It's an old cliche by now that every bad disaster movie begins with a scientist's warnings being ignored. We'll continue to hope, on today's BradCast, that California's Gubernatorial Recall election, with voting under way right now and Election Day next Tuesday, doesn't turn into a bad disaster movie...now that CA's Democratic Secretary of State seems to be ignoring the urgent warnings from a whole bunch of the nation's top computer scientists. [Audio link to full show is posted below this summary.]

Several weeks ago, polling of likely voters in the GOP's sleazy attempt to oust Democratic Gov. Gavin Newsom from office in a special recall election, suggested a dead heat on the question of removal for the otherwise popular progressive Golden State Guv. Today, more recent polling suggest Newsom is up by more than 10 points among those considered to be likely voters, according to 538's average of recent surveys, and by about 8.5 points in RealClearPolitics' round-up. That, after the very Trumpy, far-right Republican radio host, Larry Elder, has emerged as Newsom's likely replacement if the Governor loses on the ballot's first question as to whether he should be recalled.

In the meantime, as we have been highlighting over the past month, California's state election officials should be very concerned about a new security threat to the election itself following the theft of Election Management System (EMS) software made by Dominion Voting Systems. The vendor's systems are used to run elections in nearly 60% of California jurisdictions. Copies of its EMS software were apparently purloined in the middle of the night by a far-right County Clerk in Mesa County, Colorado last May before being released to the wilds of the Internet during MyPillow CEO Mike Lindell's phony "cyber symposium" last month. That release now poses "critical new risks to the recall election," according to eight of the nation's top cyber security and voting system experts. They sent a chilling, 3-page warning letter [PDF] to CA Sec. of State Dr. Shirley Weber late last week, advising her to mandate a statewide Risk-Limiting Audit (RLA) as the "one critical action" she can and should take immediately to try and mitigate against this "serious threat" which, the experts argue, warrants "emergency action" on the part of state officials.

One of the authors of that letter, DR. DUNCAN BUELL, Chair Emeritus in Computer Science and Engineering at University of South Carolina, joins us on today's show to explain the letter, the threat and the need for the SoS to take action now, rather than waiting until after Election Day.

"If the results are known first and then somebody says 'let's audit', there will always be some skepticism and some conspiracy theory that the reason for the audit is because the result came out different from somebody in power who wanted it to be a different result," Buell tells me. "You've got to mandate the audit before you have the result so the voters know that this is being done specifically for the right reasons."

He goes on to explain how the EMS software, which can now be downloaded and explored for vulnerabilities by anyone with an Internet connection, is "absolutely central to everything" when it comes to running elections on computer systems. "The EMS is almost certainly going to be configuring ballot styles --- even for hand-marked [paper] ballots, where the bubble is to be filled in, in terms of position on the page --- and it's going to be the system at the end of the day that does the tabulations. So anything that is that central is really critical."

When I ask if it's an overstatement to refer access to the EMS software as "the keys to the kingdom" when it comes to computerized voting and tabulation systems, Buell confirms: "I don't think that's an overstatement at all. That's very much the case."

Even with the recent shift in polling, suggesting a possible lead for Newsom in the Recall, Buell notes, "I don't necessarily think either side should be breathing a 'sigh of relief' because the problem really is that the election system needs to be secure, and the election process has to be done in a transparent way that voters can trust and understand. With the release of the [EMS] software, it's hard for anyone to really feel that what's going to happen is what ought to happen unless there is a statistically sound Risk-Limiting Audit conducted after the fact, just to make sure things got done right. This is a question of confidence, transparency, and the fact that we don't get to do elections over."

He offers much more insight on all of this during our conversation today, as based on his many years of experience with voting systems as both a Professor and expert witness in voting system related cases and challenges across the country. We discuss the lack of response the eight top experts have so far received from Sec. Weber in CA, and a dismissive --- and arguably naive --- statement given by her office to AP last week following the release of the letter.

"I have seen well-meaning election officials with too little skepticism and too much hubris," Buell warns. "I think that's a problem. We don't know what the results are going to be, so we don't know ground truth for what's going to come out of this recall election in California. We can't do it over. This means that, yes, all of the processes have to be rock solid. But it also argues that there needs to be a way, after the fact, to make sure that the outcome that you think you got is the outcome that you should have gotten. That's what one of these RLAs, Risk Limiting Audits, will do."

He also observers that California is lucky, in that the inventor of the RLA protocol, Philip Stark of U.C. Berkeley, is right here to help. Stark is also a signatory of the letter to Weber. He joined us on the show several weeks ago, just after the stolen Dominion EMS software was released, to explain the serious concerns at that time --- well before the national media had noticed any of this, and before CA's SoS got around to seemingly ignoring the warning and advice of the nation's top experts in the field.

Given that Donald Trump is already falsely and predictably claiming that the CA Recall is "a rigged election", as is Fox "News", it's even more imperative that Weber mandate a professional, publicly witnessed, statewide post-election audit now (as opposed to the type of scammy, secret, "audit" theater recently carried out by inexperienced, partisan, conspiracy buffoons in Maricopa County, Arizona, for instance) before the computer-tallied results of next week's critical Recall Election are known.

Speaking of fraud and conspiracy buffoons, we have a bit of fresh news this week about the slow, but still "ongoing" criminal investigation by Fulton County, Georgia District Attorney Fanni Willis into the conspiracy led by Donald Trump to try and strong-arm Peach State officials into stealing the election on his behalf last year. That probe could also end up targeting fellow conspirators Sen. Lindsey Graham (R-SC) and Rudy Giuliani.

And then we close with the really really dumb comments from MyPillow conspiracy buffoon Mike Lindell, in which he recently seems to have thrown himself under the bus on his own streaming video channel, in regards to the $1.3 billion defamation lawsuit he is currently facing from Dominion Voting Systems...

