It's now or never. It's our final BradCast before Election Day 2024 and our last chance to open our phone lines to callers to have their say. [Audio link to full show follows this summary.]

Either Kamala Harris will become the next President of the United States and the first Black, Southeast-Asian American woman to do so, or Donald Trump, a 78-year old, 34-time convicted criminal felon, adjudicated rapist and self-proclaimed wannabe-Dictator will. Those are the two choices.

So today we take a bit of time to make that case to those who are either undecided, planning not to vote at all, or considering voting for a so-called "third-party" candidate.

To that end, we open up the phones to listeners to make their own such case to other voters. Among those who did so was listener "Maura", who described herself as being "a Republican and business owner most of my life." Her argument to those voters is that, while Harris may not be perfect, "voting is a bit like getting on a bus. You have the option to get on a bus or not get on a bus. And if you're going somewhere, you go to the bus that goes closest to where you are trying to go."

She also went on to spell out a number of other things she likes about Harris' policies and added at the end: "Plus! Plus! She is the only candidate that is likely to have the support in Congress, and to be able to support and protect our civil rights across the country. If we have civil rights, we must have them nationally."

Before we get to a full slate of callers today, however, a few very related news items of note...

  • Just another heads up: Donald Trump will declare victory on Tuesday night, whether he has actually won or not. Do not be surprised. Do not be alarmed. Do not be frightened. Do not be gaslit. It is completely, 100% expected in the event that he is losing and it will be your first post-election indication that he is attempting to steal the 2024 election as he tried, but failed, to do in 2020.
  • On Sunday, Donald Trump reiterated his disturbing homicidal ideation at a rally by telling supporters he wouldn't mind if someone "shot through the fake news" which was covering the event. That followed, just days earlier, a similarly appalling remark in which he mentioned Republican former Congresswoman Liz Cheney and suggested the idea of having "nine barrels shooting at her," asking how she feels about being so pro-war "when the guns are trained on her face." (For those Trump apologists who say those remarks were just fine, because "context", I'd ask if they would be just fine with Kamala Harris, at a rally, declaring in any context: "Let's put Donald Trump there with a rifle, with nine-barrels shooting at him, with guns trained on his face.")
  • Stunning news out of Iowa on Saturday, where the "gold standard" Des Moines Register poll run by Ann Selzer found Kamala Harris actually was leading Donald Trump --- in IOWA --- by three points on the last weekend before Election Day. If Harris is actually leading in deep-red Iowa, as the survey finds, what does that tell us about all of the other polls, particularly in so-called battleground states, that pre-election polling averages claim to be tied just before E-Day? Selzer has a remarkably accurate record over the years in her Iowa polling to the extent that polling guru Nate Silver, creator of polling average site 538, said about Selzer and her shock poll results on Saturday: "In a world where most pollsters have a lot of egg on their faces, she has near-oracular status."
  • Over the weekend, European Green parties from nearly 20 different countries, issued a joint statement calling on "US Green Party candidate Jill Stein to withdraw her Presidential candidacy, and endorse Kamala Harris." The Euro Greens cite the U.S. party's "close relationship" with authoritarians around the world and an election in which the stakes "could not be higher" on a host of issues, including climate change. "We are clear that Kamala Harris is the only candidate who can block Donald Trump and his anti-democratic, authoritarian policies from the White House," they declared in calling for Stein to endorse Harris in a race they describe as "too close for comfort."
  • Longtime election expert and fellow Election Integrity advocate Jonathan Simon recently penned an open letter to the Green Party's Jill Stein, including results from the so-called "Blue Wall" states of Wisconsin, Michigan and Pennsylvania back in 2016, noting that Stein's share of the vote that year in all three states was larger than the margin of victory for Donald Trump over Hillary Clinton that resulted in his winning the White House the first time.
  • And, finally, before we get to callers and their "closing arguments" to undecided voters or those considering voting third-party, we share the closing argument, in his own words, from independent, self-described democratic socialist U.S. Senator Bernie Sanders on why he believes it is critically important to elect Kamala Harris despite his virulent disagreements with the Biden-Harris Administration's policy on Israel and Gaza...

Today on The BradCast: Either Trump wins or the nation gets it, apparently. [Audio link to full show follows this summary.]

For months now, the Republican propaganda outlet known as Fox "News" has been leading the rest of the rightwing echosphere in misleading the public about this year's election. To listen to their 24/7 lockstep message, it is a metaphysical impossibility that Donald Trump could lose this November. If he does, it can only be because Democrats have stolen the election "again", as "they did in 2020."

While its hosts almost certainly know better, they have been characterizing Joe Biden as so old and feeble --- and Trump so wildly popular --- that there can only be one legitimate outcome this year: a Trump victory. A Trump landslide, in fact. Anything short of that is, as Fox is dangerously grooming its brain-poisoned viewers to believe, due to massive fraud carried out by Democrats.

