Today on The BradCast: Rachel Maddow is an excellent broadcaster. But, boy, did she fall --- along with a bunch of other mainstream corporate media outlets on Friday --- for a wildly misleading spin on a new rule adopted last week by the Georgia State Board of Elections in advance of this November's elections. [Audio link to full show follows this summary.]

Before we get to an expert to help set the record straight on this matter today, to explain how virtually everyone from WaPo to New York Times to Atlanta Journal Constitution to, yes, Maddow got it wrong...a few quick news items of note...

  • It's possible, with Hurricane John about to slam into the West Coast of Mexico in the Pacific, and a different storm to be named Helene quickly spinning up in the Atlantic, that by week's end --- if John crosses the Mexican peninsula and enters the Gulf --- we could have two major hurricanes, both threatening landfall in the Gulf of Mexico at the same time. Climate change is wacky fun, in't?
  • Nearly 500 are confirmed killed and more than 1,000 injured near Lebanon's border with Israel on Monday, as Prime Minister Benjamin Netanyahu ordered the deadliest barrage on Hezbollah since the 2006 Israel-Hezbollah war. All of which is meant to extend the Israeli PM's time in office and out of jail on corruption charges filed well before his war on Gaza --- and even war crimes charges that are likely to come his way if and when he is ever finally removed from office. Hezbollah reportedly fired thousands of rockets in return at Israel.
  • Congressional leaders have reportedly reached a deal to keep the Government open after the end of this month, as the new fiscal year begins on October 1. The deal would continuing funding the Government until at least December 20. The agreement to prevent a government shutdown just weeks before the Presidential election --- when every member of the U.S. House and one-third of the U.S. Senate will be on the ballot --- comes as House Speaker Mike Johnson gave up on a measure Donald Trump was insisting on to make it a crime for non-citizens to vote (which is already unlawful under federal law). We'll see if the agreement is finalized by both chambers, and whether Republicans will then send us over yet another fiscal cliff this Christmas.
  • Newly released FBI data find violent crime in America, including murder, dropped precipitously from 2022 to 2023.
  • The U.S. economy continues to outpace the rest of the developed world and the stock market remains at all-time record levels under the Biden-Harris Administration, even as Donald Trump's failing media company, which trades on the NASDAQ as DJT, plummeted another 10% on Monday to a new all-time low since going public, as the race is on to meet my prediction that his loser of a company could become a penny stock by Election Day!
  • And, speaking of Trump grifts, it looks like Melania Trump, who has barely appeared on the campaign trail this season, was paid nearly $240,000 to speak at a political fundraiser at her own home in Mar-a-Lago last April. Who wrote the check to her remains unknown at this time.

And then, it's on to the story which has apparently freaked out Democrats and voting rights advocates since it was first misreported by pretty much everybody on Friday. That was the day that three Trump-supporting MAGA election denialists on the Georgia State Elections Board adopted a new rule requiring hand-counting at each precinct at the end of election night.

But the new rule requires only the hand-counting of the number of ballots cast at the precinct --- not the actual results on those ballots, as many have misreported --- before they are sealed up and sent to county headquarters.

Similar reconciliation of the number of ballots cast against the number of voters who signed in to the poll books or to the number of pages reported as scanned by the precinct tabulators, are carried out in many of other states without problem at the end of election night.

According to our guest today, an expert in Georgia's terrible touchscreen voting and scanning system, the process is likely to take anywhere from 15 minutes to a half an hour after the close of polls. But you wouldn't know that from the mainstream media coverage, with Democrats and Republican election officials alike in Georgia, screaming bloody murder that this new rule would lead to inaccurate tallies, delays in the count, and potentially add "months" to the time it will take to tally up results in the Peach State this year!

We're joined again today by the great MARILYN MARKS, longtime voting system expert and Executive Director of the Coalition for Good Governance. Her non-partisan organization is responsible for the federal lawsuit that ultimately banned Georgia's unverifiable, insecure touchscreen voting systems made by Diebold, only to see them replaced by Republican Sec. of State Brad Raffensperger with similarly unverifiable and insecure touchscreen systems made by Dominion. She is also the woman who discovered and exposed the MAGA breach, copy and distribution of statewide voting system software in Coffee County, GA that resulted in criminal charges against five people, including Sidney Powell, in the state's racketeering felony indictment against Donald Trump and many others.

As Marks explains today, the mainstream media outlets were misreporting on Friday's new hand-count of the number of ballots cast rule "out of hysteria for no good reason." She confirms that "it's simply a ballot counting rule that most states have," allowing them to "know how many ballots you have collected" and to confirm that number before ballots are moved anywhere. "That is a common-sense rule. It will take about 20 minutes at most to implement at most of the polling places in Georgia --- that's a rough estimate --- and it is a safeguard on a lot of different things."