We've got quite a few updates on a number of stories we've been covering of late on The BradCast. Some of them not necessarily happy and others quite astounding. As well as some mainstream media failure, and other news from this seemingly endless Summer. [Audio link to full show is posted below this summary.]

Among the stories covered on today program...

  • Even as infections, hospitalizations and deaths continue to soar in their states, more politically ambitious Trumpy Rightwing Governors are leading their constituents on a death march by banning mask mandates by small local governments and school districts. Happily, a number of the school districts are putting the health and safety of their children above the authoritarian edicts of their Governors, as well as over the deadly demands of too many brainwashed, disinformed parents fighting to endanger their own children and themselves.
  • We've got updates today on several stories we've covered in recent weeks, including the anti-vax parents of four children in Texas, who both changed their minds about vaccinations just before they were intubated several weeks ago. Also, updates on some of the Rightwing anti-vax radio hosts who have either recently died or are now hospitalized in grave condition from COVID. Also, yet another far-right radio host --- this one a Christian broadcaster who derided COVID vaccines as "government control" on his daily "Prophecy Today" program --- has now died from...you guessed it.
  • A disturbed far-right Trumper from North Carolina brought Capitol Hill to a standstill today --- requiring evacuations from the U.S. Capitol to the U.S. Supreme Court --- after pulling his license plate-free pickup truck onto the sidewalk in front of the Library of Congress and threatening to detonate a bomb. During the 5-hour standoff with police, which thankfully ended peacefully, media outlets reviewed the man's Facebook Live-streamed rants and other videos. He reportedly railed against Joe Biden, "Nancy", "antifa" and the Democrats, demanding they all resign en masse; declared "the revolution is here" and that he is the "last generation" of those willing to stand up for America. He said that Trump will be reinstated and posted video from his participation at "Stop the Steal" and "Million MAGA March" rallies. So, how did Associated Press, at least for a time today (via the Internet Archives), lead their description of the man's politics? By claiming that in one of his videos he "said he loved the president, Democrat Joe Biden." --- Really, AP?
  • We've also got a few quick updates today on the Trump-loving Mesa County, Colorado County Clerk, Tina Peters, who, as we have been reporting in some detail over the past week, allegedly entered a secure area of the County's Election Division in the middle of the night with two accomplices last May, turned off the security cameras, and allowed two hard drives containing Dominion Voting's Election Management System (EMS) software to be copied in full. During one of her several appearances on stage last week at MyPillow CEO Mike Lindell's failed three-day "Cyber Symposium" where he didn't reveal the promised "proof" that China stole the election for Joe Biden, the extremely sensitive contents of those hard drives were released into the Internet wilds for download by thousands. That, in the middle of California's critical Gubernatorial Recall election, where some 60% of the state will rely on that same, proprietary Dominion EMS software. Peters claimed during Lindell's forum that she was being "persecuted" by CO's Democratic Sec. of State Jenna Griswold because she's a "conservative Republican". Griswold has now removed Peters from her role, as Mesa's now-former chief election official is facing a criminal probe by the County's conservative Republican District Attorney. This week, the FBI joined that investigation, as federal crimes may have been violated in the theft and release of that software. And today, VICE reports, Peters is on the lam, being sheltered in a "safe house" somewhere by the MyPillow guy (who already faces a $1.3 billion lawsuit [PDF] from Dominion himself.) Will the "persecution" never end?
  • Finally, Desi Doyen joins us for our latest Green News Report, with grim news of deadly climate change-fueled extreme weather from Haiti to both coasts of the U.S. to much of Europe; and some happier news this week from the Biden Administration...

Cybersecurity and voting system expert confirms security breach, software authenticity to BRAD BLOG, as Mike Lindell's event to 'prove' stolen 2020 election, 'reinstate' Trump goes criminally off rails

Okay. Now it's not just insane. It could also be criminal, as a leak of actual voting system software at MyPillow CEO Mike Lindell's three-day, so-called "cyber symposium" in South Dakota may have imperiled the security of the Gubernatorial Recall election now under way in California. We've got some exclusive details on today's BradCast. [Audio link to full show is posted below this summary.]

First up, before the details on what appears to have happened at Lindell's bizarre circus show in Sioux Falls, some very quick news, on the Census Bureau's release of 2020 data today and the GOP's plans to use it to gerrymander themselves into a U.S. House majority; U.S. plans to evacuate the embassy in Kabul as the Taliban retakes much of Afghanistan; Support from national teacher's unions to mandate vaccination or testing for the nation's school staff; and Rightwing radio host COVID and vaccine deniers findings themselves dead and/or hospitalized...with COVID.

Then, it's on to the 2020 "stolen election" Crazy Train still unfolding in MAGALand.

On Wednesday, a U.S. District Court judge appointed by Donald Trump, ruled that Dominion Voting Systems' $1.6 billion defamation lawsuits against Trump attorneys Sidney Powell, Rudy Giuliani and, yes, Mike Lindell, may proceed. Judge Carl J. Nichols' 44-page ruling [PDF] denied all parts of the defendants various Motions to Dismiss. Suffice to say it did not go well for them, on any front, leading former crack-addict and current phony stolen-election addict Lindell to declare the ruing "the worst decision a judge has made in the history of this country." (Which someone named Dred Scott would likely dispute.)

But the real madness has been unfolding in South Dakota this week, at Lindell's three-day "Cyber Symposium" that was promised to reveal "absolute proof" that the 2020 election was stolen through a massive, sophisticated cyberattack by China (I think.) Lindell's promised "proof" of the steal was so unimpeachable that it was to result, he's been declaring for weeks, in an immediate 9 to 0 decision by the U.S. Supreme Court to reinstate Trump to the White House this Friday the 13th!

It may not work out that way, however. The far-right newspaper Washington Times published a gob-smacking story on Wednesday, in which a cyber expert hired by Lindell himself to examine and explain the super-secret 37 terabytes of data --- said to have been captured from Internet transfers just days after the November election, revealing that China flipped millions of votes --- told the paper that the data and claims about them were illegitimate.