We're joined today by MATT GERTZ, longtime Senior Fellow at Media Matters for America, to discuss his research --- detailed in an op-ed last week --- on how "Fox News is helping Trump plan another Jan. 6-style assault on democracy."

"If you look at the last two presidential elections --- in 2016 Donald Trump won, in 2020 Donald Trump lost --- the one thing that they have in common is that in both cases, Donald Trump claimed to have been the victim of massive election fraud," Gertz tells me today. "He always does this. It is the most predictable thing in politics, that Donald Trump will claim he is the victim of election fraud with no evidence to that effect." But now, of course, Fox "News" is joining in on the scam and the "guard rails" that were in place in 2020 in the Republican Party are all now all but gone, warns Gertz.

"What Fox News, and the rightwing media more broadly, has been doing over the past several years, is prime their audiences to assume that any election that doesn't end with a massive Trump victory is the result of illegitimate votes being cast, that it is a rigged election against Donald Trump and they should respond with all possible action to prevent Joe Biden from being allowed to remain in office if he wins."

"What's different now is that they know what the result can be," charges Gertz. "They know that all of these claims about election fraud incite their viewers, that it leads them to even march upon the Capitol to try to prevent the peaceful transition of power. And they're doing it anyway."

I have been wondering aloud of late which outcome concerns me the most, a Trump victory or a Trump loss. It might be a toss-up right about now...

THEN... We've been covering the oppressive heat dome across much of the nation --- and elsewhere in the world --- for some time now. Last week, we added wildfires in several states to the mix, along with the first named storm of hurricane season spinning quickly up before slamming Mexico and the southern coast of Texas. Now we can add massive flooding to the mix, as several states in the Upper Midwest --- where South Dakota, Iowa, Nebraska and Minnesota meet --- inundated over the weekend with as much as eight times their typical rain fall for this part of the year. In one town, the flood gauge was submerged!

Many of those states are run by Republican Governors who are also climate change denialists, reminding us, yet again, that the stakes this November could not be higher, as Trump has vowed to rollback all of the landmark climate achievements of the current President.

In related news, as temperature records are being shattered around the globe, at least 1,300 pilgrims at the annual Hajj in the Saudi Arabia's city of Mecca died from heat stroke as temperatures climbed above 124 degrees Fahrenheit. And, oddly enough, back here in California, on the central and northern coast, unseasonably cold ocean temps --- due to a bizarre weather pattern from Oregon --- have led officials to issue warnings to beach goers to stay out of the water for any length of time to avoid hypothermia, even as temperatures inland climbed over 100 degrees this weekend. More madness and chaos in our climate changed world...

Far-right Republicans in the Lone Star State are telling us about their extreme plans. Why are both state and national media downplaying them? We discuss on today's BradCast. [Audio link to full show follows this summary.]

BUT FIRST UP... The Presidential Primary season comes to a close this week, with Tuesday's contests in New Jersey, Montana, New Mexico, South Dakota, Iowa and D.C. (Though Democrats in Guam and the Virgin Islands still have a chance to ring in this weekend! And non-Presidential primaries will continue in many states in the week's ahead!) We've got some of your noteworthy results fron Tuesday today, such that there are any, including Presidential results reflecting small, if notable numbers of voters on each sides of the aisle who remain dissatisfied with both President Biden and convicted felon Donald Trump as their party's nominee.

THEN... This week, lawmakers in the very narrowly GOP-controlled chambers of Arizona's state legislature became the latest such body to try and pass new laws mimicking Texas' Senate Bill 4. That law, currently under federal challenge by the Biden Administration, grants unprecedented authority to state and local law enforcement officials to arrest people suspected of being in the country unlawfully and allows state judges to deport them. Those are roles traditionally played by federal, not state, officials. In Arizona, the Democratic Governor vetoed a similar effort earlier this year, so GOP lawmakers are now moving to place the measure on the state's already very long November ballot.

What happens in the increasingly radicalized state of Texas, unfortunately, does not stay in Texas, where Republicans hold solid majorities in both chambers of the state legislature, every single statewide office (since 1994), and every seat on the state Supreme Court. Those Republicans have only become more radical with each passing year, as evidenced by the state GOP's horrifying official party platform [PDF] adopted at their recent state party convention.

Just a few of the many planks, among others, call for doctors to be charged with homicide for carrying out an abortion; the Bible to be taught by chaplains in public schools; the deportation of noncitizens living lawfully in the country if they happen to participate in the wrong public protest; the withdraw of the U.S. from the United Nations and the organization's removal from U.S. soil.