"If there are major discrepancies," between the number of ballots and the number signed into the poll books, she says, "that's the time to figure it out, not after all the equipment and people get moved."

Many Democrats --- justifiably --- fear that, if Trump loses in the state again, some Republican officials on the election boards at both the state and county level are hoping to find ways to create havoc and chaos that could delay certification and ultimately place the actual election results in doubt, leading to challenges in Court or Congress on January 6th next year.

"We seem to be in such a hyper-partisan environment right now," says Marks, "that if we can throw some mud, true or not, on the other side, it's a way to build enthusiasm for our team." But that, she suggests, is short-sighted and unhelpful given the very REAL concerns about the election in Georgia (and elsewhere.)

We also discuss, some of the very good reasons that Democrats should be concerned about the reported results in Georgia this year, particularly given the software breach of statewide voting systems in Coffee County that Sec. Raffensperger has refused to mitigate in any way before the 2024 election, including with software patches distributed by Dominion.

Marks is concerned by the "chaos" that could be caused by someone exploiting the Coffee County caper. "It would be so easy for someone to shut down the system by just writing code that would shut down all the machines at 10am on Election Day," she offers by way of just one example. "There's nothing Georgia could do about it. They are not prepared." In response, I offer an even simpler and arguably more chilling scenario at how a tiny group of people can create utter havoc in the state by simply claiming that the state's touchscreen systems have misprinted their ballots --- whether that's true or not. There is no way, with the systems, to determine if they are telling the truth.

"The Party told you to reject the evidence of your eyes and ears. It was their final, most essential command," wrote George Orwell in his classic dystopian novel, 1984. It was a lesson that the Republican Party has learned well.

A recent poll pertaining to whose economic approach is preferred by American voters --- Donald Trump's or Kamala Harris's --- suggests that we remain in the midst of an Orwellian moment driven by GOP disinformation and the mainstream media's inability --- or disinterest --- in countering it. But, really, it's not particularly difficult if one tries.

As the business magazine Fortune described in early 2021, Donald Trump left office with "the worst jobs records since Herbert Hoover". Before that, in late 2020, a U.S. House Budget Committee report noted that Trump's mishandling of COVID had been an "epic failure" that "resulted in thousands of avoidable deaths and the most severe economic crisis in a generation...[S]mall businesses across the country [were] closing their doors for good, families [were] facing hunger and eviction, and millions of Americans [were] still having to make the impossible choice between their health and a paycheck."

The Biden administration, largely as the result of legislation passed before the MAGA Cult barely gerrymandered its way to a do-nothing House majority during the 2022 midterm, produced the fastest economic recovery and lowest inflation rate on the globe, as compared to all other advanced nations. Biden's economic record includes the "two strongest years of job growth in history", the creation of nearly 11 million new jobs, including "750,000 new manufacturing jobs", and, at 3.5%, "the lowest unemployment rate in 50 years." Where Trump never fulfilled his oft-repeated promise to create infrastructure projects, the Biden administration finally delivered, by making "infrastructure investments in all 50 States, D.C., territories and throughout Tribal Nations."

As we recently reported, during her swift-moving, upbeat campaign, Vice President Kamala Harris has advanced immensely popular economic policies. Yet, according to a report on a head-scratching 3-day Reuters/Ipsos poll conducted between Aug. 23 and Aug. 25, 2024, "former President Trump's approach to the economy and employment was preferred by 43% of registered voters, as compared to only 40%, who preferred Harris's approach."

The Orwellian misinformation leading to such a polling result can be attributed, in no small part, to an epic mainstream media failure to adequately cover the Biden administration's stellar economic accomplishments. More directly the answer can be found in a recent book authored by Steve Benen, longtime blogger and producer of MSNBC's Rachel Maddow Show, entitled Ministry of Truth: Democracy, Reality, and the Republicans' War on the Recent Past. In it, Benen notes that, for a significant percentage of the electorate, Trump's fictions have simply displaced reality. Many Americans have been duped by a brazen collective and organized effort by Trump, Congressional Republicans and the right-wing media echo chamber to rewrite recent history...

Guest: Election expert Marilyn Marks of Coalition for Good Governance; Also: A breakthrough in Israel/Gaza cease-fire negotiations?...

We've got a bit of a contrarian view on today's BradCast on a few recent, reportedly alarming election developments in the battleground state of Georgia. But that contrarian view happens to come from one of the nation's most knowledgeable experts when it comes to the way the Peach State runs their elections. [Audio link to full show follows this summary.]

First up, a few news headlines today, including a potential breakthrough in the Israel/Gaza war, with Israel reportedly agreeing to terms for a cease-fire and hostage release, according to U.S. Sec. of State Antony Blinken on Monday. There are few specifics available, and Hamas has yet to agree to the terms, so we will see if it actually comes to pass this time. I remain hopeful but dubious, for reasons discussed on today's show.