It's a simply coo-coo for Cocoa Puffs story --- again, from a Rightwing outlet --- detailing how none of Lindell's claims appear to be real, and seem to be sourced to a former Government contractor who was also the source of (false) claims that the Obama Administration wiretapped Trump Tower in 2016. But, as Lindell's own experts explained to the Washington Times, the data doesn't show what it is supposed to show...but that may only be because the source dude supposedly had a stroke the day before the symposium!

Lindell's expert, who says there still could be some evidence of something anyway in the data they did examine, told the paper: "We were handed a turd. And I had to take that turd and turn it into a diamond."

But now the loony toons story takes a potentially much darker turn, albeit a somewhat confusing one. Mother Jones' AJ Vicens does a fine job attempting to make at least some sense of what has happened with this part of the story over the last several days. It seems to involve an election official named Tina Peters, County Clerk of Mesa County, Colorado (who is now apparently being investigated by state law enforcement authorities), a guy named Ron Watkins, widely thought to be "Q" of the infamous Q-Anon MAGA conspiracy world, and potentially a former campaign manager for Rep. Lauren Boebert (R-CO). See Vicens for that part of the story.

The upshot is that duplicate images said to be of stolen hard drives containing actual, proprietary Dominion Voting System software, seemingly from Mesa County, was released at Lindell's Cyber Symposium and is now said to be out in the wild, as it was made available for download to pretty much anybody with the technical know-how to grab it.

This afternoon, we confirmed with legendary Finnish cybersecurity and voting systems expert Harri Hursti, who is at South Dakota conference, apparently serving as an analyst for a news outlet, that the hard drives do, in fact, contain Dominion's Election Management System (EMS) software, though not its source code, as some have reported via Twitter. As Dominion explains on its website, the EMS "Drives the entire election project through a single comprehensive database...From election definition to results reporting." It is, in short, the heart of the entire Dominion election system suite.

"What was shared were 3 different images of installed EMS systems," Hursti told me via email from Sioux Falls. "I can confirm that those were circulated for copying. It [isn't] source code as such, but part of the code is interpreted code, there is human readable and editable things there."

Hursti is well known in the voting system world, where his most notorious "white hat" hack of a Diebold voting system was revealed in HBO's Emmy-nominated 2006 documentary, Hacking Democracy; He was also featured in their 2020 Emmy-nominated Kill Chain: The Cyber War on America's Elections; and, in what may have been Hursti's first American film interview, my own with him in 2010's award-winning Murder, Spies and Voting Lies: The Clint Curtis Story. He also heads up the infamous DefCon Voting Village in Las Vegas each year, and most recently was tapped by the state of New Hampshire to oversee a very thorough, professional and transparent post-election audit to determine why the Diebold optical-scanners in the town of Windham miscounted several hundred votes in a State Representative race last November.

In other words, his credentials here are impeccable. Though what the dangers of the release of Dominion's software into the wild may be is still less than clear. Particularly as it pertains to the September 14th Gubernatorial Recall election now underway here in California. It's something that I am still trying to dig into. Dominion's EMS software is used in a number of large jurisdictions in the state, including San Diego County, San Francisco and Riverside Counties.

Earlier this week, I spoke on The BradCast with cybersecurity and voting system expert Rich DeMillo, founder of Georgia Tech's School of Cybersecurity and Privacy, about serious vulnerability concerns that have recently emerged [PDF] in a long-running federal lawsuit seeking to ban Dominion's touchscreen vote systems across the state of Georgia. How this new security breach may now come into play in either that case, here in California, or in any of the other many jurisdictions which use the same software across the nation, is unclear at the moment. One expert I spoke with this afternoon, however, said it does seem to prove yet again that "security by obscurity" (attempting to keep vulnerable software safe by keeping it a secret) doesn't actually work, especially when it comes to voting systems.

More on this story, I suspect, in the days ahead.

As Desi notes on today's BradCast, the underlying theme to our boatload of stories is that "elections matter". Then again, that seems to pretty much be our underlying theme every day on this program. Glad she's finally noticed! [Audio link to full show is posted below summary.]

Among the too-many stories covered on today's show...