Perhaps most disturbing (at least to me), the manifesto calls for a new law to mandate that statewide officials must win not only a majority in the state, but majorities in more than half of Texas' 254 counties in order to win office. That measure, if turned into law, would make it largely impossible for any Democrat to ever win statewide office again, given that the vast majority of the state's liberals are populated in a handful of large counties that are home to the state's major cities. Texas would become a one party state.

The Washington Post's Karen Tumulty this week described the TX GOP party platform as "hair-raising" and a sign that the state GOP has "gone off the deep end". But, at the same time, she marginalizes the document as "not a serious policy road map."

It is not only national media downplaying it. The Austin American Statesman describes the platform as little more "a wish list...than a road map that will be followed...by lawmakers in Austin or Washington". The otherwise excellent Texas Tribune similarly downplays the stated threats to democracy (and just about everything else) in their own coverage.

But our guest today, ANDREA GRIMES, an Austin-based journalist and activist who has been covering state GOP conventions since 2010, argued in an op-ed at MSNBC late last week that such views by major media outlets "aren’t merely outdated. They’re patently incorrect, contradicted by demonstrable evidence that the Texas GOP platform has been driving policy in Texas and beyond not just recently, but for several years."

She joins us to detail that case today, warning that while all of these planks may sound crazy, increasingly radicalized and extremist Republicans and their office holders in Texas "and beyond" are telling us exactly what they plan to do and have a record, going back years now, of enacting into law some of the state GOP party's most appalling measures. Once fringey ideas that began as little more than seemingly buffoonish platform planks dismissed by media outlets as sops to the party's most extremist elements have since become mainstream Republican party orthodoxy and enacted into law in Texas and many other states. The failure by mainstream media to notice and warn that "these people are not messing around" continues to ill-serve the nation.

Grimes details how the problem goes back to at least the "Tea Party" days and the "white racist reactionary political movement" that rose up in response to the nation's first Black President. But that has accelerated, she says, since 2016 "with the rise of Trump" and "a Republican Party that is living its best, most crazy life at this point, achieving win after win in terms of policy."

So why are these state GOP party platforms, much of which have become law in recent years, still being downplayed by editors at mainstream state and national media outlets, rather than being regarded as the warnings that they are?

"The phrase that continues to come into my head over and over is 'normalization bias'," Grimes tells me. "It's very difficult to come to grips with the true terrors of our political reality because they are outrageous. It is outrageous for Samuel Alito to be flying an upside-down American flag at his home. It is outrageous for Trump to foment an insurrection. It's outrageous for insurrectionists to storm the U.S. Capitol. These things are outrageous. And I think there's a sense among members of the mainstream media that, if they can strive to pursue the maintenance of objectivity and normalization, that things will somehow even out on their own, and they won't be asked to truly describe the world as it is. They won't be asked to go into this uncomfortable place of appearing biased, when in fact they would simply be describing reality."

"American journalism is so rooted in this conceit of objectivity. It is so beholden to this idea," she adds. We've got much more to discuss along these lines today, including whether there is any analogue to this phenomenon on the Democratic side (spoiler alert: nope, nothing even close) and what, if anything, can now be done by Americans to stem the tide of radicalism, particularly if media outlets continue to fail call it out for what it is. FINALLY... Just before the close of today's show, news breaks out of Georgia that the state Appeals Court has placed a pause on Fulton County District Attorney Fani Willis' sprawling conspiracy indictment against Trump and 18 co-conspirators for their alleged criminal scheme to steal the 2020 election in Georgia, as an appeal by the defendants to remove Willis from the case moves forward. Upshot for now: The case was highly unlikely, at this point, to get to trial before November. Now it absolutely won't.

Today on The BradCast: Imagine if Justice Ketanji Brown Jackson was found to have been flying a Joe Biden "Dark Brandon" flag at her house. Ya think Republicans in Congress might have anything to say about it? Might take any action in response to it? [Audio link to full program follows this summary.]

Among the stories covered on today's program...