Then, you may have heard in recent days, about loud concerns from Democrats regarding new rules for this November's elections being promulgated by the Georgia State Board of Elections. The SEB is a five-person board with four appointed Republicans, three of whom are dyed-in-the-wool MAGA election deniers, and just one Democrat. The three MAGA members were recently called out by name by Donald Trump during one of his recent rallies in Atlanta, where he described the three as "on fire", "doing a great job", and "pit-bulls fighting for honesty, transparency and victory."

Of course, state elections boards are supposed to be largely neutral facilitators of state election law, as opposed to fighting for "victory" for any particular candidate or party. But, apparently, that's not the case in Georgia these days, where the SEB has adopted a number of new rules --- pushed by some notorious GOP "voter fraud" villains --- which critics on the left describe as a threat to the integrity of this year's elections in the state.

In short, the critique is that the new rules, allowing the state's 159 county boards of election to carry out a "reasonable inquiry" into allegations of fraud, error or miscount during the canvass before certifying results as "true and accurate" in their county this November, could end up delaying the ministerial and mandatory certification of results beyond the state and even federal deadlines. That would result in chaos that could take the decision of who won the election away from voters, and hand it to the far-right Republican-majority state legislature to determine, or to the Trump-packed courts, or even to a GOP-majority in the U.S. House to determine who will become the next President.

As Rolling Stone recently reported, there is reason to be concerned about MAGA election officials who may try to block certification --- in the event Trump loses again --- in a bunch of battleground states. Moreover, a bunch of otherwise respectable media outlets --- from The Guardian, to the New York Times to the Washington Post to even ProPublica and Rachel Maddow --- have all been misreporting in recent days that these new rules would allow election official to delay certification beyond Georgia's deadline for county certification of 5pm on the Monday following the election.

But my guest today says that is not only inaccurate, but that Democrats may ultimately be shooting themselves in the foot by putting up such a fight against the notion that a "reasonable inquiry" may be in order in a number of counties this year, given the opaque, unverifiable, insecure touchscreen voting systems forced on voters at the polling place by Republican Sec. of State Brad Raffensperger and the terrible way in which he runs elections in the state.

We're joined once again today by MARILYN MARKS, Executive Director of the non-profit Coalition for Good Governance (CGG). Her organization successfully sued the state of Georgia in federal court in 2019 to ban the state's 100% unverifiable touchscreen voting systems made by Diebold back, only to see Raffensperger replace them with newer 100% unverifiable and insecure touchscreen voting systems made by Dominion. (CGG's lawsuit continues, following a trial earlier this year to ban the new systems as well. They still await a verdict from the same federal judge who banned the older systems, and hope to seem them finally replaced with verifiable hand-marked paper ballots. Marks is also the one who first exposed Team Trump's unlawful breach, copy and distribution of Georgia's statewide voting system software in Coffee County, resulting in the indictments of five co-conspirators, including Sidney Powell, in Fulton County D.A. Fani Willis' sprawling conspiracy case against Donald Trump for his attempts to steal GA's 2020 election.)

Marks argues today that the SEB's new administrative rule language, allowing for "reasonable inquiry", cannot be used to block certification. She says the worries are unwarranted, as administrative rules cannot be used to overcome statutory deadlines for certification. (Law professor Derek Muller recently appeared to agree with her.) She concurs that Republicans are likely to try and bollocks up this year's election any way that they can --- in Georgia and elsewhere --- but that the SEB's new rules for "reasonable inquiry" about election results, and a similar one allowing county election officials to review "election-related documentation" before mandatory certification, are not quite as alarming as many Democrats are warning.

Marks tells me that many of the organizations and media outlets misreporting the rule and state law "are from out of state. They are assuming that Georgia is like a normal state, and that Georgia actually has good elections, that numbers reconcile, that ballots are counted well. The problem is that Georgia does not have a reasonable system for counting ballots." She argues that Dems may want to be careful about what they wish for when fighting against "reasonable inquiry" regarding results this year.

"What these rules actually do is help the Democrats," Marks argues. "Because they are going to need to do everything possible to protect --- if Harris wins, and you know it's going to be close --- if Harris wins, they'll have to do everything possible to protect that win. And without some of these transparency measures, they would have a hell of a fight."

If she's right, why then are so many respectable media outlets misreporting the actual rules changes? "I think it's a game of telephone, that somebody started this, saying, 'Oh, they adopted a rule to delay certification...' And then nobody is going back and looking at the actual words of the rules that were actually passed. The rules that were passed actually reinforce the deadlines." CGG makes that abundantly clear in a detailed fact-check newsletter sent to members on Sunday night.