  • Democratic Gov. Andrew Cuomo finally resigns amid his sexual harassment scandal. Lt. Gov. Kathy Hochul will become New York's next Governor and the first woman to serve in that role;
  • $1 trillion bipartisan infrastructure bill finally clears the U.S. Senate with a 69 to 30 vote (including 19 Repubs voting in favor with all of the Dems.) It's a big early victory for President Biden's "Build Back Better" agenda and a feather in his cap. But there's a long way to go still, including an eventual vote in the House and, most importantly since everything hinges on it, agreement among Dems on the much larger $3.5 trillion, Dems-only reconciliation package paired to go with it. But, for now, so far so good;
  • Pandemic horrors continue to worsen in the U.S., despite easy availability of free, safe and effective vaccines to prevent it. The most devastated states are run mostly or completely by Republicans. Arkansas had just 8 ICU beds available in the entire state as of Monday, according to Republican Gov. Asa Hutchinson, after throwing away 80,000 unused vaccine doses last week. Mississippi had 0 ICU beds open and more than 200 patients waiting in ERs for a room, with all numbers heading straight up. Louisiana hospitals have returned to the bad old pre-vaccine days, but Democratic Gov. John Bel Edwards is "praying and fasting", so that should help. Florida is smashing their pandemic records with hospitalizations at an all-time peak and young, healthy and unvaccinated residents now dying (many from the same church over the past two weeks.) At the same time, Texas is halting elective medical procedures and begging out-of-state health care workers to come to the state. But the Republican Governors in both TX and FL are banning school districts from requiring masks for staff and children (who, under 12, cannot be vaccinated!) in the new school year. Two of the largest districts in Texas are, thankfully, defying Gov. Greg Abbott's authoritarian order. Several districts in Florida are doing the same in response to Gov. Ron DeSantis, who is now threatening to withhold salaries of Superintendents and School Board Members who ignore his tyrannical and deadly edicts;
  • In Wisconsin, where a Democratic Governor presides along side a gerrymandered GOP-controlled state legislature, Gov. Tony Evers vetoed several Republican absentee ballot voter suppression laws today, which would have affected disabled and elderly voters in particular, and challenged the state Assembly's schemes to carry out an Arizona-style post-election "audit";
  • Speaking of 2020 denialism, Dominion Voting Systems filed three more defamation lawsuits today, seeking $1.6 billion in damages each, against wingnut news outlets Newsmax and One America News Network (OANN), as well as Trump MAGA billionaire Patrick Byrne, the former Overstock CEO and a major financier of the AZ Audit and huckster of 2020 denialism and fetishist merchandise and media. Today's new legal complaints, filed in federal court, are in addition to previous similar ones filed against Trump attorneys Rudy Giuliani and Sidney Powell, as well as MyPillow CEO Mike Lindell and Fox "News". (Ever wonder why these "news" organizations are being sued by voting machines companies, but we haven't been, despite our nearly-20 years of critical reporting on them? There's a reason for that, as we also discuss today.);
  • And, speaking of the MyPillow Guy, CNN's Drew Griffin took apart his "Absolute Proof" of election fraud in an investigative report late last week. Even as Griffin made a few errors himself, suffice to say it didn't go well for MyPillow Guy, who is also reportedly having a tough time today kicking off his three-day "Cyber Symposium" in South Dakota, after which he has promised his "absolute proof" will result in a 9 to 0 decision by the U.S. Supreme Court to reinstate Donald Trump before the month is out! Sounds plausible;
  • Finally, Desi Doyen joins us for our latest Green News Report, as the U.N. declares "code red for humanity" in its latest assessment by the Intergovernmental Panel on Climate Change (IPCC), while apocalyptic wildfires and drought play out around the world at the very same time from Northern California to Greece. What an elaborate "hoax"!

Guest: Richard DeMillo of Georgia Tech's School of Cybersecurity; Also: New UN climate report warns humanity faces 'unprecedented' danger...

Today on The BradCast, it's both "Code Red for humanity", according to the authors of the new report released today by the UN's Intergovernmental Panel on Climate Change, synthesizing some 14,000 climate studies from the past 8 years. And it's also "code red" for American elections, most immediately, here in California. [Audio link to full show is posted below this summary.]

New polling out last week finds that the otherwise ridiculous Republican attempt to recall Democratic Gov. Gavin Newsom is now supported by some 46% of those polled. In short, the effort to remove the Governor (for reasons nobody can quite explain, other than Republicans can no longer win regular statewide elections in the state) is now a dead heat. Who would replace Newsom if he's recalled? That is also unknown, as scores of Republicans are vying for the position, should voters choose "Yes" to recall the Governor on Question 1 of the ballot on September 14th. If a majority of voters do vote "Yes", then whoever wins on Question 2 on the ballot becomes the next Governor of the most populous state in the nation.

So, the stakes are pretty high. Which is just one of the reasons that it is so troubling that some of the largest counties in the state, including Los Angeles, San Diego and Riverside, all offer voters 100% unverifiable touchscreen voting systems when they vote in person at the polling place.

The good news is that, due to the pandemic, the Secretary of State is sending all registered voters a hand-marked paper Vote-by-Mail ballot for the Recall. The bad news is that many voters, for various reasons, will use those unverifiable touchscreen Ballot Marking Device voting systems at the polling place instead. If enough of them do, it will be strictly impossible after the election to know if any of the computer-marked ballots printed by them actually reflect the intent of any voter.

The further bad news is that an ongoing federal lawsuit in Georgia, where plaintiffs hope a federal judge will permanently ban the state's brand new touchscreen computer Ballot Marking Device (BMD) voting systems made by Dominion, has recently produced some disturbing news. One of the nation's top voting systems and cybersecurity experts, J. Alex Halderman of University of Michigan, hired by plaintiffs Coalition for Good Governance, has been given access to the Dominion ImageCastX systems used across the state, and his findings are reportedly so troubling, that the federal judge in the case has sealed his report, even from the plaintiffs themselves!

Last week, in a public declaration [PDF] in the case, Halderman warned his testing of those very systems "has shown that the BMDs used in Georgia suffer from specific, highly exploitable vulnerabilities that allow attackers to change votes," in a way that the state's mitigation techniques will not prevent. He says that his findings must be "urgently" reviewed by both the Sec. of State in Georgia as well as Dominion. But neither is allowed to see his report under the judge's seal, and neither has filed a motion to ask the Court to unseal it for them.

As my guest notes today, apparently they'd rather not learn about the vulnerabilities in their own systems. "If the report has anything approaching the level of vulnerability that Alex describes in his summary report, they would have to do something about it. So not knowing anything about it, gives them some breathing room" to try and figure out what they should do next, he tells me.

Why is this a problem for California? Because it is one of several states where some counties use the exact same system made by Dominion. Both San Diego and Riverside use the Dominon ImageCastX system at the polling place, where voters could end up removing the Governor in just over a month. Next door, in Los Angeles County, a similarly unverifiable touchscreen Ballot Marking Device is now used at the polls.

Moreover, a study that Georgia's Sec. of State carried out last November, to determine if voters actually bother to review their computer-marked ballots printed out by the touchscreen systems before casting them, found that almost none of them did. The results of that study were kept secret by GA's Sec. of State Brad Raffensperger, and only released last week, after the Atlanta Journal Constitution obtained the results via GA's Open Records Act.

