Today on The BradCast: A whole lotta madness. [Audio link to full show follows this summary.]

Among our many, mad stories today...

• The Trump Administration challenged the constitutionality of lower court judges issuing nationwide injunctions at the U.S. Supreme Court today, as part of Donald Trump's wildly unconstitutional Executive Order declaring an end to Constitutional Birthright Citizenship. He's lost in every lower court, so far, even if the merits of that Order, largely, were not heard by the High Court today. The Administration did, however, appear to be on track to lose their maximalist argument against nationwide injunctions as well.

• The House GOP's effort to ram Trump's "big, beautiful" agenda through the House before the Memorial Day recess continues apace, after several all-nighter mark-up sessions in major House committees. The bill is meant to encompass the entire Trump/GOP agenda to give enormous tax cuts to rich people and corporations, while taking health care (and much more ) from millions of the neediest Americans, in one single bill. But many Republicans can't agree on how many Americans should have their health care taken away from them to pay for a bill that will add nearly $4 trillion to the national debt. And some Republicans appear to have no idea about major provisions in the legislation.

• As Congress is gutting health care and nutrition assistance for the nation's neediest, the Trump Administration continues to work toward --- "eliminating" --- the Federal Emergency Management Agency (FEMA) just weeks before hurricane and wildfire season kick into gear. Trump fired FEMA's acting Director last week after he dared testify, in contradiction to Trump, that he didn't think it a good idea to eliminate the agency. His replacement is promising to "run right over" anyone who gets in his way, even as an internal review obtained by CNN warns that FEMA "is not ready" for hurricane season.

• And hurricanes this year could be more deadly than ever. That, thanks to both climate change and, more immediately, drastic Trump cuts to the National Weather Service (NWS) and the National Oceanic and Atmospheric Administration (NOAA) which houses it. Last week, five former NWS directors penned an open letter, warning of great danger to the public in the wake of recent draconian cuts at the Service. Scientific American details their chilling concerns.

• It has now been two months since Maryland father and Venezuelan migrant Kilmar Abrego Garcia was "accidentally" disappeared to a gulag in El Salvador by the Trump Administration in violation of a court order. But Trump's ridiculous contention about Abrego Garcia having "MS-13" tattooed onto his knuckles continues. That, as the Administration continues to defy a Supreme Court order to facilitate the man's return. But because Trump was obviously and transparently wrong about "MS-13" on the man's knuckles (it clearly Photoshopped onto a photo shown to him), everybody else in his Administration must pretend he wasn't wrong about it. That led to an absurd and surreal colloquy between DHS Sec. Kristi Noem and Rep. Eric Swalwell (D-CA) in a House Homeland Security Committee hearing on Wednesday.

• Yes, it's a mad world right now in these United States, though one that we should have seen coming. (Some of us did.) Former U.S. Supreme Court Justice David Souter --- who died last week in New Hampshire at the age of 85 --- tried to warn us about pretty much everything we're seeing now...back in 2012, before the Trump-era.

• Finally, we close with Desi Doyen and our latest Green News Report, as Republicans in Congress work to end Joe Biden's landmark clean, renewable energy initiatives; the Trump EPA rolls back limits on toxic chemicals in drinking water; and some recent good news for the climate out of Australia...

Among our coverage...

• West Virginia coal miners are suing Bobby Kennedy Jr., Secretary of the Dept. of Health and Human Services (HHS), for recent layoffs at the National Institute for Occupational Safety & Health (NIOSH) and the shut down of critical medical screening and job replacement services for miners. The lead plaintiff in the suit is suffering from lung disease, amid a growing epidemic of black lung in Coal Country. But with some 875 of NIOSH's 1,000 employees terminated earlier this month, they are no longer available to help move miners like him to non-dusty jobs, as required by the Mine Safety and Health Act of 1977. In addition to free screenings for lung disease and the right to job transfers, the federal law also blocks Administrations from weakening existing protections. The Trump Administration, however, doesn't seem to much care about the rule of law.

• In response to the NIOSH layoffs and shutdown of these critical programs for miners, WV's Republican U.S. Senator Shelley Moore Capito --- who voted to confirm Kennedy just weeks ago --- is now begging him to restore those jobs at NIOSH, many of which were in her state, and the critical medical services for miners in Central Appalachia. All of that, as Trump recently welcomed coal miners to the White House to serve as props for his announcement of new Executive Orders meant to try and force the revival of the dying coal industry ("beautiful, clean coal," as he insists on falsely describing it) and to otherwise try and knee-cap cleaner, safer, more profitable renewable energy initiatives in the bargain.

• Also part of the new Administration's celebration of Earth Day this year, Trump's Environmental Protection Agency sent letters to hundreds of EPA employees in the Office of Environmental Justice and External Civil Rights today to inform them their services are no longer needed, as environmental justice --- protecting low-income Americans and minorities most at risk from air and water pollution --- no longer aligns "with the agency’s current and future needs."

• Back in Congress, Republican lawmakers in the U.S. House are facing a serious dilemma. The House Ways and Means Committee is currently tasked with cutting some $1.5 trillion in federal services to Americans in order to help pay for Trump's $4.5 trillion tax cuts to mostly benefit huge corporations and the wealthy. But many Republican members of the Committee have seen huge, renewable energy-related job growth in their home districts, thanks entirely to tax credits made available via the Inflation Reduction Act passed without a single Republican vote in 2022 and signed into law by President Biden. The majority of the tax credits to companies to spur new manufacturing jobs in the renewable energy business are, by design of the previous Democratic Administration, in "red" states and counties. But Trump has ordered Congressional Republicans to kill all clean energy funding enacted by Biden. This is a real, if under-reported conundrum for Republicans and, potentially, a very good opportunity for Democrats in response.