And why, then, are so many of the GOP "voter fraud" fraudsters --- from Trump to Cleta Mitchell to Hans von Spakovsky --- pushing these measures so hard at the State Elections Board in Georgia?

"Yeah, it's worrisome who is promoting it," Marks concedes. "But the Democrats should be one-upping them, and promoting these very same concepts, but doing it with better legal language, with more precision. And doing do it to be certain that they, the Democrats, are not sitting outside with their noses pressed against the windowpane, not able to figure out what's going on with the vote-counting" in November. "Let's don't make it easier for the people who have already told us, 'We are going to try to upend the election if we don't like the results,'" she warns.

As CGG concluded their fact-check newsletter last night: "In Georgia, it should be clear that more election transparency, citizen oversight, accuracy, and accountability are essential—not less!" On today's BradCast: Tuesday's horrific election meltdown in Georgia didn't have to happen. We have been reporting and warning about exactly the disaster that occurred during the state's primary elections for well over a year on this program. [Audio link to show is posted below.]

Our guest today, MARILYN MARKS of the non-partisan, non-profit Coalition for Good Governance, has been filing both state and federal litigation for years in hopes of blocking the use of the new, unverifiable, touchscreen voting system implemented by GA's Republican Sec. of State Brad Raffensperger for this year's critical Presidential election. For years, she has been joining us on the show --- as she does again today --- to warn about the now-failed systems, month after month, as the Secretary moved forward with his Big Government mandate to force all counties in the state to switch to the new, dangerous, computerized voting systems.

One county (Athens-Clarke), whose County Board of Elections voted in March to use hand-marked paper ballots instead of Raffensperger's $104 million touchscreens, was threatened with fines and legal action by the Secretary if they refused to use his new systems made by Dominion Voting, a Canadian company whose lobbyist in Georgia was the Chief of Staff for the former Sec. of State, now Governor Brian Kemp. Raffensperger's strong-arming did the trick. The County used the disease-vector touchscreens on Tuesday along with all of the others.

The multiple failures of the electronic pollbook computers and computerized touchscreen Ballot Marking Devices and optical-scan computers used at every polling place in the state resulted in hours-long lines for voters throughout the day. Precincts in 20 counties were ordered by courts to remain open for hours past their scheduled closing time, with the last voter reportedly casting a vote at 12:37am on Wednesday.

The shameful story in Georgia is very similar to the disaster that occurred here in Los Angeles County during the March 3rd Super Tuesday election this year, after County officials failed to heed our warnings about their new $300 million touchscreen voting and electronic pollbook system that similarly crashed and burned on Election Day and resulted in the disenfranchisement of untold numbers of voters.

"Maybe it is the nature of the beast," Marks laments today. "It seems like in all matters of civil rights, things have to get to such an extreme that disaster has to happen, maybe multiple times, before society can pay attention." While there has been quite a bit of media coverage of Georgia's disaster today, where were they when their coverage might have made a difference before voters lost their right to vote?

As to who is to blame, Raffensperger still refuses to take any responsibility whatsoever. He blames county poll workers for being poorly trained to operate his needlessly complex systems. Like Donald Trump, Raffensperger takes no responsibility for what went wrong, despite being responsible for forcing all counties to use the new system. In fact, he told Georgia Public Radio yesterday, as voters were lined up for blocks and blocks (and blocks) in the blazing Georgia heat and humidity and thunderstorms to try and cast their vote, that it was "a good day for Georgia". He actually described the primary as "a great success."

Marks sees it differently, as does most of the world. "Ninety percent of this problem was caused by Raffensperger and the State Election Board, because they insisted that the state and the counties use the very complex, Rube Goldberg systems that nobody had been trained on, that hadn't been properly tested, shoving them in during pandemic conditions when they could have simply used the scanner and hand-marked paper ballots, and a paper pollbook, and had a simple election during pandemic conditions," she says. "The Secretary of State insisted on this roll-out. And gave the counties almost no choice. They could have defied him, and he would likely have fined them. He set them up for failure."

Marks, whose earlier lawsuit resulted in Georgia's previous touchscreen voting system being found unconstitutional in federal court, with the judge ordering that they could never be used against in the Peach State, has a continuing federal complaint against the new system. She tells me she expects to be back in court soon. "Before, the State was claiming that all of our claims were just speculative. Well, you know what? They're not speculative anymore. We have fabulous evidence --- horrendous evidence --- that this system does not create an accountable election."

A registered Republican, Marks says it is not too late for Georgia to change course before November, though the court may have to force them to do so. She also cautions about similar unnecessarily complex and already-failed new computer voting systems being used in other states --- including battleground states like Pennsylvania and North Carolina --- instead of verifiable hand-marked paper ballots for this year's critical Presidential election. Since the corporate media are unlikely to make the necessarily noise before the next election disaster --- when it might be preventable --- Marks suggests voters can take action on their own to demand hand-marked paper ballots and paper pollbooks (as backup to the e-pollbooks).