So what could all of this mean for California? Should anyone be surprised by either the results of the GA Sec. of State's study or the troubling findings by Halderman? Should these unverifiable and vulnerable BMD voting systems ever be used by any voter in an American election (other than disabled voters who may choose to use an assistive device)? And, by the way, is there any evidence that these systems may have somehow stolen the very close election for Joe Biden over Donald Trump last year in Georgia?

We're joined today by longtime cybersecurity and voting systems expert RICHARD DEMILLO, founder of Georgia Tech's new School of Cybersecurity and Privacy. He offers some cold, hard, well-informed thoughts on these systems and why Halderman's report may have been sealed by the federal judge in Atlanta. He also offers advice on whether voters in California, Georgia or any other state should ever choose to vote on one of these systems when the option of using a hand-marked paper ballot is available to them.

"The more machines you use, the more likely it is that they're going to be hacked. It's just a matter of numbers. The machines are vulnerable. There are people that are adversarial that want access to the machines. The more you make it available to them, the more likely it is that they'll be used that way," states DeMillo. "You're opening yourself up to a lot of risk that seems to be unnecessary."

In the meantime, should voters and election officials in California --- including in Riverside and San Diego, where the same unverifiable and vulnerable Dominion systems are used, as well as those in Los Angeles, where a very similar touchscreen system is now forced on all voters at the polling place --- be concerned about the new, court-sealed findings in Georgia?

DeMillo offers several, unequivocal answers. But, in short, yes, we should all be alarmed.

DeMillo also offers his thoughts on the MAGA argument that Georgia was stolen last year, and says that after requested by CNN to review MyPillow Guy Mike Lindell's "absolute proof" that the election was stolen from Trump (in what turned to be a brutal takedown for Lindell) he finds the only "absolute proof" Lindell offered is that he has absolutely no idea how elections actually work. "Literally, every word that comes out of his mouth about elections and whether or not they were hacked and how they were conducted, is simply contradicted by facts," DeMillo tells me. "There are other things to think about in election security, but that's not one of them."

Finally, we close with a few words (more to come later this week!) on the climate disaster now unfolding in places like Evia, Greece, where thousands were evacuated by passenger ferry overnight this weekend, hoping to outrun massive wildfires amid record heat that has now reportedly destroyed thousands of structures. That, on the same day that the IPCC warns our man-made climate crisis is now "unprecedented" and unfolding even quicker than scientists had predicted only a few short years ago...

Will we ever escape the 2020 "Big Lie"? Maybe. But it's gonna take a while. That said, we've got some very good news on today's BradCast about the next "Big Lie" 2020 ballot audit! [Audio link to full show follows this summary.]

But, first up today, GOP pollster Frank Luntz appeared on a podcast this week to offer some sage insight about the 2022 elections. We would caution you to take it much of it with some very large grains of salt! Among the points he made, which we discuss (dispute) today: Trump's "Big Lie" is working to con his supporters, but that may cost the Republican Party some wins in the House and/or Senate next year, because, as Luntz claims, voters don't turn out if they believe their vote doesn't count. We explain, based on our own 20 years or so on this particularly beat, why Luntz is probably very wrong and why Dems would be making a huge mistake to take too much comfort from his point on that. Luntz is also dangerously wrong about what he beliefs will happen if Trump becomes the nominee for President in 2024, as we also discuss.

Then, the far-right cable outlet Newsmax has issued a statement apologizing for its false "Big Lie" claims that the 2020 election was stolen for Joe Biden by the Dominion Voting Systems company and, specifically, by its Director of Product Strategy and Security, Dr. Eric Coomer. He sued the wingut outlet for defamation last December, naming the Trump Campaign, Team Trump attorneys Rudy Giuliani and Sidney Powell, and even farther rightwing outlet, One America News Network (OANN) as defendants as well.

All of them had forwarded baseless claims that Coomer was on a conference call with "Antifa", promising to steal the election for Biden. Seriously. That's what they claimed. It was an absurd charge that nonetheless was repeated and reported over and again in MAGA Land after they were confirmed as losers in the November election. It resulted in death threats and doxxing for Coomer, his family, his co-workers, etc. Newsmax has now admitted their reporting was false, and that they have no evidence to support Dominion or Coomer having stolen anything.

Newsmax has now been removed from Coomer's lawsuit in exchange for the public apology and an undisclosed sum of money. Looney Toons MyPillow CEO Mike Lindell, however (who is being sued by Dominion for $1.3 billion [PDF]), can't seem to sleep at night now. He is furious about the development, and is now reportedly calling on the MAGA Mob to boycott Newsmax and watch OANN instead because Newsmax caved...by telling the truth.

Next, taking a break (mostly) today from our recent in-depth coverage of the clown show "audit" theater playing out in Maricopa County (Phoenix), Arizona, we move to the next post-election audit of 2020 ballots demanded by the MAGA Mob. This one will now be in Windham, New Hampshire and will be very different from the non-transparent shell-game being carried out largely in secret by the clueless, experience-free Cyber Ninjas nitwits and cretins in Phoenix.

In Windham, a November recount of four local state Representatives races were found to have been off by about 300 votes from the initial tally. That, of course, is cause for concern [PDF]. Particularly since the town still uses really old, easily-manipulated, oft-failed Diebold AccuVote optical scanners to tally voters' hand-marked paper ballots. (Their systems are also programmed and maintained by a disreputable company named LHS Associates.)

The reason for the discrepancy in the state Rep results is apparently still unclear. This has led the MAGA Mob to believe they've finally found evidence that the election was stolen from Trump (somehow) and --- in his best fat, sad Jake LaMotta at the end of Raging Bull impression --- led Trump during a wedding at Mar-a-Lago over the weekend to declare "massive election fraud" has been discovered in NH, which he was certified to have lost by about 59,000 votes.

But, here's the fun twist! The Windham audit will not be overseen by Cyber Ninja clowns with no experience in elections or voting systems. Longtime post-election audit expert Mark Lindeman, Ph.D., who currently serves as Acting Co-Director for the non-partisan, non-profit voting system watchdog, Verified Voting, has been tapped to run the audit. In turn, two longtime friends of both The BradCast and The BRAD BLOG, whose expertise for this audit is unparalleled, have also been tapped to work on it.