  • Republicans in the Ohio state legislature are still blocking Joe Biden from this year's Presidential election ballot in the Buckeye State. Even Republican Governor Mike DeWine is now calling it "ridiculous" and "absurd" and has called a special legislative session for next week to fix the problem that GOP lawmakers have so far refused to. Think they'll finally do it?
  • The corrupt rightwing majority on the packed and stolen U.S. Supreme Court on Thursday, allowed a racial gerrymander in South Carolina to remain in place for the 2024 election. All of the Court's liberal Justices dissented. The 6 to 3 majority opinion was written by Justice Samuel Alito, who appeared more concerned that state lawmakers might be seen as having engaged in "offensive and demeaning" conduct, than he did about the tens of thousands of Black voters in the state whose votes have been shifted to other districts to make it easier for Republican Rep. Nancy Mace to hold on to a seat in the U.S. House. It's not a racial gerrymander, the Court's Republican majority claims, it's a partisan one. And, apparently, that's just fine. (Justice Clarence Thomas went out of his way in a concurring opinion to note that racial gerrymanders are just fine as well.) All of that, after a lower court panel of federal judges found that SC's racial gerrymander amounted to the "bleaching of African American voters."
  • And, speaking of Sam Alito....Now the whole world knows, if they didn't already, that the corrupt, far-right Republican Supreme Court Justice is both a personal supporter of the Trump-incited 2021 insurrection at the U.S. Capitol and a Christian Nationalist. At least based on the two different flags he has been flying over two of his houses, according to more excellent reporting by the New York Times on Wednesday. That, as we await two different major rulings from the High Court regarding accountability for Donald Trump in relation to the insurrection. Neither Alito nor Thomas, whose wife directly participated in the insurrection, have recused themselves from either case. So, what are Democrats in the U.S. Senate going to do about any of it? So far, it doesn't look like they're prepared to do much, at least beyond issuing an occasional "outraged" press release. As discussed in some detail today, that needs to change.
  • One of voting system vendor Smartmatic's several, huge, defamation lawsuits for lies told about the company "rigging" the 2020 election, is against the far-right political propaganda outlet known as Newsmax. Court documents made public this week reveal that Newsmax destroyed evidence --- text messages and emails --- that they were required to retain for the lawsuit.
  • This week, Joe Biden cancelled student loan debt for another 160,000 borrowers, bringing the total number receiving some form of forgiveness up to nearly five million. His Dept. of Education has now approved about $167 billion in loan forgiveness under a number of different programs, following the corrupt SCOTUS ruling that prevented the President's initial effort to forgive up to $20,000 for some 43 million borrowers. Still, $167 billion is nothing to sneeze at. And it's money that can now go instead into the economy instead to purchase homes, cars, etc., which helps everyone. Fox "News", of course --- which had no problem when Trump gave trillions of federal dollars to millionaires, billionaires and wealthy corporations via GOP tax cuts --- seems to have a different opinion about federal government relief for those who actually need it.
  • Finally, Desi Doyen joins us for our latest Green News Report, as deadly, climate changed-fueled extreme weather lashes folks from Mexico to Iowa; Florida's Gov. Ron DeSantis signs a "Don't Say Climate Change" law as the state broils in yet another heat wave; Oakland, California becomes the nation's first school district to move to 100% all-electric school buses; And microplastics are now found everywhere, even inside of us. You'll have a ball finding out where scientists have discovered them most recently. It's nuts!...

And with that great news, The BradCast (and Green News Report) will be standing down next week for a much-needed break over the Memorial Day holiday week. It was yet another busy news day and, thus, it was another very busy BradCast. [Audio link to full show follows below this summary.]

Among the many stories covered today...

  • It has been a very very bad 24 hours for our disgraced former President in three of his four criminal cases, as he's now received rejections from three different judges to three different motions to dismiss or delay in three different jurisdictions over that period. Last night, Juan Merchan, the judge in his New York hush-money fraud case rejected his last minute motion to delay his April 15th trial until after SCOTUS rules on his laughable "Presidential Immunity" claim. The judge in his Georgia election theft conspiracy case, Scott McAfee, rejected Trump's effort to dismiss on ridiculous First Amendment "protected political speech" grounds. And even Aileen Cannon, the corrupt Trump-appointed federal judge overseeing his case in Florida for stealing national security documents upon leaving the White House, finally issued an order rejecting his absurd Presidential Records Act defense as cause for pre-trial dismissal. Sad!
  • The secretive, supposedly "centrist" No Labels group announced they will not be running a third-party candidate for President in 2024 after all.
  • Kim Taylor, the wife of an elected Republican official in Iowa who was named as an unindicted co-conspirator, will get just four months in prison after being found guilty last year of 52(!) election fraud crimes, including registering and casting votes for her husband in the names of others. (Tip for vote fraudsters looking to get off easy: Be a Republican.)
  • Wisconsin's newly progressive Supreme Court majority will now decide whether to reverse the previous right-wing majority's ban on the use of absentee ballot drop-boxes in the critical battleground state this year.
  • An out-of-the-blue call on Tuesday by a rightwing extremist on Twitter to change the way Nebraska will allocate its Electoral College votes in 2024 --- in hopes of awarding an extra vote for Trump this year --- gained support just hours later from the state's Governor and the desperate former President before failing in a vote by the state legislature Wednesday night. Bigly. The measure still could come back up for another vote, however, before the legislative session's end on April 18, or in a Special Session thereafter if called by the Governor.
  • Following a reportedly tense call on Thursday between the nation's two leaders, the White House announced that President Biden issued a warning to Israel's far-right Prime Minister Benjamin Netanyahu: Change course in Gaza or...else. The White House said the President demanded swift changes to Israel's war on Gaza to allow much more food and humanitarian aid to reach starving citizens and protection for both civilians and relief workers. Though it remains unclear how U.S. support may change, an Administration spokesperson said they expected to see action from Israel "in hours or days" before reassessing current policy.
  • On Wednesday, Senator Bernie Sanders joined President Biden at the White House to tout their successful efforts at lowering the cost of healthcare and, specially, prescription drug prices following the adoption of the Inflation Reduction Act which every Republican in Congress voted again. After forcing Big Pharma to lower the cost of insulin and certain asthma medication for Medicare recipients to no more than $35/month, both men called for still more cuts in the price of overpriced prescription drugs sold in America to everyone, not just those on Medicare.
  • Finally, Desi Doyen joins us for our latest Green News Report with news on a looming, climate-change fueled hunger crisis in Southern Africa; the Biden Administration's largest-ever investment to decarbonize American manufacturing; how melting polar ice is bending time itself; and the opening of America's first commercial-scale offshore wind farm...which is decidedly not killing whales (insists Desi.)

