Attorneys from the watchdog group, Citizens for Responsibility and Ethics in Washington (CREW), including a retired federal judge, have now filed an Amici Curiae Brief [PDF] (friends of the court brief) in the 11th Circuit Court of Appeal in relation to the stolen classified documents case (United States v. Trump).

The case was recently dismissed by U.S. District Court Judge Aileen Cannon, a Donald Trump appointee, who contended that Attorney General Merrick Garland did not have the power to appoint Jack Smith as Special Counsel. In the view of former Acting Solicitor General Neal Katyal, the "devastating" 81-page brief [PDF] Smith filed in conjunction with the government's appeal of that dismissal order, suggests a near certainty that Cannon's dismissal order will be reversed by the appellate court.

While Smith may have been constrained by DOJ policy not to seek Judge Cannon's removal in his motion, CREW isn't so constrained...

The quote in the headline for today's BradCast comes, according to one of our guests today, from former acting Solicitor General Neal Katyal, who knows quite a bit about both Constitutional crimes and American history. Finally, Donald J. Trump is facing accountability for his worst (known) crime of all: Attempting to overthrow American democracy itself by stealing a Presidential election from the American people before our very eyes. Luckily, he was as bad at that as he is at everything else. [Audio link to full show follows this summary.]

"This is a momentous legal event. It's the most significant legal event of our lifetimes, one of the most significant legal events ever in the history of this country. It is up there with Marbury vs Madison, Brown vs Board of Education, Dred Scott as a defining case for the times," Katyal told MSNBC after the new indictment against the the disgraced former President was handed up in D.C. yesterday. "This indictment lays out a case that a guy who was President of the United States --- while he was President of the US --- leveraged his office, used his power to thwart the will of the people in the most solemn thing they do in our country, vote. This is the biggest constitutional crime in our history."

We're joined today discuss that crime and Trump's latest indictment (his third in four months, and his second at the federal level) for it by two favorite BradCast special coverage guests. HEATHER DIGBY PARTON is the award-winning columnist at Salon and founder of Digby's Hullabaloo blog; and our old friend "DRIFTGLASS" is otherwise known as both @Mr_Electrico on Twitter and simply "Bill" at home in "Flyover Country, Illinois" where he has long and proudly produced The Professional Left Podcast.

Following the release of Special Counsel Jack Smith's new, very readable 45-page indictment [PDF] against Trump just minutes before airtime on Tuesday --- including four felony fraud, obstruction and conspiracy charges related to his attempt to steal the 2020 election before, during, and after the January 6, 2021 insurrection he incited at the U.S. Capitol --- we've had a bit of time to finally read the charges and evidence presented with them in full.

Also, we've had some time to learn about the judge assigned to the case, U.S. District Court Judge Tanya Chutkan. And, boy howdy, is Trump not gonna like her. She was appointed by President Obama, has been particularly tough on January 6 insurrectionists, and famously (and correctly) wrote, in a 2021 ruling allowing the bipartisan House Jan. 6 Select Committee access to documents from the Trump White House that "Presidents are not kings, and Plaintiff is not President."

As noted, he's not gonna like her one bit. Oh, well. Perhaps it balances out the Trump-appointed federal judge/stooge overseeing his federal indictment on 40 felony charges related to his theft and retention of national security documents and his attempts to obstruct the government's investigation and attempts to retrieve them down in Florida.

Among the topics discussed with "Digby" and "Driftglass" on today's special coverage...

  • Why it took so long to bring this case, particularly as so much of it had already been revealed by the House Jan. 6 Committee last year.
  • What either struck or surprised them about the new indictment.

Democracy had a good night in Georgia on Tuesday night, before facing a brand-new nightmare by Wednesday morning at the far-right U.S. Supreme Court. We cover both on today's BradCast. [Audio link to full show follows this summary.]

The final votes of the 2022 midterms have at last been cast --- though some counting and recounting remains --- and Georgia's Democratic Sen. Raphael Warnock has been re-elected to his first full 6-year term in the U.S. Senate. His apparent defeat of Herschel Walker, loser Donald Trump's personally selected candidate in Tuesday's runoff election in the Peach State, caps a string of contests that the GOP arguably could have or should have won across the country in a midterm year like this one. But they chose to go with the far-right, loony-tunes candidates preferred by the disgraced former President instead.

After picking up a Senate seat this year, Democrats are set to hold an outright 51 to 49 majority in the upper chamber beginning in January, even as they narrowly lost their majority in the U.S. House. We discuss what all of that is likely to mean and review several remarkable historic milestones for Democrats in this year's anything-but-red-wave midterms.

After a late night of celebration, it was an early morning of worry, as the U.S. Supreme Court heard Moore v. Harper. We have long warned of the dangers of this case for American elections as we know them. The dispute comes from a challenge filed by North Carolina Republicans after the state's Supreme Court nixed partisan U.S. House maps gerrymandered by the state's GOP legislature. The state court ordered new, fair maps to be drawn instead for 2022, when Republicans and Democrats would evenly split the state's 14 House Districts, winning seven seats each in the closely divided state.

But state Republicans sued, arguing a novel, never-before-approved-by-SCOTUS legal theory they've recently discovered in the U.S. Constitution's Elections Clause called the "Independent State Legislature" theory. They argue that the Constitution mandates that state laws regarding federal elections may be created only by state Legislatures and that no judicial review by state courts is allowable.