UC-Berkley's math professor Philip Stark, who invented the Risk-Limiting Audit (RLA) protocol, tells me that he is now on board. BradCast listeners may remember him as a guest on this show. Also now on board is the legendary Finnish cybersecurity and voting systems expert, Harri Hursti. He is the first known hacker of a Diebold optical-scan system, as witnessed in the climactic final scene of HBO's Emmy-nominated 2006 documentary, Hacking Democracy (along with our guest from this past Wednesday's show, veteran Florida election official, Ion Sancho), and as the central figure in HBO's chilling 2020 follow-up to that doc, KILL CHAIN: The Cyber War on America's Elections. Moreover, Hursti is one of the organizers each year of the Vote Hacking Village at DefCon in Las Vegas and was first interviewed by myself in the award-winning 2008 documentary Murder, Spies & Voting Lies: The Clint Curtis Story.

These are serious experts in the field, and hopefully will result in a serious examination of whatever went wrong in Windham in this past election --- even if it's unlikely to uncover that the election was stolen from Trump. Whether the MAGA Mob, who were elated about the Windham audit initially, will be as happy about the serious, non-hack professionals running it remains to be seen. So far, they are not.

Guest: Election integrity advocate, journalist Jennifer Cohn on newly discovered ES&S, EAC failures; Also: Biden endorses filibuster reform...

On today's BradCast: While Team Trump spent months pretending the Dominion Voting Systems company stole votes from Trump and flipped them to Biden with their computerized voting and tabulation systems, there is exactly zero independently verifiable evidence to support that baseless conclusion. At the same time, however, recently unearthed documents from the state of Texas and the U.S. Election Assistance Commission (EAC), reveal a gaping security hole in new systems made by the largest voting system company in the nation, Election Systems and Software, Inc. (better known as ES&S), which has systems deployed in dozens of states. [Audio link to full show is posted below summary.]

But, first up today, some annoying (if long overdue) news that Donald Trump finally made it clear(ish), during a Tuesday interview on Fox "News", that he recommends his own supporters should, indeed, get vaccinated against COVID. He cites the "great" and "safe" vaccines that are now available, describing them as "something that works" to prevent the deadly disease. We hope his supporters listen, since they are currently the most disinclined to want to get vaccinated.

Next, some long overdue encouraging news on the Senate legislative filibuster. In a Tuesday interview with ABC News, President Biden --- a longtime Senate institutionalist previously opposed to filibuster reform --- said he now favors it being overhauled. He says he supports a modification to bring back the "talking filibuster", where obstructionists are forced to hold the floor and keep speaking until they can't anymore. That would place the onus on the minority hoping to block legislation, rather than forcing Democrats, in this case, to try and find 60 votes to pass anything at all. Republican Minority Leader Mitch McConnell, who had no problem unilaterally killing the filibuster entirely to steal and pack Trump nominees onto the U.S. Supreme Court, now vows to grind the Senate to a halt if Dems dare change the legislative filibuster. But, of course, McConnell has already done that with his unprecedented use of the legislative filibuster to block everything! We discuss.

Then, on to our main story today. Shortly after the November election last year, Donald Trump and his gaggle of dopey friends and clueless, corrupt attorneys hatched an evidence-free conspiracy theory that Canadian-based Dominion Voting Systems had participated in an elaborate plot to secretly flip votes and steal the election for Biden. (The theory was based in part on my accurate, deep-dive exclusive investigative reporting from 2010, regarding some voting system vendors --- though not Dominion --- who then had ties to Venezuela and its then living President, Hugo Chavez. Team Trump bastardized that reporting to pretend it had something to do with their dumb theory that Dominion stole the 2020 election from Trump.) Dominion has since sued Team Trumpers Rudy Giuliani, Sidney Powell, and MyPillow CEO Mike Lindell for defamation, slapping them with suits for $1.3 billion each. Last week, news out of Stark County, Ohio and out of Louisiana proved that Dominion is, in fact, being financially harmed by the fraudulent "fraud" plot used to try and discredit them.

But the nation's largest voting machine company, ES&S --- with a years-long, thuggish reputation according to elections insiders, along with a long history of failed elections on their crappy, computerized voting and tabulation systems --- largely escaped scrutiny by Republicans after last November's election. But they shouldn't have, given the disturbing, well-supported, deep-dive exclusive that election integrity advocate and Twitter phenom JENNIFER COHN broke last week at Who, What, Why. She joins us today to explain both her well-sourced report and its far-reaching ramifications.

As it turns out, she reports, there is a flaw in ES&S' installation process that prevents "hash-verification" when software is installed or patched onto their ExpressVote touchscreen voting systems. What that means, in layman's terms, is that its impossible to know if the software installed onto the systems actually matches the certified version of the software that was tested by federal testing authorities under the purview of the U.S. Elections Assistance Commission.

This gaping hole --- discovered by the state of Texas in advance of last November's election --- means that untested, modified software, perhaps containing malware, could potentially have been installed onto ES&S' systems in more than a dozen states last year. Even more maddening is that ES&S was well aware of this flaw, but told elections officials (if they happened to notice the failed hash test) that it was nothing to worry about, nothing to see here, everything is fine --- just trust us.

"The strong implication from the documents which were produced is that [ES&S was] telling them that a mismatch should just be treated as a match," Cohn tells me. "That blanket instruction really concerned the Texas examiners when they found out this was happening."

More maddening still, as Cohn reports, is that ES&S forces jurisdictions to allow their own employees or contractors to do these installations, rather than allowing jurisdictions to do so themselves, which might allow local or state officials to do their own hash-verification (or "acceptance testing", as it is known by some in the industry). Some jurisdictions that refuse to allow ES&S to do the installation will have their warrantees void by the company. As one former voting system employee tweeted in response to all of this, it is "like buying a new home and before the closing the seller says, 'You don't need a final walk-through. Just trust me."