About that 2024 GOP Caucus 'landslide'...

The headline from Fox "News" typified what passes for "coverage" in right-wing media: "Trump wins massive victory in Iowa". That contrasts sharply with The BradCast's headline: "Trump Underwhelms in Iowa".

One core factor in analyzing the significance of either a Caucus or Primary Election is voter enthusiasm, as reflected by turnout.

Even when the especially harsh winter conditions are taken into consideration, the turnout for Iowa's 2024 Republican Caucuses must be regarded as dismal. The number of votes cast, 110,298 --- down from nearly 187,000 in 2016 --- represents less than 5.3% of Iowa's 2,083,979 registered voters.

The 56,260 ballots cast for Donald Trump represented a meager 7.8% of Iowa's 718,901 registered Republicans.

The 51% Trump received in the 2024 Iowa Caucus is only 3 points greater than the 48% Lyndon B. Johnson, a then incumbent President, received in the 1968 New Hampshire Democratic Presidential Primary. LBJ's opponent, Sen. Eugene McCarthy (D-MN), received 42%. Johnson's narrow "win" in NH was followed by his decision to drop out of the race.

And while the 21,085 votes that third place finisher Nikki Haley received was also minuscule, any objective observer should not ignore a poll revealing that 43% of Halley Republican voters said that, if Trump became the nominee, they would vote for President Joseph R. Biden in the general election.

So which is it --- "massive victory" or "underwhelming"?

Lucky me. I now have a rebound case of COVID. But with the first votes cast in the critical 2024 Presidential race in frozen Iowa on Monday night, I mustered as well as I could to bring you a fresh BradCast today. (No promises for tomorrow, however!) [Audio link to full show follows this summary.]

With that in mind, I need to keep this short and get back to bed. Among our stories covered today...

  • Iowa's far-right GOP caucus-goers have a habit of backing losers. On Monday, a bare majority of them (51%) voted for Donald Trump in far below zero temps. Almost half of IA's GOP caucus-goers voted against him. But that was still more than enough to defeat the disgraced former President's splintered and woeful challengers. After burning about $150 million in his all or nothing quest to win Iowa, Ron DeSantis lost it. He came out with just 21.2% of the vote, narrowly edging out third-placer Nikki Haley, who still has a not-impossible-chance of defeating or, at least, challenging Trump in next week's first-in-the-nation New Hampshire primary. She finished just behind DeSantis with 19.1% on Monday night in IA. Both challengers have vowed to move on to NH. Vivek Ramaswamy, however, who finished in a distance fourth in IA, quickly bowed out and endorsed Trump. That's about all you need to know about Monday night when it comes to the horse race. Beneath that, however, there is much more, underscoring this unprecedented moment for the nation and the need for an overwhelming majority of voters to step up and save American Democracy this year.
  • Meanwhile, down in Texas in recent days, 2028 Presidential hopeful, far-right Republican Governor Greg Abbott appears hoping to touch off a new civil war between his state's military and the federal government. In a multi-prong effort to goose his political fortunes by ensuring that immigration concerns will not be dealt with until a Republican President is in the White House (to get credit for it), and to further fuel his party's latest grift that, without a return to power for the GOP, a new "civil war" is looming, Abbott has deployed the Texas Military Dept. to the nation's Southern border. In doing so --- despite migration numbers recently plummeting thanks to high-level talks between the U.S. and Mexico --- Abbott has erected razor wire on the U.S. side of the Rio Grande and new steel fencing and gates to physically lock out U.S. Border Patrol from protecting miles of our national border. He has done so without permission of either the feds or local city governments. As the Biden Administration challenges Abbott's extra-Constitutional tin-pot authoritarianism at SCOTUS, a mother and her two young children died while attempting to cross the river over the weekend. TX troopers reportedly blocked federal officials from responding to a distress call from the Mexican government. As discussed, Republicans don't fear a new civil war. They want one. Or pretend to. And they certainly don't want to actually solve any issues at the border, else they'd have nothing to run on this November.
  • Finally, Desi Doyen joins us for our latest Green News Report with new numbers from 2023's record heat and climate disasters; as Republican climate crisis denial continues on the campaign trail on behalf of fossil fuel industry funders (with increasingly deadly results); and as the Biden Administration moves ahead with rules to force polluting oil and gas companies to finally pay their fair share in return...