"Write a letter to your Secretary of State and State Election Board, and demand it," she advises. "Something that is likely to be more effective, even though it's harder --- it's going to take some effort for voters to actually protect their elections --- is call every member of your county's bipartisan election board. You can find them because they're local citizens. Say 'You've got authority, County Election Board! We want an auditable election! We want it done with hand-marked paper ballots, and we want audits afterward. Don't wait for the state to tell you that you have to audit. Don't wait for a judge to tell you that you have to have accountable ballots. Do it on your own. Do it now, while you have time to do it!'" She argues "these counties need the pressure from the citizens, and the citizens need to put pressure on the county boards as well as the local Democratic Party and local Republican Party."

As we've said many times, this democracy ain't gonna save itself!

Next --- speaking of things that take years of disaster before they are ever reformed --- Philonise Floyd, the younger brother of George Floyd, the unarmed African-American killed by cops in Minneapolis two weeks ago, testified to the U.S. House Judiciary Committee today. We share his emotional opening statement calling on Congress to help "stop the pain" at a hearing meant to discuss a Democratic initiative in Congress for sweeping change to the nation's policing policies. As you might imagine, they are meeting Republican resistance in both chambers of Congress.

Finally today, more change in the wake of Floyd's killing: NASCAR announced today that it will ban the Confederate Flag from its events, and Donald Trump ends up firmly on the wrong side of history --- again --- as he declared he would "not even consider" renaming U.S. military bases, such as Fort Benning and Fort Bragg, which are named for Confederate Army officers. That, despite their namesake's support of slavery and their treason in launching a war against the United States, resulting in hundreds of thousands of dead Americans. While Pentagon officials, including Trump's own Defense Secretary, have said they are open to the idea, and a host of retired generals --- including the commanders of some of the 10 bases named for Confederate traitors --- favor renaming the military posts, Trump insisted on Twitter today, without any apparent irony, that the bases are a part of "a history of Winning, Victory, and Freedom."

The President's woeful, deadly response in the aftermath of Hurricane Maria must be added to the list...

"This storm [Hurricane Maria] is no longer killing Americans," an exasperated Rachel Maddow exclaimed on MSNBC in mid-October. "The federal government's response to this storm is now killing Americans."

Setting aside Donald Trump's own self-assessment that his government's response was a "10" out of 10 --- that it couldn't have been better --- actual facts reveal otherwise.

Congress need not await the outcome of Special Counsel Robert Mueller's investigation into whether the Trump campaign conspired with Russia in the 2016 election, before determining if President Donald J. Trump should be impeached.

The phrase "high crimes" that appears in the Impeachment Clause of the U.S. Constitution, according to the Constitution Society, "refers to those punishable offenses that only apply to high persons, that is, to public officials, those who, because of their official status, are under special obligations that ordinary persons are not under, and which could not be meaningfully applied or justly punished if committed by ordinary persons."

It is an impeachment threshold that can be found in President Trump's reckless and callous disregard of his special obligation to protect the lives and safety of the 3.6 million American citizens who reside in the Commonwealth of Puerto Rico --- a U.S. territory that the President formally recognized, as early as September 21, as the site of a "major disaster"...

On today's BradCast: All too predictable voting problems in the state of Wisconsin and in St. Louis, MO today; MSNBC responds to our request for comment on why Bernie Sanders received short shrift on Rachel Maddow's show last night, on the eve of the crucial Badger State primary; And we debunk wingnut nonsense concerning the minimum wage as $15/hour victories come to California, New York and elsewhere. [Link to audio for complete show below.]

First, while voters wait on line to try and obtain new Photo IDs so they can vote at all today under the GOP's new voting restrictions in WI, many St. Louis County voters showed up for local elections in MO, only to find no ballots at all to vote on. Then, we explain what happened last night on Maddow's show to suggest that Hillary Clinton was polling ahead of Sanders in WI by 6 points, when the vast majority of pre-election polls in the state suggest the exact opposite. MSNBC responds to our query late today, to tell us that the issue was due to a technical error later corrected for the Midnight re-run and online versions of her show. Full details on that in today's program.

Then, in the wake of bills signed into law this week by the Governors of both NY and CA to raise the minimum wage to $15, we speak to financial journalist David Dayen about the Right's feigned concern about job loss (but only when it comes to raising the Minimum Wage), as well as the real concerns about the increase, and activists have had an extraordinary impact on the entire conversation about the decades long wealth gap between the rich and everyone else in the U.S.