"Normally, the customer is supposed to do it. The whole point of it is to make sure that the vendor is being honest and they're not giving malicious vote-flipping software. So to have the vendor do the hash testing themselves defeats the whole point," Cohn explains. "One of the examiners called it 'the fox guarding the henhouse', and said it was ES&S self-certifying their systems. Even the attorneys for the Texas Secretary of state were appalled."

Cohn's reporting at Who, What, Why is based on a passel of documents obtained via public records requests that reveal, for example, a troubled Texas election examiner complaining via email to their Secretary of State's attorney that this security flaw is "a gift wrapped opportunity to an insider threat," before going on to add: "It’s similar to a bank robber knowing that the camera covering teller #3 is broken."

In addition to Texas, ES&S systems used last year in Alabama, Arkansas, Arizona, Washington, DC, Florida, Iowa, Idaho, Indiana, Kansas, Kentucky, Maryland, Michigan, Missouri, Ohio, Tennessee, Washington state, Wisconsin and Wyoming may all have been similarly vulnerable to running modified, vulnerable and uncertified software during the election, as Cohn details in her report, explaining today that it could be as many as 35 states.

And, as if all of that is not yet maddening enough, she also reports on the disturbing reaction from the EAC to this gaping security hole. The federal agency which is supposed to oversee voting system certification, apparently knew about this issue prior to the election, but failed to inform the public and quietly helped patch it all over for ES&S before, essentially, lying about it all once Cohn started asking questions in February. The EAC, as we have reported at The BRAD BLOG for years, has a long and troubling history of protecting private voting system vendors rather than the voters they are supposed to be watching out for.

When the EAC learned about it, Cohn says, they were "in kind of a panic, I think, because if it had leaked out, they couldn't honestly say they knew what had been installed in those states was what it was supposed to be."

So, is any of this related to why Team Trump focused their phony, evidence-free complaints almost exclusively on Dominion, while ignoring well-documented problems with ES&S almost entirely? We discuss that and much more with Cohn on today's --- yes --- maddening BradCast, where she also notes that, despite Texas officials being as troubled as they were by all of this, "I don't think that anybody ever said, 'Why don't we use pens? They don't require hash testing.'"...

There was so much news over the weekend and into Monday that it began to feel a bit like the Trump Era again. Don't worry! It ain't. But it sure felt like it trying to get caught up on today's BradCast. (Or maybe it was barely making it on air in time after we learned the catalytic converter had been stolen from our Prius. Apparently, that's now a thing!) [Audio link to full show is posted below summary.]

Among the stories covered at the top of today's show:

  • The U.S. reached the grim milestone of 500,000 confirmed deaths due to COVID-19, the disease which our failed former President had told us would simply "disappear like magic" when the weather warmed last year in Spring. Turns out he was genocidally wrong.
  • Speaking of Donald Trump the failure, it looks like he's finally run out of options to prevent his accounting firm, Mazars USA, from turning over subpoenaed tax and other financial documents to Manhattan District Attorney Cyrus Vance, Jr.'s criminal investigation into Trump's hush money payments to Stormy Daniels and into other allegedly fraudulent tax and loan schemes. The U.S. Supreme Court --- yes, even those in the stolen and packed seats filled with Trump appointees --- denied the disgraced former President's final appeal on Monday.
  • And, speaking of Trump-related frauds, his buddy Mike Lindell, the CEO of MyPillow, was sued today by Dominion Voting Systems for more than $1.7 billion dollars, in just the latest example of attempted accountability for the suckers who played along with Trump's Big Lie that the 2020 Presidential election was stolen by computerized voting and tabulation systems. Lindell, the wingnut Trump suckup who produced a silly documentary called Absolute Proof (which, as I explain, appears to contain everything but that), has ignored the private voting vendor's prior legal warnings to cease and desist his false claims alleging that Dominion's systems were used to steal the election for Joe Biden. Monday's Dominion suit against Lindell [PDF] is just the latest. The company previously sued Trump attorneys Rudy Giuliani [PDF] and Sidney Powell [PDF] for the same amount in each suit. Another company, Smartmatic --- which has only one contract in the U.S. (here in Los Angeles County, not in any of the battleground states) --- was similarly targeted by Team Trump's Big Lie, as they re-imagined a BRAD BLOG exclusive from 2010 to support their evidence-free claims. They have recently sued Fox "News" [PDF], several of their hosts, as well as Giuliani and Powell for $3.7 billion. We suspect there are still more such suits to come.

Then, as Texas finally begins to thaw out from a massive winter storm that knocked out power and water to millions in the state last week (thanks to the Lone Star State's deregulated system that left it up to private power utilities to decide if they wished to winterize their systems --- they held onto their profits instead, go figure!), it is, once again, the most poor and disenfranchised minority communities who are likely to have the most difficult time recovering. As is too often the case after such disasters, communities of color are likely to pay the biggest price for it.

We're joined today by DR. ROBERT BULLARD, Distinguished Professor at Texas Southern University, author of some 18 books, co-chair of the National Black Environmental Justice Network, and known as the "Father of Environmental Justice". Bullard himself was a victim of last week's power failures in Houston for several days.

"Texas prides itself on being the Lone Star State," he tells me. "But this severe weather event and the power outages and loss of water, has shown us that we are the ALONE Star State. Our energy policy of go it alone, keep the federal government out, doesn't make any sense. And it's never made any sense. We need to re-join the United States [and] rejoin the grid."

"They planned it on the cheap. These [Texas] officials had the nerve, they had the gall to say 'Oh, it's the windmills causing the problem.' In Texas, we have privatized the energy system to the point where people gambled --- they gambled and lost," he says.