And then there were two. Well, actually three. (Well, probably still just one.) It's another episode of Special Coverage on today's BradCast! [Audio link to full show follows this summary.]

Former SC Gov. Nikki Haley squared off with FL Gov. Ron DeSantis in Des Moines, Iowa on CNN Wednesday night for the 5th, so-called "GOP Presidential Debate," just hours after former NJ Gov. Chris Christie decided to drop out and as the disgraced former President and presumptive Republican front-runner did a live town hall on Fox "News" just up the road. All just days before voters trudge out into -6 degree ("Feels Like" -25 degree) temps on Monday night for the first-in-the-nation Iowa Caucuses.

Topline: Haley and DeSantis repeatedly called each other liars (she even created a website for his); DeSantis largely dominated Haley (while calling in some sexist tropes for good measure); and nobody laid much of a glove on GOP polling leader and four-time indictee, Donald Trump --- as usual.

Of course, there was much more than just that going on. Which is why we're joined today for smart insights on all of it by our 2024 post-debate analytical champeens and long-time OG bloggers HEATHER DIGBY PARTON of Salon and Hullabaloo and 'DRIFTGLASS' of the weekly Professional Left Podcast and its companion show, No Fair Remembering Stuff.

Today on The BradCast, we continue our COVID recovery, revisit some of the Biden v. Trump horseraces that sent so many Dems scurrying under their bed sheets late last year, and try to make sense of the disgraced former President's ridiculous argument (his attempt to delay his Jan. 6 criminal trial until after this year's election) at the U.S. Court of Appeals in D.C. on Tuesday. [Audio link to full show follows this summary.]

Among the stories cited and/or referenced today...

  • New CNN/University of New Hampshire polling finds Nikki Haley within single digits of Donald Trump in New Hampshire with the first-in-the-nation primary now just two weeks away. Their polling is not the only one showing Haley within spitting distance.
  • USA Today buries the lede in their coverage of a new USA Today/Boston Globe/Suffolk University poll finding Joe Biden seven points ahead of Trump in a general election match-up in New Hampshire and reveals that "American democracy" is the issue that both Dems and independent voters are most concerned about this year.
  • Donald Trump and his attorney apparently believe that a U.S. President may lawfully order Seal Team 6 to assassinate an American political rival. Seriously, the question was raised on Tuesday by one of the three judges on the D.C. appeals court panel tapped to hear Trump's claims of "absolute immunity" for crimes committed while serving as President. Can he sell pardons? Can he accept bribes? Sell nuclear secrets? According to Trump's attorney, sure he can! As long as he is not impeached and convicted first. Trump's other appeal argument, that being "acquitted" by the U.S. Senate at his second impeachment trial (when a majority of bipartisan Senators found him guilty of inciting an insurrection), somehow renders him immune from criminal prosecution in the judicial system because that would be unconstitutional "double jeopardy". As one of the three judges pointed out, Trump's own attorneys during the impeachment argued exactly the contrary. "It's in the Congressional Record," she said. It's all as absurd as it sounds. But, in fact, it is simply meant as a way to push Trump's March 4 trial date in his federal indictment for attempting to steal the 2020 election back past the 2024 election, when he hopes to win and make all of his many indictments go away. The three judges on the D.C. panel, however, didn't seem to be buying any of it.

It's impeachment madness on today's BradCast! Also, a whole bunch of Republicans are otherwise quitting, backing down or facing jail time. In other words, Tuesday. [Audio link to full show is posted below this summary.]

Among the many stories covered on today's program...