• But Earth Day turned out to be another very bad for chief DOGE Bro and Tesla CEO Elon Musk. Just after the close of the markets today, Tesla issued its latest quarterly report. It was brutal for the company, which announced that profits fell an extraordinary 71% as compared to the first quarter of 2024. That, thanks to several reasons, though none of them as obvious as the worldwide public disgust in response to Musk's obnoxious turn late last year to the hard, Trump, MAGA right.

• As Desi Doyen is here to remind us, however, there are still some reasons to be hopeful on this year's Earth Day. At least everywhere else in the world, where new technologies and clean-energy breakthroughs are actually being supported and making remarkable progress; where nature itself is offering exciting new opportunities to fight climate change; where threatened species are making surprising come backs in several places thanks to scientists, conservationists and local communities; where cities and states around the world are making major advances in reducing pollution, and; where countries --- other than the U.S., at least --- are banding together to help vulnerable nations adapt and survive our climate crisis.

• On the other hand, Desi is also here with our latest Green News Report --- where every day is Earth Day --- to catch us up with a few stories we missed while off on Spring Break last week. Most of those stories, focused largely on the U.S., are not nearly as bright, however, especially as the world lost one of its great climate champions this week...

Happy Earth Day. Somehow.

We can't fight every stupid, idiotic, dangerous or perilous thing during the Trump Era, can we? I know I can't, personally. But I don't speak for everyone else. And one person's stupid or idiotic may be another's dangerous or perilous. An interesting debate over picking battles and who gets to decide which ones should be waged is at the heart of today's BradCast. [Audio link to full show follows this summary.]

FIRST UP... however, speaking of dangerous, Donald Trump lackey and MAGA merchandiser (or "sycophantic suck-up" as Sen. Sheldon Whitehouse accurately described him today), Kash Patel was confirmed for a ten-year term as FBI Director by cowardly, sycophantic suck-up Republicans in the U.S. Senate today. All Democrats voted against him. Just two Republicans (Collins and Murkowski) joined them.

Aside from being wildly unqualified and publishing an "enemies list" of so-called "members of the Executive Branch deep state” that he vows to target, Patel also pleaded the Fifth to avoid implicating himself in crimes during grand jury testimony regarding his role in Trump's theft of thousands of pages of highly classified national security documents; was paid $25,000 by Russian propagandists to appear in an anti-FBI documentary series; appears to have millions of dollars linked to Chinese interests through shell corporations in the Cayman Islands; and, according to whistleblower allegations cited by the Ranking Member of the U.S. Senate Judiciary Committee, appears to have committed perjury during his Senate confirmation hearing.

Other than that, he sounds like the perfect choice for FBI Director! Donald Trump has done it again! Did I mention Patel also publicly vowed, as recently as last December, to "come after" journalists "who lied about American citizens, who helped Joe Biden rig Presidential elections"? (So much for the First Amendment, even if Patel remains a fan of the Fifth.)

THEN... Speaking of the First Amendment and protection of the free press, we recently reported on the Trump White House's attempt to violate the First Amendment by barring the Associated Press from White House events unless and until the 178-year old international media organization agreed to change its Style Guide to refer to the Gulf of Mexico as the "Gulf of America".

On the surface, it seems like a pretty minor fight, given everything else the Constitutional order is up against. But, upon closer examination, it really is fight over basic Constitutional rights. As NYTimes' opinion writer Jamelle Bouie accurately characterized it at Bluesky, "your willingness to accept this gulf of america nonsense is an indication of your willingness to accept much worse things coming from this administration."

Meanwhile, over The Atlantic, Senior Editor Gilad Edelman doesn't have any such concerns, and even appears to be victim-blaming by suggesting the fight is one that "the AP probably should never have picked in the first place."

That brief article by Edelman recently touched off our guest today, longtime media critic, political strategist and writer, JAMISON FOSER, who wonders, in a recent article, who Edelman thinks he is to decide which fights are worth waging in the Trump Era and which are not.

"I think the nature of the situation that we're in," Foser tells me today, "and the breadth and depth of the ways that we are in trouble, and things are stacked against us --- an autocratic movement has control of our entire government, much of the news media, much of the ways that people get information online --- things are really stacked against us."

"We are not in a situation in which there are obvious, clear, easily discernible, winnable fights we can choose. So this idea that people should only choose fights that they can win --- I think people should choose the fights that feel right to them. We should all be doing a little less trying to police what fights other people are choosing to engage in, and more finding a place where we can stand up and pick a fight where we can," he argues.

"We will probably lose it," he concedes, "because we will probably lose most of them. But sometimes in the loss there is some value. In this one [AP's defense of First Amendment freedoms] there is some value. There's value in saying, 'We can't stop Donald Trump from ordering his government to refer to the Gulf of Mexico as the Gulf of America. But we can say we are not going along with that. It is racist, and dumb, and he can't make us say it. There's value in saying that to ourselves, in not giving in to his attempt to control the English language. And there's value in showing our fellow Americans that we are not going along with that."

In AP's case, all they were doing was following the Style Guide they have used for decades. And Edelman still characterized it as a "fight" they "should never have picked."