Bullard explains the concept of "Environmental Justice" in layman's terms for us, as the need to overcome decades of redlining and poverty that has resulted in a disproportionate impact on minority communities when it comes to pollution, natural disasters and climate change itself. We discuss the "cascading threats that are pushed into certain communities. That's the double whammy, the triple whammy --- what the medical folks call 'co-morbidity', but we call it 'You get hit with everything damn thing!'" He adds: "How these things intersect, it means that these communities are limited when the lights go out, limited in terms of their ability to bounce back. This, for communities that are struggling with a challenge, with a disaster, and the disaster that will unfold when they get these big bills, when the shutoffs come."

On the positive side, however, on the same day that Joe Biden's Attorney General-designate Merrick Garland cited "communities of color and other minorities [who do not have equal justice and] bear the brunt caused by pandemic, pollution and climate change," during his Senate confirmation hearing, Bullard is optimistic. He says he is encouraged by the new Biden Administration's promises to tackle systemic racism and the need for environmental justice.  "These issues were on the ballot in November and we won," Bullard asserts. "We won on policies and platforms that brings justice at the center. Not a footnote, but a headline.  Environmental justice, climate justice, economic justice, racial justice, energy justice, health justice. JUSTICE is the headline"...

Now that Trump is safely out of office, as my guest on today's BradCast argues, Congress needs to "get back in the game" to reform the National Emergencies Act now, so it cannot be so easily abused by yet another President. [Audio link to full show is posted below.]

But, first up today, we pick up on a study we cited on yesterday's show finding that, in 16 developed countries examined over the past 50 years --- from the U.S. to Australia --- tax cuts have had no effect whatsoever on either jobs or Gross Domestic Product. The only thing they have done, however, is make the rich richer and increase economic inequality in countries that institute them.

In that vein, a new piece from the New York Times David Leonhardt reports on economic data finding that the U.S. economy has done better by every measure --- from jobs to GDP to incomes and even stock prices --- under Democratic Presidents than Republicans for the past 90 years. Going all the way back to FDR, the economy has grown at an average annual rate of 4.6 percent under Democrats and just 2.4 percent under Republicans. That means, as Leonhardt notes, that "The average income of Americans would be more than double its current level if the economy had somehow grown at the Democratic rate for all of the past nine decades." But why is that? We discuss. (HINT: It has to do with Dems heeding economic and historic lessons, such as using government resources to invest in flagging economies during recessions, versus the GOP's only apparent economic strategy for both good times and bad --- tax cuts!)

But, with Joe Biden now safely in office and Democrats finally in control of both Houses of Congress, things are, surprisingly enough, working out very well for a change...for now...after just two weeks. Years of Post Traumatic Democrat Syndrome, however, has left us waiting for that to change for the worse at any moment. Nonetheless, before that happens, what other lessons can be learned from the previous, disastrous Administration?

We're joined today by ELIZABETH GOITEIN, co-director of the Liberty and National Security Program at NYU's Brennan Center for Justice. Back in 2018, with a report at the Brennan Center and a disturbing landmark article for The Atlantic on "The Alarming Scope of the President's Emergency Powers", Goitein scared the hell out of a lot of us, when she warned of the dangers of the National Emergencies Act and the extraordinary powers it affords to the White House. The Act --- ironically enough, enacted by Congress, in theory, to rein in Presidential emergency powers --- "unlocks powers contained in more than 100 different provisions of law," as she recently discusses again at Politico.  However, "Since the law’s enactment in 1976, presidents have declared 69 national emergencies; 39 remain in effect today," she explains.

One of those "emergencies," a phony one, was Trump's declaration at the border with Mexico, used to steal money appropriated to the U.S. Military in order to build his wall, after Congress expressly voted against it. Another one might have been a national emergency declaration that we now know --- thanks to some stunning reporting by Axios yesterday --- that Team Trump loons Sidney Powell, Rudy Giuliani and Mike Flynn were encouraging him to declare during an absolutely bonkers (and frightening!) White House meeting in December. They were hoping he'd invoke the act in order to impound Dominion Voting Systems machines and somehow use them to steal the election from Biden.

Goitein argues that after the last four years offered a very clear demonstration of how Presidents can abuse these emergencies powers, now is the time to reform the "under a president who seems more inclined to rescind bogus emergency declarations than issue them." On today's show, she explains how that can responsibly be done by Congress.

"I think there is an understanding that this administration is our chance --- and it's a chance that we must seize - to shore up the guardrails on our democracy. Emergency Powers has been part of that conversation, and I hope and trust that it will continue to be," she tells me. "Many of those laws absolutely need to be revisited and reformed to be made more narrow. There's absolutely no reason why, in a national emergency, the President should be able to take over radio stations. And the fact that by merely declaring a threat of war, the President could potentially even take over the Internet in this country is horrifying."

At the same time, however, new Senate Majority Leader Chuck Schumer is now calling on President Biden to invoke an emergency declaration to take action on our worsening climate crisis, which, as Schumer argues, would allow him to do "many, many things under the emergency powers of the President...that he could do without legislation," in order to get around Republican denialism and intransigence in Congress. Is that a good idea? Is it justifiable? Is it even possible under the National Emergencies Act, reformed or otherwise? Goitein recently responded to some of those questions at WaPo. We discuss them with her today, along with her revelations about some of her worst fears that Trump might have carried out under the existing powers.

Finally, it seems that the loony wingnut MyPillow CEO, Mike Lindell, is having trouble selling both pillows right now and his evidence-free claims that Dominion voting machines were used to steal the election from Trump. We share an hilarious clip of Lindell trying --- and failing miserably --- to make his case, even on the far-right NewsmaxTV, after the voting machine company has issued very serious legal warnings to both Newsmax and Lindell that they intend to sue for defamation if they continue to libel the company. After $1.3 billion lawsuits filed against both Powell [PDF] and Giuliani [PDF], Newsmax appears to be taking that threat very seriously. Lindell? Not so much!...