  • Tommy Tuberville (R-AL), a U.S. Senator and grown man who goes by the name Tommy, finally backed down from his pointless, one-man, months-long blockade of promotions for more than 400 U.S. military officials. He had been protesting a Pentagon abortion policy that none of the officers in question had anything to do with. The Senate quickly promoted all of them by simple voice vote shortly thereafter.
  • House Speaker Mike Johnson (R-LA) announces he has "no choice" but to hold a floor vote for a (revenge) Impeachment inquiry of President Biden next week. The announcement follows the latest bombshell disclosure by Oversight Committee Chair and supergenius Rep. James Comer (R-KY) that Republican investigators have discovered secret monthly payments made by China to Joe Biden and laundered through his son, Hunter! Err...Three monthly payments of about a $1,400 each from Hunter Biden to his dad in 2018 to repay him for the purchase of a used truck the then former Vice President helped him buy. (Yes, the same bombshell loan repayment reported almost two years ago by the New York Post.)
  • The bow-tied, far-right, but not-insane-enough-for-today's-House-Republicans Rep. Patrick McHenry (R-NC) has had enough. He joined a growing number of colleagues announcing they will be quitting at the end of this term.
  • An important CORRECTION following my mention yesterday of North Dakota Gov. Doug Burgum dropping out of the GOP 2024 Presidential race, and the RNC announces the four candidates who have qualified to appear at Wednesday's night's "Presidential Primary Debate" in Alabama. (Neither Burgum nor Trump will be there. DeSantis, Haley, Ramaswamy and Christie will, for some reason.)
  • The three top officials for Ron DeSantis' "Never Back Down" super PAC have backed down. They quite over the weekend, joining a growing number of other Never Back Downers who have exited the Florida Governor's losing 2024 campaign in recent days.
  • Two Republican Cochise County officials, Peggy Judd and Tom Crosby, have been indicted on state charges in Arizona for conspiracy and interference of an election officer after refusing to certify the county's 2022 election results because...well, tune in.
  • Kim Taylor, the wife of Republican Woodbury County, Iowa Supervisor and failed GOP Congressional candidate has been convicted on 52 counts of election fraud-related charges for falsifying voter registrations and casting dozens of fraudulent votes in the names of others in the 2020 election. Her husband, Jeremy Taylor, named as a co-conspirator, has yet to be indicted for some reason.

Guest: David Roberts, climate and energy journalist; Also: Senate Repubs don't think much of McCarthy's Impeachment Inquiry either...

The landmark federal climate bill called the Inflation Reduction Act, adopted last year without a single Republican vote when Democrats held majorities in both chambers of Congress, has a long way to go before we can determine its full success or failure.

On the other hand, as discussed on today's BradCast, if it is going well, but few Americans know it's going well --- as corporate broadcast media spend nearly 24 hours a day on various crises both manufactured and real (ironically, many caused by climate change!) --- can it or will it make a difference in next year's elections? [Audio link to full show is posted below this summary.]

But, FIRST UP today, one (or more) of those manufactured crises. House Speaker Kevin McCarthy's desperate attempt on Tuesday to win over his own far-right caucus in the House by unilaterally declaring an impeachment inquiry of President Joe Biden doesn't seem to be going over very well. He had to break his own vow, made just 11 days ago, to do it only after a full vote of the House. It doesn't seem to be winning over enough colleagues to help him avoid a federal Government shutdown at the beginning of the new fiscal year on October 1. And even fellow Republicans in the U.S. Senate apparently see no evidence of High Crimes or Misdemeanors by the President to warrant impeachment.

On the other hand, he hasn't been pushed out of Speaker job by his own party this week...yet. So there's that!

NEXT: Biden and the Democrats' landmark Inflation Reduction Act --- featuring the largest single investment in history in climate change mitigation and clean energy manufacturing and jobs --- is now one year old. It has already begun to "turbocharging" a massive investment in new manufacturing plants and jobs in the U.S. to help reduce fossil fuel carbon emissions causing our climate crisis. It will soon be funding billions of dollars in home improvement projects to allow low and middle-income homeowners to electrify, solarize, upgrade and simply increase energy efficiency to save money. (NOTE: Not currently applicable in states like Florida, Kentucky, Iowa or South Dakota, apparently, which have failed to join the federal program to help their own residents save money and improve their home values while fighting climate change.)

Our guest today to discuss all of this is the great DAVID ROBERTS, longtime climate, energy and politics journalist and podcaster at Volts.WTF. We last spoke to him a year ago, just after passage of the critical legislation.

He explains today that it is still "too early to tell" whether the legislation is a success or not given all of its many practical objectives, which include vastly lowering emissions, creating millions of good paying jobs, sparking a manufacturing renaissance in the U.S. to bring supply chains home for renewable energy technology and overtaking China's dominance in the sector.

"Because the IRA's goals are so vast," Roberts explains, "it will only be over the course of five to ten years that we really have any understanding of whether it pulled it off. It's trying to do enormous things."

"What we definitely can say," however, is "that one of the goals --- which was to spur private investment into these products and supply chains in the U.S. --- is absolutely working. Last I looked, it's like $270 billion-worth of private investment flooding into the U.S."

But the yardstick for success here may be even longer than you think, according to Roberts. He tells me there is yet another goal for the legislation that is "not as public, but, if you talk to some Biden people behind the scenes, they will tell you that this apocalyptic terror you have about the future of democracy is not crazy."