Dayen explains why the new law, in CA alone, as he also reported at Salon last week, is a very big deal: "1 in every 8 workers in America is a Californian. Under this proposal, over 33% of them are going to get a raise at some point along the way between now and 2022. And thereafter, because after 2022, the minimum wage gets tied to inflation, so it keeps going up."

"It's really a testament to the power of activism. Before the 'Fight For 15' inaugurated in 2012, nobody would have believed that you could get a $15 an hour living wage, minimum, in a state as big as California. So, really, hats off to the #FightFor15 workers, who really pushed this," he says, offering kudos at the same time to both the Occupy movement and the Sanders campaign. "All of this is rumbling forward and moving Democrats who control states like California and New York into places that they were uncomfortable to go previously. And that is a testament to how this issue of inequality has become the functional, primary issue in American politics today."

Dayen, author of the upcoming book, Chain of Title: How Three Ordinary Americans Uncovered Wall Street's Great Foreclosure Fraud, also responds to the "hand-wringing on the part of economists and business leaders," when it comes to potential job loss in the wake of raised wages.

"We see all kinds of experiments" with the economy, he argues. "We see workers used as guinea pigs all the time by businesses" in all matter of schemes that may benefit those businesses, but not their workers. "These same economists are so worried about the fate of workers with this experiment with the minimum wage have never said a darn thing about all of these experiments that hurt workers --- that we knew were going to hurt workers at the time --- because it was literally about cutting their wages and getting rid of their benefits and putting them in hazardous workplaces. Spare me this rhetoric that you care about workers when you've sat by idly over 40 years as work has become more and more and more devalued."

But will raising the minimum wage, in fact, cost jobs? And, if so, does it even matter? Tune in for his answers to that and much more in a fascinating conversation on today's show --- one which you won't hear, for some reason, on Fox "News" or CNN...

Today on The BradCast, while voters head to the polls again in several states, and as the media continue to misreport the race, at least on the Democratic side, we mark this week's 5-year anniversary since Japan's triple disasters of earthquake, tsunami and nuclear meltdown struck in March of 2011. [Link to the complete show's audio is below.]

I'm joined once again on today's show by Voice of America's Steven L. Herman from Bangkok. We spoke to Herman originally on the program five years ago, just after the initial disaster(s), when he was one of the first journalists to visit the Fukushima Daichi nuclear plant and the 50-mile "exclusion zone" around it, following the meltdown or near-meltdown of 4 of its 6 reactors and the mass evacuation of hundreds of thousands of nearby residents --- back when, as Japan's former Prime Minister now admits, the nation was just a "paper-thin margin" away from a total catastrophe.

"We were on the ground just 24 hours after the quake struck in Fukushima," Herman recalls today. "We got the last flight into Fukushima Prefecture and when we were boarding that flight, they were contemplating canceling [it] because of concerns about a possible meltdown of the nuclear power plant."

Herman, who was then VOA News' Northeast Asia bureau chief and is now in charge of its Bangkok bureau, recently visited Fukushima again and reports today on the continuing battle to control unstable nuclear material at the plant, the lack of a long term plan to dispose of toxic water and soil that continues to pile up (at as many as 115,000 makeshift locations around the Fukushima Prefecture!), as well as on the plight of many residents who lived near the plant and are still unable to return to their homes all of these years later, due to radiation levels.

"You have this cleanup effort that is going to last decades and cost hundreds of billions of dollars," Herman tells me. "Forty years is the official estimate, costs around $250 billion. But you talk to a lot of people who are experts in the field and they say that is a very optimistic figure, that it is going to take much longer and cost much more --- and the burden of this is being borne by the Japanese taxpayers."

"Nine million cubic meters of radioactive soil are being stored in these black bags throughout the prefecture. But there is a continuing buildup of more stored water. And one consultant I talked to, an American and former US diplomat, said Tokyo Electric Power [TEPCO] can't decide what to do with all of it, and they refuse to let any foreign experienced program management companies come and help them out with this."

There's far more important information in my detailed interview with Herman than I can possibly give justice to by sharing here in a short description, concerning the "paralysis" that both Japan and TEPCO seem to be facing in dealing with the crisis, the strained if co-dependent relationship between the two entities, the recent indictments of several top officials in charge of the plant at the time, the human toll of the cleanup both now and in the hours after the initial disaster, the restart of several other nuclear plants in the country, and the continuing concerns for the stability of the precariously crippled plant "if there were to be another huge earthquake, or a tsunami were to strike the facility again --- then you're talking about a situation of total chaos."

I think it's a must-listen interview, frankly. And it was a pleasure, if a chilling and disturbing one, to catch up with Herman, who is just a tremendous reporter, all of these years later. Please check it out in full below.

First on today's BradCast: Why Rush Limbaugh believes NASA has faked their discovery of flowing liquid water on Mars. Then, why MSNBC completely ignored Bernie Sanders on last night's Rachel Maddow Show.

