 million contract to rebuild Puerto Rico's energy grid after the devastation of Hurricanes Irma and Maria, and the report late today from the Wall Street Journal that a federal oversight board plans to install an Emergency Manager to takeover, and potentially privatize, Puerto Rico's state-owned power company. We get comment from a former Puerto Rico Power Commissioner who describes why the news is "unfortunate" for the island's 3.5 million struggling residents...

On today's BradCast, Here come more hurricanes, political and otherwise. [Audio link to show is posted below.]

Hurricane Maria, on a similar path to the devastating Hurricane Irma just over a week ago, has now strengthened to a deadly Category 4 before its projected landfall on many of the same Caribbean islands still reeling from Irma. But Maria is hardly the only storm swirling right now in the Atlantic and the Pacific (including Jose, Norma, Lee and Otis!).

Then, while Republicans and so-called "conservatives" last week pretended to be furious about the suggestion that Trump was working out an agreement with Democrats to protect some 800,000 kids of undocumented immigrants --- previously protected by DACA until Trump reversed it --- from deportation, in exchange for non-Border Wall border security, it turns out they're not all that angry after all. Evidence to support that argument --- along with the GOP's stated intention to balloon the national debt with massive new tax cuts and military spending --- underscores, yet again, that Republicans, like their President, have no real ideology, other than saying and doing what they believe is necessary to stay in power.

Yes, even anti-immigration zealot Rep. Steve King (R-IA) who claimed, after the deal between Dems and Trump was made public last week, that Trump's base was "blown up, destroyed, irreparable, and disillusioned beyond repair," said over the weekend that he was "gonna stick with President Trump".

Speaking of a lack of "convictions" (pun intended there), we're then joined by former Asst. U.S. Attorney RANDALL D. ELIASON, now a blogger and professor of law at George Washington University, to explain the ongoing corruption trial of sitting U.S. Senator Bob Menendez (D-NJ). Given the recent constraints the U.S. Supreme Court has placed on charges of bribery and public corruption by officials (see SCOTUS' dismissal last year of the guilty convictions against Republican Virginia Gov. Bob McDonnell and the limits on quid pro quo political bribery detailed by Citizens United and related rulings), can prosecutors successfully make charges stick against Menendez, who is charged with a number of felony counts relating to taking a huge amount of "gifts" from a physician friend, allegedly in exchange for "official acts" by the Senator.

"It's basically an exchange for these luxury trips, and jet trips, and pretty large political donations over the years, that Senator Menendez was working on these various things on Dr. Melgen's behalf," according to federal prosecutors, explains Eliason. "What the government has to prove is that there was a corrupt link between the two, that it was because of the gifts that the Senator was doing this."

Eliason, who headed up the Public Corruption/Government Fraud section at the U.S. Attorney's District of Columbia office for many years, walks us through the legal weeds of the case, which has received shockingly little attention in the corporate media, as storms --- both political and climatic --- have sucked up a lot of press attention in recent weeks.

And, though the investigation into Menendez was begun under Obama (on the heels of a completely fake news story, published by a Rightwing "news" outlet), are there any lessons we may take from this prosecution as it relates to potential charges being investigated against Team Trump? As it turns out, there are, as the always-insightful Eliason details today.

Finally, Trump's Homeland Security Advisor H.R. McMaster claimed over the weekend that Trump might be willing to rejoin the Paris Climate Agreement, but only if the there were better terms for the U.S. Our own Desi Doyen has a thought or two in response to that claim...

On today's BradCast: Climate change continues to ravage Americans and take lives in the east and west, surprisingly good news from the U.S. Supreme Court, and the U.K. remains gripped with panic, confusion and uncertainty in the wake of last week's vote 'Brexit' vote to leave the European Union.

We start today with more on the historic deadly flooding and "mass destruction" in West Virginia 'coal country' and the out-of-control wildfires across bone-dry Southern California. Yes, it's everything we've been warning you about for so long on both The BRAD BLOG and The BradCast, even if just the latest example of the enormous (and growing) cost of climate change, as still both under-reported by the corporate media and over-shadowed by other new events across both the U.S. and world.

Then, the U.S. Supreme Court handed down several major decisions on its final day of the session. Surprisingly, a number of those decisions were very good news for progressives, even on an otherwise divided Court with its still-vacant 9th seat. The biggest decision concerned abortion rights in Texas, where the Court dealt a devastating blow to Republican laws meant to shut down women's health clinics under the guise of 'safety'. The Court saw through the Rightwing con, and the 5-3 decision could result in the overturning of similar "TRAP laws" enacted by Republicans in other states. In any event, the decision is a huge setback for rightwing anti-abortion activists and a big victory for those who believe in Constitutionally protected reproductive rights and freedoms. Can we take anything from this decision as to how SCOTUS might eventually rule in the Texas Photo ID voting restrictions case --- another GOP law meant to rob (certain) citizens of their rights for entirely specious reasons?

Also, the right of states to restrict the possession of guns by domestic abusers was upheld in a surprising bi-partisan 7 to 2 opinion, as was a new rule by the U.S. Dept. of Labor concerning overtime pay for home healthcare workers.

In an unusual unanimous decision by the Supremes, Virginia's former Republican Governor Bob McDonnell saw his bribery conviction vacated, despite having accepted some $165,000 in personal gifts and cash loans from a wealthy businessman hoping the Governor would help promote his products. Will that decision have any effect on Alabama's former Democratic Governor Don Siegelman, who is now serving his 6th year in federal prison for having done far less than McDonnell was found guilty of? That, even as the Republican federal judge who sentenced Siegelman has resigned from the bench after having been arrested for beating his wife and the Republican heads of all three branches of government in Alabama face removal of office via impeachment (Governor), ethics charges (Chief Justice of the AL Supreme Court) and multiple felony conviction (AL Speaker of the House) for various crimes, alleged and proven, in their home state.

Finally today, last week's 'Brexit' vote continues to wreak havoc as world financial markets continue to plunge (though not nearly as low as I incorrectly reported it on today's show, as based on an inaccurate number reported by my iPhone's stock app!); the British government is in complete disarray about how (or, perhaps, even, if) they will officially begin the formal procedure required to leave the EU; voters express 'bregret' over having voted to exit; questions arise about overseas voters failing to correctly receive ballot papers at all; and some call for a second ("do-over") referendum.