"We are in a perilous, perilous moment. And part of the thinking behind IRA was that it is these parts of the country that were hollowed out by globalization, hollowed out by decades of reflexive 'free trade' dogma --- it's these parts of the county that have experienced this reactionary backlash that we've all been living through over the past little while. And if that goes on, U.S. democracy is in serious, existential trouble. People are freaked out about that all the way to the top. So, part of the goal of IRA was to channel investment into those areas. And that is happening."

Roberts says that much of the new investment "is coming into Southern and Midwestern states," including by companies like First Solar, which is "investing $1.2 billion into a facility in Louisiana. That is the single largest private investment in that state's history." Similar projects are happening in states like Georgia, West Virginia and elsewhere.

So, all we need to assess success of this enormous new law is whether it helps solves both of the nation's most existential crises: Democracy and Climate Change.

"Spurring investment, yes, it is succeeding. Is it succeeding in muting that reactionary backlash? Is it succeeding in muting these horrendous politics we've dealt with? Is it succeeding in turning a few swing voters in those swing states to help Joe Biden get back into office? That we don't know yet. And part of the problem is that our media ecosystem is broken and dysfunctional, and people just don't know about [the law]."

How to solve that? Well, as you can tell, we've got much to discuss today with Roberts along those lines as well, as he characterizes that part of issue as "the six million question" given "how broken the media is, and how difficult it is to get it to focus on these things."

He's got a few ideas, however, some involve "a huge role for NGOs, for the green movement" and even for you, as the climate, economic and political effects of the IRA one year on are still "TBD"...

And his inability to read the simple text of the U.S. Constitution; Also: Callers ring in on him, Trump and other democracy v. autocracy issues...

Whenever we're able to open up the phones to callers on The BradCast, I invite listeners to ring in and disrupt all of my plans for the day. Happily, they took me up on the offer today! [Audio link to full show follows this summary.]

Thus, my plan for the second half of today's show --- to focus on Trump's latest criminal charges (Which ones? Take your pick!) --- was largely waylaid by folks who wanted to discuss both him and the topic of my monologue in the first part of today's show regarding the wildly corrupt U.S. Supreme Court Justice, Samuel Alito.

On Friday, the Wall Street Journal's editorial page ran parts of fawning 4-hour interview with Alito, in which he falsely claimed: "No provision in the Constitution gives [Congress] the authority to regulate the Supreme Court-period."

Perhaps Alito has never read the U.S. Constitution? For example, he must have missed the part (Article III, Section 2) which reads: "[T]he supreme Court shall have appellate Jurisdiction, both as to Law and Fact...and under such Regulations as the Congress shall make." [Emphasis mine.]

As Sen. Chris Murphy (D-CT) pointed out on CNN over the weekend in response to Alito's B.S., Alito arguably owes his seat to the fact that Congress has regulated the number of seats that are on the Court (and have changed that number many times over the years) since the Constitution was founded! Of course, Alito likely also hates the fact that Congress, after Watergate, as per the Constitution, created legislation (regulations!) requiring annual financial disclosures by SCOTUS Justices. As ProPublica recently detailed, Alito has flouted that legislation by failing to disclose his luxury travel funded by GOP megadonors and other Republican ideologues.

Arguably worse, however, is the fact that one of the authors of the WSJ piece is attorney David Rivkin. He is currently representing the far-right Leonard Leo before the U.S. Senate, which is seeking Leo's testimony as part of their consideration of reforming the corrupted Court. Leo is the longtime head of the Federalist Society, which has spent decades shaping the federal judiciary --- including SCOTUS --- to the liking of billionaire rightwing ideologues.

Even more shameful than that, Rivkin currently has a case pending before the High Court next term! Moore v. U.S. is likely to result in a landmark ruling that could establish whether or not a wealth tax --- long sought by progressive Dems and opposed by rightwing ideologues --- is Constitutional or not.

And yet, Rivkin arguably gave Alito something of value --- presumably for free --- in his four-hour softball interview with the Justice, headlined "Samuel Alito, The Supreme Court's Plain Spoken Defender," in which Rivkin and his co-writer (WSJ Editorial Page Editor James Taranto) fluffed him up with a 2,400-word puff piece including remarks praising Alito, for instance, for his "candor that is refreshing and can be startling."

I'm sure Sammy appreciates it and will remember the favor when it's time to decide Moore v. U.S next year. That's because Alito is damned near as corrupt as Clarence Thomas and don't even get me started here on him today. (I had a few words for the corrupted Clarence on today's show, however.)

After that, my plans to cover Donald Trump's latest criminal problems and two recent Court losses (one today, one last Friday) in the second part of the show, as mentioned, were largely waylaid by callers. And happily so! We had some very good ones! Enjoy!...