Then, onto our interview with Virginia Martin and Jason Nastke, the Democratic and Republican Election Commissioners (respectively) of Columbia County, NY, where they refuse to certify results until every hand-marked paper ballot is publicly counted by hand after each election.

The two Commissioners joined me to respond to a recent Brennan Center study [PDF] warning that the nation's voting computers and tabulators are aging and failing and should be replaced as soon as possible with new computer systems. I agree with the first part of their findings, not so much with the second part, both of which we discussed in a recent BradCast with Lawrence Norden, co-author of that well-reported study.

Martin and Nastke don't seem to agree either, finding that hand-marked paper ballots, publicly hand-counted by human beings, remain the best way to assure that every voter's intent is accurately and transparently tallied.

"In reality, computing is maybe 50 years old," the Republican Nastke tells me on today's program. "We use paper ballots and paper is hundreds, if not thousands of years old. Historical documents continue to exist to this day. So, what we know is that when a voter votes on a paper ballot that there is an absolute way for the voter's intent to be determined, and properly counted."

"When New York State and the federal government mandated that we use optical scans instead, I started looking at those systems, and my question was, how do I know that that result is the right result?," says the Democrat Martin. "I'm not going to be able to see how the voting machines added up the votes. So I'm not going to know and I'm going to have to certify these results and I feel very uncomfortable doing that. So how can I know that the machine results are correct? Well, we have the paper ballots, let's count them."

"It's not a Republican or a Democrat issue," Nastke insists. "The issue is one of what's right. And what is right is that every vote is counted." Martin adds: "The fact is that I and Jason are both very, very confident in the results that we certify. And I must say that I think the voters in our county are similarly confident. The candidates whose votes --- for or against --- we are counting, are similarly confident. If we've got a candidate that lost by a few votes, and they've been here and they've watched the process, they are very confident that they did truly lose."

"It works very well because it's so bipartisan. For every Democrat who is doing something, a Republican is watching like a hawk," she says. "And it's very, very accurate. People are thrilled to see how the process works, to understand how it works, and to actually be a part of it and see what the result is."

Martin recently responded in comments here at The BRAD BLOG following my interview with Norden. She expands on some of those thoughts today, as both Commissioners explain why they --- and their respective political parties in the county --- have been able to buck national trends to agree on hand-counting ballots, rather than using unverifiable computer systems.

I ask them, among many other questions, why other counties in New York state have yet to adopt their system?; Whether they have found errors from the optical-scan computers which initially tally ballots at each precinct (as required by the state) before the hand-count takes place?; Whether they believe humans or computers are able to count ballots more accurately? (Norden had asserted that computers were more accurate during our conversation last week); Why they don't hand-count at the precinct, rather than back at County headquarters?; Could their system work in a much larger county or is hand-counting only for small jurisdictions?; And what happens in those instances when party observers don't agree on voter intent or a voter has left their intent unclear?

We first reported on Columbia County turning to 100% hand-counts back in 2012, but this is the first time either Martin or Nastke has joined me on the show! So it's great to have them! Here's a recent article on Columbia "becoming known for hand-counting votes" from one of their local papers. Look close and you'll see some films and books I've contributed to sitting in front of Martin in the paper's photo! :-)

I'm on the road this week, but was able to carve out a minute or two upon learning that some in our trusted news media seem to have lied about the Iraq War! Can you believe it?!

As Jon Stewart declared on The Daily Show last night: "The media is on it! Now this may seem like overkill. But for me, no, it's not overkill. Because I am happy. Finally, someone is being held to account for misleading America about the Iraq War!"...

By the way, when MSNBC's Rachel Maddow produced her excellent Hubris: Selling the Iraq War documentary in 2013, to mark the tenth anniversary of our invasion, she cited the blatant and knowing lies that resulted in the war. While congratulating her on the fine work, we also took the time to document just some of the many lies told and/or facilitated by NBC and MSNBC themselves which helped lead us into that disaster in the first place...

It's become a bit of a cliche in the Obama era. Every year, when the President delivers his State of the Union address, someone in the Republican Congressional caucus makes an absolute jackass of him/herself. Let's call it the Rep. Joe Wilson "YOU LIE!" syndrome.

They just can't seem to help themselves in those grand moments in the bright lights during which they are finally forced to be in the same room with the actual reality of the person they've spent the bulk of the year deluding themselves --- with no small amount of help from Fox "News" and even the so-called legitimate news networks --- into believing to be an incompetent, dictatorial, fascistic, imperial-socialist evil genius. (I'll leave it to you to figure out how he can be all those things at once.)

We thought we had last night's winner of the Republican SOTU Jackass of the Year Award when Texas Rep. Randy Weber tweeted, before the speech even began...