That means, as argued in Moore, that partisan-gerrymandered Legislatures may create election laws that cannot be vetoed by Governors or overruled by state courts or constitutions. The theory holds that even voter-approved ballot initiatives could suddenly be found unlawful and those same state legislative bodies could also select whoever they wish to be Presidential Electors no matter who state voters actually selected. It is just that insane. But it's actually in front of a corrupted, stolen and packed right-wing SCOTUS on which a radical majority may offer its blessing.

"The blast radius from their theory would sow elections chaos," warned former acting Solicitor General Neal Katyal, one of the three attorneys who argued on behalf of respondents to NC's Republican petitioners, "forcing a confusing two track system with one set of rules for federal elections and another for state ones" with "case after case" being brought before SCOTUS challenging long-established election laws in all 50 states as adopted over the past 233 years.

Gerrymandering expert and author DAVID DALEY of FairVote was in the Courtroom to witness the proceedings at SCOTUS Wednesday morning and joined us this afternoon from the U.S. Capitol to help unpack it all.

"The consequences for this case are seismic," Daley warns. "This is yet another case that could shake the very foundation of our democracy if the court were to find that state legislatures face no constraints, either from a Governor's veto or from a state constitution, or the state Supreme Court, in how they create election law, how they certify elections, how they draw redistricting maps. It would give these state Legislatures complete, unfettered power to effectively do as they will. And that is a terrifying prospect."

We discuss what he describes as the "bonkers" ISL theory and whether, as AP argued today in its coverage, Daley agrees that there were "at least six Supreme Court justices" who "sound skeptical of making a broad ruling that would leave state legislatures virtually unchecked when making rules for elections for Congress and the presidency."

Says Daley, based on what he witnessed at the High Court this morning: "I would say that there were three Justices who were opposed --- the three liberals, Jackson, Sotomayor and Kagan. There were three who seemed very much on board in Thomas, Gorsuch and Alito. And there were three that I would define not as 'skeptical' but as 'Independent State Legislature-curious'. And I don't think they were looking for a way to knock a bonkers theory down."

Survival of the republic may now hinge on a wide-ranging criminal probe...

It's bad enough that the U.S. Department of Justice (DOJ), based upon deeply flawed opinion memos, issued by its own Office of Legal Counsel (OLC), believes a sitting President cannot be prosecuted while in office for his or her crimes.

Now, 43 Republican Senators have sought to justify their "not guilty" votes in Donald J. Trump's second impeachment trial based on the specious assertion that an impeached President cannot be tried in the Senate for crimes committed while in office after he/she is no longer in office. That disingenuous notion is at odds with historical Senate precedent, the opinions of more than 170 legal scholars from both the Right and Left, and a simple reading of the plain text of the U.S. Constitution, not to mention the Senate's own decisive, bi-partisan, 56-44 majority vote at the start of this latest Senate Impeachment trial establishing that such a trial is indeed Constitutional.

Obviously most of the 43 "impartial" Republican jurors --- a number of whom share responsibility for the insurrection because they either directly perpetrated or failed to timely refute the Big "Stop the Steal" Lie --- latched onto the "no jurisdiction" defense in a desperate effort to erect plausible deniability for themselves. A fig leaf, if you will, designed to conceal their own duplicity and cowardice. Indeed, the remarks by Minority Leader Mitch McConnell (R-KY) delivered on the floor of the Senate immediately after he cast his "not guilty" vote reveal that the factual case presented by the House Managers was both clear and convincing.

For that reason, an historically huge, bi-partisan, 57-43 majority of the U.S. Senate found Trump guilty as charged of "Incitement of Insurrection". That there were enough misinformed, duplicitous or simply cowardly Republican Senators to prevent the two-thirds vote required to meet the incredibly high bar for conviction under Senate Impeachment rules is of little moment.

A political impeachment process is very different from a legal proceeding. There are, in fact, grave statutory crimes at the heart of Trump's most recent Article of Impeachment, including 18 U.S. Code § 373 - Solicitation to commit a crime of violence; 18 U.S. Code § 2383 - Rebellion or insurrection; and 18 U.S. Code § 2384 - Seditious conspiracy. With that in mind, the DOJ's failure or refusal to prosecute the former President could result in impunity with respect to an Office that is already considered the most powerful on earth.

Trump's attempted coup may have failed, but if we cloak the Office of the President with impunity, we invite a more skilled, future demagogue to do anything --- legal or illegal --- to retain power. To counter that more-serious-than-ever concern, the DOJ, under the leadership of Attorney General-designate Merrick Garland, must investigate and prosecute the former President for violations of applicable federal laws...

Measuring the risks of such an escalation by local officials...

Philadelphia's progressive District Attorney Larry Krasner told Democracy Now's Amy Goodman on Thursday that any federal officers who break state law within the City of Brotherly Love will be arrested and prosecuted. His comments come in response to President Trump's threat to expand the "totalitarian" assaults by his secret police from Portland, Oregon to other cities run by "liberal Democrats."

While Krasner and other local law enforcement agencies likely possess the authority to arrest law breaking federal agents, should they?

Krasner acknowledged that federal officers have a right to enter the city, and often do so for agreed upon joint law enforcement activities, but argued that no one, including the President, has a right to violate state law:

If people are going to come to Philadelphia and, in uniform, they're going to fracture the skulls of protesters with rubber bullets, they're going to jump out of rental vans and drag people into those vans without probable cause, they are committing crimes under the Pennsylvania statutes. These are Pennsylvania offenses over which the district attorney in Philly has jurisdiction over that area, and we can bring those charges.

The argument may be legally supportable, but the issue entails not only the question of whether local DAs and police have the authority to effectuate the arrest of miscreant federal agents but also of weighing the risk of potentially adverse consequences...