Setting aside the impressive typos and incoherence, Rep. Weber's idiocy was clear enough. But, as it turns out, he was an amateur last night. There were at least two other elected officials in the GOP caucus vying for last night's (dis)honor, with one even willing to threaten a violent offense against a reporter on camera. But, in truth, it was the third who really represents the gravest threat to our democracy...

Some very good investigative broadcast journalism from MSNBC's Rachel Maddow on Thursday night.

On Thursday morning, New Jersey Governor and, until now, Republican Presidential favorite, Chris Christie gave a two-hour press conference (full transcript here) in which he expressed being "stunned" and "blindsided" Wednesday morning by the blockbuster revelations published that day by Shawn Boburg of the Bergen Record.

The paper's report included email and text messages [PDF] between Christie's Deputy Chief of Staff Bridget Anne Kelly and a number of other top appointees conspiring to shut down lanes of the George Washington Bridge leading out of Fort Lee, NJ on the first day of school last September. The messages reveal the staffers appearing to enjoying the pain the shut down was causing the town, joking about the inconvenience to the local children of voters of Christie's gubernatorial opponent in last November's election, and otherwise agreeing not to respond to queries from town officials about the closures.

During the presser, Christie announced he had fired Kelly before it began. He said he had done so because she had previously assured him she knew nothing about the traffic closure that went on for four days in Fort Lee, turning the town into a parking lot and delaying emergency first-responders, among other problems it caused. "I've terminated her employment because she lied to me," he explained on Thursday.

What struck me as odd about his answer to questions about his staff's response to the firing was that he said he hadn't spoken with Kelly since the revelations came out in the paper on Wednesday morning, before she was then fired on Thursday.

"I'm wondering what your staff said to you about why they lied to you. Why would they do that? What was their explanation?," the reporter asked.

"I have --- I have not had any conversation with Bridget Kelly since the email came out," he answered. "And so she was not given the opportunity to explain to me why she lied because it was so obvious that she had. And I'm, quite frankly, not interested in the explanation at the moment."

I was watching a segment last night on Rachel Maddow's show with Desi Doyen, concerning the recent warnings issued to Americans and the evacuations at dozens of U.S. embassies and consulates in the Middle East and Northern Africa. The actions were taken due, we are told, to "chatter" detected by intelligence services of the possibility of attacks by al-Qaeda (and/or "associated forces") to American interests in the region.

Maddow framed the actions being taken by the U.S. government in the context of the infamous August 6, 2001 Presidential Daily Briefing memo --- "Bin Laden Determined to Strike in US" --- ignored by George W. Bush just one month before the 9/11 attacks. Yesterday was the 12th anniversary of that memo.

In her conversation with NBC foreign affairs correspondent Andrea Mitchell, Maddow discussed the memory of that infamously ignored warning, and what effect it may have on the way the U.S. government now reacts to such detected threats. "In a post-9/11 world", the argument goes, President Obama and all future Presidents are likely to be very conscious of not underestimating such memos and "chatter," in the event that an attack does come about, for which they could later be held accountable for having ignored the "clear signs." (Not that George W. Bush or his administration was ever held accountable for such things, but that's a different matter.)

While watching the conversation about the dozens of closed diplomatic posts, I said to Desi, "I bet they're wildly over-reacting. It's not about post-9/11. It's about post-Benghazi."

In either an abundance or over-abundance of caution, U.S. embassies and consulates are being warned and shuttered and Americans are being air-lifted out of countries. It's not the memory of 9/11, at this point, that the government seems to be reacting to. It's as much the Republican reaction and/or over-reaction and/or political bludgeon made of the deaths of four U.S. personnel at our diplomatic outpost in Libya last year that seems to be leading to this reaction and/or over-reaction by the government.

Indeed, moments after I had uttered that thought to Desi, Mitchell said to Maddow: "I think, Rachel, that this is not just post-9/11, this is post-Benghazi."

The way our government now reacts to such events is not necessarily based on common sense, it seems to be as much based on fear. Not necessarily fear of being attacked, but fear of missing some important warning or another and then being held politically accountable for it later.

Since so much of this is kept secret --- except for stuff classified as "secret" and "top secret" that is routinely leaked by government officials who, unlike whistleblowers, are almost never held accountable for such leaks of classified information --- we are largely left to simply "trust" that the government is accurately portraying the threat, whether they are or not, and whether they are simply over-reacting out of caution and/or political ass-covering.

All of this, then, adds an interesting light to a curious story reported this week by Al-Jazeera English's Jason Leopold (formerly of Truthout) highlighting the government's seemingly bizarre claims that they have concerns that al-Qaeda may "attack the detention facilities at Guantanamo" or otherwise, somehow, "undermine security at the facility" if too much is known about what goes on there.

But that's not the most interesting aspect of the story...
